  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 36574\n\n                        Declara de interés público las actividades tendientes a la investigación,\nconservación y divulgación de la península de Santa Elena en Guanacaste\n\nTexto Completo acta: DC750\n\nN° 36574-MINAET\n\nLA PRESIDENTA DE\nLA REPÚBLICA\n\nY EL MINISTRO DE\nAMBIENTE, ENERGIA\n\nY TELECOMUNICACIONES\n\nDe conformidad con lo dispuesto en los  artículos 50, 140, inciso 3), 18) y 146 de\nla Constitución\n Política, artículos 4º, 11, 25 27 párrafo 1º, 28 párrafo 2º\ninciso b) de la Ley\n General de\nla Administración\n Pública y\nla Convención para\nla Protección del\nPatrimonio Mundial, Cultural y Natural, ratificada mediante Ley 5980 del 16 de\nnoviembre de 1976.\n\nConsiderando:\n\n1º-Que la\n Agenda de Ciencias y Ambiente del Siglo XXI, adoptada por\nla Conferencia de\nAmbiente y Desarrollo de las  Naciones\nUnidas (UNCED, Río de Janeiro, 1992) y ratificada en\nla Cumbre de Desarrollo\nSostenible en Johannesburgo, 2002  y\nla Resolución Nº\n60/192 del 20 de febrero de 2006 adoptada por\nla Asamblea General\ndel Sistema de las Naciones Unidas, que declara el trienio 2007-2009, y\nespecíficamente el 2008 como Año Internacional del Planeta Tierra, reconocen la\nimportancia para la humanidad de la educación y conocimiento de las Ciencias de\nla Tierra como\nherramienta para el uso sostenible de los recursos naturales y para construir\nuna infraestructura esencial para el desarrollo sostenible.\n\n2º-Que la\ngeodiversidad, entendida como la diversidad geológica y geomorfológica, es un\nfactor esencial que condiciona la diversidad biológica, cultural y del paisaje.\nAdemás, de constituir un parámetro que debe ser incluido en la evaluación y\ngestión de las áreas naturales.\n\n3º-Que el patrimonio\ngeológico constituye un patrimonio natural con valores culturales, estéticos,\nde paisaje, económicos y/o intrínsecos que es necesario preservar y transmitir\na las futuras generaciones.\n\n4º-Que en la\nplanificación del desarrollo se subestiman e incluso se ignoran los valores\nintrínsecos, tanto materiales como intangibles, de la geodiversidad, el\npatrimonio geológico y los procesos geológicos presentes en las áreas\nnaturales.\n\n5º-Que\nla Convención para\nla protección del Patrimonio Mundial, Cultural y Natural, reconoce que el\ndeterioro o desaparición de cualquier elemento del patrimonio natural\nconstituye un dañino empobrecimiento del patrimonio de todas las naciones del\nmundo, y que las formaciones geológicas y fisiogeográficas son de gran valor\nuniversal desde el punto de vista de la ciencia y de la conservación del patrimonio\nnatural.\n\n6º-Que\nla Península de\nSanta Elena, Guanacaste, es uno de los pocos sitios en el mundo donde se pueden\nobservar rocas del manto terrestre, que desplazaron más de 50 kilómetros\ndesde las profundidades del planeta Tierra y cuya edad supera los 150 millones\nde años.\n\n7º-Que\nla Península de\nSanta Elena está circunscrita al Área de Conservación Guanacaste, sitio\ndeclarado Patrimonio de la\n Humanidad declarado por\nla UNESCO en el año 1999.\n\n8º-Que el avance\ncientífico ha permitido estudiar a fondo la superficie y litoral de\nla Península de\nSanta Elena, Guanacaste, junto con una espesa y completa secuencia de rocas\nsedimentarias que lo sobreyacen.\n\n9º-Que los arrecifes\nfósiles expuestos en la\n Península de Santa Elena, son uno de los pocos remanentes de mar\nTethys, antiguo mar de la Era\nde los Dinosaurios, cuya fauna ha dado las claves para conocer los orígenes de\nCosta Rica y su contexto y evolución tectónica.\n\n10.-Que estos\nterrenos geológicos se encuentran expuestos en la superficie de\nla Península de Santa\nElena, a lo largo del litoral que cubre las bahías de Cuajiniquil, Santa Elena,\nPlaya Blanca, Potrero Grande, Nancite y Naranjo, así como el Archipiélago de\nlas Islas Murciélago. Estos terrenos cubren el sector delimitado por las\ncoordenadas 10°45' y 10°57' latitud Norte, y 85°40' y 86°00' longitud Oeste.\n\n11.-Que estos son\nhechos de carácter excepcional que deben ser reconocidos como patrimonio\nnatural, científico e histórico de\nla Nación.\n\n12.-Que resulta\naltamente de conveniencia nacional y de interés \npúblico,  promover la\nobservación  y profundizar en el\nentendimiento y estudio de estos hechos y rasgos, así como resaltar la belleza\ngeológica, su valor como patrimonio natural y su potencial turístico y de\ndeleite paisajístico. De la misma manera, tiene un fin educativo, al destacar\nestos conocimientos relacionados con la historia geológica del país y\ndivulgarlos a nivel comunal, nacional y del mundo.\n\n13.-La preservación\nde este patrimonio no conlleva la implementación de medidas o prohibiciones\nadicionales a las ya existentes, ni restringirá el desarrollo de la zona desde\nel punto de vista turístico y económico.\n\n14.-Que el artículo\n50 de la\n Constitución Política establece la obligación del Estado de\ndefender y garantizar un ambiente sano y ecológicamente equilibrado, existiendo\npor lo tanto un interés público y un compromiso del Estado de emitir las\nmedidas jurídicas que ayuden a preservar y conservar ese patrimonio, que pasa a\nser un bien común de la humanidad.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Norm 36574\n\n                        Declares of public interest the activities aimed at the investigation,\nconservation and dissemination of the Santa Elena Peninsula in Guanacaste\n\nFull Text record: DC750\n\nN° 36574-MINAET\n\nTHE PRESIDENT OF\nTHE REPUBLIC\n\nAND THE MINISTER OF\nENVIRONMENT, ENERGY\n\nAND TELECOMMUNICATIONS\n\nIn accordance with the provisions of Articles 50, 140, subsections 3), 18) and 146 of the\nPolitical Constitution, Articles 4, 11, 25, 27 paragraph 1, 28 paragraph 2\nsubsection b) of the General Law of\nPublic Administration and\nthe Convention for\nthe Protection of the World Cultural and Natural Heritage, ratified by Law 5980 of November 16,\n1976.\n\nConsidering:\n\n1º-That the\n Science and Environment Agenda for the 21st Century, adopted by\nthe United Nations Conference on\nEnvironment and Development (UNCED, Rio de Janeiro, 1992) and ratified at\nthe World Summit on Sustainable Development in Johannesburg, 2002, and\nResolution No.\n60/192 of February 20, 2006 adopted by\nthe General Assembly\nof the United Nations System, which declares the triennium 2007-2009, and\nspecifically 2008 as the International Year of Planet Earth, recognize the\nimportance for humanity of education and knowledge of Earth\nSciences as\na tool for the sustainable use of natural resources and to build\nan essential infrastructure for sustainable development.\n\n2º-That\ngeodiversity, understood as geological and geomorphological diversity, is an\nessential factor that conditions biological, cultural, and landscape diversity.\nFurthermore, it constitutes a parameter that must be included in the evaluation and\nmanagement of natural areas.\n\n3º-That geological\nheritage constitutes a natural heritage with cultural, aesthetic,\nlandscape, economic, and/or intrinsic values that must be preserved and transmitted\nto future generations.\n\n4º-That in\ndevelopment planning, the intrinsic values, both material and intangible, of geodiversity,\ngeological heritage, and the geological processes present in natural\nareas are underestimated and even ignored.\n\n5º-That\nthe Convention for\nthe Protection of the World Cultural and Natural Heritage recognizes that the\ndeterioration or disappearance of any element of the natural heritage\nconstitutes a harmful impoverishment of the heritage of all the nations of the\nworld, and that geological and physiogeographical formations are of great universal\nvalue from the point of view of science and the conservation of natural\nheritage.\n\n6º-That\nthe Santa Elena\nPeninsula, Guanacaste, is one of the few sites in the world where rocks\nfrom the Earth's mantle, which displaced more than 50 kilometers\nfrom the depths of planet Earth and whose age exceeds 150 million\nyears, can be observed.\n\n7º-That\nthe Santa Elena\nPeninsula is circumscribed within the Guanacaste Conservation Area, a site\ndeclared World Heritage\n by UNESCO in the year 1999.\n\n8º-That scientific\nadvancement has made it possible to deeply study the surface and coastline of\nthe Santa Elena\nPeninsula, Guanacaste, together with a thick and complete sequence of sedimentary\nrocks that overlie it.\n\n9º-That the fossil\nreefs exposed on the\n Santa Elena Peninsula are one of the few remnants of the Tethys\nSea, an ancient sea from the Age\nof Dinosaurs, whose fauna has provided the keys to understanding the origins of\nCosta Rica and its tectonic context and evolution.\n\n10.-That these\ngeological terrains are exposed on the surface of\nthe Santa Elena\nPeninsula, along the coastline that covers the bays of Cuajiniquil, Santa Elena,\nPlaya Blanca, Potrero Grande, Nancite, and Naranjo, as well as the Murciélago\nIslands Archipelago. These terrains cover the sector bounded by the\ncoordinates 10°45' and 10°57' North latitude, and 85°40' and 86°00' West longitude.\n\n11.-That these are\nexceptional facts that must be recognized as natural, scientific,\nand historical heritage of\nthe Nation.\n\n12.-That it is\nhighly of national convenience and public\ninterest to promote the\nobservation of and to deepen the\nunderstanding and study of these facts and features, as well as to highlight the geological\nbeauty, its value as natural heritage, and its potential for tourism and\nlandscape enjoyment. In the same manner, it serves an educational purpose, by highlighting\nthis knowledge related to the geological history of the country and\ndisseminating it at the community, national, and world levels.\n\n13.-The preservation\nof this heritage does not entail the implementation of additional measures or prohibitions\nto those already existing, nor will it restrict the development of the zone from\na tourist and economic point of view.\n\n14.-That Article\n50 of the\n Political Constitution establishes the State's obligation to\ndefend and guarantee a healthy and ecologically balanced environment; therefore,\nthere exists a public interest and a commitment by the State to issue\nthe legal measures that help to preserve and conserve that heritage, which becomes\na common good of humanity.
