Que el proceso respondió a lo establecido en la Guía oficial\ndel SINAC para el Diseño y Formulación del Plan General de Manejo de las Áreas Silvestres\nProtegidas de Costa Rica.\n\n3.1.- Que\nel proceso de elaboración del Plan General de Manejo referido fue altamente\nparticipativo.\n\n3.2.- Que el Marco Estratégico, la\nzonificación, los programas de manejo, el cronograma y el modelo de gestión\npropuestos el Plan General de Manejo del Área Marina de Manejo del\nBicentenario, son acordes con el ordenamiento jurídico nacional.\n\nIV.-Que el proceso de elaboración del Plan General de Manejo del\nÁrea Marina de Manejo del Bicentenario respondió a lo establecido en la\n\"Guía oficial del SINAC para el Diseño y Formulación del Plan General de\nManejo de las Áreas Silvestres Protegidas de Costa Rica\".\n\nV.-Que el Plan General de Manejo del Área Marina de Manejo del\nBicentenario fue aprobado por el Consejo Regional del Área de Conservación\n(CORACMC), mediante acuerdo N° 17 de la sesión ordinaria N° 13-2025 del día 20\nde agosto del 2025, siguiendo la recomendación del Comité Técnico del ACMC\nacordada en la sesión del N° 07 de 21 de julio del 2025, según oficio CARTA-SINAC_ACMC-DR-0266_2025.\n\nVI.-Que conforme a lo dispuesto en el artículo 12 inciso d) del\nDecreto Ejecutivo N° 34433-MINAE denominado \"Reglamento a la Ley de\nBiodiversidad\", es competencia del Consejo Nacional de Áreas de\nConservación aprobar los Planes Generales de Manejo de las Áreas Silvestres\nProtegidas. Por tanto,\n\nLA DIRECCIÓN DEL ÁREA DE CONSERVACIÓN\n\nMARINA COCO, RESUELVE:\n\n1°-Validar y aprobar el Plan General de Manejo del Área Marina de\nManejo del Bicentenario aprobado por el Consejo Nacional de Áreas de\nConservación mediante acuerdo N° 17 de la sesión ordinaria 13-2025 del 20 de\nagosto 2025, que dispone los siguientes aspectos de relevancia:\n\n1. Objetivo del PGM del AMM B.\n\nGestionar\nla conservación de la biodiversidad y el legado histórico-cultural excepcional\ndel Área Marina de Manejo del Bicentenario con solidez científico-técnica,\ninnovación, talento humano comprometido y calificado, con el apoyo de aliados\nestratégicos\n\n2. Elementos\nFocales de Manejo (EFM).\n\n- Pesca sostenible: Considerada un eje estratégico por su relevancia\ncultural, económica y ecológica. Se destaca la importancia de la ciencia\npesquera como base para una gestión sustentada en evidencia, buenas prácticas y\nla participación activa de actores clave.\n\n- Montes submarinos: Estructuras geológicas esenciales para la\nbiodiversidad marina y los procesos ecológicos. Se reconoce una significativa\ncarencia de información científica específica sobre estos hábitats, lo que\nrepresenta un desafío para su conservación efectiva.\n\n- Ecosistemas pelágicos: Incluyen especies altamente migratorias,\nclaves para la conectividad y estabilidad de redes tróficas. Se destacan\ndesafíos vinculados a la presión de la actividad pesquera no sostenible, la\ncontaminación y los efectos del cambio climático.\n\n3. Descripción\nde las Zonas de Manejo.\n\nLa zonificación de AMMB, incluye 4 zonas oceánicas\n\n- Zona de Amortiguamiento o Alerta: Comprende de los 0 a los 500 m\nde profundidad y 5 millas náuticas alrededor del PNIC. Es de carácter\nprecautoria entre dos áreas marinas protegidas con diferente categoría de\nmanejo (PNIC como parque nacional y AMMB como área marina de manejo).\n\n- Zona de Uso sostenible: Localizada entre los 0 a los 500 m de\nprofundidad. Se permiten actividades de carácter comercial o deportivo-turístico,\nactividad pesquera de la flota comercial de avanzada\nasí como embarcaciones de pesca deportiva-turística o de investigación.\n\n- Zona de Mínima intervención: Se permiten actividades de muy baja\nintensidad y con controles rigurosos desde 500 m de profundidad hasta el bentos (fondo marino).\n\n- Zona de Nula intervención: Es de protección absoluta en un margen de 2\nmillas náuticas alrededor de la base de los montes submarinos ubicados a partir\nde los 500 m de profundidad al bentos.\n\n4. Objetivos de conservación del Área Marina de Manejo del Bicentenario.\n\nEl Artículo 4 del Decreto Ejecutivo N° 43368-MINAE\nestablece, de forma textual, los siguientes objetivos del AMMB:\n\n- Promover la conservación y el uso sostenible de una de las áreas marinas\nde mayor productividad en el Pacífico Oriental Tropical.\n\n- Manejar de manera integral una parte representativa del ecosistema marino\nde la Cordillera Submarina del Coco.\n\n- Conservar sitios de agregación (descanso, reproducción, limpieza, y\nalimentación) de especies vulnerables, amenazadas o en peligro, tales como\nquelonios, cetáceos, elasmobranquios, y especies pelágicas, algunas de\nimportancia comercial.\n\n- Conservar ecosistemas de profundidad como formaciones coralinas mesofóticas, comunidades de\ncorales azooxantelados, llanuras abisales, dorsales, y sus comunidades bentónicas, especies\nendémicas, y posibles especies nuevas para la ciencia.\n\n- Conservar áreas de alimentación y tránsito de aves marinas.\n\n- Promover la conectividad estructural y funcional de especies\naltamente migratorias a nivel del Corredor del Pacífico Este Tropical.\n\nLa categoría de manejo del AMMB\ncomo se dijo anteriormente, permite y pretende un manejo sostenible de los\nrecursos hidrobiológicos y de los ecosistemas que alberga. De acuerdo con lo\nestablecido en el Decreto Ejecutivo N° 43368-MINAE, dentro del AMMB se\nautorizan las siguientes actividades:\n\n- Pesca sostenible (especificada y\nregulada por la zonificación y el Plan de Gestión Pesquera (PGP) que se\nelaborará posteriormente).\n\n- Ecoturismo, incluyendo buceo recreativo, snorkel.\n\n- Investigación científica y académica, incluyendo manejo activo y\nacceso a recursos genéticos y bioquímicos de la biodiversidad, así como\ninvestigación del patrimonio histórico subacuático en caso de que lo hubiera.\n\nLos permisos para ingresar al área y realizar estas actividades\nson otorgados por el ACMC, a excepción del permiso de acceso a los elementos y\nrecursos genéticos y bioquímicos de la biodiversidad que lo otorga la Comisión\nNacional de Gestión de la Biodiversidad (Conagebio),\nel permiso de investigación del patrimonio cultural subacuático que lo otorga\nel Museo Nacional, específicamente la Comisión Nacional de Patrimonio Cultural\ny las licencias de pesca a embarcaciones que son otorgadas por Incopesca.\n\nEl tipo de pesca permitido -comercial, turística y deportiva- está\nestablecido en el Decreto N° 35369 de 18 de mayo de 2009. Este mismo decreto\nprohíbe la pesca de arrastre, la pesca semiindustrial\n(cerco) e industrial y la exploración y explotación petrolera. Para regular la\npesca, el AMMB debe contar con un plan específico llamado Plan de Gestión\nPesquera (PGP) que forma parte, como los demás planes específicos, del PGM del\nAMMB. Las embarcaciones a su vez deben de contar además de la licencia de\npesca, con otros permisos de navegabilidad, salida de puerto, entre otros,\nextendidos por otras instituciones.\n\n5. Modelo\nde Gestión.\n\nEl modelo\nde gestión, el PGM se conforma de cinco programas y uno de ellos se subdivide\nen cuatro subprogramas, a saber:\n\n1.\nCoordinación estratégica.\n\n- Alianzas\ny gobernanza.\n\n- Financiamiento cooperación y\nproyectos.\n\n- Administración y operaciones.\n\n- Talento Humano.\n\n2.\nPrevención, protección y control.\n\n3. Investigación y monitoreo.\n\n4. Pesca sostenible.\n\n5. Información y comunicación.\n\n6. Plan de Acción.\n\nCada\nprograma o subprograma cuenta con un resultado estratégico vinculado a\nindicadores de gestión, enfocados en los aspectos más relevantes para su\nseguimiento y evaluación. Para alcanzar dichos resultados, se desagregan\nacciones estratégicas, resultados esperados y actividades requeridas, los\ncuales constituyen el Plan de Acción.\n\nEn resumen, el PGM se estructura en cinco programas, cuatro subprogramas,\nocho resultados estratégicos, 28 indicadores de gestión, 29 acciones\nestratégicas, 50 resultados esperados y 132 actividades requeridas.\n\n3°-Elevar la presente resolución administrativa al\nConsejo Nacional de Áreas de Conservación para su respectiva validación y\noficialización.\n\n4°-Publicar en la página Web institucional, el documento completo del Plan\nGeneral de Manejo del Área Marina de Manejo del Bicentenario.\n\n5°-Publíquese la presente resolución en el Diario Oficial La Gaceta una vez que conste el respectivo\nacuerdo de validación y oficialización del Consejo Nacional de Áreas de Conservación.", "body_en_text": "across the entirety of the text\n\n -\n\n Complete Text of Norm 0086\n\n General Management Plan of the Bicentennial Marine Management Area\n\nNATIONAL SYSTEM OF CONSERVATION AREAS\n\nCOCOS MARINE CONSERVATION AREA\n\nREGIONAL DIRECTORATE\n\nResolution SINAC-ACMC-DR-RES-0086-2025.-Ministry of Environment and Energy.-National System of Conservation\nAreas.-Cocos Marine Conservation Area, at eleven hours and thirty-seven minutes\non October 6, 2025.\n\nWhereas:\n\n1°-That in accordance with article 22 of the Biodiversity Law,\nthe National System of Conservation Areas is created, hereinafter SINAC, with\nits own legal personality, as a decentralized and participatory institutional\nmanagement and coordination system that integrates competencies in\nforestry, wildlife, and protected areas matters, in order to issue\npolicies, plan, and execute processes aimed at achieving sustainability\nin the management of the natural resources of Costa Rica.\n\n2°-That it is a priority policy of SINAC to facilitate and promote\nactions that lead to the protection, conservation, and sustainable management of\nthe natural resources and biodiversity present in the Protected Wild Areas,\nhereinafter the ASP, of the Conservation Areas.\n\n3°-That in accordance with articles 23 and 28 of the Biodiversity\nLaw No. 7788, published in La Gaceta No. 101 of May 27,\n1998 and articles 9 and 21 of the Regulation to the Biodiversity Law, Executive\nDecree No. 34433-MINAE, published in La Gaceta No. 68 of April 8,\n2008, the Cocos Marine Conservation Area, hereinafter referred to as the ACMC, is\npart of the organization of SINAC.\n\n4°-That by means of Executive Decree No. 43368 published in the\nGaceta No. 16 dated January 26, 2022, the Bicentennial Marine Management Area is created.\n\n5°-That by means of a Correction of Errors published in La Gaceta No. 89\nof May 16, 2022, articles 1 and 3 of the aforementioned executive\ndecree were corrected regarding the number of decimal places of the\ncoordinates.\n\n6°-That the proposal for the General Management Plan of the Bicentennial Marine Management Area National Park has been prepared, with the objective of\nManaging the sustainable use and conservation of the biodiversity of the Bicentennial\nMarine Management Area through the implementation of effective management\nstrategies and participatory governance based on inter-institutional\nand sectoral alliances.\n\nConsidering:\n\nI.-That it is the competence of SINAC through the Cocos Marine\nConservation Area to plan and administer the ASP Bicentennial Marine Management\nArea located within its administrative jurisdiction.\n\nII.-That the General Management Plans of protected wild areas\nconstitute the guiding instruments for an effective administration and\nmanagement of the natural, marine, and cultural elements present in said area\nand of the socio-environmental dynamics linked to it; constituting an\ninstrument specific to the protected wild area and must be seen as a\ntechnical tool owned by the managers, administrators, and interest\ngroups, therefore, the first instance that must carry out the validation of\nthe management proposal are the authorities of the respective Conservation Area,\nas well as the official instances of social participation established therein,\nwhich has been carried out as recorded in the administrative file.\n\nIII.-That as recorded in the\nfile, the legality block has been fulfilled under the following\nconsiderations:\n\na)\nAppointment of the Follow-up Commission by means of official communication\nSINAC-ACMC-DR-0203-2024, of April 29, 2024.\n\nb) Terms of Reference of the\nconsulting firm.\n\nParticipation process through participatory roundtables, workshops,\nand meetings; visible in the file which includes minutes and attendance lists\nfor meetings of the Follow-up Commission and participants in the workshops and\nconsultative participatory roundtables visible in the document of the proposed General\nManagement Plan.\n\n3. That the process responded to what is established in the official SINAC\nGuide for the Design and Formulation of the General Management Plan of the Protected Wild\nAreas of Costa Rica.\n\n3.1.- That\nthe process of preparing the referred General Management Plan was highly\nparticipatory.\n\n3.2.- That the Strategic Framework, the\nzoning, the management programs, the timeline, and the management model\nproposed in the General Management Plan of the Bicentennial Marine Management\nArea are consistent with the national legal framework.\n\nIV.-That the process of preparing the General Management Plan of the\nBicentennial Marine Management Area responded to what is established in the\n\"Official SINAC Guide for the Design and Formulation of the General\nManagement Plan of the Protected Wild Areas of Costa Rica.\"\n\nV.-That the General Management Plan of the Bicentennial Marine Management\nArea was approved by the Regional Council of the Conservation Area\n(CORACMC), by means of agreement No. 17 of regular session No. 13-2025 of the day 20\nof August 2025, following the recommendation of the Technical Committee of the ACMC\nagreed upon in session No. 07 of July 21, 2025, according to official communication CARTA-SINAC_ACMC-DR-0266_2025.\n\nVI.-That in accordance with the provisions of article 12 subsection d) of the\nExecutive Decree No. 34433-MINAE called \"Regulation to the Biodiversity\nLaw,\" it is the competence of the National Council of Conservation\nAreas to approve the General Management Plans of the Protected Wild\nAreas. Therefore,\n\nTHE DIRECTORATE OF THE COCOS MARINE\n\nCONSERVATION AREA, RESOLVES:\n\n1°-To validate and approve the General Management Plan of the Bicentennial Marine\nManagement Area approved by the National Council of Conservation\nAreas by means of agreement No. 17 of regular session 13-2025 of August 20,\n2025, which provides the following relevant aspects:\n\n1. Objective of the PGM of the AMM B.\n\nManaging\nthe conservation of biodiversity and the exceptional historical-cultural legacy\nof the Bicentennial Marine Management Area with scientific-technical solidity,\ninnovation, committed and qualified human talent, with the support of strategic\nallies.\n\n2. Focal\nManagement Elements (EFM).\n\n- Sustainable fishing: Considered a strategic axis due to its cultural,\neconomic, and ecological relevance. The importance of fisheries\nscience is highlighted as a basis for evidence-based management, good\npractices, and the active participation of key actors.\n\n- Seamounts: Essential geological structures for marine\nbiodiversity and ecological processes. A significant\nlack of specific scientific information on these habitats is recognized, which\nrepresents a challenge for their effective conservation.\n\n- Pelagic ecosystems: They include highly migratory species,\nkey to the connectivity and stability of trophic webs. Challenges are highlighted\nlinked to the pressure of unsustainable fishing activity,\npollution, and the effects of climate change.\n\n3. Description\nof the Management Zones.\n\nThe zoning of AMMB includes 4 oceanic zones\n\n- Buffer or Alert Zone: Comprises from 0 to 500 m\ndepth and 5 nautical miles around PNIC. It is of a\nprecautionary nature between two marine protected areas with a different management\ncategory (PNIC as a national park and AMMB as a marine management area).\n\n- Sustainable Use Zone: Located between 0 to 500 m\ndepth. Activities of a commercial or sport-tourism nature are permitted,\nfishing activity by the advanced commercial fleet,\nas well as sport-tourism or research fishing vessels.\n\n- Minimal Intervention Zone: Activities of very low\nintensity and with rigorous controls are permitted from 500 m depth down to the benthos (seafloor).\n\n- No Intervention Zone: It is of absolute protection within a margin of 2\nnautical miles around the base of the seamounts located from\n500 m depth to the benthos.\n\n4. Conservation objectives of the Bicentennial Marine Management Area.\n\nArticle 4 of Executive Decree No. 43368-MINAE\nestablishes, verbatim, the following objectives of the AMMB:\n\n- Promote the conservation and sustainable use of one of the marine areas\nof greatest productivity in the Eastern Tropical Pacific.\n\n- Comprehensively manage a representative part of the marine ecosystem\nof the Cocos Submarine Ridge.\n\n- Conserve aggregation sites (resting, reproduction, cleaning, and\nfeeding) for vulnerable, threatened, or endangered species, such as\nchelonians, cetaceans, elasmobranchs, and pelagic species, some of\ncommercial importance.\n\n- Conserve deep-sea ecosystems such as mesophotic coral formations, communities of\nazooxanthellate corals, abyssal plains, ridges, and their benthic communities, endemic\nspecies, and possible species new to science.\n\n- Conserve feeding and transit areas for seabirds.\n\n- Promote the structural and functional connectivity of highly\nmigratory species at the level of the Eastern Tropical Pacific Corridor.\n\nThe management category of the AMMB,\nas previously stated, allows and aims for the sustainable management of\nhydrobiological resources and the ecosystems it harbors. In accordance with what is\nestablished in Executive Decree No. 43368-MINAE, the following activities are\nauthorized within the AMMB:\n\n- Sustainable fishing (specified and\nregulated by the zoning and the Fisheries Management Plan (PGP) that will\nbe prepared subsequently).\n\n- Ecotourism, including recreational diving, snorkeling.\n\n- Scientific and academic research, including active management and\naccess to genetic and biochemical resources of biodiversity, as well as\nresearch of the underwater historical heritage, should it exist.\n\nPermits to enter the area and carry out these activities\nare granted by the ACMC, with the exception of the permit to access the elements and\ngenetic and biochemical resources of biodiversity, which is granted by the National\nCommission for Biodiversity Management (Conagebio),\nthe permit for research of underwater cultural heritage, which is granted by\nthe National Museum, specifically the National Commission of Cultural Heritage,\nand the fishing licenses for vessels, which are granted by Incopesca.\n\nThe type of fishing permitted—commercial, tourism-related, and sport—is\nestablished in Decree No. 35369 of May 18, 2009. This same decree\nprohibits trawling, semi-industrial fishing\n(purse seine) and industrial fishing, and oil exploration and exploitation. To regulate\nfishing, the AMMB must have a specific plan called the Fisheries Management\nPlan (PGP) which forms part, like the other specific plans, of the PGM of the\nAMMB. The vessels, in turn, must have, in addition to the fishing\nlicense, other navigability permits, port clearance, among others,\nissued by other institutions.\n\n5. Management\nModel.\n\nThe management\nmodel of the PGM is made up of five programs, and one of them is subdivided\ninto four subprograms, namely:\n\n1.\nStrategic coordination.\n\n- Alliances\nand governance.\n\n- Financing, cooperation, and\nprojects.\n\n- Administration and operations.\n\n- Human Talent.\n\n2.\nPrevention, protection, and control.\n\n3. Research and monitoring.\n\n4. Sustainable fishing.\n\n5. Information and communication.\n\n6. Action Plan.\n\nEach\nprogram or subprogram has a strategic result linked to\nmanagement indicators, focused on the most relevant aspects for its\nmonitoring and evaluation.
