Para efecto de clasificarlos, existen tres clases de\nrefugios nacionales de vida silvestre: Refugios de propiedad estatal, Refugios\nde propiedad mixta y Refugios de propiedad privada.\n\nIII.-Que la sociedad\ndenominada ASOCIACIÓN DE COOPERATIVAS EUROPEAS LONGO MAI, cédula jurídica\nnúmero tres-cero cero dos-cero cuarenta y cinco mil seiscientos sesenta y tres,\na través de su Apoderado Generalísimo sin límite de suma el señor Roland\nSpendligwimmer Beimrohr, mayor de edad, casado una vez, ciudadano austriaco,\ncon número de cédula de residencia uno cero cuatro cero cero cero cero uno cero\nuno dos uno, vecino de Finca Sonador, Longo Mai de Buenos Aires de Puntarenas,\ncuya personería está vigente, solicitó en el año 2011 al Área de Conservación\nLa Amistad Pacífico, Oficina Subregional de Buenos Aires el sometimiento\nvoluntario al Régimen de Refugios Privados de Vida Silvestre, parte de cinco\ninmuebles de su propiedad.\n\nIV.-Que mediante\nmemorial del 21 de febrero del 2014 presentado a la Asesoría Legal de la\nSecretaría Ejecutiva del Sistema Nacional de Áreas de Conservación, el señor\nJiri Spendligwimmer Spendligwimmer, mayor, costarricense, casado una vez,\nantropólogo, vecino de San Isidro de El General, cédula de identidad número\n800870154, en su calidad de gerente con facultades de Apoderado Generalísimo\nsin límite de suma de ACE LONGO MAI, SOCIEDAD DE RESPONSABILIDAD LIMITADA,\ncédula jurídica número 3-102-661273, cuya personería está vigente, manifestó\nque los inmuebles anteriormente a nombre de ASOCIACIÓN DE COOPERATIVAS EUROPEAS\nLONGO MAI se encuentran actualmente inscritos en el Registro Nacional a nombre\nde su representada y acepta someter las mismas al régimen de Refugio Nacional\nde Vida Silvestre, categoría privado, por lo que solicita continuar con el\ntrámite respectivo a la declaratoria.\n\nV.-Que los inmuebles a nombre de ACE LONGO MAI, SOCIEDAD DE\nRESPONSABILIDAD LIMITADA, se encuentran inscritas en el Registro de la\nPropiedad Inmueble, bajo los folios reales que se describen a continuación;\ntodos del Partido de Puntarenas, Cantón 3 Buenos Aires, Distrito 2 Volcán,\nsegún el siguiente detalle:\n\n| Finca | Propiedad Folio Real | Nº Plano Catastrado | Área total de cada finca |\n| --- | --- | --- | --- |\n| Finca Nº 1 | 6-153446-000 | P-1039317-2005 | 226 ha. 8765.06 dm² |\n| Finca Nº 2 | 6-153447-000 | P-1174323-2007 | 271 ha. 8495.09 dm² |\n| Finca Nº 3 | 6-159593-000 | P-1283607-2008 | 188 ha. 736.18 dm² |\n| Finca Nº 4 | 6-179953-000 | P-1524560-2011 | 73 ha. 4893 m² |\n| Finca Nº 5 | 6-179954-000 | P-1530477-2011 | 32 ha. 5424 m² |\n| Área total de las fincas | 792 ha. 8313.33 dm² |  |  |\n\nVI.-Que la medida total de los cinco inmuebles inscritos a\nnombre de ACE LONGO MAI, SOCIEDAD DE RESPONSABILIDAD LIMITADA es de setecientos\nnoventa y dos hectáreas ocho mil trescientos trece metros con treinta y tres\ndecímetros cuadrados (792 ha. 8313.33 dm²).\n\nVII.-Que la\nASOCIACION DE COOPERATIVAS EUROPEAS LONGO MAI entonces propietaria de los\ninmuebles a nombre de ACE LONGO MAI, SOCIEDAD DE RESPONSABILIDAD LIMITADA, a\ntravés del representante de la Sociedad aceptó expresamente, someter\nvoluntariamente al régimen de Refugio Nacional de Vida Silvestre, categoría\nprivada, en total un área de 452 hectáreas de los inmuebles descritos en el\nconsiderando 5 del presente decreto ejecutivo, por un período de diez años,\nsegún lo establece el artículo 171 inciso f) del Reglamento a la Ley de\nConservación de Vida Silvestre.\n\nVIII.-Que los\ninmuebles sometidos al régimen de Refugio Nacional de Vida Silvestre, por\nvoluntad de su propietario, serán dedicados exclusivamente a la conservación en\nadelante, por lo que desde el punto de vista ambiental representan una\nimportante área de recuperación de los hábitat naturales y para la regeneración\nde zonas degradadas que servirán para el desarrollo de la flora y fauna\npresentes en la zona.\n\nIX.-Que las áreas a someter\nal régimen de Refugio Nacional de Vida Silvestre, se componen de bosques\nprimarios y bosques intervenidos que han estado en recuperación desde el año\n1979. Los inmuebles se ubican dentro del bosque tropical muy húmedo -\ntransición a pre montano, y bosque pluvial pre montano, según el mapa ecológico\nde Costa Rica y el Sistema de Clasificación de zonas de vida del mundo de L.R.\nHoldridge.\n\nAmbas zonas de vida se caracterizan por\npresentar un exceso de precipitación de 4000 a 6000 mm como promedio anual y se\nencuentran entre los 600 a 1000 metros sobre el nivel del mar.\n\nX.-Que dentro del\nárea objeto de sometimiento al régimen de Refugio Nacional de Vida Silvestre,\nexisten un gran número de recursos faunísticos (insectos, mamíferos, anfibios,\naves y reptiles) así como recursos florísticos que merecen ser conservados\nracional y sosteniblemente, para garantizar su permanencia dentro de los\necosistemas en que actualmente se encuentran.\n\nXI.-Que con la\nprotección oficial de los ecosistemas descritos en el considerando anterior, se\nlogrará la conservación de especies de vida silvestre propias de dichos\nhábitats, los cuales tienen gran importancia biológica y socioeconómica, ya que\nalgunas se encuentran en peligro de extinción, debido al estado actual de los recursos\nnaturales en la zona.\n\nXII.-Que de\nconformidad con el artículo 70 inciso e.2) del Reglamento a la Ley de\nBiodiversidad, Decreto Ejecutivo Nº 34433-MINAE, el principal efecto ambiental\nque genera la declaratoria de un inmueble bajo este régimen jurídico lo es, que\npara los efectos de la conservación de los recursos naturales la administración\ndel mismo corresponderá al propietario de los inmuebles, la cual será\nsupervisada por el Sistema Nacional de Áreas de Conservación a través del Área\nde Conservación La Amistad Pacífico, Oficina Subregional de Buenos Aires.\n\nXIII.-Que analizada\nla documentación que consta en el expediente administrativo se determinó que\ncumplió con lo establecido en el artículo 171 del Decreto Ejecutivo Nº 32633-\nMINAE denominado Reglamento a la Ley de Conservación de la Vida Silvestre.\n\nXIV.-Que por medio de\nla resolución número ACLA-P-D-299-2012 de las ocho horas del día catorce de\njunio del año dos mil doce, el Director del Área de Conservación La Amistad\nPacífico, Licenciado Ronald Chan Fonseca, aceptó la solicitud de sometimiento\nvoluntario al régimen de Refugio Nacional de Vida Silvestre que realizó la\nASOCIACIÓN DE COOPERATIVAS EUROPEAS LONGO MAI entonces titular de los inmuebles\nindicados en el considerando número 5, titularidad que cambio durante la\ntramitación del presente decreto ejecutivo según consta en el expediente de\nmarras.\n\nXV.-Que mediante\nacuerdo Nº 3 de la sesión ordinaria Nº 05-2012 del Consejo Regional del Áreas\nde Conservación La Amistad Pacífico (CORACLAP) del 15 de junio del 2012, aprobó\nla iniciativa de declaratoria del Refugio Nacional de Vida Silvestre Longo Mai,\ncategoría privada, de conformidad al artículo 30 inciso 7) de la Ley de\nBiodiversidad Nº 7788.\n\nXVI.-Que mediante Acuerdo Nº 11 de la Sesión Ordinaria Nº 02-2013 del 25\nde febrero del 2013 el Consejo Nacional de Áreas de Conservación (CONAC) aprobó\nla creación del Refugio Nacional de Vida Silvestre Longo Mai, categoría\nprivada, de conformidad al artículo 25 inciso 6) de la Ley de Biodiversidad Nº 7788.\nPor tanto,\n\nDecretan:\n\n\"CRÉASE EL REFUGIO\nNACIONAL DE VIDA SILVESTRE LONGO MAI, CATEGORÍA PRIVADA\"\n\nArtículo 1º-Créase el Refugio Nacional de Vida Silvestre Longo Mai,\ncategoría privada, el cual está formado por una superficie total de\ncuatrocientos cincuenta y dos hectáreas (452 ha) For the purpose of classification, there are three classes of\nnational wildlife refuges: State-owned Refuges, Refuges\nof mixed ownership and Privately-owned Refuges.\n\nIII.-That the\nentity called ASOCIACIÓN DE COOPERATIVAS EUROPEAS LONGO MAI, legal identification\nnumber three-zero zero two-zero forty-five thousand six hundred sixty-three,\nthrough its General Attorney-in-fact without limit of amount Mr. Roland\nSpendligwimmer Beimrohr, of legal age, married once, Austrian citizen,\nwith residence ID number one zero four zero zero zero zero one zero\none two one, resident of Finca Sonador, Longo Mai of Buenos Aires de Puntarenas,\nwhose legal representation is valid, requested in 2011 from the Área de Conservación\nLa Amistad Pacífico, Buenos Aires Subregional Office the voluntary\nsubmission to the Regime of Private Wildlife Refuges, for part of five\nproperties owned by it.\n\nIV.-That by\nbrief dated February 21, 2014, submitted to the Legal Advisory Office of the\nExecutive Secretariat of the National System of Conservation Areas, Mr.\nJiri Spendligwimmer Spendligwimmer, of legal age, Costa Rican, married once,\nanthropologist, resident of San Isidro de El General, identity card number\n800870154, in his capacity as manager with powers of General Attorney-in-fact\nwithout limit of amount of ACE LONGO MAI, SOCIEDAD DE RESPONSABILIDAD LIMITADA,\nlegal identification number 3-102-661273, whose legal representation is valid, stated\nthat the properties formerly in the name of ASOCIACIÓN DE COOPERATIVAS EUROPEAS\nLONGO MAI are currently registered in the National Registry in the name of\nhis represented entity and accepts submitting the same to the regime of National\nWildlife Refuge, private category, and therefore requests to continue with the\nrespective process for the declaration.\n\nV.-That the properties in the name of ACE LONGO MAI, SOCIEDAD DE\nRESPONSABILIDAD LIMITADA, are registered in the Real Property Registry, under the real folios described below;\nall from the Partido of Puntarenas, Canton 3 Buenos Aires, District 2 Volcán,\naccording to the following detail:\n\n| Property | Real Folio | Cadastral Plan No. | Total area of each property |\n| --- | --- | --- | --- |\n| Property No. 1 | 6-153446-000 | P-1039317-2005 | 226 ha. 8765.06 dm² |\n| Property No. 2 | 6-153447-000 | P-1174323-2007 | 271 ha. 8495.09 dm² |\n| Property No. 3 | 6-159593-000 | P-1283607-2008 | 188 ha. 736.18 dm² |\n| Property No. 4 | 6-179953-000 | P-1524560-2011 | 73 ha. 4893 m² |\n| Property No. 5 | 6-179954-000 | P-1530477-2011 | 32 ha. 5424 m² |\n| Total area of the properties | 792 ha. 8313.33 dm² |  |  |\n\nVI.-That the total measurement of the five properties registered in the\nname of ACE LONGO MAI, SOCIEDAD DE RESPONSABILIDAD LIMITADA is seven hundred\nninety-two hectares, eight thousand three hundred thirteen square meters and thirty-three\nsquare decimeters (792 ha. 8313.33 dm²).\n\nVII.-That the\nASOCIACION DE COOPERATIVAS EUROPEAS LONGO MAI, then owner of the\nproperties now in the name of ACE LONGO MAI, SOCIEDAD DE RESPONSABILIDAD LIMITADA,\nthrough the representative of the Company expressly accepted to voluntarily\nsubmit to the regime of National Wildlife Refuge, private\ncategory, a total area of 452 hectares of the properties described in\nconsidering 5 of this executive decree, for a period of ten years,\nas established in article 171 subsection f) of the Regulations to the\nWildlife Conservation Law.\n\nVIII.-That the\nproperties submitted to the regime of National Wildlife Refuge, by the\nwill of their owner, will be dedicated exclusively to conservation from now on,\ntherefore, from an environmental point of view, they represent an\nimportant area for the recovery of natural habitats and for the regeneration\nof degraded zones that will serve for the development of the flora and fauna\npresent in the area.\n\nIX.-That the areas to be submitted\nto the regime of National Wildlife Refuge consist of primary\nforests and intervened forests that have been in recovery since the year\n1979. The properties are located within the tropical very humid forest -\ntransition to premontane, and premontane rain forest, according to the ecological map\nof Costa Rica and the World Life Zone Classification System of L.R.\nHoldridge.\n\nBoth life zones are characterized by\nhaving an excess precipitation of 4000 to 6000 mm annual average and are\nfound between 600 to 1000 meters above sea level.\n\nX.-That within the\narea subject to submission to the regime of National Wildlife Refuge,\na large number of faunal resources (insects, mammals, amphibians,\nbirds and reptiles) as well as floral resources exist which deserve to be conserved\nrationally and sustainably, to guarantee their permanence within the\necosystems in which they are currently found.\n\nXI.-That with the\nofficial protection of the ecosystems described in the previous considering,\nthe conservation of wildlife species native to said\nhabitats will be achieved, which are of great biological and socioeconomic importance, since\nsome are endangered, due to the current state of natural\nresources in the area.\n\nXII.-That in\naccordance with article 70 subsection e.2) of the Regulations to the\nBiodiversity Law, Executive Decree No. 34433-MINAE, the primary environmental effect\ngenerated by the declaration of a property under this legal regime is that,\nfor the purposes of natural resource conservation, the administration\nthereof will correspond to the owner of the properties, which will be\nsupervised by the National System of Conservation Areas through the Área\nde Conservación La Amistad Pacífico, Buenos Aires Subregional Office.\n\nXIII.-That upon analyzing\nthe documentation contained in the administrative file, it was determined that\nit complied with the provisions of article 171 of Executive Decree No. 32633-\nMINAE called Regulations to the Wildlife Conservation Law.\n\nXIV.-That through\nresolution number ACLA-P-D-299-2012 of eight o'clock on the day of June\nfourteenth, two thousand twelve, the Director of the Área de Conservación La Amistad\nPacífico, Licenciado Ronald Chan Fonseca, accepted the request for voluntary\nsubmission to the regime of National Wildlife Refuge made by\nASOCIACIÓN DE COOPERATIVAS EUROPEAS LONGO MAI, then owner of the properties\nindicated in considering number 5, ownership which changed during the\nprocessing of this executive decree as recorded in the\nrelevant file.\n\nXV.-That by\nagreement No. 3 of the ordinary session No. 05-2012 of the Regional Council of the\nÁreas de Conservación La Amistad Pacífico (CORACLAP) of June 15, 2012, approved\nthe initiative for the declaration of the Longo Mai National Wildlife Refuge,\nprivate category, in accordance with article 30 subsection 7) of the\nBiodiversity Law No. 7788.\n\nXVI.-That by Agreement No. 11 of the Ordinary Session No. 02-2013 of February\n25, 2013, the National Council of Conservation Areas (CONAC) approved\nthe creation of the Longo Mai National Wildlife Refuge, private\ncategory, in accordance with article 25 subsection 6) of the Biodiversity Law No. 7788.\nTherefore,\n\nThey Decree:\n\n\"CREATION OF THE\nNATIONAL WILDLIFE REFUGE LONGO MAI, PRIVATE CATEGORY\"\n\nArticle 1.-Creates the Longo Mai National Wildlife Refuge,\nprivate category, which is formed by a total area of\nfour hundred fifty-two hectares (452 ha) of the properties registered in\nthe Public Registry of Real Property described below:\n\n| Property | Real Folio | Cadastral Plan No. | Total area of each property | Area to be submitted to Refuge |\n| --- | --- | --- | --- | --- |\n| Property No. 1 | 6-153446-000 | P-1039317-2005 | 226 ha. 8765.06 dm² | 199.4 ha. |\n| Property No. 2 | 6-153447-000 | P-1174323-2007 | 271 ha. 8495.09 dm² | 146.7 ha. |\n| Property No. 3 | 6-159593-000 | P-1283607-2008 | 188 ha. 736.18 dm² | 43.2 ha. |\n| Property No. 4 | 6-179953-000 | P-1524560-2011 | 73 ha. 4893 dm² | 43.8 ha. |\n| Property No. 5 | 6-179954-000 | P-1530477-2011 | 32 ha. 5424 dm² | 18.9 ha. |\n| Total Area of the properties | 792 ha. 8313.33 dm² | Total area of the refuge 452 ha. |  |  |\n\nAll owned by\nACE LONGO MAI, SOCIEDAD DE RESPONSABILIDAD LIMITADA, legal identification number\n3-102- 661273 and totaling four hundred fifty-two hectares\n(452 ha).\n\n \n\n Article tab\n\nArticle\n2.-The cartographic location of the Longo Mai National Wildlife Refuge,\nprivate category, is described as follows (See Annex No. 1):\n\nLongitude(X) Latitude(Y)\n\nUpper Left -83.503521 9.294192\n\nLower\nLeft -83.503521 9.246912\n\nUpper\nRight -83.456655 9.294192\n\nLower\nRight -83.456655 9.246912\n\n \n\n Article tab\n\nArticle 3.-ACE LONGO MAI SOCIEDAD DE RESPONSABILIDAD\nLIMITADA undertakes not to develop any activity that jeopardizes\nthe existence of flora and fauna without the respective permit from the National\nSystem of Conservation Areas (SINAC) of the Ministry of Environment and\nEnergy. Likewise, they will provide all necessary collaboration to officials\nof SINAC, for the control and verification work of environmental\npolicies through the Área de Conservación La Amistad Pacífico, as well as to\nresearchers, students and others who sporadically visit said area\nin the performance of their respective positions, studies and research.\nThey also undertake to comply with the provisions set forth in this regard by\nthe Wildlife Conservation Law, the Forest Law (Ley Forestal), their respective\nregulations, as well as other provisions in force on the matter.\n\n \n\n Article tab\n\nArticle\n4.-The 452 hectares of the properties indicated in article one of this\nexecutive decree will be subject to the category of National\nWildlife Refuge, private category, for a period of ten years\nrenewable for equal periods automatically, in the event that the\nowner does not express a desire to release the properties, within the term of\nthree months prior to the expiration of the period.\n\nThe\nforegoing, by means of a written request submitted to the Área de Conservación La Amistad\nPacífico, in accordance with article 171 of Executive Decree No. 32633- MINAE\ncalled Regulations to the Wildlife Conservation Law, to\ninitiate the corresponding procedures for its release and in any\ncase, the legal limitations indicated in the Forest Law (Ley Forestal) and\nother environmental legislation regarding land-use change (cambio de uso del suelo) and\nthe protection of rivers must be respected.\n\n \n\n Article tab\n\nArticle 5.-The administration, surveillance and maintenance of this\nRefuge and compliance with the technical provisions issued for this purpose by\nthe Área de Conservación La Amistad Pacífico, will be the responsibility of ACE LONGO\nMAI, SOCIEDAD DE RESPONSABILIDAD LIMITADA in its capacity as owner of the\naffected properties.\n\n \n\n Article tab\n\nArticle\n6.-ACE LONGO MAI, SOCIEDAD DE RESPONSABILIDAD LIMITADA must submit to the\nÁrea de Conservación La Amistad Pacífico, at least one annual report on the\ndifferent aspects related to the properties and the state of the natural\nresources within it.\n\n \n\n Article tab\n\nArticle\n7.-ACE LONGO MAI, SOCIEDAD DE RESPONSABILIDAD LIMITADA, shall enjoy the\nbenefits and incentives established in the Wildlife Conservation\nLaw, for which purpose the Área de Conservación La Amistad Pacífico will issue the\nnecessary documents for such purposes.\n\n \n\n Article tab\n\nArticle\n8.-Takes effect upon its publication in the Official Gazette La Gaceta.\n\nIssued at the Presidency of the Republic on the tenth day\nof the month of July, two thousand fourteen.\n\n \n\n Article tab\n\nAnnex No. 1\n\n \n\n \n\n Article tab\n\nGeneration date: 5/5/2026 19:03:20\n\n                                        Go to the beginning of the document"
