  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 37809\n\n                        Amplia para la Dirección de Aguas, el gasto presupuestario fijado para el\n2013\n\nTexto Completo acta: F1255\n\nN° 37809-H \n\n    LA PRESIDENTA DE LA REPÚBLICA\n\n    Y EL MINISTRO DE HACIENDA \n\nCon fundamento en las atribuciones que les confieren los artículos 140 incisos 3) y 18) y 146 de la\nConstitución  Política; los artículos 25 inciso 1), 27 inciso 1) y 28 inciso 2) acápite b) de la Ley\nN° 6227, Ley General de la Administración Pública de 2 de mayo de 1978 y sus reformas; la Ley N°\n8131, Ley de la Administración Financiera de la República y Presupuestos Públicos de 18 de setiembre\nde 2001 y sus reformas; su Reglamento, el Decreto Ejecutivo N° 32988-H-MP-PLAN de 31 de enero de\n2006 y sus reformas; la Ley N° 7593, Ley de la Autoridad Reguladora de los Servicios Públicos de 9\nde agosto de 1996 y sus reformas; el Decreto Ejecutivo N° 26635-MINAE de 18 de diciembre de 1997 y\nsu reforma; el Decreto Ejecutivo N° 32452-H de 29 de junio de 2005 y sus reformas; y el Decreto\nEjecutivo N° 37042-H de 13 de marzo de 2012 y sus reformas. \n\n    Considerando: \n\nI.-Que el Transitorio V de la Ley N° 7593, publicada en\nLa Gaceta N° 169 de 5\nde setiembre de 1996 y sus reformas, traslada el Departamento de Aguas del\nServicio Nacional de Electricidad, incluyendo su personal, activos y funciones,\nal Ministerio del Ambiente y Energía, disponiendo que el traslado se haría\nefectivo dentro del plazo máximo de un año después de entrar en vigencia esa\nley, con el propósito de facilitar los ajustes presupuestarios y de otra\nnaturaleza que sean pertinentes. \n\nII.-Que el artículo 1° del Decreto\nEjecutivo N° 26635-MINAE, publicado en La Gaceta N° 22 de 2 de febrero de 1998 y su\nreforma, trasladó con base en el Transitorio V de la citada Ley N° 7593, el\nDepartamento de Aguas al Instituto Meteorológico Nacional del Ministerio del\nAmbiente y Energía, definiendo en el artículo 2° que su misión será la de\nadministrar oportuna y eficientemente los recursos hídricos en todo el\nterritorio nacional, procurando el desarrollo sostenible mediante su\nordenamiento y manejo racional; brindando un servicio excelente. \n\nIII.-Que mediante el oficio\n149-2013-IMN de 5 de abril de 2013, el Director General del Instituto\nMeteorológico Nacional, solicita ampliar el gasto presupuestario máximo\nautorizado para el año 2013 inicialmente en un monto de ¢2.531.887.217,38 (dos\nmil quinientos treinta y un millones ochocientos ochenta y siete mil doscientos\ndiecisiete colones con treinta y ocho céntimos), suma que en forma posterior es\nmodificada, precisando que la ampliación solicitada asciende a\n¢2.523.067.217,38 (dos mil quinientos veintitrés millones sesenta y siete mil\ndoscientos diecisiete colones con treinta y ocho céntimos), para la Dirección de\nAguas. \n\nIV.-Que la ampliación del gasto\npresupuestario máximo solicitada, se requiere para cubrir diferentes\nnecesidades, relacionadas con el fortalecimiento de la capacidad tecnológica y\nadministrativa para la regulación del aprovechamiento y la administración del\nagua, que contribuye con la gestión integral del recurso hídrico a nivel\nnacional, para el año 2013. \n\nV.-Que de la citada cifra, la suma\nde ¢1.737.352.305,00 (mil setecientos treinta y siete millones trescientos\ncincuenta y dos mil trescientos cinco colones exactos), corresponde a recursos\nde superávit libre por lo que de conformidad con lo establecido en el artículo\n7° del Decreto Ejecutivo N° 37042-H, publicado en el Alcance Digital N° 35 a La Gaceta N° 59 de 22\nde marzo de 2012 y sus reformas, corresponde ampliar ese monto vía Decreto\nEjecutivo. Estos recursos se destinarán a la compra de equipo especializado de\ntrabajo de campo para conocer la disponibilidad de agua en nuestros ríos y\notros cuerpos de agua, así como a la compra de estaciones meteorológicas que\ncontribuirían al adecuado desarrollo de las funciones de la Dirección de\nAguas y a la adquisición de vehículos tipo rural. Asimismo, la ampliación\npermitirá el desarrollo de los proyectos denominados \"Sistema Nacional de\nMonitoreo de Agua Subterránea en Tiempo Real\" y \"Sistema Nacional de Gestión\nIntegral de la\n Información del Recurso Hídrico\", ambos considerados\nsustantivos por estar relacionados con una de las funciones primordiales de la Dirección de\nAguas, como lo es la gestión y monitoreo del agua en el país. \n\nVI.-Que del monto anterior no se\nautorizó la suma ¢9.000.000,00 (nueve millones de colones exactos), en gastos\nde la subpartida de \"maquinaria y equipo de producción\" y \"equipo y mobiliario\nde oficina\", para la compra de equipo para la sala de capacitación y\ndesarrollo, la compra de una máquina trituradora de papel de uso eléctrico,\netiquetador para CD, una máquina encuadernadora manual, una gata hidráulica, un\ntaladro para labores de urgencia en el Departamento Informático, toda vez que\ndichos gastos no se consideran prioritarios para el desarrollo de la actividad\nsustantiva de la\n Dirección de Aguas. \n\nVII.-Que mediante el Decreto\nEjecutivo N° 37042-H citado, se emitieron las Directrices Generales de Política\nPresupuestaria para el año 2013, estableciéndose en el artículo 5°, el\nporcentaje máximo en que podría incrementarse el gasto presupuestario de las\nentidades públicas, ministerios y demás órganos, con respecto al del año precedente.\nEn correspondencia con dicha disposición, el monto de gasto presupuestario\nmáximo resultante para la\n Dirección de Aguas, fue establecido en la suma de\n¢928.002.400,00 (novecientos veintiocho millones dos mil cuatrocientos colones\nexactos), el cual fue comunicado mediante el oficio STAP-1515-2012 del 22 de\nagosto de 2012, cifra que no contempla el gasto indicado previamente en este\ndecreto. \n\nVIII.-Que mediante el Decreto\nEjecutivo N° 32452- H, publicado en La Gaceta N° 130 de 6 de julio de 2005 y sus\nreformas, se emite el \"Lineamiento para la aplicación del artículo 6 de la Ley No. 8131 de\nla Administración\n Financiera de la República y Presupuestos Públicos y la regulación\nde la clase de ingresos del Sector Público denominada Financiamiento\". \n\nIX.-Que el artículo 7° del Decreto\ncitado en el considerando anterior, dispone que los recursos de financiamiento\nque provienen de vigencias anteriores -superávit libre- son parte del\npatrimonio de los órganos y las entidades y pueden utilizarlos en períodos\nsubsiguientes para financiar gastos que se refieran a la actividad ordinaria de\néstas, con los cuales se atienda el interés de la colectividad, el servicio\npúblico y los fines institucionales siempre que no tengan el carácter\npermanente o generen una obligación que requiera financiarse a través del\ntiempo, como la creación de plazas para cargos fijos, o cualquier otro\ncompromiso de la misma naturaleza. \n\nX.-Que por lo anterior, resulta\nnecesario ampliar el gasto presupuestario máximo fijado a la Dirección de\nAguas para el año 2013, incrementándolo en la suma de ¢1.728.352.305,00 (mil\nsetecientos veintiocho millones trescientos cincuenta y dos mil trescientos\ncinco colones exactos).   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Regulation 37809\n\n                        Increases the budget expenditure set for the Water Directorate for\n2013\n\nComplete Text of Record: F1255\n\nN° 37809-H \n\n    THE PRESIDENT OF THE REPUBLIC\n\n    AND THE MINISTER OF FINANCE \n\nBased on the powers conferred by articles 140 subsections 3) and 18) and 146 of the\nPolitical Constitution; articles 25 subsection 1), 27 subsection 1) and 28 subsection 2) paragraph b) of Law\nN° 6227, General Law of Public Administration of 2 May 1978 and its amendments; Law N°\n8131, Law of Financial Administration of the Republic and Public Budgets of 18 September\n2001 and its amendments; its Regulation, Executive Decree N° 32988-H-MP-PLAN of 31 January\n2006 and its amendments; Law N° 7593, Law of the Regulatory Authority for Public Services of 9\nAugust 1996 and its amendments; Executive Decree N° 26635-MINAE of 18 December 1997 and\nits amendment; Executive Decree N° 32452-H of 29 June 2005 and its amendments; and Executive\nDecree N° 37042-H of 13 March 2012 and its amendments. \n\n    Considering: \n\nI.—That Transitory Provision V of Law N° 7593, published in\nLa Gaceta N° 169 of 5\nSeptember 1996 and its amendments, transfers the Department of Water of the\nNational Electricity Service, including its personnel, assets, and functions,\nto the Ministry of Environment and Energy, providing that the transfer would become\neffective within a maximum period of one year after the entry into force of that\nlaw, for the purpose of facilitating the pertinent budgetary and other\nadjustments.\n\nII.—That article 1 of Executive\nDecree N° 26635-MINAE, published in La Gaceta N° 22 of 2 February 1998 and its\namendment, transferred, based on Transitory Provision V of the aforementioned Law N° 7593, the\nDepartment of Water to the National Meteorological Institute of the Ministry of\nEnvironment and Energy, defining in article 2 that its mission shall be to\nadminister water resources (recursos hídricos) throughout the national\nterritory in a timely and efficient manner, seeking sustainable development through their\nplanning and rational management; providing excellent service.\n\nIII.—That through official communication\n149-2013-IMN of 5 April 2013, the General Director of the National\nMeteorological Institute, requests to increase the maximum authorized budget expenditure\nfor the year 2013 initially in an amount of ¢2,531,887,217.38 (two\nthousand five hundred thirty-one million eight hundred eighty-seven thousand two hundred\nseventeen colones and thirty-eight céntimos), a sum that is subsequently\nmodified, specifying that the requested increase amounts to\n¢2,523,067,217.38 (two thousand five hundred twenty-three million sixty-seven thousand\ntwo hundred seventeen colones and thirty-eight céntimos), for the Water Directorate.\n\nIV.—That the requested increase in maximum budget\nexpenditure is required to cover different\nneeds, related to the strengthening of technological and\nadministrative capacity for the regulation of water use and administration,\nwhich contributes to the integrated management of water resources (recurso hídrico) at the national\nlevel, for the year 2013.\n\nV.—That of the cited amount, the sum\nof ¢1,737,352,305.00 (one thousand seven hundred thirty-seven million three hundred\nfifty-two thousand three hundred five exact colones), corresponds to free surplus\nresources, and therefore, in accordance with the provisions of article\n7 of Executive Decree N° 37042-H, published in Digital Supplement N° 35 to La Gaceta N° 59 of 22\nMarch 2012 and its amendments, that amount is to be increased via Executive\nDecree. These resources will be allocated to the purchase of specialized field\nwork equipment to ascertain water availability in our rivers and\nother bodies of water, as well as to the purchase of meteorological stations that\nwould contribute to the proper execution of the functions of the Water\nDirectorate and to the acquisition of rural-type vehicles. Likewise, the increase\nwill allow the development of the projects called \"National Real-Time\nGroundwater Monitoring System\" and \"National System for the Integrated\nManagement of Water Resource Information\", both considered\nsubstantive as they are related to one of the primary functions of the Water\nDirectorate, namely the management and monitoring of water in the country.\n\nVI.—That from the previous amount, the sum of\n¢9,000,000.00 (nine million exact colones) was not authorized for expenses\nin the sub-item for \"production machinery and equipment\" and \"office equipment and\nfurniture\", for the purchase of equipment for the training and\ndevelopment room, the purchase of an electric paper shredder,\na CD labeler, a manual binding machine, a hydraulic jack, a\ndrill for emergency tasks in the IT Department, given\nthat these expenses are not considered priorities for the development of the\nsubstantive activity of the Water\nDirectorate.\n\nVII.—That through the cited Executive\nDecree N° 37042-H, the General Budgetary Policy\nGuidelines for the year 2013 were issued, establishing in article 5, the\nmaximum percentage by which the budget expenditure of\npublic entities, ministries, and other bodies could increase, with respect to the preceding year.\nIn accordance with that provision, the resulting maximum budget expenditure\namount for the Water\nDirectorate was established in the sum of\n¢928,002,400.00 (nine hundred twenty-eight million two thousand four hundred exact\ncolones), which was communicated through official communication STAP-1515-2012 of 22\nAugust 2012, an amount that does not contemplate the expenditure previously indicated in this\ndecree.\n\nVIII.—That through Executive\nDecree N° 32452-H, published in La Gaceta N° 130 of 6 July 2005 and its\namendments, the \"Guideline for the application of article 6 of Law No. 8131 on the\nFinancial Administration of the Republic and Public Budgets and the regulation\nof the class of public sector income called Financing\" is issued.\n\nIX.—That article 7 of the Decree\ncited in the preceding considering provides that financing resources\noriginating from prior budget periods -free surplus- are part of the\nequity of the bodies and entities and may be used in subsequent\nperiods to finance expenses related to their ordinary\nactivity, which serve the collective interest, the public\nservice, and institutional purposes, provided they do not have a\npermanent character or generate an obligation that requires financing over\ntime, such as the creation of permanent positions or any\nother commitment of the same nature.\n\nX.—That in view of the foregoing, it is\nnecessary to increase the maximum budget expenditure set for the Water\nDirectorate for the year 2013, increasing it by the sum of ¢1,728,352,305.00 (one\nthousand seven hundred twenty-eight million three hundred fifty-two thousand three hundred\nfive exact colones). Therefore.\n\n    They Decree:\n\nArticle 1.—Increase, for the Water\nDirectorate, the maximum budget expenditure for 2013, established in accordance\nwith Executive Decree N° 37042-H, published in Supplement N° 35 to La Gaceta N° 59 of 22\nMarch 2012 and its amendments, by the sum of ¢1,728,352,305.00 (one\nthousand seven hundred twenty-eight million three hundred fifty-two thousand three hundred\nfive exact colones), for that period.\n\nArticle\n2.—The active administration of the Water\nDirectorate is responsible for compliance with the provisions of article 6 of Law N° 8131, Law of\nthe Financial\nAdministration of the Republic and Public Budgets, published in La Gaceta N° 198 of\n16 October 2001 and its amendments, as well as Executive Decree N°\n32452-H, published in La\nGaceta N° 130 of 6 July 2005 and its amendments.\n\nArticle\n3.—Effective from its publication.\n\nGiven at the Presidency\nof the Republic,\non the twenty-first day of the month of June of the year two thousand thirteen."
