La Sala Constitucional analiza una acción de inconstitucionalidad contra los artículos 70 al 75 de la Ley de Planificación Urbana en relación con la obligación de obtener autorización municipal para segregaciones y urbanizaciones. El accionante alega violación de los artículos 169 y 170 constitucionales (autonomía municipal) y del artículo 50 (derecho a un ambiente sano), así como de la Ley Forestal 7575, al aplicar las mismas reglas de fraccionamiento a todo tipo de suelo, incluyendo zona marítimo-terrestre y bosque, sin considerar particularidades ecológicas. La Sala rechaza la acción por el fondo: considera que la intervención municipal en estos procesos es una medida de policía urbanística y ambiental legítima, que no invade la zona marítimo-terrestre (excluida de la propiedad privada), y que no existe competencia del INVU en esas zonas. Tampoco encuentra violación de la autonomía municipal, ya que la exigencia de visado previo responde a un interés público. La sentencia reafirma la constitucionalidad del control municipal en materia de fraccionamientos y urbanizaciones, incluso en áreas ecológicamente sensibles como bosques y costas, siempre que no se afecte el régimen especial de dominio público.

IX.- This Chamber does not find that the questioned norms violate the Principle of Municipal Autonomy enshrined in Article 170 of the Constitution; on the contrary, municipal intervention in urbanization (segregation) or construction processes responds to a general public interest, insofar as it constitutes a manifestation of municipal police power; in the case of the maritime-terrestrial zone, as indicated, since it is not part of private property, the contested provisions are not applicable. X.- Consequently, the challenged norms are not unconstitutional for the reasons invoked and do not violate Article 50 of the Constitution or the municipal autonomy enshrined in Articles 169 and 170 ibidem, and therefore the claim must be dismissed in its entirety.
