  "body_es_text": "Recuerde que Control F es una opción que le permite buscar en la totalidad del texto\n\n\nIr al final del documento\n\n- Usted está en la última versión de la norma -\n\nReforma Reglamento para la perforación de pozos y aprovechamiento de aguas subterráneas\n\n\n\n\n\n\nN°43712-MINAE\n\n\n\n\n\nEL PRESIDENTE DE LA REPÚBLICA Y\n\n\n\n\n\nEL MINISTRO DE AMBIENTE Y ENERGÍA\n\n\n\n\n\nEn uso de las facultades que les confieren los artículos 50, 140 incisos 3) y 18), y 146 de la\nConstitución Política; artículos 27 inciso 1) y 28 inciso 2) acápite b) de la Ley General de la\nAdministración Pública N06227 del 2 de mayo de 1978; artículo 177 de la Ley de Aguas N0276 del 27 de\nagosto de 1942; y el artículo 50 de la Ley Orgánica del Ambiente N°7554 del 4 de octubre de 1995.\n\n\n\n\n\nConsiderando:\n\n\n\n\n\nI.-Que de conformidad con la Ley de Aguas N°276, en sus artículos 17, 21, 27, 176, 177 y 178, el\nMinisterio de Ambiente y Energía es el ente rector del agua a nivel nacional y le corresponde\ndisponer sobre su dominio, aprovechamiento, utilización, gobierno y vigilancia de estas; lo cual\nrealiza por medio de su Dirección de Agua conforme al Decreto Ejecutivo N° 35669-MINAE del 04 de\ndiciembre de 2009, denominado \"Reglamento Orgánico del Ministerio de Ambiente y Energía\".\n\n\n\n\n\nII.-Que la Ley N°5516 del 2 de mayo de 1974 denominada \"Reforma artículos 131 a 135 Ley de Aguas de\n1942\", establece en su artículo 2°, que para facilitar las atribuciones de dominio, gobierno y\nvigilancia de las aguas de dominio público que corresponde al Ministerio de Ambiente y Energía, éste\nllevará un registro para la inscripción de las personas o empresas que tengan como actividad la\nperforación de pozos y no dará licencia para perforar a quienes no estén inscritos en el mencionado\nregistro.\n\n\n\n\n\nIII.-Que de conformidad con el artículo 50 de la Ley Orgánica del Ambiente N°7554, el agua es de\ndominio público, y su conservación y uso sostenible son de interés social.\n\n\n\n\n\nIV.-Que de conformidad con el Reglamento Orgánico del Ministerio de Ambiente y Energía, Decreto\nEjecutivo N°35669- MINAE, corresponde a la Dirección de Agua del Ministerio de Ambiente y Energía,\nadmitir, tramitar y resolver sobre solicitudes de perforación del subsuelo para la exploración y\nexplotación de aguas subterráneas y asignar el número de pozo respectivo, asimismo, le corresponde\noperar y mantener el registro de perforadoras de pozos.\n\n\n\n\n\nV.-Que como parte de un proceso continuo de mejora regulatoria y la oportunidad de permitir mayor\ndisponibilidad para atender otros quehaceres sustantivos de la Dirección de Agua, como es la\nvigilancia y administración del agua encampo, se han ajustado y disminuido los procesos y plazos,\ntanto para la Administración como para el administrado, facilitando el trámite, pero con valor\nagregado en su control y seguimiento.\n\n\n\n\n\nVI.-Que con fundamento en el análisis jurídico emitido mediante oficio DA-2460-08-2022 del 12 de\nagosto de 2022 de la Dirección de Agua, procede la derogatoria del artículo 54 del Reglamento para\nla perforación de pozos y aprovechamiento de aguas subterráneas, Decreto Ejecutivo N°43053-MINAE del\n22 de abril de 2021.\n\n\n\n\n\nVII.-Que, de conformidad con el Reglamento a la Ley de Protección al Ciudadano del Exceso de\nRequisitos y Trámites Administrativos, Decreto Ejecutivo N°37045-MPMEIC y sus reformas, se determinó\nque la presente propuesta no establece ni modifica trámites, requisitos o procedimientos, que el\nadministrado deba cumplir, situación por la que no se procedió con el trámite de control previo.   "body_en_text": "Remember that Control F is an option that allows you to search the entire text\n\nGo to the end of the document\n\n- You are viewing the latest version of the regulation -\n\nReform of the Regulation for the drilling of wells and use of groundwater\n\nN°43712-MINAE\n\nTHE PRESIDENT OF THE REPUBLIC AND\n\nTHE MINISTER OF ENVIRONMENT AND ENERGY\n\nExercising the powers conferred by Articles 50, 140 subsections 3) and 18), and 146 of the\nPolitical Constitution; Articles 27 subsection 1) and 28 subsection 2) paragraph b) of the General Law of\nPublic Administration N06227 of May 2, 1978; Article 177 of the Water Law N0276 of August 27,\n1942; and Article 50 of the Organic Law of the Environment N°7554 of October 4, 1995.\n\nConsidering:\n\nI.—That in accordance with the Water Law N°276, in its Articles 17, 21, 27, 176, 177 and 178, the\nMinistry of Environment and Energy is the governing body for water at the national level and is responsible\nfor ruling on its ownership, use, utilization, governance, and monitoring; which it carries out\nthrough its Water Directorate pursuant to Executive Decree N° 35669-MINAE of December 4,\n2009, entitled \"Organic Regulation of the Ministry of Environment and Energy.\"\n\nII.—That Law N°5516 of May 2, 1974, entitled \"Reform of Articles 131 to 135 of the Water Law of\n1942,\" establishes in its Article 2°, that to facilitate the powers of ownership, governance, and\nmonitoring of public-domain waters vested in the Ministry of Environment and Energy, it\nshall maintain a registry for the registration of persons or companies engaged in the\ndrilling of wells and shall not issue a license to drill to those not registered in said\nregistry.\n\nIII.—That in accordance with Article 50 of the Organic Law of the Environment N°7554, water is\npublic domain, and its conservation and sustainable use are of social interest.\n\nIV.—That in accordance with the Organic Regulation of the Ministry of Environment and Energy, Executive\nDecree N°35669-MINAE, the Water Directorate of the Ministry of Environment and Energy is responsible\nfor receiving, processing, and resolving applications for subsurface drilling for the exploration and\nexploitation of groundwater and assigning the respective well number; likewise, it is responsible\nfor operating and maintaining the registry of well drilling companies.\n\nV.—That as part of an ongoing process of regulatory improvement and the opportunity to allow greater\navailability to address other substantive tasks of the Water Directorate, such as the\nmonitoring and administration of water in the field, the processes and timeframes have been adjusted and reduced,\nboth for the Administration and for the regulated party, facilitating the procedure, but with added\nvalue in its control and follow-up.\n\nVI.—That based on the legal analysis issued via official communication DA-2460-08-2022 of August 12,\n2022, from the Water Directorate, the repeal (derogatoria) of Article 54 of the Regulation for\nthe drilling of wells and use of groundwater, Executive Decree N°43053-MINAE of\nApril 22, 2021, is appropriate.\n\nVII.—That, in accordance with the Regulation to the Law for the Protection of Citizens from Excessive\nAdministrative Requirements and Procedures, Executive Decree N°37045-MPMEIC and its amendments, it was determined\nthat this proposal does not establish or modify procedures, requirements, or formalities that\nthe regulated party must comply with, a situation for which the prior control procedure was not undertaken.
