  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 37849\n\n                        Crea Refugio Nacional de Vida Silvestre Río General, categoría privada\n\nTexto Completo acta: F50E2\n\nNº\n37849-MINAET \n\n    LA\n EL PRESIDENTA\nDE LA REPÚBLICA\n\n    Y EL MINISTRO DE AMBIENTE Y ENERGÍA \n\nEn el ejercicio de las facultades conferidas por el artículo 140, incisos 3), 8), 18) y 146) de la\nConstitución Política y con fundamento en lo dispuesto en los artículos 82 inciso c) y 87 de la Ley\nde Conservación de la Vida Silvestre N° 7317 de 7 de diciembre de 1992; los artículos 32, 34, 35, 36\ny 37 de la Ley Orgánica del Ambiente N° 7554 del 13 de noviembre de 1995; los artículos 58 y 60 de\nla Ley de Biodiversidad N° 7788 del 27 de mayo de 1998; el artículo 6, inciso a) de la Ley Forestal\nN° 7575; los artículos 171 y 172 del Reglamento a la Ley de Conservación de la Vida Silvestre,\nDecreto Ejecutivo N° 32633-MINAE publicado en La Gaceta N° 180 del 20 de setiembre del 2005; los\nartículos 70 inciso e), 71 y 72 del Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo N°\n34433-MINAE del 11 de marzo del 2008 y los artículos 6, 9, 11 y 27 de la Ley General de la\nAdministración Pública N° 6227 del 2 de mayo de 1978. \n\n    Considerando: \n\nI.-Que es interés del Estado costarricense fortalecer\nlas estructuras administrativas en el campo de los recursos naturales, a fin de\ncontar con políticas definidas que garanticen el uso racional de dichos\nrecursos. \n\nII.-Que\nla sociedad denominada Corporación de Desarrollo Agrícola del Monte Sociedad\nAnónima (PINDECO-DEL MONTE), cédula jurídica número tres-ciento uno-diez mil\nochocientos ochenta y dos, representada por el señor Rodrigo Alberto Jiménez\nRímolo, mayor de edad, casado una vez, ingeniero civil, vecino de San José,\nportador de la cédula de identidad número uno- quinientos cuatro-ciento ochenta\ny cinco, quien es Segundo Vicepresidente con facultades de apoderado\ngeneralísimo sin límite de suma de la citada sociedad, cuya personería está vigente\ne inscrita en la\n Sección Mercantil del Registro Público al tomo: sesenta y\ndos, folio: trescientos veinte, asiento: doscientos treinta, solicitó al Área\nde Conservación La\n Amistad Pacífico, Oficina Subregional de Buenos Aires el\nsometimiento voluntario al Régimen de Refugios Privados de Vida Silvestre,\nparte de cuatro inmuebles de su propiedad inscritos en el Registro de la Propiedad Inmueble\na los folios reales que se describen a continuación: Todos del Partido de\nPuntarenas, del Cantón 3 que es Buenos Aires, del Distrito 2 que es Volcán,\nfolios reales número: 1. 6-158380-000, con una medida total de 124 ha 2982,13 dm², cuya\nárea a someter sería de 66 ha\n8682,00 dm2 con plano catastrado P-1205426-2007. 2. 6-155078-000, con una\nmedida total de 602 ha\n6635,84 dm2, cuya área a someter sería de 334 ha 3458,00 dm² con plano\ncatastrado P-1205427- 2007. 3. 6-102318-000, con una medida total de 453 ha 8120, 26 dm2, cuya\nárea a someter sería de 141\n ha 4194,00 dm2 con plano catastrado P-665650-1987. 4.\n6-20295-000, con una medida total de 46 ha 6813,33 dm2, cuya área a someter, sería\nde 11 ha\n6909,00 dm2 con plano catastrado P-1204790-2007. Para una medida total someter\na refugio, de los cuatro inmuebles, correspondiente a 554 ha 3243,00 dm2. \n\nIII.-Que\nlas áreas a someter corresponden a diferentes sectores dentro de las\nplantaciones de pina, donde no se implemento dicha actividad agrícola por ser\nfragmentos remanentes de bosque, dentro de los cuales se incluyen áreas de\nprotección de los Ríos General, Sonador y las Quebradas Cacao, Vueltas,\nSegundo, además de sectores con pendientes que no favorecen al cultivo de la\nfruta, sectores de bosque secundario y/o bosque ripario, sin embargo, hay\nvarias partes que se pueden considerar con estructuras vegetales que varían\nentre charrales y tacotales jóvenes, que cumplen con los parámetros\nestablecidos para incluirse dentro de la definición de bosque que indica la Ley Forestal N° 7575. \n\nIV.-La\nsociedad Corporación de Desarrollo Agrícola del Monte Sociedad Anónima, a\ntravés del representante de la\n Sociedad aceptó expresamente, someter voluntariamente al\nrégimen de Refugio Nacional de Vida Silvestre, categoría privada, los inmuebles\ndichos por un periodo de diez años, según lo establece el artículo 171 inciso\nf) del Decreto Ejecutivo N° 32633-MINAE, prorrogables en forma automática salvo\nsu previa manifestación o de la administración que exprese lo contrario.\n\nV.-Que\ndentro del área objeto de la solicitud existe un gran número de recursos\nfaunísticos (insectos, mamíferos, anfibios, aves y reptiles) así como recursos\nflorísticos que merecen ser conservados racional y sosteniblemente, para\ngarantizar su permanencia dentro de los ecosistemas en que actualmente se\nencuentran. Los inmuebles sometidos al Refugio, fueron dedicados a actividades\nagrícolas en un pasado reciente, y por voluntad de su propietario, serán\ndedicados exclusivamente a la conservación en adelante, por lo que representa\nuna importante área de recuperación de los hábitat naturales y para la\nregeneración de zonas degradadas que servirán para el desarrollo de la flora y\nfauna presente en la zona. \n\nVI.-Que de conformidad con el artículo 87 de la Ley de Conservación de\nla Vida Silvestre, el\nprincipal efecto ambiental que genera la declaratoria de un inmueble bajo este\nrégimen jurídico lo es, que para los efectos de la conservación de los recursos\nnaturales la administración general del refugio corresponde a los propietarios\nde los inmuebles, la cual será supervisada por el Área de Conservación La Amistad Pacífico,\nOficina Subregional de Buenos Aires.\n\nVII.-Que\npor medio de la resolución número ACLA-P-D-039 de las trece horas del día\nveintitrés de enero del año dos mil doce, el Director a. i., del Área de\nConservación La\n Amistad Pacífico, Licenciado Luis Sánchez Arguedas, aceptó la\nsolicitud de sometimiento voluntario que realizó el Segundo Vicepresidente de\nla sociedad Corporación de Desarrollo Agrícola del Monte Sociedad Anónima\n(PINDECO-DEL MONTE), bajo la categoría de Refugio Nacional de Vida Silvestre,\ncategoría privada. \n\nVIII.-Que\ncon la protección de los ecosistemas inmersos dentro del área silvestre\nprotegida a declarar, se logrará la protección y conservación de especies de\nvida silvestre de gran importancia biológica, socioeconómica y en peligro de\nextinción. \n\nIX.-Que\nla administración de la vida silvestre y la recomendación de medidas que\naseguren la perpetuidad de las especies es función de la Dirección General\nde Vida Silvestre del Ministerio del Ambiente y Energía. \n\nX.-Que\nla Ley de\nConservación de la Vida\n Silvestre N° 7317 en su artículo 82 dispone que son refugios\nnacionales de fauna y vida silvestre, los que el Poder Ejecutivo declare o haya\ndeclarado como tales, para la protección e investigación de la flora y la fauna\nsilvestres, en especial de las que se encuentren en vías de extinción. Para\nefecto de clasificarlos, existen tres clases de refugios nacionales de vida\nsilvestre: Refugios de propiedad estatal, Refugios de propiedad mixta y\nRefugios de propiedad privada. \n\nXI.-Que\nanalizada la documentación presentada por Corporación de Desarrollo Agrícola\ndel Monte Sociedad Anónima se determinó que cumplió con lo establecido en el\nartículo 171 del Decreto Ejecutivo N° 32633-MINAE denominado Reglamento a la Ley de Conservación de\nla Vida Silvestre.\n\nXII.-Que\nmediante acuerdo N° 12 de la sesión ordinaria N° 10-2012 del Consejo Nacional\nde Áreas de Conservación (CONAC) aprobó la creación del Refugio Nacional de\nVida Silvestre Río General, categoría privada, de conformidad al artículo 25\ninciso 6) de la Ley\nde Biodiversidad N° 7788. Acuerdo ratificado en sesión ordinaria N° 11-2012 del\n26 de noviembre del 2012. Asimismo, brindarán\ntoda la colaboración necesaria a los funcionarios del SINAC, para las labores\nde control y verificación de las políticas ambientales mediante el Área de\nConservación La\n Amistad Pacífico, así como a los investigadores, estudiantes\ny otros que esporádicamente visiten dicha área en las funciones propias de sus\nrespectivos cargos, estudio e investigaciones. Asimismo se comprometen a\ncumplir con las disposiciones que al efecto señalan la Ley de Conservación de la Vida Silvestre,\nla Ley Forestal, sus respectivos\nReglamentos, así como las demás disposiciones vigentes en materia de\nlegislación ambiental.\n\nArtículo\n3°-Los inmuebles indicados en el artículo primero del presente decreto\nejecutivo, estarán sometidos a la categoría de Refugio Nacional de Vida\nSilvestre, categoría privado, por un período de diez años prorrogables por\nperíodos iguales, para lo cual los propietarios deberán solicitarlo con tres\nmeses de antelación a la finalización de dicho período. \n\nEn\ncaso de no querer mantener dicha categoría de manejo, la propietaria deberá de\nmanifestar su deseo de desafectar las fincas mediante escrito presentado ante\nel Área de Conservación La\n Amistad Pacífico, con no menos de seis meses de anticipación\nal vencimiento del plazo de afectación; para iniciar los trámites\ncorrespondientes a la desafectación de la misma y en todo caso deberán\nrespetarse las limitaciones legales indicadas en la Ley Forestal y en la\ndemás legislación ambiental con respecto al cambio de uso del suelo y a la\nprotección de los ríos.\n\nArtículo\n4°-La administración, vigilancia y mantenimiento de este Refugio y el\ncumplimiento de las disposiciones técnicas que al efecto emita el Área de\nConservación La\n Amistad Pacífico, serán responsabilidad de la propietaria de\nlos inmuebles la sociedad Corporación de Desarrollo Agrícola del Monte Sociedad\nAnónima (PINDECO-DEL MONTE), para lo cual la propietaria deberá enviar al Área\nde Conservación La\n Amistad Pacífico, al menos un informe anual sobre los\ndiferentes aspectos relacionados con los inmuebles y el estado de los recursos\nnaturales dentro del mismo.\n\nArtículo\n5°-La propietaria de las fincas señaladas, gozará de los beneficios e\nincentivos establecidos en la Ley\nde Conservación de la\n Vida Silvestre, para lo cual el Área de Conservación La Amistad Pacífico\ny las dependencias ministeriales involucradas, emitirán los documentos\nnecesarios.\n\nArtículo\n6°-Rige a partir de su publicación en el Diario Oficial La Gaceta.\n\nDado en la Presidencia de la República, a los cinco\ndías del mes de julio del dos mil trece.",
  "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Decree 37849\n\n                        Creates Río General National Wildlife Refuge, private category\n\nComplete Text of file: F50E2\n\nNo.\n37849-MINAET \n\n    THE\n PRESIDENT OF THE REPUBLIC\n\n    AND THE MINISTER OF ENVIRONMENT AND ENERGY \n\nIn exercise of the powers conferred by Article 140, subsections 3), 8), 18) and 146) of the\nPolitical Constitution and based on the provisions of Articles 82 subsection c) and 87 of the\nWildlife Conservation Law No. 7317 of December 7, 1992; Articles 32, 34, 35, 36\nand 37 of the Organic Environmental Law No. 7554 of November 13, 1995; Articles 58 and 60 of\nthe Biodiversity Law No. 7788 of May 27, 1998; Article 6, subsection a) of the Forest Law\nNo. 7575; Articles 171 and 172 of the Regulations to the Wildlife Conservation Law,\nExecutive Decree No. 32633-MINAE published in La Gaceta No. 180 of September 20, 2005;\nArticles 70 subsection e), 71 and 72 of the Regulations to the Biodiversity Law, Executive Decree No.\n34433-MINAE of March 11, 2008 and Articles 6, 9, 11 and 27 of the General Public\nAdministration Law No. 6227 of May 2, 1978. \n\n    Considering: \n\nI.-That it is in the interest of the Costa Rican State to strengthen\nthe administrative structures in the field of natural resources, in order to\nhave defined policies that guarantee the rational use of said\nresources. \n\nII.-That\nthe corporation named Corporación de Desarrollo Agrícola del Monte Sociedad\nAnónima (PINDECO-DEL MONTE), legal identification number three-one hundred one-ten thousand\neight hundred eighty-two, represented by Mr. Rodrigo Alberto Jiménez\nRímolo, of legal age, married once, civil engineer, resident of San José,\nholder of identity card number one- five hundred four-four hundred eighty-\nfive, who is Second Vice President with powers of general unlimited attorney-in-fact\nof the aforementioned corporation, whose legal capacity is current\nand registered in the\n Mercantile Section of the Public Registry at volume: sixty-\ntwo, folio: three hundred twenty, entry: two hundred thirty, requested from the\nLa Amistad Pacífico Conservation Area, Buenos Aires Subregional Office the\nvoluntary submission to the Private Wildlife Refuge Regime,\nof portions of four properties owned by it registered in the Real Property Registry\non the real folios described below: All of the Partido of\nPuntarenas, of Canton 3 which is Buenos Aires, of District 2 which is Volcán,\nreal folio numbers: 1. 6-158380-000, with a total area of 124 ha 2982.13 dm², whose\narea to be submitted would be 66 ha\n8682.00 dm2 with cadastral plan P-1205426-2007. 2. 6-155078-000, with a\ntotal area of 602 ha\n6635.84 dm2, whose area to be submitted would be 334 ha 3458.00 dm² with cadastral\nplan P-1205427-2007. 3. 6-102318-000, with a total area of 453 ha 8120.26 dm2, whose\narea to be submitted would be 141\n ha 4194.00 dm2 with cadastral plan P-665650-1987. 4.\n6-20295-000, with a total area of 46 ha 6813.33 dm2, whose area to be submitted would be\n11 ha\n6909.00 dm2 with cadastral plan P-1204790-2007. For a total submitted\nto the refuge area, of the four properties, corresponding to 554 ha 3243.00 dm2. \n\nIII.-That\nthe areas to be submitted correspond to different sectors within\nthe pineapple plantations, where said agricultural activity was not implemented because they are\nremaining forest fragments (fragmentos remanentes de bosque), which include\nprotection areas of the General and Sonador Rivers and the Cacao, Vueltas,\nand Segundo Streams, in addition to sectors with slopes that do not favor fruit\ncultivation, sectors of secondary forest and/or riparian forest, however, there\nare several parts that can be considered with vegetative structures that vary\nbetween scrubland and young fallow land, which meet the parameters\nestablished to be included within the definition of forest indicated by Forest Law No. 7575. \n\nIV.-The\ncorporation Corporación de Desarrollo Agrícola del Monte Sociedad Anónima,\nthrough the representative of the\n Corporation, expressly accepted to voluntarily submit to\nthe National Wildlife Refuge regime, private category, the\naforementioned properties for a period of ten years, as established in Article 171 subsection\nf) of Executive Decree No. 32633-MINAE, automatically renewable for equal periods unless\nit or the administration expresses otherwise beforehand.\n\nV.-That\nwithin the area subject to the application there is a large number of\nfaunal resources (insects, mammals, amphibians, birds and reptiles) as well as\nfloral resources that deserve to be conserved rationally and sustainably, to\nguarantee their permanence within the ecosystems where they currently\nare found. The properties submitted to the Refuge, were dedicated to agricultural\nactivities in the recent past, and by the will of their owner, they will be\ndedicated exclusively to conservation henceforth, thus representing\nan important recovery area for natural habitats and for the\nregeneration of degraded zones that will serve for the development of the flora and\nfauna present in the area. \n\nVI.-That in accordance with Article 87 of the Wildlife Conservation\nLaw, the\nmain environmental effect generated by the declaration of a property under this\nlegal regime is that, for the purposes of the conservation of natural\nresources, the general administration of the refuge corresponds to the owners\nof the properties, which will be supervised by the La Amistad Pacífico Conservation Area,\nBuenos Aires Subregional Office.\n\nVII.-That\nthrough resolution number ACLA-P-D-039 at one o'clock in the afternoon on\nJanuary twenty-third of the year two thousand twelve, the Acting Director of the\nLa Amistad Pacífico Conservation Area, Licentiate Luis Sánchez Arguedas, accepted the\nrequest for voluntary submission made by the Second Vice President of\nthe corporation Corporación de Desarrollo Agrícola del Monte Sociedad Anónima\n(PINDECO-DEL MONTE), under the category of National Wildlife Refuge,\nprivate category. \n\nVIII.-That\nwith the protection of the ecosystems immersed within the protected wild area\nto be declared, the protection and conservation of wildlife species\nof great biological, socioeconomic importance and in danger of\nextinction will be achieved. \n\nIX.-That\nthe administration of wildlife and the recommendation of measures that\nensure the perpetuity of the species is a function of the General Directorate\nof Wildlife of the Ministry of Environment and Energy. \n\nX.-That\nWildlife\nConservation Law No. 7317 in its Article 82 provides that national\nwildlife refuges are those that the Executive Branch declares or has\ndeclared as such, for the protection and research of wild flora and\nfauna, especially those that are endangered. For\nclassification purposes, there are three classes of national wildlife\nrefuges: State-owned Refuges, Mixed-ownership Refuges and\nPrivate-ownership Refuges. \n\nXI.-That\nupon analyzing the documentation presented by Corporación de Desarrollo Agrícola\ndel Monte Sociedad Anónima, it was determined that it complied with the provisions of\nArticle 171 of Executive Decree No. 32633-MINAE named Regulations to the Wildlife\nConservation Law.\n\nXII.-That\nby agreement No. 12 of ordinary session No. 10-2012 of the National Council\nof Conservation Areas (CONAC), the creation of the Río General National\nWildlife Refuge, private category, was approved in accordance with Article 25\nsubsection 6) of the Biodiversity\nLaw No. 7788. Agreement ratified in ordinary session No. 11-2012 of\nNovember 26, 2012. They will also provide\nall necessary collaboration to SINAC officials, for control\nand verification tasks of environmental policies through the La\nAmistad Pacífico Conservation Area, as well as to researchers, students\nand others who sporadically visit said area in the functions proper to their\nrespective positions, studies and research. They also commit to\ncomplying with the provisions indicated for this purpose by the Wildlife Conservation Law,\nthe Forest Law, their respective\nRegulations, as well as other current provisions on\nenvironmental legislation.\n\nArticle\n3°-The properties indicated in the first article of this executive\ndecree, will be submitted to the category of National Wildlife\nRefuge, private category, for a period of ten years renewable for\nequal periods, for which the owners must request it three\nmonths in advance of the end of said period. \n\nIn\nthe event of not wanting to maintain said management category, the owner must\nexpress their desire to disaffect the farms by written notice presented to\nthe La Amistad Pacífico Conservation Area, no less than six months in advance\nof the expiration date of the affected status; to initiate the procedures\ncorresponding to its disaffectation, and in any case the\nlegal limitations indicated in the Forest Law and in the\nrest of the environmental legislation regarding land-use change (cambio de uso del suelo) and the\nprotection of rivers must be respected.\n\nArticle\n4°-The administration, surveillance and maintenance of this Refuge and the\ncompliance with the technical provisions issued for this purpose by the\nLa Amistad Pacífico Conservation Area, will be the responsibility of the owner of\nthe properties, the corporation Corporación de Desarrollo Agrícola del Monte Sociedad\nAnónima (PINDECO-DEL MONTE), for which the owner must send to the\nLa Amistad Pacífico Conservation Area, at least one annual report on the\ndifferent aspects related to the properties and the state of the natural\nresources within it.\n\nArticle\n5°-The owner of the indicated farms will enjoy the benefits and\nincentives established in the Wildlife\nConservation\n Law, for which the La Amistad Pacífico Conservation Area\nand the ministerial offices involved will issue the necessary\ndocuments.\n\nArticle\n6°-It shall be effective as of its publication in the Official Gazette La Gaceta.\n\nGiven at the Presidency of the Republic, on the fifth\nday of the month of July of two thousand thirteen."
