Tendrá el carácter de una Dirección General del Ministerio de\nAgricultura y Ganadería. Sus funciones y atribuciones serán las siguientes:\n\na)\nAsesorar al Ministro de Agricultura y Ganadería en todas las decisiones e\niniciativas de política, legislación y administración de los parques nacionales;\n\nb)\nEjecutar los programas del Ministerio de Agricultura y Ganadería para el\ndesarrollo de los parques nacionales, administrando los recursos, que se\nasignan en los presupuestos ordinarios y extraordinarios de\nla República;\n\nc)\nProponer planes de coordinación interinstitucional para establecer metas\ncomunes, referentes al desarrollo y administración de los parques nacionales;\n\nd)\nVelar por la conservación de los parques nacionales;\n\ne)\nEstablecer programas para la difusión de los logros conseguidos con los parques\nnacionales.\n\nf)\nTodas las demás que le correspondan de la aplicación de las leyes, reglamentos\ny resoluciones aplicables.\n\n(Reformado por Ley Orgánica del\nMinisterio de Energía y Ambiente Nº 7152 de 5 de\njunio de 1990, al trasladar competencias aquí indicadas del MAG al Ministerio\nde Ambiente y Energía(*))\n\n(*)(Modificada su denominación por\nel artículo 11 de la Ley\n\"Traslado del sector Telecomunicaciones del Ministerio de Ambiente,\nEnergía y Telecomunicaciones al Ministerio de Ciencia y Tecnología, N° 9046 del 25 de junio de 2012)\n\n \n\n Ficha articulo\n\nARTICULO\n4º.- En el Ministerio de Agricultura y Ganadería funcionará, junto al Servicio\nde Parques Nacionales, un consejo como organismo asesor del Poder Ejecutivo en\nlo referente a la política de creación, desarrollo y conservación de parques\nnacionales.\n\n(Reformado\npor Ley Orgánica del Ministerio de Energía y Ambiente Nº\n7152 de 5 de junio de 1990, al trasladar competencias aquí indicadas del MAG al\nMinisterio de Ambiente y Energía(*))\n\n(*)(Modificada su denominación por\nel artículo 11 de la Ley\n\"Traslado del sector Telecomunicaciones del Ministerio de Ambiente,\nEnergía y Telecomunicaciones al Ministerio de Ciencia y Tecnología, N° 9046 del 25 de junio de 2012)\n\n \n\n Ficha articulo\n\n     ARTICULO 5.- El Consejo estará integrado por:\n\n     a) El Ministro de Ambiente y Energía, o su representante, quien lo\n\npresidirá.\n\n     (El nombre del Ministerio fue así reformado por el artículo 116 de\n\nla Ley Orgánica del Ambiente No.7554 del 4 de octubre de 1995)\n\n     b) El Ministro de Cultura, Juventud y Deportes o su representante.\n\n     c) Un representante del Ministerio de Educación Pública.\n\n    ch) Un representante del Instituto Costarricense de Turismo.\n\n     d) El Director del Servicio de Parques Nacionales.\n\n     e) Un representante del Colegio de Biólogos.\n\n     El Poder Ejecutivo integrará el Consejo mediante decreto. Sus\n\nmiembros permanecerán en sus cargos mientras su nombramiento no sea\n\nrevocado.\n\n     Los miembros del Consejo no podrán devengar remuneración alguna por\n\nsu asistencia a las sesiones de trabajo.\n\n     (Así reformado por el artículo 12 de la Ley Nº 7152 de 5 de junio de\n\n1990)\n\n Ficha articulo\n\n     ARTICULO 6º.- El Servicio de Parques Nacionales contará con los\n\nrecursos que se le asignen en los presupuestos ordinarios y\n\nextraordinarios de la República. Contará, además, con las siguientes\n\nrentas, las cuales ingresarán al fondo de parques nacionales:\n\n     1) Las donaciones que haga el Estado, cualquier persona física o\n\njurídica, para ser administradas por el Servicio de Parques Nacionales.\n\nEstas donaciones quedan exoneradas del pago de los impuestos de\n\nBeneficencia, Timbre Universitario y derechos del Registro Público y\n\ndeberán formalizarse conforme a las disposiciones del Código Civil y\n\nleyes conexas.\n\n     2) Las cuotas por derecho de entrada a los parques nacionales que\n\nacordare el Servicio.\n\n     3) Los recursos que generare el Servicio, en virtud del ejercicio de\n\nlas funciones y atribuciones que esta ley asigna.\n\n     4) El producto de la venta del timbre pro parques nacionales, que se\n\ncrea en el artículo siguiente.\n\n Ficha articulo\n\n     ARTICULO 7º.- Créase el timbre pro parques nacionales. El Banco\n\nCentral de Costa Rica deberá emitir y recaudar su producto.\n\n     Las denominaciones serán:\n\n  a) Timbre de un colón, que deberán llevarlos las patentes municipales\n\nde cualquier clase; y\n\n  b) Timbre de cinco colones, que deberá ser cancelado en:\n\n     1) Los pasaportes y salvoconductos que se expidan o visen para salir\n\ndel país, salvo aquellos que por tratados y leyes vigentes se encuentren\n\nexentos de impuestos y tasas.\n\n     2) Los documentos necesarios para que se inscriba por primera vez un\n\nvehículo automotor en el Registro Público de la Propiedad de Vehículos.\n\n     3) Las autenticaciones de firmas que haga el Ministerio de\n\nRelaciones Exteriores.\n\n  c) Timbre de cien colones que deberán cancelar anualmente todos los\n\nclubes sociales, salones públicos de baile y lugares similares, con fines\n\nlucrativos, así como en las solicitudes para abrir negocios de esa\n\nnaturaleza.\n\n Ficha articulo\n\nARTICULO 8º.- Dentro de\nlos parques nacionales, queda prohibido a los visitantes:\n\n1) Talar árboles y\nextraer plantas o cualquier otro tipo de productos forestales.\n\n2) Cazar o capturar\nanimales silvestres, recolectar o extraer cualquiera de sus productos o\ndespojos.\n\n3) Cazar tortugas\nmarinas de cualquier especie; recolectar o extraer sus huevos o cualquier otro\nproducto o despojo.\n\n4) Rayar, marcar,manchar o provocar\ncualquier tipo de daño o deterioro a las plantas, los equipos o las\ninstalaciones.\n\n5) Pescar deportiva,\nartesanal o industrialmente, salvo el caso previsto en el artículo diez.\n\n6) Recolectar o extraer\ncorales, conchas, rocas o cualquier otro producto o desecho del mar.\n\n7) Recolectar o extraer\nrocas, minerales, fósiles o cualquier otro producto geológico.\n\n8) Portar armas de\nfuego, arpones y cualquier otro instrumento que pueda ser usado para cacería.\n\n9) Introducir animales\no plantas exóticas.\n\n10) Pastorear y abrevar\nganado o criar abejas.\n\n11) Provocar cualquier\ntipo de contaminación ambiental.\n\n12) Extraer piedras,\narenas, grava o productos semejantes.\n\n13) Dar de comer o\nbeber a los animales.\n\n14) Construir líneas de\nconducción eléctrica o telefónica, acueductos o carreteras o vías férreas.\n\n15) Realizar cualquier\ntipo de actividad comercial, agrícola o industrial.\n\n16) El ingreso a\nsitios, en que el área silvestre protegida no lo permita de acuerdo con el\ninstrumento técnico de planificación con el que cuente o en sitios autorizados\nsin cumplir con la normativa vigente. Esta prohibición aplica para los parques\nnacionales y sitios declarados oficialmente bajo cualquier categoría de manejo.\n\n(Así adicionado el inciso anterior por el artículo 1° de la\nley N° 10861 del 25 de febrero de 2026)\n\n17) Realizar\nactividades no autorizadas en el área silvestre protegida, de acuerdo con el\ninstrumento técnico de planificación, ya sea parque nacional o cualquier otra\ncategoría de manejo oficialmente declarada.\n\n(Así adicionado el inciso anterior por el artículo 1° de la\nley N° 10861 del 25 de febrero de 2026)\n\n Ficha articulo\n\nARTICULO 9º.- Quien contraviniera lo dispuesto\nen el artículo ocho, será expulsado inmediatamente del Parque Nacional y puesto\na la orden de las autoridades judiciales correspondientes, por los empleados del\nServicio de Parques Nacionales, quienes para ese efecto tendrán el carácter de\nautoridades de policía.\n\n Ficha articulo\n\nArtículo 9 bis- Se sancionará con multa por parte de la\nautoridad del Sinac lo que contravenga el artículo 8.\nPara dichos efectos, deberá notificarse en el acto al infractor y se le\notorgará un plazo de quince días hábiles para proceder al pago de la multa. Las\nmultas no son excluyentes de las responsabilidades civiles y penales que\ncorrespondan. El Sinac contará con un sistema\ndigitalizado que permita registrar y consultar a las personas prevenidas para\naplicar su debida sanción.\n\na) Si el infractor ingresa en sitios en que el área\nsilvestre protegida no lo permita, de acuerdo con el instrumento técnico de\nplanificación, o en sitios autorizados sin cumplir con la normativa vigente, se\nle multará con tres salarios base, además, si el hecho constituye un delito se\nle aplicará la ley correspondiente.\n\nb) Si el infractor realiza o promueve en medios digitales\nactividades no autorizadas en el área silvestre protegida, de acuerdo con el\ninstrumento técnico de planificación, se le multará con tres salarios base;\nademás, si el hecho constituye un delito se le aplicará la ley correspondiente.\n\nc) El operador turístico que promueva y/o venda tours, a\ntravés de cualquier medio, a sitios en que el área silvestre protegida no lo\npermita de acuerdo con el instrumento técnico de planificación o en sitios\nautorizados sin cumplir con la normativa vigente, se le multará con siete\nsalarios base; además, si el hecho constituye un delito o contravención se le\naplicará la ley correspondiente.\n\nd) Si el infractor es un operador turístico y/o sus guías\ningresan con turistas a sitios que estén clasificados de alto riesgo en las\náreas silvestres protegidas, se le multará con diez salarios base y el comiso\ndel equipo que porta. Para aquellos que cuenten con declaratoria turística, se\nle notificará al Instituto Costarricense de Turismo, para que proceda de\nacuerdo con su normativa. e) Si cualquiera de los infractores indicados en los\npuntos anteriores es reincidente en el ingreso no autorizado a las áreas\nsilvestres protegidas del país, la multa se incrementará en un cincuenta por\nciento (50%), a la definida en los puntos anteriores.\n\nf) Si al infractor se le ha aplicado las multas de los incisos anteriores (a, b, c, d y e) y es\nnuevamente reincidente, se le prohibirá el ingreso a las áreas silvestres protegidas por un plazo de\nun año.\n\ng) En caso de que la atención de alguna de las infracciones anteriores requiera realizar un rescate\nespecializado, se aplicará una multa adicional equivalente a cinco salarios base por cada persona\nrescatada que haya cometido la infracción y diez salarios base al guía u operador turístico\nresponsable. Los fondos recaudados por estas multas se distribuirán en un sesenta por ciento (60%)\npara el Sistema Nacional de Áreas de Conservación (Sinac) y un cuarenta por ciento (40%) para la\nAsociación Cruz Roja Costarricense.\n\nTodas las multas estipuladas en este artículo deberán\ncancelarse en la cuenta bancaria que para ello disponga el Sistema Nacional de\nÁreas de Conservación (Sinac), autorizada por el\nMinisterio de Hacienda. Las multas provenientes por concepto de las\ninfracciones estipuladas en los incisos a), b), c), d) y e) deberán ser\nreintegradas en su totalidad al Sinac. Las multas\nprovenientes por concepto de las infracciones estipuladas en el inciso g)\ndeberán ser transferidas por el Ministerio de Hacienda, en los porcentajes\nindicados en dicho inciso a los respectivos beneficiarios.\n\nTodos los fondos que por concepto de multas ingresen al Sinac serán destinados al Fondo de Parques\nNacionales, los cuales serán utilizados para fortalecer los programas de prevención, protección y\ncontrol y turismo sostenible del Sistema Nacional de Áreas de Conservación.\n\n(Así adicionado por\nel artículo 2° de la ley N° 10861 del 25 de febrero de 2026)\n\n Ficha articulo\n\nArtículo 9 ter- En el caso de que el infractor no realice el\npago de la multa establecida, el monto adeudado constituirá deuda líquida\nexigible por parte del Sistema Nacional de Áreas de Conservación y la\ncertificación que emita tendrá el carácter de título ejecutivo válido y\nsuficiente para proceder con el cobro judicial en la vía ejecutiva.\n\nLa denominación de salario base corresponde a lo dispuesto\nen el artículo 2 de la Ley 7337, del 5 de mayo de 1993, que crea el concepto\nsalario base para delitos especiales del Código Penal.\n\n(Así adicionado por\nel artículo 2° de la ley N° 10861 del 25 de febrero de 2026)\n\n Ficha articulo\n\n     ARTICULO 10.- El Servicio podrá, previo dictamen afirmativo del\n\nconsejo, autorizar la pesca deportiva y artesanal en determinadas áreas\n\nde los parques nacionales, cuando se compruebe que no producirán\n\nalteraciones ecológicas.\n\n Ficha articulo\n\n     ARTICULO 11.- No podrán constituirse servidumbres a favor de fundos\n\nparticulares en terrenos de parques nacionales.\n\n Ficha articulo\n\n     ARTICULO 12.- No pueden otorgarse concesiones de tipo alguno para la\n\nexplotación de productos de los parques nacionales, ni otorgarse permiso\n\npara establecer otras instalaciones que las del Servicio.\n\n Ficha articulo\n\n     ARTICULO 13.- Corresponderá al Servicio de Parques Nacionales\n\nproponer al Poder Ejecutivo la creación de nuevos parques nacionales.\n\nEstos serán establecidos mediante decreto ejecutivo, en el que se\n\nindicarán, con toda precisión, los límites que previamente haya señalado\n\nel Instituto Geográfico de Costa Rica. Estos límites no podrán variarse\n\nsino mediante una ley.\n\n Ficha articulo\n\n     ARTICULO 14.- Modifícase de la Ley Forestal Nº 4465 de 25 de\n\nnoviembre de 1969, el inciso e) del artículo diez, que se lee así:\n\n    \"e) Hacer los estudios necesarios y proponer la creación de las\n\nzonas protectoras y reservas forestales\".\n\n     De los artículos 21, 23, 25 y 75 todo lo que se refiere a parques\n\nnacionales y reservas biológicas corresponderá al Servicio de Parques\n\nNacionales.\n\n Ficha articulo\n\n     ARTICULO 15.- Deróguese el artículo 77 de la Ley Forestal Nº 4465\n\ndel 25 de noviembre de 1969.\n\n Ficha articulo\n\n     ARTICULO 16.- Del artículo 78 de la Ley Forestal Nº 4465 del 25 de\n\nnoviembre de 1969, se eliminará la expresión \"Fondo Forestal\", la cual\n\nserá sustituida por \"Fondo de Parques Nacionales\".\n\n Ficha articulo\n\n     ARTICULO 17.- Se autoriza al Ministerio de Agricultura y Ganadería,\n\na traspasarle al Ministerio de Cultura, Juventud y Deportes la\n\nadministración del Monumento Nacional Guayabo. Its functions and powers shall be the following:\n\na) Advise the Minister of Agriculture and Livestock on all decisions and initiatives regarding policy, legislation, and administration of national parks;\n\nb) Execute the programs of the Ministry of Agriculture and Livestock for the development of national parks, administering the resources allocated in the ordinary and extraordinary budgets of the Republic;\n\nc) Propose inter-institutional coordination plans to establish common goals regarding the development and administration of national parks;\n\nd) Ensure the conservation of national parks;\n\ne) Establish programs for the dissemination of the achievements made with national parks.\n\nf) All others corresponding to it from the application of applicable laws, regulations, and resolutions.\n\n(Amended by the Organic Law of the Ministry of Energy and Environment No. 7152 of June 5, 1990, by transferring the powers indicated here from the MAG to the Ministry of Environment and Energy (*))\n\n(*)(Its name amended by Article 11 of the Law \"Transfer of the Telecommunications sector from the Ministry of Environment, Energy and Telecommunications to the Ministry of Science and Technology, No. 9046 of June 25, 2012)\n\nArticle record\n\nARTICLE 4.- In the Ministry of Agriculture and Livestock, alongside the National Parks Service, a council shall function as an advisory body to the Executive Branch regarding the policy for the creation, development, and conservation of national parks.\n\n(Amended by the Organic Law of the Ministry of Energy and Environment No. 7152 of June 5, 1990, by transferring the powers indicated here from the MAG to the Ministry of Environment and Energy (*))\n\n(*)(Its name amended by Article 11 of the Law \"Transfer of the Telecommunications sector from the Ministry of Environment, Energy and Telecommunications to the Ministry of Science and Technology, No. 9046 of June 25, 2012)\n\nArticle record\n\n     ARTICLE 5.- The Council shall be composed of:\n\n     a) The Minister of Environment and Energy, or their representative, who shall\n\npreside over it.\n\n     (The name of the Ministry was thus amended by Article 116 of\n\nthe Organic Law of the Environment No. 7554 of October 4, 1995)\n\n     b) The Minister of Culture, Youth and Sports or their representative.\n\n     c) A representative of the Ministry of Public Education.\n\n    ch) A representative of the Costa Rican Tourism Institute.\n\n     d) The Director of the National Parks Service.\n\n     e) A representative of the College of Biologists.\n\n     The Executive Branch shall integrate the Council by decree. Its\n\nmembers shall remain in their positions as long as their appointment is not\n\nrevoked.\n\n     The members of the Council may not earn any remuneration for\n\ntheir attendance at work sessions.\n\n     (Thus amended by Article 12 of Law No. 7152 of June 5,\n\n1990)\n\nArticle record\n\n     ARTICLE 6.- The National Parks Service shall have the\n\nresources allocated to it in the ordinary and extraordinary\n\nbudgets of the Republic. It shall also have the following\n\nrevenues, which shall enter the national parks fund:\n\n     1) Donations made by the State, any natural or\n\nlegal person, to be administered by the National Parks Service.\n\nThese donations are exempt from the payment of Charitable, University Stamp, and Public Registry fees taxes and\n\nmust be formalized in accordance with the provisions of the Civil Code and\n\nrelated laws.\n\n     2) The entrance fees to the national parks that\n\nthe Service agrees upon.\n\n     3) The resources generated by the Service, by virtue of exercising\n\nthe functions and powers that this law assigns.\n\n     4) The proceeds from the sale of the pro-national parks stamp, which is\n\ncreated in the following article.\n\nArticle record\n\n     ARTICLE 7.- The pro-national parks stamp is hereby created. The Central\n\nBank of Costa Rica must issue and collect its proceeds.\n\n     The denominations shall be:\n\n  a) One colón stamp, which must be affixed to municipal licenses\n\nof any kind; and\n\n  b) Five colón stamp, which must be paid on:\n\n     1) Passports and safe-conducts that are issued or visaed for leaving\n\nthe country, except those that, by current treaties and laws, are\n\nexempt from taxes and fees.\n\n     2) The documents necessary for the first registration of a\n\nmotor vehicle in the Public Registry of Vehicle Property.\n\n     3) The authentication of signatures made by the Ministry of\n\nForeign Affairs.\n\n  c) One hundred colón stamp that must be paid annually by all\n\nsocial clubs, public dance halls, and similar places, for profit,\n\nas well as on applications to open businesses of that\n\nnature.\n\nArticle record\n\nARTICLE 8.- Within the national parks, visitors are prohibited from:\n\n1) Felling trees and extracting plants or any other type of forest products.\n\n2) Hunting or capturing wild animals, collecting or extracting any of their products or remains.\n\n3) Hunting sea turtles of any species; collecting or extracting their eggs or any other product or remains.\n\n4) Scratching, marking, staining, or causing any type of damage or deterioration to the plants, equipment, or facilities.\n\n5) Sport, artisanal, or industrial fishing, except in the case provided for in Article ten.\n\n6) Collecting or extracting corals, shells, rocks, or any other product or waste from the sea.\n\n7) Collecting or extracting rocks, minerals, fossils, or any other geological product.\n\n8) Carrying firearms, harpoons, and any other instrument that could be used for hunting.\n\n9) Introducing exotic animals or plants.\n\n10) Grazing and watering livestock or keeping bees.\n\n11) Causing any type of environmental pollution.\n\n12) Extracting stones, sand, gravel, or similar products.\n\n13) Giving food or drink to the animals.\n\n14) Building electric or telephone conduction lines, aqueducts, or roads or railways.\n\n15) Carrying out any type of commercial, agricultural, or industrial activity.\n\n16) Entry to sites where the protected wilderness area (área silvestre protegida) does not permit it according to the technical planning instrument it has, or at authorized sites without complying with current regulations. This prohibition applies to national parks and sites officially declared under any management category.\n\n(Thus the previous subsection was added by Article 1 of Law No. 10861 of February 25, 2026)\n\n17) Carrying out unauthorized activities in the protected wilderness area (área silvestre protegida), according to the technical planning instrument, whether it is a national park or any other officially declared management category.\n\n(Thus the previous subsection was added by Article 1 of Law No. 10861 of February 25, 2026)\n\nArticle record\n\nARTICLE 9.- Whoever contravenes the provisions of Article eight shall be immediately expelled from the National Park and placed at the disposal of the corresponding judicial authorities, by the employees of the National Parks Service, who for this purpose shall have the character of police authorities.\n\nArticle record\n\nArticle 9 bis- Anyone who contravenes Article 8 shall be sanctioned with a fine by the authority of SINAC.\nFor these purposes, the offender must be notified immediately and granted a period of fifteen business days to proceed with the payment of the fine. The fines do not exclude the corresponding civil and criminal liabilities. SINAC shall have a digitalized system that allows registering and consulting the individuals cautioned in order to apply their due sanction.\n\na) If the offender enters sites where the protected wilderness area (área silvestre protegida) does not permit it, according to the technical planning instrument, or at authorized sites without complying with current regulations, they shall be fined three base salaries; furthermore, if the act constitutes a crime, the corresponding law shall be applied.\n\nb) If the offender carries out or promotes, on digital media, unauthorized activities in the protected wilderness area (área silvestre protegida), according to the technical planning instrument, they shall be fined three base salaries; furthermore, if the act constitutes a crime, the corresponding law shall be applied.\n\nc) The tour operator that promotes and/or sells tours, through any medium, to sites where the protected wilderness area (área silvestre protegida) does not permit it according to the technical planning instrument, or at authorized sites without complying with current regulations, shall be fined seven base salaries; furthermore, if the act constitutes a crime or contravention, the corresponding law shall be applied.\n\nd) If the offender is a tour operator and/or their guides enter with tourists sites that are classified as high risk in the protected wilderness areas (áreas silvestres protegidas), they shall be fined ten base salaries and the confiscation of the equipment they carry. For those who have a tourism declaration, the Costa Rican Tourism Institute shall be notified so that it may proceed according to its regulations. e) If any of the offenders indicated in the previous points is a repeat offender regarding unauthorized entry into the country's protected wilderness areas (áreas silvestres protegidas), the fine shall be increased by fifty percent (50%) over that defined in the previous points.\n\nf) If the fines from the previous subsections (a, b, c, d, and e) have been applied to the offender and they are once again a repeat offender, they shall be prohibited from entering the protected wilderness areas (áreas silvestres protegidas) for a period of one year.\n\ng) In the event that addressing any of the previous infractions requires carrying out a specialized rescue, an additional fine equivalent to five base salaries shall be applied for each rescued person who has committed the infraction, and ten base salaries to the responsible guide or tour operator. The funds collected from these fines shall be distributed as sixty percent (60%) to the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC) and forty percent (40%) to the Costa Rican Red Cross Association.\n\nAll fines stipulated in this article must be paid into the bank account that the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC) arranges for this purpose, authorized by the Ministry of Finance. The fines originating from the infractions stipulated in subsections a), b), c), d), and e) must be reimbursed in full to SINAC. The fines originating from the infractions stipulated in subsection g) must be transferred by the Ministry of Finance, in the percentages indicated in said subsection, to the respective beneficiaries.\n\nAll funds that enter SINAC as fines shall be allocated to the National Parks Fund, which shall be used to strengthen the prevention, protection, and control and sustainable tourism programs of the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación).\n\n(Thus added by Article 2 of Law No. 10861 of February 25, 2026)\n\nArticle record\n\nArticle 9 ter- In the event that the offender does not pay the established fine, the amount owed shall constitute a liquid debt collectible by the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación) and the certification it issues shall have the character of a valid and sufficient executive title to proceed with judicial collection via the executive procedure.\n\nThe denomination of base salary corresponds to the provisions of Article 2 of Law 7337, of May 5, 1993, which creates the concept of base salary for special crimes of the Penal Code.\n\n(Thus added by Article 2 of Law No. 10861 of February 25, 2026)\n\nArticle record\n\n     ARTICLE 10.- The Service may, with the prior affirmative opinion of the\n\ncouncil, authorize sport and artisanal fishing in certain areas\n\nof the national parks, when it is proven that they will not produce\n\necological alterations.\n\nArticle record\n\n     ARTICLE 11.- Easements (servidumbres) may not be constituted in favor of private\n\nestates on national park lands.\n\nArticle record\n\n     ARTICLE 12.- Concessions of any kind may not be granted for the\n\nexploitation of products from the national parks, nor may permission be granted\n\nto establish installations other than those of the Service.\n\nArticle record\n\n     ARTICLE 13.- The National Parks Service shall be responsible for\n\nproposing to the Executive Branch the creation of new national parks.\n\nThese shall be established by executive decree, which shall indicate,\n\nwith full precision, the boundaries that the Geographic Institute of Costa Rica has previously designated. These boundaries may not be changed\n\nexcept by law.\n\nArticle record\n\n     ARTICLE 14.- Subsection e) of Article ten of the Forest Law No. 4465 of November 25,\n\n1969, is hereby amended to read as follows:\n\n    \"e) Carry out the necessary studies and propose the creation of\n\nprotective zones and forest reserves.\"\n\n     Of Articles 21, 23, 25, and 75, everything referring to national\n\nparks and biological reserves shall correspond to the National Parks\n\nService.\n\nArticle record\n\n     ARTICLE 15.- Article 77 of the Forest Law No. 4465\n\nof November 25, 1969, is hereby repealed.\n\nArticle record\n\n     ARTICLE 16.- From Article 78 of the Forest Law No. 4465 of November 25,\n\n1969, the expression \"Forest Fund\" shall be eliminated and\n\nreplaced by \"National Parks Fund\".\n\nArticle record\n\n     ARTICLE 17.- The Ministry of Agriculture and Livestock is authorized\n\nto transfer to the Ministry of Culture, Youth and Sports the\n\nadministration of the Guayabo National Monument.
