San José, a las nueve horas veinte minutos del veintidos de marzo de dos mil veinticuatro .\n\nRecurso de amparo presentado por ADRIÁN MAURICIO VEGA AGUILAR, cédula de identidad 0110220518, a favor de MARCELA TERESA GRANIER CARDONA, cédula de identidad 0800790993, contra la MUNICIPALIDAD DE MORA.\n\nResultando:\n\n1.- Por escrito presentado en la Secretaría de esta Sala a las siete horas trece minutos del veinte de marzo del dos mil veinticuatro ALFONSO JIMÉNEZ CASCANTE, en su  calidad de ALCALDE MUNICIPAL solicita prórroga de plazo para cumplir la sentencia número 2024005628 de las nueve horas veinte minutos del uno de marzo de dos mil veinticuatro. Manifiesta lo siguiente:\n\n“Este Gobierno Local ha realizado una serie de gestiones que son requeridas de manera previa para poder solventar la problemática referente al árbol de mango que se ubica 600 metros oeste y 100 sur de la clínica de Cuidad Colon, por lo que se activó la contratación N° 2024LD-000010-0002200001, en donde se confeccionó la solicitud de contratación para proceder con el derribo y poda de árboles en atención de emergencias que se presenten dentro del cantón de Mora. Veamos lo que se refleja en el sistema de compras públicas (SICOP):\n\nNótese que como bien se menciona, el proceso de contratación ya se encuentra activo, sin embargo, este municipio se encuentra en el proceso de revisión de ofertas y como bien se conoce se debe culminar con todas las etapas procesales a nivel de contratación administrativa, con la finalidad de tener un resultado positivo y gestionar el trámite que nos ocupa. TERCERO: SOBRE GESTIONES POR IMPLEMENTAR: Actualmente la contratación N° 2024LD-000010-0002200001 “DERRIBO Y PODA DE ARBOLES- ATENCIÓN DE EMERGENCIAS”, se encuentra en fase de revisión de ofertas, esto dado que en fecha del 08 de marzo del año en curso se debió solicitar una subsanación a los oferentes de la misma, para esto puede verse.\n\nTales subsanaciones contaron con plazo para ser atendidas por los oferentes hasta el día 12 de marzo, por lo que actualmente la Proveeduría Municipal así como la unidad solicitante, se encuentra realizando el estudio de tales subsanaciones, para determinar de esta manera si fueron corregidos los elementos pertinentes y por ende poder continuar a la fase de adjudicación. La cual una vez se encuentre en firme, este Gobierno Local podrá emitir la orden de inicio y por ende, realizar la corte del árbol que nos ocupa dentro del presente recurso de amparo” (ver registro electrónico).\n\n2.- En los procedimientos seguidos se han observado las prescripciones legales.\n\n Redacta el Magistrado Solano Aguilar; y,\n\nConsiderando:\n\nI.- SOBRE LA SOLICITUD DE PRÓRROGA:  En el presente asunto, las autoridades recurridas piden se conceda una prórroga del plazo para dar cumplimiento a lo ordenado en la sentencia N° 2024005628 de las nueve horas veinte minutos del uno de marzo de dos mil veinticuatro; en que esta Sala dispuso:\n\n“Se declara con lugar el recurso. Se ordena a ALFONSO JIMÉNEZ CASCANTE en su calidad de Alcalde Municipal, CINDY MONGE SOTO, en su calidad de Directora Jurídica y GRETTEL AGÜERO ALFARO en calidad de Coordinadora de la Unidad de Gestión Ambiental todos de la Municipalidad de Mora o a quienes en su lugar ocupen los cargos, que coordinen lo necesario, tomen las medidas necesarias y giren las órdenes que correspondan dentro del ámbito de sus competencias, a fin de que, en el plazo máximo de QUINCE DÍAS, contado a partir de la notificación de esta sentencia, se resuelva de forma definitiva la problemática denunciada por la recurrente referente al árbol de mango que se ubica 600 metros Oeste y 100 Sur la clínica de Ciudad Colón. Lo anterior se dicta con el apercibimiento de que con base en lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quienes recibieren una orden que deban cumplir o hacer cumplir, dictada en un recurso de amparo y que no la cumplieren o no la hicieren cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Mora al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El Magistrado Castillo Víquez pone nota.  Notifíquese.”\n\n \n\nEl gestionante expone las razones por las que no se ha podido dar cumplimiento a lo resuelto por esta Sala, en el plazo de 15 días concedido y describe además los avances para proceder con la corta del árbol.  Así las cosas,  tomando en cuenta la justificación dada y el tiempo transcurrido desde que se notificó la sentencia;  se da la prórroga solicitada hasta el 20 de mayo de 2024 para su efectivo cumplimiento, como en efecto se dispone.\n\nPor tanto:\n\nSe amplía el plazo conferido en la sentencia N° 2024005628 de las nueve horas veinte minutos del uno de marzo de dos mil veinticuatro hasta el 24 de mayo de 2024 para cumplir lo ahí ordenado, bajo los mismos apercibimientos. San José, at nine hours twenty minutes on the twenty-second of March, two thousand twenty-four.\n\nAmparo action filed by ADRIÁN MAURICIO VEGA AGUILAR, identification card number 0110220518, on behalf of MARCELA TERESA GRANIER CARDONA, identification card number 0800790993, against the MUNICIPALITY OF MORA.\n\nWhereas:\n\n1.- Through a writing filed with the Secretariat of this Chamber at seven hours thirteen minutes on the twentieth of March, two thousand twenty-four, ALFONSO JIMÉNEZ CASCANTE, in his capacity as MUNICIPAL MAYOR, requests an extension of time to comply with judgment number 2024005628 of nine hours twenty minutes on the first of March, two thousand twenty-four. He states the following:\n\n\"This Local Government has carried out a series of steps that are required beforehand in order to resolve the problem concerning the mango tree located 600 meters west and 100 south of the Ciudad Colón clinic, for which procurement No. 2024LD-000010-0002200001 was activated, where the procurement request was prepared to proceed with the felling and pruning of trees in response to emergencies that arise within the canton of Mora. Let us see what is reflected in the public procurement system (SICOP):\n\nNote that as is well mentioned, the procurement process is already active; however, this municipality is in the process of reviewing offers and, as is well known, all procedural stages at the administrative procurement level must be completed, in order to have a positive result and manage the proceeding at hand. THIRD: ON STEPS TO BE IMPLEMENTED: Currently, procurement No. 2024LD-000010-0002200001 'TREE FELLING AND PRUNING - EMERGENCY RESPONSE,' is in the offer review phase, this given that on March 8 of the current year, a correction had to be requested from the bidders thereof, for this it can be seen.\n\nSuch corrections had a deadline to be addressed by the bidders until March 12, so currently the Municipal Procurement Department as well as the requesting unit are conducting the study of such corrections, in order to determine in this manner whether the pertinent elements were corrected and, therefore, to be able to continue to the award phase. Once this is final, this Local Government may issue the start order and, therefore, carry out the cutting of the tree at issue in this amparo action\" (see electronic record).\n\n2.- The legal requirements have been observed in the proceedings followed.\n\nDrafted by Judge Solano Aguilar; and,\n\nConsidering:\n\nI.- REGARDING THE REQUEST FOR EXTENSION: In the present matter, the respondent authorities request that an extension of time be granted to comply with what was ordered in judgment No. 2024005628 of nine hours twenty minutes on the first of March, two thousand twenty-four; in which this Chamber ordered:\n\n\"The amparo action is granted. ALFONSO JIMÉNEZ CASCANTE, in his capacity as Municipal Mayor, CINDY MONGE SOTO, in her capacity as Legal Director, and GRETTEL AGÜERO ALFARO, in her capacity as Coordinator of the Environmental Management Unit, all of the Municipality of Mora, or whomever occupies their positions in their stead, are ordered to coordinate whatever is necessary, take the necessary measures, and issue the corresponding orders within the scope of their powers, so that, within a maximum period of FIFTEEN DAYS, counted from the notification of this judgment, the problem reported by the petitioner concerning the mango tree located 600 meters West and 100 South of the Ciudad Colón clinic is definitively resolved. The foregoing is issued with the warning that, based on the provisions of Article 71 of the Law of Constitutional Jurisdiction, a prison sentence of three months to two years, or a fine of twenty to sixty days, shall be imposed on those who receive an order that they must comply with or enforce, issued in an amparo action, and fail to comply with it or fail to enforce it, provided the offense is not more severely punished. The Municipality of Mora is ordered to pay the costs, damages, and losses caused by the acts that serve as the basis for this declaration, which shall be liquidated in the execution of judgment of the contentious-administrative jurisdiction. Notify.\"\n\nThe petitioner sets forth the reasons why it has not been possible to comply with what was resolved by this Chamber within the 15-day period granted and also describes the progress made to proceed with the cutting of the tree. This being the case, taking into account the justification given and the time elapsed since the judgment was notified, the requested extension is granted until May 20, 2024, for its effective compliance, as is hereby ordered.\n\nTherefore:\n\nThe period granted in judgment No. 2024005628 of nine hours twenty minutes on the first of March, two thousand twenty-four is extended until May 24, 2024, to comply with what was ordered therein, under the same warnings.
