Del informe rendido bajo juramento por las autoridades recurridas, con las consecuencias incluso penales que prevé el numeral 44 de la Ley de la Jurisdicción Constitucional se acredita una infracción a los derechos fundamentales de la parte recurrente, con fundamento en las consideraciones que a continuación se exponen. [...] Nótese que dicha actuación se llevó a cabo con posterioridad a que a la autoridad recurrida se le notificó la resolución curso emitida dentro del presente recurso, lo cual se llevó a cabo a las 10:34 horas del 06 de mayo de 2025, motivo por el cual, en cuanto a dicho extremo el recurso debe ser estimado.
V.- [...] la respuesta brindada por la autoridad recurrida en cuanto a esta segunda gestión no respondió de manera clara y precisa lo consultado por la parte recurrente, en relación al servicio de agua y la zona protegida, motivo por el cual en cuando a dicho extremo el recurso debe ser estimado, con las consecuencias que se indican en la parte dispositiva.
POR TANTO: Se declara parcialmente con lugar el recurso. Se ordena a Eddie Sánchez Ramírez, en su condición de Alcalde de la Municipalidad de San Isidro de Heredia, o a quien en su lugar ocupe eso cargos, que gire las órdenes pertinentes y lleve a cabo todas las actuaciones que estén dentro del ámbito de sus competencias para que, en el plazo de DIEZ DÍAS contados a partir de la notificación de esta sentencia, se conteste de forma completa y brinde la información a la solicitud presentada por la parte en el oficio No. CPDSPSIH-GM-05-2025 del 28 de marzo de 2025 y se le notifique a la dirección señalada para recibir notificaciones.
English (translation)IV.- ON THE MERITS. From the sworn report of the respondent authorities, which carries the consequences—including criminal—provided for in article 44 of the Constitutional Jurisdiction Law, a violation of the fundamental rights of the petitioners is established, based on the following considerations. Nº 2025015379 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del veintitres de mayo de dos mil veinticinco . Recurso de amparo interpuesto por Nombre01, cédula de identidad CED01, Nombre02, cédula de identidad CED02, a favor de COMITÉ PRO DEFENSA DE LOS SERVICIOS PÚBLICOS DE SAN ISIDRO DE HEREDIA, contra la MUNICIPALIDAD DE SAN ISIDRO DE HEREDIA. RESULTANDO: 1.- Por escrito aportado en la Secretaría de la Sala el 30 de abril de 2025, la parte recurrente interpone recurso de amparo y manifiestan que en calidad de miembros del Comité Pro-Defensa de los servicios públicos de San Isidro de Heredia, el 26 de setiembre de 2024, remitieron un correo electrónico a la cuenta ...01, a través del cual solicitaron al Alcalde de San Isidro de Heredia, lo siguiente: "1. El 26 de agosto del año en curso, envíe un correo a su persona haciendo unas preguntas relacionadas con el tema de los oficiales de la Policía Municipal: 1. ¿Cuántos oficiales de la policía municipal hay en la planilla de municipalidad? 2. ¿Cuáles medidas se toman en el caso del horario en que ellos están en su merecido tiempo de descanso? 3. ¿Cuántos oficiales de la policía municipal están autorizados para realizar mullas, quilar placas u otras funciones del puesto mismo? 4. El domingo hace ocho días en las fiestas patronales de Santa Elena, en el momento del desfile y la Eucaristía, estaba el señor Geovanny en este sector, pitando. quitando a la gente hasta do mala manera que estaban estacionados en la orilla de la calle, ¿esto es una función correcta? Se comprende que tiene que cumplir su labor de ser el caso, pero no de la manera en que lo estaba haciendo, pero, además, es conocimiento de todos que esta calle es realmente angosta y no hay donde estacionar, como en este caso, por ser una actividad a la que llegan muchas personas. ¿No es posible ser un poco tolerante en estos casos que es una actividad de la comunidad?. Además, quisiera saber ante la duda de varios vecinos que me han preguntado cuáles son las funciones de la señora vicealcalde?. ¿Cuál es el correo electrónico para poder comunicase con ella en caso que usted este muy ocupado? ¿La mayor duda es por qué la señora vicealcaldesa no le represento como le corresponde en la actividad en la Asamblea Legislativa el 19 de agosto siendo este un tema de real importancia para nuestro cantón ya que usted no participo? Esta consulta la hacemos con base al pronunciamiento de la PGR y el Código Municipal. Se le incluye en este oficio lo indicado sobre la figura de este puesto. En relación con el tema de los contenedores de San Francisco, los cuales fueron clausurados por la municipalidad, ¿en qué punto está el proceso? ¿Cuáles medidas se han tornado para que ya no se tenga este lugar con contenedores o por lo menos lo ban considerado? ¿Ya que aún vive gente en este lugar y el estatus de ellos dial es? ¿Cuidadores del lugar o personas arrendantes?" (véase al respecto oficio No. CPDSPSIH-GR-02-2024). Añade que el 28 de marzo de 2025 remitieron el oficio No. CPDSPSIH-GM-05-2025 y solicitaron a los involucrados el expediente relacionado a la construcción del Colegio Mundo Unido en Santa Cecilia de San Isidro de Heredia. Reclaman que, al momento de la interposición de este recurso, no han recibido respuesta a ambas gestiones. Solicitan la intervención de la Sala 2.- Por resolución de las doce horas cuarenta minutos del dos de mayo de dos mil veinticinco, se le da curso al proceso y se requieren los informes a las autoridades recurridas. 3.- Informa bajo juramento Eddie Sánchez Ramírez, en su condición de Alcalde de la Municipalidad de San Isidro de Heredia que el 28 de agosto de 2024, a través del correo electrónico ...02, se remitió un mensaje dirigido a la cuenta En dicho correo se adjuntó el oficio CPDSPSIH-GR02-2024, ...01 mediante el cual se solicita respuesta a una serie de preguntas relacionadas con diversos temas, entre ellos asuntos concernientes a la vicealcaldesa, las obras vinculadas a Agropecuarias El Encanto Azul S.A. (contenedores de San Francisco), así como temas relativos a los policías municipales. En respuesta a las preguntas del oficio CPDSPSIH-GR02-2024, se realiza el oficio No. MSIH-AM-66-2025, con fecha 08 de mayo de 2025 y firmado y remitido al correo ...02, el día 9 de mayo de 2025. Que con respecto al proyecto constructivo United World College (UWC), el 24 de marzo del presente año, el Comité Pro Defensa de los Servicios Públicos de San Isidro de Heredia, mediante el correo electrónico ...02, envió una solicitud de información relacionada con dicho proyecto. En respuesta a ese mensaje, el 26 de marzo de 2025, el señor Bernal Monge Suñol, coordinador del Departamento de Desarrollo y Control Urbano, informó que las edificaciones del proyecto aún no cuentan con licencias constructivas aprobadas, ya que estas se encuentran en proceso de revisión por parte de la Dirección a su cargo. Explicó que dicho proceso requiere una valoración previa por parte de la Comisión de Obras y del Concejo Municipal. Además, detalló que el proyecto actualmente cuenta con permisos para la ejecución de obras de movimiento de tierras, infraestructura y desfogue pluvial. La primera licencia fue emitida en 2023 (PC-81-2023), y en el año 2024 se otorgaron licencias para la planta de tratamiento y otras obras, según consta en el oficio MSIH-AM-DCU-001-2024. Asimismo, aclaró que el proyecto no dispone de una aprobación de disponibilidad de agua por parte de la ESPH, aunque sí cuenta con una concesión de aprovechamiento otorgada. Indicó, además, que el UWC ha iniciado el trámite de licencias constructivas para la primera fase de edificaciones y obras viales, proceso que continuará siendo supervisado por la Dirección de Control Urbano. Como respaldo, se adjuntaron ocho documentos, entre ellos informes técnicos, resoluciones de SETENA y MINAE, planos, informes de inspección, denuncias y acuerdos del Concejo Municipal. Ese mismo 26 de marzo de 2025, el Comité Pro Defensa de los Servicios Públicos de San Isidro de Heredia continuó realizando consultas al respecto, las cuales fueron respondidas por el señor Monge Suñol en el transcurso del mismo día. El 28 de marzo de 2025, mediante la cuenta de correo ...02, se envió un mensaje dirigido al señor Bernal Monge Suñol y a la señora Kendy Villalobos Rodríguez, coordinadora de la Unidad Técnica de Gestión Ambiental. En dicho mensaje se adjuntó el oficio CPDSPSIH-GM-05-2025, con fecha del mismo día, mediante el cual se solicitó copia del expediente administrativo del proyecto Colegio Mundo Unido, así como respuesta a varias consultas relacionadas con el mismo, consultas que a criterio de esta Municipalidad, ya habían sido contestadas anteriormente, En atención al correo enviado el 28 de marzo de 2025, el señor Bernal Monge Suñol respondió el 8 de mayo de 2025, reiterando que las consultas e inquietudes fueron atendidas en su comunicación del 26 de marzo de 2025. Además, indicó que en la documentación ya remitida se incluye información relevante que responde a dichas consultas. En cuanto al expediente administrativo solicitado, se informó que las personas interesadas pueden presentarse en la Municipalidad para obtener copia de los documentos relacionados con las licencias constructivas tramitadas y aprobadas hasta la fecha. Véase en este sentido, que como se detalló en el apartado de antecedentes, el día 24 de marzo de 2025, la señora Nombre01, a nombre del COMITÉ dicho, realizó una serie de consultas, que obtuvieron respuesta oportuna por parte del Ing. Bernal Monge Suñol, Director de Desarrollo y Control Urbano, el 26 de marzo mediante correo electrónico. A pesar de ello, el mismo 26 de marzo de 2025, vuelve la señora Nombre01 a presentar en condición de réplica, nuevas consultas, las cuales nuevamente fueron atendidas por el Ing. Monge Suñol en el transcurso de ese mismo día. A pesar de ello, el día 28 de marzo de 2025, dos días después de las respuestas dadas por el Ing. Monge Suñol, la señora Nombre01 y el señor Nombre02, vuelven a gestionar, pero mediante oficio, para consultar sobre los mismos temas ya abordados, incluyendo frases como “cuál es la realidad del caso”. A criterio de esta Administración, además de la falta de respeto que puede implicar este tipo de frases sugiriendo que las respuestas anteriores contienen información no veraz, se demuestra con ello que este oficio corresponde a una réplica de asuntos ya contestados y ya abordados, que a criterio de esta Administración no se encuentran amparados en el derecho de petición. En todo caso, consideramos que esta forma de actuar por parte de la señora Nombre01 y el señor Nombre02, podría implicar un abuso al derecho de petición, en tanto se hacen consultas en un correo inicial, de la cual derivan gran cantidad de gestiones adicionales, pretendiendo con ello generar algún tipo de conversación o chat por este medio, y denunciando cualquier falta de contestación de las gestiones posteriores, como si la Administración no hubiera realizado esfuerzos para contestar de forma respetuosa y amplia las gestiones iniciales. Con ello, se busca el error de la Administración y este tipo de reclamos constitucionales, más con una finalidad de buscar errores, que demostrando un verdadero interés sobre los temas atendidos. Solicita que se declare sin lugar el recurso. 4.- En la substanciación del proceso se han observado las prescripciones de ley. Redacta el Magistrado Cruz Castro; y, Considerando: I.- OBJETO DEL RECURSO. (véase al respecto oficio No. CPDSPSIH-GR-02-2024). Acusan además el 28 de marzo de 2025 remitieron el oficio No. CPDSPSIH-GM-05-2025 y solicitaron a los involucrados el expediente relacionado a la construcción del Colegio Mundo Unido en Santa Cecilia de San Isidro de Heredia y solicitaron a los involucrados el expediente relacionado a la construcción del Colegio Mundo Unido en Santa Cecilia de San Isidro de Heredia. II.- HECHOS PROBADOS. De relevancia para dirimir el presente recurso de amparo, se tienen por acreditados los siguientes: a) El 26 de setiembre de 2024, los recurrentes remitieron un correo electrónico a la cuenta ...01 con el oficio CPDSPSIH-GR02-2024 a través del cual solicitaron al Alcalde de San Isidro de Heredia, lo siguiente: "1. (informe de la autoridad recurrida). b) En oficio No. MSIH-AM-66-2025 del 8 de mayo de 2025, el Alcalde de la Municipalidad de San Isidro le indicó a la recurrente Nombre01: “A. Respecto a la Pregunta 1: Se adjunta a este correo el oficio MISH-AM-POLM2-30-2025, en el cual el oficial Reiner Corella Carazo, funcionario de la policía municipal, emite su respuesta a los cuatro incisos contenidos en la pregunta 1. Cabe señalar que el oficial Geovanny Brenes se encuentra actualmente incapacitado, por lo que no ha sido posible obtener su pronunciamiento respecto al punto 1.4., por parte del señor Brenes. En todo caso, se le indica que en caso de que el funcionario Geovanny Brenes haya actuado de forma incorrecta en el ejercicio de sus funciones, lo correcto es que se presenten las denuncias formales por parte de las personas perjudicadas con la presentación de cualquier prueba que pueda ser utilizada en un proceso de investigación. Con ello, se entiende que no es posible tomar ninguna acción contra el funcionario, basado en rumores o en consultas realizadas por personas que no indican si fueron perjudicadas con una actuación en específica. B. Respecto a las demás consultas: 2. ¿Cuáles son las funciones de la vicealcaldesa? Mediante el oficio No. MSIH-AM-118-2024, de fecha 6 de mayo de 2024, el señor alcalde municipal, Eddie Ramírez Sánchez, asignó las funciones administrativas y operativas correspondientes a la Primera Vicealcaldía para el periodo 2024-2028, de conformidad con lo establecido en el artículo 14 bis del Código Municipal. Dichas funciones fueron publicadas en La Gaceta No. 93 del 24 de mayo de 2024. Se adjunta copia de dicha publicación para su conocimiento. 3. ¿Cuál es el correo electrónico de la vicealcaldesa? El correo electrónico oficial de la Vicealcaldesa es: ...03 4. ¿Por qué la vicealcaldesa no se presentó a la actividad en la Asamblea Legislativa el 19 de agosto? Según información proporcionada por la señora vicealcaldesa, no se logró ubicar la convocatoria mencionada por su persona. Bajo tales términos, entiéndase que no se asistió a la actividad en la Asamblea Legislativa realizada el 19 de agosto debido a que no recibió una invitación formal para participar. En ausencia de una convocatoria oficial, no fue posible programar su presencia en dicho evento. ¿Respecto a las consultas sobre los contenedores en San Francisco? El caso relacionado con las obras ejecutadas por la sociedad Inversiones Agropecuarias El Encanto Azul S.A. se encuentra actualmente bajo conocimiento del Tribunal Contencioso Administrativo, el cual deberá resolver una apelación presentada contra una resolución emitida por la Alcaldía Municipal. En cuanto a las demás inquietudes, se informa que el sitio en cuestión permanece clausurado y se encuentra a la espera de lo que resuelva el Tribunal. Por lo tanto, no debería estar siendo objeto de ningún tipo de arrendamiento en este momento, y si se encuentra en ese estado, dicho arrendamiento es ilegal. Lo anterior, fue notificado por correo enviado a las 14:47 horas del 9 de mayo de 2025 a la dirección ...04 (informe de la autoridad recurrida). c) En oficio No. CPDSPSIH-GM-05-2025 del 28 de marzo de 2025, los recurrentes solicitaron a los funcionarios Bernal Monge Suñol y a la señora Kendy Villalobos Rodríguez, coordinadora de la Unidad Técnica de Gestión Ambiental de la municipalidad recurrida: “(…). Copia del expediente completo del Colegio Mundo Unido. Además quisiéramos nos indique cual es la realidad del caso, ya que el agua primero se dijo que la dio la asada en el 2022 y ahora aparentemente la van a tomar del río por una concesión, ¿cómo se va a hacer cuando esté el verano y los ríos se sequen? De donde se va a tomar el agua para 200 estudiantes, más personal administrativo. ¿También no queda la duda de que hay afectación de zona protegida y de la línea de la zona inalienable que usted nos responde que cuando se hizo el traspaso fue corregido, bajo qué criterios se hizo y con la autorización de cual entidad? Existen versiones diferentes del caso, por eso para nosotros es importante tener la información del expediente y estar claros en el proceso que se llevó desde el inicio hasta hoy. Como medio para recibir notificaciones indicaron los correos ...05 o ...06 . Lo anterior fue remitido por correo enviado a las 21:05 horas del 28 de marzo de 2025 a las direcciones ...07 y ...08 (informe de la autoridad recurrida). d) En correo electrónico enviado a las 17:53 horas del 8 de mayo de 2025, el Coordinador de Desarrollo y Control Urbano a. i. de la Municipalidad San Isidro de Heredia le indicó a la recurrente: “Las respuestas a sus consultas e inquietudes fueron respondidas en correo del 26 de marzo del 2025, además en la documentación enviada se encuentra información que atiende sus consultas. Referente al expediente puede presentarse a la Municipalidad y obtener copia de los expedientes para las licencias constructivas tramitadas y aprobadas a la fecha”. En el correo electrónico enviado a las 13:05 horas del 26 de marzo de 2025, el funcionario Bernal Monge Suñol le indicó a la recurrente: “Estimada Nombre03. En adjunto los documentos que dan respuesta a sus consultas. Le aclaro que las edificaciones del proyecto no cuentan aún con licencias constructivas, dichas licencias y su aprobación son labor a cargo de la Dirección de Control Urbano. Esta dirección bajo la coordinación de mi persona como ingeniero municipal está a cargo de la revisión de dichas licencias. Previo a esta aprobación, hay un proceso que involucra a la Comisión de obras y posteriormente al Concejo Municipal” (informe de la autoridad recurrida). e) Que la resolución de curso emitida dentro del presente recurso fue notificada a la autoridad recurrida a las 10:34 horas del 06 de mayo de 2025 (expediente digital). III.- SOBRE EL ENVÍO DE LA GESTIÓN BAJO ESTUDIO A CUENTAS DE CORREO ELECTRÓNICO. En este asunto se ha acreditado que varias las gestiones formuladas por la parte fueron remitidas a la parte recurrida a direcciones de correo electrónico, a saber: ...01, ...07 y ...08 . Este Tribunal, en la resolución de curso de este amparo, solicitó a los recurridos indicar si tales direcciones se encuentran o no establecidas como como medios oficiales para la recepción de gestiones remitidas por los usuarios a la institución. Sin embargo, los recurridos no se pronunciaron al respecto, por lo que, en consecuencia, en atención a lo dispuesto en el ordinal 45 de la Ley de la Jurisdicción Constitucional, estas se tienen en esa calidad. Además, debe observarse que tales gestiones fueron contestadas por la parte recurrida, por lo que se entiende que esta última ha reconocido su presentación. Así las cosas, teniendo por verificado lo anterior, resulta procedente el conocimiento por el fondo de este proceso de amparo. IV.- SOBRE EL FONDO. Del informe rendido bajo juramento por las autoridades recurridas, con las consecuencias incluso penales que prevé el numeral 44 de la Ley de la Jurisdicción Constitucional se acredita una infracción a los derechos fundamentales de la parte recurrente, con fundamento en las consideraciones que a continuación se exponen. Al respecto, se acredita que el 26 de setiembre de 2024, los recurrentes remitieron un correo electrónico a la cuenta ...01 con el oficio CPDSPSIH-GR02-2024 a través del cual solicitaron al Alcalde de San Isidro de Heredia, lo siguiente: "1. El 26 de agosto del año en curso, envíe un correo a su persona haciendo unas preguntas relacionadas con el tema de los oficiales de la Policía Municipal: 1. ¿Cuántos oficiales de la policía municipal hay en la planilla de municipalidad? 2. ¿Cuáles medidas se toman en el caso del horario en que ellos están en su merecido tiempo de descanso? 3. ¿Cuántos oficiales de la policía municipal están autorizados para realizar mullas, quilar placas u otras funciones del puesto mismo? 4. El domingo hace ocho días en las fiestas patronales de Santa Elena, en el momento del desfile y la Eucaristía, estaba el señor Geovanny en este sector, pitando. quitando a la gente hasta do mala manera que estaban estacionados en la orilla de la calle, ¿esto es una función correcta? Se comprende que tiene que cumplir su labor de ser el caso, pero no de la manera en que lo estaba haciendo, pero, además, es conocimiento de todos que esta calle es realmente angosta y no hay donde estacionar, como en este caso, por ser una actividad a la que llegan muchas personas. ¿No es posible ser un poco tolerante en estos casos que es una actividad de la comunidad?. Además, quisiera saber ante la duda de varios vecinos que me han preguntado cuáles son las funciones de la señora vicealcalde?. ¿Cuál es el correo electrónico para poder comunicase con ella en caso que usted este muy ocupado? ¿La mayor duda es por qué la señora vicealcaldesa no le represento como le corresponde en la actividad en la Asamblea Legislativa el 19 de agosto siendo este un tema de real importancia para nuestro cantón ya que usted no participo? Esta consulta la hacemos con base al pronunciamiento de la PGR y el Código Municipal. Se le incluye en este oficio lo indicado sobre la figura de este puesto. En relación con el tema de los contenedores de San Francisco, los cuales fueron clausurados por la municipalidad, ¿en qué punto está el proceso? ¿Cuáles medidas se han tornado para que ya no se tenga este lugar con contenedores o por lo menos lo ban considerado? ¿Ya que aún vive gente en este lugar y el estatus de ellos dial es? ¿Cuidadores del lugar o personas arrendantes?". Posteriormente, en oficio No. MSIH-AM-66-2025 del 8 de mayo de 2025, el Alcalde de la Municipalidad de San Isidro le indicó a la recurrente Nombre01: “A. Respecto a la Pregunta 1: Se adjunta a este correo el oficio MISH-AM-POLM2-30-2025, en el cual el oficial Reiner Corella Carazo, funcionario de la policía municipal, emite su respuesta a los cuatro incisos contenidos en la pregunta 1. Cabe señalar que el oficial Geovanny Brenes se encuentra actualmente incapacitado, por lo que no ha sido posible obtener su pronunciamiento respecto al punto 1.4., por parte del señor Brenes. En todo caso, se le indica que en caso de que el funcionario Geovanny Brenes haya actuado de forma incorrecta en el ejercicio de sus funciones, lo correcto es que se presenten las denuncias formales por parte de las personas perjudicadas con la presentación de cualquier prueba que pueda ser utilizada en un proceso de investigación. Con ello, se entiende que no es posible tomar ninguna acción contra el funcionario, basado en rumores o en consultas realizadas por personas que no indican si fueron perjudicadas con una actuación en específica. B. Respecto a las demás consultas: 2. ¿Cuáles son las funciones de la vicealcaldesa? Mediante el oficio No. MSIH-AM-118-2024, de fecha 6 de mayo de 2024, el señor alcalde municipal, Eddie Ramírez Sánchez, asignó las funciones administrativas y operativas correspondientes a la Primera Vicealcaldía para el periodo 2024-2028, de conformidad con lo establecido en el artículo 14 bis del Código Municipal. Dichas funciones fueron publicadas en La Gaceta No. 93 del 24 de mayo de 2024. Se adjunta copia de dicha publicación para su conocimiento. 3. ¿Cuál es el correo electrónico de la vicealcaldesa? El correo electrónico oficial de la Vicealcaldesa es: ...03 4. ¿Por qué la vicealcaldesa no se presentó a la actividad en la Asamblea Legislativa el 19 de agosto? Según información proporcionada por la señora vicealcaldesa, no se logró ubicar la convocatoria mencionada por su persona. Bajo tales términos, entiéndase que no se asistió a la actividad en la Asamblea Legislativa realizada el 19 de agosto debido a que no recibió una invitación formal para participar. En ausencia de una convocatoria oficial, no fue posible programar su presencia en dicho evento. ¿Respecto a las consultas sobre los contenedores en San Francisco? El caso relacionado con las obras ejecutadas por la sociedad Inversiones Agropecuarias El Encanto Azul S.A. se encuentra actualmente bajo conocimiento del Tribunal Contencioso Administrativo, el cual deberá resolver una apelación presentada contra una resolución emitida por la Alcaldía Municipal. En cuanto a las demás inquietudes, se informa que el sitio en cuestión permanece clausurado y se encuentra a la espera de lo que resuelva el Tribunal. Por lo tanto, no debería estar siendo objeto de ningún tipo de arrendamiento en este momento, y si se encuentra en ese estado, dicho arrendamiento es ilegal. Lo anterior, fue notificado por correo enviado a las 14:47 horas del 9 de mayo de 2025 a la dirección ...04 . Nótese que dicha actuación se llevó a cabo con posterioridad a que a la autoridad recurrida se le notificó la resolución curso emitida dentro del presente recurso, lo cual se llevó a cabo a las 10:34 horas del 06 de mayo de 2025, motivo por el cual, en cuanto a dicho extremo el recurso debe ser estimado. V.- Por otra parte, se acredita que en oficio No. CPDSPSIH-GM-05-2025 del 28 de marzo de 2025, los recurrentes solicitaron a los funcionarios Bernal Monge Suñol y a la señora Kendy Villalobos Rodríguez, coordinadora de la Unidad Técnica de Gestión Ambiental de la municipalidad recurrida: “(…). Copia del expediente completo del Colegio Mundo Unido. Además quisiéramos nos indique cual es la realidad del caso, ya que el agua primero se dijo que la dio la asada en el 2022 y ahora aparentemente la van a tomar del río por una concesión, ¿cómo se va a hacer cuando esté el verano y los ríos se sequen? De donde se va a tomar el agua para 200 estudiantes, más personal administrativo. ¿También no queda la duda de que hay afectación de zona protegida y de la línea de la zona inalienable que usted nos responde que cuando se hizo el traspaso fue corregido, bajo qué criterios se hizo y con la autorización de cual entidad? Existen versiones diferentes del caso, por eso para nosotros es importante tener la información del expediente y estar claros en el proceso que se llevó desde el inicio hasta hoy. Como medio para recibir notificaciones indicaron los correos ...05 o ...06 . Lo anterior fue remitido por correo enviado a las 21:05 horas del 28 de marzo de 2025 a las direcciones ...07 y ...08 . Posteriormente, en correo electrónico enviado a las 17:53 horas del 8 de mayo de 2025, el Coordinador de Desarrollo y Control Urbano a. i. de la Municipalidad San Isidro de Heredia le indicó a la recurrente: “Las respuestas a sus consultas e inquietudes fueron respondidas en correo del 26 de marzo del 2025, además en la documentación enviada se encuentra información que atiende sus consultas. Referente al expediente puede presentarse a la Municipalidad y obtener copia de los expedientes para las licencias constructivas tramitadas y aprobadas a la fecha”. En el correo electrónico enviado a las 13:05 horas del 26 de marzo de 2025, el funcionario Bernal Monge Suñol le indicó a la recurrente: “Estimada Nombre03. En adjunto los documentos que dan respuesta a sus consultas. Le aclaro que las edificaciones del proyecto no cuentan aún con licencias constructivas, dichas licencias y su aprobación son labor a cargo de la Dirección de Control Urbano. Esta dirección bajo la coordinación de mi persona como ingeniero municipal está a cargo de la revisión de dichas licencias. Previo a esta aprobación, hay un proceso que involucra a la Comisión de obras y posteriormente al Concejo Municipal”. En cuanto al acceso al expediente administrativo se acredita que la autoridad recurrida puso a disposición de la parte su acceso, motivo por el cual el recurso debe ser desestimado, en cuanto a dicho extremo. Por otra parte, la respuesta brindada por la autoridad recurrida en cuanto a esta segunda gestión no respondió de manera clara y precisa lo consultado por la parte recurrente, en relación al servicio de agua y la zona protegida, motivo por el cual en cuando a dicho extremo el recurso debe ser estimado, con las consecuencias que se indican en la parte dispositiva. VI.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión número 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión número 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI. POR TANTO: Se declara parcialmente con lugar el recurso. Se ordena a Eddie Sánchez Ramírez, en su condición de Alcalde de la Municipalidad de San Isidro de Heredia, o a quien en su lugar ocupe eso cargos, que gire las órdenes pertinentes y lleve a cabo todas las actuaciones que estén dentro del ámbito de sus competencias para que, en el plazo de DIEZ DÍAS contados a partir de la notificación de esta sentencia, se conteste de forma completa y brinde la información a la solicitud presentada por la parte en el oficio No. CPDSPSIH-GM-05-2025 del 28 de marzo de 2025 y se le notifique a la dirección señalada para recibir notificaciones. Se les advierte que de no acatar la orden dicha incurrirán en el delito de desobediencia, que de conformidad con el artículo 71 de la Ley de esta jurisdicción impone prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de San Isidro de Heredia al pago de las costas, daños y perjuicios causados, los que se liquidarán en ejecución de sentencia ante la jurisdicción contencioso administrativa. On August 26 of this year, I sent an email to you asking some questions related to the Municipal Police officers: 1. How many municipal police officers are on the municipal payroll? 2. What measures are taken regarding the schedule when they are on their well-deserved rest time? 3. How many municipal police officers are authorized to issue fines, remove license plates, or perform other functions of the position itself? 4. Last Sunday, eight days ago, during the patron saint festivities of Santa Elena, at the time of the parade and the Eucharist, Mr. Geovanny was in this sector, honking, moving people, even in a rude manner, who were parked on the edge of the street; is this a proper function? It is understood that he has to carry out his duty, if necessary, but not in the manner he was doing it, and furthermore, it is common knowledge that this street is really narrow and there is nowhere to park, as in this case, because it is an event that many people attend. Is it not possible to be a little tolerant in these cases, as it is a community event? Furthermore, I would like to know, given the question from several neighbors who have asked me, what are the functions of the Deputy Mayor? They add that on March 28, 2025, they sent official communication No. CPDSPSIH-GM-05-2025 and requested from those involved the administrative record (expediente) related to the construction of the Colegio Mundo Unido in Santa Cecilia de San Isidro de Heredia. They claim that, at the time of filing this action, they have not received a response to either of their requests. They request the intervention of the Chamber. **2.-** By resolution issued at twelve hours forty minutes on May 2, two thousand twenty-five, the proceeding is admitted and reports are requested from the respondent authorities. **3.-** Eddie Sánchez Ramírez, in his capacity as Mayor of the Municipality of San Isidro de Heredia, reports under oath that on August 28, 2024, through electronic mail ...02, a message was sent addressed to the account ...01. Attached to said email was official communication CPDSPSIH-GR02-2024, through which a response is requested to a series of questions related to various topics, including matters concerning the Deputy Mayor, the works linked to Agropecuarias El Encanto Azul S.A. (San Francisco containers), as well as matters related to municipal police officers. In response to the questions in official communication CPDSPSIH-GR02-2024, official communication No. MSIH-AM-66-2025 is issued, dated May 8, 2025, and signed and sent to email ...02 on May 9, 2025. That regarding the United World College (UWC) construction project, on March 24 of this year, the Comité Pro Defensa de los Servicios Públicos de San Isidro de Heredia, via electronic mail ...02, sent a request for information related to said project. In response to that message, on March 26, 2025, Mr. Bernal Monge Suñol, coordinator of the Department of Urban Development and Control (Departamento de Desarrollo y Control Urbano), reported that the project's buildings do not yet have approved construction licenses (licencias constructivas), as these are under review by the Directorate under his charge. He explained that this process requires prior assessment by the Works Commission and the Municipal Council. Furthermore, he detailed that the project currently has permits for the execution of earthworks (movimientos de tierra), infrastructure, and storm drainage works. The first license was issued in 2023 (PC-81-2023), and in 2024, licenses for the treatment plant and other works were granted, as recorded in official communication MSIH-AM-DCU-001-2024. Likewise, he clarified that the project does not have a water availability approval from the ESPH, although it does have a concession for water use (concesión de aprovechamiento) granted. He also indicated that UWC has initiated the process for construction licenses for the first phase of buildings and road works, a process that will continue to be supervised by the Urban Control Directorate. As support, eight documents were attached, including technical reports, resolutions from SETENA and MINAE, plans, inspection reports, complaints, and agreements of the Municipal Council. That same March 26, 2025, the Comité Pro Defensa de los Servicios Públicos de San Isidro de Heredia continued making inquiries regarding the matter, which were answered by Mr. Monge Suñol during that same day. On March 28, 2025, through email account ...02, a message was sent addressed to Mr. Bernal Monge Suñol and Ms. Kendy Villalobos Rodríguez, coordinator of the Technical Unit for Environmental Management (Unidad Técnica de Gestión Ambiental). Said message was accompanied by official communication CPDSPSIH-GM-05-2025, dated the same day, through which a copy of the administrative record for the Colegio Mundo Unido project was requested, as well as a response to several inquiries related to the project, inquiries that, in the opinion of this Municipality, had already been previously answered. In response to the email sent on March 28, 2025, Mr. Bernal Monge Suñol replied on May 8, 2025, reiterating that the inquiries and concerns were addressed in his communication of March 26, 2025. Additionally, he indicated that the documentation already provided includes relevant information that addresses those inquiries. Regarding the requested administrative record, it was reported that interested persons may appear at the Municipality to obtain copies of the documents related to the construction licenses processed and approved to date. See in this regard, that as detailed in the background section, on March 24, 2025, Ms. Nombre01, on behalf of said COMMITTEE, made a series of inquiries, which received a timely response from Engineer Bernal Monge Suñol, Director of Urban Development and Control, on March 26 via electronic mail. Despite this, on that same March 26, 2025, Ms. Nombre01 again submits new inquiries, in the form of a rejoinder, which were again addressed by Engineer Monge Suñol during that same day. Despite this, on March 28, 2025, two days after the responses given by Engineer Monge Suñol, Ms. Nombre01 and Mr. Nombre02, again petition, but via official communication, to inquire about the same topics already addressed, including phrases such as "what is the reality of the case". In the opinion of this Administration, beyond the lack of respect that this type of phrase can imply, suggesting that the previous responses contain untruthful information, it is demonstrated thereby that this official communication corresponds to a rejoinder on matters already answered and addressed, which in the opinion of this Administration are not protected under the right of petition. In any case, we consider that this manner of acting by Ms. Nombre01 and Mr. Nombre02, could imply an abuse of the right of petition, insofar as inquiries are made in an initial email, from which they derive a large number of additional actions, thereby seeking to generate some type of conversation or chat through this medium, and denouncing any lack of response to the subsequent actions, as if the Administration had not made efforts to respond respectfully and extensively to the initial actions. With this, the error of the Administration is sought, and this type of constitutional claim, more with the aim of looking for errors, than demonstrating a genuine interest in the topics addressed. He requests that the action be dismissed. **4.-** In the substantiation of the process, the prescriptions of law have been observed. They further accuse that on March 28, 2025, they sent official communication No. CPDSPSIH-GM-05-2025 and requested from those involved the administrative record related to the construction of the Colegio Mundo Unido in Santa Cecilia de San Isidro de Heredia. **II.- PROVEN FACTS.** Of relevance for deciding this amparo action, the following are deemed accredited: a) On September 26, 2024, the petitioners sent an electronic mail to the account ...01 with official communication CPDSPSIH-GR02-2024 through which they requested the Mayor of San Isidro de Heredia the following: "1. (report from the respondent authority). b) In official communication No. MSIH-AM-66-2025 of May 8, 2025, the Mayor of the Municipality of San Isidro indicated to the petitioner Nombre01: "A. Regarding Question 1: Attached to this email is official communication MISH-AM-POLM2-30-2025, in which officer Reiner Corella Carazo, a municipal police official, issues his response to the four items contained in question 1. It is worth noting that officer Geovanny Brenes is currently on sick leave, so it has not been possible to obtain his pronouncement regarding point 1.4, from Mr. Brenes. In any case, you are advised that should officer Geovanny Brenes have acted incorrectly in the exercise of his duties, the proper course is for formal complaints to be filed by the affected persons, accompanied by any evidence that may be used in an investigation process. Therefore, it is understood that it is not possible to take any action against the officer based on rumors or on inquiries made by persons who do not indicate if they were affected by a specific action. B. Regarding the other inquiries: 2. What are the functions of the Deputy Mayor? Through official communication No. MSIH-AM-118-2024, dated May 6, 2024, the municipal mayor, Eddie Ramírez Sánchez, assigned the administrative and operational functions corresponding to the First Vice Mayoralty for the period 2024-2028, in accordance with Article 14 bis of the Código Municipal. According to information provided by the Deputy Mayor, the convocation mentioned by you could not be located. Under these terms, it is to be understood that the event at the Legislative Assembly held on August 19 was not attended because no formal invitation to participate was received. In the absence of an official convocation, it was not possible to schedule her presence at said event. Regarding the inquiries about the containers in San Francisco? The case related to the works executed by the company Inversiones Agropecuarias El Encanto Azul S.A. is currently under the jurisdiction of the Tribunal Contencioso Administrativo, which must resolve an appeal filed against a resolution issued by the Municipal Mayor's Office. As for the other concerns, it is reported that the site in question remains closed and is awaiting the Court's decision. Regarding the administrative record, you may appear at the Municipality and obtain copies of the files for the construction licenses processed and approved to date." In the electronic mail sent at 1:05 p.m. on March 26, 2025, official Bernal Monge Suñol indicated to the petitioner: "Dear Nombre03. Attached are the documents that respond to your inquiries. I clarify that the project's buildings do not yet have construction licenses; said licenses and their approval are the responsibility of the Urban Control Directorate. This directorate, under the coordination of myself as municipal engineer, is in charge of reviewing said licenses. Prior to this approval, there is a process that involves the Works Commission and subsequently the Municipal Council" (report from the respondent authority). e) That the order for proceedings issued within this action was notified to the respondent authority at 10:34 a.m. on May 6, 2025 (digital court file). **III.- ON THE SENDING OF THE PETITION UNDER STUDY TO ELECTRONIC MAIL ACCOUNTS.** In this matter, it has been accredited that several of the petitions made by the party were sent to the respondent party at electronic mail addresses, namely: ...01, ...07, and ...08. This Court, in the order for proceedings of this amparo action, requested the respondents to indicate whether or not such addresses are established as official means for receiving petitions sent by users to the institution. However, the respondents did not rule on this point, meaning that, consequently, in accordance with the provisions of article 45 of the Ley de la Jurisdicción Constitucional, they are deemed as such. Furthermore, it must be observed that these petitions were answered by the respondent party, therefore it is understood that the latter has acknowledged their submission. Thus, having verified the foregoing, it is appropriate to hear the merits of this amparo proceeding. **IV.- ON THE MERITS.** From the report rendered under oath by the respondent authorities, with the even criminal consequences provided for in article 44 of the Ley de la Jurisdicción Constitucional, an infringement of the fundamental rights of the petitioners is accredited, based on the considerations set forth below. In this regard, it is accredited that on September 26, 2024, the petitioners sent an electronic mail to the account ...01 with official communication CPDSPSIH-GR02-2024 through which they requested the Mayor of San Isidro de Heredia the following: "1. On August 26 of this year, I sent an email to you asking some questions related to the Municipal Police officers: 1. How many municipal police officers are on the municipal payroll? 2. What measures are taken regarding the schedule when they are on their well-deserved rest time? 3. How many municipal police officers are authorized to issue fines, remove license plates, or perform other functions of the position itself? 4. Last Sunday, eight days ago, during the patron saint festivities of Santa Elena, at the time of the parade and the Eucharist, Mr. Geovanny was in this sector, honking, moving people, even in a rude manner, who were parked on the edge of the street; is this a proper function? It is understood that he has to carry out his duty, if necessary, but not in the manner he was doing it, and furthermore, it is common knowledge that this street is really narrow and there is nowhere to park, as in this case, because it is an event that many people attend. Is it not possible to be a little tolerant in these cases, as it is a community event? Regarding Question 1: Attached to this email is official communication MISH-AM-POLM2-30-2025, in which officer Reiner Corella Carazo, a municipal police official, issues his response to the four items contained in question 1. It is worth noting that officer Geovanny Brenes is currently on sick leave, so it has not been possible to obtain his pronouncement regarding point 1.4, from Mr. Brenes. In any case, you are advised that should officer Geovanny Brenes have acted incorrectly in the exercise of his duties, the proper course is for formal complaints to be filed by the affected persons, accompanied by any evidence that may be used in an investigation process. Therefore, it is understood that it is not possible to take any action against the officer based on rumors or on inquiries made by persons who do not indicate if they were affected by a specific action. Subsequently, in an email sent at 5:53 p.m. on May 8, 2025, the Acting Coordinator of Urban Development and Control of the Municipality of San Isidro de Heredia stated to the petitioner: "The responses to your queries and concerns were answered in the email of March 26, 2025; additionally, the documentation sent contains information that addresses your queries. Regarding the case file, you may appear at the Municipality and obtain a copy of the case files for the construction permits processed and approved to date." In the email sent at 1:05 p.m. on March 26, 2025, the official Bernal Monge Suñol stated to the petitioner: "Dear Nombre03. Attached are the documents that respond to your queries. I clarify that the project buildings do not yet have construction permits; these permits and their approval are the responsibility of the Directorate of Urban Control. This directorate, under my coordination as municipal engineer, is in charge of reviewing these permits. Prior to this approval, there is a process involving the Works Commission and subsequently the Municipal Council." Regarding access to the administrative case file, it is demonstrated that the respondent authority made access available to the party, for which reason the appeal must be dismissed with respect to that point. On the other hand, the response provided by the respondent authority regarding this second request did not clearly and precisely answer what the petitioner inquired about in relation to the water service and the protected area (zona protegida), for which reason the appeal must be granted with respect to that point, with the consequences indicated in the operative part. VI.- DOCUMENTATION PROVIDED TO THE CASE FILE. The parties are warned that if they have provided any document on paper, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic device or one produced by new technologies, these must be removed from the office within a maximum period of 30 business days from the notification of this judgment. Otherwise, any material not removed within this period will be destroyed, in accordance with the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena in session number 27-11 of August 22, 2011, article XXVI and published in the Boletín Judicial number 19 of January 26, 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial, in session number 43-12 held on May 3, 2012, article LXXXI. Eddie Sánchez Ramírez, in his capacity as Mayor of the Municipality of San Isidro de Heredia, or whoever occupies that position, is ordered to issue the pertinent instructions and carry out all actions within the scope of his competencies so that, within a period of TEN DAYS from the notification of this judgment, a complete response is provided and the information is given to the request filed by the party in letter CPDSPSIH-GM-05-2025 of March 28, 2025, and that it is notified to the address indicated for receiving notifications. They are warned that failure to comply with said order will result in the crime of disobedience, which in accordance with article 71 of the Law of this jurisdiction imposes a prison sentence of three months to two years, or a fine of twenty to sixty days, on anyone who receives an order that must be complied with or enforced, issued in an amparo appeal, and fails to comply with it or fails to enforce it, provided the crime is not more severely punishable. The Municipality of San Isidro de Heredia is ordered to pay the costs, damages, and losses caused, which will be settled in the execution of sentence before the administrative litigation jurisdiction.
