  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 44965\n\n                        Creación del Sistema Nacional de Certificación \"Madera Legal Costa Rica\"\n\nNº 44965-MINAE\n\nEL PRESIDENTE\nDE LA REPUBLICA\n\nY EL MINISTRO\nDEL AMBIENTE Y ENERGIA\n\nEn ejercicio\nde las facultades que les confieren los artículos 50, 140 inciso 3) y 18) y el artículo\n146 de la Constitución Política; artículos 27 inciso 1) y 28 inciso 2) acápite\nb) de la Ley General de la Administración Pública Nº6227 del 2 de mayo de 1978,\nlos artículos 1 º y 6° de la Ley Forestal Nº 7575 del 13 de febrero ele 1996,\nel artículo 2 inciso c), y 48 de la Ley Orgánica del Ambiente Nº 7554 del 4 de\noctubre de 1995, Ley de Aprobación de la Adhesión al Convenio Internacional de\nlas Maderas Tropicales, Ley Nº 9143 del 11 de junio del 201 3, el Decreto\nEjecutivo Nº 27695, del 21 de enero de 1999, Manual de Procedimientos para la\nAcreditación de Certificadores Forestales, el Decreto Ejecutivo Nº 30310 -MINAE\ndel 17 de abril del 2002, Reforma Reglamento a la Ley Forestal y Reconoce al\nSistema de Certificación Forestal del Consejo de Manejo Forestal como un\nSistema Nacional de Certificación, el Decreto Ejecutivo Nº 41772- MINAE del 05\nde junio del 2019.\n\nCONSIDERANDO:\n\n1. Que\nmediante Ley Nº 9143, del 1 1 de junio del 2013, Costa Rica firmó el\ninstrumento de adhesión al Convenio Internacional sobre Maderas Tropicales,\npromoviendo los esfuerzos globales del aprovechamiento sostenible de los\nbosques tropicales mediante la adopción de medidas y políticas públicas que\ntiendan a mejorar el manejo, uso y conservación de los bosques tropicales y sus\nrecursos genéticos.\n\n2. Que el\nartículo 48 de la Ley Nº 7554 del 04 de octubre de 1995, Ley Orgánica del Ambiente\nestablece que es obligación del Estado conservar, proteger y administrar el\nrecurso forestal. Para esos efectos, la ley que se emita deberá regular lo\nrelativo a la producción, el aprovechamiento, la industrialización y el fomento\nde estos recursos, garantizando su uso sostenible, así como la generación de\nempleo digno y el mejoramiento del nivel de vida de los grupos sociales\ndirectamente relacionados con las actividades silviculturales.\n\n3. Que el\nartículo 1 de la Ley Nº 7575 del 13 de febrero de 1996, Ley Forestal, establece\ncomo función esencial y prioritaria del Estado velar por la conservación,\nprotección y administración de los bosques naturales y por la producción, el\naprovechamiento, la industrialización y el fomento de los recursos forestales\ndel país destinados a ese fin, de acuerdo con el principio de uso adecuado y\nsostenible de los recursos naturales renovables. Además, velará por la\ngeneración de empleo y el incremento del nivel de vida de la población rural,\nmediante su efectiva incorporación a las actividades silviculturales.\n\n4. Que la Ley Forestal Nº 7575, en el artículo 6 inciso o), se indica que las competencias de la\nAdministración Forestal del Estado son las siguientes: \"o) Otorgar las licencias de certificadores\nforestales, a propuesta de una comisión integrada por representantes de entes académicos y\ncientíficos reconocidos, nacionales y extranjeros, destacados en el tema ambiental. A esta comisión,\ntambién, se le encomendará regular y vigilar el sistema de sellos verdes o certificaciones\nforestales. Los requisitos para calificar como certificador forestal, la integración de la citada\ncomisión, sus responsabilidades y funcionamiento se establecerán en el reglamento de esta ley. \"\n\n5. Que en los\nartículos 7 y 10 de la Ley Forestal Nº 7575, se crea la Oficina Nacional Forestal,\ncorno un ente público no estatal con personalidad jurídica propia, así como sus\nfunciones.\n\n6. Que el\nReglamento de la Ley Forestal Nº 7575, Decreto Ejecutivo Nº 25721 del 17 de\noctubre de 1996, en su capítulo séptimo hace referencia a las certificaciones\nforestales y específicamente el artículo 26 crea y establece las funciones de\nla Comisión Nacional de Sostenibilidad Forestal.\n\n7. Que el\nartículo 28 del mismo Reglamento señala que \"Los interesados en obtener\nla certificación forestal de manera voluntaria, podrán contratar los servicios\nde un certificador autorizado por la A.FE.\"\n\n8. Que el Decreto\nEjecutivo Nº 27695, del 21 de enero de 1999, establece el Manual de Procedimientos\npara la Acreditación Certificadores Forestales, donde el artículo 2 menciona los\nrequisitos para la solicitud y los artículos 3, 4, 5 y 6 establecen la\ntramitación de las solicitudes. Cabe destacar que los requisitos y trámites\nantes mencionados son únicamente aplicables para el Sistema de Certificación\nForestal del Consejo de Manejo Forestal (FSC por sus siglas en inglés).\n\n9. Que el\nDecreto Ejecutivo Nº 30310-MINA E del 17 de abril del 2002, Reforma Reglamento\na la Ley Forestal y Reconoce al Sistema de Certificación Forestal del Consejo de\nManejo Forestal como un Sistema Nacional de Certificación, en su artículo 2\nestablece que: \"Se reconoce el Sistema de Certificación Forestal del\nConsejo de Manejo Forestal, conocido por sus siglas en inglés como F.S.C., como\nun Sistema Nacional de Certificación y por tanto reconózcanse los certificadores\ndebidamente acreditados ante él y los certificados otorgados por ellos en el país.\nLo anterior sin pe1juicio de que en el futuro se reconozcan o desarrollen otros\nesquemas nacionales o internacionales que puedan ser considerados Sistemas\nNacionales de Certificación.\" Lo anterior, permite el reconocimiento o\ndesarrollo de otro sistema nacional o internacional distinto a la certificación\n\"FSC\" originalmente reconocida.\n\n10. Que el\na1tículo 5 del Decreto Ejecutivo Nº 30310-MINAE señala que la Administración\nForestal del Estado de previa recomendación de la Comisión Nacional de Certificación\nForestal podrá acreditar a otros certificadores, por tanto, existe la\noportunidad de crear un sistema nacional de certificación de legalidad de la\nmadera que cuente con sus propios certificadores.\n\n11. Que el artículo 3 del Decreto Ejecutivo Nº 41772-MINAE del 05 de junio del 2019, sobre\nPrincipios Rectores del sector Forestal Productivo, se establece lo siguiente: \"Conforme a lo\nestablecido en Decreto Ejecutivo Nº 39310 del 27 de enero de 2015, \"Política Nacional de Compras\nPúblicas Sustentables y Creación del Comité Directivo Nacional de Compras Sustentables\", todas las\ninstituciones de la Administración Central y Descentralizada deberán inc01porar dentro de los Planes\nde Gestión Ambiental Institucional, las acciones pertinentes y necesarias orientadas a la\nsustitución de productos de una alta huella de carbono, siendo prioritaria la utilización de madera\nnacional cosechada con el fin de contribuir efectivamente con el Plan Nacional de Descarbonización y\nla Contribución Prevista y Determinada a Nivel Nacional de Costa Rica ante la Convención Marco de\nlas Naciones Unidas para el Cambio Climático. \"\n\n12. Que la\nDirectriz 050-MINAE del 05 ele junio del 2019, sobre la construcción sostenible\ndel sector público, en el anexo 2, el cual contiene los criterios de\nsostenibilidad de aplicación en construcciones nuevas, el criterio 3 hace\nreferencia a especificar desde la etapa de diseño los materiales a utilizar,\ndonde dos de sus estrategias indican: \"La madera utilizada cuenta con\ncertificación de sostenibilidad reconocida por la entidad competente (MINAE).\n\".\n\n13. Que de\nconformidad con el artículo 12 bis del Decreto Ejecutivo Nº 37045-MP-MEIC del\n22 de febrero de 2012 y sus reformas \"Reglamento a la Ley de Protección al\nCiudadano del Exceso de Requisitos y Trámites Administrativos\" se ha\ncompletado como primer paso la Sección I denominada Control Previo de Mejora\nRegulatoria, que conforma el formulario de Evaluación Costo Beneficio y las\nrespuestas brindadas en esa Sección han sido todas negativas, toda vez que la\npresente propuesta no contiene trámites ni requisitos que el administrado deba\ncumplir.\n\nPor tanto;\n\nDECRETAN:\n\nCREACIÓN DEL\nSISTEMA NACIONAL DE CERTIFICACIÓN\n\n\"MADERA\nLEGAL COSTA RICA\"\n\nArtículo 1.\nAcrónimos. En el presente decreto ejecutivo se emplearán las siguientes abreviaturas\ncon su respectivo significado:\n\nAFE:\nAdministración Forestal del Estado\n\nCNSF:\nComisión Nacional para la Sostenibilidad Forestal\n\nCIAGRO:\nColegio de Ingenieros Agrónomos de Costa Rica\n\nONF: Oficina\nNacional Forestal (ONF)\n\nSINAC:\nSistema Nacional de Áreas de Conservación\n\nPSA: Pago por\nServicios Ambientales\n\nSIGEREFO:\nSistema de Gestión de Regencias Forestales\n\nArtículo 2.\nCreación del sistema nacional ele certificación. Se crea el sistema nacional de\ncertificación \"Madera Legal Costa Rica\", dicho sistema es voluntario\npara la certificación nacional de legalidad de la madera, por tanto,\nreconózcanse los certificadores debidamente acreditados ante él y los\ncertificados otorgados por ellos en el país. Su objetivo es promover el uso y\nconsumo de madera nacional legal y sostenible, así como el fortalecimiento del\nsector forestal mediante la creación de una certificación viable a nivel legal,\ntécnico, administrativo y financiero.\n\nEste sistema\nde certificación será administrado por la Oficina Nacional Forestal (ONF) y facilitará\nla vinculación interinstitucional con el Sistema Nacional de Áreas de\nConservación (SlNAC), la Comisión Nacional para la Sostenibilidad Forestal\n(CNSF) y el Colegio de Ingenieros Agrónomos de Costa Rica (CIAGRO).\n\nArtículo 3.\nResponsabilidad ele las instituciones vinculadas. Se instruye a la Administración\nForestal del Estado a través del Sistema Nacional de Áreas de Conservación y la\nComisión Nacional para la Sostenibilidad Forestal asumir las responsabilidades derivadas\nde este Decreto Ejecutivo y coordinar sus actuaciones según lo que se disponga\nen el articulado del presente Decreto Ejecutivo, con el fin de ejecutar las\nmedidas atinentes a sus competencias de forma eficiente.\n\nArtículo 4.\nInclusión de la certificación en las compras públicas sustentables. Las instituciones\nde la administración central y descentralizada deberán incluir como requisito para\nlas compras sustentables de productos maderables la certificación \"Madera\nLegal Costa Rica\". Lo anterior aplicará para aquellos productos que formen\nparte del alcance de esta certificación.\n\nArtículo 5.\nAlcance de la certificación. El sistema nacional de certificación de legalidad\nde la madera abarca la certificación de la madera en troza o aserrada, a través\nde una serie de requisitos, criterios e indicadores que garantizarán la\nlegalidad de los productos maderables, así como también, la formalidad de los\ninteresados. En el futuro se podrán incorporar otras categorías que se\nincluirán en el procedimiento interno del sistema de certificación.\n\nLa\ncertificación partirá de la verificación de manera proveniente de proyectos de aprovechamiento\nmaderable, industrias de transformación primaria y comercializadores de madera\naserrada con servicio de aserrío de terceros.\n\nPara su ejecución, la Oficina Nacional Forestal se encargará de administrar el sistema de\ncertificación y los regentes forestales podrán acreditarse como certificadores forestales ante el\nSistema Nacional de Áreas de Conservación para que realicen las verificaciones requeridas para\nasegurar que la persona (física o jurídica) solicitante cumpla con los requisitos enunciados en el\nartículo 8 de este decreto. Cada acto de verificación se hará constar a través de un informe de\nregencia forestal que a su vez se reconocerá como el informe de certificación para obtenerla por\nprimera vez o mantenerla incluyendo subsanaciones de no conformidades cuando corresponda en el plazo\nele vigencia según lo establecido en el Manual de Procedimientos de Madera Legal Costa Rica.\n\nArtículo 6.\nComposición. El sistema nacional ele\ncertificación ele legalidad de la madera está compuesto de las siguientes\ncategorías, modalidades y sub modalidades:\n\n \n\n*La habilitación ele esta u\notras categorías se establecerán mediante resolución publicada en el diario\noficial La Gaceta.\n\nArtículo 7.\nCompetencias institucionales. En la gobernanza del presente sistema nacional de\ncertificación se interrelacionan las siguientes instituciones y competencias:\n\na) Oficina\nNacional Forestal\n\n1. Administrar el sistema nacional de certificación ele legalidad de la madera: \"Madera Legal Costa\nRica\".\n\n2. Comunicar\na la AFE y la CNSF el listado ele regentes forestales con la capacitación ele\ncertificación aprobada.\n\n3. Promover\nel sistema nacional de certificación ante los actores involucrados y público en\ngeneral.\n\n4. Conformar\nexpedientes y registros ele los proyectos de aprovechamiento y empresas\ncertificadas y comunicar a la AFE cuando así lo requiera.\n\n5. Coordinar\nla capacitación ele los certificadores forestales.\n\n6. Generar\nlos códigos QR para los proyectos ele aprovechamiento y empresas certificadas.\n\n7. Mantener\nel portafolio ele las empresas certificadas actualizado en la página web.\n\n8. Coordinar\ncon SINAC la desacreditación ele los regentes acreditados como certificadores\nforestales que corresponda.\n\n9. Atender\ndudas o consultas sobre el sistema de certificación.\n\n10. Realizar\nesfuerzos para enlazar la oferta con la demanda de productos certificados.\n\n11. Orientar\na las personas interesadas en interponer una denuncia ligada al sistema\nnacional de certificación de legalidad de la madera sobre la forma efectiva de\ntramitarla.\n\n12. Notificar\na los regentes cuando queda en efecto la acreditación y desacreditación como\ncertificadores forestales.\n\nb) Comisión\nNacional para la Sostenibilidad Forestal\n\n1. Realizar\nrecomendaciones a la AFE sobre oportunidades de mejora para \"Madera Legal\nCosta Rica\" como sistema nacional de certificación forestal.\n\n2. Recomendar\na la AFE la acreditación de los certificadores forestales cuando le sea\nsolicitado.\n\n3. Recomendar\na la AFE la suspensión de la acreditación de los certificadores forestales\ncuando sea comunicado por parte del CIAGRO.\n\n4. Recomendar\na la AFE la desacreditación de los certificadores forestales que voluntariamente\nlo soliciten o cuando hayan incumplido requisito(s) o la normativa vigente.\n\nc) Colegio de\nIngenieros Agrónomos\n\n1. Apoyar la\ncapacitación de los certificadores forestales con la ONF.\n\n2. Crear y\nsupervisar la nueva modalidad de regencia forestal en la industria de transformación\nprimaria.\n\n3. Habilitar\nla presentación de una adenda, cuando corresponda, al formulario de regencia\nforestal para que se reconozca que la persona regentada optó por el proceso de\ncertificación.\n\n4. Recibir\nlos informes de regencia y fiscalizar el ejercicio profesional.\n\n5. Enviar\noportunamente a la AFE el listado de los regentes acreditados como certificadores\nforestales que se encuentren suspendidos por faltas graves.\n\nd) Sistema\nNacional de Áreas de Conservación\n\n1. Generar\nlos convenios necesarios con la ONF u otros para proceder de forma eficiente\ncon la ejecución del presente sistema nacional de certificación.\n\n2. Colaborar\nen la capacitación de los certificadores forestales.\n\n3. Solicitar\nlos informes de. regencia forestal ligados a las diferentes categorías de certificación\nde la legalidad de la madera a la ONF cuando lo requiera.\n\n4. Comunicar\na la ONF y al CIAGRO sobre el hallazgo de anomalías en proyectos de\naprovechamiento e industrias certificadas o en proceso.\n\n5. Acreditar\na los regentes forestales que fungirán como certificadores forestales de acuerdo\ncon la recomendación de la CNSF.\n\n6. Suspender\nla acreditación a los regentes forestales que fungen como certificadores forestales\nde acuerdo con la recomendación de la CNSF.\n\n7. Enviar\noportunamente a la CNSF el listado de los regentes acreditados como certificadores\nforestales suspendidos enviada por CIAGRO.\n\n8. Comunicar\na la ONF la acreditación y desacreditación de los certificadores forestales.\n\n9. Monitorear\nla correcta ejecución de las diferentes categorías del sistema nacional de\ncertificación de legalidad de la madera en lo que respecta a las acciones de\nlos regentados y regentes forestales acreditados como certificadores\nforestales.\n\nArtículo 8.\nRequisitos. Las personas interesadas en\nparticipar en el sistema ele certificación \"Madera Legal Costa Rica\"\ndeberán cumplir con los requisitos que se detallan a continuación:\n\na) Requisitos\ngenerales\n\n1. Estar al\ndía con las obligaciones tributarias, según lo establece la Ley Nº 9428. Esta información\nserá constatada por la ONF, en la Página Web del Ministerio ele Hacienda (Administración\nTributaria Virtual).\n\n2. Estar al\ndía en el pago ele las cuotas patronales y obreras ele la Caja Costarricense\ndel Seguro Social, o bien, poseer un arreglo de pago aprobado, según lo\nestablece la Ley Nº 9686. Esta información será constatada por la ONF, en la\nPágina Web de la Caja Costarricense de Seguro Social.\n\n3. Contar con\nel seguro obligatorio de riesgos de trabajo (RT), según lo establece la Ley Nº\n2, a excepción de los casos que indica el artículo 194 del Código de Trabajo.\n\nb) Requisitos\nespecíficos para la categoría de aprovechamiento maderable.\n\nAdicionalmente,\na los requisitos generales, las personas interesadas deberán cumplir con los\nsiguientes requisitos:\n\n1.\nComprometerse mediante declaración ju rada a desarrollar la actividad de\nacuerdo con los principios, criterios e indicadores de sostenibilidad forestal\nsegún corresponda (DE N°34559, artículo 2; DE Nº39952, artículo 5; DE Nº27388\nartículo 2, y sus modificaciones). En el caso de las plantaciones forestales\nel· acatamiento de los principios, criterios e indicadores son voluntarios.\n\n2. Contar con\nun formulario de regencia forestal debidamente inscrito ante el CIAGRO y\nvigente o resolución emitida por CIAGRO (en caso de las inscripciones en\nlínea), a excepción de los proyectos que no cuentan con PSA, en cuyo caso se\ndeberá presentar posterior a la aprobación de la inscripción por parte de ONF.\n\n3. Presentar\nun estudio técnico realizado por un profesional forestal cuyo contenido dependerá\nde la subcategoría y modalidad de certificación y se detalla a continuación:\n\ni. Para la\nsubcategoría de proyectos en la modalidad de plantaciones forestales: ubicación\nadministrativa, colindantes registrales, ubicación del área del proyecto respecto\na las áreas silvestres protegidas, uso actual, descripción del sitio, acceso a\nla propiedad, pendiente, pedregosidad, profundidad de suelo, acceso dentro de\nla finca, resultados de las muestras de suelo y su interpretación e indicar,\ncuando corresponda, las recomendaciones o acciones requeridas, evaluación de\nlos factores físico-ambientales, ecológicos y silviculturales, con los que deberá\nrecomendar la(s) especie(s), sitios a- plantar y el manejo de la(s) misma (s), especies,\ndensidad de plantación, turno de corta, programa de actividades de mantenimiento\ny manejo silvicultura! y preparación del terreno antes del establecimiento,\ntipo de material de reforestación a emplear, área efectiva por especie,\nsobrevivencia, estado titosanitario, cronograma anual de las actividades silviculturales\na realizar hasta la cosecha final, localización y cuantificación de las superficies\nocupadas por otros usos de la tierra (infraestructura existente, zonas de protección,\netc.), perímetro de la finca y el área a certificar, linderos y actividades de\nprevención de incendios, dominio de la propiedad, otros.\n\nii. Para la\nsubcategoría de proyectos en la modalidad de bosques: nombre del dueño del\ninmueble, número de cédula, folio(s) real (es), número(s) de plano, área(s)\ntotal (es) de folio(s), uso actual, ubicación administrativa y la dirección\nexacta de la(s) finca(s), colindantes registrales, indicar si el área a someter\nse encuentra dentro de un área\nsilvestre protegida, señalando el nombre de la misma, detallar las áreas de protección,\ncuantificar y deducir del área efectiva las áreas ocupadas por caminos primarios\ny patios de acopio, infraestructuras y otros usos, indicar si eventualmente\nquedaron previstas labores silviculturales después del cierre del plan de\nmanejo, aportar los archivos digitales del perímetro de la finca y el área a certificar,\nindicar si él o las áreas a certificar están dentro ele los sitios en arrendamiento\no no, estado de los linderos y las actividades de prevención de incendios\nejecutadas.\n\nc) Requisitos\nespecíficos para las categorías de industria primaria de la madera, comercialización\nele madera aserrada con aserrío de terceros e industria secundaria de la madera.\nAdicionalmente, a los requisitos generales, las personas interesadas deberán cumplir\ncon los siguientes requisitos:\n\n1. Contar con\nel permiso sanitario de funcionamiento de acuerdo con el Decreto Ejecutivo\n39472.\n\n2. Contar con\nla patente comercial municipal al día.\n\n3. Estar\ninscrito en el registro de industrias de SINAC, de acuerdo con el Decreto ejecutivo\n25721, artículo 72. (aplica únicamente para industrias de transformación primaria).\n\n4. Contar con\nun contrato de regencia que deberá presentarse posterior a la aprobación de la\ninscripción por parte de ONF.\n\nd) Los\ndocumentos a presentar son los siguientes:\n\n1. Solicitud\nexpresa por la persona física o jurídica, interesada legitimada conteniendo la\nsiguiente información:\n\ni. Fecha y\nlugar.\n\nii. Nombre de\nla empresa (nombre de fantasía o comercial, cuando corresponda).\n\niii. Nombre\ncompleto del propietario(a), copropietarios(as), calidades del petente (estado\ncivil, ocupación, domicilio exacto) y número de cédula de identidad, pasaporte\no cédula de residencia; según sea el caso.\n\niv. Ubicación\nadministrativa del inmueble en donde se desarrolla aprovechamiento maderable,\nindustria de transformación primaria o comercializadora de madera aserrada con\nservicio de aserrío de terceros.\n\nv. Medio para\nrecibir notificaciones.\n\nvi. Indicar\ndominio de propiedad del inmueble donde se desarrolla la actividad productiva\n(propietario, poseedor, arrendatario, etc).\n\nvii. Firma\ndel propietario o persona legitimada. Cuando se trate de un solicitante con incapacidad\npara firmar y deba hacerlo a través ele huella dactilar, se deberá autenticar\ncon notario público. La presentación en forma personal, será válida con una\nanotación que hará el funcionario de la ONF consignando la autenticidad.\n\nviii. En caso\nde servidumbres en terrenos de propiedad privada, la solicitud deberá presentarse\npor el titular o titulares del inmueble sobre el cual se constituye la servidumbre\ndebidamente inscrita sobre el tomo de inscripción de la finca.\n\nix. Indicar\nla categoría de certificación a la que quieren aplicar (proyecto de aprovechamiento\nmaderable, industrias de transformación primaria, comercializadores de madera\naserrada o industria de transformación secundaria).\n\nx. Indicar si\nla persona física o jurídica es propietario de otros inmuebles donde se haya\naprovechado en el último año, se esté aprovechando o se aprovechará (indicar\nnúmero de finca, ubicación y estado del aprovechamiento), esto con la finalidad\nde conocer si la persona física o jurídica cuenta con otros inmuebles donde se\nhaya dado o se realizará aprovechamiento maderable, los cuales no están\ninscritos en la certificación. Aplica para la categoría de aprovechamiento maderable.\n\nxi. Indicar\nsi la persona física o jurídica es propietario de otras industrias de transformación\nprimaria adicionales a la que se está inscribiendo para obtener la certificación\n(indicar nombre y ubicación). Aplica para las categorías de industrias ele\ntransformación primaria.\n\nxii. Indicar\nsi la persona física o jurídica es propietario de otras comercializadoras de madera\naserrada con servicio de aserrío de terceros (indicar nombre y ubicación). Aplica\npara la categoría de comercializadores de madera aserrada con servicio de aserrío\nde terceros.\n\nxiii. En caso\nde proyectos de reforestación y bosques sometidos al programa de Pago de\nServicios Ambientales, se deberá indicar el número de contrato.\n\nxiv. En caso\nde industrias y comercializadores que cuenten con viabilidad ambiental de\nSETENA se deberá indicar el número de resolución.\n\nxv. Indicar·\nel número de resolución del registro de industrias de SINAC (aplica únicamente\npara la categoría de industrias de transformación primaria).\n\n2. Si la\nsolicitud la realiza una tercera persona, deberá presentar un Poder Especial\nfísico o digital, conforme a lo establecido en el Artículo 1256 del Código\nCivil, en el que se especifique el acto o actos a los que ha sido facultado.\n\n3. Para\ninmuebles donde no se ha concluido con la etapa de inscripción en el Registro Nacional,\nes necesario presentar copia certificada de la sentencia en firme de la información\nposesoria concluida. La certificación de este documento podrá ser de notario(a)\npúblico o del Juzgado correspondiente.\n\n4. Cuando se\ntrate de inmuebles cuya situación de tenencia está por resolverse a través de\nun proceso sucesorio, deberá presentarse la correspondiente copia certificada,\nde la resolución judicial sobre el nombramiento del albacea, con menos de tres\nmeses de emitida, por el juzgado correspondiente o por Notario.\n\n5. Permiso sanitario\nde funcionamiento emitido por la municipalidad correspondiente: Aplica para\nindustrias de transformación primaria de la madera y comercializadores de\nmadera aserrada con servicio de aserrío de terceros. Se deberá presentar copia\ndel permiso sanitario de funcionamiento vigente.\n\n6. Patente\nmunicipal: En caso de industrias de transformación primaria de la madera y comercializadores\nde madera aserrada con servicio de aserrío de terceros. Se deberá presentar\ncopia de la patente municipal vigente.\n\n7. Constancia\nde registro único tributario (arreglo de pago): Este documento deberá presentarse\núnicamente si el solicitante (persona física o jurídica) tiene un arreglo de pago\ncon el Ministerio de Hacienda.\n\n8.\nObligaciones obrero - patronales (arreglo de pago): Este documento deberá presentarse\núnicamente si el solicitante (persona física o jurídica) tiene un arreglo de pago\ncon la CCSS.\n\n9. Copia\npóliza de riesgos: El solicitante (persona física\no jurídica) debe presentar constancia de la póliza de riesgos del trabajo\nvigente.\n\n10. Copia del\nformulario de regencia forestal inscrito o resolución emitida por el ClAGRO en\ncaso de las inscripciones en línea a través del SIGEREFO (aplica para la\ncategoría de aprovechamiento maderable a excepción de los proyectos sin PSA).\n\n11. Estudio\ntécnico elaborado por un profesional forestal (aplica para plantaciones forestales\ny bosques).\n\n12.\nDeclaración jurada: El solicitante (persona física o jurídica) debe presentar\nuna declaración jurada indicando lo siguiente:\n\ni. Compromiso\npara cumplir con los principios, criterios e indicadores y/o stándares de\nsostenibilidad que garantizan el manejo forestal sostenible (en el caso de la\ncategoría de aprovechamiento maderable en bosques y plantaciones).\n\nii. Indicar\nque los salarios y demás condiciones laborales de los colaboradores son al\nmenos los mínimos de ley.\n\niii. Indicar el promedio del volumen de consumo anual de madera en troza y aserrada en caso de\nindustrias de transformación primaria y comercializadores de madera aserrada con servicio de aserrío\nde terceros. El volumen a reportar deberá ser el volumen promedio de los últimos cuatro años de\noperación de la empresa. En caso de empresas que tengan menos de 4 años de operación, deberán\nindicar el promedio de consumo de madera anual de acuerdo con el tiempo de operación. Para el caso\nde empresas con menos de 1 año de operación, se deberá indicar una proyección del volumen a consumir\nen el año de certificación.\n\nLos\ndocumentos previamente descritos, según corresponda, deberán adjuntarse al\nformulario de solicitud de inscripción al sistema de certificación \"Madera\nLegal Costa Rica\" el cual podrá realizarse en línea o de manera personal a\ntravés de la ONF.\n\nArtículo 9.\nFuncionamiento. El sistema\nnacional de certificación de legalidad de la madera dispone en la página web:\nwww.maderalegal.org de un procedimiento interno elaborado por la Oficina\nNacional Forestal, institución administradora de esta certificación, el cual contempla\nlas siguientes secciones:\n\na)\nLineamientos para las personas interesadas en inscribirse y certificar sus\nproyectos\n\ny/o\nproductos.\n\nb) Recepción\nde solicitudes de inscripción al sistema de certificación\n\nc) Variables\nele verificación\n\nd)\nProcedimiento de verificación\n\ne) Aceptación\no rechazo del sistema de certificación\n\nf) Emisión\ndel certificado\n\n1.\nCertificación de proyectos de aprovechamiento maderable\n\n2.\nCertificación de industrias de transformación primaria\n\n3.\nCertificación de comercializadores de madera aserrada con servicio de aserrío\nde terceros.\n\ng) Inclusión\nal portafolio de proveedores certificados\n\nh)\nSeguimiento y visitas\n\ni) Vigencia\n\nj) Informes\n\nk) Otros\n\nAdicionalmente,\nla ONF dispondrá de dos procedimientos internos de uso de código QR y sello ele\ncertificación para productos y documentación. Ambos procedimientos estarán disponibles\nen la página web: www.macleralegal.org del sistema de certificación y deberán ser\nacatados en su totalidad por las personas interesadas en certificar sus\nproductos y/o proyectos.\n\nArtículo 10.\nRegencia forestal. Se deberá inscribir el respectivo formulario de regencia forestal\nante el Colegio de Ingenieros Agrónomos de Costa Rica, en el cual se deberá\nhacer constar que el regentado (persona interesada en la certificación) optará\npor el sistema nacional de certificación de legalidad de la madera y en los\ncasos que corresponda se desarrollará una adenda al formulario de regencia\nforestal que incluya la información requerida respecto a cada categoría de\ncertificación.\n\nArtículo 11.\nAcreditación de certificadores. Los regentes forestales que opten por fungir\ncomo certificadores del sistema de certificación \"Madera Legal Costa\nRica\" deberán acreditarse ante la AFE, para lo cual la CNSF realizará, en\nprimera instancia, la recomendación respectiva previo al cumplimiento de los siguientes\nrequisitos:\n\na) Ser\nregente forestal acreditado ante el CIAGRO, en cumplimiento con todas sus obligaciones\npara ejercer la regencia y que no esté descontando alguna suspensión en su\nfigura como regente.\n\nb) Haber\naprobado la capacitación de la nueva modalidad de regencia forestal ligada a la\ncertificación de legalidad de la madera a cargo de la ONF, CIAGRO y SINAC.\n\nc) No poseer\nsanciones por faltas que procedan a la suspensión como regente por un periodo\nmayor o igual a 9 meses, en los últimos 5 años de ejercicio de la regencia forestal\nde acuerdo con las disposiciones de la Ley Orgánica del CIAGRO, Reglamento de\nla Ley Orgánica del ClAGRO y el Código de ética profesional del CIAGRO, esto\ncon el fin de garantizar la idoneidad de los certificadores forestales.\n\nEn caso de\nque se aplique esta sanción, se procederá a la suspensión de la acreditación de\ncertificador forestal por un lapso de 5 años.\n\nLas\ncapacitaciones para los regentes forestales interesados en acreditarse como\ncertificadores serán realizadas por la ONF.\n\nArtículo 12. Los\nartículos 3, 4, 5, 8, 9 y 10 del Decreto Ejecutivo Nº 30310-MINAE \"Reforma\nReglamento a la Ley Forestal y Reconoce al Sistema de Certificación Forestal\ndel Consejo de Manejo forestal como un Sistema Nacional de Certificación del 17\nde abril del 2022, será norma complementaria a este decreto ejecutivo.\n\nDichos\nartículos establecen los principios fundamentales del reconocimiento nacional\nde la certificación forestal, los cuales garantizan el reconocimiento legal de\nlos certificados otorgados por entidades acreditadas, regulan la administración\ny transparencia del registro de certificaciones, y permiten la acreditación de\nnuevos certificadores. Además, fomentan el uso de madera y productos\ncertificados en el sector público y establecen mecanismos de trazabilidad para\nasegurar su origen sostenible.\n\nArtículo 13.\nProcedimientos. La ONF elaborará el manual de procedimientos para que las personas\ninteresadas en inscribirse en \"Madera Legal Costa Rica\" como sistema\nnacional de certificación de la madera, puedan orientarse de forma efectiva\nsobre actividades, plazos y acciones administrativas correctivas que deberán\nllevar a cabo como parte del proceso de certificación. Dicho manual se\npublicará en la página web: www.maderalegal.org como máximo 1 mes posterior a\nla publicación del presente decreto y además serán comunicados a las personas\ninteresadas a través de correo electrónico,\n\nTransitorio\nI. That\nthrough Law No. 9143, of June 11, 2013, Costa Rica signed the\ninstrument of adhesion to the International Tropical Timber Agreement,\npromoting global efforts for the sustainable use of\ntropical forests through the adoption of measures and public policies that\ntend to improve the management, use, and conservation of tropical forests and their\ngenetic resources.\n\n2. That\nArticle 48 of Law No. 7554 of October 4, 1995, Organic Environmental Law (Ley Orgánica del Ambiente)\nestablishes that it is the State's obligation to conserve, protect, and manage the\nforest resource. For these purposes, the law that is issued must regulate\nmatters related to the production, use (aprovechamiento), industrialization, and promotion\nof these resources, guaranteeing their sustainable use, as well as the generation of\ndecent employment and the improvement of the standard of living of social groups\ndirectly related to forestry activities.\n\n3. That\nArticle 1 of Law No. 7575 of February 13, 1996, Forestry Law (Ley Forestal), establishes\nas an essential and priority function of the State to ensure the conservation,\nprotection, and management of natural forests and the production,\nuse (aprovechamiento), industrialization, and promotion of the country's forest resources\ndestined for that purpose, in accordance with the principle of adequate and\nsustainable use of renewable natural resources. Furthermore, it will ensure the\ngeneration of employment and the increase in the standard of living of the rural population,\nthrough their effective incorporation into forestry activities.\n\n4. That the Forestry Law (Ley Forestal) No. 7575, in Article 6 paragraph o), indicates that the powers of the\nState Forest Administration (AFE) are as follows: \"o) Grant forest certifier\nlicenses, upon the proposal of a commission composed of representatives of recognized national and foreign academic and\nscientific entities, prominent in the environmental field. This commission\nwill also be entrusted with regulating and monitoring the system of green seals or forest\ncertifications. The requirements to qualify as a forest certifier, the composition of the aforementioned\ncommission, its responsibilities, and operation will be established in the regulations of this law.\"\n\n5. That in\nArticles 7 and 10 of the Forestry Law (Ley Forestal) No. 7575, the National Forestry Office (ONF) is created,\nas a non-state public entity with its own legal personality, as well as its\nfunctions.\n\n6. That the\nRegulation to the Forestry Law (Ley Forestal) No. 7575, Executive Decree No. 25721 of October 17,\n1996, in its seventh chapter refers to forest\ncertifications and specifically Article 26 creates and establishes the functions of\nthe National Commission for Forest Sustainability (CNSF).\n\n7. That\nArticle 28 of the same Regulation states that \"Those interested in obtaining\nforest certification voluntarily may contract the services\nof a certifier authorized by the AFE.\"\n\n8. That Executive\nDecree No. 27695, of January 21, 1999, establishes the Manual of Procedures\nfor the Accreditation of Forest Certifiers, where Article 2 mentions the\nrequirements for the application and Articles 3, 4, 5, and 6 establish the\nprocessing of applications. It is worth noting that the requirements and procedures\naforementioned are only applicable to the Forest Stewardship Council (FSC) Forest Certification System.\n\n9. That\nExecutive Decree No. 30310-MINAE of April 17, 2002, Reform to the Regulation\nof the Forestry Law and Recognition of the Forest Stewardship Council Forest Certification System as a National Certification System, in its Article 2\nestablishes that: \"The Forest Stewardship\nCouncil Forest Certification System, known by its acronym in English as F.S.C., is recognized as\na National Certification System, and therefore, the certifiers\nduly accredited before it and the certificates granted by them in the country are recognized.\nThe foregoing without prejudice to the future recognition or development of other\nnational or international schemes that may be considered National\nCertification Systems.\" The foregoing allows the recognition or\ndevelopment of another national or international system different from the \"FSC\" certification\noriginally recognized.\n\n10. That\nArticle 5 of Executive Decree No. 30310-MINAE indicates that the State Forest Administration (AFE), upon prior recommendation of the National Forest Certification Commission, may accredit other certifiers; therefore, there is\nthe opportunity to create a national wood legality certification system that has its own certifiers.\n\n11. That Article 3 of Executive Decree No. 41772-MINAE of June 5, 2019, on\nGuiding Principles of the Productive Forest Sector, establishes the following: \"In accordance with\nthe provisions of Executive Decree No. 39310 of January 27, 2015, \"National Policy for Sustainable\nPublic Procurement and Creation of the National Steering Committee for Sustainable Procurement\", all\ninstitutions of the Central and Decentralized Administration must incorporate within the Institutional\nEnvironmental Management Plans the pertinent and necessary actions aimed at the\nsubstitution of products with a high carbon footprint, prioritizing the use of national\nharvested wood in order to effectively contribute to the National Decarbonization Plan and\nthe Nationally Determined Contribution of Costa Rica to the United Nations Framework\nConvention on Climate Change.\"\n\n12. That\nDirective 050-MINAE of June 5, 2019, on sustainable construction\nin the public sector, in Annex 2 (Anexo 2), which contains the\nsustainability criteria for application in new constructions, criterion 3 makes\nreference to specifying from the design stage the materials to be used,\nwhere two of its strategies indicate: \"The wood used has a\nsustainability certification recognized by the competent entity (MINAE).\n\"\n\n13. That in\naccordance with Article 12 bis of Executive Decree No. 37045-MP-MEIC of\nFebruary 22, 2012, and its amendments, \"Regulation to the Law for the Protection of the Citizen from Excessive Requirements and Administrative Procedures,\" the first step, Section I called Prior Control of Regulatory\nImprovement, has been completed, which comprises the Cost-Benefit Evaluation form, and the\nresponses provided in that Section have all been negative, since the\npresent proposal does not contain procedures or requirements that the administered party must\ncomply with.\n\nTherefore;\n\nTHEY DECREE:\n\nCREATION OF THE\nNATIONAL CERTIFICATION SYSTEM\n\n\"MADERA\nLEGAL COSTA RICA\"\n\nArticle 1.\nAcronyms. The following abbreviations\nwith their respective meanings shall be used in this executive decree:\n\nAFE:\nState Forest Administration (Administración Forestal del Estado)\n\nCNSF:\nNational Commission for Forest Sustainability (Comisión Nacional para la Sostenibilidad Forestal)\n\nCIAGRO:\nCollege of Agronomists of Costa Rica (Colegio de Ingenieros Agrónomos de Costa Rica)\n\nONF: National\nForestry Office (Oficina Nacional Forestal)\n\nSINAC:\nNational System of Conservation Areas (Sistema Nacional de Áreas de Conservación)\n\nPSA: Payment for\nEnvironmental Services (Pago por Servicios Ambientales)\n\nSIGEREFO:\nForestry Management (Regencia) Management System (Sistema de Gestión de Regencias Forestales)\n\nArticle 2.\nCreation of the national certification system. The national certification\nsystem \"Madera Legal Costa Rica\" is created; this system is voluntary\nfor the national wood legality certification, therefore,\nthe certifiers duly accredited before it and the\ncertificates granted by them in the country are recognized. Its objective is to promote the use and\nconsumption of legal and sustainable national wood, as well as the strengthening of the\nforestry sector through the creation of a viable certification at a legal,\ntechnical, administrative, and financial level.\n\nThis certification\nsystem shall be administered by the National Forestry Office (ONF) and shall facilitate\ninter-institutional linkage with the National System of Conservation Areas (SINAC), the National Commission for Forest Sustainability (CNSF), and the College of Agronomists of Costa Rica (CIAGRO).\n\nArticle 3.\nResponsibility of the linked institutions. The State Forest Administration (AFE), through the National System of Conservation Areas (SINAC) and the National Commission for Forest Sustainability (CNSF), is instructed to assume the responsibilities derived\nfrom this Executive Decree and to coordinate its actions according to what is provided\nin the articles of this Executive Decree, in order to execute the\nmeasures pertaining to its competencies efficiently.\n\nArticle 4.\nInclusion of the certification in sustainable public procurement. The institutions\nof the central and decentralized administration must include the \"Madera\nLegal Costa Rica\" certification as a requirement for\nsustainable procurement of wood products. The foregoing shall apply to those products that form\npart of the scope of this certification.\n\nArticle 5.\nScope of the certification. The national wood legality certification\nsystem encompasses the certification of roundwood or sawn wood, through\na series of requirements, criteria, and indicators that will guarantee the\nlegality of the wood products, as well as the formality of the\ninterested parties. In the future, other categories may be incorporated that will\nbe included in the internal procedure of the certification system.\n\nThe\ncertification will start from the verification of wood from timber harvesting (aprovechamiento maderable) projects, primary transformation industries, and sawn wood\nmarketers with third-party sawmilling services.\n\nFor its execution, the National Forestry Office (ONF) will be responsible for administering the certification\nsystem, and forestry managers (regentes forestales) may be accredited as forest certifiers before the\nNational System of Conservation Areas (SINAC) so that they carry out the verifications required to\nensure that the requesting person (individual or legal entity) meets the requirements set forth in\nArticle 8 of this decree. Each verification act shall be recorded through a forestry management (regencia forestal) report, which in turn shall be recognized as the certification report for obtaining it\nfor the first time or maintaining it, including rectifications of non-conformities when applicable within the\nvalidity period as established in the Madera Legal Costa Rica Procedures Manual.\n\nArticle 6.\nComposition. In the governance of this national certification\nsystem, the following institutions and competencies are interrelated:\n\na) National\nForestry Office (ONF)\n\n1. Administer the national wood legality certification system: \"Madera Legal Costa\nRica\".\n\n2. Notify\nthe AFE and the CNSF of the list of forestry managers (regentes forestales) with the approved certification\ntraining.\n\n3. Promote\nthe national certification system to the stakeholders involved and the general\npublic.\n\n4. Create\nrecords (expedientes) and registries of the harvesting (aprovechamiento) projects and certified\ncompanies, and notify the AFE when it so requires.\n\n5. Coordinate\nthe training of forest certifiers.\n\n6. Generate\nQR codes for the harvesting (aprovechamiento) projects and certified companies.\n\n7. Maintain\nthe portfolio of certified companies updated on the website.\n\n8. Coordinate\nwith SINAC the disaccreditation of\nforestry managers (regentes) accredited as forest certifiers as applicable.\n\n9. Address\ndoubts or queries about the certification system.\n\n10. Make\nefforts to link the supply with the demand for certified products.\n\n11. Guide\nthe persons interested in filing a complaint related to the national wood legality certification system on the effective way to\nprocess it.\n\n12. Notify\nthe forestry managers (regentes) when the accreditation and disaccreditation as\nforest certifiers takes effect.\n\nb) National\nCommission for Forest Sustainability (CNSF)\n\n1. Make\nrecommendations to the AFE on improvement opportunities for \"Madera Legal\nCosta Rica\" as a national forest certification system.\n\n2. Recommend\nto the AFE the accreditation of forest certifiers when\nrequested.\n\n3. Recommend\nto the AFE the suspension of the accreditation of forest certifiers\nwhen notified by the CIAGRO.\n\n4. Recommend\nto the AFE the disaccreditation of forest certifiers who voluntarily\nrequest it or when they have failed to comply with requirement(s) or current regulations.\n\nc) College of\nAgronomists (Colegio de Ingenieros Agrónomos)\n\n1. Support the\ntraining of forest certifiers with the ONF.\n\n2. Create and\nsupervise the new forestry management (regencia forestal) modality in the primary transformation\nindustry.\n\n3. Enable\nthe submission of an addendum, when applicable, to the forestry management (regencia forestal)\nform so that it is recognized that the managed person opted for the\ncertification process.\n\n4. Receive\nthe management (regencia) reports and oversee the professional practice.\n\n5. Promptly\nsend to the AFE the list of managers (regentes) accredited as certifiers\nforestales who are suspended for serious infractions.\n\nd) National\nSystem of Conservation Areas (SINAC)\n\n1. Generate\nthe necessary agreements with the ONF or others to proceed efficiently\nwith the execution of this national certification system.\n\n2. Collaborate\nin the training of forest certifiers.\n\n3. Request\nthe forestry management (regencia forestal) reports linked to the different certification\ncategories for wood legality from the ONF when required.\n\n4. Notify\nthe ONF and the CIAGRO of the finding of anomalies in harvesting (aprovechamiento)\nprojects and certified or in-process industries.\n\n5. Accredit\nthe forestry managers (regentes forestales) who will act as forest certifiers in accordance\nwith the recommendation of the CNSF.\n\n6. Suspend\nthe accreditation of forestry managers (regentes forestales) who act as forest certifiers\nin accordance with the recommendation of the CNSF.\n\n7. Promptly\nsend to the CNSF the list of managers (regentes) accredited as forest\ncertifiers who are suspended, sent by CIAGRO.\n\n8. Notify\nthe ONF of the accreditation and disaccreditation of forest certifiers.\n\n9. Monitor\nthe correct execution of the different categories of the national\nwood legality certification system with respect to the actions of\nthe managed parties and forestry managers (regentes forestales) accredited as forest\ncertifiers.\n\nArticle 8.\nRequirements. Persons interested in\nparticipating in the \"Madera Legal Costa Rica\" certification system\nmust comply with the requirements detailed below:\n\na) General\nrequirements\n\n1. Be up to\ndate with tax obligations, as established by Law No. 9428. This information\nshall be verified by the ONF, on the Website of the Ministry of Finance (Virtual\nTax Administration).\n\n2. Be up to\ndate in the payment of employer and worker contributions to the Costa Rican\nSocial Security Fund, or have an approved payment arrangement, as\nestablished by Law No. 9686. This information shall be verified by the ONF, on the\nWebsite of the Costa Rican Social Security Fund.\n\n3. Have\nmandatory work risk insurance (RT), as established by Law No.\n2, except for the cases indicated in Article 194 of the Labor Code.\n\nb) Specific\nrequirements for the timber harvesting (aprovechamiento maderable) category.\n\nIn addition\nto the general requirements, interested persons must comply with the\nfollowing requirements:\n\n1.\nCommit, through a sworn statement, to developing the activity in\naccordance with the principles, criteria, and indicators of forest sustainability\nas applicable (DE No. 34559, Article 2; DE No. 39952, Article 5; DE No. 27388\nArticle 2, and its amendments). In the case of forest plantations,\ncompliance with the principles, criteria, and indicators is voluntary.\n\n2. Have a\nforestry management (regencia forestal) form duly registered before the CIAGRO and\nin force, or a resolution issued by CIAGRO (for online\nregistrations), except for projects that do not have PSA, in which case it\nmust be submitted after the approval of registration by the ONF.\n\n3. Present\na technical study carried out by a forestry professional, whose content will depend\non the sub-category and modality of certification and is detailed below:\n\ni. For the\nsub-category of projects in the forest plantation modality: administrative\nlocation, registered adjacent properties, location of the project area with respect\nto protected wild areas, current use, site description, access to\nthe property, slope, stoniness, soil depth, access within\nthe estate, results of the soil samples and their interpretation, and indicate,\nwhen applicable, the recommendations or required actions, evaluation\nof the physical-environmental, ecological, and silvicultural factors, with which\nit must recommend the species, planting\nsites, and management of the same, species,\nplanting density, rotation cycle (turno de corta), maintenance activity program\nand silvicultural management, and land preparation before establishment,\ntype of reforestation material to be used, effective area per species,\nsurvival, phytosanitary status, annual schedule of silvicultural\nactivities to carry out until the final harvest, location and quantification of the surfaces\noccupied by other land uses (existing infrastructure, protection zones,\netc.), perimeter of the estate and the area to be certified, boundary lines (linderos), and\nfire prevention activities, property domain, others.\n\nii. For the\nsub-category of projects in the forest modality: owner's name of the\nproperty, identification number, registered estate number(s) (folio(s) real(es)), plan number(s), total\narea(s) of the registered estate(s) (folio(s)), current use, administrative location, and the exact\naddress of the estate(s), registered adjacent properties, indicate if the area to be submitted\nis located within a protected wild area, noting its name, detail the protection\nareas, quantify and deduct from the effective area the areas occupied by primary roads\nand log yards (patios de acopio), infrastructure, and other uses, indicate if eventually\nsilvicultural works were planned after the closure of the management\nplan, provide the digital files of the perimeter of the estate and the area to be certified,\nindicate whether the area or areas to be certified are within leased sites\nor not, status of boundary lines (linderos), and the\nfire prevention activities executed.\n\nc) Specific\nrequirements for the categories of primary wood industry, sawn\nwood marketing with third-party sawmilling, and secondary wood industry.\nIn addition to the general requirements, interested persons must comply\nwith the following requirements:\n\n1. Have the\nsanitary operating permit in accordance with Executive Decree\n39472.\n\n2. Have the\nmunicipal business license up to date.\n\n3. Be\nregistered in the SINAC industry registry, in accordance with Executive Decree\n25721, Article 72. (applies only to primary transformation industries).\n\n4. Have a\nmanagement (regencia) contract, which must be submitted after the approval of\nregistration by the ONF.\n\nd) The\ndocuments to be submitted are the following:\n\n1. Express\nrequest by the interested and legitimized individual or legal entity, containing the\nfollowing information:\n\ni. Date and\nplace.\n\nii. Company\nname (fantasy or trade name, when applicable).\n\niii. Full\nname of the owner(s), co-owner(s), applicant's qualities (marital\nstatus, occupation, exact domicile) and identification card number, passport,\nor residence card; as the case may be.\n\niv. Administrative\nlocation of the property where the timber harvesting (aprovechamiento maderable),\nprimary transformation industry, or sawn wood marketer with third-party\nsawmilling service is being developed.\n\nv. Means for\nreceiving notifications.\n\nvi. Indicate\nthe property ownership status of the real estate where the productive activity\nis developed (owner, possessor, lessee, etc.).\n\nvii. Signature\nof the owner or legitimized person. When it concerns an applicant unable\nto sign and must do so by fingerprint, it must be authenticated\nby a notary public. In-person submission will be valid with a\nnotation made by the ONF official attesting to authenticity.\n\nviii. In case\nof easements (servidumbres) on private property, the application must be submitted\nby the titleholder(s) of the property over which the easement (servidumbre) is constituted,\nduly registered in the estate's registration volume.\n\nix. Indicate\nthe certification category to which they wish to apply (timber harvesting project (proyecto de aprovechamiento maderable), primary transformation industries, sawn wood\nmarketers, or secondary transformation industry).\n\nx. Indicate if\nthe individual or legal entity is the owner of other properties where harvesting (aprovechamiento) has occurred in the last year, is occurring, or will occur (indicate\nestate number, location, and status of the harvesting (aprovechamiento)), this for the purpose\nof knowing if the individual or legal entity has other properties where timber harvesting (aprovechamiento maderable) has taken place or will take place, which are not\nregistered in the certification. Applies to the timber harvesting (aprovechamiento maderable) category.\n\nxi. Indicate\nif the individual or legal entity is the owner of other primary\ntransformation industries in addition to the one being registered for certification\n(indicate name and location). Applies to the primary\ntransformation industries categories.\n\nxii. Indicate\nif the individual or legal entity is the owner of other sawn wood\nmarketers with third-party sawmilling services (indicate name and location). Applies\nto the category of sawn wood marketers with third-party sawmilling\nservices.\n\nxiii. In case\nof reforestation projects and forests submitted to the Payment for\nEnvironmental Services (Pago de Servicios Ambientales) program, the contract number must be indicated.\n\nxiv. In case\nof industries and marketers that have environmental viability from\nSETENA, the resolution number must be indicated.\n\nxv. Indicate\nthe resolution number of the SINAC industry registry (applies only\nto the primary transformation industries category).\n\n2. If the\nrequest is made by a third party, they must submit a physical or digital Special Power of Attorney,\nin accordance with the provisions of Article 1256 of the Civil\nCode, specifying the act or acts for which they have been authorized.\n\n3. For\nproperties where the registration stage with the National Registry has not been completed,\nit is necessary to submit a certified copy of the final judgment of the concluded possessory\ninformation. The certification of this document may be by a notary\npublic or the corresponding Court.\n\n4. When\nit concerns properties whose tenure situation is to be resolved through\na probate process, the corresponding certified copy\nof the judicial resolution on the appointment of the executor, issued less than three\nmonths ago, by the corresponding court or by a Notary, must be submitted.\n\n5. Sanitary operating\npermit issued by the corresponding municipality: Applies for\nprimary wood transformation industries and sawn wood\nmarketers with third-party sawmilling services. A copy\nof the valid sanitary operating permit must be submitted.\n\n6. Municipal\nlicense: In the case of primary wood transformation industries and sawn wood\nmarketers with third-party sawmilling services. A copy\nof the valid municipal license must be submitted.\n\n7. Certificate\nof single tax registry (payment arrangement): This document must be submitted\nonly if the applicant (individual or legal entity) has a payment arrangement\nwith the Ministry of Finance.\n\n8. Worker-\nemployer obligations (payment arrangement): This document must be submitted\nonly if the applicant (individual or legal entity) has a payment arrangement\nwith the CCSS.\n\n9. Copy of\nthe risk insurance policy: The applicant (individual or legal\nentity) must submit proof of the valid work risk\ninsurance policy.\n\n10. Copy of the\nregistered forestry management (regencia forestal) form or resolution issued by the CIAGRO in\ncase of online registrations through the SIGEREFO (applies to the\ntimber harvesting (aprovechamiento maderable) category, except for projects without PSA).\n\n11. Technical\nstudy prepared by a forestry professional (applies to forest plantations\nand forests).\n\n12.\nSworn statement: The applicant (individual or legal entity) must submit\na sworn statement indicating the following:\n\ni. Commitment\nto comply with the principles, criteria, and indicators and/or sustainability\nstandards that guarantee sustainable forest management (in the case of the\ntimber harvesting (aprovechamiento maderable) category in forests and plantations).\n\nii. Indicate\nthat the salaries and other working conditions of the collaborators are at\nleast the legal minimum.\n\niii. Indicate the average annual volume of roundwood and sawn wood consumption in the case of\nprimary transformation industries and sawn wood marketers with third-party sawmilling\nservices. The volume to be reported must be the average volume of the last four years of\noperation of the company. In the case of companies that have been operating for less than 4 years, they must\nindicate the average annual wood consumption according to the operating time. For\ncompanies with less than 1 year of operation, a projection of the volume to be consumed\nin the certification year must be indicated.\n\nThe\npreviously described documents, as applicable, must be attached to the\napplication form for registration to the \"Madera Legal\nCosta Rica\" certification system, which may be done online or in person through\nthe ONF.\n\nArticle 9.\nOperation. The national\nwood legality certification system provides on the website:\nwww.maderalegal.org an internal procedure prepared by the National\nForestry Office (ONF), the administering institution of this certification, which contemplates\nthe following sections:\n\na)\nGuidelines for persons interested in registering and certifying their projects\n\nand/or\nproducts.\n\nb) Reception\nof applications for registration to the certification system\n\nc) Verification\nvariables\n\nd)\nVerification procedure\n\ne) Acceptance\nor rejection of the certification system\n\nf) Issuance\nof the certificate\n\n1.\nCertification of timber harvesting (aprovechamiento maderable) projects\n\n2.\nCertification of primary transformation industries\n\n3.\nCertification of sawn wood marketers with third-party\nsawmilling service.\n\ng) Inclusion\nin the certified supplier portfolio\n\nh)\nFollow-up and visits\n\ni) Validity\n\nj) Reports\n\nk) Others\n\nAdditionally,\nthe ONF will have two internal procedures for the use of the QR code and the certification\nseal for products and documentation. Both procedures will be available\non the certification system's website: www.maderalegal.org and must be\nfully complied with by persons interested in certifying their\nproducts and/or projects.\n\nArticle 10.\nForestry management (Regencia forestal). The respective forestry management (regencia forestal) form must be registered\nbefore the College of Agronomists of Costa Rica (CIAGRO), in which it must be\nstated that the managed party (person interested in the certification) will opt\nfor the national wood legality certification system, and in\ncases where applicable, an addendum to the forestry management (regencia\nforestal) form will be developed that includes the required information regarding each certification\ncategory.\n\nArticle 11.\nAccreditation of certifiers. The forestry managers (regentes forestales) who choose to act\nas certifiers of the \"Madera Legal Costa\nRica\" certification system must be accredited before the AFE, for which the CNSF will make,\nin the first instance, the respective recommendation prior to compliance with the following\nrequirements:\n\na) Be a\nforestry manager (regente forestal) accredited before the CIAGRO, in compliance with all their obligations\nto practice forestry management (regencia) and who is not serving any suspension in their\ncapacity as manager (regente).\n\nb) Having approved the training for the new forest management (regencia forestal) modality linked to the timber legality certification conducted by the ONF, CIAGRO, and SINAC.\n\nc) Not having sanctions for infractions that result in suspension as a forest regent for a period greater than or equal to 9 months, in the last 5 years of practicing as a forest regent in accordance with the provisions of the Ley Orgánica del CIAGRO, Reglamento de la Ley Orgánica del CIAGRO, and the Código de ética profesional of CIAGRO, this for the purpose of guaranteeing the suitability of forest certifiers.\n\nIn the event that this sanction is applied, the forest certifier accreditation shall be suspended for a period of 5 years.\n\nThe training courses for forest regents interested in becoming accredited as certifiers shall be conducted by the ONF.\n\nArticle 12. Articles 3, 4, 5, 8, 9, and 10 of Decreto Ejecutivo Nº 30310-MINAE \"Reforma Reglamento a la Ley Forestal y Reconoce al Sistema de Certificación Forestal del Consejo de Manejo Forestal como un Sistema Nacional de Certificación of April 17, 2022, shall be complementary rules to this executive decree.\n\nSaid articles establish the fundamental principles for the national recognition of forest certification, which guarantee the legal recognition of certificates issued by accredited entities, regulate the administration and transparency of the certification registry, and permit the accreditation of new certifiers. Furthermore, they promote the use of certified timber and products in the public sector and establish traceability mechanisms to ensure their sustainable origin.\n\nArticle 13. Procedures. The ONF shall prepare the manual of procedures so that individuals interested in enrolling in \"Madera Legal Costa Rica\" as the national timber certification system may effectively orient themselves regarding activities, deadlines, and corrective administrative actions that they must carry out as part of the certification process. Said manual shall be published on the website: www.maderalegal.org no later than 1 month after the publication of this decree and shall also be communicated to interested parties via electronic mail.\n\nTransitorio I. Within a period not exceeding 3 months from the publication of this decree, the Sistema Nacional de Áreas de Conservación (SINAC) must formalize the specific agreement with the Oficina Nacional Forestal for the purpose of executing the actions set forth in this Decreto Ejecutivo.\n\nArticle 14: Effective upon its publication.\n\nGiven at the Presidencia de la República, San José, on the seventh day of March, two thousand twenty-five."
