  "body_es_text": "Recuerde que Control F es una opción que le permite buscar\n                en la totalidad del texto\n\n                Ir al final del documento\n\n                    - Usted está en la última versión de la norma\n                    -\n\n                        Texto Completo Norma 25663\n\n                        Restricción a la corta o aprovechamiento del árbol de almendro.\n\nTexto Completo acta: 607C8\nN°25663-MINAE\n\n                           N°25663-MINAE\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY EL MINISTRO DEL AMBIENTE Y ENERGÍA\n\nCon fundamento en los artículos 11, 50, 89, 140 incisos 3) y 8) de\n  la Constitución Política; artículo 28 inciso b) de la Ley General de la Administración\n  Pública; artículo 8 incisos b), c), d), f), e), y) del Convenio sobre la Diversidad\n  Biológica y sus Anexos I y II firmado el 13 de junio de 1992 en Río de Janeiro, Brasil,\n  aprobado mediante ley 7416 del 30 de junio de 1994; artículo 4 en relación con el\n  artículo 9, artículo 15 y 23 todos del Convenio para la Conservación de la\n  Biodiversidad y Protección de las Áreas Silvestres Prioritarias en América Central,\n  aprobado mediante ley 7433 del 14 de setiembre de 1994; artículos 46, 48 y 116 de la ley\n  7554 del 04 de octubre de 1995, Ley Orgánica del Ambiente; artículo 3 de la ley 7317 del\n  30 de octubre de 1992, Ley de Conservación de la Vida Silvestre, en relación con el\n  artículo 6 inciso e) de la ley 7575 del 13 de febrero de1996, Ley Forestal; y,\n\nConsiderando:\n\nI.—Que mediante el artículo 1- del decreto ejecutivo\n  número 25167-MINAE, publicado en el Diario Oficial \"La Gaceta\" número 111 del\n  12 de junio de 1996, el Poder Ejecutivo dispuso una restricción a la corta o\n  aprovechamiento del árbol Almendro (Dipteryx panamensis) en las zonas comprendidas entre\n  el Río San Carlos y el Río Sarapiquí, por el lado norte el Río San Juan (frontera\n  Costa Rica-Nicaragua), por el lado oeste longitud 84.15 grados, por el lado sur latitud\n  10.33 grados y por el lado este longitud 83.53 grados, por ser esta la especie forestal\n  preferentemente utilizada por la Lapa Verde (Ara Ambigua) como sitio de anudamiento y\n  fuente alimentaria.\n\nII.—Que de conformidad con los artículos 25 de la Ley de\n  Conservación de la Vida Silvestre y 65 de su Reglamento, decreto ejecutivo número\n  22545-MIRENEM, publicado en \"La Gaceta\" 195 del 13 de octubre de 1993, la Lapa\n  Verde (Ara Amigua) está declarada como especie de fauna en peligro de extinción.\n\nIII.—Que para la correcta aplicación de dicha norma, es\n  conveniente complementar sus alcances con ciertos parámetros técnico-conceptuales, que\n  beneficien su aplicabilidad y mejor comprensión.\n\nIV—Que durante la vigencia del decreto ejecutivo 25167-MINAE, se\n  comprobó que se hace necesario reiterar sus contenidos jurídicos y emitir actos que\n  contribuyan a hacer efectiva la protección que el Estado debe garantizar a la Lapa Verde,\n  como expresión de las especies que corre un inminente peligro de extinción si no se\n  emiten regulaciones oportunas, lo cual iría en evidente perjuicio de la biodiversidad\n  actual y del derecho de las futuras generaciones al goce y contemplación de esta ave,\n  como parte de los ecosistemas naturales del país.\n\nPor lo tanto,\n\ndecretan:\n\nArtículo I.—Principio general y ámbito de aplicación\n\nSe mantiene la restricción a la corta o aprovechamiento del árbol\n  conocido como Almendro (nombre científico Dipteryx panamensis), en la zona descrita en el\n  artículo 1- del decreto ejecutivo No 25167-MINAE, publicado en \"La Gaceta\" No\n  111 del 12 de junio de 1996. En consecuencia, toda actividad de corta o aprovechamiento\n  del Almendro, que ocurra dentro de la zona ecogeográfica descrita, se debe realizar de\n  conformidad con las disposiciones técnicas del presente decreto.\n\n \n\n Ficha articulo\n\nArtículo II.—Vocabulario\n\nPara los efectos de hacer efectiva esta restricción, cuando se\n  utilicen los siguiente términos, debe dárseles las acepciones que a continuación se\n  indican:\n\na) Árbol hueco: Árbol que presenta uno o varios huecos\n  unidireccionados con cavidad cilindrica y profunda, aptos para la anidación de la Lapa\n  Verde, que no están siendo utilizados por dichas aves.\n\nb) Árbol nido: Aquel árbol en bosque o en áreas sin bosque,\n  que posea la cavidad o cavidades naturales en forma cilindrica, con aptitud para que la\n  Lapa Verde (Ara Ambigua) establezca sus nidos, los que generalmente ocurren en alturas\n  superiores a los diez metros y que esté siendo utilizado o tenga uso potencial de\n  anidación para esta especie. En su hecho generalmente aceptado por la doctrina que la\n  especie de árbol en que la lapa verde anida es el Almendro o Almendro Amarillo (Dipterix\n  Panamensis)\n\nc) Árbol portador: Individuo que con un diámetro mayor o igual\n  al mínimo de corta definido, debe permanecer en el área que va a ser intervenida por\n  aprovechamiento, con el fin de aportar material genético que garantice la subsistencia de\n  la especie, o el mantenimiento de la biodiversidad, por sus características se convierte\n  en un individuo elegible para cosecha futura.\n\nd) Áreas sin bosque: Cualquiera de las siguiente\n  circunstancias:\n\n           i.\nTerrenos dedicados a cultivos agrícolas o a la actividad ganadera.\n\nii. Potreros.\n\niii. Terrenos en los que se combine el cultivo de árboles con\n  cultivos alimenticios o pastos y,\n\niv. Plantaciones forestales\n\ne) Bosque: Se conceptúa tal y como aparece definido en el\n  artículo 3-inciso d) de la Ley Forestal 7575, publicada en \"La Gaceta\" No 72\n  del 16 de abril de 1996.\n\nf) Censo comercial en bosque: Cuantifícación y cualificación\n  de los árboles con características físico-mecánicas adecuadas, para el aprovechamiento\n  según las previsiones contempladas en el Plan de Manejo.\n\ng) DAP: Las siglas de \"Diámetro a la Altura del\n  Pecho\" que equivale a 1.30 metros a nivel del suelo.\n\nh) Inventario forestal en áreas sin bosque: Cuantificación y\n  cualificación aplicada de una especie o grupo de especie.\n\ni) Mapa: Representación gráfica y geográfica del inmueble o\n  del conjunto de inmuebles en los que se realiza o se va a realizar el aprovechamiento o la\n  corta de árboles.\n\nj) Plan de manejo forestal: Concepto definido en la ley forestal\n  7575, artículo 3- inciso e), publicada en \"La Gaceta\" No 72 del 16 de abril de\n  1996.\n\nk) Servicios ambientales: Concepto definido por la Ley Forestal\n  7575, inciso 3- inciso k), publicada en \"La Gaceta\" No 72 del 16 de abril de\n  1996.\n\n \n\n Ficha articulo\n\nArtículo III.—Parámetros técnicos aplicables:\n\n1. Para el caso de bosques deberá ubicarlos en el mapa base, y en el caso de\n  áreas sin bosque, haciendo un mapa que refleje su ubicación lo más exacta posible en el\n  terreno.\n\nb) Como parte del censo comercial del plan de manejo, o del inventario\n  forestal, según corresponda, debe el regente enviar al Área de Conservación respectiva,\n  la información con las características de estos árboles (DAP y altura), su ubicación\n  en el mapa y su estado fitosanitario.\n\n7. ANULADO por resolución de la Sala Constitucional N°\n  02-02486 de las 10:54 horas del 08/03/2002.\n\n \n\n Ficha articulo\n\nArtículo IV.-Acciones complementarias.\n\n1. La administración forestal del Estado, a través de las Áreas de Conservación Arenal (ACA) y\nCordillera Volcánica Central (ACA), mantendrá actualizada una base de datos con la siguiente\ninformación: permisos emitidos, árboles remanentes; árboles ni árboles semilleros, su ubicación y\notras características.\n\n2. Consequently, any activity of felling or harvesting\n  of the Almendro occurring within the described ecogeographic zone must be carried out in\n  accordance with the technical provisions of this decree.\n\n \n\n Article file\n\nArticle II.—Vocabulary\n\nFor the purposes of making this restriction effective, when\n  the following terms are used, they shall be given the meanings indicated below:\n\na) Hollow tree (Árbol hueco): A tree that has one or several\n  unidirectional holes with a deep cylindrical cavity, suitable for nesting of the Great Green Macaw,\n  which are not being used by said birds.\n\nb) Nest tree (Árbol nido): That tree in forest (bosque) or in areas without forest (áreas sin bosque),\n  that possesses the natural cavity or cavities in cylindrical form, suitable for the\n  Great Green Macaw (Ara Ambigua) to establish its nests, which generally occur at heights\n  greater than ten meters and that is being used or has potential nesting use\n  for this species. It is a generally accepted fact in the doctrine that the\n  tree species in which the Great Green Macaw nests is the Almendro or Almendro Amarillo (Dipterix\n  Panamensis).\n\nc) Seed tree (Árbol portador): An individual that, with a diameter greater than or equal\n  to the defined minimum cutting diameter, must remain in the area to be intervened by\n  harvesting (aprovechamiento), in order to contribute genetic material that guarantees the survival of\n  the species, or the maintenance of biodiversity; due to its characteristics it becomes\n  an individual eligible for future harvest.\n\nd) Areas without forest (Áreas sin bosque): Any of the following\n  circumstances:\n\n           i.\nLands dedicated to agricultural crops or livestock activity.\n\nii. Pastures (Potreros).\n\niii. Lands where tree cultivation is combined with\n  food crops or pastures, and\n\niv. Forest plantations.\n\ne) Forest (Bosque): Understood as defined in\n  Article 3-subsection d) of Forestry Law 7575, published in \"La Gaceta\" No. 72\n  of April 16, 1996.\n\nf) Commercial census in forest (Censo comercial en bosque): Quantification and qualification\n  of trees with adequate physical-mechanical characteristics for harvesting\n  according to the provisions contemplated in the Forest Management Plan (Plan de Manejo).\n\ng) DBH (DAP): The acronym for \"Diameter at Breast Height (Diámetro a la Altura del\n  Pecho)\" which is equivalent to 1.30 meters above ground level.\n\nh) Forest inventory in areas without forest (Inventario forestal en áreas sin bosque): Applied quantification and\n  qualification of a species or group of species.\n\ni) Map (Mapa): Graphic and geographical representation of the property\n  or set of properties where the harvesting or\n  felling of trees is carried out or will be carried out.\n\nj) Forest management plan (Plan de manejo forestal): Concept defined in Forestry Law\n  7575, Article 3-subsection e), published in \"La Gaceta\" No. 72 of April 16,\n  1996.\n\nk) Environmental services (Servicios ambientales): Concept defined by Forestry Law\n  7575, subsection 3-subsection k), published in \"La Gaceta\" No. 72 of April 16,\n  1996.\n\n \n\n Article file\n\nArticle III.—Applicable Technical Parameters:\n\n1. Hollow trees (árboles huecos) and nest trees (árboles nido) must be excluded from\n  harvesting.\n\n4. In forests (bosques) where the Almendro (Dipyerix Panamensis), according\n  to the commercial census conducted, has a frequency of less than zero point three (0.3) trees\n  per hectare, it will be considered \"infrequent (poco frecuente)\" and its felling\n  or harvesting will not be permitted.\n\n5. Without prejudice to the responsibilities directly created by the\n  Forestry Law, forestry regents (regentes forestales) must comply with the following obligations:\n\na) Mark the seed trees (árboles portadores) and nest trees (árboles nido) of Dipterix\n  Panamensis. For the case of forests, they must locate them on the base map, and in the case of\n  areas without forest (áreas sin bosque), by making a map that reflects their location as accurately as possible on the\n  ground.\n\nb) As part of the commercial census of the management plan, or of the forest\n  inventory, as applicable, the regent must send to the respective Conservation Area (Área de Conservación),\n  the information with the characteristics of these trees (DBH and height), their location\n  on the map and their phytosanitary status.\n\n7. The State Forest Administration, through the Arenal Conservation Area (ACA) and\nCentral Volcanic Cordillera Conservation Area (ACA), will keep an updated database with the following\ninformation: permits issued, remaining trees; nest trees (árboles ni) seed trees (árboles semilleros), their location and\nother characteristics.\n\n2.
