SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas cincuenta minutos del veintisiete de febrero de dos mil veinticuatro .

Gestión posterior planteada por [Nombre 001], en relación con la sentencia nro. 2021017825 de las 9:20 horas de 13 de agosto de 2021.

Resultando:

1.- Por escrito incorporado en el expediente electrónico el 17 de enero de 2024, el recurrente interpone gestión posterior en relación con la sentencia  nro. 2021017825 de las 9:20 horas de 13 de agosto de 2021. Manifiesta que: “NO HA SIDO ATENDIDA EN SU TOTALIDAD. Lo ofrecido por el ente municipal solo fue atendido de manera parcial en el año 2021 y parte del año 2022; sin embargo a finales del año 2022 y todo el año 2023 no continuaron con la atención de la problemática, es decir el cronograma de limpieza y de seguridad en la zona NO SOLUCIONO (sic) DEFINITIVAMENTE la situación; además el Área Rectora de Salud Pública de Santa Cruz no le dio seguimiento al Plan Remedial propuesto, ni atendió de forma efectiva el asunto con las ordenes (sic) sanitarias que procuraran la atención de depósitos de residuos en dicha vía, obviando su deber de fiscalizar las medidas propuestas por el ente municipal. Por este medio informamos que la calle vieja hacia Santa Bárbara, ubicada a tan solo un kilómetro de las oficinas centrales de la Municipalidad de Santa Cruz continúa recibiendo grandes cantidades basura de varios tipos, ahora se está viendo afectada una naciente de agua que pasa por dicha calle con el depósito de recipientes de almacenamiento de grasas de cocina u otros; así también su acceso se ha deteriorado, los planes de vigilancia (cámara de monitoreo y vigilancia policial) no funcionan desde finales del año 2022, convirtiendo nuevamente el sitio en una zona insalubre y peligrosa donde existe un gran peligro a la salud pública de los vecinos de Campero. Valorando las omisiones de la Jefatura del Departamento de Gestión Ambiental, la Presidencia del Concejo Municipal, el señor Alcalde del cantón y ademas (sic) el olvido por parte de la Dirección del Área Rectora del Ministerio de Salud solicitamos que se les prevenga por UNICA (sic) VEZ el cumplimiento inmediato de dicha SENTENCIA”.

2.- Mediante resolución de magistrado instructor de las 7:23 horas de 19 de enero de 2024 se confirió audiencia a Warren Chavarría Venegas, en su condición de director del Área Rectora de Salud de Santa Cruz; así como, a Jorge Arturo Alfaro Orias, María Daisy Víquez Zamora y Marisela Moreno Rodríguez, por su orden alcalde, jefa a.i. del Departamento de Gestión Ambiental y presidenta del Concejo Municipal, todos de la Municipalidad de Santa Cruz, para que se refieran y aporten las pruebas correspondientes respecto a los hechos y omisiones que se les atribuyen.

3.- Por escrito incorporado en el expediente electrónico el 25 de enero de 2024, informan Jorge Arturo Alfaro Orias y Maricela Moreno Rodríguez, por su orden alcalde y presidenta del concejo, ambos de la Municipalidad de Santa Cruz, en los siguientes términos: “En Oficio DAM-DGA-PA-0003-2024 del 23 de Enero de 2024 el Señor Manuel Angulo Mora del Departamento de Protección Ambiental, informó a la Coordinadora de Servicios Ambientales Geissel Linet Gutiérrez Marchena, lo siguiente: "El día 23 de enero de 2024 se realizó la campaña de limpieza en el lugar conocido con (sic) la Cuesta, específicamente camino viejo a Santa Barbara, donde encontramos desechos de todo tipo como, por ejemplo, residuos ordinarios, láminas de zinc, plásticos de todo tipo, restos de camas, fregaderos, etc." El oficio indicado continuó mencionando que: "Cabe mencionar que la ejecución del trabajo fue realizado, en un horario de 09:00 a. m., a 12:00 m.d, y realizada por dos funcionarios del Servicio de Servicios Urbanos Ambientales y mi persona. He de indicar que los residuos se trasladaron a el vehículo placa SM 5868, y se dispusieron una cantidad de 1430 kilos, que fueron depositados en el Relleno Sanitario del PTA." Petición: Teniendo a la vista la desobediencia alegada por el recurrente [Nombre 001], pido declarar sin lugar en todos sus extremos, en razón de que la Municipalidad de Santa Cruz ha dado cumplimiento a lo ordenado por esta Sala en Sentencia N°2021017825 de las nueve horas veinte minutos del trece de Agosto de dos mil veintiuno”.

4.- Por escrito incorporado en el expediente electrónico el 26 de enero de 2024, informa Warren Chavarría Venegas, en su condición de director del Área Rectora de Salud del Ministerio de Salud de Santa Cruz. Indica: “I -SOBRE LOS HECHOS PRIMERO- Consta en los folios 00124, 00125 y 00126 del expediente administrativo, Informe Técnico N° MS-RCH-ARS-SC-ERS-IT-0194-2021, el cual en su conclusión indica lo siguiente: “(…) A razón de lo hasta aquí visto mediante inspección en y con las evidencias encontradas se recomienda solicitar informe a la Municipalidad de Santa Cruz, donde ofrezca una descripción de las acciones realizadas después de haberse colocado la cámara de vigilancia ( se encuentra operando dicha cámara, quien es la persona responsable de observar dicha cámara, que acciones se han realizado y en caso de lograr capturar a una persona o vehículo depositando residuos camino o vía pública, ¿Qué sanción o medida se aplica?), también solicitar procederá realizar labores de limpieza y/o mantenimiento de la ruta o vía arriba mencionada)”. SEGUNDO- Consta en el folio 00128 del expediente administrativo oficio DAM-0931-2021, en el cual el Sr. Jorge Arturo Alfaro Orias, alcalde Municipal de Santa Cruz le solicita al departamento de Gestión Ambiental realizar las acciones indicadas en el Informe Técnico N° MS-RCH-ARS-SC-ERS-IT-0194-2021. TERCERO- Consta en el folio 00129 del expediente administrativo, nota dirigida al Dr., Warren Chavarría Venegas, director del Área Rectora de Salud de Santa Cruz, Ministerio de Salud el día 127 (sic) de mayo de 2021, por el Sr. [Nombre 001] la cual indica, que se mantiene la disposición de residuos en la vía pública, y solicita emitir Orden Sanitaria contra el Departamento de Gestión Ambiental y al alcalde de Santa cruz, donde se les ordene limpiar y habilitar la vía pública inmediatamente. CUARTO- Consta en los folios 00135 y 00136 del expediente administrativo Informe Técnico N° MS-RCH-ARS-SC-ERS-IT-0289-2021, emitido por el Bachiller Guillermo Caravaca Martínez del Equipo de Regulación del Area (sic) Rectora de alud (sic) de Santa Cruz, donde en la conclusión, expone “(…) A razón de lo que hasta aquí visto mediante inspeccionen (sic) sitio y con las evidencias encontradas se recomienda GIRAR ORDEN SANITARIA donde se Solicite informe a la municipalidad de Santa Cruz, sobre las acciones según lo solicitado en el Informe Técnico N° MS-RCH-ARS-SC-ERS-IT-0194-2021, también solicitar las (sic) realizar las labores de limpieza y/o mantenimiento de la ruta o vía arriba mencionada a la mayor brevedad posible” QUINTO- En razon (sic) a la recomendación indicada por el Bachiller Guillermo Caravaca Martínez del Equipo de Regulación del Area (sic) Rectora de Salud de Santa Cruz, consta en los folios 00137 y 00138 del expediente administrativo, que el día 08 de junio del 2021, se emite la orden sanitaria N° MS-RCH-ARS-S-ERS-OS-0144-2021, donde entre otras cosas, se ordenó lo siguiente: “1. Realizar la limpieza de dicha ruta en un plazo no mayor a tres (3) días hábiles. 2. Replicar el plan de acciones correctivas propuestas mediante oficio N° DAM-1602-2021-DGA-0350-2019, y al mismo tiempo ampliar la programación de dichas acciones.” SEXTO- Consta en el folio 00140 del expediente administrativo, oficio DAM-1628-2021. Mediante el cual la Licda Dixabeth Matarrita Mendoza, alcaldesa a.i de la Municipalidad de Santa Cruz, solicita al departamento de Gestión Ambiental el cumplimiento de la Orden Sanitaria N° MS-RCH-ARS-S-ERS-OS-0144-2021. SEPTIMO (sic) - Consta en los folios 00142 y 00143 del expediente administrativo, oficio DAM-1852-2021, mediante el cual la Licda Dixabeth Matarrita Mendoza, alcaldesa a.i, le informa al Dr. Warren Chavarría Venegas, director de Área Rectora de Salud de Santa Cruz el cumplimiento de la Orden Sanitaria N° MS-RCH-ARS-S-ERS-OS-0144-2021. OCTAVO- Consta del folio 00159 al folio 00165 del expediente administrativo, oficio DAM-2033-2021, mediante el MSC Jorge Arturo Alfaro Orias alcalde de la Municipalidad de Santa Cruz, presenta al Dr. Warren Chavarría Venegas, director de Área Rectora de Salud de Santa Cruz, el Plan de Intervención Sitio “La cuesta a Santa Bárbara”. NOVENO- Consta del folio 00166 al folio 00169 del expediente administrativo, recurso de amparo, interpuesto por el señor [Nombre 001], contra El (sic) Ministerio Salud y otro. DECIMO (sic)- Consta del folio 00170 al folio 00173 del expediente administrativo Informe Técnico N° MS-RCH-ARS-SCERS-IT-0334-2021, sobre inspección realizada al sitio el día 30 de junio del 2021 por el Bachiller Guillermo Caravaca Martínez del Equipo de Regulación del Area (sic) Rectora de Salud de Santa Cruz, donde se extrae de dicho informe que se llega a la conclusión DAR POR CUMPLIDA LA ORDEN SANITARIA. DECIMO (sic) PRIMERO- Consta del folio 00178 al folio 00181 del expediente administrativo oficio DR-CH-PSJ-A-387-2020, mediante el cual el Dr. Warren Chavarría Venegas, Director de Área Rectora de Salud de Santa Cruz, emite informe sobre el Recurso de Amparo Interpuesto por el señor [Nombre 001], contra el Área Rectora de Salud de Santa Cruz, donde se concluye: “Con lo dicho supra y con las pruebas documentales que se aportan, es evidente y manifiesto que el Area (sic) de Salud de Santa Cruz ha realizado todo lo relacionado con su competencia, ha quedado demostrado que se han atendido todas las denuncias planteadas, e inclusive se le ha venido dando seguimiento a la Orden Sanitaria N° MS-RCH-ARS-S-ERS-OS-0144-2021, donde se ha observado un cumplimiento parcial de parte de la municipalidad de Sata Cruz con respecto al cumplimiento de lo ordenado.”  DECIMO (sic) SEGUNDO- Consta del folio 00190 al folio 00261 del expediente administrativo, la resolucion (sic) número 2021017825 de la Sala Constitucional de la Corte de Suprema Justicia, de las nueve horas con veinte minutos del día 13 de agosto del 2021, sobre el recurso de amparo interpuesto por el señor [Nombre 001], donde se extrae en el por tanto de dicha resolucion (sic)  “Se declara parcialmente con lugar el recurso solo en cuanto a la falta de atención del problema indebida disposición de residuos en el sitio denominado “La Cuesta a Santa Bárbara”. Se ordena a Warren Chavarría Venegas, en su condición de director del Área Rectora de Salud de Santa Cruz, o a quien ocupe ese caso, que gire las órdenes pertinentes y disponga lo necesario a los efectos de que: 1) en el plazo de TRES DÍAS contado a partir de la notificación de esta sentencia, se inspeccione el sitio denominado “La Cuesta a Santa Bárbara” y se determine si el primer punto de la orden sanitaria MS-RCH-ARS-SC-RS-OS-0144-2021 que le impuso a la Municipalidad de Santa Cruz “1. Realizar la limpieza de dicha ruta en un plaza NO mayor a tres (3) días hábiles” fue efectivamente cumplido por ese gobierno local luego de los trabajos que realizó el 10 de julio de 2021 y, en caso de que ello no hubiera ocurrido, deberá llevarse a cabo todas las actuaciones que el ordenamiento jurídico faculta para procurar su cumplimiento; 2) en el plazo de UN MES contado a partir de la notificación de esta sentencia, se analice el plan remedial propuesto por la Municipalidad de Santa Cruz en atención a la orden sanitaria MS-RCH-ARS-SCERS-OS-0144-2021 y se determine si el cronograma y las acciones propuestas constituyen una solución efectiva al problema de salud pública detectado. Asimismo, no solo deberán darle seguimiento al plan remedial, sino que, en caso de que se establezca la necesidad de implementar acciones adicionales, o bien, la modificación de tal plan, deberán dentro del mismo plazo emitir las órdenes sanitarias correspondientes a fin de que se atienda de forma efectiva la problemática y se garantice su solución definitiva. Se ordena a Jorge Arturo Alfaro Orias y María Daisy Víquez Zamora, por su orden alcalde y jefa a.i. del Departamento de Gestión Ambiental, ambos de la Municipalidad de Santa Cruz, o a quienes ocupen sus cargos, que: 1) acaten las disposiciones y órdenes del Ministerio de Salud, en los plazos establecidos por esta autoridad, en cuanto a la atención de la problemática de indebida disposición de residuos en el sitio denominado “La Cuesta a Santa Bárbara”; 2) en el plazo de UN MES contado a partir de la notificación de esta sentencia, dispongan lo necesario y lleven a cabo todas las actuaciones dentro del ámbito de sus competencias a fin de garantizar la solución efectiva del problema de indebida disposición de residuos en el sitio denominado “La Cuesta a Santa Bárbara” para que así este no se vuelva a presentar. Se ordena a Marisela Moreno Rodríguez, presidenta del Concejo Municipal de Santa Cruz, o a quien ocupe ese cargo, de INMEDIATO, poner esta sentencia en conocimiento del órgano que representa, para que, en el ámbito de su competencia, se tomen los acuerdos necesarios y se coordine lo pertinente a los efectos de procurar el cumplimiento de lo resuelto por la Sala en lo que atañe al ente municipal. Se advierte a las autoridades recurridas que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado y la Municipalidad de Santa Cruz al pago de las costas, daños y perjuicios ocasionados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En cuanto a los hechos anteriores al 22 de abril de 2020 estese a lo resuelto en la sentencia n.ͦ 2020012825 de las 9:15 horas de 10 de julio de 2020. En lo demás, se declara sin lugar el recurso...” DECIMO (sic) TERCERO- Consta en los folios 00267, 00268 y 00269 del expediente administrativo Informe Técnico MS-RCH-ARS-SC-ERS-IT-00393-2021; en donde se extrae de su conclusión “(…) De acuerdo con el seguimiento realizado en “La cuesta de Santa Barbara” , en atención resolución N° 2021017825, se Comprueba (sic) el cumplimiento del punto uno y do (sic) de la orden sanitaria N° MS-RCH-ARS-S-ERS-OS-0144-2021, ya que las fechas de limpieza programadas para el martes 8 de junio, viernes 30 de julio fueron debidamente ejecutadas y el lugar se encuentra limpio libre de residuos ordinarios.”. DECIMO (sic) CUARTO- Consta de folio 00290 al folio 00293 del expediente administrativo, Acta de Inspección en Sitio N° MS-RCH-ARS-SC-ERS.AIO-11-2024., donde se extrae lo siguiente: “(…) El día y hora arriba señalados se realiza inspección en sitio con el fin de verificar el cumplimiento de la orden sanitaria N° MS-RCH-ARS-S-ERS-OS-0144-2021, específicamente el cumplimiento del punto N° 1 – Realizar la limpieza de dicha ruta en un plazo NO mayor a tres (3) días hábiles. Al momento de la vista se logra comprobar el cumplimiento de lo solicitado se aportan fotografías que demuestran que el sitio se encuentra limpio de desechos”. II-CONCLUSION (sic) Con lo dicho supra y con las pruebas documentales que se aportan, es evidente y manifiesto que el Área Rectora de Salud de Santa Cruz ha realizado todo lo relacionado con su competencia, ha quedado demostrado que se han atendido todas las denuncias planteadas, y se le ha venido dando seguimiento a la orden sanitaria N° MS-RCH-ARS-SC-ERS-OS-0144-2021, e inclusive en la ultima (sic) inspección realizada en el presente año 2024 se logró comprobar el cumplimiento de lo solicitado”.

5.- Por constancia de 29 de enero de 2024, Paola Castro Pérez y Mariane Castro Villalobos, por su orden técnica judicial 3 y secretaria a. i., ambas de esta Sala, hicieron saber: “revisado, a las catorce horas cincuenta y ocho minutos del veintinueve de enero de dos mil veinticuatro, en el SISTEMA COSTARRICENSE DE GESTIÓN DE DESPACHOS JUDICIALES el CONTROL DE DOCUMENTOS RECIBIDOS Y ESTE EXPEDIENTE, no apareció que del 23 al 25 de enero de 2025, la jefa a.i. del Departamento de Gestión Ambiental de la Municipalidad de Santa Cruz haya presentado escrito o documento alguno, a fin de rendir el informe que se le solicitó en la resolución dictada a las siete horas veintitrés minutos del diecinueve de enero de dos mil veinticuatro, en el expediente número 21-013028-0007-CO que es RECURSO DE AMPARO promovido por [Nombre 001]”.

6.- En los procedimientos seguidos se han observado las prescripciones legales.

 Redacta el Magistrado Rueda Leal; y,

 Considerando:

I.- En la sentencia nro. 2021017825 de las 9:20 horas de 13 de agosto de 2021 se dispuso:

“IV.- Sobre el caso concreto. En el sub lite, el recurrente también menciona hechos que ocurrieron de forma posterior a la sentencia citada en el considerando anterior. Señala que el 14 de diciembre de 2020 planteó una nueva denuncia ante la alcaldía municipal por la mala disposición de residuos sólidos, en la que solicitó la aplicación y seguimiento de las medidas preventivas propuestas en 2019. Manifiesta que el 11 de febrero de 2021 formuló la denuncia n.◦ EAC-DEN-0052-2021 ante el Área Rectora de Salud de Santa Cruz, por la misma problemática. Refiere que, el 6 de abril del 2021, el Área Rectora de Salud de Santa Cruz emitió el informe técnico MS-RCH-ARS-SC-ERS-IT-0194-2021 con respecto a la inadecuada disposición de residuos sólidos en el sector de “Calle Vieja a Santa Bárbara”, el cual fue notificado el 8 de abril siguiente al despacho de la Alcaldía Municipal. Añade que el 27 de mayo de 2021 solicitó al director del Área Rectora de Salud de Santa Cruz la emisión urgente de una orden sanitaria para la limpieza inmediata de la zona y rehabilitación de la vía pública, pues habían transcurridos tres meses desde que se formuló la denuncia. Acota que el 1° de junio de 2021 planteó queja ante el Concejo Municipal de Santa Cruz debido al atraso de la Alcaldía y el Departamento de Gestión Ambiental en la atención de la denuncia planteada en diciembre de 2020. Asegura que el 8 de junio de 2021, tras denunciar la problemática en un medio de comunicación local, algunos funcionarios municipales se apersonaron al lugar en un vehículo estilo pick up y recogieron una pequeña parte de los residuos -los reciclables-; empero, dejaron más del 90% de los desechos, entre ellos escombros, lavadoras, aceite, motores, partes de vehículos. Manifiesta que tales residuos se encuentran cerca de afluentes de agua, zonas de agricultura, ganadería y casas de habitación. Relata que, el 8 de junio de 2021, el Área Rectora de Salud de Santa Cruz emitió la orden sanitaria-RCH-ARSSC-ERS-OS-0144-2021, en la que ordenó aplicar medidas urgentes. Acota que, el 18 de junio de 2021, el Concejo Municipal, por oficio SM-0890-Ord.23-2021, acordó por unanimidad remitir nuevamente su denuncia al despacho del alcalde y al departamento encargado. Aduce que acude a la Sala a los efectos de obtener atención eficiente del servicio que le corresponde brindar a la Municipalidad de Santa Cruz y al Ministerio de Salud. Formula la siguiente petitoria: “1. Solicito se le ordene a la Alcaldía y al Departamento de Gestión Ambiental de la Municipalidad de Santa Cruz el cumplimiento inmediato de la orden Sanitaria MS-RCH-ARS-SC-ERS-OS-0144-2021 y presentar de inmediato un nuevo plan de acciones de recolección, mantenimiento y limpieza a largo plazo de la calle vieja a Santa Bárbara. 2. Solicito se ordene al Departamento Unidad Técnica de Gestión Vial Municipal la rehabilitación, habilitación y la presentación de un plan de mantenimiento periódico del camino de la calle vieja a Santa Bárbara. 3. Solicito se ordene al Ministerio de Salud Pública sede Santa Cruz a iniciar si es necesario el procedimiento administrativo según Ley General de Salud “multa por desobediencia” o el traslado al Ministerio Publico en el caso del incumplimiento de la orden sanitaria MS-RCH-ARS-SC-ERS-OS-0144-2021”.

Del estudio de los autos, en relación con la Municipalidad de Santa Cruz, se tiene por demostrado, que, el 15 de diciembre de 2020, ese ente recibió un oficio del accionante dirigido al alcalde, en el que indicó: “Sirva la presente para saludarle y asimismo muy respetuosamente realizar formal solicitud de INTERVENCIÓN de la vía pública de supervisión municipal ubicada sobre la calle vieja hacia Santa Bárbara, sector la cuesta, donde al día de hoy se encuentran varios depósitos de basura, situación que se viene denunciando desde el 20 de agosto del año 2018 a las administraciones municipales anteriores donde ha tenido que intervenir el Ministerio de Salud, Defensoría de los Habitantes, Sala Constitucional, CoopeGuanacaste, con acciones contundentes para que el departamento encargado ejecutara las labores que por oficio debía realizar. A partir del año 2019 el departamento gestión ambiental ante la presión de diversos sectores emite las medidas preventivas oficios DGA-0350-2019, DGA-0185-2019, DGA0222-2019 y DGA-0627-2019, donde recomienda ciertas acciones con la intervención de varios departamentos municipales las cuales han sido insuficientes y no fueron cumplidas en su totalidad; destaco algunas de ellas: ejecutar campañas de limpieza; se ha planteado la necesidad de vigilar el sitio con cámaras de video y con rondas de monitoreo presencial, Colocar (sic) lámparas para dotar de iluminación, Habilitación de la calle para que vuelva a ser transitado con frecuencia y exista temor de los infractores a ser descubiertos contaminando el sitio con residuos, Podría (sic) de igual modo plantearse a los colindantes de la vía un plan de arborización en sus fincas para embellecer la ruta, sumado a la rehabilitación y alumbrado del camino se podría volver la ruta atractiva para la realización de competencias y recreativas ciclísticas, así como para caminatas o para cabalgatas, por ejemplo..”. Otro aspecto es que la vía se encuentra en muy mal estado, la capa de rodamiento de lastre se encuentra dañado, con zanjas que impiden el tránsito de vehículos livianos, emergencias, servicios públicos u otros por ende la importancia la colaboración de la Unidad Técnica de Gestión Vial desde el 17 de julio del año 2019 ese había comprometió (sic) en la intervención del camino público mediante correo electrónico con el suscrito. Actualmente en la zona se encuentra instalada una cámara de video vigilancia que se supone que funciona 24 horas, sin embargo consultando al servicio de Policía Municipal me externaron que ellos no tienen acceso a la misma, solamente el personal Administratativo (sic) de Gestión Ambiental quienes laboran con horario de oficina, por lo cual se limita el buen uso del dispositivo que podría ser utilizado tanto por Policía Municipal como por la Fuerza Pública del cantón. En aras de la protección ambiental, del cumplimiento de lo dispuesto en el artículo 8 de la Ley para la Gestión Integral de Residuos N° 8839, establece entre las funciones de las municipalidades las siguientes: "Las municipalidades serán responsables de la gestión integral de los residuos generados en su cantón; para ello deberán: ƒ) prevenir y eliminar las vertederos en el cantón y el acopio no autorizado de residuos. (...) j) Promover la capacitación y realizar campañas educativas de sensibilización de los habitantes del cantón respectivo para fomentar la cultura de recolección separada, de limpieza de los espacios públicos y de gestión integral de residuos." les (sic) solicito interponga sus buenos oficios para la atención oportuna del caso ampliamente denunciado y para erradicar la contaminación ambiental en la zona”. El 1ͦ de junio de 2021, la Secretaría del Concejo Municipal de Santa Cruz recibió una gestión del accionante dirigida a la presidenta de ese órgano, en la que indicó: “Sirva la presente para saludarle y asimismo muy respetuosamente solicitarle su valiosa intervención y la del Consejo (sic) que preside en relación a una denuncia presentada por el suscrito ante la alcaldía municipal desde el mes diciembre del año 2021 (sic), en referencia a un botadero de basura a cielo abierto ubicado en el sector de la calle vieja hacia Santa Bárbara, sector la cuesta, a tan solo 1 km del Municipio, donde en dicha vía se depositan todo tipo de residuos sobre la vía pública, contaminando en gran manera el medio ambiente e impidiendo el libre de tránsito de personas hacia sus propiedades. Esta situación se viene dando desde hace años y no es la primera vez que se denuncia, sin embargo, los últimos tres años he constatado que dicho departamento no realiza de forma continua las limpiezas que plantea, no existen informes que indique cuantos casos ha remitido al Tribunal Ambiental por las infracciones a la ley Ambiental entre otros. Cabe destacar que desde el año 2020 los funcionarios tienen una gran herramienta para poder aplicar la legislación ya que en el sitio se instaló una cámara de video vigilancia de alta tecnología que según me informó la Policía Municipal solo Gestión Ambiental tienen acceso, en un horario limitado de 8 horas días y 5 días a la semana, lo cual resta provecho al buen uso que se le puede dar al dispositivo. Es importante mencionar que desde el 20 de agosto del año 2018 han tenido que intervenir varias instituciones como el Ministerio de Salud (con dos órdenes sanitarias) la Defensoría de los Habitantes(recomendaciones por incumplimiento de respuesta y servicio municipal) Sala Constitucional (Amparo por derecho a la Salud) CoopeGuanacaste (instalación de lumbreras y ofrecimiento de árboles) para instar a que el departamento ambiental ejecute las labores que por oficio debían realizar, la respuesta de dicho departamento siempre ha sido tardía, incompleta e ineficiente tratándose de un tema tan delicado como lo es la Salubridad. A partir del año 2019 el Departamento Gestión Ambiental ante la presión de diversos sectores emite las medidas preventivas oficios DGA-0350-2019, DGA-0185-2019, DGA0222-2019 y DGA-0627-2019, donde se compromete a realizar ciertas acciones las cuales no fueron cumplidas en su totalidad. A continuación, destaco algunas de ellas: ejecutar campañas de limpieza; se ha planteado la necesidad de vigilar el sitio con cámaras de video y con rondas de monitoreo presencial, Colocar (sic) lámparas para dotar de iluminación, Habilitación de la calle para que vuelva a ser transitado con frecuencia y exista temor de los infractores a ser descubiertos contaminando el sitio con residuos, Podría (sic) de igual modo plantearse a los colindantes de la vía un plan de arborización en sus fincas para embellecer la ruta, sumado a la rehabilitación y alumbrado del camino se podría volver la ruta atractiva para la realización de competencias y recreativas ciclísticas, así como para caminatas o para cabalgatas, por ejemplo..”. Actualmente la vía se encuentra en muy mal estado ya que la capa de rodamiento de lastre se encuentra muy dañada, llenas de desechos, vidrios y zanjas que impiden el tránsito de vehículos livianos, emergencias, servicios municipales u otros por ende la importancia la colaboración del Departamento de Gestión Vial quien desde el 17 de julio del año 2019 se había comprometido con la intervención del camino público mediante correos electrónicos con el suscrito y con el despacho de la alcaldía. En aras de la prestación de buen servicio municipal, la protección ambiental y del cumplimiento de lo dispuesto en el artículo 8 de la Ley para la Gestión Integral de Residuos N° 8839, que establece entre las funciones de las municipalidades las siguientes: "Las municipalidades serán responsables de la gestión integral de los residuos generados en su cantón; para ello deberán: ƒ) prevenir y eliminar las vertederos en el cantón y el acopio no autorizado de residuos. (...) j) Promover la capacitación y realizar campañas educativas de sensibilización de los habitantes del cantón respectivo para fomentar la cultura de recolección separada, de limpieza de los espacios públicos y de gestión integral de residuos." les solicito muy respetuosamente lo siguiente: PRIMERO: Se intervenga con limpieza periódica la zona denunciada (una limpieza por trimestre como mínimo) y gestionando la continuación del plan remedial presentado por el Departamento de Gestión Ambiental en el año 2020. SEGUNDO: Se coordine con el Departamento Gestión Vial para el raspado, limpieza y tratamiento del tramo con lastre desde la entrada principal hasta el sector de la cuesta (tanque A.Y.A). TERCERO: Se coordine la realización de operativos preventivos por parte de la policía municipal y se les permita acceder al sistema de video vigilancia con el fin de aplicar las sanciones correspondientes. CUARTO: Se coordine la eliminación de maleza, ramas u otros que impidan la buena visibilidad de la cámara instalada y del alumbrado público instalado por Coopeguanacaste. QUINTO: Se me conceda audiencia con el Consejo (sic) Municipal en su asamblea semanal para poder presentar soluciones o aportes como denunciante y ciudadano. La coordinadora de Servicios Ambientales del Departamento de Gestión Ambiental de la Municipalidad de Santa Cruz, mediante oficio DGA-0392-2021 de 9 de junio de 2021 dirigido a la alcaldesa a.i., señaló: “Asunto: Plan de Intervención Sitio “La Cuesta a Santa Bárbara” Estimada señora: Reciba un cordial saludo y un sincero deseo de éxito en sus labores, la presente es para dar respuesta al punto 2 de la Orden Sanitaria MS-RCH-ARSSC-ERS-OS-0144-2021…“Replicar el plan de acciones correctivas propuestas mediante oficios N°0162-2019 y DGA- 0350-2019 y al mismo tiempo ampliar la programación de dichas acciones”… (…) Del Plan propuesto en el año 2019 este Departamento recomienda retomar los siguientes puntos Para el año 2021: (….) Por otra parte, cabe resaltar que la decisión de intervención para rehabilitamiento de la calle pública que se cita en la propuesta es asunto que no compete al Departamento de Gestión Ambiental, ni tampoco lo es la planificación de intervención de la ruta, ni la designación o reserva de presupuesto para ello; por lo cual se cita en este Plan a los responsables de dicha tarea. Por último, se adjunta a este documento un listado de los oficios antecedentes sobre esta temática para enterar a la administración actual, del estado de la cuestión y lo que este Departamento ha indicado de forma reiterada respecto al abordaje propuesto para la problemática que se suscita en el sitio denominado “La Cuesta a Santa Bárbara”. El Concejo Municipal de Santa Cruz, en el inciso 22 del artículo 4 de la sesión ordinaria 23-2021 celebrada el 8 de junio de 2021, acordó trasladar la gestión que el accionante planteó ante ese órgano al alcalde. La coordinadora de Servicios Ambientales del Departamento de Gestión Ambiental de la Municipalidad de Santa Cruz, mediante oficio DGA-0434-2021 de 22 de junio de 2021 dirigido a la alcaldesa a.i., expuso: “Asunto: Indicación sobre atención en la cuesta Santa Bárbara (…) Por medio de la presente les saludo y deseo éxito en sus funciones. Respecto al oficio DAM-1628-2021 sobre la Orden Sanitaria MSRCH-ARS-SC-ERS-OS-0144-2021, enviado el 08 de junio del 2021, en relación con la atención del camino viejo a Santa Bárbara, se indica que el mismo fue intervenido el día 08 de junio del 2021 por parte del personal del Departamento de Gestión Ambiental. Con relación a la labor realizada, mediante oficio DGA-0039 2021 del 9 de junio, el inspector Ambiental Overath Ortega Urbina se informa sobre la labor realizada por este Departamento, en donde se cita “El día 08 de Junio del 2021, el Departamento de Gestión Ambiental inicia con los trabajos de limpieza en este sector, indicar que se ocuparon con 3 peones, se gastaron 38 bolsas, se realizaron 3 viajes en el pick up SM-4403, e informo (sic) que se lograron disponer 1340 kilos de residuos”. Es importante aclarar, que para las labores pendientes de atención, el día miércoles 09 de junio del 2021, se codina (sic) con Unidad Técnica de Gestión Vial para la colaboración de una vagoneta, un cargador y los choferes, esto necesario para la atención en sitio, en donde se indica lo siguiente por parte del señor Didier Monge Jimenez (sic): “Con relación a la solicitud de equipo se indica que por el momento no se tiene el cargador en funcionamiento y solamente estamos contando con una vagoneta la cual esta destacada en el sector de Portegolpe, por lo que se nos hace imposible el suministro de los equipos solicitados para el día de mañana. Por otra parte, no se tiene recurso económico disponible para disponer de equipo alquilado por demanda”. A esto, nos encontramos a la espera de la respuesta de la UTGV, sobre el momento en el cual sea posible hacer uso de la maquinaria. (…) A lo anterior se suma, el Plan de Intervención Sitio “La Cuesta Santa Bárbara”, realizado por la Geog. Geissel Gutiérrez Marchena, informado mediante oficio DGA-0392-2021, del día 9 de junio del 2021, en donde se detallan medidas preventivas en atención al cumplimiento de la orden sanitaria, la cual involucra otras unidades de la Municipalidad en complemento con la gestión brindada por el Departamento de Gestión Ambiental. De esta forma, se plantea el plan propuesto para el año 2021, con relación al punto en mención”. La Unidad Técnica de Gestión Vial de la Municipalidad de Santa Cruz, por oficio DDUR-UTGVM-2021-039 de 2 de julio de 2021 dirigido al alcalde de Santa Cruz, mencionó: “Por este medio, se brinda programación, para el mantenimiento del camino viejo La Cuesta-santa Bárbara, en donde según el cronograma de trabajo, le correspondería ser intervenido a partir del 17 de noviembre del 2021”. El 8 de julio de 2021, el jefe del Departamento de Gestión Ambiental de la Municipalidad de Santa Cruz fue notificado del curso de este proceso. El 9 de julio de 2021, el alcalde de Santa Cruz fue notificado del curso de este proceso. La coordinadora de Servicios Ambientales del Departamento de Gestión Ambiental de la Municipalidad de Santa Cruz, mediante oficio DGA-0492-2021 de 9 de julio de 2021 dirigido a la alcaldesa a.i., expuso: “Asunto: Indicación sobre atención en la cuesta Santa Bárbara en adición a oficio DGA-0434-2021 Buenas tardes estimado, Por medio de la presente le saludo y deseo éxito en sus funciones. La presente es para informar la gestión realizada ante Unidad Técnica de Gestión Vial, en relación con la solicitud de la prestación de una vagoneta y un cargador, con su respectivo chófer, necesarios para la atención del sector denominado como Cuesta Santa Bárbara. Como parte de su conocimiento, se indica que la diligencia se realiza mediante correo electrónico que complementan las conversaciones sostenidas a través de llamadas telefónicas. Sin embargo, no se cuenta con un comunicado por parte de UTGV en el cual confirmen el momento oportuno a ser utilizado el equipo. (…)”. Katia Gómez Mata, educadora ambiental del Departamento de Gestión Ambiental de la Municipalidad de Santa Cruz, por oficio DGA-0494-2021 de 9 de julio de 2021 dirigido a la coordinadora de Servicios Ambientales, indicó: “Asunto: Educación ambiental, actividades de intervención en La Cuesta, Santa Bárbara Estimado señora: Mediante la presente le saludo y deseo éxito en sus labores. A continuación, en el cuadro 1 se describen las actividades a ejecutar para enmendar la problemática del vertedero ilegal en La Cuesta, Santa Bárbara. Cuadro 1. Cronograma de actividades de educación ambiental. (…) El plan de educación ambiental efectuará campañas de divulgación de información por medio auditivo (perifoneo), digital (redes sociales y video informativo) e impreso (volantes y afiches) a las comunidades afectadas directamente por el vertedero. Por otro lado, realizará una identificación de los posibles generadores acompañado del asesoramiento y seguimiento para la correcta disposición de sus residuos, esto mediante capacitaciones, mesas de trabajo y visita al Parque Tecnológico Ambiental, además, se involucrará a la Asociación de Desarrollo de Santa Bárbara, Colegio Técnico Profesional de Santa Bárbara y líderes comunales para implementar una solución interdisciplinaria y permanente”. El inspector ambiental Overath Ortega Urbina, funcionario del Departamento de Gestión Ambiental de la Municipalidad de Santa Cruz, por oficio DGA-0497-2021 de 12 de julio de 2021 dirigido a la coordinadora de Servicios Ambientales, indicó: “Aprovecho la presente para saludarle y a la vez informarle sobre la labor realizada en la campaña de Limpieza en el camino viejo a Santa Bárbara (La Cuesta): El día 10 de julio del 2021 se realizó la campaña de limpieza en el lugar conocido con la Cuesta, específicamente camino viejo a Santa Bárbara, donde encontramos desechos de todo tipo como por ejemplo, desechos de construcción, televisores, cerámica, libros, plásticos de todo tipo, desechos ordinarios etc. Esta campaña se realizó para terminar de recoger lo que no se pudo en la campaña del 8 de junio, por no haber contado con la maquinaria en dicha fecha, ni en días posteriores, sino hasta este día. Cabe indicar que la ejecución del trabajo fue realizada, en un horario de 6:00 am a 14:00 pm horas, con la colaboración a la UTGVM, departamento que nos facilitó el Back Hoe placa # 23805 conducida por el señor Ramiro Sancho y una Vagoneta placa # 138740 conducida por el señor Luis Pizarro y con una capacidad de 12 m3, esto para poder cargar y trasladar los desechos hasta el relleno sanitario de esta Municipalidad. Mencionar que la maquinaria facilitada es propiedad de la empresa Movimientos y Acarreos La Península, la cual es Alquilada por la UTGVM. Finalizada la limpieza se solicitó el peso de los desechos al encargado de la báscula el señor José Randall Gómez Espinoza y se determinó que la cantidad recolectada fue de 52.860 kilos, en 7 viajes realizados por la vagoneta”. La coordinadora de Servicios Ambientales del Departamento de Gestión Ambiental de la Municipalidad de Santa Cruz, mediante oficio DGA-0498-2021 de 12 de julio de 2021 dirigido al alcalde, expuso:“(…) Este Departamento extrae de dicho Recurso (sic) lo que el señor denomina como incumplimientos, a lo cual se hará referencia en adelante y se responderá sobre lo actuado: • El día 8 de junio se realizó campaña de limpieza en el sitio denominado “La Cuesta a Santa Bárbara” quedando pendiente de recolectar residuos voluminosos y escombros de construcción, los cuales por falta de maquinaria como Back Hoe y Vagoneta no se pudieron extraer del sitio, al respecto y las gestiones para la obtención de dichos equipos constan en los oficios adjuntos dirigidos a Alcaldía, DGA-0434-2021 y DGA-0492-2021 ambos referidos por la Ingeniera Diana Vallejos Noguera, Coordinadora de Servicios Ambientales de la Municipalidad de Santa Cruz. • Se adjunta Oficio DGA-0497 que da fe de que el sitio denominado “La Cuesta a Santa Bárbara” se atendió con la maquinaria que se requería, la cual fue facilitada por la Unidad Técnica de Gestión Vial Municipal el Sábado 10 de julio del corriente, se evidencia en dicho Oficio que el sitio queda completamente limpio. •Como parte del Plan de Intervención del sitio “La Cuesta a Santa Bárbara” referido a alcaldía municipal mediante Oficio DGA 0392-2021 el 9 de junio, se indica que corresponde realizar otra campaña de limpieza el viernes 30 de Julio del corriente. •Como parte del Plan de Intervención del sitio “La Cuesta a Santa Bárbara” referido a alcaldía municipal mediante Oficio DGA-0392-2021 el 9 de junio, se indica que se elaborará Programa de Educación Ambiental dirigido a la Comunidad de Santa Bárbara, las Instituciones Educativas y los Chatarreros que forman parte de los Generadores de residuos, dicho Plan se adjunta en Oficio DGA-0494-2021 el mismo fue elaborado por la Ingeniera Katia Gómez Mata, educadora ambiental del Departamento de Gestión Ambiental Municipal. •Como parte del Plan de Intervención del sitio “La Cuesta a Santa Bárbara” referido a alcaldía municipal mediante Oficio DGA-0392-2021 el 9 de junio se cita como medida la Habilitación del camino denominado “Calle vieja Santa Bárbara”, este tema que es del abordaje de la Unidad Técnica de Gestión Vial Municipal, consta en Oficio DDUR-UTGVM-ADM-2021-039 del 2 de Julio del corriente, indicando la fecha de Programación del mantenimiento camino viejo La Cuesta-Santa Bárbara a partir del 17 de noviembre del año en curso. • Como parte del Plan de Intervención del sitio “La Cuesta a Santa Bárbara” referido a alcaldía municipal mediante Oficio DGA-0392-2021 el 9 de junio, se indica que es requerido el Monitoreo de la Cámara de Vigilancia instalada en el sitio “La Cuesta a Santa Bárbara” para ello se requiere una directriz de alcaldía municipal hacia Policía Municipal, Seguridad Interna Municipal e Inspector ambiental, para establecer la coordinación y acciones conjuntas poder ejecutar las tareas descritas “Establecer horarios rotativos de Monitoreo de la cámara instalada en sitio “La Cuesta” por parte de la Policía Municipal, El Departamento de Seguridad Interna Municipal y el Inspector Ambiental. Elaborar un cronograma rotativo de rondas de monitoreo en el sector. Establecer un protocolo de acción para toma de datos de infractores y traslado de las respectivas denuncias”. Por lo anterior, la gran mayoría de las medidas citadas en el Plan de Intervención del sitio “La Cuesta a Santa Bárbara” descritos en Oficio DGA-0392-2021, se encuentran en ejecución, resta para su totalidad de cumplimiento, la directriz de Alcaldía Municipal mediante la cual se procederá a la implementación de Vigilancia y monitoreo de la cámara instalada en el sitio y se elaborará el protocolo respectivo para toma de datos de infractores y traslado de las denuncias respectivas. Todo ello es materia de seguridad, lo cual por competencias no cobija al Departamento de Gestión Ambiental, no obstante, éste se sumará al proceso de capacitación para su implementación, incorporando al Inspector Ambiental designado al Departamento de Gestión Ambiental”. El 13 de julio de 2021, la presidenta del Concejo Municipal de Santa Cruz fue notificada del curso de este proceso.

Por otra parte, en cuanto al Área Rectora de Salud de Santa Cruz, se comprobó que el 11 de febrero de 2021 recibió una denuncia contra el Departamento de Gestión Ambiental de la Municipalidad de Santa Cruz, en la quese (sic) expuso que, en la dirección “Del salón de eventos de la coopeGuanacaste (sic) 2 kilómetros sur este, entrada a calle vieja a Santa Barbara, sector la cuesta”, había problemas de malos olores, manejo de desechos, vectores (moscas y otros), roedores, seguridad y contaminación de fuentes de agua; además, se describieron los siguientes hechos: “Sirva la presente para denunciar por tercera vez el botadero a cielo abierto en la zona mal llamada “el basurero” en la cual se continua vertiendo basura de todo tipo y de lo cual se ha venido denunciando desde el año 2018 y donde han existido anteriormente dos órdenes sanitarias en contra del mismo departamento municipal por lo tanto muy respetuosamente solicito nuevamente la intervención de su representada. La calle al ser de uso público y estar bajo mantenimiento municipal puede ser visitada a cualquier día u hora. Adjunto prueba documental referente a la denuncia formal presentada el día 14 de diciembre de 2020 y fotografías de la zona ”. El señor Guillermo Caravaca Martínez, funcionario del Equipo de Regulación de la Salud del Área Rectora de Salud de Santa Cruz, por informe técnico MS-RCH-ARS-SC-ERS-IT-0194-2021 de 6 de abril de 2021 dirigido al director de esa área, señaló: “ASUNTO: Inspección físico-sanitaria realizada en el sitio mencionado en la denuncia N◦ EAC-DEN-0052-2021, interpuesta el día 11 de febrero de 2021, por problemas de disposición de residuos sólidos en vía pública, ubicado 2km este del salón multiusos de COOPEGUANACASTE, camino a Santa Bárbara, Santa Cruz, Guanacaste. (…), procedo a informar lo siguiente: ANTECEDENTES • Oficio N◦ DGA-0222-2019, referente al informe de campaña de limpieza realizada en “camino viejo a Santa Bárbara-La Cuesta”. • Oficio N◦ DAM-1602-20219 (sic) emitido por la alcaidesa María Rosa López Gutiérrez el día 28 de mayo de 2019, donde remite a esta Área Rectora de Salud el oficio DGA-0350-2019 el cual es la propuesta de plan de acción correspondiente a la orden sanitaria del caso calle vieja a Santa Barbara. • Informe técnico N◦ MS-RCH-ARS-SC-ERS-IT-00694-2019 emitido el 03 de julio de 2019 por el funcionario Saúl Luna Mora, donde se acoge el “Plan de Acciones de Medidas Preventivas” y que se le brindará seguimiento a dicho plan. • Informe técnico N◦ MS-RCH-ARS-SC-ERS-IT-00856-2019 emitido el 19 de agosto de 2019 por el funcionario Saúl Luna Mora, donde se informa el cumplimiento de lo propuesto en el “Plan de Acciones de Medidas Preventivas”. • Recurso de amparo bajo el expediente N◦ 20-007332-0007-CO ingresado el 27 de abril de 2020 e interpuesto por el Sr. Manuel Pérez Agüero contra botadero clandestino ubicado en el sector de Campero calle vieja a Santa Bárbara. • Resolución de recurso de amparo N◦ 2020012825, donde el día 10 de julio de 2020 se declara sin lugar el recurso de amparo interpuesto por el Sr. Manuel Pérez Agüero. •Denuncia N◦ EAC-DEN-0052-2021, donde se interpone queja por problemas de mala disposición residuos sólidos en vía pública, situado 2km sureste del salón de eventos de COOPEGUANACASTE, calle vieja a Santa Bárbara. SOBRE LOS HECHOS DE LO ACTUADO SE INFORMA LO SIGUIENTE: PRIMERO: Se realiza inspección en atención a denuncia el día 17 de marzo de 2021 en el lugar señalado en la denuncia, donde se corrobora la mala disposición de residuos sólidos ordinarios (hechos denunciados). SEGUNDO: Al momento de la visita se toman fotografías de los hechos denunciados y además de la aparente cámara de vigilancia colocada por la Municipalidad de Santa Cruz, dichas fotos se encuentran en los anexos. TERCERO: Se observa la implementación de la recomendación realizada en el oficio N◦ DGA-0222-2019 por parte de la coordinadora de servicios ambientales, referente a la colocación de cámara de vigilancia. CUARTO: No se tiene certeza o claridad sobre la institución encargada de administrar la cámara de vigilancia; por lo que sería conveniente solicitar un informe a la institución responsable sobre lo observado y las acciones realizadas según lo observado mediante dicha cámara. QUINTO: Se considera prudente y necesario aportar fotografías sobre la construcción del nuevo sistema de tratamiento de aguas residuales (antes, durante y después), el sistema existente se encuentra al costado oeste de la propiedad del establecimiento y el nuevo sistema se ubica al costado este de la propiedad del establecimiento. CONCLUSIÓN A razón de lo hasta aquí visto mediante la inspección en sitio y con las evidencias encontradas se recomienda solicitar informe a la Municipalidad de Santa Cruz, donde ofrezca un (sic) descripción sobre las acciones realizadas después de haberse colocado la cámara de vigilancia (se encuentra operando dicha cámara, quien es la persona responsable de observar dicha cámara, que acciones se han realizado y en caso de lograr capturar a una persona o vehículo depositando residuos en dicho camino o vía pública, ¿Qué sanción o medida se aplica?), también se solicita proceder a realizar labores de limpieza y/o mantenimiento de la ruta o vía arriba mencionada”. El director del Área Rectora de Salud de Santa Cruz, por oficio MS-DRRSCH-391-2021 de 8 de abril de 2021 dirigido al alcalde de Santa Cruz, indicó: “Reciba un cordial saludo. Por medio de la presente le remito el Informe técnico citado en el asunto, sobre la atención de una denuncia por inadecuada disposición de residuos sólidos en el denominado "camino viejo a Santa Bárbara" ubicado 2 km al este del centro de convenciones de Coopeguanacaste, por lo que le solicito interponga sus buenos oficios, con el fin de que se nos brinde un informe sobre las acciones realizadas sobre el caso en cuestión por su representada e indicarlos si se ha podido identificar a los infractores por medio de la cámara de vigilancia instalada en el lugar”. El 27 de mayo de 2021, el Área Rectora de Salud de Santa Cruz recibió una gestión del recurrente, en la que meniconó (sic): “Sirva la presente para saludarle y a su vez solicitar su intervención URGENTE en relación al informe técnico MS-RCH-ARS-SC-ERS-IT-0194-2021 denuncia de VIEJA DATA sobre la disposición de residuos sólidos en el denominado -camino viejo a Santa Barbará (sic)- ubicado a 2 km al este del centro de convenciones de Coopeguanacaste, dado las condiciones actuales en el sitio, la gran cantidad de BASURA derramada en vía pública, los antecedentes relacionados al lugar, la afectación a la salud pública por la cantidad vertida en ella, solicito muy respetuosamente emitir la ORDEN SANITARIA en contra del Departamento de Gestión Ambiental y la Alcaldía Municipal, ordenándoles limpiar y habilitar inmediatamente la vía pública, la cual es el único acceso hacia mi propiedad y en el tanto atienden los otros aspectos solicitados por su representada en el oficio MS-DARSSC-391-2021”. El señor Guillermo Caravaca Martínez, funcionario del Equipo de Regulación de la Salud del Área Rectora de Salud de Santa Cruz, por informe técnico MS-RCH-ARS-SC-ERS-IT-0289-2021 de 8 de junio de 2021 dirigido al director de esa área, manifestó: “ASUNTO: Inspección físico-sanitaria realizada en el sitio mencionado en la denuncia N◦ EAC-DEN-0052-2021 y en seguimiento al informe técnico N◦ MS-RCH-ARS-SC-ERS-IT-0194-2021, dicho caso se ubica 2km este del salón multiusos de COOPEGUANACASTE, camino viejo a Santa Bárbara, Santa Cruz, Guanacaste. (…), procedo a informar lo siguiente: ANTECEDENTES • Oficio N◦ DGA-0222-2019, referente al informe de campaña de limpieza realizada en “camino viejo a Santa Bárbara-La Cuesta”. • Oficio N◦ DAM-1602-20219 (sic) emitido por la alcaidesa María Rosa López Gutiérrez el día 28 de mayo de 2019, donde remite a esta Área Rectora de Salud el oficio DGA-0350-2019 el cual es la propuesta de plan de acción correspondiente a la orden sanitaria del caso calle vieja a Santa Barbara. • Informe técnico N◦ MSRCH-ARS-SC-ERS-IT-00694-2019 emitido el 03 de julio de 2019 por el funcionario Saúl Luna Mora, donde se acoge el “Plan de Acciones de Medidas Preventivas” y que se le brindará seguimiento a dicho plan. • Informe técnico N◦ MS-RCH-ARS-SC-ERS-IT-00856-2019 emitido el 19 de agosto de 2019 por el funcionario Saúl Luna Mora, donde se informa el cumplimiento de lo propuesto en el “Plan de Acciones de Medidas Preventivas”. • Recurso de amparo bajo el expediente N◦ 20-007332-0007-CO ingresado el 27 de abril de 2020 e interpuesto por el Sr. Manuel Pérez Agüero contra botadero clandestino ubicado en el sector de Campero calle vieja a Santa Bárbara. • Resolución de recurso de amparo N◦ 2020012825, donde el día 10 de julio de 2020 se declara sin lugar el recurso • Denuncia N◦ EAC-DEN-0052-2021, donde se interpone queja por problemas de mala disposición residuos sólidos en vía pública, situado 2km sureste del salón de eventos de COOPEGUANACASTE, calle vieja a Santa Bárbara. • Informe técnico N◦ MS-RCH-ARS-SC-ERS-IT-0194-2021, donde se concluye solicitar un informe a la municipalidad sobre el caso que aquí nos ocupa. SOBRE LOS HECHOS DE LO ACTUADO SE INFORMA LO SIGUIENTE: PRIMERO: Al momento de la redacción del presente infame NO se ha obtenido respuesta por parte de la Municipalidad de Santa Cruz. SEGUNDO: El sitio se encuentra igual que al momento de la visita de inspección realizada el 17 de marzo de 2021. TERCERO: Se observa la implementación de la recomendación realizada en el oficio N◦ DGA-0222-2019 por parte de la coordinadora de servicios ambientales, referente a la colocación de cámaras de vigilancia. CUARTO: Al no existir un informe referente al caso que aquí nos ocupa, NO se tiene certeza o claridad sobre la funcionalidad de la cámara de vigilancia y la efectividad de las posibles sanciones. QUINTO: Se considera prudente y necesario la limpieza urgente del sitio afectado, además, tomando en cuenta que es un problema persistente se debe de generar un plan de mantenimiento y limpieza a largo plazo y no únicamente como medida paliativa, debido a que siempre se presenta el mismo problema de vertido de residuos sólidos en dicha localidad. CONCLUSIÓN A razón de lo hasta aquí visto mediante Inspección en sitio y con las evidencias encontradas se recomienda GIRAR ORDEN SANITARIA donde se solicite informe a la Municipalidad de Santa Cruz, sobre las acciones según lo solicitado en el Informe N◦MS-RCH-ARSSC-ERS-IT-0194-2021, también solicitar realizar labores de limpieza y/o mantenimiento de la ruta o vía arriba mencionada a la mayor brevedad posible. El Área Rectora de Salud de Santa Cruz, en la orden sanitaria MS-RCH-ARS-SCERS-OS-0144-2021 de 8 de junio de 2021 dirigida a la vicealcaldesa de Santa Cruz y con fecha de vencimiento 25 de junio de 2021, dispuso: “Con base en revisión de expediente realizada al caso de botadero a cielo abierto ubicado camino viejo a Santa Bárbara, en atención a denuncia y seguimiento de caso, se corroboró incumplimiento de lo solicitado vía oficio, donde se evidencian NO conformidades en la disposición y recolección de residuos, además la limpieza de la vía pública, según lo indicado en informe técnico N MS-RCH-ARS-SC-ERS-IT-0289-2021, como consta en expediente administrativo que resguarda esta Área Rectora, donde se concluye lo siguiente: • PRIMERO: Al momento de la redacción del presente infame NO se ha obtenido respuesta por parte de la Municipalidad de Santa Cruz. • SEGUNDO: El sitio se encuentra igual que al momento de la visita de inspección realizada el 17 de marzo de 2021. • TERCERO: Se observa la implementación de la recomendación realizada en el oficio N◦ DGA-0222-2019 por parte de la coordinadora de servicios ambientales, referente a la colocación de cámaras de vigilancia. • CUARTO: Al no existir un informe referente al caso que aquí nos ocupa, NO se tiene certeza o claridad sobre la funcionalidad de la cámara de vigilancia y la efectividad de las posibles sanciones. • QUINTO: Se considera prudente y necesario la limpieza urgente del sitio afectado, además, tomando en cuenta que es un problema persistente se debe de generar un plan de mantenimiento y limpieza a largo plazo y no únicamente como medida paliativa, debido a que siempre se presenta el mismo problema de vertido de residuos sólidos en dicha localidad. Se comprobó que existen algunas NO conformidades, según la Ley General de Salud N' 5395, Ley de Gestión Integral de Residuos, Ley N◦ 8839 y su reglamento y demás normativa vigente y aplicable; las mismas contravienen dicha reglamentación, por lo que representan un riesgo para la salud pública. Por lo tanto, en el plazo antes indicado y a partir de esta notificación se le ordena: 1. Realizar la limpieza de dicha ruta en un plaza NO mayor a tres (3) días hábiles. 2. Replicar el plan de acciones correctivas propuesto mediante los oficio (sic) N◦ DAM-1602-2019 y DGA-0350-2019 y al mismo tiempo ampliar la programación de dichas acciones. 3. Remitir copia a esta área rectora de salud del plan de acciones anteriormente mencionado. 4. Brindar respuesta al informe técnico N MS-RCH-ARS-SC-ERSIT-0194-2021 el cual fue remitido mediante el oficio MS-DRRSCH-DARSSC-391-2021 el día 08 de abril de 2021 (…)”. El 30 de junio de 2021, el Área Rectora de Salud de Santa Cruz recibió el oficio DAM-1852-2021 de 23 de junio de 2021 de la alcaldesa a.i de Santa Cruz, en el que se indicó: “Reciba un cordial saludo, deseándole éxitos en sus funciones, mediante la presente, en cumplimiento de lo solicitado mediante orden sanitaria MS-RCN-ARS-SC-ERS-OS-0144-2021, se remite oficios DGA-0434-2021, DGA-0039-2021-2021 y DGA-0392-2021 remitiendo cronograma y actividades realizadas por esta Municipalidad de Santa Cruz. Con respecto a este asunto, mediante el Departamento de Gestión Ambiental, inició con los trabajos de limpieza en este sector, y se ocuparon con 3 peones, se gastaron 38 bolsas, se realizaron 3 viajes en el pick up SM-4403, y se lograron disponer 1340 kilos de residuos. Sobre este mismo asunto, la Municipalidad procedió con la reparación de la Cámara colocada en el luga (sic). No obstante, cierto tipo de material implica la utilización de un equipo de mayores dimensiones, el cual, se le solicita a la Unidad Técnica Vial Municipal, por lo que el día miércoles 09 de junio del 2021, se coordina con la Unidad Técnica de Gestión Vial Municipal para la colaboración de una vagoneta, un cargador y los choferes, departamento que señala, lo siguiente por parte del señor Didier Monge Jimena: “Con relación a la solicitud de equipo se indica que por el momento no se tiene el cargador en funcionamiento y solamente estamos contando con una vagoneta la cual esta (sic) destacada en el sector de Portegolpe, por lo que se nos hace imposible el suministro de los equipos solicitados para el día de mañana. Por otra parte no se tiene recurso económico disponible para disponer de equipo alquilado por demanda”. En razón de lo anterior, se está introduciendo recursos a dicha unidad a efectos de terminar la limpieza en la zona y otros trabajos de pendientes, por lo cual, se solicita el plazo prudencial de dos meses, dado que dichos elementos deben pasar por el debido proceso presupuestario propio de una institución pública”. El 8 de julio de 2021, el director del Área Rectora de Salud de Santa Cruz fue notificado del curso de este proceso. El señor Guillermo Caravaca Martínez, funcionario del Equipo de Regulación de la Salud del Área Rectora de Salud de Santa Cruz, en el informe técnico MS-RCH-ARS-SC-ERS-IT-0334-2021 de 9 de julio de 2021 dirigido al director de esa área, señaló: “ASUNTO: Informe en seguimiento orden sanitaria N◦ MS-RCH-ARS-SC-ERS-0144-2021, relacionado con denuncia N◦ EAC-DEN-0052-2021 sobre disposición de residuos sólidos en el camino viejo a Santa Bárbara, ubicado 2 km al este del salón multiusos de COOPEGUANACASTE. (…), procedo a informar lo siguiente: ANTECEDENTES • Resolución de recurso de amparo N◦ 2020012825 del expediente N◦ 20-007332-0007-CO de la sala constitucional (sic), donde se declara sin lugar el recurso interpuesto por los Srs. Manuel Pérez Agüero y [Nombre 001], por el problema de disposición de residuos sólidos a cielo abierto y en la vía pública. • Denuncia N◦ EAC-DEN-0052-2021 interpuesta el 11 de febrero de 2021 por aparente problema de mala disposición de residuos sólidos a cielo abierto y en vía pública. • Informe técnico N◦ MS-RCH-ARS-SCERS-IT-0194-2021, donde se indica la realización de inspección en atención a la denuncia N◦ EAC-DEN-0051-2021 y donde se corrobora lo denunciado, por lo que se solicita información mediante oficio acciones realizadas según lo denunciado. • Nota donde se interpone nuevamente denuncia donde se solicita la limpieza y habilitación de la vía pública (calle vieja a Santa Bárbara). • Informe técnico N⸰ MS-RCH-ARS-SC-ERS-IT-0289-2021, donde se recomienda girar orden sanitaria para que se informe a esta área rectora de salud debido a la NO respuesta por parte de la municipalidad según lo solicitado en el informe N MSRCH-ARS-SC-ERS-IT-0194-2021. • Orden Sanitaria N MS-RCH-ARS-SC-ERSOS-0144-2021 dirigida y notificada a la Sra. Dixabeth Matarrita Mendoza (vicealcaldesa), notificada el día 11 de junio de 2021 con plazo de cumplimiento de 10 días hábiles. • Oficio N DAM-1852-2021 emitido el 23 de junio de 2021 y notificado el 30 de junio de 2021 por la alcaldesa municipal a.i. en cumplimiento a la orden sanitaria N MS-RCH-ARSSC- ERS-OS-0144-2021. SOBRE LOS HECHOS DE LO ACTUADO SE INFORMA LO SIGUIENTE: 1. El día 30 de junio de 2021 al ser las 14:50 horas, se realiza inspección de seguimiento a la orden sanitaria N MS-RCH-ARSSC- ERS-OS-0144-2021, donde se observa una gran limpieza de residuos sólidos ordinarios, pero se observa la permanencia de residuos sólidos ordinarios (escombros y tierra) y orgánicos (ramas y hojas), por lo que según lo indicado en el oficio N DAM-1852-2021 se debe a la necesidad de maquinaria pesada y no contar con presupuesto y dicha maquinaria al momento de realizar la limpieza. 2. El día 08 de julio de 2021 al ser las 10:40 horas, se realiza inspección de seguimiento a la orden sanitaria N MS-RCHARSSC-ERS-OS-0144-2021, donde se observa siempre la permanencia de residuos ordinarios (escombros y tierra) y orgánicos (ramas y hojas). 3. Según las fotografías tomadas en los tres (3) escenarios se observa un trabajo realizado por la municipalidad de Santa Cruz con respecto al cumplimiento de lo ordenado y además se entiende la situación de la necesidad de designar presupuesto para realizar las obras o trabajos para poder remover la totalidad de los residuos. 4. Con respecto a lo solicitado en la conclusión del informe técnico N MS-RCHARS-SC-ERSIT-0194-2021 se logra entender que no existen multas ni actos administrativos por el NO funcionamiento de la cámara de vigilancia colocada en dicha localidad, por lo que la municipalidad deberá de realizar las acciones necesarias para que dicho sistema de vigilancia sea efectivo y no sea un recurso económico mal invertido, ya que el mismo ha estado fuera de operación. 5. Cabe señalar que la habilitación del camino o ruta como lo solicita el Sr. [Nombre 001] no es competencia de este Ministerio ya que no es algo que atente o ponga en riesgo la salud pública. 6. Según lo adjunto en el oficio N DAM-1852-2021, donde se remite oficio N DGA-0392-2021 Plan de intervención Sitio “La cuesta a Santa Bárbara” (plan remedial), se acepta siempre y cuando el trámite sea atendido con la mayor celeridad posible. CONCLUSIÓN A razón de lo hasta aquí visto mediante inspección en sitio, revisión de expediente y con las evidencias encontradas se recomienda DAR POR CUMPLIDA LA ORDEN SANITARIA. Además, se recomienda aceptar el plan remedial presentado mediante los oficios DAM-1852-2021 y DGA-0392-2021 y cabe señalar que esta área rectora de salud le estará brindando seguimiento al plan remedial, por lo que se solicita atender o priorizar el caso que aquí nos ocupa. Se recomienda notificar el presente correo a la Municipalidad de Santa Cruz y al quejoso para que tenga conocimiento sobre el plan de acciones o plan remedial presentado por dicho gobierno local”.

De lo anterior se desprende que, al 8 de junio de 2021, el sitio denominado “La Cuesta a Santa Bárbara” tenía un problema de indebida disposición de residuos sólidos, el cual se encontraba en las mismas condiciones al menos desde el mes de marzo anterior. De ahí que, tanto el Ministerio de Salud como la Municipalidad de Santa Cruz, se encontraban en la obligación atender tal situación cada uno dentro del ámbito de sus competencias, pues en ambas instituciones se había denunciado la problemática meses atrás (en diciembre de 2020 ante el gobierno local y en febrero de 2021 ante la autoridad de salud).

En relación con la Municipalidad de Santa Cruz, se acredita un periodo de inacción de más de cinco meses, pues fue hasta después de que el accionante reiterara su gestión el 1ͦ de junio de 2021 (esta vez ante el concejo municipal) y luego del dictado de la orden sanitaria MS-RCH-ARS-SC-ERS-OS-0144-2021 de 8 de junio de 2021, que el gobierno local emitió el “Plan de Intervención Sitio “La Cuesta a Santa Bárbara”. Asimismo, si bien consta que, el 8 de junio de 2021, el Departamento de Gestión Ambiental recogió mil trescientos cuarenta kilos de residuos y al día siguiente esa dependencia coordinó con la Unidad Técnica de Gestión Vial la colaboración para contar con una vagoneta, un cargador y choferes, no menos cierto es que fue hasta el 10 de julio de 2021 (luego de la notificación del curso a las autoridades de la administración municipal), que recolectaron cincuenta y dos mil ochocientos sesenta kilos de residuos, tales como “desechos de construcción, televisores, cerámica, libros, plásticos de todo tipo, desechos ordinarios”.

Sobre el Área Rectora de Salud de Santa Cruz, también se observa un inadecuado seguimiento a la problemática denunciada el 11 de febrero de 2021, toda vez que desde el 17 de marzo de 2021 se corroboró una mala disposición de residuos ordinarios en el lugar denunciado (incluso, el 27 de mayo de 2021, el accionante pidió una intervención urgente por las condiciones del sitio); empero, no fue sino hasta el 8 de junio siguiente que se dictó la orden sanitaria MS-RCHARS-SC-ERS-OS-0144-2021, luego de determinar la necesidad de una limpieza urgente y de verificar que el lugar se encontraba en las mismas condiciones desde marzo. En ese sentido, la orden sanitaria de marras con fecha de vencimiento 25 de junio de 2021, dispuso: “Por lo tanto, en el plazo antes indicado y a partir de esta notificación se le ordena: 1. Realizar la limpieza de dicha ruta en un plaza NO mayor a tres (3) días hábiles. 2. Replicar el plan de acciones correctivas propuesto mediante los oficio (sic) N◦ DAM-1602-2019 y DGA-0350-2019 y al mismo tiempo ampliar la programación de dichas acciones. 3. Remitir copia a esta área rectora de salud del plan de acciones anteriormente mencionado. 4. Brindar respuesta al informe técnico N MS-RCH-ARS-SC-ERS-IT-0194-2021 el cual fue remitido mediante el oficio MS-DRRSCH-DARSSC-391-2021 el día 08 de abril de 2021 (…)”. De hecho, el 30 de junio de 2021, el Área Rectora de Salud de Santa Cruz recibió el oficio DAM-1852-2021 de 23 de junio de 2021 de la alcaldesa a.i de Santa Cruz, en el que informó el cronograma y plan de acción, así como las medidas tomadas en atención a la orden sanitaria, entre ellas la recolección parcial de basura efectuada el 9 de junio y la reparación de la cámara vigilancia; sin embargo, en ese momento se informó que todavía existían tareas pendientes de cumplir.

Ahora, no fue sino hasta después del vencimiento del plazo otorgado en la orden sanitaria y luego de la notificación del curso de este amparo a la autoridad de salud recurrida, que un funcionario del Equipo de Regulación de la Salud del Área Rectora de Salud de Santa Cruz, en el informe técnico MS-RCH-ARS-SC-ERS-IT-0334-2021 de 9 de julio de 2021, recomendó dar por cumplida la orden y “aceptar el plan remedial presentado mediante los oficios DAM-1852-2021 y DGA-0392-2021”. No obstante, llama la atención de la Sala que ese funcionario haya recomendado dar por cumplida la orden sanitaria, pese a que, en el documento que suscribió, consignó expresamente que, al 8 de julio de 2021, todavía existían residuos ordinarios en el sitio denunciado. Incluso, nótese que, de acuerdo con el informe de la Municipalidad de Santa Cruz, no fue sino hasta dos días después de esa fecha que se recogieron desechos de “construcción, televisores, cerámica, libros, plásticos de todo tipo” cuya cantidad fue de cincuenta y dos mil ochocientos sesenta kilos. Asimismo, aun cuando tal funcionario también dispuso aceptar el plan remedial, lo condicionó a que fuera atendido a la mayor celeridad posible, por lo que no estableció plazos concretos ni un seguimiento adecuado.

En virtud de lo anterior, si bien se observa que, tanto la municipalidad como el área rectora de salud tomaron medidas y llevaron a cabo acciones luego de la notificación de este recurso, la Sala no aprecia que el plan remedial propuesto por el gobierno local hubiera sido analizado por la autoridad de salud a los efectos de determinar si constituye o no una solución viable y definitiva a la problemática denunciada. Asimismo, aun cuando se aprecia que un funcionario del Ministerio de Salud recomendó dar por cumplida la orden sanitaria, esto se hizo incluso antes de que la municipalidad presuntamente finalizara la recolección de residuos en el sitio, por lo que no consta un análisis íntegro y completo del cumplimiento de la orden sanitaria luego de los trabajos efectuados por el gobierno local.

Precisamente, ante la detección de un problema de salud pública como lo es la inadecuada disposición de grandes cantidades de residuos en sitios públicos, resulta trascendental no solo tomar medidas correctivas sino también preventivas para evitar que ese tipo de situaciones se vuelvan a presentar.

En consecuencia, se declara con lugar este extremo, en los términos que se dictarán en la parte dispositiva de la sentencia.

V.- Finalmente, aun cuanto el accionante solicita que se ordene al Departamento Unidad Técnica de Gestión Vial Municipal de la Municipalidad de Santa Cruz “la rehabilitación, habilitación y la presentación de un plan de mantenimiento periódico del camino de la calle vieja a Santa Bárbara”, no menos cierto es que en la gestión de diciembre de 2020 lo que se indicó fue “que la vía se encuentra en muy mal estado, la capa de rodamiento de lastre se encuentra dañado, con zanjas que impiden el tránsito de vehículos livianos, emergencias, servicios públicos u otros”. Sin embargo, no existe prueba en el expediente que demuestre que el estado de la calle sea intransitable a tal grado que ponga en peligro la vida o integridad física de la población. Asimismo, tampoco se individualizaron personas en estado de vulnerabilidad (adultas mayores, con discapacidad o menores de edad) que resulten afectadas por las condiciones del camino. Incluso, en el escrito de interposición este extremo se desarrolla de forma muy general, pues la mayoría de argumentos giran en torno a la indebida disposición de residuos. En todo caso, se observa que el mantenimiento del camino público está programado a partir del 17 de noviembre de 2021. En consecuencia, en los términos planteados en el escrito de interposición, se descarta alguna situación que amerite la intervención de la Sala en cuanto este extremo y, por ello, se declara sin lugar.

Por tanto:

Se declara parcialmente con lugar el recurso solo en cuanto a la falta de atención del problema indebida disposición de residuos en el sitio denominado “La Cuesta a Santa Bárbara”. Se ordena a Warren Chavarría Venegas, en su condición de director del Área Rectora de Salud de Santa Cruz, o a quien ocupe ese caso (sic), que gire las órdenes pertinentes y disponga lo necesario a los efectos de que: 1) en el plazo de TRES DÍAS contado a partir de la notificación de esta sentencia, se inspeccione el sitio denominado “La Cuesta a Santa Bárbara” y se determine si el primer punto de la orden sanitaria MS-RCH-ARS-SC-ERS-OS-0144-2021 que le impuso a la Municipalidad de Santa Cruz “1. Realizar la limpieza de dicha ruta en un plaza NO mayor a tres (3) días hábiles” fue efectivamente cumplido por ese gobierno local luego de los trabajos que realizó el 10 de julio de 2021 y, en caso de que ello no hubiera ocurrido, deberá llevarse a cabo todas las actuaciones que el ordenamiento jurídico faculta para procurar su cumplimiento; 2) en el plazo de UN MES contado a partir de la notificación de esta sentencia, se analice el plan remedial propuesto por la Municipalidad de Santa Cruz en atención a la orden sanitaria MS-RCH-ARS-SC-ERS-OS-0144-2021 y se determine si el cronograma y las acciones propuestas constituyen una solución efectiva al problema de salud pública detectado. Asimismo, no solo deberán darle seguimiento al plan remedial, sino que, en caso de que se establezca la necesidad de implementar acciones adicionales, o bien, la modificación de tal plan, deberán dentro del mismo plazo emitir las órdenes sanitarias correspondientes a fin de que se atienda de forma efectiva la problemática y se garantice su solución definitiva. Se ordena a Jorge Arturo Alfaro Orias y María Daisy Víquez Zamora, por su orden alcalde y jefa a.i. del Departamento de Gestión Ambiental, ambos de la Municipalidad de Santa Cruz, o a quienes ocupen sus cargos, que: 1) acaten las disposiciones y órdenes del Ministerio de Salud, en los plazos establecidos por esta autoridad, en cuanto a la atención de la problemática de indebida disposición de residuos en el sitio denominado “La Cuesta a Santa Bárbara”; 2) en el plazo de UN MES contado a partir de la notificación de esta sentencia, dispongan lo necesario y lleven a cabo todas las actuaciones dentro del ámbito de sus competencias a fin de garantizar la solución efectiva del problema de indebida disposición de residuos en el sitio denominado “La Cuesta a Santa Bárbara” para que así este no se vuelva a presentar. Se ordena a Marisela Moreno Rodríguez, presidenta del Concejo Municipal de Santa Cruz, o a quien ocupe ese cargo, de INMEDIATO, poner esta sentencia en conocimiento del órgano que representa, para que, en el ámbito de su competencia, se tomen los acuerdos necesarios y se coordine lo pertinente a los efectos de procurar el cumplimiento de lo resuelto por la Sala en lo que atañe al ente municipal. Se advierte a las autoridades recurridas que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado y la Municipalidad de Santa Cruz al pago de las costas, daños y perjuicios ocasionados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En cuanto a los hechos anteriores al 22 de abril de 2020 estese a lo resuelto en la sentencia n.ͦ 2020012825 de las 9:15 horas de 10 de julio de 2020. En lo demás, se declara sin lugar el recurso. El Magistrado Salazar Alvarado pone nota. Notifíquese.”.

Tal resolución fue notificada a las partes recurridas por correo electrónico el 17 de agosto de 2021.

II.- SOBRE LA GESTIÓN PLANTEADA. En la especie, el recurrente interpone gestión de desobediencia en relación con la sentencia nro. 2021017825 de las 9:20 horas de 13 de agosto de 2021. Manifiesta que: “NO HA SIDO ATENDIDA EN SU TOTALIDAD. Lo ofrecido por el ente municipal solo fue atendido de manera parcial en el año 2021 y parte del año 2022; sin embargo a finales del año 2022 y todo el año 2023 no continuaron con la atención de la problemática, es decir el cronograma de limpieza y de seguridad en la zona NO SOLUCIONO (sic) DEFINITIVAMENTE la situación; además el Área Rectora de Salud Pública de Santa Cruz no le dio seguimiento al Plan Remedial propuesto, ni atendió de forma efectiva el asunto con las ordenes (sic) sanitarias que procuraran la atención de depósitos de residuos en dicha vía, obviando su deber de fiscalizar las medidas propuestas por el ente municipal. (…) Valorando las omisiones de la Jefatura del Departamento de Gestión Ambiental, la Presidencia del Concejo Municipal, el señor Alcalde del cantón y ademas (sic) el olvido por parte de la Dirección del Área Rectora del Ministerio de Salud solicitamos que se les prevenga por UNICA (sic) VEZ el cumplimiento inmediato de dicha SENTENCIA”.

Sobre el particular, es menester recordar que en el referido pronunciamiento se ordenó: “a Warren Chavarría Venegas, en su condición de director del Área Rectora de Salud de Santa Cruz, o a quien ocupe ese caso (sic), que gire las órdenes pertinentes y disponga lo necesario a los efectos de que: 1) en el plazo de TRES DÍAS contado a partir de la notificación de esta sentencia, se inspeccione el sitio denominado “La Cuesta a Santa Bárbara” y se determine si el primer punto de la orden sanitaria MS-RCH-ARS-SC-ERS-OS-0144-2021 que le impuso a la Municipalidad de Santa Cruz “1. Realizar la limpieza de dicha ruta en un plaza NO mayor a tres (3) días hábiles” fue efectivamente cumplido por ese gobierno local luego de los trabajos que realizó el 10 de julio de 2021 y, en caso de que ello no hubiera ocurrido, deberá llevarse a cabo todas las actuaciones que el ordenamiento jurídico faculta para procurar su cumplimiento; 2) en el plazo de UN MES contado a partir de la notificación de esta sentencia, se analice el plan remedial propuesto por la Municipalidad de Santa Cruz en atención a la orden sanitaria MS-RCH-ARS-SC-ERS-OS-0144-2021 y se determine si el cronograma y las acciones propuestas constituyen una solución efectiva al problema de salud pública detectado. Se ordena a Jorge Arturo Alfaro Orias y María Daisy Víquez Zamora, por su orden alcalde y jefa a.i. del Departamento de Gestión Ambiental, ambos de la Municipalidad de Santa Cruz, o a quienes ocupen sus cargos, que: 1) acaten las disposiciones y órdenes del Ministerio de Salud, en los plazos establecidos por esta autoridad, en cuanto a la atención de la problemática de indebida disposición de residuos en el sitio denominado “La Cuesta a Santa Bárbara”; 2) en el plazo de UN MES contado a partir de la notificación de esta sentencia, dispongan lo necesario y lleven a cabo todas las actuaciones dentro del ámbito de sus competencias a fin de garantizar la solución efectiva del problema de indebida disposición de residuos en el sitio denominado “La Cuesta a Santa Bárbara” para que así este no se vuelva a presentar. Se ordena a Marisela Moreno Rodríguez, presidenta del Concejo Municipal de Santa Cruz, o a quien ocupe ese cargo, de INMEDIATO, poner esta sentencia en conocimiento del órgano que representa, para que, en el ámbito de su competencia, se tomen los acuerdos necesarios y se coordine lo pertinente a los efectos de procurar el cumplimiento de lo resuelto por la Sala en lo que atañe al ente municipal”.

Al respecto, con ocasión de la gestión de desobediencia planteada, el director del Área Rectora de Salud de Santa Cruz informó: “DECIMO (sic) TERCERO- Consta en los folios 00267, 00268 y 00269 del expediente administrativo Informe Técnico MS-RCH-ARS-SC-ERS-IT-00393-2021; en donde se extrae de su conclusión “(…) De acuerdo con el seguimiento realizado en “La cuesta de Santa Barbara” , en atención resolución N° 2021017825, se Comprueba el cumplimiento del punto uno y do (sic) de la orden sanitaria N° MS-RCH-ARS-S-ERS-OS-0144-2021, ya que las fechas de limpieza programadas para el martes 8 de junio, viernes 30 de julio fueron debidamente ejecutadas y el lugar se encuentra limpio libre de residuos ordinarios. DECIMO (sic) CUARTO- Consta de folio 00290 al folio 00293 del expediente administrativo, Acta de Inspección en Sitio N° MS-RCH-ARS-SC-ERS.AIO-11-2024., donde se extrae lo siguiente: “(…) El día y hora arriba señalados se realiza inspección en sitio con el fin de verificar el cumplimiento de la orden sanitaria N° MS-RCH-ARS-S-ERS-OS-0144-2021, específicamente el cumplimiento del punto N° 1 – Realizar la limpieza de dicha ruta en un plazo NO mayor a tres (3) días hábiles. Al momento de la vista se logra comprobar el cumplimiento de lo solicitado se aportan fotografías que demuestran que el sitio se encuentra limpio de desechos. (…) se le ha venido dando seguimiento a la orden sanitaria N° MS-RCH-ARS-SC-ERS-OS-0144-2021, e inclusive en la ultima (sic) inspección realizada en el presente año 2024 se logró comprobar el cumplimiento de lo solicitado”.

Por su parte, las autoridades municipales señalaron: “En Oficio DAM-DGA-PA-0003-2024 del 23 de Enero de 2024 el Señor Manuel Angulo Mora del Departamento de Protección Ambiental, informó a la Coordinadora de Servicios Ambientales Geissel Linet Gutiérrez Marchena, lo siguiente: "El día 23 de enero de 2024 se realizó la campaña de limpieza en el lugar conocido con (sic) la Cuesta, específicamente camino viejo a Santa Barbara, donde encontramos desechos de todo tipo como, por ejemplo, residuos ordinarios, láminas de zinc, plásticos de todo tipo, restos de camas, fregaderos, etc." El oficio indicado continuó mencionando que: "Cabe mencionar que la ejecución del trabajo fue realizado, en un horario de 09:00 a. m., a 12:00 m.d, y realizada por dos funcionarios del Servicio de Servicios Urbanos Ambientales y mi persona. He de indicar que los residuos se trasladaron a el vehículo placa SM 5868, y se dispusieron una cantidad de 1430 kilos, que fueron depositados en el Relleno Sanitario del PTA".

Desde este panorama, no se observa algún incumplimiento que en este momento amerite la intervención de la Sala. Nótese que, de acuerdo con lo informado por las autoridades recurridas, el acta de inspección del Ministerio de Salud de 24 de enero de 2024 y las fotografías aportadas, el lugar se encuentra limpio y sin desechos. Incluso, consta en el expediente no solo el cumplimiento de las órdenes sanitarias emitidas, sino la programación de campañas de limpieza trimestrales por parte del gobierno local.

En consecuencia, no ha lugar a la gestión formulada.

III.- Finalmente, el recurrente manifiesta: “Por este medio informamos que la calle vieja hacia Santa Bárbara, ubicada a tan solo un kilómetro de las oficinas centrales de la Municipalidad de Santa Cruz continúa recibiendo grandes cantidades basura de varios tipos, ahora se está viendo afectada una naciente de agua que pasa por dicha calle con el depósito de recipientes de almacenamiento de grasas de cocina u otros; así también su acceso se ha deteriorado, los planes de vigilancia (cámara de monitoreo y vigilancia policial) no funcionan desde finales del año 2022, convirtiendo nuevamente el sitio en una zona insalubre y peligrosa donde existe un gran peligro a la salud pública de los vecinos de Campero”.

Atinente a lo anterior, el tutelado narra hechos nuevos y posteriores al dictado de la sentencia principal de este proceso (nro. 2021017825 de las 9:20 horas de 13 de agosto de 2021). Justamente, reclama la afectación de una naciente de agua por el depósito de recipientes de almacenamiento de grasas de cocina u otros, el deterioro del acceso y la falta de funcionamiento de los planes de vigilancia (cámara de monitoreo y vigilancia policial) desde finales de 2022. Dentro de este contexto, lo procedente es desglosar el escrito incorporado en el expediente electrónico el 17 de enero de 2024, a fin de que sea tramitado como un asunto nuevo en cuanto a estos últimos extremos.

IV.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidos en algún dispositivo de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en el plazo máximo de 30 días hábiles contado a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material no retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 del 22 de agosto de 2011, publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012, así como en el acuerdo de Consejo Superior del Poder Judicial, aprobado en el artículo LXXXI de la sesión nro. 43-12 celebrada el 3 de mayo de 2012.

Por tanto:

 No ha lugar a la gestión formulada. Desglósese el escrito incorporado en el expediente electrónico el 17 de enero de 2024, a los efectos de que, en los términos del considerando III in fine de este pronunciamiento, sea tramitado como un asunto nuevo.

**CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE.** San José, at nine hours fifty minutes on February twenty-seventh, two thousand twenty-four.

Subsequent proceeding filed by [Name 001], in relation to judgment no. 2021017825 of 9:20 hours on August 13, 2021.

**Whereas:**

1.- By brief incorporated into the electronic case file on January 17, 2024, the petitioner files a subsequent proceeding in relation to judgment no. 2021017825 of 9:20 hours on August 13, 2021. He states that: “IT HAS NOT BEEN FULLY COMPLIED WITH. What was offered by the municipal entity was only partially addressed in the year 2021 and part of the year 2022; however, at the end of the year 2022 and throughout the year 2023 they did not continue addressing the problem, that is, the cleaning and security schedule in the area DID NOT DEFINITIVELY RESOLVE (sic) the situation; furthermore, the Santa Cruz Public Health Governing Area (Área Rectora de Salud Pública de Santa Cruz) did not follow up on the proposed Remedial Plan, nor did it effectively address the matter with the sanitary orders (ordenes sanitarias) that would ensure the handling of waste deposits on said road, ignoring its duty to oversee the measures proposed by the municipal entity. We hereby inform that the old road to Santa Bárbara, located just one kilometer from the central offices of the Municipality of Santa Cruz, continues to receive large quantities of various types of trash, and a spring (naciente) that passes through said road is now being affected by the deposit of containers storing cooking grease or other substances; likewise, its access has deteriorated, the surveillance plans (monitoring camera and police surveillance) have not worked since the end of the year 2022, once again turning the site into an unsanitary and dangerous area where there is a great danger to the public health of the residents of Campero. Assessing the omissions of the Head of the Environmental Management Department (Jefatura del Departamento de Gestión Ambiental), the Presidency of the Municipal Council (Concejo Municipal), the Mayor of the canton, and also (sic) the neglect by the Directorate of the Governing Area (Área Rectora) of the Ministry of Health, we request that they be warned FOR THE ONLY (sic) TIME to immediately comply with said JUDGMENT.”

2.- By order of the instructing magistrate at 7:23 hours on January 19, 2024, a hearing was granted to Warren Chavarría Venegas, in his capacity as director of the Santa Cruz Health Governing Area (Área Rectora de Salud de Santa Cruz); as well as to Jorge Arturo Alfaro Orias, María Daisy Víquez Zamora and Marisela Moreno Rodríguez, in their respective roles as mayor, acting head of the Environmental Management Department (Departamento de Gestión Ambiental) and president of the Municipal Council (Concejo Municipal), all of the Municipality of Santa Cruz, so that they may refer to and provide the corresponding evidence regarding the acts and omissions attributed to them.

3.- By brief incorporated into the electronic case file on January 25, 2024, Jorge Arturo Alfaro Orias and Maricela Moreno Rodríguez, in their respective roles as mayor and president of the council, both of the Municipality of Santa Cruz, report in the following terms: “In Official Communication DAM-DGA-PA-0003-2024 of January 23, 2024, Mr. Manuel Angulo Mora of the Environmental Protection Department (Departamento de Protección Ambiental), informed the Coordinator of Environmental Services (Servicios Ambientales) Geissel Linet Gutiérrez Marchena, of the following: 'On January 23, 2024, a cleaning campaign was carried out at the place known as (sic) La Cuesta, specifically the old road to Santa Barbara, where we found waste of all kinds, for example, ordinary waste, zinc sheets, plastics of all types, remains of beds, sinks, etc.' The indicated official communication went on to mention that: 'It is worth mentioning that the work was carried out from 9:00 a.m. to 12:00 p.m., and performed by two officials from the Urban Environmental Services (Servicios Urbanos Ambientales) unit and myself. I must indicate that the waste was transferred to vehicle license plate SM 5868, and a quantity of 1430 kilos was disposed of at the PTA Sanitary Landfill (Relleno Sanitario del PTA).' Request: Having in view the disobedience alleged by the petitioner [Name 001], I request that it be dismissed in all its aspects, on the grounds that the Municipality of Santa Cruz has complied with what was ordered by this Chamber in Judgment No. 2021017825 of nine hours twenty minutes on August thirteenth, two thousand twenty-one.”

4.- By brief incorporated into the electronic case file on January 26, 2024, Warren Chavarría Venegas reports, in his capacity as director of the Santa Cruz Health Governing Area (Área Rectora de Salud) of the Ministry of Health of Santa Cruz. He indicates: “I - REGARDING THE FACTS FIRST- Found on folios 00124, 00125 and 00126 of the administrative file is Technical Report No. MS-RCH-ARS-SC-ERS-IT-0194-2021, which in its conclusion indicates the following: ‘(…) By reason of what has been observed here through inspection at and with the evidence found, it is recommended to request a report from the Municipality of Santa Cruz, offering a description of the actions taken after the surveillance camera was installed (is said camera operating, who is the person responsible for observing said camera, what actions have been taken and, if a person or vehicle is caught depositing waste on the road or public thoroughfare, what sanction or measure is applied?), also requesting to proceed with cleaning and/or maintenance work on the route or road mentioned above.’ SECOND- Found on folio 00128 of the administrative file is official communication DAM-0931-2021, in which Mr. Jorge Arturo Alfaro Orias, Municipal Mayor of Santa Cruz, requests the Environmental Management Department (Departamento de Gestión Ambiental) to carry out the actions indicated in Technical Report No. MS-RCH-ARS-SC-ERS-IT-0194-2021. THIRD- Found on folio 00129 of the administrative file is a note addressed to Dr. Warren Chavarría Venegas, director of the Santa Cruz Health Governing Area, Ministry of Health on the 127th (sic) of May, 2021, by Mr. [Name 001], which indicates that the disposal of waste on the public road persists, and requests a Sanitary Order (Orden Sanitaria) be issued against the Environmental Management Department and the mayor of Santa Cruz, ordering them to clean and enable the public road immediately. FOURTH- Found on folios 00135 and 00136 of the administrative file is Technical Report No. MS-RCH-ARS-SC-ERS-IT-0289-2021, issued by Bachelor Guillermo Caravaca Martínez of the Regulation Team of the Santa Cruz Health Governing Area (Area Rectora de alud), where in the conclusion, he states ‘(…) By reason of what has been observed here through site inspection and with the evidence found, it is recommended to ISSUE A SANITARY ORDER (ORDEN SANITARIA) requesting a report from the municipality of Santa Cruz on the actions as requested in Technical Report No. MS-RCH-ARS-SC-ERS-IT-0194-2021, also requesting to carry out the cleaning and/or maintenance work on the route or road mentioned above as soon as possible.’ FIFTH- By reason of the recommendation indicated by Bachelor Guillermo Caravaca Martínez of the Regulation Team of the Santa Cruz Health Governing Area, found on folios 00137 and 00138 of the administrative file is that, on June 8, 2021, sanitary order (orden sanitaria) No. MS-RCH-ARS-S-ERS-OS-0144-2021 was issued, where among other things, the following was ordered: ‘1. Carry out the cleaning of said route within a period not exceeding three (3) working days. 2. Replicate the corrective action plan proposed via official communication No. DAM-1602-2021-DGA-0350-2019, and at the same time extend the schedule for said actions.’ SIXTH- Found on folio 00140 of the administrative file is official communication DAM-1628-2021, through which Licda Dixabeth Matarrita Mendoza, acting mayor of the Municipality of Santa Cruz, requests the Environmental Management Department to comply with Sanitary Order No. MS-RCH-ARS-S-ERS-OS-0144-2021. SEVENTH- Found on folios 00142 and 00143 of the administrative file is official communication DAM-1852-2021, through which Licda Dixabeth Matarrita Mendoza, acting mayor, informs Dr. Warren Chavarría Venegas, director of the Santa Cruz Health Governing Area, of compliance with Sanitary Order No. MS-RCH-ARS-S-ERS-OS-0144-2021. EIGHTH- Found from folio 00159 to folio 00165 of the administrative file is official communication DAM-2033-2021, through which MSC Jorge Arturo Alfaro Orias, mayor of the Municipality of Santa Cruz, presents to Dr. Warren Chavarría Venegas, director of the Santa Cruz Health Governing Area, the Intervention Plan for the Site “La cuesta a Santa Bárbara”. NINTH- Found from folio 00166 to folio 00169 of the administrative file is an amparo action, filed by Mr. [Name 001], against the Ministry of Health and others. TENTH- Found from folio 00170 to folio 00173 of the administrative file is Technical Report No. MS-RCH-ARS-SCERS-IT-0334-2021, on an inspection carried out at the site on June 30, 2021, by Bachelor Guillermo Caravaca Martínez of the Regulation Team of the Santa Cruz Health Governing Area, where it can be extracted from said report that the conclusion reached is that the SANITARY ORDER IS DEEMED COMPLIED WITH. ELEVENTH- Found from folio 00178 to folio 00181 of the administrative file is official communication DR-CH-PSJ-A-387-2020, through which Dr. Warren Chavarría Venegas, Director of the Santa Cruz Health Governing Area, issues a report on the Amparo Action filed by Mr. [Name 001], against the Santa Cruz Health Governing Area, where it is concluded: ‘With the foregoing and with the documentary evidence provided, it is evident and manifest that the Santa Cruz Health Area (Area de Salud de Santa Cruz) has done everything related to its competence, it has been demonstrated that all the complaints filed have been addressed, and Sanitary Order No. MS-RCH-ARS-S-ERS-OS-0144-2021 has been continuously followed up on, where partial compliance has been observed on the part of the municipality of Sata Cruz with respect to compliance with what was ordered.’ TWELFTH- Found from folio 00190 to folio 00261 of the administrative file is resolution number 2021017825 of the Constitutional Chamber of the Supreme Court of Justice, at nine hours and twenty minutes on August 13, 2021, regarding the amparo action filed by Mr. [Name 001], where it is extracted in the therefore part of said resolution: ‘The action is partially granted only with regard to the lack of attention to the problem of improper waste disposal at the site called “La Cuesta a Santa Bárbara”. It is ordered to Warren Chavarría Venegas, in his capacity as director of the Santa Cruz Health Governing Area (Área Rectora de Salud de Santa Cruz), or whoever holds that position, to issue the pertinent orders and provide what is necessary so that: 1) within a period of THREE DAYS counted from the notification of this judgment, the site called “La Cuesta a Santa Bárbara” be inspected and it be determined whether the first point of sanitary order MS-RCH-ARS-SC-RS-OS-0144-2021 imposed on the Municipality of Santa Cruz - “1. Carry out the cleaning of said route within a period NOT exceeding three (3) working days” - was effectively complied with by that local government after the work carried out on July 10, 2021, and, should this not have occurred, all actions that the legal system provides must be undertaken to ensure its compliance; 2) within a period of ONE MONTH counted from the notification of this judgment, the remedial plan proposed by the Municipality of Santa Cruz in response to sanitary order MS-RCH-ARS-SCERS-OS-0144-2021 be analyzed and it be determined whether the schedule and actions proposed constitute an effective solution to the detected public health problem. Likewise, not only must they follow up on the remedial plan, but, should the need to implement additional actions be established, or the modification of such plan, they must within the same period issue the corresponding sanitary orders so that the problem is effectively addressed and its definitive solution is guaranteed. It is ordered to Jorge Arturo Alfaro Orias and María Daisy Víquez Zamora, in their respective roles as mayor and acting head of the Environmental Management Department (Departamento de Gestión Ambiental), both of the Municipality of Santa Cruz, or whoever holds their positions, to: 1) abide by the provisions and orders of the Ministry of Health, within the deadlines established by this authority, regarding the attention of the problem of improper waste disposal at the site called “La Cuesta a Santa Bárbara”; 2) within a period of ONE MONTH counted from the notification of this judgment, provide what is necessary and carry out all actions within the scope of their powers in order to guarantee the effective solution to the problem of improper waste disposal at the site called “La Cuesta a Santa Bárbara” so that it does not recur. It is ordered to Marisela Moreno Rodríguez, president of the Municipal Council of Santa Cruz, or whoever holds that position, to IMMEDIATELY make this judgment known to the body she represents, so that, within the scope of its competence, the necessary agreements are taken and the pertinent actions are coordinated to ensure compliance with what has been resolved by the Chamber regarding the municipal entity. The respondent authorities are warned that, in accordance with the provisions of Article 71 of the Law of Constitutional Jurisdiction (Ley de la Jurisdicción Constitucional), imprisonment of three months to two years or a fine of twenty to sixty days shall be imposed on anyone who receives an order that must be complied with or enforced, issued within an amparo action, and does not comply with it or enforce it, provided that the offense is not more severely punished. The State and the Municipality of Santa Cruz are ordered to pay the costs, damages, and losses caused by the acts that serve as the basis for this declaration, which shall be liquidated in the enforcement of the judgment in contentious-administrative proceedings. As for the events prior to April 22, 2020, abide by what was resolved in judgment no. 2020012825 of 9:15 hours on July 10, 2020. In all other respects, the action is dismissed...’ THIRTEENTH- Found on folios 00267, 00268 and 00269 of the administrative file is Technical Report MS-RCH-ARS-SC-ERS-IT-00393-2021; where it is extracted from its conclusion: ‘(…) In accordance with the follow-up carried out in “La cuesta de Santa Barbara”, in response to resolution No. 2021017825, compliance with points one and two of sanitary order No. MS-RCH-ARS-S-ERS-OS-0144-2021 is Verified (sic), since the cleaning dates scheduled for Tuesday, June 8, and Friday, July 30 were duly executed and the place is found clean, free of ordinary waste.’ FOURTEENTH- Found from folio 00290 to folio 00293 of the administrative file is On-Site Inspection Record No. MS-RCH-ARS-SC-ERS.AIO-11-2024., where the following is extracted: ‘(…) On the day and time indicated above, an on-site inspection is carried out in order to verify compliance with sanitary order No. MS-RCH-ARS-S-ERS-OS-0144-2021, specifically compliance with point No. 1 – Carry out the cleaning of said route within a period NOT exceeding three (3) working days. At the time of the inspection, compliance with what was requested is verified; photographs are provided that demonstrate the site is free of waste.’ II- CONCLUSION With the foregoing and with the documentary evidence provided, it is evident and manifest that the Santa Cruz Health Governing Area (Área Rectora de Salud de Santa Cruz) has done everything related to its competence, it has been demonstrated that all the complaints filed have been addressed, and Sanitary Order No. MS-RCH-ARS-SC-ERS-OS-0144-2021 has been continuously followed up on, and even in the last (sic) inspection carried out in the current year 2024, compliance with what was requested was verified.”

5.- By certification of January 29, 2024, Paola Castro Pérez and Mariane Castro Villalobos, in their respective roles as judicial technician 3 and acting secretary, both of this Chamber, made it known: “reviewed, at fourteen hours fifty-eight minutes on January twenty-ninth, two thousand twenty-four, in the COSTA RICAN JUDICIAL CASE MANAGEMENT SYSTEM for the CONTROL OF RECEIVED DOCUMENTS AND THIS CASE FILE, it did not appear that from January 23 to 25, 2025, the acting head of the Environmental Management Department of the Municipality of Santa Cruz had filed any brief or document, in order to render the report requested in the resolution issued at seven hours twenty-three minutes on January nineteenth, two thousand twenty-four, in case file number 21-013028-0007-CO, which is an AMPARO ACTION brought by [Name 001].”

6.- In the proceedings followed, the legal prescriptions have been observed.

Drafted by Magistrate Rueda Leal; and,

**Considering:**

I.- In judgment no. 2021017825 of 9:20 hours on August 13, 2021, the following was ordered:

“IV.- Regarding the specific case. In the sub lite, the petitioner also mentions events that occurred after the judgment cited in the preceding considering. He points out that on December 14, 2020, he filed a new complaint with the municipal mayor's office regarding the improper disposal of solid waste, in which he requested the application and follow-up of the preventive measures proposed in 2019. He states that on February 11, 2021, he filed complaint no. EAC-DEN-0052-2021 before the Santa Cruz Health Governing Area (Área Rectora de Salud de Santa Cruz), for the same problem. He states that, on April 6, 2021, the Santa Cruz Health Governing Area issued technical report MS-RCH-ARS-SC-ERS-IT-0194-2021 regarding the inadequate disposal of solid waste in the sector of “Calle Vieja a Santa Bárbara”, which was notified on April 8 following to the office of the Municipal Mayor's Office. He adds that on May 27, 2021, he requested the director of the Santa Cruz Health Governing Area to urgently issue a sanitary order for the immediate cleaning of the area and rehabilitation of the public road, since three months had passed since the complaint was filed. He notes that on June 1, 2021, he filed a complaint before the Municipal Council (Concejo Municipal) of Santa Cruz due to the delay of the Mayor's Office and the Environmental Management Department (Departamento de Gestión Ambiental) in addressing the complaint filed in December 2020. He assures that on June 8, 2021, after reporting the problem in a local media outlet, some municipal officials appeared at the place in a pick-up style vehicle and collected a small part of the waste - the recyclables -; however, they left more than 90% of the waste, including debris, washing machines, oil, motors, vehicle parts. He states that such waste is located near water tributaries, agricultural areas, livestock areas, and houses. He recounts that, on June 8, 2021, the Santa Cruz Health Governing Area issued sanitary order-RCH-ARSSC-ERS-OS-0144-2021, in which it ordered the application of urgent measures. He notes that, on June 18, 2021, the Municipal Council, by official communication SM-0890-Ord.23-2021, unanimously agreed to once again refer his complaint to the mayor's office and the responsible department. He argues that he comes before the Chamber for the purpose of obtaining efficient service from the Municipality of Santa Cruz and the Ministry of Health. He formulates the following petition: ‘1. I request that the Mayor's Office and the Environmental Management Department of the Municipality of Santa Cruz be ordered to immediately comply with Sanitary Order MS-RCH-ARS-SC-ERS-OS-0144-2021 and to immediately present a new plan of actions for long-term collection, maintenance, and cleaning of the old road to Santa Bárbara. 2. I request that the Municipal Road Management Technical Unit Department be ordered to rehabilitate, enable, and present a periodic maintenance plan for the old road to Santa Bárbara. 3. I request that the Ministry of Public Health, Santa Cruz office, be ordered to initiate, if necessary, the administrative procedure according to the General Health Law “fine for disobedience” or the referral to the Public Ministry in the event of non-compliance with sanitary order MS-RCH-ARS-SC-ERS-OS-0144-2021’.

From the study of the case file, in relation to the Municipality of Santa Cruz, it is established that, on December 15, 2020, that entity received an official communication from the petitioner addressed to the mayor, in which he indicated: ‘This letter serves to greet you and also very respectfully to make a formal request for INTERVENTION on the public road under municipal supervision located on the old road towards Santa Bárbara, la cuesta sector, where to date there are several garbage deposits, a situation that has been reported since August 20, 2018, to previous municipal administrations where the Ministry of Health, the Ombudsman's Office (Defensoría de los Habitantes), the Constitutional Chamber, CoopeGuanacaste have had to intervene, with forceful actions so that the responsible department would carry out the tasks it was required to perform by virtue of its office. Starting in 2019, the environmental management department, under pressure from various sectors, issued preventive measures in official communications DGA-0350-2019, DGA-0185-2019, DGA0222-2019 and DGA-0627-2019, where it recommends certain actions with the involvement of various municipal departments, which have been insufficient and were not fully implemented; I highlight some of them: carry out cleaning campaigns; the need to monitor the site with video cameras and with on-site monitoring rounds has been raised, Place (sic) lamps to provide lighting, Enabling the road so that it is frequented again and offenders fear being discovered polluting the site with waste, A plan for tree planting on adjoining properties to beautify the route could also be proposed, added to the rehabilitation and lighting of the road, the route could become attractive for holding cycling competitions and recreational cycling, as well as for walks or horseback rides, for example. Another aspect is that the road is in very poor condition, the ballast wearing course is damaged, with ditches that prevent the transit of light vehicles, emergencies, public services or others, hence the importance of the collaboration of the Road Management Technical Unit which, since July 17, 2019, had committed (sic) to intervening on the public road via email with the undersigned. Currently, a video surveillance camera is installed in the area that is supposed to work 24 hours a day, however, consulting the Municipal Police service, they informed me that they do not have access to it, only the Administrative (sic) staff of Environmental Management who work office hours, thereby limiting the good use of the device that could be used by both the Municipal Police and the canton's Public Police Force. In the interest of environmental protection, of compliance with the provisions of Article 8 of the Law for Integrated Waste Management No. 8839, it establishes among the functions of the municipalities the following: “The municipalities shall be responsible for the integrated management of waste generated in their canton; to this end, they must: f) prevent and eliminate dumps in the canton and the unauthorized collection of waste. (...) j) Promote training and carry out educational awareness campaigns for the inhabitants of the respective canton to encourage the culture of separated collection, cleaning of public spaces, and integrated waste management.” I request that you use your good offices for the timely attention of this widely reported case and to eradicate environmental contamination in the area’. On June 1, 2021, the Secretariat of the Municipal Council of Santa Cruz received a petition from the petitioner addressed to the president of that body, in which he indicated: ‘This letter serves to greet you and also very respectfully to request your valuable intervention and that of the Council (sic) you preside over in relation to a complaint filed by the undersigned with the municipal mayor's office since the month of December of the year 2021 (sic), in reference to an open-air garbage dump located in the sector of the old road towards Santa Bárbara, la cuesta sector, just 1 km from the Municipality, where all types of waste are deposited on the public road in said road, greatly contaminating the environment and preventing the free transit of people to their properties. This situation has been occurring for years and it is not the first time it has been reported, however, over the last three years I have verified that said department does not continuously carry out the cleanings it proposes, there are no reports indicating how many cases it has referred to the Environmental Tribunal (Tribunal Ambiental) for violations of the Environmental law, among others. It should be noted that since the year 2020 officials have had a great tool to apply the legislation since a high-tech video surveillance camera was installed at the site that, according to what the Municipal Police informed me, only Environmental Management has access to, in a limited schedule of 8 hours a day and 5 days a week, which detracts from the benefit that can be derived from the good use of the device. It is important to mention that since August 20, 2018, several institutions have had to intervene such as the Ministry of Health (with two sanitary orders), the Ombudsman's Office (recommendations for non-compliance with municipal response and service), the Constitutional Chamber (Amparo for the right to Health), CoopeGuanacaste (installation of lamps and offer of trees) to urge the environmental department to carry out the tasks it was required to perform by virtue of its office, the response of said department has always been late, incomplete, and inefficient in dealing with a matter as delicate as Sanitation. Starting in 2019, the Environmental Management Department, under pressure from various sectors, issued preventive measures in official communications DGA-0350-2019, DGA-0185-2019, DGA0222-2019 and DGA-0627-2019, where it committed to carrying out certain actions which were not fully implemented. Below, I highlight some of them: carry out cleaning campaigns; the need to monitor the site with video cameras and with on-site monitoring rounds has been raised, Place (sic) lamps to provide lighting, Enabling the road so that it is frequented again and offenders fear being discovered polluting the site with waste, A plan for tree planting on adjoining properties to beautify the route could also be proposed, added to the rehabilitation and lighting of the road, the route could become attractive for holding cycling competitions and recreational cycling, as well as for walks or horseback rides, for example.’ Currently the road is in very poor condition since the ballast wearing course is very damaged, full of waste, glass and ditches that prevent the transit of light vehicles, emergencies, municipal services or others, hence the importance of the collaboration of the Road Management Department which, since July 17, 2019, had committed to intervening on the public road via emails with the undersigned and with the office of the mayor's office. In the interest of providing good municipal service, environmental protection, and compliance with the provisions of Article 8 of the Law for Integrated Waste Management No. 8839, which establishes among the functions of the municipalities the following: “The municipalities shall be responsible for the integrated management of waste generated in their canton; to this end, they must: f) prevent and eliminate dumps in the canton and the unauthorized collection of waste. (...) j) Promote training and carry out educational awareness campaigns for the inhabitants of the respective canton to encourage the culture of separated collection, cleaning of public spaces, and integrated waste management.” I very respectfully request the following: FIRST: That periodic cleaning be carried out in the reported area (at least one cleaning per quarter) and that the continuation of the remedial plan presented by the Environmental Management Department in the year 2020 be managed. SECOND: That coordination be made with the Road Management Department for the scraping, cleaning and treatment of the section with ballast from the main entrance to the sector of la cuesta (A.Y.A tank). THIRD: That preventive operations be coordinated by the municipal police and that they be allowed to access the video surveillance system in order to apply the corresponding sanctions. FOURTH: That the removal of weeds, branches or other elements that impede the good visibility of the installed camera and the public lighting installed by Coopeguanacaste be coordinated.’

FIFTH: That I be granted an audience with the Municipal Council (sic) in its weekly assembly in order to present solutions or contributions as a complainant and citizen. The Environmental Services coordinator of the Environmental Management Department of the Municipality of Santa Cruz, through official letter DGA-0392-2021 of June 9, 2021, addressed to the acting mayor, stated: "Subject: Intervention Plan for the 'La Cuesta a Santa Bárbara' Site Dear Madam: Receive a cordial greeting and a sincere wish of success in your work. This letter is to respond to point 2 of the Sanitary Order MS-RCH-ARSSC-ERS-OS-0144-2021… 'Replicate the plan of corrective actions proposed through official letters N°0162-2019 and DGA-0350-2019 and simultaneously expand the scheduling of said actions'… (…) Of the Plan proposed in 2019, this Department recommends resuming the following points for the year 2021: (….) On the other hand, it is worth highlighting that the decision regarding the intervention for rehabilitation of the public road cited in the proposal is a matter that does not fall within the competence of the Environmental Management Department, nor is the planning of the route's intervention, nor the designation or reservation of a budget for it; for which reason those responsible for said task are cited in this Plan. Finally, attached to this document is a list of the antecedent official letters on this subject to inform the current administration of the state of the matter and what this Department has repeatedly indicated regarding the proposed approach to the problems arising at the site called 'La Cuesta a Santa Bárbara'."

The Municipal Council of Santa Cruz, in subsection 22 of article 4 of ordinary session 23-2021 held on June 8, 2021, agreed to transfer the petition that the claimant presented before that body to the mayor. The Environmental Services coordinator of the Environmental Management Department of the Municipality of Santa Cruz, through official letter DGA-0434-2021 of June 22, 2021, addressed to the acting mayor, stated: "Subject: Indication regarding attention at the cuesta Santa Bárbara (…) By means of this letter, I greet you and wish you success in your duties. Regarding official letter DAM-1628-2021 on Sanitary Order MSRCH-ARS-SC-ERS-OS-0144-2021, sent on June 8, 2021, in relation to the attention of the old road to Santa Bárbara, it is indicated that it was intervened on June 8, 2021, by personnel from the Environmental Management Department. Regarding the work carried out, through official letter DGA-0039 2021 of June 9, Environmental Inspector Overath Ortega Urbina reports on the work performed by this Department, which cites: 'On June 8, 2021, the Environmental Management Department began cleaning work in this sector. It should be noted that 3 laborers were used, 38 bags were consumed, 3 trips were made in the pick-up SM-4403, and I report (sic) that 1340 kilos of waste were disposed of.' It is important to clarify that for the pending attention work, on Wednesday, June 9, 2021, coordination was made (sic) with the Vial Management Technical Unit for the collaboration of a dump truck, a loader, and the drivers, this being necessary for on-site attention, where the following was indicated by Mr. Didier Monge Jimenez (sic): 'Regarding the equipment request, it is indicated that at the moment the loader is not operational and we only have one dump truck which is assigned in the Portegolpe sector, making it impossible for us to supply the requested equipment for tomorrow. On the other hand, there is no economic resource available to arrange for rented equipment on demand.' Given this, we are awaiting the response from the UTGV regarding the moment when it is possible to make use of the machinery. (…) Added to the above is the Intervention Plan for the 'La Cuesta Santa Bárbara' Site, prepared by Geographer Geissel Gutiérrez Marchena, reported through official letter DGA-0392-2021, on June 9, 2021, detailing preventive measures in attention to compliance with the sanitary order, which involves other units of the Municipality in complement to the management provided by the Environmental Management Department. Thus, the plan proposed for the year 2021 is set forth in relation to the aforementioned point."

The Vial Management Technical Unit of the Municipality of Santa Cruz, by official letter DDUR-UTGVM-2021-039 of July 2, 2021, addressed to the mayor of Santa Cruz, mentioned: "By this means, a schedule is provided for the maintenance of the old road La Cuesta-Santa Bárbara, where according to the work schedule, it would be intervened starting November 17, 2021."

On July 8, 2021, the head of the Environmental Management Department of the Municipality of Santa Cruz was notified of the course of this proceeding. On July 9, 2021, the mayor of Santa Cruz was notified of the course of this proceeding. The Environmental Services coordinator of the Environmental Management Department of the Municipality of Santa Cruz, through official letter DGA-0492-2021 of July 9, 2021, addressed to the acting mayor, stated: "Subject: Indication regarding attention at the cuesta Santa Bárbara in addition to official letter DGA-0434-2021. Good afternoon, dear sir, By means of this letter I greet you and wish success in your duties. This letter is to report the management undertaken before the Vial Management Technical Unit, in relation to the request for the provision of a dump truck and a loader, with their respective driver, necessary for the attention of the sector called Cuesta Santa Bárbara. For your knowledge, it is indicated that the diligence is carried out via email which complements the conversations held through phone calls. However, we do not have a communication from the UTGV in which they confirm the opportune time for the equipment to be used. (…)."

Katia Gómez Mata, environmental educator of the Environmental Management Department of the Municipality of Santa Cruz, by official letter DGA-0494-2021 of July 9, 2021, addressed to the Environmental Services coordinator, indicated: "Subject: Environmental education, intervention activities in La Cuesta, Santa Bárbara Dear Madam: Through this letter, I greet you and wish you success in your work. Below, Table 1 describes the activities to be executed to remedy the problem of the illegal dump in La Cuesta, Santa Bárbara. Table 1. Schedule of environmental education activities. (…) The environmental education plan will carry out information dissemination campaigns through auditory means (loudspeaker announcements), digital means (social networks and informative video), and printed means (flyers and posters) to the communities directly affected by the dump. On the other hand, it will carry out an identification of potential generators accompanied by advice and follow-up for the correct disposal of their waste, this through training, work groups, and a visit to the Environmental Technology Park. Additionally, the Santa Bárbara Development Association, the Santa Bárbara Professional Technical High School, and community leaders will be involved to implement an interdisciplinary and permanent solution."

Environmental inspector Overath Ortega Urbina, an official of the Environmental Management Department of the Municipality of Santa Cruz, by official letter DGA-0497-2021 of July 12, 2021, addressed to the Environmental Services coordinator, indicated: "I take this opportunity to greet you and at the same time inform you about the work carried out in the cleaning campaign on the old road to Santa Bárbara (La Cuesta): On July 10, 2021, a cleaning campaign was carried out in the place known as La Cuesta, specifically the old road to Santa Bárbara, where we found waste of all kinds such as, for example, construction debris, televisions, ceramics, books, plastics of all kinds, ordinary waste, etc. This campaign was carried out to finish collecting what could not be done in the June 8 campaign, due to not having had the machinery on that date, nor on subsequent days, until this day. It should be noted that the execution of the work was carried out from 6:00 am to 2:00 pm, with the collaboration of the UTGVM, a department which provided us with the Back Hoe license plate # 23805 driven by Mr. Ramiro Sancho and a dump truck license plate # 138740 driven by Mr. Luis Pizarro, with a capacity of 12 m3, this in order to load and transport the waste to the sanitary landfill of this Municipality. It should be mentioned that the machinery provided is the property of the company Movimientos y Acarreos La Península, which is rented by the UTGVM. Once the cleaning was finished, the weight of the waste was requested from the person in charge of the scale, Mr. José Randall Gómez Espinoza, and it was determined that the amount collected was 52,860 kilos, in 7 trips made by the dump truck."

The Environmental Services coordinator of the Environmental Management Department of the Municipality of Santa Cruz, through official letter DGA-0498-2021 of July 12, 2021, addressed to the mayor, stated: "(…) This Department extracts from said Appeal (sic) what the gentleman calls non-compliance, to which reference will be made below and a response will be given regarding the actions taken: • On June 8, a cleaning campaign was carried out at the site called 'La Cuesta a Santa Bárbara,' with the collection of bulky waste and construction debris pending, which due to a lack of machinery such as a Back Hoe and dump truck could not be extracted from the site. The efforts regarding this and those for obtaining said equipment are recorded in the attached official letters addressed to the Mayor's Office, DGA-0434-2021 and DGA-0492-2021, both referred by Engineer Diana Vallejos Noguera, Environmental Services Coordinator of the Municipality of Santa Cruz. • Official Letter DGA-0497 is attached, which attests that the site called 'La Cuesta a Santa Bárbara' was attended with the required machinery, which was provided by the Municipal Vial Management Technical Unit on Saturday, July 10 of the current year. Said Official Letter shows that the site was left completely clean. • As part of the Intervention Plan for the site 'La Cuesta a Santa Bárbara' referred to the municipal mayor's office through Official Letter DGA 0392-2021 on June 9, it is indicated that another cleaning campaign is scheduled for Friday, July 30 of the current year. • As part of the Intervention Plan for the site 'La Cuesta a Santa Bárbara' referred to the municipal mayor's office through Official Letter DGA-0392-2021 on June 9, it is indicated that an Environmental Education Program will be developed aimed at the Community of Santa Bárbara, the Educational Institutions, and the Scrap Dealers who form part of the Waste Generators. Said Plan is attached in Official Letter DGA-0494-2021, which was prepared by Engineer Katia Gómez Mata, environmental educator of the Municipal Environmental Management Department. • As part of the Intervention Plan for the site 'La Cuesta a Santa Bárbara' referred to the municipal mayor's office through Official Letter DGA-0392-2021 on June 9, the measure cited is the Enabling of the road called 'Calle vieja Santa Bárbara,' this topic, which is the approach of the Municipal Vial Management Technical Unit, is recorded in Official Letter DDUR-UTGVM-ADM-2021-039 of July 2 of the current year, indicating the scheduling date for maintenance of the old road La Cuesta-Santa Bárbara starting November 17 of the current year. • As part of the Intervention Plan for the site 'La Cuesta a Santa Bárbara' referred to the municipal mayor's office through Official Letter DGA-0392-2021 on June 9, it is indicated that Monitoring of the Surveillance Camera installed at the site 'La Cuesta a Santa Bárbara' is required; for this, a directive from the municipal mayor's office towards the Municipal Police, Municipal Internal Security, and the Environmental Inspector is needed, to establish coordination and joint actions to be able to execute the described tasks: 'Establish rotating schedules for Monitoring the camera installed at the 'La Cuesta' site by the Municipal Police, the Municipal Department of Internal Security, and the Environmental Inspector. Develop a rotating schedule of monitoring rounds in the sector. Establish an action protocol for collecting offender data and transferring the respective complaints.' Therefore, the vast majority of the measures cited in the Intervention Plan for the site 'La Cuesta a Santa Bárbara' described in Official Letter DGA-0392-2021 are in execution. Remaining for their total fulfillment is the directive of the Municipal Mayor's Office through which the implementation of Surveillance and monitoring of the camera installed at the site will proceed and the respective protocol for collecting offender data and transferring the respective complaints will be developed. All this is a security matter, which by competence does not cover the Environmental Management Department; however, it will join the training process for its implementation, incorporating the Environmental Inspector assigned to the Environmental Management Department."

On July 13, 2021, the president of the Municipal Council of Santa Cruz was notified of the course of this proceeding.

On the other hand, regarding the Santa Cruz Governing Health Area, it was verified that on February 11, 2021, it received a complaint against the Environmental Management Department of the Municipality of Santa Cruz, in which it was stated that at the address "From the CoopeGuanacaste (sic) events hall, 2 kilometers southeast, entrance to the old road to Santa Barbara, La Cuesta sector," there were problems of bad odors, waste management, vectors (flies and others), rodents, safety, and contamination of water sources. Additionally, the following facts were described: "This letter serves to report for the third time the open-air dump in the area wrongly called 'the garbage dump,' in which garbage of all types continues to be dumped and which has been reported since 2018 and where there have previously been two sanitary orders against the same municipal department; therefore, I very respectfully request once again the intervention of your represented office. The road, being for public use and under municipal maintenance, can be visited on any day or at any time. I attach documentary evidence referring to the formal complaint filed on December 14, 2020, and photographs of the area."

Mr. Guillermo Caravaca Martínez, an official of the Health Regulation Team of the Santa Cruz Governing Health Area, by technical report MS-RCH-ARS-SC-ERS-IT-0194-2021 of April 6, 2021, addressed to the director of that area, stated: "SUBJECT: Physical-sanitary inspection carried out at the site mentioned in complaint N° EAC-DEN-0052-2021, filed on February 11, 2021, due to problems of solid waste disposal on the public road, located 2 km east of the COOPEGUANACASTE multipurpose hall, on the road to Santa Bárbara, Santa Cruz, Guanacaste. (…), I proceed to report the following: BACKGROUND • Official Letter N° DGA-0222-2019, regarding the report of the cleaning campaign carried out on the 'old road to Santa Bárbara-La Cuesta.' • Official Letter N° DAM-1602-20219 (sic) issued by Mayor María Rosa López Gutiérrez on May 28, 2019, where she forwards to this Governing Health Area official letter DGA-0350-2019, which is the proposed action plan corresponding to the sanitary order for the case of the old road to Santa Barbara. • Technical report N° MS-RCH-ARS-SC-ERS-IT-00694-2019 issued on July 3, 2019, by official Saúl Luna Mora, where the 'Preventive Measures Action Plan' is accepted and that follow-up will be given to said plan. • Technical report N° MS-RCH-ARS-SC-ERS-IT-00856-2019 issued on August 19, 2019, by official Saúl Luna Mora, reporting compliance with what was proposed in the 'Preventive Measures Action Plan.' • Amparo appeal under case file N° 20-007332-0007-CO filed on April 27, 2020, and brought by Mr. Manuel Pérez Agüero against a clandestine dump located in the Campero sector on the old road to Santa Bárbara. • Resolution of amparo appeal N° 2020012825, where on July 10, 2020, the amparo appeal brought by Mr. Manuel Pérez Agüero was declared without merit. • Complaint N° EAC-DEN-0052-2021, where a complaint is filed for problems of poor solid waste disposal on the public road, located 2 km southeast of the COOPEGUANACASTE events hall, old road to Santa Bárbara. REGARDING THE FACTS OF WHAT HAS BEEN DONE, THE FOLLOWING IS REPORTED: FIRST: An inspection is carried out in response to the complaint on March 17, 2021, at the place indicated in the complaint, where the poor disposal of ordinary solid waste (reported facts) is corroborated. SECOND: At the time of the visit, photographs are taken of the reported facts and also of the apparent surveillance camera placed by the Municipality of Santa Cruz; said photos are in the annexes. THIRD: The implementation of the recommendation made in official letter N° DGA-0222-2019 by the environmental services coordinator, regarding the placement of a surveillance camera, is observed. FOURTH: There is no certainty or clarity about the institution responsible for managing the surveillance camera; therefore, it would be advisable to request a report from the responsible institution on what has been observed and the actions taken according to what has been observed through said camera. FIFTH: It is considered prudent and necessary to provide photographs regarding the construction of the new wastewater treatment system (before, during, and after). The existing system is located on the western side of the establishment's property, and the new system is located on the eastern side of the establishment's property. CONCLUSION Based on what has been seen so far through the on-site inspection and with the evidence found, it is recommended to request a report from the Municipality of Santa Cruz, where it provides a (sic) description of the actions taken after the surveillance camera was placed (is said camera operating, who is the person responsible for observing said camera, what actions have been taken, and if a person or vehicle is caught depositing waste on that road or public way, what sanction or measure is applied?). It is also requested to proceed with cleaning work and/or maintenance of the route or road mentioned above."

The director of the Santa Cruz Governing Health Area, by official letter MS-DRRSCH-391-2021 of April 8, 2021, addressed to the mayor of Santa Cruz, indicated: "Receive a cordial greeting. Through this letter, I send you the Technical Report cited in the subject line, regarding the attention to a complaint for inadequate disposal of solid waste on the so-called 'old road to Santa Bárbara' located 2 km east of the Coopeguanacaste convention center. Therefore, I ask you to interpose your good offices, so that we may be provided with a report on the actions taken regarding the case in question by your represented office and to indicate whether the offenders have been identified through the surveillance camera installed at the site."

On May 27, 2021, the Santa Cruz Governing Health Area received a petition from the appellant, in which he mentioned (sic): "This letter serves to greet you and in turn request your URGENT intervention in relation to technical report MS-RCH-ARS-SC-ERS-IT-0194-2021 on the LONG-STANDING complaint regarding the disposal of solid waste on the so-called 'old road to Santa Barbará' (sic) located 2 km east of the Coopeguanacaste convention center. Given the current conditions at the site, the large amount of GARBAGE spilled on the public road, the background related to the place, and the impact on public health due to the quantity dumped there, I very respectfully request that the SANITARY ORDER be issued against the Environmental Management Department and the Municipal Mayor's Office, ordering them to clean and immediately enable the public road, which is the only access to my property, while they attend to the other aspects requested by your represented office in official letter MS-DARSSC-391-2021."

Mr. Guillermo Caravaca Martínez, an official of the Health Regulation Team of the Santa Cruz Governing Health Area, by technical report MS-RCH-ARS-SC-ERS-IT-0289-2021 of June 8, 2021, addressed to the director of that area, stated: "SUBJECT: Physical-sanitary inspection carried out at the site mentioned in complaint N° EAC-DEN-0052-2021 and in follow-up to technical report N° MS-RCH-ARS-SC-ERS-IT-0194-2021. Said case is located 2 km east of the COOPEGUANACASTE multipurpose hall, old road to Santa Bárbara, Santa Cruz, Guanacaste. (…), I proceed to report the following: BACKGROUND • Official Letter N° DGA-0222-2019, regarding the report of the cleaning campaign carried out on the 'old road to Santa Bárbara-La Cuesta.' • Official Letter N° DAM-1602-20219 (sic) issued by Mayor María Rosa López Gutiérrez on May 28, 2019, where she forwards to this Governing Health Area official letter DGA-0350-2019, which is the proposed action plan corresponding to the sanitary order for the case of the old road to Santa Barbara. • Technical report N° MSRCH-ARS-SC-ERS-IT-00694-2019 issued on July 3, 2019, by official Saúl Luna Mora, where the 'Preventive Measures Action Plan' is accepted and that follow-up will be given to said plan. • Technical report N° MS-RCH-ARS-SC-ERS-IT-00856-2019 issued on August 19, 2019, by official Saúl Luna Mora, reporting compliance with what was proposed in the 'Preventive Measures Action Plan.' • Amparo appeal under case file N° 20-007332-0007-CO filed on April 27, 2020, and brought by Mr. Manuel Pérez Agüero against a clandestine dump located in the Campero sector on the old road to Santa Bárbara. • Resolution of amparo appeal N° 2020012825, where on July 10, 2020, the appeal was declared without merit. • Complaint N° EAC-DEN-0052-2021, where a complaint is filed for problems of poor solid waste disposal on the public road, located 2 km southeast of the COOPEGUANACASTE events hall, old road to Santa Bárbara. • Technical report N° MS-RCH-ARS-SC-ERS-IT-0194-2021, where it is concluded to request a report from the municipality on the case at hand. REGARDING THE FACTS OF WHAT HAS BEEN DONE, THE FOLLOWING IS REPORTED: FIRST: At the time of drafting this report, NO response has been obtained from the Municipality of Santa Cruz. SECOND: The site is in the same condition as at the time of the inspection visit carried out on March 17, 2021. THIRD: The implementation of the recommendation made in official letter N° DGA-0222-2019 by the environmental services coordinator, regarding the placement of surveillance cameras, is observed. FOURTH: As there is no report regarding the case at hand, there is NO certainty or clarity about the functionality of the surveillance camera and the effectiveness of possible sanctions. FIFTH: It is considered prudent and necessary to urgently clean the affected site. Furthermore, taking into account that it is a persistent problem, a long-term maintenance and cleaning plan must be generated and not merely a palliative measure, because the same problem of solid waste dumping always occurs in said locality. CONCLUSION Based on what has been seen so far through on-site inspection and with the evidence found, it is recommended to ISSUE A SANITARY ORDER requesting a report from the Municipality of Santa Cruz on the actions as requested in Report N° MS-RCH-ARSSC-ERS-IT-0194-2021, also requesting to carry out cleaning work and/or maintenance of the route or road mentioned above as soon as possible."

The Santa Cruz Governing Health Area, in sanitary order MS-RCH-ARS-SCERS-OS-0144-2021 of June 8, 2021, addressed to the vice-mayor of Santa Cruz and with an expiration date of June 25, 2021, ordered: "Based on the review of the case file regarding the open-air dump located on the old road to Santa Bárbara, in response to a complaint and case follow-up, non-compliance with what was requested via official letter was corroborated, where NON-conformities in the disposal and collection of waste, in addition to the cleaning of the public road, are evidenced, as indicated in technical report N MS-RCH-ARS-SC-ERS-IT-0289-2021, as recorded in the administrative file kept by this Governing Area, where the following is concluded: • FIRST: At the time of drafting this report, NO response has been obtained from the Municipality of Santa Cruz. • SECOND: The site is in the same condition as at the time of the inspection visit carried out on March 17, 2021. • THIRD: The implementation of the recommendation made in official letter N° DGA-0222-2019 by the environmental services coordinator, regarding the placement of surveillance cameras, is observed. • FOURTH: As there is no report regarding the case at hand, there is NO certainty or clarity about the functionality of the surveillance camera and the effectiveness of possible sanctions. • FIFTH: It is considered prudent and necessary to urgently clean the affected site. Furthermore, taking into account that it is a persistent problem, a long-term maintenance and cleaning plan must be generated and not merely a palliative measure, because the same problem of solid waste dumping always occurs in said locality. It was verified that there are some NON-conformities, according to the Ley General de Salud N' 5395, the Ley de Gestión Integral de Residuos, Ley N° 8839 and its regulation, and other current and applicable regulations; these contravene said regulations, therefore representing a risk to public health. Therefore, within the period indicated above and from this notification, you are ordered to: 1. Clean said route within a period NOT exceeding three (3) business days. 2. Replicate the plan of corrective actions proposed through official letters (sic) N° DAM-1602-2019 and DGA-0350-2019 and simultaneously expand the scheduling of said actions. 3. Send a copy of the aforementioned action plan to this governing health area. 4. Provide a response to technical report N MS-RCH-ARS-SC-ERSIT-0194-2021, which was sent through official letter MS-DRRSCH-DARSSC-391-2021 on April 8, 2021 (…)."

On June 30, 2021, the Santa Cruz Governing Health Area received official letter DAM-1852-2021 of June 23, 2021, from the acting mayor of Santa Cruz, in which it was indicated: "Receive a cordial greeting, wishing you success in your duties. Through this letter, in compliance with what was requested through sanitary order MS-RCN-ARS-SC-ERS-OS-0144-2021, official letters DGA-0434-2021, DGA-0039-2021-2021, and DGA-0392-2021 are forwarded, sending a schedule and activities carried out by this Municipality of Santa Cruz. Regarding this matter, through the Environmental Management Department, work began on cleaning this sector, and they used 3 laborers, 38 bags were consumed, 3 trips were made in the pick-up SM-4403, and 1340 kilos of waste were disposed of. On this same matter, the Municipality proceeded with the repair of the Camera placed at the site (sic). However, a certain type of material implies the use of larger-dimensioned equipment, which is requested from the Municipal Vial Technical Unit. Therefore, on Wednesday, June 9, 2021, coordination was made with the Municipal Vial Management Technical Unit for the collaboration of a dump truck, a loader, and the drivers. This department indicated the following from Mr. Didier Monge Jimena: 'Regarding the equipment request, it is indicated that at the moment the loader is not operational and we only have one dump truck which is (sic) assigned in the Portegolpe sector, making it impossible for us to supply the requested equipment for tomorrow. On the other hand, there is no economic resource available to arrange for rented equipment on demand.' Due to the above, resources are being introduced to said unit in order to finish the cleaning in the area and other pending work. Therefore, a reasonable period of two months is requested, given that said elements must go through the proper budgetary process of a public institution."

On July 8, 2021, the director of the Santa Cruz Governing Health Area was notified of the course of this proceeding. Mr. Guillermo Caravaca Martínez, an official of the Health Regulation Team of the Santa Cruz Governing Health Area, in technical report MS-RCH-ARS-SC-ERS-IT-0334-2021 of July 9, 2021, addressed to the director of that area, stated: "SUBJECT: Follow-up report on sanitary order N° MS-RCH-ARS-SC-ERS-0144-2021, related to complaint N° EAC-DEN-0052-2021 regarding solid waste disposal on the old road to Santa Bárbara, located 2 km east of the COOPEGUANACASTE multipurpose hall. (…), I proceed to report the following: BACKGROUND • Resolution of amparo appeal N° 2020012825 from case file N° 20-007332-0007-CO of the Constitutional Chamber (sic), where the appeal brought by Messrs. Manuel Pérez Agüero and [Name 001] for the problem of open-air solid waste disposal and on the public road is declared without merit. • Complaint N° EAC-DEN-0052-2021 filed on February 11, 2021, for an apparent problem of poor open-air solid waste disposal and on the public road. • Technical report N° MS-RCH-ARS-SCERS-IT-0194-2021, indicating the carrying out of an inspection in response to complaint N° EAC-DEN-0051-2021 and where what was reported is corroborated, for which reason information is requested through an official letter regarding actions taken according to what was reported."

• Note where a new complaint is filed requesting the cleaning and opening of the public road (old road to Santa Bárbara). • Technical report No. MS-RCH-ARS-SC-ERS-IT-0289-2021, which recommends issuing a sanitary order so that this health governing area is informed due to the NO response from the municipality as requested in report No. MSRCH-ARS-SC-ERS-IT-0194-2021. • Sanitary Order No. MS-RCH-ARS-SC-ERSOS-0144-2021 addressed and notified to Mrs. Dixabeth Matarrita Mendoza (deputy mayor), notified on June 11, 2021, with a compliance deadline of 10 business days. • Official communication No. DAM-1852-2021 issued on June 23, 2021, and notified on June 30, 2021, by the acting municipal mayor in compliance with sanitary order No. MS-RCH-ARSSC- ERS-OS-0144-2021. REGARDING THE FACTS OF THE ACTIONS TAKEN, THE FOLLOWING IS REPORTED: 1. On June 30, 2021, at 2:50 p.m., a follow-up inspection of sanitary order No. MS-RCH-ARSSC- ERS-OS-0144-2021 is conducted, where a large cleanup of ordinary solid waste is observed, but the persistence of ordinary solid waste (debris and soil) and organic waste (branches and leaves) is observed, which, according to what was indicated in official communication No. DAM-1852-2021, is due to the need for heavy machinery and the lack of budget and said machinery at the time of performing the cleanup. 2. On July 8, 2021, at 10:40 a.m., a follow-up inspection of sanitary order No. MS-RCHARSSC-ERS-OS-0144-2021 is conducted, where the persistence of ordinary waste (debris and soil) and organic waste (branches and leaves) is always observed. 3. According to the photographs taken in the three (3) scenarios, work carried out by the Municipality of Santa Cruz is observed regarding compliance with what was ordered, and furthermore, the situation of the need to allocate a budget to carry out the works or tasks to remove all of the waste is understood. 4. Regarding what was requested in the conclusion of technical report No. MS-RCHARS-SC-ERSIT-0194-2021, it is understood that there are no fines or administrative acts for the NON-functioning of the surveillance camera placed in said location, so the municipality must take the necessary actions so that said surveillance system is effective and does not represent a poorly invested economic resource, since it has been out of operation. 5. It should be noted that the opening of the road or route as requested by Mr. [Name 001] is not the competence of this Ministry since it is not something that threatens or endangers public health. 6. According to what is attached in official communication No. DAM-1852-2021, where official communication No. DGA-0392-2021 Intervention Plan Site "La cuesta a Santa Bárbara" (remedial plan) is forwarded, it is accepted provided that the procedure is handled with the greatest possible speed. CONCLUSION Based on what has been seen to date through an on-site inspection, file review, and with the evidence found, it is recommended that THE SANITARY ORDER BE DEEMED COMPLIED WITH. Furthermore, it is recommended to accept the remedial plan submitted through official communications DAM-1852-2021 and DGA-0392-2021, and it should be noted that this health governing area will be monitoring the remedial plan, therefore it is requested that the case at hand be addressed or prioritized. It is recommended that this communication be notified to the Municipality of Santa Cruz and to the complainant so that they are aware of the action plan or remedial plan submitted by said local government."

From the foregoing, it follows that, as of June 8, 2021, the site called "La Cuesta a Santa Bárbara" had a problem of improper solid waste disposal, which had been in the same condition at least since the previous month of March. Hence, both the Ministry of Health and the Municipality of Santa Cruz were obligated to address such a situation, each within the scope of their competencies, since the problem had been reported months earlier to both institutions (in December 2020 to the local government and in February 2021 to the health authority).

In relation to the Municipality of Santa Cruz, a period of inaction of more than five months is proven, since it was not until after the claimant reiterated his request on June 1, 2021 (this time before the municipal council) and after the issuance of sanitary order MS-RCH-ARS-SC-ERS-OS-0144-2021 of June 8, 2021, that the local government issued the "Intervention Plan Site 'La Cuesta a Santa Bárbara'". Likewise, although it is recorded that, on June 8, 2021, the Department of Environmental Management collected one thousand three hundred forty kilos of waste and the next day that unit coordinated with the Technical Road Management Unit for collaboration to have a wagon, a loader, and drivers, it is no less true that it was not until July 10, 2021 (after notification of the proceeding to the municipal administration authorities), that they collected fifty-two thousand eight hundred sixty kilos of waste, such as "construction debris, televisions, ceramics, books, plastics of all kinds, ordinary waste."

Regarding the Health Governing Area of Santa Cruz, inadequate follow-up on the problem reported on February 11, 2021, is also observed, given that since March 17, 2021, improper disposal of ordinary waste was corroborated at the reported site (in fact, on May 27, 2021, the claimant requested urgent intervention due to the site's conditions); however, it was not until the following June 8 that sanitary order MS-RCHARS-SC-ERS-OS-0144-2021 was issued, after determining the need for urgent cleaning and verifying that the site had been in the same conditions since March. In that regard, the sanitary order in question, with an expiration date of June 25, 2021, ordered: "Therefore, within the period indicated above and as of this notification, you are ordered: 1. To clean said route within a period NO greater than three (3) business days. 2. Replicate the corrective action plan proposed through official communications (sic) No. DAM-1602-2019 and DGA-0350-2019 and at the same time expand the schedule of said actions. 3. Forward a copy of the aforementioned action plan to this health governing area. 4. Provide a response to technical report No. MS-RCH-ARS-SC-ERS-IT-0194-2021 which was forwarded through official communication MS-DRRSCH-DARSSC-391-2021 on April 8, 2021 (…)". In fact, on June 30, 2021, the Health Governing Area of Santa Cruz received official communication DAM-1852-2021 of June 23, 2021, from the acting mayor of Santa Cruz, which reported the schedule and action plan, as well as the measures taken in response to the sanitary order, including the partial collection of garbage carried out on June 9 and the repair of the surveillance camera; however, at that time it was reported that there were still tasks pending completion.

Now, it was not until after the expiration of the period granted in the sanitary order and after the notification of the course of this amparo to the respondent health authority, that an official from the Health Regulation Team of the Health Governing Area of Santa Cruz, in technical report MS-RCH-ARS-SC-ERS-IT-0334-2021 of July 9, 2021, recommended deeming the order complied with and "accepting the remedial plan submitted through official communications DAM-1852-2021 and DGA-0392-2021". However, it draws the Chamber's attention that this official recommended deeming the sanitary order complied with, despite the fact that, in the document he signed, he expressly recorded that, as of July 8, 2021, ordinary waste still existed at the reported site. Indeed, note that, according to the report from the Municipality of Santa Cruz, it was not until two days after that date that waste from "construction, televisions, ceramics, books, plastics of all kinds" was collected, amounting to fifty-two thousand eight hundred sixty kilos. Likewise, even though said official also ordered the acceptance of the remedial plan, he conditioned it on being addressed with the greatest possible speed, therefore he did not establish concrete deadlines or adequate follow-up.

By virtue of the foregoing, although it is observed that both the municipality and the health governing area took measures and carried out actions after the notification of this appeal, the Chamber does not find that the remedial plan proposed by the local government was analyzed by the health authority for the purpose of determining whether or not it constitutes a viable and definitive solution to the reported problem. Likewise, even though it is noted that an official of the Ministry of Health recommended deeming the sanitary order complied with, this was done even before the municipality supposedly finalized the collection of waste at the site, so a complete and comprehensive analysis of compliance with the sanitary order after the work carried out by the local government is not recorded.

Precisely, upon the detection of a public health problem such as the inadequate disposal of large quantities of waste in public sites, it is crucial not only to take corrective measures but also preventive ones to prevent such situations from recurring.

Consequently, this point is declared with merit, under the terms that will be set forth in the operative part of the judgment.

V.- Finally, even though the claimant requests that the Department Technical Municipal Road Management Unit of the Municipality of Santa Cruz be ordered to undertake "the rehabilitation, opening, and presentation of a periodic maintenance plan for the old road to Santa Bárbara," it is no less true that the request of December 2020 indicated "that the road is in very poor condition, the ballast wearing course is damaged, with ditches that impede the transit of light vehicles, emergencies, public services, or others." However, there is no evidence in the file demonstrating that the condition of the road is impassable to such a degree that it endangers the life or physical integrity of the population. Likewise, no individuals in a state of vulnerability (elderly adults, persons with disabilities, or minors) who are affected by the road conditions were individually identified. In fact, in the filing brief, this point is developed in a very general manner, as the majority of the arguments revolve around the improper disposal of waste. In any case, it is observed that maintenance of the public road is scheduled to begin on November 17, 2021. Consequently, under the terms set forth in the filing brief, any situation meriting the Chamber's intervention regarding this point is dismissed, and, therefore, it is declared without merit.

Therefore:

The appeal is partially granted only regarding the lack of attention to the problem of improper waste disposal at the site called "La Cuesta a Santa Bárbara". Warren Chavarría Venegas, in his capacity as director of the Health Governing Area of Santa Cruz, or whoever holds that position (sic), is ordered to issue the pertinent orders and arrange what is necessary so that: 1) within a period of THREE DAYS counted from the notification of this judgment, the site called "La Cuesta a Santa Bárbara" is inspected and it is determined whether the first point of sanitary order MS-RCH-ARS-SC-ERS-OS-0144-2021 imposed on the Municipality of Santa Cruz, "1. To clean said route within a period NO greater than three (3) business days," was effectively complied with by that local government after the work it carried out on July 10, 2021, and, should this not have occurred, all actions authorized by the legal system to procure its compliance must be carried out; 2) within a period of ONE MONTH counted from the notification of this judgment, the remedial plan proposed by the Municipality of Santa Cruz in response to sanitary order MS-RCH-ARS-SC-ERS-OS-0144-2021 is analyzed and it is determined whether the schedule and the proposed actions constitute an effective solution to the detected public health problem. Likewise, they must not only monitor the remedial plan, but also, should the need to implement additional actions or modify said plan be established, they must, within the same period, issue the corresponding sanitary orders so that the problem is effectively addressed and its definitive solution is guaranteed. Jorge Arturo Alfaro Orias and María Daisy Víquez Zamora, in their respective roles as mayor and acting head of the Department of Environmental Management, both of the Municipality of Santa Cruz, or whoever holds their positions, are ordered to: 1) comply with the provisions and orders of the Ministry of Health, within the periods established by this authority, regarding the attention to the problem of improper waste disposal at the site called "La Cuesta a Santa Bárbara"; 2) within a period of ONE MONTH counted from the notification of this judgment, arrange what is necessary and carry out all actions within the scope of their competencies to ensure the effective solution of the problem of improper waste disposal at the site called "La Cuesta a Santa Bárbara" so that it does not recur. Marisela Moreno Rodríguez, president of the Municipal Council of Santa Cruz, or whoever holds that position, is ordered to IMMEDIATELY bring this judgment to the attention of the body she represents, so that, within the scope of its competence, the necessary agreements are adopted and the pertinent actions are coordinated to ensure compliance with the Chamber's ruling regarding the municipal entity. The respondent authorities are warned that, in accordance with Article 71 of the Ley de la Jurisdicción Constitucional, imprisonment of three months to two years or a fine of twenty to sixty days shall be imposed on anyone who receives an order that must be complied with or enforced, issued within an amparo appeal, and fails to comply with it or enforce it, provided that the offense is not more severely penalized. The State and the Municipality of Santa Cruz are ordered to pay the costs, damages, and losses caused by the facts that serve as the basis for this declaration, which shall be liquidated in the execution of the judgment of the contentious-administrative court. Regarding the facts prior to April 22, 2020, abide by what was decided in judgment No. 2020012825 of 9:15 a.m. on July 10, 2020. In all other respects, the appeal is declared without merit. Judge Salazar Alvarado notes. Notify."

Said resolution was notified to the respondent parties by email on August 17, 2021.

II.- ON THE FILED PROCEEDING. In this case, the appellant files a disobedience proceeding in relation to judgment No. 2021017825 of 9:20 a.m. on August 13, 2021. He states that: "IT HAS NOT BEEN FULLY ADDRESSED. What was offered by the municipal entity was only partially addressed in 2021 and part of 2022; however, at the end of 2022 and throughout 2023, they did not continue addressing the problem, meaning the cleaning and security schedule in the area DID NOT DEFINITIVELY SOLVE (sic) the situation; furthermore, the Public Health Governing Area of Santa Cruz did not follow up on the proposed Remedial Plan, nor did it effectively address the matter with the sanitary orders (sic) that sought the attention of waste deposits on said road, ignoring its duty to supervise the measures proposed by the municipal entity. (...) Assessing the omissions of the Head of the Department of Environmental Management, the Presidency of the Municipal Council, the Mayor of the canton, and also (sic) the neglect by the Directorate of the Health Governing Area of the Ministry of Health, we request that they be warned for a SINGLE (sic) TIME for the immediate compliance with said JUDGMENT."

In this respect, on the occasion of the filed disobedience proceeding, the director of the Health Governing Area of Santa Cruz reported: "THIRTEENTH (sic)- It is recorded in folios 00267, 00268, and 00269 of the administrative file Technical Report MS-RCH-ARS-SC-ERS-IT-00393-2021; where its conclusion states '(...) In accordance with the follow-up carried out in 'La cuesta de Santa Barbara', in attention to resolution No. 2021017825, Compliance with points one and two (sic) of sanitary order No. MS-RCH-ARS-S-ERS-OS-0144-2021 is Verified, since the cleaning dates scheduled for Tuesday, June 8, Friday, July 30 were duly executed and the site is clean and free of ordinary waste. FOURTEENTH (sic)- It is recorded from folio 00290 to folio 00293 of the administrative file, On-Site Inspection Report No. MS-RCH-ARS-SC-ERS.AIO-11-2024., where the following is stated: '(...) On the day and time indicated above, an on-site inspection is carried out to verify compliance with sanitary order No. MS-RCH-ARS-S-ERS-OS-0144-2021, specifically compliance with point No. 1 – To clean said route within a period NO greater than three (3) business days. At the time of the visit, compliance with what was requested is verified; photographs are provided demonstrating that the site is clean of waste. (...) follow-up has been given to sanitary order No. MS-RCH-ARS-SC-ERS-OS-0144-2021, and even in the last (sic) inspection carried out in the current year 2024, compliance with what was requested was verified'."

For their part, the municipal authorities indicated: "In Official Communication DAM-DGA-PA-0003-2024 of January 23, 2024, Mr. Manuel Angulo Mora of the Department of Environmental Protection, informed the Environmental Services Coordinator Geissel Linet Gutiérrez Marchena, of the following: 'On January 23, 2024, a cleanup campaign was carried out in the place known as (sic) la Cuesta, specifically the old road to Santa Barbara, where we found waste of all kinds, such as, for example, ordinary waste, zinc sheets, plastics of all kinds, remnants of beds, sinks, etc.' The indicated official communication continued mentioning that: 'It is worth mentioning that the execution of the work was carried out, during a schedule from 9:00 a.m. to 12:00 noon, and performed by two officials from the Environmental Urban Services Service and myself. I must indicate that the waste was transferred to vehicle license plate SM 5868, and a quantity of 1430 kilos was disposed of, which were deposited in the PTA Sanitary Landfill'."

From this perspective, no non-compliance is observed that currently warrants the Chamber's intervention. Note that, according to what was reported by the respondent authorities, the Ministry of Health's inspection report of January 24, 2024, and the photographs provided, the site is clean and free of waste. Indeed, the file records not only compliance with the issued sanitary orders but also the scheduling of quarterly cleanup campaigns by the local government.

Consequently, the filed proceeding is dismissed.

III.- Finally, the appellant states: "Through this means we inform that the old road to Santa Bárbara, located just one kilometer from the central offices of the Municipality of Santa Cruz, continues to receive large quantities of garbage of various types; a spring (naciente) of water that passes through said road is now being affected by the deposit of containers storing cooking grease or other substances; likewise, its access has deteriorated, the surveillance plans (monitoring camera and police surveillance) have not worked since the end of 2022, once again turning the site into an unsanitary and dangerous area where there is a great danger to the public health of the residents of Campero."

Regarding the foregoing, the petitioner narrates new and subsequent facts to the issuance of the main judgment in this proceeding (No. 2021017825 of 9:20 a.m. on August 13, 2021). Precisely, he complains about the affectation of a water spring (naciente) by the deposit of containers storing cooking grease or other substances, the deterioration of the access, and the lack of functioning of the surveillance plans (monitoring camera and police surveillance) since the end of 2022. Within this context, the appropriate course of action is to separate the brief incorporated into the electronic file on January 17, 2024, so that it is processed as a new matter regarding these last points.

IV.- DOCUMENTATION PROVIDED TO THE FILE. The parties are advised that if any paper documents have been provided, as well as objects or evidence contained in any electronic, computer, magnetic, optical, telematic device or one produced by new technologies, these must be removed from the office within a maximum period of 30 business days counted from the notification of this judgment. Otherwise, any material not removed within this period will be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena in article XXVI of session No. 27-11 of August 22, 2011, published in the Boletín Judicial No. 19 of January 26, 2012, as well as the agreement of the Consejo Superior del Poder Judicial, approved in article LXXXI of session No. 43-12 held on May 3, 2012.

Therefore:

The filed proceeding is dismissed. Separate the brief incorporated into the electronic file on January 17, 2024, for the purposes that, under the terms of Considerando III in fine of this pronouncement, it be processed as a new matter.
