La Sala Constitucional analizó un recurso de amparo presentado por un grupo de vecinos contra la tala de árboles en la finca del proyecto ‘La Cusinga Golf’, ubicada en Quebrada Ganado, con relictos de bosque tropical transición a seco. Los recurrentes alegaron violación al derecho a un ambiente sano y ecológicamente equilibrado. La Sala recordó que ese derecho, reconocido en el artículo 50 constitucional, es un bien jurídico supraindividual, tutelable mediante amparo por cualquier persona, sin necesidad de demostrar lesión personal directa. En este caso, constató que los permisos de aprovechamiento forestal fueron emitidos por la autoridad competente, y que las actividades de tala se estaban realizando conforme a esos permisos. No se acreditó un acto arbitrario o ilegal por parte de las autoridades recurridas ni de la empresa. La Sala concluyó que no se produjo violación alguna a los derechos fundamentales invocados y declaró SIN LUGAR el recurso.
