  "body_es_text": "Recuerde que Control F es una opción que le permite buscar en la totalidad del texto\n\n\nIr al final del documento\n\n- Usted está en la última versión de la norma -\n\nLey de Protección, Conservación y Recuperación de las Poblaciones de Tortugas Marinas\n\n Artículo 1º-Con el propósito de adoptar las medidas necesarias para garantizar los fines de esta\nLey y los compromisos adquiridos por el país en los instrumentos internacionales ratificados sobre\nla materia, se declara de interés público la investigación científica relacionada con las tortugas\nmarinas y su hábitat.\n\nTodas las instituciones públicas que posean información científica relacionada con las tortugas\nmarinas, estarán obligadas a facilitarla, sin costo alguno, al Ministerio del Ambiente y Energía\n(MINAE), cuando así se les solicite, con el fin de manejar racionalmente estas especies.\n\nLas organizaciones privadas que posean información relacionada con esta materia, podrán\nfacilitársela al MINAE, cuando les sea requerida.\n\n\nFicha articulo\n\n\n\n\n\nArtículo 2º-Para evitar la muerte accidental de tortugas marinas en actividades pesqueras, las\nembarcaciones camaroneras de arrastre, nacionales o extranjeras, que operen en el mar territorial o\nen la zona económica exclusiva, deberán usar Dispositivos Excluidores de Tortugas (DET) en las zonas\no áreas establecidas por el Instituto Costarricense de Pesca y Acuicultura (INCOPESCA), sin\nperjuicio de lo contenido en los convenios internacionales.\n\nLas embarcaciones de arrastre, nacionales o extranjeras, que no utilicen el Dispositivo Excluidor de\nTortugas (DET) en las áreas señaladas por el INCOPESCA, serán sancionadas con multa de tres a cinco\nsalarios base, definidos en el artículo 2 de la Ley N° 7337, de 5 de mayo de 1993.\n\nAsimismo, a las embarcaciones que no utilicen el Dispositivo Excluidor de Tortugas (DET) se les\nrevocará la licencia de pesca.\n\n\nFicha articulo\n\n\n\n\n\nArtículo 3º-El MINAE será el ente responsable de coordinar con los Ministerios de Educación Pública\n(MEP) y de Economía, Industria y Comercio (MEIC), al igual que con el Instituto Costarricense de\nTurismo (ICT) y las demás instituciones relacionadas con la protección y la conservación de la vida\nsilvestre, proyectos que promocionen actividades turísticas para la observación del anidamiento y\ndesove de las tortugas.\n\nTodo proyecto deberá contar con la autorización razonada del MINAE, debidamente sustentada en\ncriterios técnicos de impacto que garanticen la protección de estas especies marinas.\n\n\nFicha articulo\n\n\n\n\n\nArtículo 4º-Decláranse de interés ecoturístico los siguientes ecosistemas de anidamiento y desove de\ntortugas marinas: Ostional, Nancite, Playa Grande, Tivives, Gandoca y Tortuguero, y todos los que en\nel futuro determine el MINAE. A tal efecto, este Ministerio organizará programas de capacitación\npara los pobladores locales en materia de tortugas marinas y turismo sostenible. A los pobladores\nque aprueben los programas de capacitación, el Sistema Nacional de Áreas de Conservación del MINAE\nlos dotará de un carné oficial que los acredite como guías de grupos de turistas en las playas de\ninterés ecoturístico. Igualmente, las personas que realicen actividades con grupos para la\nobservación de tortugas fuera de las áreas de competencia del MINAE deberán obtener la respectiva\nlicencia de guía de turismo otorgada por el ICT, de conformidad con la Ley N° 7472, Promoción de la\ncompetencia y defensa efectiva del consumidor, de 20 de diciembre de 1994.\n\nLas empresas de hospedaje, al igual que las agencias operadoras de grupos de turistas ubicadas en\nlas zonas donde se encuentren las playas declaradas de interés ecoturístico, o que realicen\nactividades en dichas zonas, tendrán prioridad para que el ICT las afilie al Programa de\nCertificación para la Sostenibilidad Turística.\n\n\nFicha articulo\n\n\n\n\n\nArtículo 5º-El MEP y las instituciones de educación superior universitaria, públicas y privadas, y\nparauniversitaria, mediante sus programas aprobados de educación ambiental, promoverán la protección\ny la conservación de nuestros recursos naturales, con especial énfasis en la protección de tortugas\nmarinas.\n\n\nFicha articulo\n\n\n\n\n\nArtículo 6º-Quien mate, cace, capture, destace, trasiegue o comercie tortugas marinas, será penado\ncon prisión de uno a tres años.   "body_en_text": "Remember that Control F is an option that allows you to search the entire text\n\nGo to the end of the document\n\n- You are viewing the latest version of the regulation -\n\nLaw for the Protection, Conservation, and Recovery of Sea Turtle Populations\n\nArticle 1º—For the purpose of adopting the necessary measures to guarantee the aims of this Law and the commitments acquired by the country in ratified international instruments on the subject, scientific research related to sea turtles and their habitat is declared to be in the public interest.\n\nAll public institutions that possess scientific information related to sea turtles shall be obliged to provide it, at no cost, to the Ministry of Environment and Energy (Ministerio del Ambiente y Energía, MINAE), when so requested, in order to rationally manage these species.\n\nPrivate organizations that possess information related to this subject may provide it to MINAE when requested.\n\n---\n\nArticle 2º—To avoid the accidental death of sea turtles in fishing activities, national or foreign shrimp trawlers operating in the territorial sea or the exclusive economic zone must use Turtle Excluder Devices (Dispositivos Excluidores de Tortugas, DET) in the zones or areas established by the Costa Rican Institute of Fisheries and Aquaculture (Instituto Costarricense de Pesca y Acuicultura, INCOPESCA), without prejudice to the provisions of international agreements.\n\nNational or foreign trawlers that do not use the Turtle Excluder Device (DET) in the areas designated by INCOPESCA shall be sanctioned with a fine of three to five base salaries, as defined in Article 2 of Law No. 7337, of May 5, 1993.\n\nLikewise, vessels that do not use the Turtle Excluder Device (DET) shall have their fishing license revoked.\n\n---\n\nArticle 3º—MINAE shall be the entity responsible for coordinating with the Ministries of Public Education (Ministerio de Educación Pública, MEP) and of Economy, Industry, and Commerce (Ministerio de Economía, Industria y Comercio, MEIC), as well as with the Costa Rican Tourism Institute (Instituto Costarricense de Turismo, ICT) and other institutions related to the protection and conservation of wildlife, projects that promote tourism activities for the observation of turtle nesting and egg-laying.\n\nEvery project must have the reasoned authorization of MINAE, duly supported by technical impact criteria that guarantee the protection of these marine species.\n\n---\n\nArticle 4º—The following nesting and egg-laying ecosystems for sea turtles are declared to be of ecotourism interest: Ostional, Nancite, Playa Grande, Tivives, Gandoca, and Tortuguero, and all those that MINAE determines in the future. To this end, this Ministry shall organize training programs for local residents on the subject of sea turtles and sustainable tourism. For residents who pass the training programs, the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación) of MINAE shall provide them with an official ID card accrediting them as guides for tourist groups on beaches of ecotourism interest. Likewise, persons conducting group activities for turtle observation outside the areas of MINAE's competence must obtain the respective tourism guide license issued by the ICT, in accordance with Law No. 7472, Promotion of Competition and Effective Consumer Defense, of December 20, 1994.\n\nLodging companies, as well as tour operator agencies for tourist groups located in the zones where the beaches declared to be of ecotourism interest are found, or that carry out activities in said zones, shall have priority for the ICT to affiliate them with the Certification Program for Tourism Sustainability (Programa de Certificación para la Sostenibilidad Turística).\n\n---\n\nArticle 5º—The MEP and higher education institutions, public and private, and para-university institutions, by means of their approved environmental education programs, shall promote the protection and conservation of our natural resources, with special emphasis on the protection of sea turtles.\n\n---\n\nArticle 6º—Whoever kills, hunts, captures, slaughters, transports, or trades sea turtles shall be punished with imprisonment from one to three years. The penalty shall be three months to two years of imprisonment for whoever retains sea turtles for commercial purposes, or trades products or subproducts of these species.\n\nThe collection of olive ridley turtle eggs in the Ostional Wildlife Refuge (Refugio de Vida Silvestre de Ostional) shall not be punishable, provided it is carried out in accordance with the regulatory provisions issued by MINAE.\n\n---\n\nArticle 7º—All goods, instruments, and implements used in the commission of the crimes set forth in the previous article shall become property of the State, as stipulated in the Penal Code.\n\n---\n\nArticle 8º—It shall be the responsibility of MINAE, in coordination with the Ministries of Public Security and of Health, the Costa Rican Institute of Fisheries and Aquaculture (INCOPESCA), and the Board of Port Administration and Economic Development of the Atlantic Slope (Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica), to ensure compliance with the provisions of this Law, within their respective spheres of competence.\n\n---\n\nArticle 9º—In compliance with the provisions of the Inter-American Convention for the Protection and Conservation of Sea Turtles, approved by Law No. 7906, of August 23, 1999, MINAE shall designate the representatives to the Consultative Committee and the Scientific Committee indicated in that international instrument.\n\nEffective from its publication.\n\n---\n\nDate generated: 4/5/2026 19:07:48\n\nGo to the beginning of the document"
