así como establecer las\nmedidas preventivas para evitar el deterioro de los mismos.\n\n2º-Que\nlos incendios forestales provocan al país año a año, cuantiosas pérdidas e\nirreparables daños en los recursos forestales, agrícolas, suelo, aire, agua,\nbelleza escénica y la calidad de vida de los habitantes.\n\n3º-Que\nde conformidad con el artículo 6 inciso k) de la Ley Forestal Nº 7575,\nes competencia de la Administración Forestal del Estado la prevención\ny control de incendios forestales en los terrenos del patrimonio natural del\nEstado y colaborar en la prevención de incendios en plantaciones y bosques\nprivados.\n\n4º-Que\nel artículo 35 de la Ley\n Forestal Nº 7575, declara de interés público todas las\nacciones que se emprendan, a fin de prevenir y extinguir incendios forestales;\nsiendo éstas medidas vinculantes para todas las autoridades del país.\n\n5º-Que el artículo 35 de la\n Ley Forestal Nº 7575 dispone que corresponde a la Administración\n Forestal del Estado (AFE), por medio del Sistema Nacional de\nÁreas de Conservación (SINAC) ordenar y encauzar las acciones tendientes a\nprevenir los incendios forestales.\n\n6º-Las\nacciones de prevención y control de incendios forestales requieren una estrecha\ncoordinación y apoyo conjunto entre las diferentes instituciones públicas,\norganizaciones no gubernamentales y empresas privadas, junto al apoyo de la\nsociedad.\n\n7º-Que\nmediante Decreto Ejecutivo N° 26399-MINAE del 27 de octubre de 1007 y derogado\nmediante el artículo 13 del Decreto Ejecutivo N° 29149 del 13 de noviembre del\n2000, se creó la\n Comisión Nacional sobre Incendios Forestales (CONIFOR), ente\nde coordinación interinstitucional adscrito al Sistema Nacional de Áreas de\nConservación (SINAC) del Ministerio de Ambiente, Energía y Telecomunicaciones\n(MINAET).\n\n8º-Que desde el año 1997, nuestro país ha contado con Estrategias de Manejo\ndel Fuego; en las cuales se han establecido los lineamientos y políticas que\nhan permitido al Estado; atender de forma integral la problemática de los\nincendios forestales en el país; articulando acciones y fortaleciendo la\ngestión para el manejo integral del fuego en las instituciones que conforman la CONIFOR. Por\ntanto,\n\n Decretan:\n\n \"Declárese\n la Estrategia\n Nacional de Manejo Integral \n\n del Fuego en Costa Rica 2012-2021 y su Plan Nacional \n\n de\nAcción como los instrumentos oficiales para la \n\n planificación,\ncontrol, seguimiento y evaluación \n\n en esta materia; se ratifica a la Comisión Nacional\n\n sobre Incendios Forestales (CONIFOR) y se crea  \n\n el Programa Nacional de Manejo Integral del Fuego, \n\n el Comité Técnico Nacional de Incendios Forestales \n\n (COTENA)\ny el Centro Nacional de Manejo \n\n Integral\ndel Fuego (CENMIF) del Sistema\n\n Nacional\nde Áreas de Conservación\"\n\nArtículo 1º-Declárese la Estrategia Nacional\nde Manejo Integral del Fuego en Costa Rica 2012-2021 y su Plan Nacional de Acción,\ncomo los instrumentos oficiales para la planificación, control, seguimiento y\nevaluación en esta materia; en los cuales se establecen las directrices y\nlineamientos a desarrollar a nivel nacional por medio de las instituciones que\nconforman la\n Comisión Nacional sobre Incendios Forestales (CONIFOR).\n\nArtículo\n2º-Se ratifica a la\n Comisión Nacional sobre Incendios Forestales (CONIFOR) creada\nmediante Decreto Ejecutivo N° 26399-MINAE, como la única instancia de\ncoordinación en acciones de manejo integral del fuego; a la cual le\ncorresponderá la formulación, gestión, ejecución, apoyo, seguimiento y\nevaluación de los lineamientos interinstitucionales definidos en la Estrategia Nacional\ny las actividades descritas en el Plan Nacional de Manejo Integral del Fuego.\n\nArtículo\n3º-La\n Comisión Nacional sobre Incendios Forestales (CONIFOR) estará\nintegrada por un representante titular y un suplente, delegados por la máxima\nautoridad de cada una de las siguientes instituciones:\n\na. Sistema Nacional de Áreas de Conservación,\nsiendo el representante titular el Coordinador de dicha Comisión; al que se le\nreconocerá como Coordinador Nacional de la CONIFOR.\n\nb. Benemérito Cuerpo de Bomberos de Costa Rica,\nquien desempeñará la\n Secretaría de la Comisión.\n\nc. Ministerio de Agricultura y Ganadería.\n\nd. Ministerio de Educación Pública.\n\ne. Ministerio de Seguridad Pública.\n\nf.  Comisión Nacional de Prevención de Riesgos y\nAtención de Emergencias.\n\ng. Instituto Costarricense de Electricidad.\n\nh. Instituto de Desarrollo Rural.\n\ni.  Instituto Costarricense de Acueductos y\nAlcantarillados.\n\nj.  Instituto Meteorológico Nacional.\n\nk. Benemérita Cruz Roja Costarricense.\n\nl.  Asociación de Voluntarios para el Servicio en\nlas Áreas Silvestres Protegidas.\n\nArtículo 4º-Los\nintegrantes que se designen para representar a las instituciones señaladas en\nel artículo anterior, en la\n CONIFOR, deberán ser ratificados cada dos años por medio de\nla autoridad respectiva y desempeñarán sus cargos como parte de sus\nresponsabilidades ordinarias; los mismos tendrán disponibilidad y apoyo\ninstitucional para asistir a las diversas actividades convocada.\n\nLos\ndesignados deberán tener experiencia de campo y haber recibido capacitación en\nmanejo del fuego.\n\nArtículo 5º-Le corresponde a las instituciones que conforman la CONIFOR, promover el\ndesarrollo de los programas institucionales y actividades relacionadas al\nmanejo integral del fuego, dentro de las competencias de protección, manejo y\nadministración de los recursos naturales, atinentes a cada una de ellas.\n\nArtículo\n6º-Las funciones de la CONIFOR\nserán las siguientes:\n\na. Realizar reuniones ordinarias y\nextraordinarias, convocadas por el Coordinador Nacional o la Secretaría de la Comisión, debiendo\nsesionar una vez al mes o bien cuando se amerite, de acuerdo al reglamento de\nfuncionamiento vigente.\n\nb. Representar al país en las diversas actividades\nde manejo del fuego que se llevan a cabo a nivel nacional e internacional.\n\nc. Establecer mecanismos de coordinación y\ncontacto en el ámbito nacional e internacional, para aunar esfuerzos y\nfortalecer las acciones de manejo integral del fuego.\n\nd. Fortalecer acciones que permitan la\nincorporación y participación de la sociedad, organizaciones comunales,\norganizaciones gubernamentales y no gubernamentales.\n\ne. Implementar\na nivel de cada institución un Plan Anual de Trabajo, con base en las líneas\nestratégicas descritas en la Estrategia Nacional de Manejo Integral del Fuego\nen Costa Rica.\n\nf.  Implementar y apoyar acciones conjuntas para\nel cumplimiento de las actividades descritas en el Plan Nacional de Acción de\nManejo Integral del Fuego.\n\ng. Establecer acciones de coordinación\ninterinstitucional para mejorar las diversas actividades de manejo integral del\nfuego que se lleven a cabo a nivel nacional.\n\nh. Brindar apoyo humano, técnico, logístico y económico\npara llevar a cabo actividades de prevención, uso adecuado del fuego, atención\nde emergencias por incendios forestales e investigación a nivel nacional; así\ncomo lo requerido por las Comisiones Regionales de Manejo Integral del Fuego.\n\ni.  Apoyar técnica, logística, económicamente y\ncon personal al Centro Nacional de Manejo Integral del Fuego (CENMIF).\n\nj.  Realizar las coordinaciones con los entes\nrespectivos, en caso de solicitarse asistencia técnica o atención de incendios\nforestales en otros países.\n\nk. Aprobar el Plan Anual de Trabajo y de\nContingencia de la CONIFOR.\n\nl.  Dar cumplimiento al reglamento interno de\nfuncionamiento de la CONIFOR.\n\nArtículo 7º-Para el cumplimiento de las\nfunciones de la CONIFOR,\nse tendrán como políticas principales las siguientes:\n\na. Las acciones que se establezcan para atender la\nproblemática de los incendios forestales y quemas agrícolas, se desarrollaran\ndentro del contexto de manejo integral del fuego al amparo del derecho a la\nvida, estructura nacional establecida y el desarrollo sustentable.\n\nb. La\nparticipación estará basada en el compromiso de las instituciones\ngubernamentales y no gubernamentales a nivel nacional e internacional, empresas\nprivadas, gobiernos locales y organizaciones comunales mediante el reconocimiento\ndel rol e integración de la sociedad en el manejo integral del fuego.\n\nc. La toma de\ndecisiones en el manejo integral del fuego se fundamentara en la coordinación\ninterinstitucional, mediante el conocimiento y la experiencia acumulada con\nrelación a la gestión institucional, social, mitigación, investigación y\ntransferencia de conocimientos y operaciones.\n\nd. Promover acciones de apoyo, intercambio,\nasesoría y acompañamiento a la Comisión\n Interinstitucional de Quemas Agrícolas, de acuerdo a lo\nestablecido en el decreto ejecutivo vigente para tal fin.\n\ne. Asesoramiento técnico al Centro de Operaciones\nde Emergencias (COE) ante casos de incendios forestales que se presenten a\nnivel nacional, que amerite la convocatoria de la CONIFOR, ante este ente de\ncoordinación nacional.\n\nArtículo 8º-La Comisión Nacional\nsobre Incendios Forestales (CONIFOR) estará bajo la dirección y supervisión de\nla Dirección Ejecutiva\ndel Sistema Nacional de Áreas de Conservación (SINAC) quien aprobará, apoyará y\nsupervisará las acciones en materia de manejo del fuego, que sean necesarias a\nnivel nacional.\n\nArtículo\n9º-La\n Dirección Ejecutiva del Sistema Nacional de Áreas de\nConservación (SINAC) nombrará al representante de la institución, ante la Comisión Nacional\nsobre Incendios Forestales (CONIFOR), el cual tendrá a cargo las siguientes\nacciones:\n\n.   Gestionar la ejecución y seguimiento de la Estrategia Nacional\nde Manejo Integral del Fuego en Costa Rica y el Plan Nacional de Acción.\n\n.   Establecer lineamientos metodológicos para la\nelaboración y supervisión de los Planes Anuales de Trabajo de las instituciones\nque conforman la CONIFOR,\nen materia de manejo integral del fuego.\n\n.   Apoyar, fortalecer y asesorar la gestión\ntécnica y toma de decisiones de la\n CONIFOR, la Dirección Ejecutiva del SINAC u otro ente o\nJerarca de la Administración Pública que requiera del\nasesoramiento técnico en materia de manejo integral del fuego.\n\n.   Brindar\napoyo, seguimiento y supervisión a las acciones que realicen las Áreas de\nConservación del SINAC en esta temática.\n\n.   Apoyar, supervisar, relevar y transferir el\nmando, así como la toma de decisiones en la atención de incendios forestales,\ncuyo criterio durante la emergencia será vinculante para las respectivas\nautoridades.\n\n.   Fomentar el desarrollo de programas institucionales\nsobre manejo integral del fuego entre las instituciones que conforman la CONIFOR.\n\n.   Apoyar técnicamente y dar criterio durante la\ngestión de búsqueda de recursos que se requieran del ámbito internacional, para\nel manejo integral del fuego.\n\n.   Definir y apoyar las acciones que permitan el\nfortalecimiento y participación de la sociedad en las acciones de manejo\nintegral del fuego.\n\n.   Evaluar y\nproponer lineamientos para la creación y organización de las brigadas de\nbomberos (as) forestales voluntarios.\n\n.   Coordinar el desarrollo y operación del\nCentro Nacional para el Manejo Integral del Fuego (CENMIF).\n\n.   Promover campañas interinstitucionales y\nnacionales sobre manejo integral del fuego.\n\n.   Representar al país en las comisiones o\ncomités, nacionales e internacionales sobre manejo integral del fuego.\n\n.   Supervisar la difusión de las acciones\ninterinstitucionales que se ejecutan en cumplimiento del Plan Nacional de\nManejo Integral del Fuego.\n\nArtículo 10.-La sede de la Coordinación\nde la\n Comisión Nacional sobre Incendios Forestales (CONIFOR) se\nubicará en las oficinas de la Secretaría Ejecutiva del SINAC.\n\nArtículo 11.-Las instituciones miembros de la Comisión Nacional\nsobre Incendios Forestales (CONIFOR) deberán establecer anualmente en\nconcordancia con la\n Estrategia Nacional de Manejo Integral del Fuego, programas\norientados a contribuir a la prevención y control de los incendios forestales y\nquemas agrícolas; optimizando el uso del fuego en los terrenos a nivel\nnacional, dándole seguimiento a las políticas definidas en el presente decreto\nejecutivo.\n\nArtículo\n12.-Las entidades gubernamentales, gobiernos locales, empresa privada,\norganismos no gubernamentales nacionales e internacionales y la sociedad podrán\nproporcionar a la CONIFOR,\nel apoyo que esta requiera en cuanto a las acciones de manejo integral del\nfuego; para ello el SINAC administrará los recursos recibidos para las\nactividades que se deban llevar a cabo a nivel nacional, regional y local.\n\nArtículo\n13.-Con el propósito de atender la problemática de los incendios forestales,\ntodas las entidades Gubernamentales que manejan fondos públicos designaran de\nacuerdo con la normativa jurídica vigente; los recursos humanos, materiales,\nlogísticos, técnicos y económicos necesarios, que las entidades responsables requieran,\ny así puedan llevar a cabo las diversas actividades de Manejo Integral del\nFuego, promoviendo con ello una mejor calidad de vida de la población, la\nprotección y conservación de la biodiversidad.\n\nArtículo\n14.-Se crea el Programa Nacional de Manejo Integral del Fuego como la instancia\ninterna de coordinación y asesoramiento técnico de la Dirección Ejecutiva\ndel SINAC, en acciones de manejo integral del fuego que se realicen a nivel\nnacional por parte del SINAC.\n\nArtículo\n15.-Se crea el Comité Técnico Nacional de Incendios Forestales (COTENA) como la\ninstancia interna de coordinación y asesoramiento técnico a la Dirección Ejecutiva\ndel SINAC, en acciones de manejo integral del fuego que se realicen a nivel\nnacional por parte del Programa Nacional de Manejo del Fuego del SINAC.\n\nArtículo\n16.-El Comité Técnico Nacional de Incendios Forestales (COTENA) estará\nconformado por los funcionarios (as) que funjan como Encargados del Programa\nManejo del Fuego de las Áreas de Conservación que tienen incidencia de incendios\nforestales; cuyo cargo será ocupado por personal que cuente con capacitación en\nmanejo del fuego; la coordinación de COTENA, estará a cargo del Coordinador del\nPrograma Nacional de esta institución.\n\nArtículo\n17.-Créase el Centro Nacional de Manejo Integral del Fuego (CENMIF), el cual se\nubicará en las oficinas de la Secretaría Ejecutiva del SINAC. El CENMIF, tendrá\nun espacio físico, con personal, equipo y tecnología, aportado por el SINAC; el\ncual integrará, manejará y brindará la información de lo que se desarrolle a\nnivel de país en materia de Manejo Integral del Fuego.\n\nArtículo\n18.-Deróguese el Decreto Ejecutivo Nº 31397-MINAE, publicado en La Gaceta Nº 198 del\n15 de octubre del 2003 y el Decreto Ejecutivo Nº 33108-MINAE, publicado en La Gaceta Nº 124 del\n28 de junio del 2006.\n\nArtículo\n19.-Rige a partir de su publicación en el Diario Oficial La Gaceta.\n\nDado en la Presidencia de la República.-San\nJosé, a los nueve días del mes de enero del dos mil trece.", "body_en_text": "throughout the entire text\n\n -\n\n Full Text of Regulation 37480\n\n Declares the national strategy for integrated fire management in Costa Rica and its\nNational Action Plan, ratifies the National Commission on Forest Fires (CONIFOR), and creates\nthe National Program for Integrated Fire Management, the COTENA, CENMIF, of SINAC\n\nFull Text of act: EEB57\n\nNº 37480-MINAET\n\n THE PRESIDENT OF THE REPUBLIC\n\n AND THE\nMINISTER OF ENVIRONMENT, ENERGY AND TELECOMMUNICATIONS\n\nExercising the\npowers conferred by articles 50, 140 subsections 3) and 18), and 146 of the Political\n Constitution; article 6 subsection k) and 35 of the Forestry Law No. 7575\nof February 13, 1996, and article 27 of the General Law of Public\n Administration No. 6227 of May 2, 1978.\n\n Considering:\n\n1º—That it is the duty of the State to ensure the\nprotection and conservation of natural resources, and to establish\npreventive measures to avoid their deterioration.\n\n2º—That\nforest fires cause the country, year after year, substantial losses and\nirreparable damage to forest resources, agriculture, soil, air, water,\nscenic beauty, and the quality of life of the inhabitants.\n\n3º—That\nin accordance with article 6 subsection k) of the Forestry Law No. 7575,\nthe State Forest Administration has competence for the prevention\nand control of forest fires on lands of the State's natural heritage and to collaborate in the prevention of fires on private plantations and forests.\n\n4º—That\narticle 35 of the Forestry\n Law No. 7575 declares all\nactions undertaken to prevent and extinguish forest fires to be of public interest;\nthese measures being binding for all authorities of the country.\n\n5º—That article 35 of the\n Forestry Law No. 7575 provides that it is the responsibility of the State\n Forest Administration (AFE), through the National System of\nConservation Areas (SINAC), to order and direct the actions aimed at\npreventing forest fires.\n\n6º—The\nactions for prevention and control of forest fires require close\ncoordination and joint support among the different public institutions,\nnon-governmental organizations, and private companies, together with the support of\nsociety.\n\n7º—That\nthrough Executive Decree N° 26399-MINAE of October 27, 1997, and repealed\nby article 13 of Executive Decree N° 29149 of November 13,\n2000, the\n National Commission on Forest Fires (CONIFOR) was created, an\ninter-institutional coordination body attached to the National System of Conservation\nAreas (SINAC) of the Ministry of Environment, Energy and Telecommunications\n(MINAET).\n\n8º—That since 1997, our country has had Fire Management Strategies,\nin which the guidelines and policies that have allowed the State to comprehensively address the problem of\nforest fires in the country have been established, articulating actions and strengthening\nmanagement for integrated fire management (manejo integral del fuego) in the institutions that make up CONIFOR. Therefore,\n\n They decree:\n\n \"Declare\n the National Strategy for Integrated Management\n\n of Fire in Costa Rica 2012-2021 and its National\n\n Action Plan as the official instruments for\n\n planning, control, monitoring, and evaluation\n\n in this matter; ratify the National Commission\n\n on Forest Fires (CONIFOR), and create\n\n the National Program for Integrated Fire Management,\n\n the National Technical Committee on Forest Fires\n\n (COTENA),\nand the National Center for Integrated\n\n Fire Management (CENMIF) of the National\n\n System of Conservation Areas\"\n\nArticle 1—Declare the National Strategy\nfor Integrated Fire Management in Costa Rica 2012-2021 and its National Action Plan\nas the official instruments for planning, control, monitoring, and\nevaluation in this matter, in which the directives and\nguidelines to be developed at the national level through the institutions that\nmake up the\n National Commission on Forest Fires (CONIFOR) are established.\n\nArticle\n2—The\n National Commission on Forest Fires (CONIFOR) created\nby Executive Decree N° 26399-MINAE is ratified as the sole\ncoordination body for integrated fire management (manejo integral del fuego) actions, to which\nshall correspond the formulation, management, execution, support, monitoring, and\nevaluation of the inter-institutional guidelines defined in the National Strategy\nand the activities described in the National Plan for Integrated Fire Management.\n\nArticle\n3—The\n National Commission on Forest Fires (CONIFOR) shall be\ncomprised of one permanent representative and one alternate delegate from the highest\nauthority of each of the following institutions:\n\na. National System of Conservation Areas,\nthe permanent representative being the Coordinator of said Commission, who shall be\nrecognized as the National Coordinator of CONIFOR.\n\nb. Benemérito Cuerpo de Bomberos de Costa Rica,\nwho shall hold the\n Secretariat of the Commission.\n\nc. Ministry of Agriculture and Livestock.\n\nd. Ministry of Public Education.\n\ne. Ministry of Public Security.\n\nf.  National Commission for Risk Prevention and\nEmergency Response.\n\ng. Instituto Costarricense de Electricidad.\n\nh. Instituto de Desarrollo Rural.\n\ni.  Instituto Costarricense de Acueductos y\nAlcantarillados.\n\nj.  Instituto Meteorológico Nacional.\n\nk. Benemérita Cruz Roja Costarricense.\n\nl.  Asociación de Voluntarios para el Servicio en\nlas Áreas Silvestres Protegidas.\n\nArticle 4—The\nmembers designated to represent the institutions listed in\nthe previous article in\n CONIFOR must be ratified every two years by\nthe respective authority and shall perform their duties as part of\ntheir ordinary responsibilities; they shall have the availability and\ninstitutional support to attend the various activities convened.\n\nThose\ndesignated must have field experience and have received training in\nfire management (manejo del fuego).\n\nArticle 5—It is the responsibility of the institutions that make up CONIFOR to promote the\ndevelopment of institutional programs and activities related to\nintegrated fire management (manejo integral del fuego), within the competencies of protection, management, and\nadministration of natural resources pertinent to each of them.\n\nArticle\n6—The functions of CONIFOR\nshall be the following:\n\na. Hold ordinary and extraordinary\nmeetings, convened by the National Coordinator or the Secretariat of the Commission, and shall\nmeet once a month or whenever warranted, according to the\ncurrent operating regulations.\n\nb. Represent the country in the various activities\nof fire management (manejo del fuego) carried out at the national and international level.\n\nc. Establish coordination and\ncontact mechanisms at the national and international level to combine efforts and\nstrengthen integrated fire management (manejo integral del fuego) actions.\n\nd. Strengthen actions that allow the\nincorporation and participation of society, community organizations,\ngovernmental and non-governmental organizations.\n\ne. Implement,\nat the level of each institution, an Annual Work Plan based on the strategic\nlines described in the National Strategy for Integrated Fire Management\nin Costa Rica.\n\nf.  Implement and support joint actions for\nthe fulfillment of the activities described in the National Action Plan for\nIntegrated Fire Management.\n\ng. Establish inter-institutional coordination\nactions to improve the various integrated fire management (manejo integral del fuego)\nactivities carried out at the national level.\n\nh. Provide human, technical, logistical, and economic\nsupport to carry out prevention activities, appropriate use of fire, emergency response to forest fires, and research at the national level, as\nwell as what is required by the Regional Commissions for Integrated Fire Management.\n\ni.  Support technically, logistically, economically, and\nwith personnel the National Center for Integrated Fire Management (CENMIF).\n\nj.  Carry out coordination with the respective\nentities in case technical assistance or attention to forest\nfires is requested in other countries.\n\nk. Approve the Annual Work and\nContingency Plan of CONIFOR.\n\nl.  Comply with the internal operating\nregulations of CONIFOR.\n\nArticle 7—For the fulfillment of the\nfunctions of CONIFOR,\nthe following shall be the main policies:\n\na. The actions established to address the\nproblem of forest fires and agricultural burning (quemas agrícolas) shall be developed\nwithin the context of integrated fire management (manejo integral del fuego) under the protection of the right to\nlife, the established national structure, and sustainable development.\n\nb. Participation\nshall be based on the commitment of governmental\nand non-governmental institutions at the national and international level, private\ncompanies, local governments, and community organizations, through the recognition\nof the role and integration of society in integrated fire management (manejo integral del fuego).\n\nc. Decision-making\nin integrated fire management (manejo integral del fuego) shall be based on inter-institutional\ncoordination, through knowledge and accumulated experience in\nrelation to institutional and social management, mitigation, research, and\ntransfer of knowledge and operations.\n\nd. Promote actions of support, exchange,\nadvice, and accompaniment to the Inter-institutional\n Commission on Agricultural Burning, in accordance with what is\nestablished in the current executive decree for that purpose.\n\ne. Technical advice to the Emergency Operations\nCenter (COE) in cases of forest fires that occur at the\nnational level, warranting the convening of CONIFOR before this\nnational coordination body.\n\nArticle 8—The National Commission\non Forest Fires (CONIFOR) shall be under the direction and supervision of\nthe Executive Directorate\nof the National System of Conservation Areas (SINAC), which shall approve, support, and\nsupervise the actions in fire management (manejo del fuego) that are necessary at the\nnational level.\n\nArticle\n9—The\n Executive Directorate of the National System of\nConservation Areas (SINAC) shall appoint the institution's representative to the National Commission\non Forest Fires (CONIFOR), who shall be in charge of the following\nactions:\n\n.   Manage the execution and monitoring of the National Strategy\nfor Integrated Fire Management in Costa Rica and the National Action Plan.\n\n.   Establish methodological guidelines for the\npreparation and supervision of the Annual Work Plans of the institutions\nthat make up CONIFOR\nin matters of integrated fire management (manejo integral del fuego).\n\n.   Support, strengthen, and advise the technical\nmanagement and decision-making of\n CONIFOR, the Executive Directorate of SINAC, or any other entity or\nHead of the Public Administration that requires\ntechnical advice in matters of integrated fire management (manejo integral del fuego).\n\n.   Provide\nsupport, follow-up, and supervision to the actions carried out by the\nConservation Areas of SINAC on this topic.\n\n.   Support, supervise, assume and transfer\ncommand, as well as decision-making in the response to forest fires,\nthe criteria of which during the emergency shall be binding for the respective\nauthorities.\n\n.   Promote the development of institutional programs\non integrated fire management (manejo integral del fuego) among the institutions that make up CONIFOR.\n\n.   Provide technical support and give criteria during the\nprocess of seeking resources required from the international sphere for\nintegrated fire management (manejo integral del fuego).\n\n.   Define and support the actions that allow the\nstrengthening and participation of society in integrated fire management\nactions.\n\n.   Evaluate and\npropose guidelines for the creation and organization of\nvolunteer forest firefighter brigades.\n\n.   Coordinate the development and operation of the\nNational Center for Integrated Fire Management (CENMIF).\n\n.   Promote inter-institutional and\nnational campaigns on integrated fire management (manejo integral del fuego).\n\n.   Represent the country in national and international commissions or\ncommittees on integrated fire management (manejo integral del fuego).\n\n.   Supervise the dissemination of the inter-institutional\nactions carried out in compliance with the National\nIntegrated Fire Management Plan.\n\nArticle 10.—The headquarters of the Coordination\nof the\n National Commission on Forest Fires (CONIFOR) shall be\nlocated at the offices of the Executive Secretariat of SINAC.\n\nArticle 11.—The member institutions of the National Commission\non Forest Fires (CONIFOR) shall establish annually, in\naccordance with the\n National Strategy for Integrated Fire Management, programs\naimed at contributing to the prevention and control of forest fires and\nagricultural burning (quemas agrícolas), optimizing the use of fire on lands at the national\nlevel, and following up on the policies defined in this executive\ndecree.\n\nArticle\n12.—Governmental entities, local governments, private companies,\nnational and international non-governmental organizations, and society may\nprovide CONIFOR\nwith the support it requires regarding integrated fire management (manejo integral del fuego)\nactions; for this purpose, SINAC shall administer the resources received for the\nactivities to be carried out at the national, regional, and local level.\n\nArticle\n13.—For the purpose of addressing the problem of forest fires,\nall Governmental entities that manage public funds shall designate, in\naccordance with current legal regulations, the human, material,\nlogistical, technical, and economic resources necessary that the responsible entities require\nto carry out the various Integrated Fire Management\nactivities, thereby promoting a better quality of life for the population and the\nprotection and conservation of biodiversity.\n\nArticle\n14.—The National Program for Integrated Fire Management is created as the internal\ncoordination and technical advisory body for the Executive Directorate\nof SINAC in integrated fire management (manejo integral del fuego) actions carried out at the national\nlevel by SINAC.\n\nArticle\n15.—The National Technical Committee on Forest Fires (COTENA) is created as the\ninternal coordination and technical advisory body to the Executive Directorate\nof SINAC in integrated fire management (manejo integral del fuego) actions carried out at the national\nlevel by the National Program for Fire Management of SINAC.\n\nArticle\n16.—The National Technical Committee on Forest Fires (COTENA) shall be\ncomprised of the officials who serve as Heads of the Fire Management\nProgram of the Conservation Areas that are affected by forest fires,\nwhose position shall be held by personnel with training in\nfire management (manejo del fuego); the coordination of COTENA shall be in charge of the Coordinator of the\nNational Program of this institution.\n\nArticle\n17.—Create the National Center for Integrated Fire Management (CENMIF), which shall be\nlocated at the offices of the Executive Secretariat of SINAC. The CENMIF shall have\na physical space, with personnel, equipment, and technology provided by SINAC, which\nshall integrate, manage, and provide the information on what is developed at the\ncountry level in matters of Integrated Fire Management.\n\nArticle\n18.—Repeal Executive Decree Nº 31397-MINAE, published in La Gaceta Nº 198 of\nOctober 15, 2003, and Executive Decree Nº 33108-MINAE, published in La Gaceta Nº 124 of\nJune 28, 2006.\n\nArticle\n19.—Shall become effective upon its publication in the Official Newspaper La Gaceta.\n\nGiven at the Presidency of the Republic.—San\nJosé, on the ninth day of January of two thousand thirteen." }
