y Deseosos de concertar una\nconvención sobre la protección de la flora, la fauna, y las bellezas escénicas\nnaturales dentro de los propósitos arriba enunciados han convenido en los siguientes\nartículos:\n\nARTICULO 1\n\nDefinición de los términos y expresiones empleados en esta\nConvención.\n\n1.-Se entenderá por Parques Nacionales: Las regiones establecidas para\nla protección y conservación de las bellezas escénicas naturales y de la flora y la\nfauna de importancia nacional, de las que el público pueda disfrutar mejor al ser puestas\nbajo la vigilancia oficial.\n\n2.-Se entenderá por Reservas Nacionales: Las regiones establecidas\npara la conservación y utilización, bajo vigilancia oficial, de las riquezas naturales,\nen las cuales se dará a la flora y la fauna toda protección que sea compatible con los\nfines para los que son creadas estas reservas.\n\n3.-Se entenderá por Monumentos Naturales: Las regiones, los objetos o\nlas especies vivas de animales o plantas de interés estético o valor histórico o\ncientífico, a los cuales se les da protección absoluta. Los Monumentos Naturales se\ncrean con el fin de conservar un objeto específico o una especie determinada de flora o\nfauna declarando una región, un objeto o una especie aislada, monumento natural\ninviolable excepto para realizar investigaciones científicas debidamente autorizadas, o\ninspecciones gubernamentales.\n\n4.-Se entenderá por Reservas de Regiones Vírgenes: Una región\nadministrada por los poderes públicos, donde existen condiciones primitivas naturales de\nflora, fauna, vivienda y comunicaciones, con ausencia de caminos para el tráfico de\nmotores y vedada a toda explotación comercial.\n\n5.-Se entenderá por Aves Migratorias: Las aves pertenecientes o\ndeterminadas especies, todos los individuos de las cuales o algunos de ellos, cruzan, en\ncualquier estación del año, las fronteras de los países de América. Algunas especies\nde las siguientes familias de aves pueden citarse como ejemplos de aves migratorias:\nCharadriidae, Scolopacidae, Caprimulgidae, Hirundinidae.\n\n Ficha articulo\n\nARTICULO 2\n\n1.-Los Gobiernos Contratantes estudiarán inmediatamente la posibilidad de crear, dentro del\nterritorio de sus respectivos países, los parques nacionales, las reservas nacionales, los\nmonumentos naturales, y las reservas de regiones vírgenes definidos en el artículo precedente. En\ntodos aquellos casos en que dicha creación sea factible se comenzará la misma tan pronto como sea\nconveniente después de entrar en vigor la presente Convención.\n\n2.-Si en algún país la creación de parques o reservas nacionales, monumentos naturales o reservas de\nregiones vírgenes no fuera factible en la actualidad, se seleccionarán a la brevedad posible los\nsitios, objetos o especies vivas de animales o plantas, según sea el caso, que se transformarán en\nparques o reservas nacionales, monumentos naturales o reservas de regiones vírgenes tan pronto como\na juicio de las autoridades del país, lo permitan las circunstancias.\n\n3.-Los Gobiernos Contratantes notificarán a la Unión Panamericana de la creación de parques\nnacionales, reservas nacionales, monumentos naturales y reservas de regiones vírgenes, y de la\nlegislación y los sistemas administrativos adoptados a este respecto.\n\n Ficha articulo\n\nARTICULO 3\n\nLos Gobiernos Contratantes convienen en que los límites de los parques nacionales no serán alterados\nni enajenada parte alguna de ellos sino por acción de la autoridad legislativa competente. Dichas reglamentaciones contendrán disposiciones que permitan la caza o recolección de\nejemplares de fauna y flora para estudios e investigaciones científicas por individuos y organismos\ndebidamente autorizados.\n\n2.-Los Gobiernos Contratantes convienen en adoptar o en recomendar a sus respectivos cuerpos\nlegislativos la adopción de leyes que aseguren la protección y conservación de los paisajes, las\nformaciones geológicas extraordinarias, y las regiones y los objetos naturales de interés estético o\nvalor histórico o científico.\n\n Ficha articulo\n\nARTICULO 6\n\nLos Gobiernos Contratantes convienen en cooperar los unos con los otros para promover los propósitos\nde esta Convención. Con este objeto prestarán la ayuda necesaria, que sea compatible con su\nlegislación nacional, a los hombres de ciencia de las Repúblicas Americanas que se dedican a las\ninvestigaciones y exploraciones y podrán, cuando las circunstancias lo justifiquen, celebrar\nconvenios los unos con los otros o con instituciones científicas de las Américas que tiendan a\naumentar la eficacia de su colaboración; y pondrán a la disposición de todas las Repúblicas, por\nigual, ya sea por medio de su publicación o de cualquiera otra manera, los conocimientos científicos\nque lleguen a obtenerse por medio de esas labores de cooperación.\n\n Ficha articulo\n\nARTICULO 7\n\nLos Gobiernos Contratantes adoptarán las medidas apropiadas para la protección de las aves\nmigratorias de valor económico o de interés estético o para evitar la extinción que amenace a una\nespecie determinada. Se adoptarán medidas que permitan, hasta donde los respectivos gobiernos lo\ncrean conveniente, utilizar racionalmente las aves migratorias, tanto en el deporte como en la\nalimentación, el comercio, la industria y para estudios e investigaciones científicos.\n\n Ficha articulo\n\nARTICULO 8\n\nLa protección de las especies mencionadas en el Anexo de esta Convención es de urgencia e\nimportancia especial. Las especies allí incluidas serán protegidas tanto como sea posible y solo las\nautoridades competentes del país podrán autorizar la caza, matanza, captura o recolección de\nejemplares de dichas especies. Estos permisos podrán concederse solamente en circunstancias\nespeciales cuando sean necesarios para la realización de estudios científicos o cuando sean\nindispensables en la administración de la región en que dicho animal o planta se encuentre.\n\n Ficha articulo\n\nARTICULO 9\n\nCada uno de los Gobiernos Contratantes tomará las medidas necesarias para la vigilancia y\nreglamentación de las importaciones, exportaciones y tránsito de especies protegidas de flora o\nfauna, o parte alguna de las mismas, por los medios siguientes:\n\n1.-Concesión de certificados que autoricen la exportación o tránsito de especies protegidas de flora\no fauna, o de sus productos.\n\n2.-Prohibición de las importaciones de cualquier ejemplar de fauna o flora protegido por el país de\norigen, o parte de alguna del mismo, si no está acompañado de un certificado expedido de acuerdo con\nlas disposiciones del Párrafo 1 de este Artículo, autorizando su exportación.\n\n Ficha articulo\n\nARTICULO 10\n\n1.-Las disposiciones de la presente Convención no reemplazan los acuerdos internacionales celebrados\npreviamente por una o más de las altas partes contratantes.\n\n2.-La Unión Panamericana suministrará a los Gobiernos Contratantes toda información pertinente a los\nfines de la presente Convención que le sea comunicada por cualquier museo nacional, u organismo\nnacional o internacional, creado dentro de sus jurisdicciones e interesado en los fines que persigue\nla Convención.\n\n Ficha articulo\n\nARTICULO 11\n\n1.-El original de la presente Convención en español, inglés, portugués y francés será depositado en\nla Unión Panamericana y abierto a la firma de los Gobiernos Americanos el 12 de octubre de 1940.\n\n2.-La presente Convención quedará abierta a la firma de los Gobiernos Americanos. Los instrumentos\nde ratificación serán depositados en la Unión Panamericana, la cual notificará el depósito y la\nfecha del mismo, así como el texto de cualquier declaración o reserva que los acompañe, a todos los\ngobiernos americanos.\n\n3.-La presente Convención entrará en vigor tres meses después de que se hayan depositado en la Unión\nPanamericana no menos de cinco ratificaciones.\n\n4.-Cualquier ratificación que se reciba después de que la presente Convención entre en vigor tendrá\nefecto tres meses después de la fecha del depósito de dicha ratificación en la Unión Panamericana.\n\n Ficha articulo\n\nARTICULO 12\n\n1.- Cualquiera de los Gobiernos Contratantes podrá denunciar la\npresente Convención en todo momento dando aviso por escrito a la Unión Panamericana. La\ndenuncia tendrá efecto un año después del recibo de la notificación respectiva por la\nUnión Panamericana. Ninguna denuncia, sin embargo, surtirá efecto sino cinco años\ndespués de entrar en vigor la presente Convención.\n\n2.- Si como resultado de denuncias simultáneas o sucesivas el número\nde Gobiernos Contratantes se reduce a menos de tres, la Convención dejará de tener\nefecto desde la fecha en que, de acuerdo a las disposiciones del Párrafo precedente, la\núltima de dichas denuncias tenga efecto.\n\n3.- La Unión Panamericana notificará a todos los Gobiernos Americanos\nlas denuncias y las fechas en que comiencen a tener efecto.\n\n4.- Si la Convención dejara de tener vigencia según lo dispuesto en\nel Párrafo segundo del presente artículo, la Unión Panamericana notificará a todos los\nGobiernos Americanos la fecha en que la misma cese en sus efectos.\n\nEn Fe de lo Cual, los infrascritos Plenipotenciarios, después de haber\ndepositado sus Plenos Poderes, que se han encontrado en buena y debida forma, firman y\nsellan esta Convención en la Unión Panamericana, Washington, D. Natural Monuments are\ncreated for the purpose of conserving a specific object or a particular species of flora or\nfauna by declaring a region, an object, or an isolated species an inviolable natural\nmonument except for the conduct of duly authorized scientific investigations, or\ngovernment inspections.\n\n4.- \"Virgin Region Reserves\" shall be understood to mean: A region\nadministered by public authorities, where primitive natural conditions of\nflora, fauna, housing, and communications exist, with an absence of roads for motor\ntraffic and closed to all commercial exploitation.\n\n5.- \"Migratory Birds\" shall be understood to mean: Birds belonging to\ndetermined species, all individuals of which or some of them, cross, at\nany season of the year, the borders of the countries of America. Some species\nof the following families of birds may be cited as examples of migratory birds:\nCharadriidae, Scolopacidae, Caprimulgidae, Hirundinidae.\n\n Article file\n\nARTICLE 2\n\n1.-The Contracting Governments shall immediately study the possibility of creating, within the\nterritory of their respective countries, the national parks, national reserves, natural\nmonuments, and virgin region reserves defined in the preceding article. In\nall cases where such creation is feasible, it shall be commenced as soon as\nconvenient after the entry into force of this Convention.\n\n2.-If in any country the creation of national parks or reserves, natural monuments, or virgin\nregion reserves is not feasible at the present time, the sites, objects, or living species\nof animals or plants, as the case may be, that will be transformed into national parks or reserves,\nnatural monuments, or virgin region reserves shall be selected as soon as possible, as soon as, in\nthe judgment of the country's authorities, circumstances permit.\n\n3.-The Contracting Governments shall notify the Pan American Union of the creation of national\nparks, national reserves, natural monuments, and virgin region reserves, and of the\nlegislation and administrative systems adopted in this regard.\n\n Article file\n\nARTICLE 3\n\nThe Contracting Governments agree that the boundaries of national parks shall not be altered\nnor any part of them alienated except by action of the competent legislative authority. The\nresources existing within them shall not be exploited for commercial purposes.\n\nThe Contracting Governments agree to prohibit the hunting, killing, and capture of specimens of\nfauna and the destruction and collection of specimens of flora in national parks, except\nwhen carried out by the park authorities or by order or under the supervision of the same, or for\nduly authorized scientific investigations.\n\nThe Contracting Governments further agree to provide national parks with facilities\nfor the recreation and education of the public, in accordance with the purposes pursued by this Convention.\n\n Article file\n\nARTICLE 4\n\nThe Contracting Governments agree to maintain virgin region reserves inviolable insofar\nas feasible, except for duly authorized scientific investigation and for government\ninspection, or for other purposes consistent with the purposes for which the reserve\nwas created.\n\n Article file\n\nARTICLE 5\n\n1.-The Contracting Governments agree to adopt, or to recommend to their respective competent\nlegislative bodies, the adoption of laws and regulations that ensure the protection and\nconservation of flora and fauna within their respective territories and outside the national parks and\nreserves, natural monuments, and virgin region reserves mentioned in\nArticle 2. Such regulations shall contain provisions that permit the hunting or collection of\nspecimens of fauna and flora for scientific studies and investigations by duly authorized individuals and\norganizations.\n\n2.-The Contracting Governments agree to adopt, or to recommend to their respective legislative\nbodies the adoption of laws that ensure the protection and conservation of landscapes,\nextraordinary geological formations, and regions and natural objects of aesthetic interest or\nhistorical or scientific value.\n\n Article file\n\nARTICLE 6\n\nThe Contracting Governments agree to cooperate with one another to promote the purposes\nof this Convention. To this end, they shall provide the necessary assistance, compatible with\ntheir national legislation, to the scientists of the American Republics engaged in\ninvestigations and explorations; they may, when circumstances justify it, enter into\nagreements with one another or with scientific institutions of the Americas that tend to\nincrease the effectiveness of their collaboration; and they shall place at the disposal of all the Republics, equally,\nwhether through publication or in any other manner, the scientific knowledge\nobtained through such cooperative efforts.\n\n Article file\n\nARTICLE 7\n\nThe Contracting Governments shall adopt appropriate measures for the protection of migratory\nbirds of economic value or aesthetic interest or to prevent the extinction threatening a\nparticular species. Measures shall be adopted that permit, insofar as the respective governments\ndeem it appropriate, the rational utilization of migratory birds, whether for sport or for\nfood, commerce, industry, and scientific study and investigation.\n\n Article file\n\nARTICLE 8\n\nThe protection of the species mentioned in the Annex to this Convention is of special urgency\nand importance. The species included therein shall be protected as much as possible, and only the\ncompetent authorities of the country may authorize the hunting, killing, capture, or collection of\nspecimens of said species. These permits may be granted only under special\ncircumstances when they are necessary for carrying out scientific studies or when they are\nindispensable in the administration of the region where such animal or plant is found.\n\n Article file\n\nARTICLE 9\n\nEach of the Contracting Governments shall take the necessary measures for the supervision and\nregulation of imports, exports, and transit of protected species of flora or\nfauna, or any part thereof, by the following means:\n\n1.-Granting of certificates authorizing the export or transit of protected species of flora\nor fauna, or their products.\n\n2.-Prohibition of imports of any specimen of fauna or flora protected by the country of\norigin, or any part thereof, if it is not accompanied by a certificate issued in accordance with\nthe provisions of Paragraph 1 of this Article, authorizing its export.\n\n Article file\n\nARTICLE 10\n\n1.-The provisions of this Convention shall not replace international agreements previously\nentered into by one or more of the high contracting parties.\n\n2.-The Pan American Union shall provide the Contracting Governments with all information pertinent to the\npurposes of this Convention that is communicated to it by any national museum, or national\nor international organization, created within their jurisdictions and interested in the purposes pursued by\nthe Convention.\n\n Article file\n\nARTICLE 11\n\n1.-The original of this Convention in Spanish, English, Portuguese, and French shall be deposited with\nthe Pan American Union and open for signature by the American Governments on October 12, 1940.\n\n2.-This Convention shall remain open for signature by the American Governments. The instruments\nof ratification shall be deposited with the Pan American Union, which shall notify the deposit and the\ndate thereof, as well as the text of any declaration or reservation accompanying them, to all the\nAmerican governments.\n\n3.-This Convention shall enter into force three months after not less than five ratifications\nhave been deposited with the Pan American Union.\n\n4.-Any ratification received after this Convention enters into force shall take\neffect three months after the date of deposit of said ratification with the Pan American Union.\n\n Article file\n\nARTICLE 12\n\n1.- Any of the Contracting Governments may denounce this\nConvention at any time by giving written notice to the Pan American Union. The\ndenunciation shall take effect one year after receipt of the respective notification by the\nPan American Union. No denunciation, however, shall take effect until five years\nafter the entry into force of this Convention.\n\n2.- If, as a result of simultaneous or successive denunciations, the number\nof Contracting Governments is reduced to fewer than three, the Convention shall cease to have\neffect from the date on which, in accordance with the provisions of the preceding Paragraph, the\nlast of said denunciations takes effect.\n\n3.- The Pan American Union shall notify all the American Governments of\nthe denunciations and the dates on which they begin to take effect.\n\n4.-If the Convention should cease to be in force as provided in\nthe second paragraph of this article, the Pan American Union shall notify all the\nAmerican Governments of the date on which it ceases its effects.\n\nIn Witness Whereof, the undersigned Plenipotentiaries, after having\ndeposited their Full Powers, which have been found in good and due form, sign and\nseal this Convention at the Pan American Union, Washington, D.
