la Ley\nde Pesca y Acuicultura Nº 8436 del 1º de marzo del 2005.\n\n Considerando:\n\n1º.- Que el Estado\ngarantizara, defenderá y preservara el derecho que tiene todo ciudadano a un\nambiente sano y ecológicamente equilibrado, lo que conlleva a que se dé un uso\nracional y sostenible de los recursos marítimos, según lo dispone el artículo\n50 de\nla Constitución Política.\n\n2º.- Que el Estado\nejerce una soberanía completa y exclusiva, de conformidad con el artículo 6 de\nla Constitución\n Política, en el espacio aéreo de su territorio, en sus aguas\nterritoriales, en una distancia de doce millas a partir de la línea de bajamar\ny ejerce una jurisdicción especial sobre el mar patrimonial, en una extensión\nde doscientas millas, todo con el fin de proteger, conservar y desarrollar\nsosteniblemente los recursos y riquezas naturales existentes en las aguas, el\nsuelo y el subsuelo de esas zonas.\n\n3º.- Que el Plan\nNacional de Desarrollo, en el área de recursos marinos, establece que el\nGobierno implementará actividades con el fin de dimensionar la importancia\neconómica, ecológica y social de la zona marino costera y sus recursos, y sus\nislas, bajo las premisas del desarrollo sostenible. Asimismo, el artículo\nprimero de la Ley\nde Creación del INCOPESCA establece que\nla Institución\ndeberá atender los lineamientos fijados en dicho Plan.\n\n4º.- Que\nla Ley Nº 8436 Ley de Pesca y\nAcuicultura, vigente desde el 25 de abril del año 2005, en su artículo 40\nestablece que únicamente se permite la pesca del tiburón cuando las especies se\ndesembarquen en los sitios de descargue con las respectivas aletas adheridas al\nvástago de forma natural y que el Instituto Costarricense de Pesca y\nAcuicultura, es el órgano responsable de controlar que las embarcaciones\nnacionales y extranjeras, que se dediquen a la pesca del tiburón, en el mar\nterritorial y en la zona económica exclusiva, realicen esa práctica apegados a\nla legislación vigente además de ser el encargado de coordinar los operativos\npara realizar inspecciones en conjunto con autoridades competentes en estas\nembarcaciones.            \n\n5º.- Que mediante el Decreto\nEjecutivo Nº 36782-MINAET-MAG-MOPT-TUR-SP-S-MTSS, se estableció el Reglamento a\nla Ley de Pesca y\nAcuicultura, el cual dispone en los artículos del 36 al 40 lo referente a la\ncaptura, aprovechamiento y comercialización del Tiburón, reafirmando y\nampliando lo regulado en la ley que reglamenta.\n\n6°.- Que el acuerdo\nAJDIP- 371-2010 emitido por\nla Junta Directiva del Instituto Costarricense de\nPesca y Acuicultura, establece la obligación de descargar en el muelle oficial\npúblico de la terminal pesquera del barrio El Carmen de Puntarenas, a todas las\nembarcaciones de palangre de bandera extranjera que lleguen a puertos del\nPacífico costarricense, bajo la fiscalización de los inspectores de ese\nInstituto, del Servicio Nacional de Salud Animal del Ministerio de Agricultura\ny Ganadería y de la\n Dirección de Aduanas del Ministerio de Hacienda, con la\nfinalidad de mejorar las condiciones de trasparencia, así como los mecanismos\nde supervisión, control y fiscalización de las descargas.\n\nPor tanto,\n\n DECRETAN:\n\n PROHIBICION DE\nALETEO DE TIBURONES, DE IMPORTACIÓN DE ALETAS\n\n Y DE TRANSPORTE, TRASIEGO Y\nPORTACIÓN DE ALETAS DENTRO\n\n DE UNA EMBARCACIÓN\nEN AGUAS JURISDICCIONALES\n\nArtículo 1º-. Likewise, Article one of the Law for the Creation of INCOPESCA establishes that the Institution must attend to the guidelines set forth in said Plan.\n\n4th.- That Law No. 8436, the Fisheries and Aquaculture Law, in force since April 25, 2005, establishes in its Article 40 that shark fishing is only permitted when the species are landed at the unloading sites with the respective fins naturally attached to the body, and that the Costa Rican Institute of Fisheries and Aquaculture is the responsible body for controlling that national and foreign vessels engaged in shark fishing, in the territorial sea and the exclusive economic zone, carry out this practice in accordance with the legislation in force, in addition to being in charge of coordinating operations to conduct inspections jointly with competent authorities on these vessels.\n\n5th.- That through Executive Decree No. 36782-MINAET-MAG-MOPT-TUR-SP-S-MTSS, the Regulation to the Fisheries and Aquaculture Law was established, which provides, in Articles 36 through 40, regarding the capture, utilization, and commercialization of shark, reaffirming and expanding upon what is regulated in the law it regulates.\n\n6th.- That the agreement AJDIP- 371-2010 issued by the Board of Directors of the Costa Rican Institute of Fisheries and Aquaculture establishes the obligation for all foreign-flagged longline vessels arriving at Costa Rican Pacific ports to unload at the official public dock of the fishing terminal of the El Carmen district of Puntarenas, under the supervision of the inspectors of that Institute, the National Animal Health Service of the Ministry of Agriculture and Livestock, and the Customs Directorate of the Ministry of Finance, with the purpose of improving transparency conditions, as well as the mechanisms for supervision, control, and oversight of the landings.\n\nTherefore (Por tanto),\n\nDECREE:\n\nPROHIBITION OF SHARK FINNING (ALETEO DE TIBURONES), OF THE IMPORTATION OF FINS,\nAND OF THE TRANSPORT, TRANSFER (TRASIEGO), AND CARRYING OF FINS WITHIN\nA VESSEL IN JURISDICTIONAL WATERS\n\nArticle 1.- Shark finning (aleteo de tiburón), of any species, is prohibited in the jurisdictional waters of Costa Rica. The total detachment of any of the shark's fins from its body or stem from the moment of the species' capture by any method is prohibited.\n\nArticle file\n\nArticle 2.- The importation of shark fins of any species from other countries is prohibited, unless it is demonstrated by means of a certification issued by the customs authorities of the country of origin that those fins were shipped naturally attached to the shark's stem.\n\nArticle file\n\nArticle 3.- It is the responsibility of the officials of the Costa Rican Institute of Fisheries and Aquaculture and the competent authorities to enforce this provision, for which they must carry out the necessary proceedings and inspections in any place within the national territory and on national or foreign vessels, in order to verify that the captured shark species have all of their respective fins naturally attached to the stem at the time of landing.
