  "body_es_text": "Recuerde que Control F es una opción que le permite buscar en la totalidad del texto\n\n\nIr al final del documento\n\n- Usted está en la última versión de la norma -\n\nReglamento del Consejo Regional del Área de Conservación Marina Isla del Coco\n\nNº 35542-MINAE(*)\n\n(*)(Así modificada su denominación por el artículo 11 de la Ley \"Traslado del sector\nTelecomunicaciones del Ministerio de Ambiente, Energía y Telecomunicaciones al Ministerio de Ciencia\ny Tecnología, N° 9046 del 25 de junio de 2012)\n\n\n\n\n\nEL PRESIDENTE DE LA REPÚBLICA\n\n\n\n\n\nY EL MINISTRO DE AMBIENTE Y ENERGÍA(*)\n\n\n\n\n\n(*)(Así modificada su denominación por el artículo 11 de la Ley \"Traslado del sector\nTelecomunicaciones del Ministerio de Ambiente, Energía y Telecomunicaciones al Ministerio de Ciencia\ny Tecnología, N° 9046 del 25 de junio de 2012)\n\n\n\n\n\n            En ejercicio de las facultades que les confieren los incisos 3) y 18) del artículo 140 y\n146 de la Constitución Política, los artículos 23, 29, 30 y 39 de la Ley de Biodiversidad, Nº 7788\ndel 30 de abril de 1998  y los artículos 30 y siguientes del Reglamento a la Ley de Biodiversidad,\nDecreto Ejecutivo Nº 34433-MINAE del 11 de marzo del 2008.\n\n\n\n\n\n \n\n\n\n\n\nConsiderando:\n\n\n\n\n\n \n\n\n\n\n\n            I.-Que la Ley de Biodiversidad Nº 7788 del 30 de abril de 1998, en su artículo 22 creó\nel Sistema Nacional de Áreas de Conservación (SINAC), como un sistema de gestión y coordinación\ninstitucional, desconcentrado y participativo, que integrará las competencias en materia forestal,\nvida silvestre, áreas protegidas y el Ministerio de Ambiente y Energía(*), con el fin de dictar\npolíticas, planificar y ejecutar procesos dirigidos a lograr la sostenibilidad en el manejo de los\nrecursos naturales de Costa Rica.\n\n\n\n\n\n(*)(Así modificada su denominación por el artículo 11 de la Ley \"Traslado del sector\nTelecomunicaciones del Ministerio de Ambiente, Energía y Telecomunicaciones al Ministerio de Ciencia\ny Tecnología, N° 9046 del 25 de junio de 2012)\n\n\n\n\n\n            II.-Que la Ley de Biodiversidad supra citada, en su artículo 23, inciso 4), crea la\nfigura del Consejo Regional, el cual tiene la tarea de ejercer la administración de las Áreas de\nConservación, integrándose mediante convocatoria pública, realizada por el representante regional\ndel SINAC, a todas las organizaciones no gubernamentales y comunales interesadas, así como a las\nmunicipalidades y las instituciones públicas presentes en el Área.\n\n\n\n\n\n            III.-Que el artículo 30 de la Ley de Biodiversidad, establece las funciones del Consejo\nRegional, donde, entre otras cosas se le asigna la tarea relevante de fomentar la participación de\nlos diferentes sectores del Área en el análisis, la discusión y la búsqueda de soluciones para los\nproblemas regionales relacionados con los recursos naturales y el ambiente que señala la ley.\n\n\n\n\n\n            IV.-Que de conformidad al artículo 12 inciso d) del Reglamento a la Ley de\nBiodiversidad, Decreto Ejecutivo Nº 34433-MINAE publicado en La Gaceta Nº 68 del 08 de abril de\n2008, el Consejo Nacional de Áreas de Conservación (CONAC), en sesión extraordinaria Nº 05-2009\ncelebrada el día 25 de mayo del 2009, mediante Acuerdo Nº 13, aprobó el Reglamento del Consejo\nRegional del Área de Conservación Marina Isla del Coco. Por tanto,\n\n\n\n\n\n \n\n\n\n\n\nDECRETAN:\n\n\n\n\n\nReglamento del Consejo Regional del Área\n\n\n\n\n\nde Conservación Marina Isla del Coco\n\n\n\n\n\nCAPÍTULO I\n\n\n\n\n\nDisposiciones generales\n\n\n\n\n\n \n\n\n\n\n\n            Artículo 1º-Este Reglamento norma  la conformación y el funcionamiento del Consejo\nRegional del Área de Conservación Marina Isla del Coco (ACMIC), de acuerdo con los artículos 29 y 30\nde la Ley de la Biodiversidad, Nº 7788 del 30 de abril de 1998.\n\n\n\n\n\nFicha articulo\n\n\n\n\n\n            Artículo 2º-El Consejo Regional del Área de Conservación Marina Isla del Coco, de\nacuerdo con el artículo 29 de la Ley de Biodiversidad Nº 7788, es el órgano del Sistema Nacional de\nÁreas de Conservación, responsable de la administración del Área de Conservación Marina Isla del\nCoco.\n\n\n\n\n\n\n\n \n\n\n\n\n\nFicha articulo\n\n\n\n\n\n            Artículo 3º-El Consejo Regional estará integrado por representantes locales de las\nInstituciones Públicas, de Organismos Gubernamentales y No Gubernamentales, de las Organizaciones\nComunales de la Región, que estén vinculados directa o indirectamente con el desarrollo y manejo del\nACMIC y con la conservación y el desarrollo sostenible de la Región, así como las Municipalidades\ndel área de influencia.\n\n\n\n\n\n\n\n \n\n\n\n\n\nFicha articulo\n\n\n\n\n\n            Artículo 4º-En el Presente Reglamento se utilizarán las siguientes abreviaturas:\n\n\n\n\n\n \n\n\n\n\n\n            ACMIC: Área de Conservación Marina Isla del Coco\n\n\n\n\n\n \n\n\n\n\n\n            CORAC: Consejos Regionales de Áreas de Conservación\n\n\n\n\n\n \n\n\n\n\n\n    CORACMIC: Consejo Regional del Área de Conservación Marina Isla del Coco\n\n\n\n\n\n \n\n\n\n\n\n            FPN: Fundación de Parques Nacionales\n\n\n\n\n\n \n\n\n\n\n\n            MINAE(*): Ministerio de Ambiente y Energía (*)\n\n\n\n\n\n(*)(Así modificada su denominación por el artículo 11 de la Ley \"Traslado del sector\nTelecomunicaciones del Ministerio de Ambiente, Energía y Telecomunicaciones al Ministerio de Ciencia\ny Tecnología, N° 9046 del 25 de junio de 2012)\n\n\n\n\n\n            SINAC: Sistema Nacional de Áreas de Conservación.\n\n\n\n\n\n\n\n \n\n\n\n\n\nFicha articulo\n\n\n\n\n\nCAPÍTULO II\n\n\n\n\n\n \n\n\n\n\n\nDe los fines\n\n\n\n\n\n \n\n\n\n\n\n            Artículo 5º-El Consejo Regional del ACMIC tendrá los siguientes fines:\n\n\n\n\n\n \n\n\n\n\n\na. Garantizar la eficiencia y la eficacia de la gestión conservacionista y administrativa del ACMIC\nacorde con la legislación ambiental y de la administración pública.\n\n\n\n\n\n \n\n\n\n\n\nd. Proyectar, promocionar y defender los intereses del ACMIC en todas las instancias, tanto a nivel\nnacional como internacional.\n\n\n\n\n\n\n\n \n\n\n\n\n\nFicha articulo\n\n\n\n\n\nCAPÍTULO III\n\n\n\n\n\n \n\n\n\n\n\n \n\n\n\n\n\nDe la estructura administrativa\n\n\n\n\n\n \n\n\n\n\n\n            Artículo 6º-El Consejo Regional del ACMIC estará conformado por los siguientes órganos:\n\n\n\n\n\n \n\n\n\n\n\na. Asamblea General\n\n\n\n\n\n \n\n\n\n\n\nb. Junta Directiva\n\n\n\n\n\n \n\n\n\n\n\nc. Fiscalía\n\n\n\n\n\n \n\n\n\n\n\nd. Secretaría Ejecutiva\n\n\n\n\n\n\n\n \n\n\n\n\n\nFicha articulo\n\n\n\n\n\nCAPÍTULO IV\n\n\n\n\n\n \n\n\n\n\n\nDe la asamblea\n\n\n\n\n\n \n\n\n\n\n\n            Artículo 7º-La Asamblea General del ACMIC es el máximo órgano del CORACMIC, estará\nconformada por representantes de las Instituciones Públicas, de la Municipalidad de Puntarenas, de\nlas Organizaciones no gubernamentales y comunales del área de influencia  del ACMIC en el país.\n\n\n\n\n\n\n\n \n\n\n\n\n\nFicha articulo\n\n\n\n\n\n            Artículo 8º-La Asamblea será convocada públicamente, en forma ordinaria cada dos años,\nen el mes de junio, para conocer los informes de Junta Directiva, de la Fiscalía y elegir a los\nmiembros de la Junta Directiva acorde con el artículo 12 de este Reglamento y extraordinariamente\ncuando sea necesario, para conocer informes y asuntos específicos que someterá a su conocimiento la\nJunta o la Fiscalía o el 25% de los asambleístas. Serán presididas por el Presidente del Consejo y\nen su ausencia por el Vicepresidente. El quórum en primera convocatoria será del 51% de los\nacreditados a la hora fijada y en segunda convocatoria con los miembros presentes treinta minutos\ndespués.\n\n\n\n\n\n\n\n \n\n\n\n\n\nFicha articulo\n\n\n\n\n\n            Artículo 9º-Las Instituciones y Organizaciones presentes en la Junta Directiva  deberán\nacreditar un representante y un suplente. El suplente institucional u organizacional representará al\ntitular con derecho a voz y voto, en su ausencia, tanto en las asambleas, como en la Junta\nDirectiva, en caso de ser electo.\n\n\n\n\n\n\n\n \n\n\n\n\n\nFicha articulo\n\n\n\n\n\n            Artículo 10.-El CORACMIC convocará a Asamblea Pública según lo dispuesto en el artículo\n8 del presente Reglamento. Corresponderá al Secretario Ejecutivo realizar la respectiva\nconvocatoria.\n\n\n\n\n\n\n\n \n\n\n\n\n\nFicha articulo\n\n\n\n\n\n            Artículo 11.-La acreditación de Asambleísta será realizada ante la Secretaría Ejecutiva\ndel CORACMIC por las instituciones y organizaciones no gubernamentales, comunales y la Municipalidad\nde Puntarenas, cada dos años, una vez que haya sido realizada la Asamblea General. Cada entidad\nreportará en documento firmado y sellado, los nombres, calidades y posiciones de los representantes,\nésta tendrá vigencia de dos años, debiendo ser renovada para cada Asamblea Anual. La acreditación de\nlos Asambleístas se hará ante la Secretaría Ejecutiva del Consejo, representada por la Dirección del\nACMIC.\n\n\n\n\n\n\n\n \n\n\n\n\n\nFicha articulo\n\n\n\n\n\n            Artículo 12.-Serán Funciones de la Asamblea:\n\n\n\n\n\n \n\n\n\n\n\na. Nombrar a los miembros de la Junta Directiva y al Fiscal.\n\n\n\n\n\n \n\n\n\n\n\nb. Conocer y aprobar el informe anual de la Junta Directiva y de la Fiscalía.\n\n\n\n\n\n \n\n\n\n\n\nc. Conocer y aprobar asuntos específicos que someta a la Junta Directiva.\n\n\n\n\n\n \n\n\n\n\n\nd. Mantenerse informada sobre las actividades que realiza la Junta Directiva y el ACMIC.\n\n\n\n\n\n \n\n\n\n\n\ne. Proponer políticas, planes y proyectos de interés para el ACMIC y para la Región.\n\n\n\n\n\n\n\n \n\n\n\n\n\nFicha articulo\n\n\n\n\n\nCAPÍTULO V\n\n\n\n\n\n \n\n\n\n\n\nDe la junta directiva\n\n\n\n\n\n \n\n\n\n\n\n            Artículo 13.-Integración de la Junta Directiva.\n\n\n\n\n\n \n\n\n\n\n\n1. La Junta Directiva estará integrada por siete miembros, con  derecho a voz y voto y un fiscal. \nCinco de sus miembros y el fiscal, electos por mayoría simple en la Asamblea General cada cuatro\naños y durarán en su función el periodo de tiempo según el artículo 12 del presente Reglamento,\npodrán ser reelectos una sola vez. El Director (a) del ACMIC ejercerá la Secretaría Ejecutiva\npermanentemente.\n\n\n\n\n\n \n\n\n\n\n\n2. El representante de la Municipalidad de Puntarenas será designado por acuerdo del Consejo\nMunicipal  y no por la Asamblea.\n\n\n\n\n\n \n\n\n\n\n\n3. En la primera sesión del Consejo Regional se integrará una Junta Directiva formada por un\nPresidente (a), un Vicepresidente (a), un Tesorero(a), un Secretario (a), dos Vocales y un (a)\nFiscal, cuyas funciones son:\n\n\n\n\n\n \n\n\n\n\n\nPresidente(a): Presidir las Asambleas y las sesiones de la Junta; representar al Consejo en las\nactividades internas del ACMIC y en las de proyección del Área de Conservación en la Región, así\ncomo ante los entes públicos y privados; velar porque el Consejo Regional cumpla las políticas,\nleyes y reglamentos relativos a su función, según lo establece el ordenamiento jurídico y técnico\nvinculante al SINAC;  rendir informes al Consejo Regional, cuando sean requeridos y firmar las actas\ndel Consejo Regional. En su ausencia será representado por el vicepresidente, en caso de que éste\ntambién se encuentre ausente será representado por el I vocal y en último caso por el II vocal.\n\n\n\n\n\n \n\n\n\n\n\nVicepresidente(a): Ejercerá, en ausencia del presidente las mismas funciones que éste.\n\n\n\n\n\n \n\n\n\n\n\nSecretario(a): Colaborar con la Secretaría Ejecutiva; contribuir en las convocatorias que se\nrequieran; mantener una permanente comunicación con los consejos locales y demás integrantes del\nCORAC y contribuir en la elaboración del acta.\n\n\n\n\n\n \n\n\n\n\n\nTesorero(a): Revisar el presupuesto anual del Consejo Regional en función del Plan de Trabajo y\npresentarlo a la Dirección previa aprobación de la Junta Directiva. Mantener un registro de gastos y\nbrindar un informe trimestral a la Junta Directiva y anual a la  asamblea del CORACMIC. Así como lo\nreferente al artículo 30, inciso 5 de la Ley de Biodiversidad.\n\n\n\n\n\n \n\n\n\n\n\nVocales: En su orden descendente suplirán a los demás directivos en su ausencia, integrarán las\ncomisiones y representarán al Consejo Regional y al ACMIC en cualquier función que se les asigne.\n\n\n\n\n\n \n\n\n\n\n\n4. La Junta Directiva de CORACMIC se reunirá ordinariamente al menos una vez al mes y\nextraordinariamente cuando la Presidencia o el 51% (cincuenta y uno por ciento) de los miembros así\nlo soliciten al Secretario Ejecutivo. La convocatoria será realizada por el Secretario Ejecutivo del\nCORACMIC según lo dispone el artículo 40 del Reglamento a la Ley de Biodiversidad. El calendario y\nhora de las sesiones se definirán en la primera sesión. La agenda la elaborarán en forma conjunta\nla  Presidencia y la Secretaría y se entregará con anticipación a los Directivos. Los acuerdos se \naprobarán por mayoría simple y en caso de empate el Presidente ejerce el doble voto. Fomentar la participación de los diferentes sectores del Área, en el análisis, la discusión y la\nbúsqueda de soluciones para los problemas regionales relacionados con los recursos naturales y el\nambiente.\n\n\n\n\n\n \n\n\n\n\n\nd. Presentar al Consejo Nacional de Áreas de Conservación la propuesta para el nombramiento del\nDirector(a) del Área, mediante una terna.\n\n\n\n\n\n \n\n\n\n\n\ne. Aprobar las estrategias, las políticas, los lineamientos, las directrices, los planes y los\npresupuestos específicos del ACMIC, a propuesta del Director.\n\n\n\n\n\n \n\n\n\n\n\nf.  Definir los asuntos específicos para el manejo del área y someterlos al Consejo Nacional para su\naprobación.\n\n\n\n\n\n \n\n\n\n\n\ng. Decidir, conjuntamente con el Director del ACMIC, sobre la administración de los fondos\npatrimoniales, donaciones específicas y los ingresos provenientes de la venta de servicios.\n\n\n\n\n\n \n\n\n\n\n\nh. Aprobar el presupuesto anual y los reglamentos de funcionamiento para los organismos propios del\nConsejo Regional.\n\n\n\n\n\n \n\n\n\n\n\ni.  Coordinar con las diferentes instancias del ACMIC la organización de actividades para la\nconservación del patrimonio socio-cultural y natural dentro del ACMIC y en la región de influencia.\n\n\n\n\n\n \n\n\n\n\n\nj.  Motivar la organización de las comunidades y promover la participación de grupos organizados en\nlas labores que desarrolla el ACMIC.\n\n\n\n\n\n \n\n\n\n\n\nk. Canalizar información y promover su divulgación en todas las esferas de acción del ACMIC.\n\n\n\n\n\n \n\n\n\n\n\nl.  Supervisar la labor del Director y del órgano de administración financiera establecidos.\n\n\n\n\n\n \n\n\n\n\n\nm.  Aprobar, en primera instancia, lo referente a las concesiones y contratos de servicios que\nestipula el artículo 39 de la Ley de Biodiversidad.\n\n\n\n\n\n \n\n\n\n\n\nn. Designar de su seno a un representante ante el Consejo Nacional de Áreas de Conservación.\n\n\n\n\n\n \n\n\n\n\n\no. Propiciar la participación de representantes del ACMIC en las Comisiones Ambientales de las\nMunicipalidades de Puntarenas, Quepos, entre otras.\n\n\n\n\n\n \n\n\n\n\n\np.   "body_en_text": "Regulation of the Regional Council of the Cocos Island Marine Conservation Area\n\nNo. 35542-MINAE(*)\n\n(*)(Thus modified its denomination by Article 11 of Law “Transfer of the Telecommunications Sector from the Ministry of Environment, Energy and Telecommunications to the Ministry of Science and Technology,” No. 9046 of June 25, 2012)\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF ENVIRONMENT AND ENERGY(*)\n\n(*)(Thus modified its denomination by Article 11 of Law “Transfer of the Telecommunications Sector from the Ministry of Environment, Energy and Telecommunications to the Ministry of Science and Technology,” No. 9046 of June 25, 2012)\n\nIn exercise of the powers conferred by subsections 3) and 18) of Article 140 and Article 146 of the Political Constitution, Articles 23, 29, 30, and 39 of the Biodiversity Law, No. 7788 of April 30, 1998, and Articles 30 and following of the Regulation to the Biodiversity Law, Decreto Ejecutivo No. 34433-MINAE of March 11, 2008.\n\nConsidering:\n\nI.—That the Biodiversity Law No. 7788 of April 30, 1998, in its Article 22 created the National System of Conservation Areas (SINAC), as a decentralized and participatory institutional management and coordination system, which will integrate competencies in forestry, wildlife, protected areas, and the Ministry of Environment and Energy(*), for the purpose of issuing policies, planning, and executing processes aimed at achieving sustainability in the management of the natural resources of Costa Rica.\n\n(*)(Thus modified its denomination by Article 11 of Law “Transfer of the Telecommunications Sector from the Ministry of Environment, Energy and Telecommunications to the Ministry of Science and Technology,” No. 9046 of June 25, 2012)\n\nII.—That the Biodiversity Law cited above, in its Article 23, subsection 4), creates the figure of the Regional Council (Consejo Regional), which has the task of exercising the administration of the Conservation Areas, being integrated through public call (convocatoria pública), made by the regional representative of SINAC, to all interested non-governmental and community organizations, as well as to the municipalities and public institutions present in the Area.\n\nIII.—That Article 30 of the Biodiversity Law establishes the functions of the Regional Council (Consejo Regional), where, among other things, it is assigned the relevant task of fostering the participation of the different sectors of the Area in the analysis, discussion, and search for solutions to regional problems related to the natural resources and the environment as indicated by the law.\n\nIV.—That in accordance with Article 12, subsection d) of the Regulation to the Biodiversity Law, Decreto Ejecutivo No. 34433-MINAE published in La Gaceta No. 68 of April 8, 2008, the National Council of Conservation Areas (CONAC), in extraordinary session No. 05-2009 held on May 25, 2009, through Agreement No. 13, approved the Regulation of the Regional Council of the Cocos Island Marine Conservation Area (Reglamento del Consejo Regional del Área de Conservación Marina Isla del Coco). Por tanto,\n\nDECREE:\n\nRegulation of the Regional Council of the\n\nCocos Island Marine Conservation Area\n\nCHAPTER I\n\nGeneral Provisions\n\nArticle 1.—This Regulation governs the formation and operation of the Regional Council of the Cocos Island Marine Conservation Area (Área de Conservación Marina Isla del Coco, ACMIC), in accordance with Articles 29 and 30 of the Biodiversity Law, No. 7788 of April 30, 1998.\n\nArticle 2.—The Regional Council of the Cocos Island Marine Conservation Area (Consejo Regional del Área de Conservación Marina Isla del Coco), in accordance with Article 29 of the Biodiversity Law No. 7788, is the body of the National System of Conservation Areas responsible for the administration of the Cocos Island Marine Conservation Area (Área de Conservación Marina Isla del Coco).\n\nArticle 3.—The Regional Council (Consejo Regional) will be composed of local representatives of Public Institutions, Governmental and Non-Governmental Organizations, of the Community Organizations of the Region, that are directly or indirectly linked to the development and management of the ACMIC and to the conservation and sustainable development of the Region, as well as the Municipalities of the area of influence.\n\nArticle 4.—The following abbreviations will be used in this Regulation:\n\nACMIC: Cocos Island Marine Conservation Area (Área de Conservación Marina Isla del Coco)\n\nCORAC: Regional Councils of Conservation Areas (Consejos Regionales de Áreas de Conservación)\n\nCORACMIC: Regional Council of the Cocos Island Marine Conservation Area (Consejo Regional del Área de Conservación Marina Isla del Coco)\n\nFPN: National Parks Foundation (Fundación de Parques Nacionales)\n\nMINAE(*): Ministry of Environment and Energy (Ministerio de Ambiente y Energía)(*)\n\n(*)(Thus modified its denomination by Article 11 of Law “Transfer of the Telecommunications Sector from the Ministry of Environment, Energy and Telecommunications to the Ministry of Science and Technology,” No. 9046 of June 25, 2012)\n\nSINAC: National System of Conservation Areas (Sistema Nacional de Áreas de Conservación).\n\nCHAPTER II\n\nOf the Purposes\n\nArticle 5.—The Regional Council of the ACMIC shall have the following purposes:\n\na. Integrate the different sectors of society, public and private, in order to promote activities for the conservation of natural resources and socio-cultural development in the environment of the ACMIC.\n\nb. Coordinate with the different sectors of society, municipalities, public institutions, non-governmental organizations, in order to promote activities that contribute to the protection of marine and terrestrial resources in the protected area of the ACMIC.\n\nc. Guarantee the efficiency and effectiveness of the conservationist and administrative management of the ACMIC in accordance with environmental and public administration legislation.\n\nd. Promote, publicize, and defend the interests of the ACMIC in all instances, both nationally and internationally.\n\nCHAPTER III\n\nOf the Administrative Structure\n\nArticle 6.—The Regional Council of the ACMIC will be composed of the following bodies:\n\na. General Assembly (Asamblea General)\n\nb. Board of Directors (Junta Directiva)\n\nc. Oversight Office (Fiscalía)\n\nd. Executive Secretariat (Secretaría Ejecutiva)\n\nCHAPTER IV\n\nOf the Assembly\n\nArticle 7.—The General Assembly (Asamblea General) of the ACMIC is the supreme body of the CORACMIC, and will be composed of representatives of Public Institutions, the Municipality of Puntarenas, non-governmental and community organizations of the area of influence of the ACMIC in the country.\n\nArticle 8.—The Assembly (Asamblea) will be publicly convened, ordinarily every two years, in the month of June, to hear the reports of the Board of Directors (Junta Directiva), of the Oversight Office (Fiscalía), and elect the members of the Board of Directors in accordance with Article 12 of this Regulation, and extraordinarily when necessary, to hear reports and specific matters that the Board or the Oversight Office or 25% of the assembly members submit for its consideration. They will be chaired by the President of the Council and in their absence by the Vice President. The quorum on first call shall be 51% of those accredited at the set time and on second call with the members present thirty minutes later.\n\nArticle 9.—The Institutions and Organizations present on the Board of Directors (Junta Directiva) must accredit a representative and an alternate. The institutional or organizational alternate shall represent the principal with full voice and vote rights, in their absence, both in the assemblies and in the Board of Directors, in the event of being elected.\n\nArticle 10.—The CORACMIC shall convene the Public Assembly (Asamblea Pública) as provided in Article 8 of this Regulation. It shall be the responsibility of the Executive Secretary (Secretario Ejecutivo) to make the respective call.\n\nArticle 11.—The accreditation of Assembly Members (Asambleísta) shall be carried out before the Executive Secretariat (Secretaría Ejecutiva) of the CORACMIC by non-governmental and community institutions and organizations and the Municipality of Puntarenas, every two years, once the General Assembly (Asamblea General) has been held. Each entity shall report in a signed and sealed document the names, qualifications, and positions of the representatives; this accreditation shall be valid for two years and must be renewed for each Annual Assembly. The accreditation of Assembly Members shall be done before the Executive Secretariat of the Council, represented by the Directorate of the ACMIC.\n\nArticle 12.—The Functions of the Assembly shall be:\n\na. Appoint the members of the Board of Directors (Junta Directiva) and the Oversight Officer (Fiscal).\n\nb. Hear and approve the annual report of the Board of Directors (Junta Directiva) and of the Oversight Office (Fiscalía).\n\nc. Hear and approve specific matters submitted to the Board of Directors (Junta Directiva).\n\nd. Stay informed about the activities carried out by the Board of Directors (Junta Directiva) and the ACMIC.\n\ne. Propose policies, plans, and projects of interest to the ACMIC and the Region.\n\nCHAPTER V\n\nOf the Board of Directors\n\nArticle 13.—Integration of the Board of Directors (Junta Directiva).\n\n1. The Board of Directors shall be composed of seven members, with voice and voting rights, and an oversight officer (fiscal). Five of its members and the oversight officer are elected by simple majority in the General Assembly (Asamblea General) every four years and shall serve for the period of time according to Article 12 of this Regulation, and may be reelected only once. The Director of the ACMIC shall permanently exercise the Executive Secretariat (Secretaría Ejecutiva).\n\n2. The representative of the Municipality of Puntarenas shall be designated by agreement of the Municipal Council and not by the Assembly.\n\n3. In the first session of the Regional Council (Consejo Regional), a Board of Directors (Junta Directiva) shall be formed consisting of a President, a Vice President, a Treasurer, a Secretary, two Vocal Members, and an Oversight Officer (Fiscal), whose functions are:\n\nPresident: Preside over the Assemblies and sessions of the Board; represent the Council in the internal activities of the ACMIC and in those projecting the Conservation Area in the Region, as well as before public and private entities; ensure that the Regional Council complies with the policies, laws, and regulations related to its function, as established by the legal and technical framework binding on SINAC; render reports to the Regional Council when required and sign the minutes of the Regional Council. In their absence, they shall be represented by the vice president; in the event that the latter is also absent, they shall be represented by the I Vocal Member and ultimately by the II Vocal Member.\n\nVice President: Shall exercise, in the absence of the president, the same functions as the latter.\n\nSecretary: Collaborate with the Executive Secretariat (Secretaría Ejecutiva); contribute to the calls for meetings that are required; maintain permanent communication with the local councils and other members of the CORAC and contribute to the drafting of the minutes.\n\nTreasurer: Review the annual budget of the Regional Council (Consejo Regional) based on the Work Plan and submit it to the Directorate upon prior approval of the Board of Directors (Junta Directiva). Maintain a record of expenses and provide a quarterly report to the Board of Directors and an annual report to the assembly of the CORACMIC. As well as matters related to Article 30, subsection 5 of the Biodiversity Law.\n\nVocal Members: In descending order, they shall substitute for the other directors in their absence, join the committees, and represent the Regional Council (Consejo Regional) and the ACMIC in any function assigned to them.\n\n4. The Board of Directors (Junta Directiva) of CORACMIC shall meet ordinarily at least once a month and extraordinarily when the Presidency or 51% (fifty-one percent) of the members so request of the Executive Secretary (Secretario Ejecutivo). The call shall be made by the Executive Secretary of the CORACMIC as provided in Article 40 of the Regulation to the Biodiversity Law. The calendar and time of the sessions shall be defined in the first session. The agenda shall be prepared jointly by the Presidency and the Secretariat and shall be delivered in advance to the Directors. Agreements shall be approved by simple majority and in case of a tie, the President exercises a double vote. Minutes shall be drawn up for each session and shall be reviewed at the next session.\n\n5. Attendance at sessions by all members shall be mandatory.\n\nArticle 14.—All representatives elected to the Board of Directors (Junta Directiva) shall be replaced in their absence, at meetings, by the corresponding alternate.\n\nArticle 15.—The functions established in Article 30 of the Biodiversity Law for the CORACMIC shall be complemented by those assigned to the ACMIC and which are detailed below:\n\na. Ensure the application of policies on the matter.\n\nb. Ensure the integration of community needs into the plans and activities of the Conservation Area.\n\nc. Foster the participation of the different sectors of the Area in the analysis, discussion, and search for solutions to regional problems related to natural resources and the environment.\n\nd. Submit to the National Council of Conservation Areas the proposal for the appointment of the Director of the Area, through a shortlist (terna).\n\ne. Approve the strategies, policies, guidelines, directives, plans, and specific budgets of the ACMIC, upon proposal of the Director.\n\nf. Define specific matters for the management of the area and submit them to the National Council for approval.\n\ng. Decide, jointly with the Director of the ACMIC, on the administration of trust funds (fondos patrimoniales), specific donations, and income from the sale of services.\n\nh. Approve the annual budget and the operating regulations for the self-regulating bodies of the Regional Council (Consejo Regional).\n\ni. Coordinate with the different instances of the ACMIC the organization of activities for the conservation of the socio-cultural and natural heritage within the ACMIC and in the region of influence.\n\nj. Motivate the organization of communities and promote the participation of organized groups in the work carried out by the ACMIC.\n\nk. Channel information and promote its dissemination in all spheres of action of the ACMIC.\n\nl. Supervise the work of the Director and the established financial administration body.\n\nm. Approve, in the first instance, matters related to the concessions and service contracts stipulated in Article 39 of the Biodiversity Law.\n\nn. Designate from within its membership a representative to the National Council of Conservation Areas.\n\no. Foster the participation of representatives of the ACMIC in the Environmental Commissions of the Municipalities of Puntarenas, Quepos, among others.\n\np. Any other function assigned by national legislation or the National Council.\n\nArticle 16.—For the fulfillment of its functions, the Board of Directors (Junta Directiva) shall form working committees, which shall study and render reports on matters within their competence within the timeframes previously stipulated by the Board of Directors.\n\nCHAPTER VI\n\nOf the Council's Oversight Office\n\nArticle 17.—The Oversight Officer (Fiscal) of the Regional Council (Consejo Regional) shall be appointed by the General Assembly (Asamblea General) for a term of four years, and may be reelected only once.\n\nArticle 18.—The Oversight Officer (Fiscal) must attend all sessions of the Board of Directors (Junta Directiva), with the right to speak but without voting rights, and participate in the sessions of the Scientific-Technical Committee (Comité Científico - Técnico); likewise, they must be regularly involved in the administrative management of the ACMIC. In their absence, they shall be represented by the alternate.\n\nArticle 19.—The functions of the Oversight Officer (Fiscal) are:\n\na. Present to the Board of Directors (Junta Directiva) of the Regional Council (Consejo Regional) all matters that come to their knowledge that affect the administration of the ACMIC.\n\nb. Submit an annual report to the General Assembly (Asamblea General).\n\nCHAPTER VII\n\nOf the Executive Secretariat\n\nArticle 20.—The Executive Secretariat (Secretaría Ejecutiva) shall be exercised by the Director of the ACMIC.\n\nArticle 21.—Functions of the Executive Secretariat (Secretaría Ejecutiva).\n\na- Convene ordinary and extraordinary sessions of the Board of Directors (Junta Directiva).\n\nb- Convene the General Assembly (Asamblea General).\n\nc- Draw up the minutes of the sessions of the Regional Council (Consejo Regional) and keep the corresponding minute book updated.\n\nd- Sign the minutes.\n\ne- Keep a file of all documentation issued or sent to the Regional Council (Consejo Regional).\n\nf- Execute, together with the President, the execution of agreements made by the Board of Directors (Junta Directiva).\n\ng- Facilitate the transfer of information throughout the entire structure of the ACMIC.\n\nh- Coordinate the dissemination of activities and information to all bodies of the Council and the member organizations of the Assembly.\n\ni- Keep the Council's file updated, review the minutes prepared by the secretary, and process the respective correspondence.\n\nj- Execute the agreements and resolutions of the CORACMIC.\n\nCHAPTER VIII\n\nFinal Provisions\n\nArticle 22.—Effective as of its publication in the Official Gazette La Gaceta.\n\nGiven at the Presidency of the Republic.—San José, on the twenty-ninth day of July, two thousand nine."
