Se establece al Fondo Nacional de Financiamiento Forestal la cantidad de\nhectáreas a financiar por actividad en el Programa de Pago por Servicios\nAmbientales y el monto a pagar con base en los recursos asignados.\n\nRESULTANDO\n\nÚNICO.-Que para\nel ejercicio 2024 el Presupuesto Nacional dispone un total de trece mil cuatro\ncientos noventa y seis millones seis cientos veintitrés mil cincuenta y tres\ncolones con 00/100 (¢13.496.623.053,00) para el Programa de Pago por Servicios\nAmbientales, los cuales serán utilizados para el pago de los compromisos de\ncontratos PSA de años anteriores y la incorporación de nuevas hectáreas para el\naño 2024.\n\nCONSIDERANDO\n\n1°-Que el\nartículo 38 del Reglamento a la Ley Forestal N° 7575, Decreto Ejecutivo N°\n25721-MINAE, del 17 de octubre de 1996 y sus reformas, dispone que el Ministro\nde Ambiente y Energía como Jerarca del Ministerio de Ambiente y Energía, en\nfunciones de la Administración Forestal del Estado, emitirá anualmente mediante\nResolución Ministerial, las actividades a financiar en el Programa de Pago por\nServicios Ambientales y los montos a pagar con base en los recursos asignados\nen el Presupuesto Nacional para el ejercicio del año fiscal 2024.\n\n2°-Que bajo\neste principio, los instrumentos financieros deben orientarse a apoyar los\npilares del Plan Nacional de Desarrollo y de Inversión Pública 2023-2026 (Rogelio\nFernández Güell) considerando los objetivos de la creación del Fondo Nacional\nde Financiamiento Forestal según la citada Ley Forestal, sin dejar de lado los\ncriterios de orden técnico establecidos.\n\n3°-Que el Plan\nNacional de Desarrollo citado, considera como una de las metas nacionales el\nmantener bajo el Programa de Pago por Servicios Ambientales, al menos\ndoscientas cincuenta mil hectáreas (250.000 has), en sus diferentes actividades.\n\n4°-Que, el\nMinisterio de Ambiente y Energía ha emitido los Principios Rectores del Sector\nForestal Productivo, mediante el Decreto Ejecutivo N°41772-MINAE, así como los\nlineamientos a considerar en las gestiones institucionales para la reactivación\ny promoción de la reforestación en el país.\n\n5º-Que en\nvirtud de los esfuerzos para lograr el reconocimiento internacional del aporte\nde los bosques en la reducción de emisiones de gases de efecto invernadero, el\nGobierno de Costa Rica, suscribe un ERPA (contrato de compra venta de reducción\nde emisiones) con el Banco Internacional de Reconstrucción y Fomento, el 9 de\ndiciembre del año 2020, el cual en su plan de distribución de beneficios se\ndispuso la creación de un mecanismo de pago por servicios ambientales\nespecializado en la reducción de emisiones, el cual posee condiciones\ndiferenciadas, este instrumento es el CREF. (Contrato de Reducción de Emisiones\nForestales).\n\nPOR TANTO:\n\nEL MINISTRO DE\nAMBIENTE Y ENERGÍA\n\nRESUELVE\n\nArtículo\n1°-Establecer el límite de gasto al Fondo Nacional de Financiamiento Forestal,\npara los contratos a formalizar en el año 2024, las actividades a financiar y\nlos montos de pago por actividad.\n\n1. Esta actividad reconoce\nprincipalmente el servicio ambiental de reducción de emisiones de gases de\nefecto invernadero, pero se puede complementar con los reconocimientos de otros\nservicios ambientales cuando haya recursos para tal fin, en adelante, contratos\nCREF.\n\nEl Fondo\nNacional de Financiamiento Forestal, podrá variar la distribución establecida\nen el cuadro anterior, de acuerdo con la disponibilidad del presupuesto\naprobado para el Programa de Pago por Servicios Ambientales.\n\nDe disponer de\nuna mayor asignación de recursos, según el artículo 5 de la Ley de\nSimplificación y Eficiencia Tributarias N° 8114 publicada en La Gaceta N° 131, del\ndía 9 de julio de 2001 y otros recursos financieros que capte el Fonafifo para el\nPago por Servicios Ambientales, se distribuirán según el criterio de los financiadores\ny de las autoridades del Ministerio o autoridades correspondientes.\n\nEn todo caso,\nlos recursos utilizados para estos fines, deberán ser incorporados en el\npresupuesto institucional o al Fideicomiso 544 Fonafifo/BNCR.\n\n2.De los montos\nde pago por actividad y otras condiciones:\n\n2.1. Actividad\nde Reforestación: Las condiciones que regirán para el trámite de solicitudes,\npara el reconocimiento de los servicios ambientales en la actividad de\nReforestación, son las siguientes:\n\na) El monto a\npagar para las especies de rápido crecimiento referidas a: Gmelina arborea,\nAcacia mangium, Vochysia guatemalensis y Vochysia hondurensis, será de\nsetecientos ochenta y tres mil seis cientos cuarenta y cuatro colones con\n00/100 (¢783,644.00) por hectárea, desembolsados durante un período de cinco\naños. Los pagos serán distribuidos de la siguiente forma:\n50% el primer año, 20% el segundo año, 15% el tercer año, 10% el cuarto año y\n5% el quinto año.\n\nb) El monto a\npagar para las especies de mediano crecimiento referidas a: Tectona grandis,\nPinus sp, Cordia alliodora, Vochysia ferruginea, Eucalyptus sp y Cedrela\nodorata, será de ochocientos ochenta y tres mil quinientos cuarenta setenta y\nseis colones con 00/100 (¢883,576.00) por hectárea, desembolsados durante un\nperíodo de cinco años. Los pagos serán distribuidos de la siguiente forma:\n50% el primer año, 20% el segundo año, 15% el tercer año, 10% el cuarto año y\n5% el quinto año.\n\nc) El monto a\npagar para especies nativas contenidas en los Decretos Ejecutivos N°\n25663-MINAE del 8 de octubre de 1996 y N° 25700- MINAE del 15 de noviembre de\n1996, será de un millón trescientos veinticinco mil trescientos sesenta y seis colones\ncon 00/100 (¢1,325,366.00) por hectárea, desembolsados durante un período de cinco\naños. Los pagos serán distribuidos de la siguiente forma:\n50% el primer año, 20% el segundo año, 15% el tercer año, 10% el cuarto año y\n5% el quinto año.\n\nd) El monto a\npagar para las Plantaciones Forestales con Turnos de Rotación Reducidos (PFTRR)\npara especies de rápido crecimiento para embalaje, será de cuatrocientos\nveintiún mil seiscientos veintiocho colones con 00/100 (¢421,628) por hectárea,\nLos pagos serán distribuidos de la siguiente forma: 50% el primer año, 25% el\nsegundo año y 25% el cuarto año.\n\ne) Las\ncondiciones que regirán para el trámite de solicitudes, para el reconocimiento\nde los servicios ambientales en la actividad de Reforestación proyecto piloto PSA\n+ Crédito, son las siguientes:\n\ni. El monto a\npagar para el proyecto piloto PSA + Crédito con la especie de rápido\ncrecimiento referida a: Gmelina arborea, será de cuatrocientos veintiún mil\nseiscientos veintiocho colones con 00/100 (¢421,628) por hectárea,\ndesembolsados en 6 tractos de acuerdo a la siguiente distribución primer año\n11%, segundo año 16%, tercer año 17%, cuarto año 18%, quinto año 19% y el sexto\naño el 19% restante que se girara, siempre y cuando el beneficiario haya\nconsentido mediante documento formal.\n\nf) Plantaciones\nForestales establecidas con recursos propios para pago por resultados. Los\nmontos a pagar serán los establecidos, en los incisos a, b, y c anteriores. Los\nmontos serán distribuidos de la siguiente forma: con la firma del contrato un\n50%, doce, veinticuatro, treinta y seis y cuarenta y ocho meses después de\ndicha firma un 20%, 15%, 10% y 5% respectivamente. Los contratos tendrán la\nvigencia prevista en el artículo 2 incisos a y b de esta resolución, pero se\nreconocerán los años de existencias de estas plantaciones; hasta un máximo de 3\naños de establecidas.\n\ng) Las personas\nfísicas o jurídicas que deseen reforestar en áreas mayores al tope establecido\nen el Reglamento a la Ley Forestal, Decreto N° 25721- MINAE y sus Reformas,\npodrán aplicar en un esquema especial de financiamiento, pudiendo duplicar el\ntope de 750 hectáreas, siempre y cuando los recursos disponibles no sean\nutilizados por los pequeños productores. Valores mínimos\nde referencia para el diámetro (DAP) y la altura total (Htot), esperada por año\npara las Plantaciones Forestales con Turnos de Rotación Reducidos (PFTRR), para\nla especie Gmelina arborea y otras especies del grupo de rápido crecimiento.\n\n \n\n| Edad (años) | VRM DAP (cm) | VRM Htot (m) |\n| --- | --- | --- |\n| 1 | - | 3,29 |\n| 2 | 8,88 | 6,65 |\n| 3 | 13,35 | 9,73 |\n| 4 | 14,69 | 10,69 |\n| 5 | 17,55 | 12,48 |\n| 6 | 19,53 | 13,80 |\n\nPara el cálculo\ndel volumen total se debe usar la siguiente ecuación: Vtot = ?/4 * (DAP)² *\nHtot * Ff * N\n\nDonde:\n\nVtot = Volumen\ntotal por hectárea expresado en metros cúbicos.\n\n? = (pi) es la\nrelación entre la longitud de una circunferencia y su diámetro en geometría\neuclidiana.\n\nDAP = Diámetro\na la altura de 1,3m expresado en metros.\n\nHtot = Altura\ntotal expresada en metros.\n\nFf = Factor de\nforma igual que 0,5.\n\nN = Número de\nárboles por hectárea.\n\na) El Estado a\ntravés del Fonafifo, adquirirá los servicios ambientales que produzcan las\nplantaciones forestales, entendidos éstos según dispone el inciso k del\nartículo 3 de la Ley Forestal N°7575.\n\nb)\nEspecíficamente, los servicios ambientales brindados por plantaciones, se pagarán\nsegún el crecimiento anual de la biomasa de acuerdo con parámetros establecidos\nen esta resolución. Dichos pagos corresponden al total de años del plazo convenido;\nno obstante, a fin de permitir el establecimiento de la plantación y su\nmantenimiento, se adelantará durante los primeros cinco años.\n\nc) El Fonafifo\npodrá modificar cuando así se solicite, aquellos contratos suscritos antes del\naño 2014, que demuestren haber alcanzado una producción mínima de 13 metros\ncúbicos de incremento medio anual por hectárea. Para tales efectos, el Fonafifo\npodrá solicitar la información que considere pertinente.\n\n2.2. Actividad\nde Regeneración Natural: Las condiciones que regirán para el trámite de\nsolicitudes, para el reconocimiento de los servicios ambientales en la actividad\nde Regeneración Natural, que se desarrollen en áreas denudadas, sin cobertura forestal,\ncon fuentes semilleras cercanas, en áreas en proceso de regeneración que no\ncumplen con la definición de bosque y libres de pastoreo; se detallan a\ncontinuación.\n\na) El monto a\npagar en Regeneración Natural, será de ochenta y dos mil quinientos sesenta y\ncinco colones con 00/100 (¢82.565) por hectárea, desembolsados en cinco pagos\nanuales de 20% durante un período de cinco años.\n\n2.3. Actividad\nde Sistemas Agroforestales: Las condiciones que regirán para el trámite de\nsolicitudes, para el reconocimiento de los servicios ambientales en la\nactividad de Sistemas Agroforestales, se detallan a continuación.\n\na) El monto a\npagar será de mil ochenta y cinco colones con 00/100 (¢1.085) por árbol,\nintegrados a Sistemas Agroforestales y desembolsados durante un período de\ncinco años. Los pagos serán distribuidos de la siguiente forma: 50% el primer\naño, 25% el tercero año y 25% el año quinto.\n\nb) El monto a pagar será de mil seiscientos ocho colones con 00/100 (¢1.608) por árbol, integrados a\nSistemas Agroforestales, estrictamente con especies nativas contenidas en los Decretos Ejecutivos N°\n25663- MINAE del 8 de octubre de 1996 y N° 25700-MINAE del 15 de noviembre de 1996, desembolsados\ndurante un período de cinco años.\n\nLos pagos\nserán distribuidos de la siguiente forma: 50% el primer año, 25% el tercero año\ny 25% el año quinto.\n\nc) El monto a pagar será de mil seiscientos ocho\ncolones con 00/100 (¢1.608) por árbol, bajo la actividad de Sistemas\nAgroforestales establecidos en Plantaciones\nde Aprovechamiento Forestal (PPAF), financiados\nmediante el crédito forestal. Los pagos serán distribuidos de la siguiente\nforma: 80% se girará una vez\nfirmado el contrato y que los árboles hayan alcanzado los 36 meses de edad; el\nrestante 20% se tramitará cuando los árboles tengan 60 meses de\nedad, al quinto año del proyecto.\n\nd) Sistemas Mixtos en Agroforestería para pequeños productores: Las condiciones para esta modalidad\nson: Cuando realicen actividades de protección de bosque, un pago de veintiún mil seiscientos\ncolones con 00/100 (¢21.600) por hectárea por año, durante un período de cinco años, (aquí de ser\nnecesario se calcularán las fracciones de hectáreas existentes, hasta el primer decimal. Cuando sean\náreas denudadas o en proceso de regeneración, se reconocerá un pago de dieciséis mil quinientos\ntrece colones con 00/100 (¢16.513) por hectárea, por año durante un período de cinco años. Cuando\nrealicen actividades de reforestación de especies maderables o de uso múltiple fuera del área\nboscosa un pago de trescientos veinte tres colones con 00/100 por árbol (¢323) por año durante un\nperíodo de cinco años; se reconocerá una cantidad mínima de doscientos árboles plantados o árboles\nexistentes identificados, hasta un máximo de dos mil doscientos árboles. En esta sub actividad podrá\nrealizarse un solo contrato que comprenda las diferentes actividades y el plazo será de cinco años\ncontados a partir de la firma del contrato.\n\n2.4. Actividad\nde Manejo de Bosque:\n\na) El monto a\npagar en proyectos de Manejo de bosque será de ciento cuarenta y tres mil\nochocientos cuarenta y un colones con 00/100 (¢143.841) por hectárea,\ndesembolsados en cinco pagos anuales de 20% durante un período de cinco años.\n\n2.5. Contratos\nde Reducción de Emisiones Forestales (CREF). Las condiciones que regirán para\nel trámite de solicitudes, para el reconocimiento de Reducción de emisiones\nforestales, se detallan a continuación:\n\na) El monto en\nlos proyectos CREF a pagar será de dieciocho dólares 00/100 ($18) por hectárea\npor año. Bajo este esquema el pago es retroactivo una vez que se haya\nverificado que efectivamente la reducción de emisiones se dio.\n\nb) El máximo de\nhectáreas a contratar será de 450.000 has para bosques privados, este monto\npodrá aumentar si existe disponibilidad de recursos de financiamiento externo\npara este ese fin.\n\nc) El plazo de\nlos contratos podrá ser retroactivo al año 2018, y su vigencia será hasta\ndiciembre del 2024, pues así fue acordado con el Banco Internacional de\nReconstrucción y Fomento (BIRF) financiador parcial de los proyectos. Con\nfundamento en lo indicado en el considerando quinto de la presente resolución.\n\nSe autoriza al\nFondo Nacional de Financiamiento Forestal y al Fideicomiso 544 BNCR-FONAIFFO,\npara que utilice los recursos del presupuesto nacional asignados a este órgano,\nconcretamente a la Modalidad de Recuperación de la Cobertura Forestal no\ncomprometidos para el año 2023, para complementar un pago por el servicio\nambiental de protección de la biodiversidad a los CREF ya firmados y a los que\nlleguen a firmarse. El manual de procedimientos de este instrumento determinará\nentre otros, el monto, los requisitos y el procedimiento para el pago\nrespectivo.\n\n3. Actualización\nde los montos a pagar. Para los pagos anuales posteriores el MINAE, mediante\nresolución razonada podrá variar estos montos y actualizarlos, de igual forma\npodrá decretar aumentos extraordinarios en los montos a pagar, lo anterior considerando\nla disponibilidad presupuestaria y su inclusión en los presupuestos\ncorrespondientes.\n\nArtículo 2°-Se\ninstruye al Fondo Nacional de Financiamiento Forestal para que incorpore en los\ncontratos de Pago por Servicios Ambientales las siguientes condiciones:\n\n1. De los\nplazos de vigencia de los contratos: Los plazos de vigencia de los contratos de\nPago por Servicios Ambientales, generados por las actividades que corresponden\na las modalidades de recuperación y/o mantenimiento de cobertura forestal serán\nlos siguientes:\n\na) Los\ncontratos correspondientes a la actividad de Reforestación mediante el\nestablecimiento de las especies de rápido crecimiento, tendrán una vigencia de\ndiez años a partir de su firma.\n\nb) Los\ncontratos correspondientes a la actividad de Reforestación que incorporen\nespecies de mediano crecimiento y las especies nativas contenidas en los\nDecretos N° 25663-MINAE del 8 de octubre de 1996 y N° 25700-MINAE del 15 de\nnoviembre de 1996, su vigencia será de dieciséis años, a partir de su firma;\nincluyendo los contratos de reforestación con recursos propios y los contratos\nde reforestación que superen el tope establecido.\n\nc) Los\ncontratos correspondientes a la sub actividad de Plantaciones Forestales con\nTurnos de Rotación Reducidos (PFTRR), tendrán una vigencia de seis años.\n\nd) Los\ncontratos correspondientes a la actividad de Regeneración Natural tendrán una\nvigencia de cinco años a partir de su firma.\n\ne) Los\ncontratos correspondientes a la actividad de Manejo de bosque, tendrán una\nvigencia de 5 años a partir de su firma. De previo a la firma del contrato,\ndeberá constar en el expediente de PSA la certificación emitida por el SINAC\ndel cierre técnico del plan de manejo, según los Estándares de Sostenibilidad\npara Manejo de Bosques Naturales: Principios, Criterios e Indicadores, Código\nde Prácticas y Manual de Procedimientos, Decreto Ejecutivo N° 27388-MINAE\npublicado el 2 de noviembre de 1998, y el Decreto Ejecutivo N° 34559-MINAE publicado\nen La Gaceta N° 115, del día 16 de junio de 2008.\n\nf) Los\ncontratos correspondientes a la actividad de establecimiento de árboles en\nSistemas Agroforestales con especies de rápido, mediano y con las especies\nnativas contenidas en los Decretos N° 25663-MINAE del 8 de octubre de 1996 y N°\n25700 MINAE del 15 de noviembre de 1996, tendrán una vigencia de cinco años a\npartir de su firma.\n\ng) Los\ncontratos correspondientes a la sub actividad de Sistemas Agroforestales\nestablecidos en Plantaciones de Aprovechamiento Forestal (PPAF) tendrán una\nvigencia de 2 años a partir de su firma; dado que ya están plantados y por esto\nse les reconocerán retroactivamente tres años por su establecimiento previo.\n\nh) Los\ncontratos correspondientes a la sub actividad de Sistemas Mixtos en\nAgroforestería para micro productores tendrán una vigencia de cinco años a\npartir de su firma\n\ni) Los\ncontratos correspondientes a la actividad de establecimiento de árboles en\nSistemas Agroforestales relacionados a convenios u otros donantes o socios\ntendrán una vigencia de cinco años a partir de su firma.\n\n2. Consideraciones\nEspeciales. Condiciones establecidas para los montos y actividades de las\nsolicitudes PSA:\n\n2.1. Se faculta al Fondo Nacional de Financiamiento\nForestal a establecer actividades y montos diferenciados a los señalados en\nesta resolución, de conformidad con acuerdos, convenios o contratos o proyectos\nespecíficos con entidades, que aporten recursos financieros al Programa de Pago\npor Servicios Ambientales, que reconozcan montos y condiciones diferentes a los\nestablecidos para los diferentes servicios ambientales; para estos proyectos no\naplicarán los criterios de priorización que se detallaron anteriormente, sino\nlos pactados en cada convenio, así como las normas especiales que correspondan\nde acuerdo a la naturaleza de la actividad. Los pagos se realizarán siempre y\ncuando se tenga disponibilidad presupuestaria para cubrir los compromisos\nadquiridos mediante el Programa de Pago por Servicios Ambientales.\n\n2.2. Los montos pendientes por pagar para los contratos\nde años anteriores, se regirán según lo establecido en los Decretos Ejecutivos\ny Resoluciones Administrativas correspondientes para cada año. Los montos no\ntramitados antes del año 2023 en forma oportuna; dependerán del mecanismo de reclamo\ny de que la institución disponga de los recursos financieros requeridos para\natender esos montos.\n\n2.3. Para cubrir el costo de inscripción del contrato\nante el Registro Público, el Fondo Nacional de Financiamiento Forestal retendrá\nen el primer desembolso del monto total del contrato un 0,6%.\n\n2.4. Los recursos recuperados en virtud de los\nincumplimientos de contratos de pago por servicios ambientales o las\ndevoluciones o finiquitos, serán transferidos al Fideicomiso 544 FONAFIFO/BNCR\ny serán presupuestados para la ejecución de nuevas actividades de fomento de\npequeños y medianos productores.\n\n2.5. El proyecto deberá contar con un regente durante\ntoda la vigencia del contrato de pago por servicios ambientales. El formulario\nde regencia podrá inscribirse ante el Colegio de Ingenieros Agrónomos, por la\ntotalidad del plazo del contrato de pago por servicios ambientales, o por\nperíodos anuales o quinquenales según disponga la persona propietaria del\ninmueble. Cualquiera que sea la forma de pago, siempre deberá aportarse el\nformulario de regencia debidamente inscrito y vigente durante el trámite de\npago respectivo; salvo en aquellos casos que, se haya determinado que el\nproyecto será supervisado directamente por el Fondo Nacional de Financiamiento\nForestal; a través de su personal profesional o personal de apoyo contratado.\n\n2.6. Sin perjuicio de otras disposiciones, la persona o\nlas personas beneficiarias deberán aportar un informe de regencia anual emitido\npor un regente forestal para el trámite de pago; o eventualmente un informe\ntécnico emitido por un profesional forestal, para aquellos proyectos que no\naplica la figura del regente forestal. Adicionalmente, para los contratos de\nReforestación de Rápido Crecimiento, deberá presentar los informes de visita,\ndonde certifique el estado de los proyectos en los años 8 y 10 a partir de su\nfecha de plantación; para los proyectos de mediano crecimiento y otras especies\ndeberán presentar dichos informes al año 8, 12 y 16, a partir de su fecha de\nplantación.\n\n2.7. Sin perjuicio de otras acciones que representen\nincumplimiento a las obligaciones del contrato, para los contratos de\nReforestación de Rápido Crecimiento a partir de los 12 meses y para las\nplantaciones de Mediano Crecimiento a partir de los 24 meses de establecida la\nplantación, se considera incumplido el contrato si la plantación no presenta el\ncrecimiento mínimo establecido en el artículo 1 inciso 2.1, o el indicado de\nprevio en el estudio técnico respectivo para otras especies. Como consecuencia\nde este incumplimiento, la persona productora no recibirá el pago correspondiente\na este año, siendo que el Fondo Nacional de Financiamiento Forestal debe suspender\nlos pagos respectivos y dar por terminado el contrato con responsabilidad para\nla persona beneficiaria previo cumplimiento del debido proceso. En casos muy calificados,\nbasados en estudios y/o informes de las personas encargadas de Oficinas\nRegionales de Fonafifo, se podría proceder con el pago respectivo y continuar\ncon el contrato aun con índices de crecimiento menor, siempre y cuando estos no\nobedezcan a incumplimientos, por la mala selección del sitio, de la especie, o\nsea producto de un inadecuado manejo de la plantación.\n\n2.8. Como principio general, serán motivo de eximente de\nresponsabilidad por incumplimiento del contrato, el caso fortuito, la fuerza mayor,\nel hecho de un tercero como eximentes generales debidamente comprobadas y\nvaloradas a juicio del Fonafifo. De igual forma, se procederá cuando la persona\npropietaria de la plantación demuestre que una plaga o enfermedad afectó la\nplantación y que las acciones oportunamente realizadas no lograron erradicarla,\nsiempre y cuando estén documentadas en el expediente de PSA y tengan el aval de\nla Oficina Regional. Se procederá de igual manera cuando el daño sea producto de\nun incendio que no pudo ser controlado a pesar de las medidas preventivas reportadas.\n\n2.9. No podrán ejecutarse proyectos en fincas que hayan\nsido objetos de plagas, enfermedades, o incendios; en tal supuesto la finca no\npodrá ser sujeto de contratos en Reforestación y/o Sistemas Agroforestales en\nBloque, en un plazo de 3 años, a partir del último contrato finalizado por esta\ncausa.\n\n2.10. En relación a las plagas y enfermedades que afecten\nlas plantaciones forestales, la Junta Directiva de Fonafifo, determinará\nlineamientos para abordar y resolver estos supuestos.\n\n2.11. El Fonafifo, será el responsable de monitorear las\nplantaciones forestales que ingresen al Programa, debiendo no solo hacer un\nseguimiento a nivel regional, sino un protocolo de control, mediante un\nmecanismo aleatorio de visitas según su capacidad técnica y administrativa, de\nacuerdo a la disponibilidad de recursos presupuestados. De igual forma, deberá\ncustodiar la información de las parcelas permanentes de mediciones de las plantaciones,\na fin de sustentar los pagos y respaldar las fijaciones de carbono y otros\ngases de efecto invernadero.\n\n2.12. Para uniformizar la información requerida de las\nparcelas permanentes de plantaciones y bloques, el Fonafifo emitirá el formato\ndel contenido de la base de datos en Excel, para que los regentes lo remitan\nanualmente con los datos individuales de diámetros y alturas. El archivo se\nencuentra disponible en el sitio web de Fonafifo (www.fonafifo.go.cr) para su descarga.\n\n2.13. En caso de que en las solicitudes presentadas se\ndeterminara la existencia de traslapes o desplazamiento entre ellas y/o con\notras fincas, el Fonafifo valorará de acuerdo a criterios técnicos y legales la\naprobación o no de las solicitudes de ingreso.\n\n2.14. En el caso de las solicitudes de ingreso de\nReforestación que involucren mezclas de especies de rápido, mediano y/o en vías\nde extinción, se deberá generar contratos separados, en virtud de las\ndiferencias de crecimiento que se presentan entre estos grupos de especies.\nAdemás, los proyectos que estén conformados por especies nativas contenidas en\nlos Decretos N° 25663- MINAE del 8 de octubre de 1996 y N° 25700-MINAE del 15\nde noviembre de 1996, deberá contener el 100% de los árboles de las especies\ncontenidas en los mencionados decretos; de lo contrario tendrá un valor en\nfunción del monto menor establecido para Reforestación.\n\n2.15. En el caso de las solicitudes de ingreso que se\npresenten para acceder al Programa de Pago por Servicios Ambientales, deben de\ncontener la información de contacto (correo electrónico, número de teléfono,\ndirección) de la persona propietaria o propietarias del inmueble. Sin esta\ninformación la administración estimará como incompleta la solicitud y procederá\na señalarla, para que la persona solicitante proceda a completarla, de no\nsuministrar la información se procederá con su archivo. Dicha información es\nfundamental para el proceso de notificación del Programa de PSA.\n\n2.16. Las plantaciones forestales de especies en peligro\nde extinción sembrados con el financiamiento de contratos de servicios\nambientales podrán ser aprovechados con fundamento en el artículo 28 de la Ley\nForestal.\n\n2.17. Los proyectos de Reforestación de los años 2016 a\n2023 serán valorados de acuerdo a los parámetros de crecimiento establecidos en\nla resolución ministerial R-167-2019-MINAE, publicados en La Gaceta N° 138 del\n23 de julio del 2019.\n\n2.18. El Fonafifo realizará el trámite de pago de los\ncontratos con morosidad según lo establecido en la Ley N°9686 y sus\nmodificaciones; en donde, la CCSS estableció el procedimiento que las\ninstituciones del Estado deben de seguir ante personas beneficiarias que están\nmorosas con la CCSS.\n\nArtículo\n3°-Rige a partir de su publicación.",
  "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Regulation 135\n\n                        Establishes the expenditure limit for the National Forest Financing Fund,\nthe number of hectares to be financed per activity in the Payment for Environmental Services Program,\nand the amount to be paid based on the allocated resources\n\nMINISTRY OF ENVIRONMENT AND\nENERGY\n\nMinisterial Office\n\nR-135-2024-MINAE\n\nMINISTRY OF\nENVIRONMENT AND ENERGY San José, at 15:08 on April 29,\n2024. The National Forest Financing Fund is established the number of\nhectares to be financed per activity in the Payment for Environmental Services Program\nand the amount to be paid based on the allocated resources.\n\nWHEREAS\n\nSOLE.—That for\nthe 2024 fiscal year, the National Budget provides a total of thirteen thousand four\nhundred ninety-six million six hundred twenty-three thousand fifty-three\ncolones with 00/100 (¢13,496,623,053.00) for the Payment for Environmental Services Program,\nwhich will be used to pay the commitments of\nPSA contracts from previous years and the incorporation of new hectares for the\nyear 2024.\n\nCONSIDERING\n\n1°—That\nArticle 38 of the Regulation to the Forestry Law No. 7575, Executive Decree No.\n25721-MINAE, of October 17, 1996, and its amendments, provides that the Minister\nof Environment and Energy, as Head of the Ministry of Environment and Energy, acting\nin the capacity of the State Forestry Administration, shall annually issue, through a Ministerial Resolution,\nthe activities to be financed in the Payment for Environmental Services Program\nand the amounts to be paid based on the resources allocated\nin the National Budget for the 2024 fiscal year.\n\n2°—That under\nthis principle, financial instruments should be oriented to support the\npillars of the National Development and Public Investment Plan 2023-2026 (Rogelio\nFernández Güell), considering the objectives of the creation of the National Forest Financing Fund\naccording to the aforementioned Forestry Law, without neglecting the\nestablished technical criteria.\n\n3°—That the\naforementioned National Development Plan considers as one of the national goals maintaining\nunder the Payment for Environmental Services Program at least\ntwo hundred fifty thousand hectares (250,000 has), across its different activities.\n\n4°—That the\nMinistry of Environment and Energy has issued the Guiding Principles of the Productive\nForest Sector, through Executive Decree No. 41772-MINAE, as well as the\nguidelines to be considered in institutional actions for the reactivation\nand promotion of reforestation in the country.\n\n5°—That by\nvirtue of the efforts to achieve international recognition of the contribution\nof forests in reducing greenhouse gas emissions, the\nGovernment of Costa Rica signed an ERPA (Emission Reductions Purchase Agreement)\nwith the International Bank for Reconstruction and Development on December 9, 2020,\nwhich, in its benefit distribution plan,\nprovided for the creation of a payment for environmental services mechanism\nspecializing in emission reductions, which has differentiated\nconditions; this instrument is the CREF (Forest Emission Reduction Contract).\n\nTHEREFORE:\n\nTHE MINISTER OF\nENVIRONMENT AND ENERGY\n\nRESOLVES\n\nArticle\n1°—To establish the expenditure limit for the National Forest Financing Fund,\nfor contracts to be formalized in the year 2024, the activities to be financed, and\nthe payment amounts per activity.\n\n1. Activities\nto be financed: For the year 2024, two modalities to be financed will be considered:\na-Forest Cover Recovery, which includes the activities of Reforestation, Natural Regeneration, and Agroforestry Systems, and b-Forest Cover Maintenance,\nwhich includes Forest Protection and Forest Management.\nFor this purpose, the following distribution is established:\n\n| PSA Modalities | Activity | Quantity |\n| --- | --- | --- |\n| Forest Cover\nRecovery* | Reforestation with fast-growing species | 1,000 hectares |\n| Reforestation with\nmedium-growth species | 3,000 hectares |\n| | Forest Plantations with Short Rotation Cycles (PFTRR) | 1,000 hectares |\n| | Natural Regeneration | 1,500 hectares |\n| | Establishment of trees in Agroforestry Systems | 500,000 trees |\n| | Agroforestry Systems established in Forest Harvest Plantations (PPAF) | 50,000 trees |\n| | Mixed Systems in Agroforestry for micro-producers | 50,400 trees |\n| | Forest Cover Maintenance | Forest Management** | 450 hectares |\n\n*: The Fonafifo\nwill process all entry applications submitted under the Reforestation sub-activity with species contained in the executive decrees\nof ban and threatened or endangered species (Decreto N° 25663-MINAE\nand Decreto N° 25700-MINAE and their amendments), for a maximum area of 600 hectares.\n\n**: These refer\nto all entry applications for farms where the\nforest management plan has been completed to the satisfaction of the State Forestry Administration (AFE).\n\nThe forest protection activity\nwill be implemented starting from the second four-month period of the\nyear 2024, for which the corresponding ministerial resolution will be issued.\n\nStarting from\nthe year 2022, a mechanism derived from and financed with resources\nfrom contracts and agreements for Emission Reductions produced by\nforests is enabled; with a quantity of 450,000 hectares. This activity mainly recognizes\nthe environmental service of reducing greenhouse gas emissions,\nbut it can be supplemented with the recognition of other\nenvironmental services when resources are available for that purpose, hereinafter, CREF\ncontracts.\n\nThe National Forest Financing Fund\nmay vary the distribution established in the previous table, according to the availability of the budget\napproved for the Payment for Environmental Services Program.\n\nIf a greater allocation of\nresources is available, according to Article 5 of the Tax Simplification and Efficiency Law No. 8114 published in La Gaceta No. 131, of\nJuly 9, 2001, and other financial resources that Fonafifo secures for the\nPayment for Environmental Services, they will be distributed according to the criteria of the funders\nand the authorities of the Ministry or corresponding authorities.\n\nIn any case,\nthe resources used for these purposes must be incorporated into the\ninstitutional budget or into the Trust 544 Fonafifo/BNCR.\n\n2. Of the payment amounts\nper activity and other conditions:\n\n2.1. Reforestation\nActivity: The conditions that will govern the processing of applications\nfor the recognition of environmental services in the Reforestation activity\nare the following:\n\na) The amount to be\npaid for fast-growing species referred to as: Gmelina arborea,\nAcacia mangium, Vochysia guatemalensis, and Vochysia hondurensis, shall be\nseven hundred eighty-three thousand six hundred forty-four colones with\n00/100 (¢783,644.00) per hectare, disbursed over a period of five\nyears. Payments will be distributed as follows:\n50% the first year, 20% the second year, 15% the third year, 10% the fourth year, and\n5% the fifth year.\n\nb) The amount to be\npaid for medium-growth species referred to as: Tectona grandis,\nPinus sp, Cordia alliodora, Vochysia ferruginea, Eucalyptus sp, and Cedrela\nodorata, shall be eight hundred eighty-three thousand five hundred forty seventy-\nsix colones with 00/100 (¢883,576.00) per hectare, disbursed over a\nperiod of five years. Payments will be distributed as follows:\n50% the first year, 20% the second year, 15% the third year, 10% the fourth year, and\n5% the fifth year.\n\nc) The amount to be\npaid for native species contained in Executive Decrees No.\n25663-MINAE of October 8, 1996, and No. 25700-MINAE of November 15,\n1996, shall be one million three hundred twenty-five thousand three hundred sixty-six colones\nwith 00/100 (¢1,325,366.00) per hectare, disbursed over a period of five\nyears. Payments will be distributed as follows:\n50% the first year, 20% the second year, 15% the third year, 10% the fourth year, and\n5% the fifth year.\n\nd) The amount to be\npaid for Forest Plantations with Short Rotation Cycles (PFTRR)\nfor fast-growing species for packaging shall be four hundred\ntwenty-one thousand six hundred twenty-eight colones with 00/100 (¢421,628) per hectare.\nPayments will be distributed as follows: 50% the first year, 25% the\nsecond year, and 25% the fourth year.\n\ne) The\nconditions that will govern the processing of applications for the recognition\nof environmental services in the Reforestation activity, PSA + Credit pilot project,\nare the following:\n\ni. The amount to\nbe paid for the PSA + Credit pilot project with the fast-growing\nspecies referred to as: Gmelina arborea, shall be four hundred twenty-one thousand\nsix hundred twenty-eight colones with 00/100 (¢421,628) per hectare,\ndisbursed in 6 installments according to the following distribution: first year\n11%, second year 16%, third year 17%, fourth year 18%, fifth year 19%, and the sixth\nyear the remaining 19% which will be paid, provided that the beneficiary has\nconsented through a formal document.\n\nf) Forest\nPlantations established with own resources for payment by results. The\namounts to be paid will be those established in subsections a, b, and c above. The\namounts will be distributed as follows: upon signing the contract,\n50%; twelve, twenty-four, thirty-six, and forty-eight months after\nsaid signing, 20%, 15%, 10%, and 5% respectively. The contracts will have the\nterm provided in Article 2, subsections a and b of this resolution, but\nthe years of existence of these plantations will be recognized; up to a maximum of 3\nyears after establishment.\n\ng) Individuals\nor legal entities wishing to reforest in areas larger than the limit established\nin the Regulation to the Forestry Law, Decreto No. 25721-MINAE and its Amendments,\nmay apply under a special financing scheme, being able to double the\nlimit of 750 hectares, provided that the available resources are not\nused by small producers. Said payments correspond to the total number of years of the agreed term;\nhowever, in order to allow the establishment of the plantation and its\nmaintenance, it will be advanced during the first five years.\n\nc) Fonafifo\nmay modify, when so requested, those contracts signed before the\nyear 2014, that demonstrate having achieved a minimum production of 13 cubic\nmeters of mean annual increment per hectare. For such purposes, Fonafifo\nmay request the information it considers pertinent.\n\n2.2. Natural Regeneration\nActivity: The conditions that will govern the processing of\napplications for the recognition of environmental services in the activity\nof Natural Regeneration, developed in denuded areas, without forest cover,\nwith nearby seed sources, in areas in the process of regeneration that do\nnot meet the definition of forest and are free of grazing; are detailed\nbelow.\n\na) The amount to be\npaid for Natural Regeneration shall be eighty-two thousand five hundred sixty-\nfive colones with 00/100 (¢82,565) per hectare, disbursed in five annual\npayments of 20% over a period of five years.\n\n2.3. Agroforestry Systems\nActivity: The conditions that will govern the processing of\napplications for the recognition of environmental services in the\nAgroforestry Systems activity are detailed below.\n\na) The amount to\nbe paid shall be one thousand eighty-five colones with 00/100 (¢1,085) per tree,\nintegrated into Agroforestry Systems and disbursed over a period of\nfive years. Payments will be distributed as follows: 50% the first\nyear, 25% the third year, and 25% the fifth year.\n\nb) The amount to be paid shall be one thousand six hundred eight colones with 00/100 (¢1,608) per tree, integrated into\nAgroforestry Systems, strictly with native species contained in Executive Decrees No.\n25663-MINAE of October 8, 1996, and No. 25700-MINAE of November 15, 1996, disbursed\nover a period of five years.\n\nPayments\nwill be distributed as follows: 50% the first year, 25% the third year,\nand 25% the fifth year.\n\nc) The amount to be paid shall be one thousand six hundred eight\ncolones with 00/100 (¢1,608) per tree, under the activity of Agroforestry\nSystems established in Forest Harvest\nPlantations (PPAF), financed\nthrough forest credit. Payments will be distributed as follows: 80% will be paid once\nthe contract is signed and the trees have reached 36 months of age; the\nremaining 20% will be processed when the trees are 60 months of\nage, in the fifth year of the project.\n\nd) Mixed Systems in Agroforestry for small producers: The conditions for this modality\nare: When carrying out forest protection activities, a payment of twenty-one thousand six hundred\ncolones with 00/100 (¢21,600) per hectare per year, for a period of five years, (here, if\nnecessary, fractions of existing hectares will be calculated, up to the first decimal. When there are\ndenuded areas or areas in the process of regeneration, a payment of sixteen thousand five hundred\nthirteen colones with 00/100 (¢16,513) per hectare per year for a period of five years will be recognized. When\ncarrying out reforestation activities with timber or multipurpose species outside the forested\narea, a payment of three hundred twenty-three colones with 00/100 per tree (¢323) per year for a\nperiod of five years; a minimum quantity of two hundred planted trees or existing\nidentified trees will be recognized, up to a maximum of two thousand two hundred trees. In this sub-activity, a\nsingle contract may be executed covering the different activities, and the term shall be five years\ncounted from the signing of the contract.\n\n2.4. Forest Management\nActivity:\n\na) The amount to\nbe paid in Forest Management projects shall be one hundred forty-three thousand\neight hundred forty-one colones with 00/100 (¢143,841) per hectare,\ndisbursed in five annual payments of 20% over a period of five years.\n\n2.5. Forest Emission Reduction\nContracts (CREF). The conditions that will govern the\nprocessing of applications for the recognition of Forest Emission Reductions\nare detailed below:\n\na) The amount in\nCREF projects to be paid shall be eighteen dollars 00/100 ($18) per hectare\nper year. Under this scheme, the payment is retroactive once it has been\nverified that the emission reduction actually occurred.\n\nb) The maximum\nhectares to be contracted shall be 450,000 has for private forests; this amount\nmay increase if external financing resources are available for\nthis purpose.\n\nc) The term of\nthe contracts may be retroactive to the year 2018, and their validity shall be until\nDecember 2024, as was agreed with the International Bank for\nReconstruction and Development (IBRD), partial financier of the projects. Based\non what is indicated in considering clause five of this resolution.\n\nThe National Forest Financing Fund and Trust 544 BNCR-FONAIFFO are authorized\nto use the national budget resources assigned to this body,\nspecifically to the Forest Cover Recovery Modality not\ncommitted for the year 2023, to supplement a payment for the environmental\nservice of biodiversity protection to the CREFs already signed and to those that\nmay be signed. The procedures manual for this instrument shall determine,\namong others, the amount, requirements, and procedure for the respective\npayment.\n\n3. Updating\nthe amounts to pay. For subsequent annual payments, the MINAE, through\na reasoned resolution, may vary these amounts and update them; likewise, it\nmay decree extraordinary increases in the amounts to be paid, considering the\nbudgetary availability and their inclusion in the corresponding\nbudgets.\n\nArticle 2°—The National Forest Financing Fund is instructed\nto incorporate the following conditions into the\nPayment for Environmental Services contracts:\n\n1. Of the\nvalidity terms of the contracts: The validity terms of the Payment for Environmental Services contracts,\ngenerated by the activities corresponding to the modalities of forest cover recovery and/or maintenance, shall be\nthe following:\n\na) The\ncontracts corresponding to the Reforestation activity through the\nestablishment of fast-growing species shall have a validity of\nten years from their signing.\n\nb) The\ncontracts corresponding to the Reforestation activity that incorporate\nmedium-growth species and the native species contained in\nDecretos No. 25663-MINAE of October 8, 1996, and No. 25700-MINAE of November 15,\n1996, shall have a validity of sixteen years from their signing;\nincluding reforestation contracts with own resources and reforestation\ncontracts that exceed the established limit.\n\nc) The\ncontracts corresponding to the sub-activity of Forest Plantations with\nShort Rotation Cycles (PFTRR) shall have a validity of six years.\n\nd) The\ncontracts corresponding to the Natural Regeneration activity shall have a\nvalidity of five years from their signing.\n\ne) The\ncontracts corresponding to the Forest Management activity shall have a\nvalidity of 5 years from their signing. Prior to the signing of the contract,\nthe PSA file must contain the certification issued by SINAC\nof the technical closure of the management plan, according to the Sustainability Standards\nfor Natural Forest Management: Principles, Criteria and Indicators, Code\nof Practices and Procedures Manual, Executive Decree No. 27388-MINAE\npublished on November 2, 1998, and Executive Decree No. 34559-MINAE published\nin La Gaceta No. 115, on June 16, 2008.\n\nf) The\ncontracts corresponding to the activity of establishing trees in\nAgroforestry Systems with fast, medium-growth species, and with the native\nspecies contained in Decretos No. 25663-MINAE of October 8, 1996, and No.\n25700 MINAE of November 15, 1996, shall have a validity of five years\nfrom their signing.\n\ng) The\ncontracts corresponding to the sub-activity of Agroforestry Systems\nestablished in Forest Harvest Plantations (PPAF) shall have a\nvalidity of 2 years from their signing; given that they are already planted and for this\nreason, three years will be recognized retroactively for their prior establishment.\n\nh) The\ncontracts corresponding to the sub-activity of Mixed Systems in\nAgroforestry for micro-producers shall have a validity of five years\nfrom their signing.\n\ni) The\ncontracts corresponding to the activity of establishing trees in\nAgroforestry Systems related to agreements or other donors or partners\nshall have a validity of five years from their signing.\n\n2. Special\nConsiderations. Conditions established for the amounts and activities of the\nPSA applications:\n\n2.1. The National Forest Financing Fund is empowered\nto establish activities and differentiated amounts from those indicated in\nthis resolution, in accordance with agreements, covenants, or contracts or specific\nprojects with entities that provide financial resources to the Payment for Environmental Services Program,\nwhich recognize amounts and conditions different from those\nestablished for the various environmental services; for these projects, the\nprioritization criteria detailed above shall not apply, but\nthose agreed upon in each agreement, as well as the special norms that correspond\naccording to the nature of the activity. Payments shall be made provided\nthat there is budgetary availability to cover the commitments\nacquired through the Payment for Environmental Services Program.\n\n2.2. The outstanding amounts to be paid for contracts\nfrom previous years shall be governed by the provisions of the Executive Decrees\nand Administrative Resolutions corresponding to each year. Amounts not\nprocessed in a timely manner before the year 2023 shall depend on the claim mechanism\nand on the institution having the required financial resources to\ncover those amounts.\n\n2.3. To cover the cost of registering the contract\nwith the Public Registry, the National Forest Financing Fund shall withhold\n0.6% from the first disbursement of the total contract amount.\n\n2.4. Resources recovered by virtue of\nbreaches of payment for environmental services contracts or\nrefunds or settlements shall be transferred to Trust 544 FONAFIFO/BNCR\nand shall be budgeted for the execution of new promotion activities for\nsmall and medium-sized producers.\n\n2.5. The project must have a regent throughout\nthe validity of the payment for environmental services contract. The regency\nform may be registered with the College of Agronomy Engineers for\nthe entire term of the payment for environmental services contract, or by\nannual or five-year periods as determined by the property owner. Whichever form of payment is used, the regency\nform, duly registered and valid, must always be provided during the\nrespective payment process; except in those cases where it has been determined that the\nproject will be supervised directly by the National Forest Financing Fund,\nthrough its professional staff or contracted support personnel.\n\n2.6. Without prejudice to other provisions, the person or\nbeneficiaries must provide an annual regency report issued\nby a forestry regent for the payment process; or eventually a technical\nreport issued by a forestry professional, for those projects where\nthe figure of the forestry regent does not apply. Additionally, for\nFast-Growth Reforestation contracts, visit reports must be submitted\ncertifying the state of the projects at years 8 and 10 from their\nplanting date; for medium-growth projects and other species,\nsuch reports must be submitted at year 8, 12, and 16, from their\nplanting date.\n\n2.7. Without prejudice to other actions that represent\nbreach of contract obligations, for\nFast-Growth Reforestation contracts, starting from 12 months, and for\nMedium-Growth plantations, starting from 24 months after the\nplantation is established, the contract is considered breached if the plantation does not present the\nminimum growth established in Article 1, subsection 2.1, or that previously indicated\nin the respective technical study for other species. As a consequence\nof this breach, the producer shall not receive the payment corresponding\nto that year, and the National Forest Financing Fund must suspend\nthe respective payments and terminate the contract with responsibility for\nthe beneficiary, prior compliance with due process. In very qualified cases,\nbased on studies and/or reports from the heads of\nFonafifo Regional Offices, the respective payment and continuation\nof the contract could proceed even with lower growth rates, provided that these do\nnot result from breaches due to poor site or species selection, or\nfrom inadequate management of the plantation.\n\n2.8. As a general principle, grounds for exemption from\nliability for breach of contract shall be fortuitous event, force majeure,\nand the act of a third party, as general exemptions, duly proven and\nevaluated at the discretion of Fonafifo. The same procedure shall apply when the\nplantation owner demonstrates that a pest or disease affected the\nplantation and that the actions taken in a timely manner failed to eradicate it,\nprovided they are documented in the PSA file and have the endorsement of\nthe Regional Office. The same procedure shall apply when the damage results from\na fire that could not be controlled despite the reported preventive measures.\n\n2.9. Projects may not be executed on farms that have\nbeen subject to pests, diseases, or fires; in such a case, the farm\nmay not be subject to contracts for Reforestation and/or Block Agroforestry Systems for a period of 3 years, starting from the last contract terminated for this\nreason.\n\n2.10. In relation to pests and diseases affecting\nforest plantations, the Board of Directors of Fonafifo shall determine\nguidelines for addressing and resolving these cases.\n\n2.11. Fonafifo shall be responsible for monitoring the\nforest plantations that enter the Program, and must not only conduct\nfollow-up at the regional level, but also a control protocol, through a\nrandom visit mechanism according to its technical and administrative capacity, and\nin accordance with the availability of budgeted resources. Likewise, it must\nsafeguard the information from the permanent measurement plots of the plantations,\nin order to support payments and back the carbon and other\ngreenhouse gas fixations.\n\n2.12. To standardize the required information from the\npermanent plots of plantations and blocks, Fonafifo shall issue the format\nfor the content of the database in Excel, so that the regents may submit it\nannually with the individual data for diameters and heights. The file is\navailable on the Fonafifo website (www.fonafifo.go.cr) for download.\n\n2.13. In the event that the submitted applications\ndetermine the existence of overlaps or displacements among them and/or with\nother farms, Fonafifo shall assess, according to technical and legal criteria, the\napproval or rejection of the entry applications.\n\n2.14. In the case of Reforestation entry applications\ninvolving mixtures of fast, medium-growth species, and/or endangered species,\nseparate contracts must be generated, by virtue of the\ndifferences in growth presented between these groups of species.\nFurthermore, projects composed of native species contained in\nDecretos No. 25663-MINAE of October 8, 1996, and No. 25700-MINAE of November 15,\n1996, must contain 100% of the trees of the species\ncontained in the aforementioned decrees; otherwise, it shall have a value based\non the lower amount established for Reforestation.\n\n2.15. In the case of entry applications submitted to access the Payment for Environmental Services (Pago por Servicios Ambientales, PSA) Program, they must contain the contact information (email, telephone number, address) of the property owner or owners. Without this information, the administration will consider the application incomplete and will flag it so that the applicant may complete it; if the information is not provided, it will be archived. Said information is essential for the notification process of the PSA Program.\n\n2.16. Forest plantations of endangered species planted with financing from environmental services contracts may be harvested based on Article 28 of the Forest Law (Ley Forestal).\n\n2.17. Reforestation projects from the years 2016 to 2023 will be evaluated according to the growth parameters established in ministerial resolution R-167-2019-MINAE, published in La Gaceta N° 138 of July 23, 2019.\n\n2.18. Fonafifo will process the payment of contracts in arrears in accordance with the provisions of Law N° 9686 and its amendments, wherein the CCSS established the procedure that State institutions must follow with respect to beneficiaries who are in arrears with the CCSS.\n\nArticle 3—This takes effect upon its publication."
