deportiva, en el Golfo de\nNicoya\n\nINSTITUTO COSTARRICENSE DE PESCA Y\nACUICULTURA\n\nAJDIP/101-2026.-Acuerdo de Junta Directiva\nINCOPESCA.\n\nConsiderando:\n\n1º-Que\nmediante oficio DDI-012-02-2019, se emitió criterio técnico para proponer la\nveda, el Documento Técnico n.º 24, en el que se analiza el comportamiento\ntemporal de las corvinas reina, aguada, picuda, y de las especies marinas de\nalto interés comercial en el golfo de Nicoya, propone que la veda se mantenga de\nmayo a julio de 2026.\n\n2º-Que el INCOPESCA tiene los estudios\ncientíficos que fundamentan el establecimiento del periodo de veda de mayo a\njulio de 2026 en el Golfo de Nicoya.\n\n3º-Que mediante el acuerdo de Junta\nDirectiva n.º AJDIP/040-2023, del 28-02-2023 se ratificó el informe de\ninvestigación oficio DOPA-014-2023, con los resultados de la investigación\nsobre la captura de fauna de acompañamiento en la pesca semiindustrial de las\nespecies de Sardina del complejo Ophistonema sp. en el Golfo de Nicoya, realizado\npor el Departamento de Investigación, el cual es concluyente en cuanto a la\nconfirmación que la captura incidental no objetivo, representa menos del 3% de\nla captura total de sardina, ubicándose dentro del 10% del margen máximo de\ntolerancia permitido conforme a lo normado mediante el punto 1.4. del acuerdo\nde Junta Directiva N.º AJDIP/100-2021.\n\n4º-Que en el Golfo de Nicoya INCOPESCA se\nestá desarrollando proyectos de investigación que su información contribuye a\nconservación y uso sostenible del ecosistema.\n\n5º-Que una vez discutida y analizada la\npropuesta de veda para el Golfo de Nicoya por parte de los señores miembros de\nla Junta Directiva del Instituto Costarricense de Pesca y Acuicultura, Por\ntanto,\n\nACUERDA:\n\n1.-Establecer una veda total para la pesca\ncomercial y deportiva, en el Golfo de Nicoya, desde el 01 de mayo del 2026\nhasta el 31 de julio de 2026.\n\n2.-La\nzona vedada corresponde el área delimitada por una línea recta imaginaria que\ninicia en Punta Torres conocida como Peñón (09°53´31\" Latitud Norte, 084°43´52\"\nLongitud Oeste) hasta el Faro de la Isla Negritos afuera (09°49´14\" Latitud\nNorte, 084°49´35\" Longitud Oeste) y desde ahí hasta la parte Este de Punta\nCuchillos en la Península de Nicoya (09°50´03\" Latitud Norte, 084°53´42\"\nLongitud Oeste) y de ahí aguas adentro hasta llegar a una línea recta\nimaginaria entre Puerto Níspero (10°12'7'' Latitud Norte, 85°13'9'' Longitud\nOeste) y Puerto Moreno (10°12'4'' Latitud Norte, 85°14'75\" Longitud Oeste) en\nla desembocadura del Río Tempisque.\n\n3.-Durante\nel período comprendido entre el 01 de junio al 31 de julio de 2026, y con\nfundamento en los resultados del informe DOPA-014-2023, se permite el ingreso a\nlas embarcaciones semiindustriales sardineras, para\nrealizar faenas de pesca únicamente en la zona delimitada por una línea\nimaginaria que inicia en Punta Torres conocida como Peñón (09°53´31\" Latitud\nNorte, 084°43´52\" Longitud Oeste) al Faro de la Isla Negritos afuera (09°49´14\"\nLatitud Norte, 084°49´35\" Longitud Oeste) y desde ahí hasta la parte Este de\nPunta Cuchillos en la Península de Nicoya (09°50´03\" Latitud Norte, 084°53´42\"\nLongitud Oeste) y de ahí hasta el Faro de Puntarenas (9° 58´36.03´´ Latitud\nNorte 84° 51 03.93´´Longitud Oeste), con el fin de suplir sardina para carnada\na la flota pesquera nacional y cuyos excedentes podrán ser comercializados para\notros fines.\n\nLos armadores o los capitanes de las\nembarcaciones están obligados a solicitar la inspección de desembarque según el\nprocedimiento establecido.\n\nTodo viaje de pesca realizado por la flota\nsemiindustrial, al realizar el desembarque debe ser inspeccionado por un\nfuncionario del departamento de fiscalización del INCOPESCA y dejar consignada\nla descarga en el respectivo formulario de inspecciones.\n\nEn concordancia con el acuerdo de Junta\nDirectiva n.º AJDIP/049-2020 de 02 de abril de 2020, la captura incidental en\nla pesca de sardina no puede ser superior al 10% de la captura total de la\nembarcación.\n\n4.-El Departamento de Investigación del\nINCOPESCA realizará muestreos biológicos para evaluar el comportamiento\nreproductivo de las sardinas y corvinas, y cualquier otra investigación que\ncontribuya a los análisis biológicos pesqueros.\n\n5.-Las personas con permisos de\ninvestigación y licencias de pesca turística vigentes, cuya zona de actividad\npesquera corresponda a la zona vedada, podrán acogerse a la ayuda económica\naportada por el IMAS durante el período de veda.\n\n6.-Se exceptúa de la veda, la extracción\nde moluscos que se desarrolla en el Golfo de Nicoya, a las personas físicas y\njurídicas con autorización vigente del INCOPESCA.\n\n7.-La Jefatura del Departamento de\nFiscalización del INCOPESCA coordinará con instituciones públicas: SENASA,\nMINAE, Ministerio de Seguridad Pública y el Servicio Nacional de Guardacostas\npara garantizar los operativos de control y vigilancia durante los períodos de\nveda en el Golfo de Nicoya.\n\n8.-Las embarcaciones cuyo puerto base de\noperación se encuentre ubicado dentro del área vedada del Golfo de Nicoya, pero\ncuya licencia de pesca les autoriza faenar fuera del área vedada y, por\nconsiguiente, deben navegar para trasladarse fuera del área a realizar su\nactividad pesquera; podrán ejecutarla y tramitar el combustible a precio\npreferencial. and sport fishing in the Gulf of\nNicoya\n\nCOSTA RICAN INSTITUTE OF FISHERIES AND\nAQUACULTURE\n\nAJDIP/101-2026.—Board of Directors Agreement\nINCOPESCA.\n\nConsidering:\n\n1º—That\nby official memorandum DDI-012-02-2019, a technical opinion was issued to propose the\nclosed season, Technical Document No. 24, in which the temporal behavior\nof the weakfish (corvina) species reina (reina), aguada (aguada), picuda (picuda), and of marine species of\nhigh commercial interest in the Gulf of Nicoya is analyzed, proposes that the closed season be maintained from\nMay to July 2026.\n\n2º—That INCOPESCA has the scientific\nstudies that support the establishment of the closed season period from May to\nJuly 2026 in the Gulf of Nicoya.\n\n3º—That by Board of Directors\nAgreement No. AJDIP/040-2023, of 02-28-2023, the research report official memorandum DOPA-014-2023 was ratified, with the results of the research\non the bycatch (fauna de acompañamiento) capture in the semi-industrial fishing of\nSardine (Sardina) species of the Ophistonema sp. complex in the Gulf of Nicoya, carried out\nby the Research Department, which is conclusive in confirming\nthat the non-target incidental catch represents less than 3% of\nthe total sardine catch, falling within the 10% maximum tolerance\nmargin allowed in accordance with point 1.4. of the Board of Directors\nAgreement No. AJDIP/100-2021.\n\n4º—That in the Gulf of Nicoya INCOPESCA is\ndeveloping research projects whose information contributes to\nconservation and sustainable use of the ecosystem.\n\n5º—That once the closed season proposal for the Gulf of Nicoya was discussed and analyzed by the members of\nthe Board of Directors of the Costa Rican Institute of Fisheries and Aquaculture, Therefore,\n\nIT IS AGREED:\n\n1.—To establish a total closed season for commercial\nand sport fishing, in the Gulf of Nicoya, from May 1, 2026\nuntil July 31, 2026.\n\n2.—The\nclosed zone corresponds to the area delimited by an imaginary straight line that\nbegins at Punta Torres known as Peñón (09°53´31\" North Latitude, 084°43´52\"\nWest Longitude) to the Lighthouse of Isla Negritos outer (09°49´14\" North\nLatitude, 084°49´35\" West Longitude) and from there to the East part of Punta\nCuchillos on the Nicoya Peninsula (09°50´03\" North Latitude, 084°53´42\"\nWest Longitude) and from there offshore until reaching an imaginary straight\nline between Puerto Níspero (10°12'7'' North Latitude, 85°13'9'' West\nLongitude) and Puerto Moreno (10°12'4'' North Latitude, 85°14'75\" West Longitude) at\nthe mouth of the Tempisque River.\n\n3.—During\nthe period between June 1 and July 31, 2026, and based\non the results of report DOPA-014-2023, entry is permitted for\nsemi-industrial sardine vessels, to\ncarry out fishing operations solely in the zone delimited by an imaginary\nline that begins at Punta Torres known as Peñón (09°53´31\" North Latitude, 084°43´52\" West Longitude) to the Lighthouse of Isla Negritos outer (09°49´14\"\nNorth Latitude, 084°49´35\" West Longitude) and from there to the East part of\nPunta Cuchillos on the Nicoya Peninsula (09°50´03\" North Latitude, 084°53´42\"\nWest Longitude) and from there to the Puntarenas Lighthouse (9° 58´36.03´´ North\nLatitude 84° 51 03.93´´ West Longitude), in order to supply sardine for bait\nto the national fishing fleet and whose surpluses may be commercialized for\nother purposes.\n\nThe vessel owners (armadores) or the captains of the\nvessels are required to request the landing inspection according to the\nestablished procedure.\n\nEvery fishing trip carried out by the semi-industrial\nfleet, upon landing, must be inspected by an\nofficial of the enforcement department (departamento de fiscalización) of INCOPESCA and the landing must be recorded\nin the respective inspection form.\n\nIn accordance with Board of Directors\nAgreement No. AJDIP/049-2020 of April 2, 2020, the incidental catch in\nsardine fishing may not exceed 10% of the vessel's total catch.\n\n4.—The Research Department of\nINCOPESCA shall carry out biological sampling to evaluate the reproductive\nbehavior of sardines and weakfish (corvinas), and any other research that\ncontributes to fishery biological analyses.\n\n5.—Persons with current research\npermits and sport fishing licenses (licencias de pesca turística), whose fishing activity zone\ncorresponds to the closed zone, may avail themselves of the economic aid\nprovided by IMAS during the closed season period.\n\n6.—Excluded from the closed season is the extraction\nof mollusks (moluscos) that takes place in the Gulf of Nicoya, for natural persons and\nlegal entities with current authorization from INCOPESCA.\n\n7.—The Head of the Enforcement Department (Departamento de Fiscalización) of INCOPESCA shall coordinate with public institutions: SENASA,\nMINAE, Ministry of Public Security and the National Coast Guard Service (Servicio Nacional de Guardacostas)\nto guarantee control and surveillance operations during the closed season\nperiods in the Gulf of Nicoya.\n\n8.—Vessels whose home port (puerto base) of\noperation is located within the closed area of the Gulf of Nicoya, but\nwhose fishing license (licencia de pesca) authorizes them to operate outside the closed area and, therefore,\nmust sail to move outside the area to carry out their fishing\nactivity; may carry it out and process fuel at the preferential\nprice. For which, they must fill out the form designed for those\npurposes which was forwarded in advance, before March 30 of each\nyear.\n\n9.—Publish once in the Official Gazette La Gaceta.\n\n10.—Firm\nagreement."
