  "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Norm 36699\n\n                        Expands the maximum budgetary expenditure for 2011 for the National Commission for Biodiversity Management\n(CONAGEBIO)\n\nFull Text act: DCCD0\n\nNº 36699-H\n\nTHE PRESIDENT OF\nTHE REPUBLIC\n\nAND THE MINISTER OF FINANCE\n\nBased on the powers conferred by articles 140, subsections 3) and 18), and 146 of\nthe Political Constitution; articles 25, subsection\n1), 27, subsection 1), and 28, subsection 2), paragraph b) of\nLaw Nº 6227, General Law of Public\n Administration, of May 2, 1978, and its amendments;\nLaw Nº 8131, Law of Financial\n Administration of\nthe Republic and Public Budgets, of September 18, 2001, and its amendments; its Regulation, Executive Decree No.\n32988-H-MP-PLAN of January 31, 2006, and its amendments;\nLaw Nº 7788, Biodiversity\n Law of April 30, 1998, and its amendments; Executive Decree Nº\n32452-H of June 29, 2005, and its amendments; and Executive Decree Nº 35821-H\nof March 4, 2010, and its amendments.\n\nConsidering:\n\n1º-Whereas by Law No.\n7788, published in La\n Gaceta Nº 101 of May 27, 1998, and its amendments, the\n National Commission for Biodiversity Management\n(CONAGEBIO) was created as a deconcentrated body of the Ministry of Environment and\nEnergy with instrumental legal personality and functions related to the\nconservation, ecologically sustainable use, and restoration of\nbiodiversity.\n\n2º-Whereas through official communications OT-129-2011 of May 20,\n2011, the National Commission for Biodiversity Management\nrequests to expand the maximum budgetary expenditure assigned for the year 2011 by\nan amount of ¢31,701,005.67 (thirty-one million seven hundred one thousand five\ncolones with sixty-seven céntimos), in order to cover the payment\nof salaries of the Technical Office for the months of September to December.\n\n3º-Whereas with resources from the specific surplus,\nas provided in Article 20 of the Biodiversity Law, the\noperating expenses of the institution will be financed, enabling compliance with\nthe actions indicated in the preceding considering clause.\n\n4º-Whereas through Executive Decree Nº 32452-H,\npublished in La Gaceta\n Nº 130 of July 6, 2005, and its amendments, the\n\"Guideline for the application of Article 6 of Law No. 8131, Law of Financial\n Administration of\nthe Republic and Public Budgets, and the regulation\nof the class of Public Sector revenues called Financing\" was issued.\n\n5º-Whereas regarding the specific surplus, numeral\n9° of the aforementioned Executive Decree Nº 32452-H enables its use\nfor the payment of expenses defined in the purposes established in the\nspecial or legal provisions applicable to such resources.\n\n6º-Whereas through Executive Decree Nº 35821-H,\npublished in La Gaceta\n Nº 55 of March 19, 2010, and its amendments, the General\nBudgetary Policy Guidelines for 2011 were issued for Public Entities,\nMinistries, and other Organs, as applicable, covered by the Scope of\nthe Budgetary Authority,\nestablishing in article 1° of the cited decree the\nmaximum budgetary expenditure for the year 2011 for the institutions covered by\nthe scope of the Budgetary Authority.\n\n7º-Whereas through official communication DM-412-2011 of May 18,\n2011, the Acting Minister of Environment, Energy, and Telecommunications endorses the request raised\nby the National Commission for Biodiversity Management\n(CONAGEBIO).\n\n8º-Whereas due to the foregoing, it is necessary to expand\nthe maximum budgetary expenditure set for the National Commission\nfor Biodiversity Management\n(CONAGEBIO) for the year 2011, increasing it by the sum of ¢31,701,005.67\n(thirty-one million seven hundred one thousand five colones with sixty-seven\ncéntimos).
