De conformidad con lo dispuesto en los artículos 15, 16, 17 y 28 de la Ley de Planificación Urbana, es obligación de toda municipalidad la creación de un Plan Regulador. Aunque éste no exista para el cantón o para el distrito, sí resulta obligatorio visar los planos de toda nueva construcción o fraccionamiento. No obstante, cuando el inmueble se ubica en zona rural y no existe Plan Regulador para el lugar, se requiere como condición indispensable para otorgar el visado, que la municipalidad realice las prevenciones y estudios que garanticen que el proyecto no se ubica en zona de riesgo o de protección, en resguardo del interés público y del derecho a un ambiente sano.

In accordance with the provisions of articles 15, 16, 17 and 28 of the Urban Planning Law, every municipality has the obligation to create a Regulatory Plan. Even if such a plan does not exist for the canton or district, it is mandatory to approve the plans for any new construction or subdivision. However, when the property is located in a rural area and there is no Regulatory Plan for the location, an indispensable condition for granting approval is that the municipality conducts the necessary warnings and studies to guarantee that the project is not located in a risk or protection zone, in protection of the public interest and the right to a healthy environment.
