A., cédula jurídica 3-101-447369. es\npropietaria del inmueble que se describe como: Finca inscrita el Folio Real\nnúmero 4-057095- 000, que corresponde al plano catastrado número H-003294-1966,\nsituada el distrito 01 Puerto Viejo, Cantón Sarapiquí, caserío Chilamate, provincia\nde Heredia, con una extensión total de cinco millones noventa y cinco mil\nmetros (509,5 Ha).\n\n3º-Que la finca\ndescrita se enmarca en la zona de vida Bosque muy Húmedo Tropical y se\nencuentra cubierta de bosque denso y humedales.\n\n4º-Que en los inventarios\npreliminares en el área se han identificado al menos 142 especies de árboles,\nde las cuales al menos dos están catalogadas como vulnerables (Minquartia\nguianensis y Dipteryx panamensis) y una se encuentra en peligro crítico de\nextinción (Hymenolobium mesoamericanum H.G. Lima).\n\n5º-Que entre los\nmamíferos no voladores se ha determinado la presencia de al menos 22 especies,\nentre los que se incluyen: el mono congo (Alouatta palliata), el mono\ncolorado (Ateles geofrogii), el mono carablanca (Cebus capucinus),\narmadillo de nueve bandas (Dasypus novemcinctus), Tepezcuintle (Agouti\npaca), Guatuza (Dasyprocta punctata), zorro pelón (Didelphys\nmarsupiales), zorra gris (Uroscyon cinereoargenteus), mapache (Procyon\nlotor), pizote (Nasua narica), martilla (Potos flavus),\ncomadreja (Mustela frenata), perro de agua (Lutra longicaudus),\ntolomuco (Eira barbara), zorrillo hediondo (Conepatus semistriatus),\ncaucel (Leopardus wiedii), perezoso de dos dedos (Choloepus hoffmanni),\nperezoso de tres dedos (Bradypus variegatus), oso hormiguero (Tamandua\nmexicana), ardillas (Sciurus variegatorides, Sciurus granatensis) y\nconejo silvestre (Sylvilagus brasiliensis).\n\n6º-Que la finca\ndescrita sirve de refugio a una importante población de la rana venenosa roja y\nazul (Oophaga pumilio) y la rana venenosa verde y negro (Dendrobates\nauratus), especies que están siendo afectadas directamente por el cambio de\nuso del suelo en la región.\n\n7º-Que la finca\ndescrita sirve de refugio a una gran variedad de especies de aves entre las que\nsobresalen la lapa verde (Ara ambiguus) y el pavón (Crax rubra)\nque se encuentran amenazados de extinción en el país.\n\n8º-Que debido al\nestado actual de los recursos naturales de la región y a la apertura nacional\nhacia la protección de las áreas silvestres y a la diversidad ecológica\nregional, es necesario preservar esa zona en la región como un refugio natural\nimportante para especies flora y fauna silvestre.\n\n9º-Que el manejo\nracional integrado de los recursos naturales del área (bosques, humedales,\nflora, fauna) contribuye a satisfacer las necesidades regionales para la\ninvestigación, recreación, ecoturismo y educación ambiental.\n\n10.-Que la\nadministración de la vida silvestre y la recomendación de medidas que aseguren\nla perpetuidad de las especies es función del Sistema Nacional de Áreas de\nConservación del Ministerio de Ambiente y Energía.\n\n11.-Que mediante\nAcuerdo Nº 14 de la Sesión Ordinaria Nº 10-2012 del 29 de octubre del 2012 el\nConsejo Nacional de Áreas de Conservación (CONAC) aprobó la creación del\nRefugio Nacional de Vida Silvestre Lapa Verde, categoría privada, de\nconformidad al artículo 25 inciso 6) de la Ley de Biodiversidad Nº 7788. A., legal identification number 3-101-447369, is the owner of the property described as: Farm registered under Folio Real number 4-057095-000, corresponding to cadastral map number H-003294-1966, located in district 01 Puerto Viejo, Sarapiquí Canton, village of Chilamate, province of Heredia, with a total area of five million ninety-five thousand meters (509.5 Ha).\n\n3º-That the described farm is situated within the Tropical Wet Forest (Bosque muy Húmedo Tropical) life zone and is covered by dense forest and wetlands.\n\n4º-That preliminary inventories in the area have identified at least 142 tree species, of which at least two are categorized as vulnerable (Minquartia guianensis and Dipteryx panamensis) and one is critically endangered (Hymenolobium mesoamericanum H.G. Lima).\n\n5º-That among the non-flying mammals, the presence of at least 22 species has been determined, including: the mantled howler monkey (mono congo, Alouatta palliata), the spider monkey (mono colorado, Ateles geoffroyii), the white-faced capuchin monkey (mono carablanca, Cebus capucinus), the nine-banded armadillo (armadillo de nueve bandas, Dasypus novemcinctus), the lowland paca (Tepezcuintle, Agouti paca), the Central American agouti (Guatuza, Dasyprocta punctata), the common opossum (zorro pelón, Didelphis marsupialis), the gray fox (zorra gris, Urocyon cinereoargenteus), the raccoon (mapache, Procyon lotor), the white-nosed coati (pizote, Nasua narica), the kinkajou (martilla, Potos flavus), the long-tailed weasel (comadreja, Mustela frenata), the neotropical river otter (perro de agua, Lontra longicaudis), the tayra (tolomuco, Eira barbara), the striped hog-nosed skunk (zorrillo hediondo, Conepatus semistriatus), the margay (caucel, Leopardus wiedii), the two-toed sloth (perezoso de dos dedos, Choloepus hoffmanni), the three-toed sloth (perezoso de tres dedos, Bradypus variegatus), the northern tamandua (oso hormiguero, Tamandua mexicana), squirrels (ardillas, Sciurus variegatoides, Sciurus granatensis), and the forest rabbit (conejo silvestre, Sylvilagus brasiliensis).\n\n6º-That the described farm serves as a refuge for a significant population of the strawberry poison-dart frog (rana venenosa roja y azul, Oophaga pumilio) and the green and black poison dart frog (rana venenosa verde y negro, Dendrobates auratus), species that are being directly affected by land-use change (cambio de uso del suelo) in the region.\n\n7º-That the described farm serves as a refuge for a great variety of bird species, among which the great green macaw (lapa verde, Ara ambiguus) and the great curassow (pavón, Crax rubra), which are threatened with extinction in the country, stand out.\n\n8º-That due to the current state of the region's natural resources and the national opening toward the protection of wild areas and regional ecological diversity, it is necessary to preserve this zone in the region as an important natural refuge for wild flora and fauna species.\n\n9º-That the integrated, rational management of the area's natural resources (forests, wetlands, flora, fauna) contributes to satisfying regional needs for research, recreation, ecotourism, and environmental education.\n\n10.-That the administration of wildlife and the recommendation of measures to ensure the perpetuation of species is a function of the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación) of the Ministry of Environment and Energy (Ministerio de Ambiente y Energía).\n\n11.-That by Agreement No. 14 of Ordinary Session No. 10-2012 of October 29, 2012, the National Council of Conservation Areas (Consejo Nacional de Áreas de Conservación, CONAC) approved the creation of the Lapa Verde National Wildlife Refuge (Refugio Nacional de Vida Silvestre Lapa Verde), private category, in accordance with Article 25, subsection 6) of the Biodiversity Law (Ley de Biodiversidad) No. 7788.
