El 21 de agosto de 2025, se realizó el\nacto formal en las instalaciones del Centro de Investigación en Ciencias del\nMar y Limnología de la Universidad de Costa Rica para\nla II entrega del Certificado de Sello Regulatorio de Calidad a 467 Asadas y la\nEmpresa de Servicios Públicos de Heredia S.A. (ESPH S.A.), correspondiente al\nperiodo 2025-2026.\n\nXV. Del informe IN-0016-IA-2026 del 26 de\nmarzo de 2026, que sirve de base para el dictado de la presente resolución\nconviene rescatar lo siguiente:\n\n\"(...)\n\nI. RESUMEN EJECUTIVO\n\nA partir de la\nexperiencia operativa de la entrada en vigor de las resoluciones de información\nbásica para los prestadores de los servicios públicos de acueducto y\nsaneamiento, se identificaron oportunidades de mejora relacionadas con la\nhomologación de los periodos de reporte, simplificación de los requerimientos\nde información y eliminación de duplicidades normativas. Con base en lo\nanterior, se recomienda la emisión de una nueva resolución que integre los\nlineamientos actualizados y la derogatoria de las resoluciones RE-0010-IA-2024\ny RE-0009-IA-2025.\n\nII. INTRODUCCIÓN\n\nEl presente informe se\nelabora como resultado de la aplicación de la resolución RE-0009-IA-2025 del 5\nde marzo de 2025, mediante la cual la Intendencia de Agua estableció los\nrequerimientos de información básica que deben cumplir las Asociaciones\nAdministradoras de los Sistemas de Acueducto y Alcantarillado Comunal (Asadas)\nen materia de regulación económica y de calidad del servicio de acueducto.\n\nA partir de los hallazgos\nderivados del informe IN-0065-IA-2025 del 21 de agosto de 2025 correspondiente\na los resultados del Sello Regulatorio de Calidad periodo 2025-2026, el\ndocumento propone incorporar oportunidades de mejora orientadas a la\nactualización, simplificación, estandarización y normalización de dichos\nrequerimientos, con el propósito de facilitar el cumplimiento normativo por\nparte de las Asadas y fortalecer su capacidad para obtener el Sello Regulatorio\nde Calidad otorgado por la Autoridad Reguladora de los Servicios Públicos\n(ARESEP).\n\nEn este marco, se\nidentificó la posibilidad de unificar ciertos requerimientos en ítems\nintegrados, así como desarrollar formularios y plantillas que optimicen aún más\nel proceso de recolección de información, simplificando tanto el envío por\nparte de los prestadores como la revisión y fiscalización por parte del ente\nregulador.\n\nAdicionalmente, el\ninforme introduce elementos estratégicos vinculados con la identificación de\nriesgos y la formulación de planes de continuidad del negocio y del servicio,\naspectos fundamentales para garantizar una gestión eficiente y sostenible de\nlos operadores comunales.\n\nLa relevancia de las Asadas\nen el desarrollo nacional, así como su contribución directa a la salud, la\neconomía y la calidad de vida de las comunidades, se enmarca en los compromisos\ninternacionales asumidos por Costa Rica, particularmente en el cumplimiento del\nObjetivo de Desarrollo Sostenible N.° 6 y las recomendaciones de la OCDE sobre\ngobernanza y sostenibilidad del recurso hídrico.\n\nEn consecuencia, la\nIntendencia de Agua orienta este informe hacia tres objetivos principales:\nestandarizar la información contable, financiera, de mercado, inversiones y\ncalidad, implementar herramientas de recolección más eficientes y consolidar\nuna base de datos robusta que sirva como insumo estratégico para la toma de\ndecisiones regulatorias y tarifarias; objetivos que se han venido cumpliendo en\neste segundo año de la implementación del Sello Regulatorio de Calidad.\n\nIII. ANTECEDENTES\n\n1. El 30 de agosto del\n2021, mediante la resolución RE-0015-IA-2021, la Intendencia de Agua estableció\nla \"Simplificación y estandarización de información de mercado para los\nservicios públicos regulados por la Intendencia de Agua\" (OT-203-2021)\n\n2. El 23 de enero del\n2023, mediante la resolución RE-0001-IA-2023 la Intendencia de Agua estableció\nla \"Simplificación y estandarización de la información geográfica para los\nservicios públicos regulados por la Intendencia de Agua\". (OT-203-2021).\n\n3. El 17 de abril del\n2023, mediante la resolución RE-0005-IA-2023 la Intendencia de Agua estableció\n\"Implementación de la contabilidad regulatoria y requerimientos de\ninformación contable para los servicios regulados por la Intendencia de Agua,\nprestado por las asociaciones administradoras de acueducto y alcantarillados\ncomunales (Asadas)\". (OT-203-2021).\n\n4. El 18 de julio de\n2023, mediante la resolución RE-0012-IA-2023, \"Conoce el Intendente de\nAgua del recurso de revocatoria interpuesto por la representación del Instituto\nCostarricense de Acueductos y Alcantarillados (AyA) contra la resolución\nRE-0005-IA-2023 del 17 de abril de 2023\". (OT-203-2021).\n\n5. El 28 de setiembre de\n2023, la Intendencia de Agua emitió el informe técnico IN-0056-IA-2023,\n\"Simplificación y normalización de los requerimientos de información\ntécnica que deben aportar los prestadores de servicios públicos del sector agua\nen materia de inversiones, según las etapas de la cadena de valor\".\n\n6. El 21 de febrero de\n2024, mediante el informe IN-0022-IA-2024, la Intendencia de Agua rindió el\ninforme respecto a los \"Requerimientos de información básica que deben\ncumplir las Asociaciones Administradoras de los Sistemas de Acueducto y\nAlcantarillado (Asadas) en materia de regulación económica (fiscalización,\nmercado y tarifas) y regulación de calidad del servicio de acueducto\".\n\n7. El 21 de febrero de\n2024, la Intendencia de Agua emitió la resolución RE-0010-IA-2024 \"Conoce\nel Intendente de Agua de los requerimientos de información básica que deben\ncumplir las Asociaciones Administradoras de los Sistemas de Acueducto y\nAlcantarillado (Asadas) en materia de regulación económica (fiscalización,\nmercado y tarifas) y regulación de calidad del servicio de acueducto\".\n(OT-008-2024)\n\n8. El 26 de febrero de\n2024, la Intendencia de Agua emitió la resolución RE-0011-IA-2024,\n\"Procede el Intendente de Agua con el dictado de los lineamientos\nnecesarios para la implementación del Sello Regulatorio de Calidad para los\nservicios públicos de acueducto y saneamiento en el país.\" (OT-277-2023)\n\n9. El 17 de octubre de\n2024, mediante el informe IN-0107-IA-2024, la Intendencia de Agua rindió el\ninforme respecto al cumplimiento de lo dispuesto por la RE-0010-IA-2024 por\nparte de aquellos prestadores de servicio público que se certificaron para el\nperiodo 2024-2025 con el Sello Regulatorio de Calidad.\n\n10. El 19 de febrero de\n2025, mediante el informe IN-0030-IA-2025, la Intendencia de Agua rindió su\ncriterio respecto a la \"Simplificación y normalización de los\nrequerimientos de información básica que deben cumplir las Asociaciones\nAdministradoras de los Sistemas de Acueducto y Alcantarillado (Asadas) en\nmateria de regulación económica (financiera, mercado e inversiones) y\nregulación de calidad del servicio de acueducto\"\n\n14. El 5 de marzo de\n2025, la Intendencia de Agua emitió la resolución RE-0009-IA-2025 \"Conoce\nel Intendente de Agua de la simplificación y normalización de los\nrequerimientos de información básica que deben cumplir las Asociaciones\nAdministradoras de los Sistemas de Acueducto y Alcantarillado (Asadas) en\nmateria de regulación económica (financiera, mercado e inversiones) y regulación\nde calidad del servicio de acueducto\". El 5 de marzo de\n2025, la Intendencia de Agua emitió la resolución RE-0010-IA-2025 \"Conoce\nel Intendente de Agua sobre la simplificación y normalización de los\nlineamientos necesarios para la implementación el Sello Regulatorio de Calidad\npara los servicios públicos de acueducto y saneamiento en el país\",\nestablecido mediante la resolución RE-011-IA-2024. (OT-013-2024)\n\n16. El 21 de agosto de\n2025, mediante el informe IN-0065-IA-2025, la Intendencia de Agua rindió el\ninforme respecto al cumplimiento de lo dispuesto por la RE-0010-IA-2025 por\nparte de aquellos prestadores del servicio público que se certificaron para el\nperiodo 2025-2026 con el Sello Regulatorio de Calidad.\n\n17. El 21 de agosto de\n2025, se realizó el acto formal en las instalaciones del Centro de\nInvestigación en Ciencias del Mar y Limnología de la\nUniversidad de Costa Rica para la II entrega del Certificado de Sello\nRegulatorio de Calidad a 467 Asadas y la Empresa de Servicios Públicos de\nHeredia S.A. (ESPH S.A.), correspondiente al periodo 2025-2026.\n\nIV. ALCANCE Y OBJETIVOS\n\n4.1. Alcance\n\nAnálisis de los\nrequerimientos de la RE-0009-IA-2025 \"Conoce el Intendente de Agua de la\nsimplificación y normalización de los requerimientos de información básica que\ndeben cumplir las asociaciones administradoras de los sistemas de acueducto y\nalcantarillado (Asadas) en materia de regulación económica (financiera, mercado\ne inversiones) y regulación de calidad del servicio de  acueducto\" del 5 de marzo de 2025 y su\naplicación en la segunda entrega del certificado correspondiente a la\nparticipación y cumplimiento por parte de las Asadas para el periodo 2025- 2026.\n\n4.2. Objetivo General\n\nModificar parcialmente la\nresolución RE-0009-IA-2025 \"Conoce el Intendente de Agua de la\nsimplificación y normalización de los requerimientos de información básica que\ndeben cumplir las asociaciones administradoras de los sistemas de acueducto y\nalcantarillado (Asadas) en materia de regulación económica (financiera, mercado\ne inversiones) y regulación de calidad del servicio de acueducto\" del 5 de\nmarzo de 2025, con el propósito de ajustarla a las mejoras detectadas en la\nrecopilación de la información para la obtención del Sello Regulatorio de Calidad\n2025-2026, según el informe IN-0065-IA-2025.\n\n4.3. Objetivos\nEspecíficos\n\na. Identificar y\nsistematizar los cambios necesarios identificados a partir de la entrega de la\nsegunda edición del Sello Regulatorio de Calidad, a partir del análisis de la\nexperiencia del año 2025.\n\nb. Actualizar el\ncontenido técnico y normativo del documento, incorporando ajustes derivados de\nnuevas disposiciones, lineamientos institucionales o requerimientos operativos\nevidenciados en los años anteriores.\n\nc. Incorporar observaciones\ny recomendaciones emitidas, tanto verbal como por otros medios, asegurando que\nlos ajustes respondan a mejoras identificados en los procesos de validación\ninterna.\n\nV. MARCO LEGAL\n\nLa Administración\nPública, tanto centralizada como descentralizada, debe sujetar su accionar al\nPrincipio de Legalidad, el cual sirve de base para fijar los rumbos sobre los\ncuales puede discurrir la actividad administrativa, debiendo encontrar siempre\nun sustento habilitante para el ejercicio de sus potestades públicas, todo de\nconformidad con lo establecido en el numeral 11 tanto de la Constitución\nPolítica costarricense como de la Ley General de la Administración\nPúblicaN°6227 (LGAP).\n\nLas competencias\nenunciadas, son reafirmadas en el artículo 6 de la Ley N°7593, que establece:\n\n\"(.) Artículo 6.-\nObligaciones de la Autoridad Reguladora. Corresponden a la Autoridad Reguladora\nlas siguientes obligaciones: .\n\na) Regular y fiscalizar\ncontable, financiera y técnicamente, a los prestadores de servicios públicos,\npara comprobar el correcto manejo de los factores que afectan el costo del\nservicio, ya sean las inversiones realizadas, el endeudamiento en que han\nincurrido, los niveles de ingresos percibidos, los costos y gastos efectuados o\nlos ingresos percibidos y la rentabilidad o utilidad obtenida.\n.\n\nd) Fijar las tarifas y\nlos precios de conformidad con los estudios técnicos. (.)\".\n\nTeniendo conocimiento de\nla normativa referida, cabe apuntar que, para el adecuado cumplimiento de sus\nfacultades regulatorias, conforme con la Ley N°7593, la Autoridad Reguladora\ncuenta con absoluta competencia para solicitar a los prestadores de los\nservicios públicos la información relativa a la prestación del servicio.\n\nAl respecto, indican los\nartículos 14, incisos a) y c), y 24 de la Ley N°7593:\n\n\"(...) Artículo\n14.-Obligaciones de los prestadores. Son obligaciones de los prestadores:\n\na) Cumplir con las\ndisposiciones que dicte la Autoridad Reguladora en materia de prestación del\nservicio, de acuerdo con lo establecido en las leyes y los reglamentos\nrespectivos.\n\n(...)\n\nc) Suministrar\noportunamente, a la Autoridad Reguladora, la información que les solicite,\nrelativa a la prestación del servicio (...)\".\n\n\"(...) Artículo 24.-\nSuministro de información: A solicitud de la Autoridad Reguladora, las\nentidades reguladas suministrarán informes, reportes, datos, copias de archivos\ny cualquier otro medio electrónico o escrito donde se almacene información\nfinanciera, contable, económica, estadística y técnica relacionada con la\nprestación del servicio público que brindan. Para el cumplimiento exclusivo de\nsus funciones, la Autoridad Reguladora tendrá la potestad de inspeccionar y\nregistrar los libros legales y contables, comprobantes, informes, equipos y las\ninstalaciones de los prestadores (...)\". Esto es así por cuanto, como se\nobserva de la normativa expuesta, la Ley N°7593 le confiere a la ARESEP de los\nservicios atribuciones, deberes y funciones para regular y fiscalizar contable,\nfinanciera y técnicamente a los prestadores que brindan servicios públicos; y a\nsu vez a estos se les establecen deberes y condiciones que deben cumplir, lo\ncual incluye, conforme con la Ley de cita, suministrar la información que les\nrequiere el órgano regulador relacionada con la prestación del servicio público.\n\nVI. ASPECTOS TÉCNICOS\n\nCon base en el análisis\nrealizado en el informe IN-0065-IA-2025 del año anterior, y como parte del\nproceso de estandarización y facilitación de la información regulatoria\nrecibida a través del cumplimiento de la información básica solicitada a las\nAsadas según las resoluciones vigentes, se considera necesario actualizar los\nrequerimientos de información a estos sistemas delegados, procurando la\nreducción de la asimetría de la información, la eficiencia y eficacia de los\ndatos presentados, la facilidad a la hora de recopilar lo estrictamente\nnecesario por parte del prestador del servicio, así como la revisión por parte\nde los funcionarios de la Intendencia.\n\nEn este sentido, se\npresenta a continuación, la información que debe remitir las Asadas, con una\nperiodicidad anual (una vez al año), tomando como base de cierre al 31 de\ndiciembre del año anterior, la cual deberá ser entregada al ente regulador\ndentro del plazo que va del 1 de enero hasta el 31 de mayo del año siguiente,\ntal y como se describe a continuación:\n\nREQUERIMIENTOS DE\nINFORMACIÓN 6.1. INFORMACIÓN FINANCIERA Y COSTOS\n\na. Balance de Situación\n(en formato Excel y pdf)\n\nb. Balance de\nComprobación antes de cierre contable al último nivel de cuenta (en formato\nExcel y pdf)\n\nc. Estado de Resultados.\n(ingresador y pdf)\n\nd. Estado de Flujo de\nEfectivo. (en formato Excel y pdf)\n\ne. Estado de cambios en\nel patrimonio. (en formato Excel y pdf)\n\nf. Notas a los estados\nfinancieros. (en formato pdf)\n\ng. Auxiliar de los\nActivos Fijos. Indicar el costo de estos activos, la vida útil, la depreciación\nacumulada y el valor en libros. En el caso que aplique, indicar cuáles de los\nactivos son derivados de donaciones o aportes. (ingresador)\n\nNota: los Estados\nfinancieros del último periodo fiscal (1 de enero al 31 de diciembre), para que\ncumplan con lo requerido deberán venir certificados o auditados por un contador\npúblico.\n\n6.2. MERCADO\n\na. Llenar y/o actualizar\nen el módulo de registro de prestadores regulados en el Sistema de Información\nRegulatoria (SIR), donde deberán completar una serie de datos referentes a la\ninformación básica del prestador y remitir constancia de haber realizado esta\nactividad. (formato declaración jurada). https://aresep.go.cr/sir/\n\nb. Con respecto a la\nfacturación, la Asada podrá suscribir una autorización a la ARESEP para que\nésta pueda acceder a la información que brindan las empresas del servicio de\nfacturación. (formulario autorización). En el caso de ya brindaron la\ninformación en el año anterior, deberá indicarlo en la declaración\njurada. (formato declaración jurada)\n\nc. En el caso de que la\nAsada no suscriba esta autorización sobre la facturación, el operador deberá remitir\nla información en los formatos, según lo establecido en la RE-0015-IA-2021. (ingresadores)\n\nd. Con respecto a la\nproducción de agua, la Asada deberá remitir el formulario descrito para este\nfin, según lo establecido en la RE-0015-IA-2021 (ingresador).\n\ne. Presentar el ingresador de hidrantes para Asadas, que incluya la\nlocalización, estado operativo, tipo y diámetro. Este requisito será mandatorio\na partir del cierre fiscal del año 2026 (31 de diciembre de 2026) para ser\npresentado en el año 2027. Sin embargo, se motiva a las Asadas\npara que trabajen en este ingresador y, en el caso de\nque ya lo tengan formulado, remitirlo al ente regulador (ingresador).\n\n6.3. INVERSIONES\n\nCon el fin de incorporar\ncomo estrategia del sector la planificación en materia de expansión,\nmantenimiento y mejora de los servicios; se espera que todos los operadores\ncuenten con un diagnóstico de sus sistemas de acueductos, saneamiento,\nhidrantes y protección del recurso hídrico, por lo tanto, es requerido indicar\nsi poseen lo siguiente:\n\na. Plan de inversiones\nelaborado con base en alguno de los siguientes criterios según el servicio:\n\ni. Acueducto o\nAlcantarillado: Estudio técnico del o los sistemas con que cuenta para brindar\nlos servicios, avalado por el Instituto Costarricense de Acueductos y\nAlcantarillados (AyA) como ente rector técnico para lo cual aportará este\nestudio con el detalle de las obras; o,\n\nii. Protección Recurso\nHídrico: Estudios hidrológicos y/o hidrogeológicos dependiendo del tipo de\nfuente, o\n\niii. Hidrantes: Plan de\ninstalación de la red de hidrantes y su mantenimiento avalado por el Benemérito\nCuerpo de Bomberos, en el caso de que aplique, o\n\niv. Plan de inversión en\notros activos (propiedad, planta y equipo)\n\nv. Además de presentar\nalguno de los estudios mencionados en los puntos anteriores, deberá presentar\ncomo mínimo el plan con los siguientes aspectos (ingresador):\n\n-\nNombre y descripción del\nproyecto\n\n-\nServicio\n\n-\nJustificación del\nproyecto\n\n-\nDetalle de las obras\n\n-\nUbicación: provincial,\ncantón, distrito\n\n-\nFuente de\nfinanciamiento: recursos propios (tarifas) o financiamiento\n\n-\nCosto y presupuesto anual\n\n-\nFecha estimada de inicio\ny finalización de obras\n\n-\nFactibilidad técnica y\nlegal (en el caso de que aplique)\n\n-\nControl de cambios\n(aprobado por el AyA y/o Cuerpo de Bomberos, en el caso de que aplique)\n\nLa información requerida\ndebe ser actualizada una vez al año.\n\n6.4. REGULACIÓN DE\nCALIDAD\n\na. Diagrama (mapa o croquis) de los sistemas que componen el acueducto (fuentes, tanques, tuberías,\nentre otros), en el que se incluya la ubicación geográfica de los principales componentes. El\ndocumento deberá presentarse en formato PDF, AutoCAD, Shape o Google Earth. En caso de no contar con\nalguno de estos formatos, podrá aportarse un diagrama simplificado, acompañado del compromiso de\nremitir el diagrama en los formatos requeridos en el plazo de dos años. De no existir modificaciones\ncon respecto al año anterior, deberá indicarlo en la declaración jurada provista para tal fin\n(formato declaración jurada).\n\nb. Indicar, mediante\ndeclaración jurada, el mecanismo o programa para la atención de quejas y\nsugerencias utilizado (quejas atendidas versus quejas pendientes de atender,\ncorrespondiente al último periodo fiscal (1 enero al 31 de diciembre)\n(declaración jurada).\n\nc. Los reportes de\ncalidad del agua potable y residual efectuados durante el periodo evaluado,\nsegún corresponda. La cantidad de muestras, la frecuencia de muestreo y los\npuntos de toma deberán establecerse de acuerdo con la población abastecida y\ndemás criterios técnicos definidos en la normativa aplicable. Estos informes\ndeberán ser entregados junto a los ingresadores\ndispuestos para este fin según la resolución RE-0018-IA-2021 o su versión\nvigente. (ingresadores).\n\nd. Indicar, mediante\ndeclaración jurada el tipo de tecnología utilizada para la desinfección del\nagua en el sistema de acueducto (RE-0018-IA-2021), así como la cantidad de\nequipos de desinfección instalados. (formato declaración jurada).\n\ne. Indicar el diámetro,\nlongitud y antigüedad por tipo de material de todas las tuberías instaladas en\nel sistema de abastecimiento (ingresador). De no\nexistir modificaciones con respecto al año anterior, deberá indicarlo en la\ndeclaración jurada provista para tal fin (formato declaración jurada).\n\nf. Indicar la cantidad de\nsolicitudes de nuevos servicios que ha recibido el acueducto, desglosadas por\nmes, las cuales deben ser reportadas de la siguiente manera (ingresador):\n\ni. Cantidad de servicios\naprobados.\n\nii. Cantidad de servicios\ndenegados, los cuales deberán ser clasificados si la denegación fue por\nausencia de capacidad hídrica, ausencia de capacidad hidráulica, o\nincumplimiento con alguna normativa o reglamento (Municipalidad, INVU, MINAE,\netc.).\n\n6.5. PLAN DE\nCONTINUIDAD DEL NEGOCIO Y/O SERVICIO\n\nEl apartado propuesto, derivado\ndel informe IN-0012-IA-2025, busca resaltar la importancia de que las Asadas\nidentifiquen, gestionen y den seguimiento a los riesgos dentro de sus\norganizaciones, con el fin de prepararse ante desastres naturales o eventos\nprovocados por el ser humano. Se requiere que las Asadas desarrollen un plan de\ncontinuidad del negocio y/o servicio, que incluya la identificación de procesos\ncríticos, pólizas de riesgos asociadas y medidas de protección tanto para\nactivos en operación como para proyectos constructivos, cuando aplique.\n\nLas Asadas podrán\nutilizar las metodologías que consideren adecuadas, pero deberán presentar la\núltima actualización y la documentación de respaldo correspondiente.\n\nEste requisito será mandatorio a partir\ndel cierre fiscal del año 2026 (31 de diciembre de 2026), sin embargo, se\nmotiva a las Asadas para que trabajen en plan y, en el caso de que ya lo tengan\nformulado, remitirlo al ente regulador para el año 2027.En el caso de aquellas\nAsadas que ya hayan presentado su plan de continuidad del negocio, indicarlo\nmediante la declaración jurada (formato de declaración jurada). Se recomienda\nque el plan de revise y actualice por lo menos cada dos años.\n\nVII. ENTREGA DE LA\nINFORMACIÓN\n\nEste tipo de información\ndeberá remitirse en los formularios correspondientes descritos a continuación y\ncon los cortes y fechas de entrega que se indican en el siguiente cuadro:\n\nCuadro N°1\n\nCronograma\npara la entrega de información\n\n \n\n| Información requerida | Fecha de corte | Fecha de entrega |\n| --- | --- | --- |\n| Financiera | 31 de diciembre | 31 de mayo |\n| Mercado1 | | |\n| Inversiones | | |\n| Calidad | | |\n| Plan de continuidad1 | | |\n\n \n\nNota: La información\ncorrespondiente a los siguientes requerimientos será considerado como parte de\nla entrega de la información del Sello Regulatorio con cierre al año 2026 (con\ncorte al 31 de diciembre): a. Plan de Continuidad del negocio /servicio, y b.\n\nIngresador de hidrantes Fuente: Intendencia de\nAgua.\n\n1. Los prestadores de\nservicio público deberán enviar la información solicitada por medio de los\ncanales oficialmente establecidos y puesto en conocimiento de las partes, a\nsaber, los correos electrónicos: (sellocalidad@aresep.go.cr o\nventanillaunica@aresep.go.cr), los módulos habilitados del Sistema de\nInformación Regulatoria (SIR) o el medio de almacenamiento en la nube que\nestablezca el ente regulador.\n\n2. Se debe recordar a los\nprestadores de servicio público, que de conformidad con lo establecido en la\nLey Nº 7593, el cumplimiento de la entrega de la información señalada en la\nresolución que se emita es requisito para la admisibilidad y análisis de\ncualquier solicitud tarifaria, ya sea de carácter ordinario o extraordinario,\npor lo que los prestadores de servicio público tienen la obligación de remitir\nesta información en los plazos establecidos.\n\nVIII. CONCLUSIONES\n\n1. La actualización y\nnormalización de los requerimientos de información técnica que deben aportar\nlos prestadores de los servicios públicos del sector agua facilitará el\ncompletar los formularios asociados de información regulatoria, y permitirá a\nla intendencia de agua crear una base de datos robusta en materia regulatoria\nde las Asadas, lo cual será de vital importancia para el análisis\ncorrespondiente en aspectos de fijaciones tarifarias.\n\n2. Las disposiciones\nprevistas en la nueva resolución que se emitirá a partir del presente informe\n(formularios y anexos), podrán ser actualizados cuando se considere necesario y\ndeberá ser comunicado a los prestadores de servicio público en forma oportuna\npor medio de canales oficiales.\n\nIX. RECOMENDACIONES\n\n1. Preparar y emitir la\nresolución correspondiente a la simplificación y normalización de los\nrequerimientos de información técnica que deben aportar las Asadas.\n\n2. Que, en virtud de lo\nanalizado en este informe, se considera oportuno y necesario en resguardo de la\nseguridad jurídica, y la unificación de criterios, dejar sin efecto a partir de\nla publicación lo establecido en las resoluciones RE-0010-IA-2024 y\nRE-0009-IA-2025, de manera que se implementen las oportunidades de mejora\nidentificadas, las estrategias implementadas y los resultados obtenidos a\npartir de la implementación del Sello Regulatorio de Calidad y las entregas del\ncertificado correspondiente a los periodos 2024-2025 y 2025-2026.\n\n3. Elaborar un\nprocedimiento interno para aplicación en la Intendencia de Agua, que describa\nlos pasos a seguir para la correspondiente revisión y análisis de los\nformularios de la información provistos por los prestadores de servicio\npúblico, según corresponda en cada fecha establecida.\n\nII. En virtud de lo establecido en el\nresultando y considerandos precedentes, como parte de los procesos de mejora\ncontinua regulatoria y dada la importancia y necesidad de una adecuada gestión\nen materia de información para aquellos servicios regulados por la Intendencia\nde Agua, resulta necesario dejar sin efecto las resoluciones RE-0010-IA-2024\ndel 21 de febrero de 2024 y RE-009-IA-2025 del 5 de marzo de 2025, de manera\nque se estandarice, homologue y simplifique lo dispuesto en ellas y se\nimplementen las oportunidades de mejora identificadas, las estrategias\nimplementadas y los resultados obtenidos a partir de la implementación del\nSello Regulatorio de Calidad y las entregas de los certificados\ncorrespondientes a los periodos 2024-2025 y 2025-2026; tal y como se dispone.\n\nPOR TANTO:\n\nCon fundamento en las\nfacultades conferidas en la Ley N°7593 y sus reformas, en la Ley General de la\nAdministración Pública N°6227, en el Decreto Ejecutivo N°29732-MP, que es el\nReglamento a la Ley N°7593, en el Reglamento Interno de Organización y\nFunciones de la Autoridad Reguladora de los Servicios Públicos y sus Órganos\nDesconcentrados (RIOF),\n\nEL INTENDENTE DE AGUA A.Í,\n\nRESUELVE:\n\nI. Dejar sin efecto las resoluciones\nRE-010-IA-2024 del 21 de febrero de 2024 y RE-009-IA-2025 del 5 de marzo de\n2025, sobre los requerimientos de información básica que deben cumplir las\nAsociaciones Administradoras de Sistemas de Acueductos y Alcantarillados\n(ASADAS) en materia de regulación económica (financiera, mercado y tarifas) y\nregulación de calidad del servicio de acueducto.\n\nII. Solicitar a todas las Asociaciones\nAdministradoras de Sistemas de Acueductos y Alcantarillados Comunales (ASADAS)\ndel país, remitir a la Intendencia de Agua de la Autoridad Reguladora de los\nServicios Públicos, con periodicidad anual (una vez al año), tomando\ncomo base de cierre al 31 de diciembre del año anterior, la siguiente\ninformación que deberá ser entregada en el plazo que va del 1 de enero hasta el\n31 de mayo del año siguiente:\n\n1. INFORMACIÓN FINANCIERA\nY COSTOS\n\na. Balance de Situación (en\nformato Excel y pdf)\n\nb. Balance de Comprobación\nantes de cierre contable al último nivel de cuenta (en formato Excel y pdf)\n\nc. Estado de Resultados. (ingresador y pdf)\n\nd. Estado de Flujo de\nEfectivo. (en formato Excel y pdf)\n\ne. Estado de cambios en el\npatrimonio. (en formato Excel y pdf)\n\nf. Notas a los estados\nfinancieros. (en formato pdf)\n\ng. Auxiliar de los Activos\nFijos. Indicar el costo de estos activos, la vida útil, la depreciación\nacumulada y el valor en libros. En el caso que aplique, indicar cuáles de los\nactivos son derivados de donaciones o aportes. REGULACIÓN DE CALIDAD\n\na. Diagrama (mapa o croquis) de los sistemas que componen el acueducto (fuentes, tanques, tuberías,\nentre otros), en el que se incluya la ubicación geográfica de los principales componentes. Los reportes de calidad\ndel agua potable y residual efectuados durante el periodo evaluado, según\ncorresponda. La cantidad de muestras, la frecuencia de muestreo y los puntos de\ntoma deberán establecerse de acuerdo con la población abastecida y demás\ncriterios técnicos definidos en la normativa aplicable. Estos informes deberán\nser entregados junto a los ingresadores dispuestos\npara este fin según la resolución RE-0018-IA-2021 o su versión vigente. (ingresadores).\n\nd. Indicar, mediante\ndeclaración jurada el tipo de tecnología utilizada para la desinfección del\nagua en el sistema de acueducto (RE-0018-IA-2021), así como la cantidad de\nequipos de desinfección instalados. (formato declaración jurada).\n\ne. Indicar el diámetro,\nlongitud y antigüedad por tipo de material de todas las tuberías instaladas en\nel sistema de abastecimiento (ingresador). Specific\nObjectives\n\na. Identify and\nsystematize the necessary changes identified from the delivery of the\nsecond edition of the Regulatory Quality Seal, based on the analysis of the\nexperience from the year 2025.\n\nb. Update the\ntechnical and regulatory content of the document, incorporating adjustments derived from\nnew provisions, institutional guidelines, or operational requirements\nevidenced in previous years.\n\nc. Incorporate observations\nand recommendations issued, both verbally and through other means, ensuring that\nthe adjustments respond to improvements identified in the internal\nvalidation processes.\n\nV. LEGAL FRAMEWORK\n\nThe Public\nAdministration, both centralized and decentralized, must subject its actions to\nthe Principle of Legality, which serves as the basis for setting the courses on\nwhich administrative activity can proceed, always needing to find\nan enabling basis for the exercise of its public powers, all in\naccordance with the provisions of article 11 of both the Costa Rican\nPolitical Constitution and the General Law of Public\nAdministration No. 6227 (LGAP).\n\nThe stated powers\nare reaffirmed in Article 6 of Law No. 7593, which establishes:\n\n\"(.) Article 6.-\nObligations of the Regulatory Authority. The Regulatory Authority\nhas the following obligations: .\n\na) Regulate and oversee, in accounting, financial,\nand technical terms, the public service providers,\nto verify the correct management of the factors that affect the cost of the\nservice, whether the investments made, the indebtedness incurred,\nthe levels of income received, the costs and expenses incurred, or\nthe income received and the profitability or utility obtained.\n.\n\nd) Set the rates and\nprices in accordance with the technical studies. (.).\"\n\nHaving knowledge of\nthe referred regulations, it should be noted that, for the proper fulfillment of\nits regulatory powers, in accordance with Law No. 7593, the Regulatory Authority\nhas absolute competence to request from the public\nservice providers the information related to the provision of the service.\n\nIn this regard, Articles\n14, subsections a) and c), and 24 of Law No. 7593 state:\n\n\"(...) Article 14.-\nObligations of the providers. The following are obligations of the providers:\n\na) Comply with the\nprovisions issued by the Regulatory Authority regarding the provision of the\nservice, in accordance with the provisions of the respective laws\nand regulations.\n\n(...)\n\nc) Timely provide\nthe Regulatory Authority with the information it requests,\nrelated to the provision of the service (...).\"\n\n\"(...) Article 24.-\nProvision of information: At the request of the Regulatory Authority,\nthe regulated entities shall provide reports, returns, data, file copies,\nand any other electronic or written medium where financial,\naccounting, economic, statistical, and technical information related to the\nprovision of the public service they provide is stored. For the exclusive fulfillment\nof its functions, the Regulatory Authority shall have the power to inspect and\nrecord the legal and accounting books, vouchers, reports, equipment, and\nthe facilities of the providers (...).\" This is so because, as\nobserved in the stated regulations, Law No. 7593 confers upon the ARESEP\nattributions, duties, and functions to regulate and oversee, in accounting, financial,\nand technical terms, the providers that offer public services; and\nin turn, these are established duties and conditions they must fulfill,\nwhich includes, in accordance with the cited Law, providing the information that the\nregulatory body requires related to the provision of the public service.\n\nVI. TECHNICAL ASPECTS\n\nBased on the analysis\ncarried out in report IN-0065-IA-2025 from the previous year, and as part of the\nprocess of standardization and facilitation of the regulatory information\nreceived through compliance with the basic information requested from\nAsadas according to the resolutions in force, it is considered necessary to update\nthe information requirements for these delegated systems, seeking the\nreduction of information asymmetry, the efficiency and effectiveness of\nthe data presented, the ease of compiling what is strictly\nnecessary by the service provider, as well as the review by\nIntendency officials.\n\nIn this regard,\nthe information that Asadas must submit is presented below, with an\nannual periodicity (once a year), using December\n31 of the previous year as the closing date, which must be delivered to the regulatory body\nwithin the period from January 1 to May 31 of the following year,\nas described below:\n\nINFORMATION REQUIREMENTS 6.1. Submit the ingresador for hydrants for Asadas, which includes the\nlocation, operational status, type, and diameter. This requirement will be mandatory\nas of the fiscal year closing of 2026 (December 31, 2026) to be\nsubmitted in 2027. However, Asadas\nare encouraged to work on this ingresador and, if\nthey have already formulated it, to submit it to the regulatory body (ingresador).\n\n6.3. INVESTMENTS\n\nIn order to incorporate\nplanning regarding expansion,\nmaintenance, and improvement of services as a sector strategy; it is expected that all operators\nhave a diagnosis of their aqueduct, sanitation,\nhydrant, and water resource protection systems, therefore, it is required to indicate\nif they possess the following:\n\na. Investment plan\nprepared based on any of the following criteria according to the service:\n\ni. Aqueduct or\nSewer: Technical study of the system or systems it has to provide\nthe services, endorsed by the Instituto Costarricense de Acueductos y\nAlcantarillados (AyA) as the technical governing body, for which it will provide this\nstudy with the detail of the works; or,\n\nii. Water Resource\nProtection: Hydrological and/or hydrogeological studies depending on the type of\nsource, or\n\niii. Hydrants:\nInstallation plan for the hydrant network and its maintenance endorsed by the Benemérito\nCuerpo de Bomberos, where applicable, or\n\niv. Investment plan in\nother assets (property, plant, and equipment)\n\nv. In addition to presenting\nany of the studies mentioned in the previous points, it must present\nat a minimum the plan with the following aspects (ingresador):\n\n-\nName and description of the\nproject\n\n-\nService\n\n-\nProject justification\n\n-\nDetail of the works\n\n-\nLocation: province,\ncanton, district\n\n-\nFunding source:\nown resources (rates) or financing\n\n-\nCost and annual budget\n\n-\nEstimated start date\nand completion date of works\n\n-\nTechnical and legal\nfeasibility (where applicable)\n\n-\nChange control\n(approved by the AyA and/or Cuerpo de Bomberos, where applicable)\n\nThe required information\nmust be updated once a year.\n\n6.4. QUALITY REGULATION\n\na. Diagram (map or sketch) of the systems that make up the aqueduct (sources, tanks, pipes,\namong others), which includes the geographic location of the main components. The\ndocument must be submitted in PDF, AutoCAD, Shape, or Google Earth format. If it does not have\nany of these formats, a simplified diagram may be provided, accompanied by the commitment to\nsubmit the diagram in the required formats within a period of two years. If there are no modifications\ncompared to the previous year, it must be indicated in the sworn statement provided for this purpose\n(sworn statement format).\n\nb. Indicate, through\na sworn statement, the mechanism or program used for handling complaints and\nsuggestions (complaints handled versus complaints pending handling,\ncorresponding to the last fiscal period (January 1 to December 31)\n(sworn statement).\n\nc. The quality\nreports for drinking and residual water carried out during the evaluated period,\nas applicable. The number of samples, the sampling frequency, and the\ncollection points must be established according to the population supplied and\nother technical criteria defined in the applicable regulations. These reports\nmust be delivered together with the ingresadores\nprovided for this purpose according to resolution RE-0018-IA-2021 or its\ncurrent version. (ingresadores).\n\nd. Indicate, through\na sworn statement, the type of technology used for water\ndisinfection in the aqueduct system (RE-0018-IA-2021), as well as the number of\ndisinfection equipment installed. (sworn statement format).\n\ne. Indicate the diameter,\nlength, and age by type of material of all pipes installed in\nthe supply system (ingresador). If there are no\nmodifications compared to the previous year, it must be indicated in the\nsworn statement provided for this purpose (sworn statement format).\n\nf. Indicate the number of\nrequests for new services that the aqueduct has received, broken down\nby month, which must be reported as follows (ingresador):\n\ni. Number of approved\nservices.\n\nii. Number of denied\nservices, which must be classified if the denial was due to\nlack of water capacity, lack of hydraulic capacity, or\nnon-compliance with any regulation or rule (Municipalidad, INVU, MINAE,\netc.).\n\n6.5. BUSINESS AND/OR SERVICE CONTINUITY\nPLAN\n\nThe proposed section, derived\nfrom report IN-0012-IA-2025, seeks to highlight the importance of Asadas\nidentifying, managing, and following up on risks within their\norganizations, in order to prepare for natural disasters or events\ncaused by humans. Asadas are required to develop a business\nand/or service continuity plan, which includes the identification of critical\nprocesses, associated risk policies, and protection measures for both\noperating assets and construction projects, when applicable.\n\nAsadas may\nuse the methodologies they deem appropriate, but must present the\nlatest update and the corresponding supporting documentation.\n\nThis requirement will be mandatory as of\nthe fiscal year closing of 2026 (December 31, 2026), however,\nAsadas are encouraged to work on the plan and, if\nthey have already formulated it, to submit it to the regulatory body for the year 2027. In the case of those\nAsadas that have already submitted their business continuity plan, indicate it\nthrough the sworn statement (sworn statement format). It is recommended\nthat the plan be reviewed and updated at least every two years.\n\nVII. Public service providers must be reminded that, in accordance with the provisions of Law No. 7593, compliance with the submission of the information specified in the resolution issued is a requirement for the admissibility and analysis of any tariff request, whether ordinary or extraordinary in nature. Therefore, public service providers are obligated to submit this information within the established deadlines.\n\nVIII. CONCLUSIONS\n\n1. The updating and standardization of the technical information requirements that public service providers in the water sector must submit will facilitate the completion of associated regulatory information forms and will allow the Water Superintendency to create a robust regulatory database for the ASADAS, which will be of vital importance for the corresponding analysis in matters of tariff setting.\n\n2. The provisions set forth in the new resolution to be issued based on this report (forms and annexes) may be updated when deemed necessary and must be communicated to public service providers in a timely manner through official channels.\n\nIX. RECOMMENDATIONS\n\n1. Prepare and issue the corresponding resolution for the simplification and standardization of the technical information requirements that the ASADAS must submit.\n\n2. That, by virtue of what has been analyzed in this report, it is considered appropriate and necessary, in safeguarding legal certainty and the unification of criteria, to render without effect, as of its publication, the provisions established in resolutions RE-0010-IA-2024 and RE-0009-IA-2025, so that the identified opportunities for improvement, the implemented strategies, and the results obtained from the implementation of the Regulatory Quality Seal and the delivery of the corresponding certificate for the periods 2024-2025 and 2025-2026 are implemented.\n\n3. Develop an internal procedure for application within the Water Superintendency, describing the steps to follow for the corresponding review and analysis of the information forms provided by public service providers, as applicable, on each established date.\n\nII. By virtue of the provisions set forth in the preceding resultando and considerandos, as part of the continuous regulatory improvement processes, and given the importance and necessity of adequate information management for those services regulated by the Water Superintendency, it becomes necessary to render without effect resolutions RE-0010-IA-2024 of February 21, 2024, and RE-009-IA-2025 of March 5, 2025, so that what is established in them is standardized, homologated, and simplified, and the identified opportunities for improvement, the implemented strategies, and the results obtained from the implementation of the Regulatory Quality Seal and the delivery of the certificates corresponding to the periods 2024-2025 and 2025-2026 are implemented; as hereby ordered.\n\nPOR TANTO:\n\nBased on the powers conferred in Law No. 7593 and its amendments, in the General Public Administration Law No. 6227, in Decreto Ejecutivo No. 29732-MP, which is the Regulation to Law No. 7593, in the Internal Regulation of Organization and Functions of the Public Services Regulatory Authority and its Deconcentrated Bodies (RIOF),\n\nTHE ACTING WATER SUPERINTENDENT,\n\nRESUELVE:\n\nI. INVESTMENTS\n\nIn order to incorporate planning for the expansion, maintenance, and improvement of services as a sector strategy, all operators are expected to have a diagnosis of their aqueduct, sanitation, hydrant, and water resource protection systems. Therefore, it is required to indicate whether they possess the following:\n\na. Investment plan prepared based on one of the following criteria according to the service:\n\ni. Aqueduct or Sewer: Technical study of the system or systems available to provide the services, endorsed by the Costa Rican Institute of Aqueducts and Sewers (AyA) as the lead technical body, for which this study will be provided with the detail of the works; or,\n\nii. Water Resource Protection: Hydrological and/or hydrogeological studies depending on the type of source, or\n\niii. Hydrants: Installation plan for the hydrant network and its maintenance endorsed by the Benemérito Fire Department, where applicable, or\n\niv. Investment plan in other assets (property, plant, and equipment)\n\nv. In addition to presenting one of the studies mentioned in the previous points, the plan must be submitted with at least the following aspects (data entry form):\n\n-\nProject name and description\n\n-\nService\n\n-\nProject justification\n\n-\nDetail of works\n\n-\nLocation: province, canton, district\n\n-\nFunding source: own resources (tariffs) or financing\n\n-\nCost and annual budget\n\n-\nEstimated start and end date of works\n\n-\nTechnical and legal feasibility (where applicable)\n\n-\nChange control (approved by AyA and/or Fire Department, where applicable)\n\nThe required information must be updated once a year.\n\n4.
