La Sala examinó si la omisión administrativa constituía una amenaza a los recursos forestales y, tras valorar las pruebas, declaró con lugar el amparo. Ordenó al SINAC y a la fiscalía agrario-ambiental tomar las medidas de protección necesarias, investigar los hechos y restaurar el daño causado al ecosistema.
