Español (source)En el caso en concreto, la acción se dirige contra el artículo 63 de la Ley Forestal, que dispone: 'Artículo 63.- Todo aquel que infrinja las normas de protección de los recursos forestales será sancionado, según la gravedad de la infracción, con multa de...'. No obstante, del análisis del expediente se desprende que el accionante en realidad cuestiona la totalidad de la Ley Forestal, al considerar que ésta es contraria al derecho de propiedad. La Sala, por mayoría, considera que la norma impugnada no es inconstitucional, por cuanto el derecho a un ambiente sano y ecológicamente equilibrado, consagrado en el artículo 50 de la Constitución Política, es un derecho fundamental que puede limitar, en ciertos casos, el ejercicio del derecho de propiedad, siempre que dicha limitación sea razonable y proporcional. La protección del ambiente, incluyendo los recursos forestales, constituye un fin constitucionalmente legítimo que justifica las restricciones impuestas por la Ley Forestal.
English (translation)In the specific case, the action is directed against article 63 of the Forestry Law, which states: 'Article 63.- Any person who violates the rules for the protection of forest resources shall be sanctioned, according to the severity of the infraction, with a fine of...'. However, from the analysis of the file it appears that the plaintiff is actually questioning the entirety of the Forestry Law, considering it contrary to the right to property. The Chamber, by majority, considers that the challenged rule is not unconstitutional, since the right to a healthy and ecologically balanced environment, enshrined in article 50 of the Political Constitution, is a fundamental right that can limit, in certain cases, the exercise of the right to property, provided that such limitation is reasonable and proportionate. The protection of the environment, including forest resources, constitutes a constitutionally legitimate purpose that justifies the restrictions imposed by the Forestry Law.
