La Sala Constitucional conoció un recurso de amparo interpuesto contra el Sistema Nacional de Áreas de Conservación (SINAC) y el Área de Conservación Central (ACC) por la presunta omisión en proteger los recursos naturales dentro de la Zona Protectora Tivives, específicamente ante una tala de árboles realizada en una propiedad privada sin los permisos correspondientes. El recurrente alegó que las autoridades no actuaron para detener la corta ni para restaurar el daño. La Sala analizó el marco normativo aplicable, incluyendo la Ley Forestal y la Ley Orgánica del Ambiente, y determinó que los recurridos sí habían realizado actuaciones administrativas, pero que estas no fueron suficientes para cumplir con su deber de protección. En consecuencia, declaró con lugar el recurso, ordenando al SINAC y al ACC adoptar todas las medidas necesarias para la restauración del área afectada y para garantizar la protección efectiva de la Zona Protectora Tivives, conforme a la legislación ambiental y forestal vigente.

The appeal is granted. Erick Herrera Quesada, in his capacity as Executive Director of the National System of Conservation Areas (SINAC), and Gustavo Solano Jiménez, in his capacity as Director of the Central Conservation Area (ACC), or whoever holds their positions, are ordered to immediately and in a coordinated manner, adopt all necessary measures to restore and compensate the environmental damage caused in the Tivives Protected Zone as a result of illegal tree felling, as well as to ensure effective compliance with the regulations protecting said zone. The foregoing, under the principle of irreducibility of the forest and the right to a healthy and ecologically balanced environment.
