Este Comité\nrealizó el Balance Hídrico de este acuífero Sardinal y ha venido monitoreando\nsu comportamiento; además en febrero de 2016, con el apoyo técnico de la\nUniversidad de Costa Rica, realizó el análisis del comportamiento de este acuífero\nante la sequía 2014-2016; resultados que se ha presentado a las comunidades\nrelacionadas y actores sociales interesados.\n\nIV.-Que mediante resolución N° 2017-001163 de las nueve horas cuarenta\nminutos del veintisiete de enero de dos mil diecisiete, la Sala Constitucional\nrecordó las recomendaciones dadas por la Comisión Técnica Interinstitucional,\nrelacionadas con el acuífero luego de realizado el análisis de febrero de 2016,\ndenominado \"Impacto de la Sequía en el Acuífero Sardinal 2015\", a saber: 1) la\nDirección de Agua del MINAE implementará la orden de instalación de sistemas de\ncontrol como caudalímetros en los pozos con aprovechamiento autorizado\n(concesión) para regular la extracción; 2) la Dirección de Agua con el apoyo\ndel SENARA, el ICAA y las comunidades, debe realizar el proceso de\nlevantamiento y cierre de los pozos realizados sin permiso; 3) el ICAA debe\ndefinir la demanda real de cada sistema de acueducto de las ASADAS y la oferta\nde agua que disponen, además de promover la implementación de las mejoras en\nlos sistemas de acueductos para reducir las pérdidas; 4) se continuará con el\nmonitoreo sistemático, mensual y se reforzará con la implementación de la red\nautomatizada del proyecto Sistema de Monitoreo de Aguas Subterráneas en Tiempo Real;\n5) el ICAA, a través del Laboratorio Nacional de Aguas, monitoreará de forma\nperiódica, cada 6 meses, la calidad de las aguas; 6) acompañamiento de las\nuniversidades a los procesos de investigación; 7) continuar con el análisis\nperiódico y sistemático de la información para control del comportamiento del\nacuífero; 8) el SENARA implementará un Plan de Aprovechamiento Sostenible del acuífero\nSardinal, con una amplia participación social; 9) reactivar la Comisión de\nAcompañamiento Plan de Monitoreo Acuífero Sardinal, con el fin de garantizar a\nlos habitantes de la localidad de Sardinal y comunidades vecinas un continuo y\neficiente servicio de agua potable para satisfacer sus necesidades más\nbásicas\".\n\nV.-Que cada una de las acciones anteriores se ha venido desarrollando en\nforma sistemática y continua, presentado el avance y resultados a las\ncomunidades relacionadas y actores sociales interesados.\n\nVI.-Que desde el año 2014 en el marco del Programa Integral de Abastecimiento\nde Agua para Guanacaste - Pacífico Norte conocido como PIAAG, se han venido\ngenerando acciones conjuntas por medio de una comisión integrada por\ninstituciones públicas competentes, empresa privada, organismos no\ngubernamentales, ASADAS de la región, entre otros, para el manejo sostenible\ndel acuífero Sardinal, además del seguimiento de avance del Acueducto Sardinal\n- El Coco - Ocotal propiedad de AyA.\n\nVII.-Que conforme a la Ley de Aguas Nº 276, en concordancia con Ley\nForestal Nº 7575 y la Ley Orgánica del Ambiente Nº 7554, el Estado debe\nprevenir el riesgo de contaminación y degradación de las aguas, para lo cual el\nPoder Ejecutivo debe dictar las medidas que juzgue oportunas, buscando una\ncolaboración y cooperación entre los distintos actores y sectores.\n\nVIII.-Que la Sala Constitucional mediante Resolución N° 2004-01923 de\nlas catorce horas cincuenta y cinco minutos del veinticinco de febrero de dos\nmil cuatro, ha definido que el Estado en aras de conservar el recurso y su\nentorno, conforme con la autoridad originaria que deriva de la Constitución\nPolítica, dicte las acciones y medidas, para ejercer el control, consulta y\ncoordinación que resulten necesarias en la vigilancia de los acuíferos y el uso\nracional del recurso hídrico.\n\nIX.-Que de conformidad con el Reglamento a la Ley de Protección al\nCiudadano del Exceso de Requisitos y Trámites Administrativos, Decreto\nEjecutivo Nº 37045-MP-MEIC y sus reformas, se determinó que la presente\npropuesta no establece ni modifica trámites, requisitos o procedimientos, que\nel administrado deba cumplir, situación por la que no se procedió con el\ntrámite de control previo. Por tanto;\n\nDecretan:\n\n\"CREACIÓN DE LA COMISIÓN PARA EL MANEJO\n\nINTEGRADO DE LOS ACUÍFEROS EN EL DISTRITO\n\nDE SARDINAL, CANTÓN CARRILLO, GUANACASTE\"\n\nArtículo 1º-Créase la Comisión para el Manejo Integrado de los Acuíferos\nen el Distrito de Sardinal, Guanacaste, cuyo ámbito de acción estará delimitado\ngeográficamente a los acuíferos Sardinal, Panamá, El Coco-Ocotal, Hermosa y los\nubicados en las comunidades de San Blas y La Libertad, todos dentro del\nDistrito Sardinal, Cantón de Carrillo, Guanacaste.\n\n \n\n Ficha articulo\n\nArtículo 2º-La Comisión tendrá los siguientes objetivos:\n\na) Promover la coordinación entre actores para el manejo integral de los\nacuíferos citados en el artículo 1, en un escenario de equilibrio entre las\nnecesidades de la población y la preservación del recurso hídrico, a través del\nuso racional, capacitación y participación ciudadana.\n\nb) Facilitar la participación coordinada para el aprovechamiento prioritario\ndel recurso hídrico para el consumo humano y sus relaciones directas con el\ndesarrollo social y económico del distrito Sardinal, Guanacaste; de conformidad\ncon los estudios técnicos y científicos que garanticen la demanda actual y\nfutura, así como su necesaria relación con la oferta hídrica de los acuíferos.\n\nc) Emitir recomendaciones a las instituciones competentes para la\ncanalización de los recursos de infraestructura, técnicos y financieros con el\nfin de realizar de manera efectiva la ejecución de acciones que promuevan el\nmanejo integral de los acuíferos.\n\n \n\n Ficha articulo\n\nArtículo 3º-La Comisión estará integrada por las siguientes representaciones:\n\na) Un representante del Ministerio de Ambiente y Energía.\n\nb) Un representante del Ministerio de Salud.\n\nc) Un representante del Instituto Costarricense de Acueductos y Alcantarillados.\n\nd) Un representante del Servicio Nacional de Aguas Subterráneas, Riego y\nAvenamiento.\n\ne) Un representante del Instituto Costarricense de Turismo.\n\nf) Un representante del Instituto de Desarrollo Rural.\n\ng) Un representante de la Municipalidad de Carrillo.\n\nh) Un representante de cada una de las Asociaciones de Desarrollo\nIntegral del Distrito Sardinal, Guanacaste.\n\ni) Un representante de cada una de las Asociaciones Administradoras de\nSistemas de Acueductos y Alcantarillados Comunales del Distrito de Sardinal,\nGuanacaste, y que hayan suscrito el convenio de delegación con el Instituto Costarricense\nde Acueductos y Alcantarillados.\n\nj) Un representante designado por cada uno de los siguientes sectores\npor parte de la Cámara respectiva: Agrícola, Turístico, Comercial, Ganadero y\nPesquero del distrito de Sardinal, Guanacaste.\n\nk) Un representante de una organización ambiental de la sociedad civil,\ncon presencia demostrada en el distrito Sardinal.\n\nLas personas que integren la Comisión no percibirán dietas, ni ninguna\notra remuneración como consecuencia de esta función.\n\n \n\n Ficha articulo\n\nArtículo 4º-Los miembros de las entidades no gubernamentales, deberán\nser designados por el órgano competente de la entidad que representan y\ncomunicarlo mediante nota escrita, al coordinador de la Comisión.\n\n \n\n Ficha articulo\n\nArtículo 5º-Los miembros de las instituciones estatales que conformen la\nComisión, deberán ser designados por sus respectivos jerarcas, quienes por\nescrito lo deberán comunicar al coordinador de la Comisión.\n\n \n\n Ficha articulo\n\nArtículo 6º-La Comisión será coordinada por el representante del\nMinisterio de Ambiente y Energía, designado por el señor Ministro, quién tendrá\nla facultad de convocatoria por iniciativa propia. La Comisión también podrá\nser convocada por al menos cinco de sus miembros, en forma conjunta.\n\nLa Comisión se reunirá al menos dos veces al año y tendrá como domicilio\npara sesionar en cualquiera de las comunidades en su ámbito de acción. Las\nsesiones se llevarán a cabo con al menos ocho miembros presentes y las\ndecisiones se tomarán por mayoría simple de votos presentes y en caso de empate\nel coordinador tendrá la facultad de ejercer el voto de calidad.\n\n \n\n Ficha articulo\n\nArtículo 7º-La Comisión tendrá las siguientes funciones:\n\na) Buscar a través de sus miembros, o mediante otras personas físicas o\njurídicas interesadas, la obtención de recursos para lograr el financiamiento,\nimplementación del \"Plan de Aprovechamiento Sostenible del Acuífero\", así como\nel desarrollo de obras que permitan la adecuada disposición de las aguas\nresiduales y su potencial reúso.\n\nb) Participar en el desarrollo de planes, programas y proyectos que\nrespondan al manejo integral de los acuíferos en su ámbito de gestión\ndispuesto.\n\nc) Desarrollar propuestas de soluciones ante problemáticas de uso\nrazonable con el ambiente, protección y vigilancia de los acuíferos.\n\nd) Pronunciarse ante la formulación de legislación que impacte la\ngestión y aprovechamiento eficiente y sostenible del agua.\n\ne) Emitir recomendaciones no vinculantes al Poder Ejecutivo e\nInstituciones Competentes en la Protección y Manejo del Recurso Hídrico en los\nacuíferos en el ámbito de gestión dispuesto.\n\nf) Efectuar las recomendaciones a las instituciones competentes para que\nse canalicen los recursos de infraestructura, técnicos y financieros, para\napoyar de manera efectiva la ejecución de acciones que promuevan el manejo\nintegral de estos acuíferos.\n\ng) Participar en el análisis, propuesta de soluciones y seguimiento a\nlos diferentes problemas puntuales que se presenten.\n\n \n\n Ficha articulo\n\nArtículo 8º-Para el cumplimiento de las funciones se constituye el\nComité de Coordinación y Administración que tendrá las siguientes funciones:\n\na) Formular el Plan de trabajo anual y someter a aprobación de la Comisión.\n\nb) Ejecutar el Plan de trabajo anual y brindar a la Comisión informes al\nrespecto.\n\nc) Atender las labores administrativas, así como el seguimiento y\ncontrol de acuerdos de la Comisión.\n\n \n\n Ficha articulo\n\nArtículo 9º-El Comité de Coordinación y Administración de la Comisión,\nestará integrada por nueve miembros de la Comisión, cinco miembros permanentes\ny cuatro miembros nombrados por periodos de dos años, los cuales se designarán\nde la siguiente manera:\n\na) Miembros permanentes:\n\n1. El representante del Ministerio de Ambiente y Energía, quien\ncoordinará.\n\n2. El representante del Ministerio de Salud.\n\n3. El representante del Instituto Costarricense de\n\nAcueductos y Alcantarillados.\n\n4. El representante del Servicio Nacional de Aguas Subterráneas, Riego y\nAvenamiento.\n\n5. El Representante de la Municipalidad de Carillo.\n\nb) Los otros cuatro miembros se designarán entre los demás integrantes\nde la Comisión, por votación de mayoría simple, no pudiendo reelegirse por\nperíodos consecutivos, a fin de dar oportunidad a miembros de otras\norganizaciones y sectores.\n\n \n\n Ficha articulo\n\nArtículo 10.-El Comité de Coordinación y Administración tendrá como\ndomicilio para sesionar en cualquiera de las comunidades en su ámbito de acción\ny se reunirá una vez al mes. Podrá solicitar la participación y colaboración de\notras instituciones centralizadas o descentralizadas del Estado,\nMunicipalidades, organismos internacionales u organizaciones no gubernamentales\ny comunales. This Committee\ncarried out the Water Balance of this Sardinal aquifer and has been monitoring\nits behavior; also, in February 2016, with the technical support of the\nUniversity of Costa Rica, it carried out the analysis of this aquifer's behavior\nduring the 2014-2016 drought; results that have been presented to the related\ncommunities and interested social actors.\n\nIV.-That through resolution No. 2017-001163 at nine hours forty\nminutes on January twenty-seventh, two thousand seventeen, the Constitutional Chamber\nrecalled the recommendations given by the Interinstitutional Technical Commission,\nrelated to the aquifer after the analysis carried out in February 2016,\ncalled \"Impact of the Drought on the Sardinal Aquifer 2015,\" namely: 1) the\nWater Directorate of MINAE will implement the order to install control systems such\nas flow meters in wells with authorized use\n(concession) to regulate extraction; 2) the Water Directorate, with the support\nof SENARA, the ICAA and the communities, must carry out the process of\nsurveying and closing wells drilled without permission; 3) the ICAA must\ndefine the real demand of each ASADAS aqueduct system and the water supply\nthey have available, in addition to promoting the implementation of improvements in\nthe aqueduct systems to reduce losses; 4) systematic, monthly monitoring will continue\nand will be reinforced with the implementation of the automated\nnetwork of the Real-Time Groundwater Monitoring System project;\n5) the ICAA, through the National Water Laboratory, will periodically monitor,\nevery 6 months, the water quality; 6) support from\nuniversities for research processes; 7) continue with the periodic\nand systematic analysis of information for controlling the aquifer's\nbehavior; 8) SENARA will implement a Sustainable Use Plan for the Sardinal\naquifer, with broad social participation; 9) reactivate the\nSardinal Aquifer Monitoring Plan Support Commission, in order to guarantee the\ninhabitants of the locality of Sardinal and neighboring communities a continuous and\nefficient potable water service to satisfy their most basic\nneeds.\"\n\nV.-That each of the preceding actions has been developed in a\nsystematic and continuous manner, presenting the progress and results to the\nrelated communities and interested social actors.\n\nVI.-That since 2014, within the framework of the Comprehensive Water Supply\nProgram for Guanacaste - North Pacific known as PIAAG, joint actions have been\ngenerated through a commission composed of\ncompetent public institutions, private companies, non-governmental\norganizations, ASADAS of the region, among others, for the sustainable management\nof the Sardinal aquifer, in addition to monitoring the progress of the Sardinal\n- El Coco - Ocotal Aqueduct owned by AyA.\n\nVII.-That in accordance with the Water Law No. 276, in concordance with the Forestry\nLaw No. 7575 and the Organic Environmental Law No. 7554, the State must\nprevent the risk of contamination and degradation of waters, for which the\nExecutive Branch must dictate the measures it deems appropriate, seeking\ncollaboration and cooperation between the different actors and sectors.\n\nVIII.-That the Constitutional Chamber, through Resolution No. 2004-01923 at\nfourteen hours fifty-five minutes on February twenty-fifth, two thousand\nfour, has defined that the State, in order to conserve the resource and its\nsurroundings, in accordance with the original authority derived from the Political\nConstitution, dictates the actions and measures, to exercise the control, consultation and\ncoordination that are necessary for the surveillance of aquifers and the rational\nuse of the water resource.\n\nIX.-That in accordance with the Regulation to the Law for the Protection of the\nCitizen from Excessive Administrative Requirements and Procedures, Executive\nDecree No. 37045-MP-MEIC and its amendments, it was determined that this\nproposal does not establish or modify procedures, requirements or formalities that\nthe administered party must comply with, a situation for which the\nprior control procedure was not carried out. Therefore;\n\nDecree:\n\n\"CREATION OF THE COMMISSION FOR THE INTEGRATED\n\nMANAGEMENT OF AQUIFERS IN THE DISTRICT\n\nOF SARDINAL, CANTON OF CARRILLO, GUANACASTE\"\n\nArticle 1.-The Commission for the Integrated Management of Aquifers\nin the District of Sardinal, Guanacaste is created, whose scope of action shall be geographically\ndelimited to the Sardinal, Panamá, El Coco-Ocotal, Hermosa aquifers and those\nlocated in the communities of San Blas and La Libertad, all within the\nDistrict of Sardinal, Canton of Carrillo, Guanacaste.\n\n \n\n Article record\n\nArticle 2.-The Commission shall have the following objectives:\n\na) Promote coordination among actors for the integral management of the\naquifers cited in Article 1, in a scenario of balance between the\nneeds of the population and the preservation of the water resource, through\nrational use, training and citizen participation.\n\nb) Facilitate coordinated participation for the priority use\nof the water resource for human consumption and its direct relationships with the\nsocial and economic development of the district of Sardinal, Guanacaste; in accordance\nwith the technical and scientific studies that guarantee current and\nfuture demand, as well as its necessary relationship with the water supply of the aquifers.\n\nc) Issue recommendations to the competent institutions for the\nchanneling of infrastructure, technical and financial resources in order\nto effectively carry out actions that promote the\nintegral management of the aquifers.\n\n \n\n Article record\n\nArticle 3.-The Commission shall be composed of the following representatives:\n\na) One representative of the Ministry of Environment and Energy.\n\nb) One representative of the Ministry of Health.\n\nc) One representative of the Costa Rican Institute of Aqueducts and Sewers.\n\nd) One representative of the National Groundwater, Irrigation and\nDrainage Service.\n\ne) One representative of the Costa Rican Tourism Institute.\n\nf) One representative of the Rural Development Institute.\n\ng) One representative of the Municipality of Carrillo.\n\nh) One representative of each of the Comprehensive Development\nAssociations of the District of Sardinal, Guanacaste.\n\ni) One representative of each of the Administrative Associations of\nCommunal Aqueduct and Sewer Systems of the District of Sardinal,\nGuanacaste, which have signed a delegation agreement with the Costa Rican Institute\nof Aqueducts and Sewers.\n\nj) One representative designated by each of the following sectors,\nby the respective Chamber: Agricultural, Tourism, Commercial, Livestock and\nFishing of the district of Sardinal, Guanacaste.\n\nk) One representative of a civil society environmental organization,\nwith demonstrated presence in the district of Sardinal.\n\nThe persons who make up the Commission shall not receive per diem payments, nor any\nother remuneration as a consequence of this function.\n\n \n\n Article record\n\nArticle 4.-The members from non-governmental entities must\nbe designated by the competent body of the entity they represent and\ncommunicate this by written note to the coordinator of the Commission.\n\n \n\n Article record\n\nArticle 5.-The members of the state institutions that make up the\nCommission must be designated by their respective heads, who\nmust communicate this in writing to the coordinator of the Commission.\n\n \n\n Article record\n\nArticle 6.-The Commission shall be coordinated by the representative of the\nMinistry of Environment and Energy, designated by the Minister, who shall have\nthe power to convene on their own initiative. The Commission may also\nbe convened by at least five of its members, jointly.\n\nThe Commission shall meet at least twice a year and shall have as its domicile\nfor meeting any of the communities within its scope of action. The\nsessions shall be held with at least eight members present and\ndecisions shall be taken by a simple majority vote of those present, and in case of a tie\nthe coordinator shall have the power to cast the deciding vote.\n\n \n\n Article record\n\nArticle 7.-The Commission shall have the following functions:\n\na) Seek, through its members or through other interested natural or\nlegal persons, the procurement of resources to achieve the financing,\nimplementation of the \"Plan for the Sustainable Use of the Aquifer,\" as well\nas the development of works that allow the adequate disposal of wastewater\nand its potential reuse.\n\nb) Participate in the development of plans, programs and projects that\nrespond to the integral management of the aquifers within its established\nmanagement scope.\n\nc) Develop solution proposals for issues of reasonable use\ncompatible with the environment, protection and surveillance of the aquifers.\n\nd) Issue opinions on the formulation of legislation that impacts the\nefficient and sustainable management and use of water.\n\ne) Issue non-binding recommendations to the Executive Branch and\nCompetent Institutions on the Protection and Management of the Water Resource in the\naquifers within the established management scope.\n\nf) Make recommendations to the competent institutions so that\ninfrastructure, technical and financial resources are channeled, to\neffectively support the execution of actions that promote the integral\nmanagement of these aquifers.\n\ng) Participate in the analysis, proposal of solutions and follow-up\nto the different specific problems that arise.\n\n \n\n Article record\n\nArticle 8.-For the fulfillment of the functions, the\nCoordination and Administration Committee is constituted, which shall have the following functions:\n\na) Formulate the annual Work Plan and submit it for approval by the Commission.\n\nb) Execute the annual Work Plan and provide the Commission with reports in\nthis regard.\n\nc) Attend to administrative tasks, as well as the follow-up and\ncontrol of the Commission's agreements.\n\n \n\n Article record\n\nArticle 9.-The Coordination and Administration Committee of the Commission,\nshall be composed of nine members of the Commission, five permanent members\nand four members appointed for periods of two years, who shall be designated\nin the following manner:\n\na) Permanent members:\n\n1. The representative of the Ministry of Environment and Energy, who\nshall coordinate.\n\n2. The representative of the Ministry of Health.\n\n3. The representative of the Costa Rican Institute of\n\nAqueducts and Sewers.\n\n4. The representative of the National Groundwater, Irrigation and\nDrainage Service.\n\n5. The Representative of the Municipality of Carillo.\n\nb) The other four members shall be designated from among the other members\nof the Commission, by simple majority vote, and may not be reelected for\nconsecutive periods, in order to give opportunity to members of other\norganizations and sectors.\n\n \n\n Article record\n\nArticle 10.-The Coordination and Administration Committee shall have as its\ndomicile for meeting any of the communities in its scope of action\nand shall meet once a month. It may request the participation and collaboration of\nother centralized or decentralized State institutions,\nMunicipalities, international organizations or non-governmental\nand communal organizations. Said guests attending the sessions shall do so with the right\nto speak, but without vote.\n\n \n\n Article record\n\nArticle 11.-For the fulfillment of its objectives, the Coordination and\nAdministration Committee of the Commission may request the participation and\ncollaboration of international environmental and financial organizations, based\nin the country or abroad, for which strict\nadherence to the legislation in force on the matter must be observed.\n\n \n\n Article record\n\nArticle 12.-The Commission shall have a period of six months, counted\nfrom the publication of this Decree, to issue its procedural\nmanual to operationalize the specific functions of each of the\nbodies.\n\n \n\n Article record\n\nArticle 13.-The Administration of financial resources for the\nfulfillment of the purposes of this body shall be the responsibility of the\nInstitutions that are members of this Commission, in accordance with their competencies.
