Que el artículo 46 de la\nConstitución Política establece el derecho constitucional de los consumidores-y\nusuarios a la protección de su salud, ambiente, seguridad e intereses económicos,\nasí como a recibir información adecuada y veraz, a la libertad de elección y a\nun trato equitativo.\n\n2. Que el artículo 50 de la\nConstitución Política consagra el derecho de todas las personas a un ambiente\nsano y ecológicamente equilibrado, siendo el deber del Estado garantizar,\ndefender y preservar ese derecho.\n\n3. Que el artículo 27 de la\nley de Protección Fitosanitaria No. 7664 del 08 de abril de 1997, establece que\nlas personas físicas y jurídicas que importen, registren almacenen, distribuyan,\nreempaquen o mezclen sustancias químicas biológicas o afines con propósitos\ncomerciales, deberán contar con los servicios de un profesional en ciencias agrícolas,\nincorporado al Colegio de Ingenieros Agrónomos.\n\n4. Que el artículo 28 de la\nLey de Protección Fitosanitaria No. 7664 del 08 de abril de 1997, establece la\nresponsabilidad de que las sustancias químicas, biológicas o afines estén\ndebidamente registrados, etiquetados y se ajusten a todas las disposiciones de\nesta ley y sus reglamentos. Igual responsabilidad le compete al regente en lo\nrelativo a los equipos de aplicación para uso agrícola.\n\n5. Que las recomendaciones\ndel regente serán vinculantes para la persona fisica o jurídica a la cual\npresta sus servicios, así establecido en el artículo 28 de la Ley de Protección\nFitosanitaria.\n\n6. Que el artículo 29 de la\nLey de Protección Fitosanitaria, establece que todas aquellas sustancias\nquímicas, biológicas o afines para uso agrícola que se clasifiquen en las categorías\nde mayor toxicidad y las declaradas de uso restringido, deberán venderse únicamente\nmediante receta expedida por un profesional en Ciencias Agrícolas, incorporado\nal Colegio de Ingenieros Agrónomos el cual hará constar en la prescripción las\nespecificaciones e indicaciones técnicas, agronómicas y los métodos que deberán\naplicarse.\n\n7. Que el artículo 30 de la\nLey de Protección Fitosanitaria, faculta al Ministerio de Agricultura y\nGanadería a restringir o prohibir la importación, el tránsito, el redestino, la\nfabricación, la formulación, el reenvase, el reempaque, el almacenamiento, la\nventa, la mezcla y la utilización de sustancias químicas, biológicas o afines y\nequipos de aplicación para uso agrícola, cuando se justifique por razones\ntécnicas y se considere que emplearlas es perjudicial para la agricultura, la\nsalud o el ambiente.\n\n8. Que la digitalización de\ndocumentos en la administración pública transforma archivos físicos en\nversiones electrónicas para agilizar procesos, mejorar la seguridad, reducir costos\ny aumentar la transparencia, permitiendo un acceso más rápido y fácil a la información\npor parte de funcionarios y ciudadanos trayendo beneficios como eficiencia y\nagilidad mediante el aceleramiento de la gestión para la búsqueda y la\nlocalización de documentos, eliminando la lentitud de los procesos manuales y\nreduciendo errores. La Reducción de costos liberando espacio físico y disminuyendo\nlos gastos en papel e insumos y el almacenamiento físico. También mejora de la\nseguridad y protección de los documentos toda vez que la digitalización permite\nrespaldar, encriptar y controlar mediante accesos restringidos, protegiendo la\ninformación sensible. Mejora en la transparencia y acceso público con la\nfacilitación y el acceso a la información, promoviendo una mayor apertura y\ncontrol ciudadano sobre los procesos administrativos y por último mejora la colaboración\ninterinstitucional facilitando el intercambio ágil de documentos entre distintas\ndependencias, fomentando la coordinación entre las instituciones\ngubernamentales.\n\n9. Que aunado a lo indicado en el acápite anterior se hace necesario digitalizar las recetas de\nproductos restringidos y crear los libros de actas de productos restringidos, con el fin de tener un\nproceso ágil de manejo de datos asociados a estos productos y trazabilidad de toda aquella necesidad\nde información ante entes fiscalizadores, control de ventas, atención de situaciones particulares y\ndemás requerimientos de alguna información específica, lo que actualmente se ve limitado al  levarse\nde forma física, por lo que es indispensable adicionar una definición, infracciones y reformar el\nartículo 17 del Decreto Ejecutivo No 26503-MAG, denominado Reglamento de Regencias Agropecuarias del\nColegio de Ingenieros Agrónomos de Costa Rica, publicado en la Gaceta 242 del 16 de diciembre de\n1997.\n\n10. Que la Ley de la\nPromoción de la Competencia y Defensa Efectiva del Consumidor, Ley 7472 del 20\nde diciembre de 1994. en su artículo 3 establece que: \"los trámites y los requisitos\nde control y regulación de las actividades económicas no deben impedir, entorpecer\nni distorsionar las transacciones en el mercado interno e internacional. La Administración\nPública debe revisar, analizar y eliminar, cuando corresponda esos trámites\npara proteger el ejercicio de la libertad de empresa de garantizar la defensa\nde la productividad ... \".\n\n11. Que de conformidad con\nlo establecido en el artículo 12 bis del Decreto Ejecutivo Nº 37045 del 22 de\nfebrero de 2012 y su reforma \"Reglamento a la Ley de Protección al Ciudadano\ndel Exceso de Trámites y Requisitos Administrativos\", esta regulación cumple\ncon los principios de mejora regulatoria, de acuerdo con el informe Nº DMRDAR- INF-269-2025\nemitido por la Dirección de Mejora Regulatoria y Reglamentación Técnica del\nMinisterio de Economía, Industria y Comercio.\n\nPor tanto,\n\nDECRETAN:\n\nADICIÓN DEL INCISO J) DEL\nARTÍCULO 2; ARTÍCULO 3; ARTÍCULO 43;\n\nTRANSITORIO SEGUNDO Y EL\nANEXO A) Y REFORMA DEL INCISO Ñ) DEL\n\nARTÍCULO 2; ARTÍCULO 17 DEL\nDECRETO EJECUTIVO Nº 26503-MAG\n\n\"REGLAMENTO DE\nREGENCIAS AGROPECUARIAS DEL COLEGIO DE\n\nINGENIEROS AGRONOMOS DE\nCOSTA RICA\"\n\nArtículo 1.- Adiciónese el inciso j) del artículo 2 del Decreto Ejecutivo Nº\n26503-MAG, denominado Reglamento de Regencias Agropecuarias del Colegio de\nIngenieros Agrónomos de Costa Rica, publicado en la Gaceta 242 del 16 de\ndiciembre de 1997, y por consiguiente córrase el alfabeto, para que se lea de\nla siguiente manera:\n\n\"j) Libro de\ninventario de productos restringidos: registro aprobado por el Ministerio de Agricultura\ny Ganadería, en el que se hará constar todo movimiento del producto restringido\nque se manipuló, importó, formuló, reempacó y vendió. El registro debe indicar\nla fecha de su formulación o entrada al país, el nombre de las personas físicas\no jurídicas a quienes se les vendió el producto, la cantidad, presentación,\nfecha de operación, número de receta, número de factura, nombre del profesional\ny número de colegiado de quien emitió la receta, uso recomendado del producto y\nsaldo de inventarios. \"\n\nArtículo 2.- Adiciónese un artículo 3 al Decreto Ejecutivo Nº 26503-MAG, denominado Reglamento\nde Regencias Agropecuarias del Colegio de Ingenieros Agrónomos de Costa Rica,\npublicado en la Gaceta 242 del 16 de diciembre de 1997, para que se lea de la\nsiguiente manera:\n\n\"Artículo 3 °-En todas\nlas categorías regencia/es el regente deberá acatar las disposiciones específicas\nemitidas por el Servicio Fitosanitario del Estado, sobre la restricción de\nventa y uso de agroquímicos en todo el país. \".\n\nArtículo 3.- Adiciónese un articulo 43 al Decreto Ejecutivo Nº 26503-MAG, denominado Reglamento\nde Regencias Agropecuarias del Colegio de Ingenieros Agrónomos de Costa Rica,\npublicado en la Gaceta 242 del 16 de diciembre de 1997, y por consiguiente\ncórrase la numeración, para que se lea de la siguiente manera:\n\n\"Artículo 43°- Toda\ninfracción a las disposiciones del presente reglamento que afecten el uso y\nmanejo de sustancias químicas, biológicas o afines y equipos para aplicarlas en\nla agricultura dará lugar a la aplicación de las sanciones establecidas en este\nreglamento, así como las medidas especiales señaladas en los artículos 67, 78,\n79, 80 y 83 de la Ley Nº 7664 del 08 de abril de 1997 \"Ley de Protección\nFitosanitaria \"y sus reformas.\"\n\nArtículo 4.- Adiciónese un transitorio segundo al Decreto Ejecutivo Nº 26503-MAG, denominado\nReglamento de Regencias Agropecuarias del Colegio de Ingenieros Agrónomos de\nCosta Rica, publicado en la Gaceta 242 del 16 de diciembre de 1997, en cuanto\nal transitorio único existente, léase correctamente como Transitorio Uno y por\nconsiguiente el transitorio nuevo se lea de la siguiente manera:\n\n\"TRANSITORIO SEGUNDO:\nSe establece un plazo de seis meses para que las regencias aprobadas por la\nJunta Directiva del Colegio agoten los formularios físicos correspondientes a\nla receta profesional para la venta de plaguicidas, que se clasifican en la\ncategoría de mayor toxicidad y aquellos que se declaren de uso restringido.\nTranscurrido este plazo el regente deberá utilizar únicamente la receta profesional\ndigital, que se realizará mediante la plataforma web del Sen1icio Fitosanitario\ndel Estado del Ministerio de Agricultura y Ganadería. \"\n\nArtículo 5.- Adiciónese el ANEXO A al Decreto Ejecutivo Nº 26503-MAG, denominado Reglamento\nde Regencias Agropecuarias del Colegio de Ingenieros Agrónomos de Costa Rica,\npublicado en la Gaceta 242 del 16 de diciembre de 1997, para que se lea de la\nsiguiente manera:\n\nANEXO A\n\nFORMULARIOS DE RECETAS DE\nPRODUCTOS AGROQUÍMICOS\n\n1. That Article 46 of the\nPolitical Constitution establishes the constitutional right of consumers and\nusers to the protection of their health, environment, safety, and economic\ninterests, as well as to receive adequate and truthful information, freedom of\nchoice, and equitable treatment.\n\n2. That Article 50 of the\nPolitical Constitution enshrines the right of all persons to a healthy and\necologically balanced environment, it being the duty of the State to guarantee,\ndefend, and preserve that right.\n\n3. That Article 27 of the\nPhytosanitary Protection Law No. 7664 of April 8, 1997, establishes that\nnatural and legal persons who import, register, store, distribute, repackage,\nor mix chemical, biological, or related substances for commercial purposes must\nhave the services of a professional in agricultural sciences, incorporated into\nthe College of Agronomists.\n\n4. That Article 28 of the\nPhytosanitary Protection Law No. 7664 of April 8, 1997, establishes the\nresponsibility for chemical, biological, or related substances to be duly\nregistered, labeled, and compliant with all provisions of this law and its\nregulations. The same responsibility falls upon the agricultural steward (regente) regarding\napplication equipment for agricultural use.\n\n5. That the recommendations\nof the agricultural steward (regente) shall be binding on the natural or legal\nperson to whom they provide their services, as established in Article 28 of the\nPhytosanitary Protection Law.\n\n6. That Article 29 of the\nPhytosanitary Protection Law establishes that all those chemical, biological, or\nrelated substances for agricultural use that are classified in the categories\nof highest toxicity and those declared for restricted use, shall be sold only\nby means of a prescription issued by a professional in Agricultural Sciences,\nincorporated into the College of Agronomists, who shall state in the\nprescription the technical and agronomic specifications and indications and the\nmethods to be applied.\n\n7. That Article 30 of the\nPhytosanitary Protection Law authorizes the Ministry of Agriculture and\nLivestock to restrict or prohibit the import, transit, re-consignment,\nmanufacture, formulation, re-containerization, repackaging, storage, sale,\nmixing, and use of chemical, biological, or related substances and application\nequipment for agricultural use, when justified for technical reasons and it is\nconsidered that their use is harmful to agriculture, health, or the\nenvironment.\n\n8. That the digitization of\ndocuments in the public administration transforms physical files into\nelectronic versions to streamline processes, improve security, reduce costs,\nand increase transparency, allowing faster and easier access to information by\nofficials and citizens, bringing benefits such as efficiency and agility by\naccelerating the management of document search and retrieval, eliminating the\nslowness of manual processes and reducing errors. Cost reduction by freeing up\nphysical space and decreasing expenses on paper, supplies, and physical\nstorage. It also improves document security and protection, since digitization\nallows for backing up, encrypting, and controlling information through\nrestricted access, protecting sensitive information. Improvement in\ntransparency and public access by facilitating access to information, promoting\ngreater openness and citizen oversight of administrative processes, and finally\nimproving inter-institutional collaboration by facilitating the agile exchange\nof documents between different departments, fostering coordination among\ngovernment institutions.\n\n9. That in addition to what\nis indicated in the preceding paragraph, it is necessary to digitize the prescriptions\nfor restricted products and create the record books (libros de actas) for restricted\nproducts, in order to have an agile process for managing data associated with\nthese products and traceability for all information needs before oversight\nentities, sales control, attention to particular situations, and other\nrequirements for specific information, which is currently limited by being kept\nin physical form; therefore, it is essential to add a definition, infractions, and\nreform Article 17 of Executive Decree No. 26503-MAG, called the Agricultural\nStewardship Regulations of the College of Agronomists of Costa Rica, published\nin Gazette 242 of December 16, 1997.\n\n10. That the Law for the\nPromotion of Competition and Effective Defense of the Consumer, Law 7472 of\nDecember 20, 1994, in its Article 3 establishes that: \"the procedures and\nrequirements for control and regulation of economic activities must not impede,\nhinder, or distort transactions in the domestic and international market. The\nPublic Administration must review, analyze, and eliminate, when appropriate,\nthose procedures to protect the exercise of freedom of enterprise and guarantee\nthe defense of productivity ... \".\n\n11.
