San José a las doce horas un minuto del primero de octubre de dos mil\nveinticinco. Se establece al Fondo Nacional de Financiamiento Forestal la\ncantidad de hectáreas a financiar por actividad en el Programa de C con base en\nlos recursos asignados.\n\nRESULTANDO\n\nÚNICO. -Que para el\nejercicio 2025 el Presupuesto Nacional dispone un total de diez mil novecientos\ncincuenta y un millones seiscientos ochenta y dos mil cuatrocientos seis\ncolones con 00/100 (¢10.951.682.406,00) para el Programa de Pago por Servicios Ambientales\n(en adelante PSA), los cuales serán utilizados para el pago de los compromisos\nde contratos PSA de años anteriores y la incorporación de nuevas hectáreas para\nel periodo 2025-2026.\n\nCONSIDERANDO\n\nPRIMERO: Que el artículo 38\ndel Reglamento a la Ley Forestal N° 7575, Decreto Ejecutivo N° 25721-MINAE, del\n17 de octubre de 1996, publicado en La Gaceta N°16 del día 23 de enero de 1997,\ny sus reformas, dispone que el Ministro de Ambiente y Energía como Jerarca de\neste Ministerio en funciones de la Administración Forestal del Estado, emitirá\nanualmente mediante Resolución Ministerial, las actividades a financiar en el\nPrograma de Pago por Servicios Ambientales o Ecosistémicos y los montos a pagar\ncon base en los recursos asignados en el Presupuesto Nacional para el ejercicio\ndel año fiscal 2025.\n\nSEGUNDO: Que, bajo este\nprincipio, los instrumentos financieros deben orientarse a apoyar los pilares\ndel Plan Nacional de Desarrollo y de Inversión Pública 2023-2026 (Rogelio\nFernández Güell) considerando los objetivos de la creación del Fondo Nacional\nde Financiamiento Forestal según la citada Ley Forestal, sin dejar de lado los\ncriterios de orden técnico establecidos.\n\nTERCERO: Que el Plan\nNacional de Desarrollo citado, considera como una de las metas nacionales el\nmantener bajo el Programa de Pago por Servicios Ambientales o Ecosistémicos, al\nmenos doscientas cincuenta mil hectáreas (500.000 has), en sus diferentes actividades.\n\nCUARTO: Que, el Ministerio\nde Ambiente y Energía ha emitido los Principios Rectores del Sector Forestal\nProductivo, mediante el Decreto Ejecutivo N°41772-MINAE, así como los lineamientos\na considerar en las gestiones institucionales para la reactivación y promoción\nde la reforestación en el país.\n\nQUINTO: Que la reforma al\nReglamento a la Ley Forestal, realizada mediante Decreto Ejecutivo N°\n44607-MINAE publicado en el Alcance número 145 a La Gaceta N° 156; establece\ncambios de fondo al Programa de Pago por Servicios Ambientales o Ecosistémicos,\npara reconocer de manera independiente los diferentes servicios ambientales a\npagar. Para tales efectos, se establecen tres servicios ambientales a\nreconocer: 1. Un pago base, que comprende los bosques con la función de\nmitigación de gases de efecto invernadero y protección de la biodiversidad; 2.\nUn pago adicional a los bosques que se ubiquen en áreas consideradas de alta\nbiodiversidad, megadiversos o zonas que por su fragilidad, conectividad o\ndeterioro que merecen ser preservadas y 3. Se reconoce un pago adicional a los\nbosques que por su ubicación coadyuven a la protección del recurso hídrico para\nfines de consumo humano, rural e hidroeléctrico.\n\nPOR TANTO:\n\nEL MINISTRO DE AMBIENTE Y\nENERGÍA\n\nRESUELVE\n\nArtículo 1°: Establecer el\nlímite de gasto al Fondo Nacional de Financiamiento Forestal, para los\ncontratos a formalizar en el periodo 2025-2026, las actividades a financiar y\nlos montos de pago por actividad.\n\n1. Actividades a financiar:\nPara el periodo 2025-2026, se considerarán dos modalidades a financiar:\n\na. Para tal fin, se\nestablece la siguiente distribución:\n\n| Modalidades de PSA | Actividad | Cantidad |\n| --- | --- | --- |\n| | Reforestación con especies de rápido crecimiento. | 1 000 hectáreas |\n\n \n\n| Recuperación de la Cobertura Forestal* | Reforestación con especies de mediano crecimiento. | 1\n000 hectáreas | | --- | --- | --- | | Plantaciones Forestales con Turnos de Rotación Reducidos\n(PFTRR). | 500 hectáreas | | | Regeneración Natural ** | 65 hectáreas | | | Establecimiento de\nárboles en Sistemas Agroforestales. | 150 000 árboles | | | Sistemas Agroforestales establecidos en\nPlantaciones de Aprovechamiento Forestal (PPAF). | 15 000 árboles | | | Sistemas Mixtos en\nAgroforestería para micro productores. | 20 000 árboles | | | Sistemas Productivos de Madera a Baja\nEscala (SIPMABE). | 100 000 árboles | | | Mantenimiento de la Cobertura Forestal*** | Protección de\nBosque para la mitigación de gases de efecto invernadero (pago base) | 30 000 hectáreas |\n\n*: El Fonafifo dará trámite a todas las\nsolicitudes de ingreso que se presenten en la subactividad de Reforestación con\nespecies contenidas en los decretos ejecutivos de veda y especies amenazadas o\nen peligro de extinción (Decretos Ejecutivos N° 25663-MINAE del 8 de octubre de\n1996 y N° 25700-MINAE del 15 de noviembre de 1996 y sus reformas), por un área\nmáxima de 15 hectáreas.\n\n**: El presupuesto para esta actividad\ncorresponde a los compromisos adquiridos mediante el convenio ICE-Fonafifo.\n\n***: Los bienes inmuebles que se encuentren\nubicados dentro de las capas geoespaciales correspondientes a protección del\nrecurso hídrico o alta biodiversidad serán susceptibles de recibir el\nrespectivo reconocimiento en la actividad de Protección de Bosque, hasta un\nlímite máximo de colocación entre los dos pluses de treinta mil hectáreas.\n\nA partir del año 2025, se\nhabilita una nueva Subactividad en el reconocimiento de los servicios\nambientales en sistemas agroforestales denominada Sistemas Productivos de\nMadera a Baja Escala (SIPMABE), la cual busca alinear el establecimiento de\nárboles en los sistemas productivos, sean agrícolas o pecuarios, buscando ofrecer\nun nuevo mecanismo de apoyo a las personas productoras, vinculado a la\nestrategia de Agropaisajes Sostenibles que impulsa el MINAE.\n\nEl Fondo Nacional de\nFinanciamiento Forestal, podrá variar la distribución establecida en el cuadro\nanterior, de acuerdo con la disponibilidad del presupuesto aprobado para el\nPrograma de Pago por Servicios Ambientales o Ecosistémicos.\n\nDe disponer de una mayor\nasignación de recursos, según el artículo 5 de la Ley de Simplificación y\nEficiencia Tributarias N° 8114 publicada en La Gaceta N° 131, del día 9 de\njulio de 2001 y otros recursos financieros que capte el Fonafifo para el Pago\npor Servicios Ambientales o Ecosistémicos, se distribuirán según el criterio de\nlos financiadores y de las autoridades del Ministerio o autoridades correspondientes.\nEn todo caso, los recursos utilizados para estos fines deberán ser incorporados\nen el presupuesto institucional o al Fideicomiso 544 Fonafifo/BNCR.\n\n2. De los montos de pago\npor actividad y otras condiciones:\n\n2.1. Actividad de\nReforestación: Las condiciones que regirán para el trámite de solicitudes, para\nel reconocimiento de los servicios ambientales en la actividad de\nReforestación, son las siguientes:\n\na. El monto a pagar para\nlas especies de rápido crecimiento referidas a: Gmelina arborea, Acacia mangium,\nVochysia guatemalensis y Vochysia hondurensis, será de setecientos ochenta y\ntres mil seis cientos cuarenta y cuatro colones con 00/100 (¢783,644) por\nhectárea, desembolsados durante un período de cinco años. Los pagos serán\ndistribuidos de la siguiente forma: 50% el primer año, 20% el segundo año, 15%\nel tercer año, 10% el cuarto año y 5% el quinto año.\n\nb. El monto a pagar para\nlas especies de mediano crecimiento referidas a: Tectona grandis, Pinus sp,\n\nCordia alliodora, Vochysia\nferruginea, Eucalyptus sp y Cedrela odorata, será de ochocientos ochenta y tres\nil quinientos cuarenta setenta y seis colones con 00/100 (¢883,576) por\nhectárea, desembolsados durante un período de cinco años. Los pagos serán distribuidos\nde la siguiente forma: 50% el primer año, 20% el segundo año, 15% el tercer\naño, 10% el cuarto año y 5% el quinto año.\n\nc. El monto a pagar para\nespecies nativas contenidas en los Decretos Ejecutivos N° 25663-MINAE del 8 de octubre\nde 1996 y N° 25700-MINAE del 15 de  noviembre\nde 1996, será de un millón trescientos veinticinco mil trescientos sesenta y\nseis colones con 00/100 (¢1,325,366) por hectárea, desembolsados durante un\nperíodo de cinco años. Los pagos serán distribuidos de la siguiente forma: 50%\nel primer año, 20% el segundo año, 15% el tercer año, 10% el cuarto año y 5% el\nquinto año.\n\nd. El monto a pagar para\nlas Plantaciones Forestales con Turnos de Rotación Reducidos (PFTRR) para\nespecies de rápido crecimiento para embalaje, será de cuatrocientos veintiún\nmil seiscientos veintiocho colones con 00/100 (¢421,628) por hectárea, Los pagos\nserán distribuidos de la siguiente forma: 50% el primer año, 25% el segundo año\ny 25% el cuarto año.\n\ne. Las condiciones que\nregirán para el trámite de solicitudes, para el reconocimiento de los servicios\nambientales en la actividad de Reforestación proyecto piloto PSA + Crédito, son\nlas siguientes:\n\nf. El monto a pagar para el\nproyecto piloto PSA + Crédito con la especie de rápido crecimiento referida a: Gmelina\narborea, será de cuatrocientos veintiún mil seiscientos veintiocho colones con\n00/100 (¢421,628) por hectárea, desembolsados en 6 tractos de acuerdo con la\nsiguiente distribución primer año 11%, segundo año 16%, tercer año 17%, cuarto\naño 18%, quinto año 19% y el sexto año el 19% restante que se girará, siempre y\ncuando el beneficiario haya consentido mediante documento formal.\n\ng. Plantaciones Forestales\nestablecidas con recursos propios para pago por resultados. Los montos a pagar serán\nlos establecidos, en los incisos a, b, y c anteriores. Los montos serán\ndistribuidos de la siguiente forma: con la firma del contrato un 50%, doce,\nveinticuatro, treinta y seis y cuarenta y ocho\n\nmeses después de dicha\nfirma un 20%, 15%, 10% y 5% respectivamente. Los contratos tendrán la vigencia prevista\nen el artículo 2 incisos a y b de esta resolución, pero se reconocerán los años\nde existencias de estas plantaciones; hasta un máximo de 3 años de\nestablecidas.\n\nh. Las personas físicas o\njurídicas que deseen reforestar en áreas mayores al tope establecido en el Reglamento\na la Ley Forestal, Decreto N° 25721- MINAE y sus Reformas, podrán aplicar en un\nesquema especial de financiamiento, pudiendo duplicar el tope de 750 hectáreas,\nsiempre y cuando los recursos disponibles no sean utilizados por los pequeños productores.\nLos montos a pagar serán los establecidos, en los incisos a, b y c anteriores.\n\ni. Se instruye al Fondo\nNacional de Financiamiento Forestal para que incorpore en los contratos de Pago\npor Servicios Ambientales en la actividad de Reforestación los valores mínimos\naceptables para realizar los pagos.\n\nEl Fondo Nacional de\nFinanciamiento Forestal utilizará los siguientes valores de referencia para\ntramitar los pagos correspondientes a cada año:\n\nCuadro 1. El Estado a través del\nFonafifo, adquirirá los servicios ambientales que produzcan las plantaciones\nforestales, entendidos éstos según dispone el inciso k del artículo 3 de la Ley\nForestal N°7575.\n\nk. Específicamente, los\nservicios ambientales brindados por plantaciones se pagarán según el\ncrecimiento anual de la biomasa de acuerdo con parámetros establecidos en esta resolución.\nDichos pagos corresponden al total de años del plazo convenido; no obstante, a\nfin de permitir el establecimiento de la plantación y su mantenimiento, se adelantará\ndurante los primeros cinco años.\n\nl. El Fonafifo podrá\nmodificar cuando así se solicite, aquellos contratos suscritos antes del año\n2015, que demuestren haber alcanzado una producción mínima de 13 metros cúbicos\nde incremento medio anual por hectárea. Para tales efectos, el Fonafifo podrá\nsolicitar la información que considere pertinente.\n\n2.2. Actividad de\nRegeneración Natural: Las condiciones que regirán para el trámite de\nsolicitudes para el reconocimiento de los Servicios Ambientales en la actividad\nde Regeneración Natural que se                                  desarrollen\nen áreas denudadas, sin cobertura forestal, con fuentes semilleras cercanas, en\náreas en proceso de regeneración que no cumplan con la definición de bosque y libres\nde pastoreo, se detallan a continuación:\n\na. El monto a pagar en\nRegeneración Natural será de ochenta y dos mil quinientos sesenta y cinco\ncolones con 00/100 (¢82.565) por hectárea, desembolsados en cinco pagos anuales\nde 20% durante un periodo de cinco años.\n\n2.3. Actividad de Sistemas\nAgroforestales: Las condiciones que regirán para el trámite de solicitudes,\npara el reconocimiento de los servicios ambientales en la actividad de Sistemas\nAgroforestales, se detallan a continuación.\n\na. El monto a pagar será de\nmil ochenta y cinco colones con 00/100 (¢1.085) por árbol, integrados a Sistemas\nAgroforestales y desembolsados durante un período de cinco años. Los pagos\nserán distribuidos de la siguiente forma: 50% el primer año, 25% el tercero año\ny 25% el año quinto.\n\nb. El monto a pagar será de\nmil seiscientos ocho colones con 00/100 (¢1.608) por árbol, integrados a Sistemas\nAgroforestales, estrictamente con especies nativas contenidas en los Decretos\nEjecutivos N° 25663-MINAE del 8 de octubre de 1996 y N° 25700-MINAE del 15 de noviembre\nde 1996, desembolsados durante un período de cinco años. Los pagos serán\ndistribuidos de la siguiente forma: 50% el primer año, 25% el tercero año y 25%\nel año quinto.\n\nc. El monto a pagar será de mil seiscientos ocho colones\ncon                                                                     \n\n00/100 (¢1.608) por árbol,\nbajo la actividad de Sistemas Agroforestales establecidos en Plantaciones de Aprovechamiento\nForestal (PPAF), financiados mediante el crédito forestal. Los pagos serán\ndistribuidos de la siguiente forma: 80% se girará una vez firmado el contrato y\nque los árboles hayan alcanzado los 36 meses de edad; el restante 20% se\ntramitará cuando los árboles tengan 60 meses de edad, al quinto año del\nproyecto.\n\nd. Sistemas Mixtos en\nAgroforestería para pequeños productores: Las condiciones para esta modalidad\nson: Cuando realicen actividades de protección de bosque, un pago de veintiún\nmil seiscientos colones con 00/100 (¢21.600) por hectárea por año, durante un\nperíodo de cinco años, (aquí de ser necesario se calcularán las fracciones de\nhectáreas existentes, hasta el primer decimal. Cuando sean áreas denudadas o en\nproceso de regeneración, se reconocerá un pago de dieciséis mil quinientos\ntrece colones con 00/100 (¢16.513) por hectárea, por año durante un período de\ncinco años.\n\nCuando realicen actividades de reforestación de especies maderables o de uso múltiple fuera del área\nboscosa un pago de trescientos veinte tres colones con 00/100 por árbol (¢323) por año durante un\nperíodo de cinco años; se reconocerá una cantidad mínima de doscientos árboles plantados o árboles\nexistentes identificados, hasta un                         máximo de dos mil doscientos árboles. En\nesta subactividad podrá realizarse un solo contrato que comprenda las diferentes actividades, para\nlo cual deberá implementar al menos dos actividades de las antes descritas, donde la actividad de\nreforestación de especies maderables o de uso múltiple es indispensable de establecer; y el plazo\nserá de cinco años contados a partir de la firma del contrato.\n\ne. El monto a pagar será de\nmil quinientos colones con 00/100 (¢1.500) por árbol, bajo la actividad de\nSistemas Agroforestales establecidos en Sistemas Productivos de Madera a Baja\nEscala (SIPMABE). Los pagos serán distribuidos de la siguiente forma: 70% el\nprimer año, 15% el segundo año y 15% el cuarto año. Y en caso de que el contrato\ncuente con el componente de financiamiento a través de un crédito forestal, se\nreconocerá un total de mil seiscientos cincuenta colones con 00/100 (¢1.650)\npor árbol y los pagos serán distribuidos de la siguiente forma: 40% el primer\naño, 10% el segundo, tercer y cuarto año y un 30% el quinto año.\n\n2.4. Actividad de\nProtección de Bosque: Las condiciones que regirán para el trámite de\nsolicitudes para el reconocimiento de los Servicios Ambientales o Ecosistémicos\nen la actividad de Protección de Bosque son las siguientes:\n\na. El monto para pagar por\nel servicio ambiental de mitigación de gases de efecto invernadero y\nbiodiversidad considerado como la base, será de ciento cinco mil colones exactos\n(?105.000,00) por hectárea, desembolsados durante un período de cinco años;\ndistribuidos en pagos anuales del 20% cada uno.\n\nb. El monto para pagar por\nel servicio ambiental de mitigación de gases de efecto invernadero y\nbiodiversidad considerado como la base, más un adicional por el servicio de\nprotección del recurso hídrico considerado como un plus, será de ciento ochenta\ny cinco mil colones con 00/100 (¢185,000.00) por hectárea, desembolsados durante\nun período de cinco años; distribuidos en pagos anuales del 20% cada uno.\n\nc. El monto para pagar por\nel servicio ambiental de mitigación de gases de efecto invernadero y\nbiodiversidad considerado como la base, más un adicional por el servicio de\nprotección de sitios de alta biodiversidad considerado como un plus, será de\nciento ochenta y cinco mil colones con 00/100 (¢185,000.00) por hectárea, desembolsados\n\ndurante un período de cinco\naños; distribuidos en pagos anuales del 20% cada uno.\n\nd. Los bienes inmuebles que\nse encuentren ubicados dentro de las capas geoespaciales correspondientes a\nrecurso hídrico o alta biodiversidad serán susceptibles de recibir el respectivo\nreconocimiento en la actividad de Protección de Bosque conforme a lo indicado\nen la presente resolución.\n\n3. Actualización de los\nmontos a pagar. Para los pagos anuales posteriores el MINAE, mediante\nresolución razonada podrá variar estos montos y actualizarlos, de igual forma\npodrá decretar aumentos extraordinarios en los montos a pagar, lo anterior\nconsiderando la disponibilidad presupuestaria y su inclusión en los\npresupuestos correspondientes.\n\n Ficha articulo\n\nArtículo 2°-Se instruye al\nFondo Nacional de Financiamiento Forestal para que incorpore en los contratos\nde Pago por Servicios Ambientales o Ecosistémicos las siguientes condiciones:\n\n1. De los plazos de\nvigencia de los contratos: Los plazos de vigencia de los contratos de Pago por\nServicios Ambientales o Ecosistémicos, generados por las actividades que\ncorresponden a las modalidades de recuperación y/o mantenimiento de cobertura\nforestal serán los siguientes:\n\na. Los contratos\ncorrespondientes a la actividad de Reforestación mediante el establecimiento de\nlas especies de rápido crecimiento tendrán una vigencia de diez años a partir\nde su firma.\n\nb. Los contratos\ncorrespondientes a la actividad de Reforestación que incorporen especies de\nmediano crecimiento y las especies nativas contenidas en los Decretos N°\n25663-MINAE del 8 de octubre de 1996 y N° 25700-MINAE del 15 de noviembre de\n1996, su vigencia será de dieciséis años, a partir de su firma; incluyendo los contratos\nde reforestación con recursos propios y los contratos de reforestación que\nsuperen el tope establecido.\n\nc. Los contratos\ncorrespondientes a la subactividad de Plantaciones Forestales con Turnos de\nRotación Reducidos (PFTRR), tendrán una vigencia de seis años a partir de su firma.\n\nd. Los contratos\ncorrespondientes a la actividad de Regeneración Natural tendrán una vigencia de\ncinco años a partir de su firma.\n\ne. Los contratos\ncorrespondientes a la actividad de establecimiento de árboles en Sistemas\nAgroforestales con especies de rápido, mediano y con las especies nativas contenidas\nen los Decretos N° 25663-MINAE del 8 de octubre de 1996 y N° 25700-MINAE del 15\nde noviembre de 1996, tendrán una vigencia de cinco años a partir de su firma.\n\nf. Los contratos correspondientes a la subactividad de Sistemas Agroforestales establecidos en\nPlantaciones de Aprovechamiento Forestal (PPAF) tendrán una vigencia de  2 años a partir de su\nfirma; dado que ya están plantados y por esto se les reconocerán retroactivamente tres años por su\nestablecimiento previo.\n\ng. Los contratos\ncorrespondientes a la subactividad de Sistemas Mixtos en Agroforestería para\nmicro productores tendrán una vigencia de cinco años a partir de su firma\n\nh. Los contratos\ncorrespondientes a la subactividad de Sistemas Productivos de Madera a Baja\nEscala (SIPMABE) tendrán una vigencia de seis años a partir de su firma; Sin embargo,\nse podrá solicitar por parte de la persona beneficiaria el adelanto de dicha\nvigencia en un año calendario (para un total de cinco años de cumplimiento de contrato),\nsiempre y cuando se cumpla en ese momento con los valores de referencia mínimos\npara el diámetro (DAP) y la altura total (Htot) para plantaciones de especies\nde rápido crecimiento correspondientes al año seis, los cuales se indican en la\npresente resolución. Además, dicho acto deberá ser aprobado técnicamente por la\njefatura de la oficina regional respectiva.\n\ni. Los contratos\ncorrespondientes a la actividad de establecimiento de árboles en Sistemas\nAgroforestales relacionados a convenios u otros donantes o socios, tendrán una\nvigencia de cinco años a partir de su firma.\n\nj. Los contratos\ncorrespondientes a la actividad de Protección de Bosque relacionados a la\nmitigación de gases de efecto invernadero y biodiversidad; así como aquellos\nque contemplen el reconocimiento adicional recurso hídrico y/o alta\nbiodiversidad, tendrán una vigencia de 5 años a partir de la fecha en que se\npresenta la solicitud de ingreso al Fondo Nacional de Financiamiento Forestal.\n\n2. De las Condiciones\n\nEn concordancia con lo\ndispuesto en la Ley Forestal, su Reglamento, el Manual de Procedimientos para\nel Programa de Pago por Servicios Ambientales, el Manual de Procedimientos para\nel programa de Pago por Servicios Ambientales o Ecosistémicos en Protección de\nBosques y normativa aplicable, las solicitudes de ingreso al Programa de Pago\npor Servicios Ambientales y los contratos que sean formalizados, deberán\ncumplir las siguientes condiciones generales y especiales:\n\n2.1.Condiciones Generales\n\na. Se faculta al Fondo\nNacional de Financiamiento Forestal a establecer actividades y montos\ndiferenciados a los señalados en esta resolución, de conformidad con acuerdos,\nconvenios o contratos o proyectos específicos con entidades, que aporten recursos\nfinancieros al Programa de Pago por Servicios Ambientales o Ecosistémicos, que\nreconozcan montos y condiciones diferentes a los establecidos para los\ndiferentes servicios ambientales; para estos proyectos no aplicarán los criterios\nde priorización que se detallaron anteriormente, sino los pactados en cada\nconvenio, así como las normas especiales que correspondan de acuerdo a la\nnaturaleza de la actividad. Los pagos se realizarán siempre y cuando se tenga\ndisponibilidad presupuestaria para cubrir los compromisos adquiridos mediante\nel Programa de Pago por Servicios Ambientales o Ecosistémicos.\n\nb. Los montos pendientes\npor pagar para los contratos de años anteriores se regirán según lo establecido\nen los Decretos Ejecutivos y Resoluciones Administrativas correspondientes para\ncada año.\n\nc. Para los pagos no\ntramitados antes del año 2024 en forma oportuna, se establece un plazo de 18\nmeses de caducidad, para el reclamo de cuotas derivadas de los contratos de\npago por servicios ambientales o ecosistémicos, en todas sus modalidades a\npartir del momento en que fuese exigible tal obligación, salvo que se presente\nuna justificación aceptable para Fonafifo de acuerdo con los principios de\nrazonabilidad y proporcionalidad. Esta caducidad no afectará la vigencia del contrato.\n\nd. Para cubrir el costo de\ninscripción del contrato ante el Registro Público, el Fondo Nacional de\nFinanciamiento Forestal retendrá en el primer desembolso del monto total del\ncontrato un 0,6%. e. Los recursos recuperados en virtud de los incumplimientos\nde contratos de pago por servicios ambientales o las devoluciones o finiquitos,\nserán transferidos al Fideicomiso 544 ONAFIFO/BNCR y serán presupuestados para\nla ejecución de nuevas actividades de fomento de pequeños y medianos productores.\n\nf. En caso de que en las\nsolicitudes presentadas se determinare la existencia de traslapes o\ndesplazamiento entre ellas y/o con otras fincas, el Fonafifo valorará de\nacuerdo con criterios técnicos y legales la aprobación o no de las solicitudes\nde ingreso.\n\ng. Las solicitudes de\ningreso que se presenten para acceder al Programa de Pago por Servicios\nAmbientales o Ecosistémicos, deberán de contener la información de contacto\n(correo electrónico, número de teléfono, dirección o domicilio) de la persona\npropietaria o propietarias del inmueble. Sin esta información, la\nadministración estimará como incompleta la solicitud y procederá a señalarla,\npara que la persona solicitante proceda a completarla, por ser dicha\ninformación fundamental para las notificaciones que deban realizarse; de no\nsuministrar la información, se procederá con su archivo.\n\nh. En aquellos casos en los\nque la persona o personas beneficiarias del contrato de Pago por Servicios\nAmbientales o Ecosistémicos se encuentre en mora con sus obligaciones con la\nCaja Costarricense del Seguro Social (CCSS), Fonafifo realizará el trámite de\npago de dichos contratos conforme al procedimiento establecido al efecto por la\nCCSS y según lo dispuesto en la Ley N°9686 y sus reformas.\n\n2.2.Condiciones Especiales\n\n2.2.1.En las actividades de\nreforestación y regeneración natural y sistemas agroforestales.\n\na) Los proyectos que se\nejecuten bajo estas actividades deberán contar con un regente forestal durante\ntoda la vigencia del contrato de pago por servicios ambientales. El formulario\nde regencia podrá inscribirse ante el Colegio de Ingenieros Agrónomos, por la\ntotalidad del plazo del contrato de pago por servicios ambientales, o por\nperíodos anuales o quinquenales, según disponga la persona propietaria del\ninmueble. Cualquiera que sea la forma de pago, siempre deberá aportarse el formulario\nde regencia debidamente inscrito y vigente durante el trámite de pago\nrespectivo.\n\nb) Sin perjuicio de otras\ndisposiciones, la persona o las personas beneficiarias deberán aportar un\ninforme de regencia anual emitido por un regente forestal para el trámite de\npago; o eventualmente un informe técnico emitido por un profesional forestal,\npara aquellos proyectos que no aplica la figura del regente forestal.\nAdicionalmente, para los contratos de Reforestación de Rápido Crecimiento,\ndeberá presentar los informes de visita, donde certifique el estado de los\nproyectos en los años 8 y 10 a partir de su fecha de plantación; para los proyectos\nde mediano crecimiento y otras especies deberán presentar dichos informes al\naño 8, 12 y 16, a partir de su fecha de plantación.\n\nc) Sin perjuicio de otras\nacciones que representen incumplimiento a las obligaciones del contrato, para\nlos contratos de Reforestación de Rápido Crecimiento y Sistemas Agroforestales establecidos\nen Sistemas Productivos de Madera a Baja Escala (SIPMABE) a partir de los 12\nmeses y para las plantaciones de Mediano Crecimiento a partir de los 24 meses\nde establecida la plantación, se considera incumplido el contrato si la\nplantación no presenta el crecimiento mínimo establecido en el artículo 1 inciso\n2.1, o el indicado de previo en el estudio técnico respectivo para otras\nespecies. Como consecuencia de este incumplimiento, la persona productora no\nrecibirá el pago correspondiente a este año, siendo que el Fondo Nacional de Financiamiento\nForestal debe suspender los pagos respectivos y dar por terminado el contrato\ncon responsabilidad para la persona beneficiaria previo cumplimiento del debido\nproceso. En casos muy calificados, basados en estudios y/o informes de las personas\nencargadas de Oficinas Regionales de Fonafifo, se podría proceder con el pago\nrespectivo y continuar con el contrato aun con índices de crecimiento menor,\nsiempre y cuando estos no obedezcan a incumplimientos, por la mala selección\ndel sitio, de la especie, o sea producto de un inadecuado manejo de la\nplantación.\n\nd) Como principio general,\nserán motivo de eximente de responsabilidad por incumplimiento del contrato, el\ncaso fortuito, la fuerza mayor, el hecho de un tercero, debidamente comprobadas\ny valoradas a juicio del Fonafifo. De igual forma, se procederá cuando la\npersona propietaria de la plantación demuestre que una plaga o enfermedad\nafectó la plantación y que las acciones oportunamente realizadas no lograron erradicarla,\nsiempre y cuando estén documentadas en el expediente de PSA y tengan la\naprobación de la Oficina Regional. Se procederá de igual manera cuando el daño\nsea producto de un incendio que no pudo ser controlado a pesar de las medidas\npreventivas reportadas.\n\ne) No podrán ejecutarse\nproyectos en fincas que hayan sido objeto de plagas, enfermedades, o incendios;\nen tal supuesto, la finca no podrá ser sujeto de contratos en Reforestación y/o\nSistemas Agroforestales, tanto en Bloque como en los Sistemas Productivos de\nMadera a Baja Escala (SIPMABE), por un plazo de 3 años, a partir del último\ncontrato finalizado por esta causa.\n\nf) En relación con las\nplagas y enfermedades que afecten las plantaciones forestales, la Junta\nDirectiva de Fonafifo, determinará lineamientos para abordar y resolver estos supuestos.\n\ng) El Fonafifo, será el\nresponsable de monitorear las plantaciones forestales que ingresen al Programa,\ndebiendo no solo hacer un seguimiento a nivel regional, sino un protocolo de\ncontrol, mediante un mecanismo aleatorio de visitas según su capacidad técnica\ny administrativa, de acuerdo con la disponibilidad de recursos presupuestados.\nDe igual forma, deberá custodiar la información de las parcelas permanentes de\nmediciones de las plantaciones, a fin de sustentar los pagos y respaldar las fijaciones\nde carbono y otros gases de efecto invernadero.\n\nh) Para uniformizar la\ninformación requerida de las parcelas permanentes de plantaciones y sistemas\nagroforestales tanto en bloques como en los Sistemas Productivos de Madera a\nBaja Escala (SIPMABE), el Fonafifo emitirá el formato del contenido de la base\nde datos en Excel, para que los regentes forestales lo remitan anualmente con\nlos datos individuales de diámetros y alturas. El archivo se encuentra\ndisponible en el sitio web de Fonafifo (www.fonafifo.go.cr) para su descarga.\n\ni) En el caso de las\nsolicitudes de ingreso en la actividad de Reforestación que involucren mezclas\nde especies de rápido, mediano y/o en vías de extinción, se deberán generar\ncontratos separados, en virtud de las diferencias de crecimiento que se presentan\nentre estos grupos de especies. Además, los proyectos que estén conformados por\nespecies nativas contenidas en los Decretos N° 25663-MINAE del 8 de octubre de\n1996 y N° 25700-MINAE del 15 de noviembre de 1996, deberán contener el 100% de\nlos árboles de las especies comprendidas en los mencionados decretos; de lo\ncontrario tendrá un valor en función del monto menor establecido para Reforestación.\n\nj) Las plantaciones\nforestales de especies en peligro de extinción sembrados con el financiamiento\nde contratos de Pago por Servicios Ambientales podrán ser aprovechados con fundamento\nen el artículo 28 de la Ley Forestal.\n\nk) Los proyectos de\nReforestación de los años 2016 a 2023 serán valorados de acuerdo con los\nparámetros de crecimiento establecidos en la resolución ministerial\nR-167-2019-MINAE, publicados en La Gaceta N° 138 del 23 de julio del 2019.\n\n2.2.2.En las actividades de\nProtección de Bosque.\n\na) De conformidad con lo\nestablecido en el Decreto Ejecutivo N°44607-MINAE, publicado en el Alcance\nN°145 a La Gaceta N°156 del 26 de agosto de 2024, para la formalización de los contratos\nde Protección de Bosque, el solicitante deberá contratar los servicios de un\nprofesional forestal, quien además de presentar los respectivos informes,\ndeberá realizar las visitas técnicas correspondientes a los años tercero y\nquinto de vigencia del contrato. Para tales fines, será requisito indispensable\nque\n\ndicho profesional se\nencuentre debidamente acreditado para ejercer ante el Colegio de Ingenieros\nAgrónomos de Costa Rica.\n\nPara el seguimiento de los\naños segundo y cuarto de vigencia contractual, se procederá conforme a lo\ndispuesto en el artículo 124 del Reglamento a la Ley Forestal.\n\nb) En las solicitudes de\ningreso a la actividad de Protección de Bosque que sean valoradas según la\nMatriz de Calificación y que presenten varias fincas; la calificación dependerá\nde la finca de mayor tamaño que se incluya en la solicitud.\n\nc) Para inmuebles que se\nencuentren sobre el límite de las áreas prioritarias, se considerarán para\nefectos de la actividad de protección de bosque aquellos inmuebles que al menos\ntengan un 30% dentro de dichas áreas.\n\nd) Para el reconocimiento\nadicional por la protección del recurso hídrico y/o el de alta biodiversidad\nlos inmuebles deberán de estar al menos en un 30% dentro de las áreas definidas\npara este reconocimiento. The quantity of hectares to be financed per activity in the C Program is established for the National Forest Financing Fund based on\nthe allocated resources.\n\nWHEREAS\n\nSOLE. -That for the\n2025 fiscal year, the National Budget allocates a total of ten billion nine hundred\nfifty-one million six hundred eighty-two thousand four hundred six\ncolones with 00/100 (¢10,951,682,406.00) for the Payment for Environmental Services Program\n(hereinafter PSA), which will be used for the payment of commitments\nfrom PSA contracts from previous years and the incorporation of new hectares for\nthe 2025-2026 period.\n\nCONSIDERING\n\nFIRST: That Article 38\nof the Regulations to the Forestry Law No. 7575, Executive Decree No. 25721-MINAE, of\nOctober 17, 1996, published in La Gaceta No. 16 on January 23, 1997,\nand its amendments, provides that the Minister of Environment and Energy, as the Head of\nthis Ministry acting as the State Forestry Administration, shall annually issue, by Ministerial Resolution, the activities to be financed in\nthe Payment for Environmental or Ecosystem Services Program and the amounts to be paid\nbased on the resources allocated in the National Budget for the\n2025 fiscal year.\n\nSECOND: That, under this\nprinciple, financial instruments must be oriented to support the pillars\nof the National Development and Public Investment Plan 2023-2026 (Rogelio\nFernández Güell), considering the objectives of the creation of the National Forest Financing Fund\naccording to the cited Forestry Law, without disregarding the\nestablished technical criteria.\n\nTHIRD: That the cited National\nDevelopment Plan considers as one of the national goals maintaining\nat least two hundred fifty thousand hectares (500,000 has) under the Payment for Environmental or Ecosystem Services Program, across its different activities.\n\nFOURTH: That the Ministry\nof Environment and Energy has issued the Guiding Principles of the Productive Forestry Sector,\nthrough Executive Decree No. 41772-MINAE, as well as the guidelines\nto be considered in institutional actions for the reactivation and promotion\nof reforestation in the country.\n\nFIFTH: That the amendment to the\nRegulations to the Forestry Law, made through Executive Decree No.\n44607-MINAE published in Supplement number 145 to La Gaceta No. 156; establishes\nfundamental changes to the Payment for Environmental or Ecosystem Services Program,\nto independently recognize the different environmental services to\nbe paid. For these purposes, three environmental services to\nrecognize are established: 1. A base payment, comprising forests with the function of\nmitigation of greenhouse gases and protection of biodiversity; 2.\nAn additional payment for forests located in areas considered of high\nbiodiversity, megadiverse, or zones that, due to their fragility, connectivity, or\ndeterioration, deserve to be preserved, and 3. An additional payment is recognized for\nforests that, due to their location, contribute to the protection of water resources for\nhuman consumption, rural, and hydroelectric purposes.\n\nTHEREFORE:\n\nTHE MINISTER OF ENVIRONMENT AND\nENERGY\n\nRESOLVES\n\nArticle 1: To establish the\nspending limit for the National Forest Financing Fund, for the\ncontracts to be formalized in the 2025-2026 period, the activities to be financed, and\nthe payment amounts per activity.\n\n1. Activities to be financed:\nFor the 2025-2026 period, two modalities to be financed will be considered:\n\na. Recovery of\nForest Cover (Cobertura Forestal), which includes the activities of Reforestation and Agroforestry Systems.\n\nb. Maintenance of\nForest Cover, which includes Forest Protection. For this purpose, the\nfollowing distribution is established:\n\n| PSA Modalities | Activity | Quantity |\n| --- | --- | --- |\n| | Reforestation with fast-growing species. | 1,000 hectares |\n\n \n\n| Recovery of Forest Cover* | Reforestation with medium-growing species. | 1,000 hectares | | --- | --- | --- | | Forest Plantations with Reduced Rotation Cycles (PFTRR). | 500 hectares | | | Natural Regeneration ** | 65 hectares | | | Establishment of trees in Agroforestry Systems. | 150,000 trees | | | Agroforestry Systems established in Forest Harvesting Plantations (PPAF). | 15,000 trees | | | Mixed Agroforestry Systems for micro-producers. | 20,000 trees | | | Low-Scale Wood Production Systems (SIPMABE). | 100,000 trees | | | Maintenance of Forest Cover*** | Forest Protection for greenhouse gas mitigation (base payment) | 30,000 hectares |\n\n*: Fonafifo will process all\napplications for entry submitted under the Reforestation sub-activity with\nspecies included in the executive decrees on logging bans and threatened or\nendangered species (Executive Decrees No. 25663-MINAE of October 8,\n1996 and No. 25700-MINAE of November 15, 1996 and their amendments), for a maximum area of 15 hectares.\n\n**: The budget for this activity\ncorresponds to the commitments acquired through the ICE-Fonafifo agreement.\n\n***: Real estate located\nwithin the geospatial layers corresponding to protection of the\nwater resource or high biodiversity will be eligible to receive the\nrespective recognition in the Forest Protection activity, up to a\nmaximum placement limit between the two supplements of thirty thousand hectares.\n\nStarting in the year 2025, a\nnew Sub-activity is enabled in the recognition of environmental\nservices in agroforestry systems called Low-Scale Wood Production Systems (Sistemas Productivos de Madera a Baja Escala, SIPMABE), which seeks to align the establishment\nof trees in production systems, whether agricultural or livestock, seeking to offer\na new support mechanism for producers, linked to the\nSustainable Agro-landscapes strategy promoted by MINAE.\n\nThe National Forest\nFinancing Fund may vary the distribution established in the table\nabove, in accordance with the availability of the budget approved for the\nPayment for Environmental or Ecosystem Services Program.\n\nIf a greater\nallocation of resources is available, according to Article 5 of the Tax Simplification and\nEfficiency Law No. 8114 published in La Gaceta No. 131, on July\n9, 2001, and other financial resources that Fonafifo captures for the Payment for Environmental or Ecosystem Services, they will be distributed according to the criteria of\nthe financiers and the authorities of the Ministry or corresponding authorities.\nIn any case, the resources used for these purposes must be incorporated\ninto the institutional budget or into the Trust 544 Fonafifo/BNCR.\n\n2. Regarding the payment amounts\nper activity and other conditions:\n\n2.1. Reforestation\nActivity: The conditions that will govern the processing of applications, for\nthe recognition of environmental services in the Reforestation\nactivity, are as follows:\n\na. The amount to be paid for\nthe fast-growing species referred to as: Gmelina arborea, Acacia mangium,\nVochysia guatemalensis and Vochysia hondurensis, will be seven hundred\neighty-three thousand six hundred forty-four colones with 00/100 (¢783,644) per\nhectare, disbursed over a period of five years. Payments will be\ndistributed as follows: 50% the first year, 20% the second year, 15%\nthe third year, 10% the fourth year, and 5% the fifth year.\n\nb. The amount to be paid for\nthe medium-growing species referred to as: Tectona grandis, Pinus sp,\n\nCordia alliodora, Vochysia\nferruginea, Eucalyptus sp, and Cedrela odorata, will be eight hundred\neighty-three thousand five hundred seventy-six colones with 00/100 (¢883,576) per\nhectare, disbursed over a period of five years. Payments will be distributed\nas follows: 50% the first year, 20% the second year, 15% the third\nyear, 10% the fourth year, and 5% the fifth year.\n\nc. The amount to be paid for\nnative species included in Executive Decrees No. 25663-MINAE of October\n8, 1996 and No. 25700-MINAE of November 15, 1996, will be one million three hundred\ntwenty-five thousand three hundred sixty-six colones with 00/100 (¢1,325,366) per\nhectare, disbursed over a period of five years. Payments will be\ndistributed as follows: 50% the first year, 20% the second year, 15% the third\nyear, 10% the fourth year, and 5% the fifth year.\n\nd. The amount to be paid for\nForest Plantations with Reduced Rotation Cycles (Plantaciones Forestales con Turnos de Rotación Reducidos, PFTRR) for\nfast-growing species for packaging, will be four hundred twenty-one\nthousand six hundred twenty-eight colones with 00/100 (¢421,628) per hectare. Payments will be\ndistributed as follows: 50% the first year, 25% the second year,\nand 25% the fourth year.\n\ne. The conditions that\nwill govern the processing of applications, for the recognition of environmental\nservices in the Reforestation activity pilot project PSA + Credit, are\nas follows:\n\nf. The amount to be paid for the\npilot project PSA + Credit with the fast-growing species referred to as: Gmelina\narborea, will be four hundred twenty-one thousand six hundred twenty-eight colones with\n00/100 (¢421,628) per hectare, disbursed in 6 installments according to the\nfollowing distribution: first year 11%, second year 16%, third year 17%, fourth\nyear 18%, fifth year 19%, and the sixth year the remaining 19% which will be disbursed, provided\nthat the beneficiary has consented through a formal document.\n\ng. Forest Plantations\nestablished with own resources for payment by results. The amounts to be paid will be\nthose established in subsections a, b, and c above. The amounts will be\ndistributed as follows: upon signing the contract 50%, twelve,\ntwenty-four, thirty-six, and forty-eight\n\nmonths after said\nsignature 20%, 15%, 10%, and 5% respectively. The contracts will have the term provided\nin Article 2 subsections a and b of this resolution, but the years\nof existence of these plantations will be recognized; up to a maximum of 3 years from\nestablishment.\n\nh. Natural or legal\npersons wishing to reforest in areas larger than the limit established in the Regulations\nto the Forestry Law, Decree No. 25721-MINAE and its Amendments, may apply under a\nspecial financing scheme, being able to double the limit of 750 hectares,\nprovided that the available resources are not used by small producers.\nThe amounts to be paid will be those established in subsections a, b, and c above.\n\ni. The National Forest\nFinancing Fund is instructed to incorporate into the Payment\nfor Environmental Services contracts in the Reforestation activity the minimum acceptable\nvalues for making payments.\n\nThe National Forest\nFinancing Fund will use the following reference values to\nprocess the payments corresponding to each year:\n\nTable 1. The State, through\nFonafifo, will acquire the environmental services produced by forest\nplantations, understood as set forth in subsection k of Article 3 of the Forestry\nLaw No. 7575.\n\nk. Specifically, the\nenvironmental services provided by plantations will be paid according to the\nannual biomass growth in accordance with parameters established in this resolution.\nSaid payments correspond to the total years of the agreed term; however, in\norder to allow the establishment of the plantation and its maintenance, payment will be advanced\nduring the first five years.\n\nl. Fonafifo may\nmodify, when so requested, those contracts signed before the year\n2015, that demonstrate having achieved a minimum production of 13 cubic meters\nof mean annual increment per hectare. For such purposes, Fonafifo may\nrequest the information it deems pertinent.\n\n2.2. Natural Regeneration\nActivity: The conditions that will govern the processing of\napplications for the recognition of Environmental Services in the Natural Regeneration activity that are developed\nin denuded areas, without forest cover, with nearby seed sources, in\nareas in the process of regeneration that do not meet the definition of forest and are free\nfrom grazing, are detailed below:\n\na. The amount to be paid for\nNatural Regeneration will be eighty-two thousand five hundred sixty-five\ncolones with 00/100 (¢82,565) per hectare, disbursed in five annual payments\nof 20% over a period of five years.\n\n2.3. Agroforestry Systems\nActivity: The conditions that will govern the processing of applications,\nfor the recognition of environmental services in the Agroforestry Systems\nactivity, are detailed below.\n\na. The amount to be paid will be\none thousand eighty-five colones with 00/100 (¢1,085) per tree, integrated into\nAgroforestry Systems and disbursed over a period of five years. Payments will be\ndistributed as follows: 50% the first year, 25% the third year,\nand 25% the fifth year.\n\nb. The amount to be paid will be\none thousand six hundred eight colones with 00/100 (¢1,608) per tree, integrated into\nAgroforestry Systems, strictly with native species included in the Decrees\nExecutive Decrees No. 25663-MINAE of October 8, 1996 and No. 25700-MINAE of November 15,\n1996, disbursed over a period of five years. Payments will be\ndistributed as follows: 50% the first year, 25% the third year, and 25%\nthe fifth year.\n\nc. The amount to be paid will be one thousand six hundred eight colones\nwith\n\n00/100 (¢1,608) per tree,\nunder the activity of Agroforestry Systems established in Forest Harvesting Plantations (Plantaciones de Aprovechamiento Forestal, PPAF), financed through forestry credit. Payments will be\ndistributed as follows: 80% will be disbursed once the contract is signed and\nthe trees have reached 36 months of age; the remaining 20% will\nbe processed when the trees are 60 months of age, in the fifth year of the\nproject.\n\nd. Mixed Agroforestry Systems for small producers: The conditions for this modality\nare: When conducting forest protection activities, a payment of twenty-one\nthousand six hundred colones with 00/100 (¢21,600) per hectare per year, over a\nperiod of five years, (here, if necessary, fractions of\nexisting hectares will be calculated, up to the first decimal. When the areas are denuded or in\nthe process of regeneration, a payment of sixteen thousand five hundred\nthirteen colones with 00/100 (¢16,513) per hectare, per year over a period of\nfive years will be recognized.\n\nWhen conducting reforestation activities with timber or multipurpose species outside the forested area, a payment of three hundred twenty-three colones with 00/100 per tree (¢323) per year over a period of five years; a minimum quantity of two hundred planted trees or identified existing trees will be recognized, up to a maximum of two thousand two hundred trees. In this sub-activity, a single contract may be executed that includes the different activities, for which at least two of the activities described above must be implemented, where the reforestation activity of timber or multipurpose species is mandatory to establish; and the term will be five years counted from the signing of the contract.\n\ne. The amount to be paid will be\none thousand five hundred colones with 00/100 (¢1,500) per tree, under the activity of\nAgroforestry Systems established in Low-Scale Wood Production Systems (Sistemas Productivos de Madera a Baja Escala, SIPMABE). Payments will be\ndistributed as follows: 70% the first year, 15% the second year, and\n15% the fourth year. And in the event that the contract\nincludes a financing component through a forestry credit,\na total of one thousand six hundred fifty colones with 00/100 (¢1,650) per tree will be recognized, and payments will be\ndistributed as follows: 40% the first year, 10% the second, third,\nand fourth year, and 30% the fifth year.\n\n2.4. Forest Protection\nActivity: The conditions that will govern the processing of\napplications for the recognition of Environmental or Ecosystem Services\nin the Forest Protection activity are as follows:\n\na. The amount to be paid for\nthe environmental service of greenhouse gas mitigation and\nbiodiversity, considered as the base, will be one hundred five thousand colones exactly\n(¢105,000.00) per hectare, disbursed over a period of five years;\ndistributed in annual payments of 20% each.\n\nb. The amount to be paid for\nthe environmental service of greenhouse gas mitigation and\nbiodiversity, considered as the base, plus an additional amount for the service of\nprotection of the water resource, considered as a supplement, will be one hundred\neighty-five thousand colones with 00/100 (¢185,000.00) per hectare, disbursed over\na period of five years; distributed in annual payments of 20% each.\n\nc. The amount to be paid for\nthe environmental service of greenhouse gas mitigation and\nbiodiversity, considered as the base, plus an additional amount for the service of\nprotection of sites of high biodiversity, considered as a supplement, will be\none hundred eighty-five thousand colones with 00/100 (¢185,000.00) per hectare, disbursed\n\nover a period of five\nyears; distributed in annual payments of 20% each.\n\nd. Real estate\nlocated within the geospatial layers corresponding to\nwater resource or high biodiversity will be eligible to receive the respective\nrecognition in the Forest Protection activity in accordance with what is indicated\nin this resolution.\n\n3. Updating of the\namounts to be paid. For subsequent annual payments, MINAE, by\nreasoned resolution, may vary these amounts and update them; likewise, it\nmay decree extraordinary increases in the amounts to be paid, the foregoing\nconsidering budget availability and its inclusion in the\ncorresponding budgets.\n\n Article Sheet\n\nArticle 2.-The National\nForest Financing Fund is instructed to incorporate the following conditions into the\nPayment for Environmental or Ecosystem Services contracts:\n\n1. Regarding the terms of\nthe contracts: The terms of the Payment\nfor Environmental or Ecosystem Services contracts, generated by the activities\ncorresponding to the modalities of recovery and/or maintenance of forest\ncover, will be as follows:\n\na. Contracts\ncorresponding to the Reforestation activity through the establishment of\nfast-growing species will have a term of ten years from\ntheir signing.\n\nb. Contracts\ncorresponding to the Reforestation activity that incorporate\nmedium-growing species and native species included in Decrees No.\n25663-MINAE of October 8, 1996 and No. 25700-MINAE of November 15,\n1996, will have a term of sixteen years from their signing; including reforestation contracts with own resources and reforestation contracts that exceed the established limit.\n\nc. Contracts\ncorresponding to the sub-activity of Forest Plantations with Reduced\nRotation Cycles (PFTRR) will have a term of six years from their signing.\n\nd. Contracts\ncorresponding to the Natural Regeneration activity will have a term of\nfive years from their signing.\n\ne. Contracts\ncorresponding to the activity of establishing trees in Agroforestry Systems with fast-growing, medium-growing, and native species included in Decrees No. 25663-MINAE of October 8, 1996 and No. 25700-MINAE of November 15, 1996, will have a term of five years from their signing.\n\nf. Contracts corresponding to the sub-activity of Agroforestry Systems established in Forest Harvesting Plantations (PPAF) will have a term of 2 years from their signing; given that they are already planted and for this reason, three years will be recognized retroactively for their prior establishment.\n\ng. Contracts\ncorresponding to the sub-activity of Mixed Agroforestry Systems for\nmicro-producers will have a term of five years from their signing.\n\nh. Contracts\ncorresponding to the sub-activity of Low-Scale Wood Production Systems (SIPMABE) will have a term of six years from their signing; However,\nthe beneficiary may request the advancement of said\nterm by one calendar year (for a total of five years of contract compliance),\nprovided that the minimum reference values\nfor diameter (DBH) and total height (Htot) for plantations of\nfast-growing species corresponding to year six, which are indicated in the\npresent resolution, are met at that time. Furthermore, said act must be technically approved by the\nhead of the respective regional office.\n\ni. Contracts\ncorresponding to the activity of establishing trees in Agroforestry\nSystems related to agreements or other donors or partners will have a\nterm of five years from their signing.\n\nj. Contracts\ncorresponding to the Forest Protection activity related to the\nmitigation of greenhouse gases and biodiversity; as well as those\nthat contemplate the additional recognition for water resource and/or high\nbiodiversity, will have a term of 5 years from the date on which\nthe application for entry to the National Forest Financing Fund is submitted.\n\n2. Regarding the Conditions\n\nIn accordance with what is\nstipulated in the Forestry Law, its Regulations, the Procedures Manual for\nthe Payment for Environmental Services Program, the Procedures Manual for\nthe Payment for Environmental or Ecosystem Services Program in Forest\nProtection, and applicable regulations, the applications for entry to the Payment\nfor Environmental Services Program and the contracts that are formalized must\ncomply with the following general and special conditions:\n\n2.1. General Conditions\n\na. The National\nForest Financing Fund is authorized to establish activities and amounts\ndifferentiated from those indicated in this resolution, in accordance with agreements,\nconventions, or specific contracts or projects with entities that contribute financial\nresources to the Payment for Environmental or Ecosystem Services Program, which\nrecognize amounts and conditions different from those established for the\ndifferent environmental services; for these projects, the\nprioritization criteria detailed above will not apply, but rather those agreed upon in each\nconvention, as well as the special rules that correspond according to the\nnature of the activity. Payments will be made provided there is\nbudget availability to cover the commitments acquired through\nthe Payment for Environmental or Ecosystem Services Program.\n\nb. The pending amounts\nto be paid for contracts from previous years will be governed by what is established\nin the Executive Decrees and Administrative Resolutions corresponding to\neach year.\n\nc. For payments not\nprocessed before the year 2024 in a timely manner, a period of 18\nmonths of expiration is established for the claim of installments derived from the contracts of\npayment for environmental or ecosystem services, in all their modalities, from\nthe moment such obligation was enforceable, unless\nan acceptable justification is presented to Fonafifo in accordance with the principles of\nreasonableness and proportionality. This expiration will not affect the validity of the contract.\nd. To cover the cost of\nregistering the contract with the Public Registry, the National Forest\nFinancing Fund will withhold 0.6% from the first disbursement of the total contract amount.\n\ne. The resources recovered due to breaches\nof payment for environmental services contracts or refunds or settlements,\nwill be transferred to Trust 544 ONAFIFO/BNCR and will be budgeted for\nthe execution of new promotion activities for small and medium-sized producers.\n\nf. In the event that\noverlaps or displacement are determined between submitted\napplications and/or with other properties, Fonafifo will assess\nin accordance with technical and legal criteria the approval or rejection of the applications\nfor entry.\n\ng. Applications\nfor entry submitted to access the Payment for Environmental\nor Ecosystem Services Program must contain the contact information\n(email, telephone number, physical address or domicile) of the\nproperty owner(s). Without this information, the\nadministration will deem the application incomplete and proceed to flag it,\nso that the applicant proceeds to complete it, as said\ninformation is fundamental for the notifications that must be made; if\nthe information is not provided, the application will be archived.\n\nh. In those cases where\nthe beneficiary or beneficiaries of the Payment for Environmental\nor Ecosystem Services contract are in default of their obligations to the\nCosta Rican Social Security Fund (CCSS), Fonafifo will process the\npayment of said contracts in accordance with the procedure established for this purpose by the\nCCSS and according to the provisions of Law No. 9686 and its amendments.\n\n2.2. Special Conditions\n\n2.2.1. In the activities of\nreforestation, natural regeneration, and agroforestry systems.\n\na) Projects\nexecuted under these activities must have a forestry regent (regente forestal) during\nthe entire term of the payment for environmental services contract. The regency\nform may be registered with the College of Agronomists, for\nthe entire term of the payment for environmental services contract, or for\nannual or five-year periods, as determined by the property\nowner. Whatever the form of payment, the\nregency form must always be provided, duly registered and in force during the respective payment\nprocess.\n\nb) Notwithstanding other\nprovisions, the beneficiary or beneficiaries must provide an\nannual regency report issued by a forestry regent for the payment\nprocess; or eventually a technical report issued by a forestry professional,\nfor those projects where the figure of the forestry regent does not apply.\nAdditionally, for Fast-Growing Reforestation contracts,\nthey must present visit reports, certifying the status of the\nprojects at years 8 and 10 from their planting date; for projects\nof medium growth and other species, they must present said reports at\nyear 8, 12, and 16 from their planting date.\n\nc) Without prejudice to other actions that constitute a breach of contract obligations, for Reforestación de Rápido Crecimiento (Fast-Growth Reforestation) contracts and Sistemas Agroforestales (Agroforestry Systems) established in Sistemas Productivos de Madera a Baja Escala (Low-Scale Timber Production Systems, SIPMABE) after 12 months and for Mediano Crecimiento (Medium-Growth) plantations after 24 months from plantation establishment, the contract is considered breached if the plantation does not meet the minimum growth established in Article 1, subsection 2.1, or that previously indicated in the respective technical study for other species. As a consequence of this breach, the producer will not receive the payment corresponding to that year, and the Fondo Nacional de Financiamiento Forestal must suspend the respective payments and terminate the contract with liability for the beneficiary, following due process. In highly qualified cases, based on studies and/or reports from the personnel in charge of Fonafifo Regional Offices, the respective payment may proceed and the contract may continue even with lower growth indices, provided these are not due to breaches, poor site selection, species selection, or result from inadequate plantation management.\n\nd) As a general principle, acts of God, force majeure, and third-party acts, duly proven and assessed at the discretion of Fonafifo, shall be grounds for exemption from liability for breach of contract. Similarly, this shall apply when the plantation owner demonstrates that a pest or disease affected the plantation and that the actions timely undertaken failed to eradicate it, provided these are documented in the PSA file and have the approval of the Regional Office. The same shall apply when the damage results from a fire that could not be controlled despite reported preventive measures.\n\ne) Projects may not be executed on farms that have been subject to pests, diseases, or fires; in such a case, the farm may not be subject to contracts in Reforestation and/or Agroforestry Systems, both in Block and in Low-Scale Timber Production Systems (SIPMABE), for a period of 3 years from the last contract terminated for this reason.\n\nf) Regarding pests and diseases affecting forest plantations, the Junta Directiva of Fonafifo shall determine guidelines to address and resolve these situations.\n\ng) Fonafifo shall be responsible for monitoring the forest plantations that enter the Program, requiring not only regional-level follow-up but also a control protocol, through a random visit mechanism according to its technical and administrative capacity, in accordance with the availability of budgeted resources. Likewise, it must safeguard the information from permanent measurement plots of the plantations, in order to support payments and back the quantification of carbon and other greenhouse gas sequestration.\n\nh) To standardize the required information from permanent plots of plantations and agroforestry systems, both in blocks and in Low-Scale Timber Production Systems (SIPMABE), Fonafifo shall issue the format for the content of the Excel database, for forestry regents to submit annually with individual diameter and height data. The file is available on the Fonafifo website (www.fonafifo.go.cr) for download.\n\ni) In the case of entry applications for the Reforestation activity involving mixtures of fast-growth, medium-growth, and/or endangered species, separate contracts must be generated, due to the growth differences that exist among these species groups. Furthermore, projects composed of native species contained in Decretos N° 25663-MINAE of October 8, 1996, and N° 25700-MINAE of November 15, 1996, must contain 100% of the trees of the species listed in said decrees; otherwise, their value will be based on the lower amount established for Reforestation.\n\nj) Forest plantations of endangered species planted with financing from Pago por Servicios Ambientales contracts may be harvested based on Article 28 of the Ley Forestal.\n\nk) Reforestation projects from the years 2016 to 2023 shall be assessed according to the growth parameters established in ministerial resolution R-167-2019-MINAE, published in La Gaceta N° 138 of July 23, 2019.\n\n2.2.2. In Forest Protection activities.\n\na) In accordance with the provisions of Decreto Ejecutivo N°44607-MINAE, published in Alcance N°145 to La Gaceta N°156 of August 26, 2024, for the formalization of Forest Protection contracts, the applicant must contract the services of a forestry professional, who, in addition to submitting the respective reports, must conduct the corresponding technical visits in the third and fifth years of the contract’s term. For such purposes, it shall be an essential requirement that said professional is duly accredited to practice before the Colegio de Ingenieros Agrónomos de Costa Rica.\n\nFor the follow-up in the second and fourth years of the contractual term, the provisions of Article 124 of the Reglamento a la Ley Forestal shall apply.\n\nb) In entry applications for the Forest Protection activity that are assessed according to the Qualification Matrix and that present several farms, the qualification will depend on the largest farm included in the application.\n\nc) For properties located on the boundary of priority areas, those properties that have at least 30% within said areas shall be considered for the purposes of the forest protection activity.\n\nd) For the additional recognition for water resource protection and/or high biodiversity, the properties must have at least 30% within the areas defined for this recognition.
