ya que puede interrumpirse el proceso de desove de las tortugas\ny así mismo durante la época de nacimiento de las crías estas pueden desorientarse\ndurante su regreso al mar.\n\n    6°—Es necesario\nregular la afluencia masiva de turistas a este Refugio durante el periodo de desove de las\ntortugas baula, verde, carey, caguama, con el fin de proteger dicho proceso y conservar el\nrecurso para futuras generaciones.\n\n    7° -Que una de las\nprincipales causas de mortalidad de tortugas adultas, se debe a su entrampamiento en redes\ncolocadas en el paso hacia las playas de anidación o sitios de alimentación. Por\ntanto,\n\nDecretan:\n\n    Artículo l° —Para efecto de\ncontrolar la afluencia masiva de personas a la zona de Playa Gandoca dentro del Refugio\nNacional de Vida Silvestre Gandoca-Manzaníllo, se declara de acceso restringido a dicha\nárea durante la época de desove de la tortuga baula, verde, carey, caguama que comprende\nun período que va desde el primero de marzo hasta el 31 de octubre de cada año.\n\n   Artículo 2°—Se declara como área destinada a la observación del desove\nde tortuga las que estén debidamente señaladas y marcadas para ese efecto.\n\n   Artículo 3°—Se autorizará observar el desove de las tortugas a cualquier\npersona o grupo de personas que se hagan acompañar por un guía que porte el carné\nextendido por el Ministerio de Recursos Naturales Energía y Minas, o por el I. C. T.,\ndicho grupo no puede exceder la cantidad de diez personas.\n\n   Artículo 4°—No se permite el uso de linternas dentro del área de desove\nsalvo la que utilizará el guía respectivo. La Dirección General de Vida Silvestre, a\ntravés de la Administración del Refugio Nacional de Vida Silvestre Gandoca Manzanillo\npodrá autorizar cuando lo considere conveniente el uso de cámaras fotográficas mediante\nun permiso por escrito; por lo que queda terminantemente prohibido el uso de dichas\ncámaras cuando no se cuente con el permiso respectivo.\n\n   Artículo 5°—Las personas que funjan como guías deberán comprometerse a\nrespetar todas las reglas que se dicten para proteger a la tortuga en el proceso de\ndesove.\n\n   Artículo 6°—Todo guía que participe en las giras para observar tortugas\nen la playa, deberá contar con un carné extendido por el Ministerio de Recursos\nNaturales,Energía y Minas, previo visto bueno del Administrador del Refugio Nacional de\nVida Silvestre Gandoca-Manzanillo, o carné extendido por el Instituto Costarricense de\nTurismo.\n\n   Artículo 7°—La cantidad máxima de personas que se permitirá estar\nsimultáneamente en la playa, para observar el desove de las tortugas, será de cincuenta.\n\n   Artículo 8°—Para el ingreso a la playa se contará con un punto\ndebidamente identificado, el cual estará situado en el camino que une a la comunidad de\nGandoca con la playa.\n\n   Artículo 9°—No se permitirá la presencia de personas o grupos de personas\nsin guía, en la playa durante la noche, entre las dieciocho horas y las cinco de la\nmañana, del día primero del mes de marzo hasta el treinta y uno de octubre de cada año.\n\n   Artículo 10.—El grupo de turistas dará por finalizado el recorrido una vez\nque haya observado el desove de una tortuga, y que el guía los acompañe al sitio de\nsalida.\n\n   Artículo 11 .—No se permite acampar ni hacer fogatas en la playa. La\nvegetación es muy frágil y de momento se encuentra en restauración.\n\nArtículo 12.—NOTA\nDE SINALEVI: En la publicación de\neste decreto, no aparece este artículo. No obstante el sistema exige una numeración\nconsecutiva, por lo que se ha creado el mismo, pero sin texto.\n\n   Artículo 13.—No\nse permitirá ningún tipo de actividad recreativa en la zona de las dunas de la playa.\n\n    Artículo 14.—Los\nfuncionarios del Ministerio de Recursos Naturales, Energía Minas, están facultados para\ndesalojar a cualquier visitante que viole o no acate las disposiciones contenidas en este\nDecreto.\n\n   Artículo 15.---Se prohibe la venta y consumo de bebidas alcohólicas en la playa\no lugares aledaños.\n\n   Artículo\n16.—Deróguese el artículo 6, del Decreto Ejecutivo N° 16614-MAG, de 1° de julio\nde 1985, publicado en \"La Gaceta N° 206 de 29 de octubre de 1985.\n\n   Artículo 17.—Rige a partir de su publicación.\n\n    Dado en la Presidencia\nde la República.—San José, a las ocho horas del día 21 de marzo de mil novecientos\nnoventa y cuatro.", "body_en_text": "in the entirety of the text\n\n -\n\n Full Text of Regulation 23069\n\n Declares Restricted Access to the Gandoca-Manzanillo National Wildlife Refuge during the nesting season of the leatherback, green, hawksbill, and loggerhead turtles\n\nFull Text of record: 96958\n\nNo. 23069\n\n(This Decree was repealed by\nArticle 8 of Executive Decree No. 29019 of September 19, 2000).\n\n \n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF NATURAL RESOURCES, ENERGY,\nAND MINES,\n\n \n\n In exercise of the\npowers conferred upon them by Article 140, subsections 3 and 18 of the Political Constitution\nand in accordance with Article 12 of Law No. 7317 of December 7, 1992.\n\n \n\nWhereas:\n\n 1.—That by\nDecree No. 16614-MAG, the Gandoca-Manzanillo National Wildlife Refuge (Refugio Nacional de Vida Silvestre Gandoca-Manzanillo) was created, one of the purposes of which is the protection of the area's renewable resources.\n\n 2.—That the management and\nadministration of this protected area corresponds to the Wildlife Directorate (Dirección de Vida Silvestre) of the\nMinistry of Natural Resources, Energy, and Mines.\n\n 3.—That the nesting colony\nof sea turtles—leatherback (Dermochelys coriacea), green turtle (Chelonia\nmydas), hawksbill turtle (Eretmochelys imbricata), and loggerhead turtle (Caretta caretta)—that\nnest on Gandoca Beach, is considered one of the most important in the Southern Caribbean.\n\n 4.—That the number\nof tourists visiting the area during the nesting season of the leatherback, green, hawksbill, and loggerhead turtles, which occurs in the period between the months of March and\nOctober, is of considerable magnitude.\n\n 5.—That scientific\nevidence exists indicating that human presence associated with the improper use\nof lights (flashlights and cameras with flash), as well as incorrect behavior during\nthe observation of nesting, can significantly alter the habitual\nbehavior of the turtles; as the nesting process of the turtles can be interrupted,\nand likewise, during the hatching season, the hatchlings can become disoriented\nduring their return to the sea.\n\n 6.—It is necessary\nto regulate the massive influx of tourists to this Refuge during the nesting period of the\nleatherback, green, hawksbill, and loggerhead turtles, in order to protect said process and conserve the\nresource for future generations.\n\n 7.—That one of the main\ncauses of mortality of adult turtles is due to their entrapment in nets\nplaced in the passage to nesting beaches or feeding sites. Therefore,\n\nThey Decree:\n\n Article 1.—For the purpose of\ncontrolling the massive influx of people to the Gandoca Beach area within the\nGandoca-Manzanillo National Wildlife Refuge, said\narea is declared of restricted access during the nesting season of the leatherback, green, hawksbill, and loggerhead turtle, which comprises\na period from March 1st to October 31st of each year.\n\n Article 2.—The areas duly designated and marked for that purpose are declared as the area intended for the observation of turtle\nnesting.\n\n Article 3.—Any person\nor group of persons accompanied by a guide carrying a permit (carné) issued\nby the Ministry of Natural Resources, Energy, and Mines, or by the I.C.T., shall be authorized to observe the nesting of the turtles;\nsaid group may not exceed the number of ten persons.\n\n Article 4.—The use of flashlights is not permitted within the nesting area\nexcept for the one to be used by the respective guide. The General Directorate of Wildlife (Dirección General de Vida Silvestre), through\nthe Administration of the Gandoca-Manzanillo National Wildlife Refuge,\nmay authorize, when it deems it appropriate, the use of photographic cameras by means of\na written permit; therefore, the use of said\ncameras is strictly prohibited when the respective permit is not held.\n\n Article 5.—Persons acting as guides must commit to\nrespecting all the rules dictated to protect the turtle during the nesting\nprocess.\n\n Article 6.—Every guide who participates in the tours to observe turtles\non the beach must carry a permit (carné) issued by the Ministry of Natural\nResources, Energy, and Mines, with the prior approval of the Administrator of the Gandoca-Manzanillo National\nWildlife Refuge, or a permit (carné) issued by the Costa Rican Tourism\nInstitute (Instituto Costarricense de Turismo).\n\n Article 7.—The maximum number of persons permitted to be\nsimultaneously on the beach to observe the nesting of the turtles shall be fifty.\n\n Article 8.—For entry to the beach, there shall be a duly\nidentified point, which shall be located on the path connecting the community of\nGandoca to the beach.\n\n Article 9.—The presence of persons or groups of persons\nwithout a guide shall not be permitted on the beach during the night, between eighteen hundred hours and five in the\nmorning, from the first day of March to the thirty-first of October of each year.\n\n Article 10.—The tourist group shall consider the tour concluded once\nit has observed the nesting of a turtle and the guide has accompanied them to the exit\npoint.\n\n Article 11.—Camping or lighting campfires on the beach is not permitted. The\nvegetation is very fragile and is currently undergoing restoration.\n\nArticle 12.—SINALEVI NOTE: In the publication of\nthis decree, this article does not appear. However, the system requires consecutive\nnumbering, therefore it has been created, but without text.\n\n Article 13.—No\ntype of recreational activity shall be permitted in the beach dune area.\n\n Article 14.—Officials\nof the Ministry of Natural Resources, Energy, and Mines are empowered to\nevacuate any visitor who violates or fails to comply with the provisions contained in this\nDecree.\n\n Article 15.—The sale and consumption of alcoholic beverages on the beach\nor nearby locations is prohibited.\n\n Article\n16.—Article 6 of Executive Decree No. 16614-MAG, of July 1,\n1985, published in La Gaceta No. 206 of October 29, 1985, is hereby repealed.\n\n Article 17.—It shall become effective upon its publication.\n\n Issued at the Presidency\nof the Republic.—San José, at eight o'clock on the twenty-first day of March, nineteen hundred\nand ninety-four." }
