Sigue sobre la coordenada 583,000 E con rumbo Sur hasta encontrar el Río Sierpe, por el cual continúa el límite, aguas abajo hasta el punto donde desagua el Río Sierpe Viejo. Continúa luego el límite aguas arriba del Río Sierpe Viejo hasta encontrar la coordenada 598,000 E por la que continúa con rumbo Sur hasta el Caño California. Sigue entonces el límite aguas abajo del Caño California hasta su confluencia con el estero Parismina primero y Caño Negro después. Continúa el límite por el Caño Negro hacia el Norte, hasta un punto distante 300 metros de la margen Norte de la Laguna Jalova. Finalmente sigue el límite del Parque por una línea paralela a la margen Norte de la Laguna Jalova, distante siempre 300 metros hasta encontrar el mar. Todas estas porciones de terreno limitan a su\nvez por el Oeste, con los Canales de Tortuguero y por el Este, con el mar\nCaribe, quedando incluida dentro del Parque la porción del mar que corresponde\na las aguas territoriales de Costa Rica\".)\n\n(2.\nMediante el artículo 1° del decreto ejecutivo N° 27223 del 22 de julio de\n1998, se amplía el Parque Nacional Tortuguero, para que incluya el área que se\nencuentra \"partiendo de un punto, límite del Parque Nacional Tortuguero,\nubicado en el río Penitencia (sin nombre en la hoja cartográfica) cuyas\ncoordenadas son 284950N y 580090E, luego con rumbo sureste (dejando el límite\ndel Parque Nacional Tortuguero), en línea recta se dirige al punto de\ncoordenadas 286050N y 584340E. Sigue luego en líneas rectas con las siguientes\ncoordenadas:  \n\n| 285440N | 584250E |\n| --- | --- |\n| 285190N | 584575E |\n| 285275N | 584660E |\n\n Por\núltimo, ubicado en la margen del Caño Penitencia. Se dirige luego en\nlíneas rectas a los puntos de las siguientes coordenadas:  \n\n| 282420N | 581100E |\n| --- | --- |\n| 282250N | 580040E |\n| 282575N | 580290E |\n| 282750N | 579930E |\n| 282500N | 579210E |\n| 284000N | 579700E |\n\n Punto\nubicado en el Caño Perro Capón (que no aparece en la hoja cartográfica),\nsigue aguas abajo por este caño hasta la desembocadura del Caño Perro Capón\nen el río Penitencia en el punto que dio origen a la presente descripción en\nlas coordenadas 284950N y 580090E\").\n\n \n\n \n\n \n\n Ficha articulo\n\n     Artículo 2º.- Se declaran inalienables todos los terrenos de reserva\n\nnacional, que se encuentran dentro de los linderos de este parque.\n\n Ficha articulo\n\n     Artículo 3º.- Corresponde al Servicio de Parques Nacionales del\n\nMinisterio de Agricultura y Ganadería la delimitación en el terreno de\n\neste parque nacional, así como la administración, protección y desarrollo\n\ndel mismo.  El Servicio de Parques Nacionales no podrá traspasarlo a\n\nninguna otra institución.  Para impulsar su desarrollo y para velar\n\nporque los fines del mismo se cumplan, se crea la Junta Asesora del\n\nParque Nacional Tortuguero, bajo la coordinación de JAPDEVA, integrada\n\npor un representante de cada uno de los siguientes organismos: JAPDEVA,\n\nInstituto Costarricense de Turismo, Servicio de Parques Nacionales.\n\n Ficha articulo\n\n     Artículo 4º.- La Dirección General Forestal, una vez aprobada esta\n\nley, realizará un censo y estudio de los terrenos sometidos a ocupación.\n\n Ficha articulo\n\n     Artículo 5º.- Las explotaciones agropecuarias en manos de\n\nparticulares, inscritas o no en el Registro Público de la Propiedad,\n\nsituadas dentro del parque, existentes a la fecha de vigencia de esta\n\nley, quedan automáticamente sometidas al Régimen Forestal.  Las labores\n\nque se realicen en ellas deben ser las corrientes para este tipo de\n\nproducción y siempre que no impliquen la tala de algún árbol.\n\n Ficha articulo\n\n     Artículo 6º.- El Servicio de Parques Nacionales gestionará la compra\n\ndirecta o por expropiación de las fincas, inscritas o no inscritas en el\n\nRegistro Público, comprendidas dentro del parque y que se consideren\n\nindispensables para la conservación y desarrollo de éste.  Tanto en el\n\ncaso de fincas inscritas como en el de las fincas sin inscribir, siempre\n\ny cuando los requisitos se ajusten a la prescripción positiva que\n\nestablece la ley o leyes respectivas, se pagará de conformidad con el\n\nvalor del derecho de propiedad o de posesión, según avalúo de peritos de\n\nla Dirección General de Tributación Directa.  El simple derecho de\n\nposesión, sin la existencia de mejoras, no dará derecho al pago.  La\n\nexpropiación se realizará de conformidad con los artículos 157 y\n\nsiguientes del Código Municipal.\n\n Ficha articulo\n\n     Artículo 7º.- El Ministerio de Agricultura y Ganadería incluirá, a\n\npartir del 1976, en su presupuesto ordinario, las sumas necesarias para\n\nadquirir los terrenos de dominio particular comprendidos dentro del\n\nparque, así como las partidas para la protección, desarrollo e\n\ninvestigación en el mismo.  Asimismo se obliga al Ministerio de\n\nAgricultura y Ganadería a incluir, a partir de 1976, las siguientes\n\nplazas, para asegurar la protección de este parque: un administrador de\n\nparque nacional, un asistente de administrador de parque nacional y diez\n\nguardas.  Además la suma necesaria para la construcción de puestos y\n\ncompra de medios de transporte para labores de vigilancia.\n\n Ficha articulo\n\n     Artículo 8º.- Dentro del área que constituye este parque nacional\n\nqueda prohibido:\n\n  a) Talar árboles o extraer productos forestales de cualquier clase,\n\nexcepto la explotación comercial y tecnificada de los cocales, la cual\n\nqueda a criterio del Servicio de Parques Nacionales;\n\n  b) Cazar o capturar animales silvestres, o recolectar cualquiera de sus\n\nproductos o despojos, con la excepción que se establece en el artículo 9º\n\nde esta ley;\n\n  c) Pescar o cazar tortugas marinas de cualquier especie o recolectar o\n\nrecoger sus huevos o despojos.  Esta prohibición se extiende desde la\n\ndesembocadura del Río Matina a la desembocadura del Río Colorado y hasta\n\nel límite de las aguas territoriales de Costa Rica dentro del Mar Caribe;\n\ny\n\n  d) Recolectar o extraer objetos de valor histórico o arqueológico.\n\n Ficha articulo\n\n     Artículo 9º.- La pesca de consumo doméstico o deportivo, dentro de\n\nlos límites del parque nacional, quedará sujeta a las condiciones que\n\nestablezca el Servicio de Parques Nacionales, previa consulta a CONICIT.\n\n Ficha articulo\n\n     Artículo 10.- La Junta de Administración Portuaria y Desarrollo\n\nEconómico de la Vertiente Atlántica mantendrá la administración de la vía\n\nacuática dentro de los linderos de este parque y establecerá las\n\nedificaciones necesarias para el servicio de cabotaje, procurando causar\n\nel menor daño al aspecto escénico natural y no provocar la contaminación.\n\n Ficha articulo\n\n     Artículo 11.- El servicio de cabotaje será reglamentado por la Junta\n\nde Administración Portuaria y Desarrollo Económico de la Vertiente\n\nAtlántica.\n\n Ficha articulo\n\n     Artículo 12.- Para sufragar los gastos que demande la conservación y\n\ndesarrollo del parque, se establece un porcentaje del 20% del derecho de\n\npeaje a través de la vía acuática del canal, el cual debe entregarse al\n\nfondo de Parques Nacionales mensualmente. From this point, the boundary continues along a line parallel to the Tortuguero River, equidistant from it by one hundred meters, following its course upstream, until reaching the confluence with the Agua Fría River. From this point, the boundary continues upstream on the Agua Fría River to a point located at coordinates 266,550 N and 583,000 E. It continues along coordinate 583,000 E heading South until encountering the Sierpe River, along which the boundary continues downstream to the point where the Sierpe Viejo River empties. The boundary then continues upstream along the Sierpe Viejo River until reaching coordinate 598,000 E, along which it continues heading South to the Caño California.\n\nThe boundary then continues downstream along the Caño California to its confluence first with the Parismina estuary and then with the Caño Negro.\n\nThe boundary continues along the Caño Negro northward to a point 300 meters from the northern shore of the Laguna Jalova. Finally, the Park boundary follows a line parallel to the northern shore of the Laguna Jalova, always 300 meters distant, until reaching the sea.\n\nOn the Northeast side, from the last point (located 300 meters North of the Laguna Jalova) to the initial point (coordinate 280,000 N, immediately South of the town of Tortuguero), the Park boundary shall be the Caribbean Sea, including within it the portion of the sea corresponding to the territorial waters of Costa Rica.\n\n(SINALEVI NOTES:\n\n(1. By Article 2 of Decreto Ejecutivo N° 11148 of February 5, 1980, \"the Tortuguero National Park, created by Law Number 5680 of November 3, 1975, is extended to include the Laguna Jalova, the area between it and the current park boundary, and the area between the Laguna Jalova and a parallel line 100 m distant from its southern shore. The Servicio de Parques Nacionales may not transfer it to any other institution. To promote its development and to ensure its purposes are fulfilled, the Advisory Board (Junta Asesora) of the Tortuguero National Park is created, under the coordination of JAPDEVA, composed of one representative from each of the following bodies: JAPDEVA, Instituto Costarricense de Turismo, Servicio de Parques Nacionales.\n\nArticle record\n\nArticle 4.- Once this law is approved, the Dirección General Forestal shall conduct a census and study of the lands subject to occupation.\n\nArticle record\n\nArticle 5.- Agricultural and livestock operations in the hands of private individuals, whether registered or not in the Registro Público de la Propiedad, located within the park and existing on the effective date of this law, are automatically subject to the Forest Regime (Régimen Forestal). The tasks carried out on them must be those customary for this type of production and provided they do not involve the felling of any tree.\n\nArticle record\n\nArticle 6.- The Servicio de Parques Nacionales shall arrange the direct purchase or expropriation of farms, whether registered or not in the Registro Público, included within the park and considered indispensable for its conservation and development. Both in the case of registered farms and unregistered farms, as long as the requirements conform to the positive prescription established by the respective law or laws, payment shall be made in accordance with the value of the property right or possessory right, according to an appraisal by experts from the Dirección General de Tributación Directa. The mere right of possession, without the existence of improvements, shall not confer the right to payment. Expropriation shall be carried out in accordance with Articles 157 and following of the Código Municipal.\n\nArticle record\n\nArticle 7.- The Ministerio de Agricultura y Ganadería shall include, starting in 1976, in its ordinary budget, the sums necessary to acquire privately owned lands included within the park, as well as the allocations for its protection, development, and research. Likewise, the Ministerio de Agricultura y Ganadería is obligated to include, starting in 1976, the following positions to ensure the protection of this park: one national park administrator, one assistant national park administrator, and ten rangers (guardas). In addition, the sum necessary for the construction of posts and the purchase of means of transport for surveillance duties.\n\nArticle record\n\nArticle 8.- Within the area constituting this national park, the following is prohibited:\n\na) Felling trees or extracting forest products of any kind, except for the commercial and technical exploitation of coconut groves, which remains at the discretion of the Servicio de Parques Nacionales;\n\nb) Hunting or capturing wild animals, or collecting any of their products or remains, with the exception established in Article 9 of this law;\n\nc) Fishing for or hunting sea turtles of any species or collecting or gathering their eggs or remains. This prohibition extends from the mouth of the Matina River to the mouth of the Colorado River and up to the limit of the territorial waters of Costa Rica within the Caribbean Sea; and\n\nd) Collecting or extracting objects of historical or archaeological value.\n\nArticle record\n\nArticle 9.- Domestic or sport fishing within the limits of the national park shall be subject to the conditions established by the Servicio de Parques Nacionales, after consulting CONICIT.\n\nArticle record\n\nArticle 10.- The Junta de Administración Portuaria y Desarrollo Económico de la Vertiente Atlántica shall maintain the administration of the waterway within the boundaries of this park and shall establish the necessary buildings for the cabotage service (servicio de cabotaje), endeavoring to cause the least damage to the natural scenic aspect and not causing pollution.\n\nArticle record\n\nArticle 11.- The cabotage service (servicio de cabotaje) shall be regulated by the Junta de Administración Portuaria y Desarrollo Económico de la Vertiente Atlántica.\n\nArticle record\n\nArticle 12.- To cover the expenses required by the conservation and development of the park, a percentage of 20% of the toll right (derecho de peaje) through the canal waterway is established, which must be delivered to the Parques Nacionales fund monthly. If, from the remaining 80%, which shall be applied to the maintenance of the canals, any surplus is produced, it shall be invested in the development of the park.\n\nThe Servicio Nacional de Parques is authorized to charge fees (derechos) for access to and use of the park and its facilities, all of which shall be decreed by the Poder Ejecutivo as taxes (tasas), in accordance with Articles 4 and 5 of the Código de Normas y Procedimientos Tributarios.\n\nThe collection and administration of these revenues shall be the responsibility of the Junta de Administración Portuaria y Desarrollo Económico de la Vertiente Atlántica.\n\nArticle record\n\nArticle 13.- The Servicio de Parques Nacionales may establish agreements with JAPDEVA, the Instituto Costarricense de Turismo, and other national and international institutions for the conservation, protection, and scientific research within this park.\n\nArticle record\n\nArticle 14.- The Tortuguero National Park is established without prejudice to the possibility of opening other canals in its territory, to enable other adjacent zones, by the Junta de Administración Portuaria y Desarrollo Económico de la Vertiente Atlántica, or by third parties with its authorization in each case, with the prior approval of the Servicio de Parques Nacionales and CONICIT.\n\nArticle record\n\nArticle 15.- The Procuraduría General de la República shall register this park in the Registro Público as an individualized State property.\n\nArticle record\n\nArticle 16.- Within the zone between the mouth of the Matina River and the mouth of the Colorado River and from the Caribbean Sea up to one kilometer West of the main navigation canal, excepting the area included within the Tortuguero National Park, land use (uso de la tierra) and the exploitation of all natural resources shall be regulated by JAPDEVA, after mandatory consultation with CONICIT, and may only be carried out with the approval of this institution.\n\nArticle record\n\nArticle 17.- This law is effective from its publication and repeals or modifies any other conflicting provisions as pertinent.\n\nTransitional Provision I.- For the purposes of Article 16, JAPDEVA shall, with the advice of CONICIT, within a period of no more than twelve months from the effective date of this law, carry out the complete study of the potential land use and natural resources so that private possessors strictly conform to it.
