SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del veintinueve de abril de dos mil veinticinco .

 Gestión posterior planteada por Nombre01, cédula de identidad CED01, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA), en relación con la sentencia nro. 2020016705 de las 9:15 horas de 4 de setiembre de 2020.

Resultando:

1.- Por escrito incorporado recibido en la Secretaría de la Sala el 26 de marzo de 2025, la gestionante plantea desobediencia en relación con la sentencia nro. 2020016705 de las 9:15 horas de 4 de setiembre de 2020, Alega que este Tribunal les ordenó a las autoridades del Instituto Costarricense de Acueductos y Alcantarillados construir la planta de tratamiento de aguas negras en un plazo que se cumplía en el 2024; no obstante, a la fecha no se ha realizado el mandato. Sostiene que mediante el dictamen nro. 23120 del expediente 23062, el terreno que se había asignado para la construcción de la planta fue cedido a un ente privado de la marina de Golfito.

2.- Mediante resolución de las 15:20 horas de 27 de marzo de 2025 el magistrado instructor le confirió audiencia a Irving Zelaya Palacios, en su condición de Director a. Nombre02. de la Región Brunca, Noilyn Gutiérrez Arias, en su condición de Jefe de la Oficina Cantonal de Golfito, ambos del Instituto Costarricense de Acueductos y Alcantarillados (ICAA), y Fernando Mata Castro, en su condición de Director del Área Rectora de Salud del Ministerio de Salud, o a quienes desempeñen dichos cargos, para que se refieran y aporten las pruebas correspondientes en relación los hechos y omisiones que se les atribuyen.

3.- Por escrito incorporado al expediente digital el 2 de abril de 2025, informan Guillermo Zúñiga Esquivel y Noilyn Gutiérrez Arias, por su orden director regional a. i. de la Región Brunca y jefa de la oficina cantonal de Golfito, ambos del Instituto Costarricense de Acueductos y Alcantarillados. “I. EN RESPUESTA A LOS HECHOS ALEGADOS POR LA PARTE RECURRENTE. Con fundamento en el informe técnico titulado "Estado del Proyecto de Saneamiento en la Comunidad de Golfito, Puntarenas", de marzo de 2025, elaborado por UEN Programación y Control, el cual se adjunta como prueba y forma parte integral del expediente administrativo, se presenta la siguiente información: 1. En relación con la Resolución N.º 2024-021942, emitida por la Sala Constitucional en atención a la construcción de la Planta de Tratamiento de Aguas Residuales, se indica que dicha resolución está vinculada al proyecto BPIP 000413, denominado "Construcción de Alcantarillado Sanitario para la Ciudad de Golfito, Puntarenas", el cual comprende tanto la Planta de Tratamiento de Aguas Residuales como el sistema de alcantarillado sanitario. 2. El proyecto cuenta con diseños finales concluidos, viabilidad ambiental aprobada, terrenos debidamente adquiridos e inscritos a nombre de la institución, así como el pliego de condiciones finalizado, elementos todos necesarios para dar inicio a la etapa de licitación. 3. En cuanto al financiamiento del proyecto, la Administración Superior del Instituto Costarricense de Acueductos y Alcantarillados (AyA) está llevando a cabo las gestiones pertinentes para la formalización de un financiamiento dentro del marco del "Programa de Saneamiento", del cual forma parte el proyecto de Golfito. Dichas gestiones tienen como objetivo la ejecución de estos proyectos en el corto o mediano plazo, en cumplimiento de las necesidades urgentes de saneamiento en las comunidades beneficiadas y en observancia de las resoluciones emitidas por la Sala Constitucional. (ver prueba. Nota del BCIE GERCR-1712025, 27 de febrero 2025). 4. Se prevé que la ejecución del proyecto inicie en el segundo semestre del año 2026, condicionado a la formalización y obtención del financiamiento dentro del plazo establecido. 5. Actualmente, la institución está gestionando la formalización de un convenio con el Instituto Costarricense de Ferrocarriles (INCOFER), con el propósito de obtener la autorización para la colocación de tubería de la red de alcantarillado sanitario dentro del derecho de vía de dicha entidad. 6. En virtud de lo anterior, se pone en conocimiento de este Honorable Tribunal que el Instituto Costarricense de Acueductos y Alcantarillados está realizando todas las gestiones necesarias para la ejecución del proyecto, contando con avances significativos y encontrándose en la fase de formalización del financiamiento requerido para la materialización de los proyectos comprendidos dentro del "Programa de Saneamiento", siendo uno de estos el Proyecto "Construcción de Alcantarillado Sanitario para la Ciudad de Golfito, Puntarenas". II. CONCLUSIONES • En el presente caso, el Instituto Costarricense de Acueductos y Alcantarillados (AyA) ha avanzado significativamente en el desarrollo del Proyecto "Construc ción de Alcantarillado Sanitario para la Ciudad de Golfito, Puntarenas". Se cuen ta con los diseños finales, viabilidad ambiental aprobada, terrenos adquiridos y el pliego de condiciones listo, elementos clave para el proceso de licitación. Ac tualmente, la institución se encuentra en la etapa de formalización del financia miento dentro del "Programa de Saneamiento" y en la gestión de un convenio con INCOFER para el uso del derecho de vía. Se proyecta que la ejecución ini cie en el segundo semestre de 2026, condicionado a la obtención del financia miento. Con estas acciones, AyA reafirma su compromiso con el cumplimiento de la resolución de la Sala Constitucional y con la mejora del saneamiento en la comunidad de Golfito. El AyA ha llevado a cabo todas las acciones pertinentes dentro de su competencia y en estricto apego al marco de legalidad vigente. En consecuencia, se concluye que la acusación de desobediencia carece de fun damento técnico, legal y reglamentario, ya que el AyA ha cumplido cabalmente con las obligaciones impuestas por imperio de ley, en conformidad con el marco constitucional y el principio de legalidad. Por ello, no se ha incurrido en ninguna violación ni se ha desobedecido lo dispuesto por este Honorable Tribunal. (Véase Informe técnico técnico "Estado del Proyecto de Saneamiento en la Comunidad de Golfito, Puntarenas" y nota del BCIE GERCR-1712025, ad juntos)”.

4.- Por escrito incorporado al expediente digital el 8 de abril de 2025, informa Fernando Mata Castro, en su condición de director del Área Rectora de Salud del Ministerio de Salud en Golfito. Indica que: “Sobre los alegatos de la recurrente, en fecha 23 de julio de 2019 el Ing. Marvin Salamanca Codero, Unidad de Rectoría de la Salud, Dirección Regional de Rectoría de la Salud Brunca, realizó visita de inspección a la propiedad con plano catastrado 6-2060218-2018, donde se pretende desarrollar el proyecto el cual propone recolectar la totalidad de las aguas residuales generadas en el área por medio de una nueva red de alcantarillado sanitario, en donde indicó que es criterio de la Unidad de Rectoría dar el respectivo VISTO BUENO DE UBICACIÓN, con una vigencia de dos años, lo anterior, mediante el oficio BRU-URS-258-2019, de fecha 05 de agosto de 2019, según consta en nuestro expediente administrativo No. 0892-BRU-GO que se custodia en el Área Rectora de Salud de Golfito. Por otra parte, en agosto de 2021, el Instituto Costarricense de Acueductos y Alcantarillados solicitó ante la Unidad de Dirección área Rectora de Salud Golfito Rectoría de la Salud, Dirección Regional de Rectoría de la Salud Brunca, el visto bueno de ubicación para planta de tratamiento, plano catastrado P-2060218-2018, ubicado en el cantón de Golfito, provincia Puntarenas, la cual procesaría las agua residuales provenientes de los sectores de ese cantón, dicha solicitud fue atendida y aprobada por la Unidad de Rectoría mediante el oficio MS-DRRSBRU-URS-IT 234-2021, de fecha 31 de agosto de 2021, con una vigencia de dos años, lo anterior, según MS DRRSBRU-URS-IT-82-2025, de fecha 04 de abril de 2025, suscrito por el Ing. Marvin Salamanca Cordero, Unidad de Rectoría de la Salud. La Dirección de Aguas del Ministerio de Ambiente y Energía, con Número de Expediente 3921-V, mediante la resolución No. R-0162-2021-AGUAS-MINAE, de las once horas veinte minutos del 04 de febrero de 2021 otorgó el Permiso de Vertido al Instituto Costarricense de Acueductos y Alcantarillado, con vigencia de 10 años. Mediante el oficio MS-DRRSBRU-URS-IT-234-2021, de fecha 31 de agosto de 2021, suscrito por el Ing. Marvin Salamanca Cordero, Unidad de Rectoría de la Salud, manifestó que en respuesta al visto bueno de ubicación para la ubicación para la construcción de una planta de tratamiento para la ciudad de Golfito, Puntarenas, el día 10 de agosto de 2021 realizó inspección a la propiedad plano 6-2060218-2018 y es criterio de la Unidad de Rectoría dar el respectivo visto bueno de ubicación, a fin de continuar con la tramitología, con una vigencia de dos años. Por medio de la plataforma “Ventanilla Única de Inversión” de PROCOMER, sistema VUI, en el año 2024 ingresó la solicitud de visto bueno de ubicación de la planta de tratamiento del Instituto Costarricense de Acueductos y Alcantarillados, por lo que, el funcionario Marvin Salamanca Cordero realizó visita a la propiedad indicando que el tipo de tratamiento se encontraba en las mismas condiciones de las referidas en el año 2021, que considera oportuno otorgar el visto bueno de ubicación, otorgándolo mediante el oficio MS-DRRSBRU-URS-IT-167-2024, con una vigencia de 2 años, a la fecha se encuentra vigente el visto bueno de ubicación, lo anterior, según MS-DRRSBRU-URS-IT-82-2025, de fecha 04 de abril de 2025, suscrito por el Ing. Marvin Salamanca Cordero, Unidad de Rectoría de la Salud. Del último informe del Instituto Costarricense de Acueductos y Alcantarillados, de fecha 28 de marzo de 2025 dirigido al Ministerio de Salud, se extrae: “… IV. Estado actual El proyecto ““Construcción de alcantarillado sanitario para la cuidad de Golfito”cuenta con los diseños finales concluidos, la viabilidad ambiental aprobada y vigente ante SETENA, con los terrenos y servidumbres adquiridos, así como toda la documentación técnica (Términos de Referencia (TdR), Especificaciones Técnicas y Borrador de Pliego de Condiciones) finalizada para licitar el proyecto. Esta documentación se mantiene actualizada durante la búsqueda de una fuente de financiamiento. Actualmente el AyA realiza el proceso de actualización del estudio de factibilidad según lo requerido por MIDEPLAN. Para lograr la cobertura estimada y el impacto deseado con el proyecto de construcción de la red de alcantarillado en Golfito, es necesaria la suscripción de un Convenio con el INCOFER, ya que se requiere instalar tuberías de recolección en el derecho de vía del INCOFER (actual Dirección01). La formalización de este convenio se encuentra en proceso. IV.2 Presupuestos de ejecución El monto total estimado para la ejecución del proyecto “Construcción de alcantarillado sanitario para la cuidad de Golfito” es US$ 26.36 millones, de estos siendo US$ 10.20 millones correspondientes a la Planta de Tratamiento de Aguas Residuales. Estos montos no incluyen el impuesto al valor agregado. IV.3 Estado de financiamiento El Ministerio de Hacienda tomó la decisión de desestimar los fondos no desembolsados del contrato de préstamo N°28568 del Banco KfW. Esta resolución fue comunicada mediante documentos MH-DM-OF1303-2023 y MH-DM-OF-1445-2023, con fechas del 16 de agosto del 2023 y 8 de setiembre del 2023 respectivamente, dando al AyA la instrucción para realizar las acciones que correspondan, en aras de no realizar más desembolsos asociados a este préstamo. La institución se ve obligada a acatar este requerimiento, a pesar de tener conocimiento de las necesidades que tienen las comunidades y el rezago en materia de saneamiento existente. El avance logrado en este proyecto permitió tener los Documentos de Licitación listos y aprobados por el ente prestatario para iniciar el proceso de contratación de estos proyectos, la Administración Superior institucional se enfoca en el análisis de potencial crediticio de la Institución y de estrategias viables de financiamiento, para que estos proyectos se ejecuten en un corto o mediano plazo, en beneficio de las comunidades que requieren atención prioritaria en el tema de saneamiento y para el cumplimiento de las resoluciones de la Sala Constitucional. En esta búsqueda de financiamiento, el AyA promueve un acercamiento con el Banco Centroamericano de Integración Económica (BCIE) con el fin de obtener recursos para el proyecto de alcantarillado de Golfito y otros cuatro proyectos de saneamiento ubicados en los sectores de Jacó, Palmares, Quepos y el Área Metropolitana de San José, proyectos que en conjunto se denominan Programa de Saneamiento. Mediante el oficio PRE-2025-00052, AyA solicita al BCIE realizar las gestiones correspondientes a otorgar financiamiento a los proyectos de alcantarillado sanitario mencionados. Producto de esta gestión, el AyA obtiene la aprobación del crédito No. 2344 por parte del BCIE, a partir de esta resolución, el AyA se encuentra trabajando en las aprobaciones necesarias a nivel país para poder formalizar dicho crédito. IV.4 Cronograma de obras De acuerdo con lo establecido en la programación del proyecto, se estima iniciar el proceso de Licitación en el segundo semestre de este año, lo cual permitiría el inicio de ejecución de las obras para el segundo semestre del año 2026. Dichas fechas están sujetas a la formalización y obtención del préstamo en el plazo establecido. V. Conclusiones … Se estima que el proyecto inicie su ejecución en el segundo semestre del 2026. Esta fecha está sujeta a formalización y obtención del préstamo en el plazo establecido. Actualmente la Institución se encuentra trabajando en la formalización de un Convenio con el INCOFER mediante el cual se le permita al AyA colocar tubería de la red de alcantarillado sanitario en el derecho de vía del INCOFER.” (sic). Es claro que la Dirección del Área Rectora de Salud de Golfito ha realizado todas las acciones necesarias dentro del ámbito de sus competencias para atender la situación, se ha atendido el caso oportuna y adecuadamente en el marco de las competencias legales, garantizando el debido proceso y acatando de manera respetuosa la resolución número2020016705 de las 9:15 horas del 4 de setiembre de 2020 de la Sala Constitucional, tal y como consta en las piezas aportadas dentro del expediente administrativo. Es importante mencionar que los rezagos que ha tenido el proyecto como inversión pública, dentro de los plazos conferidos en el Voto 2024-021942, no es responsabilidad del Ministerio de Salud, no obstante, siempre se les ha brindado la ayuda para la colaboración y el seguimiento del proyecto.”.

5.- En los procedimientos seguidos se han observado las prescripciones legales.

 Redacta el Magistrado Cruz Castro; y,

 Considerando:

I.- En la sentencia nro. 2020016705 de las 9:15 horas de 4 de setiembre de 2020, se dispuso:

“Se declara parcialmente con lugar el recurso, únicamente por la falta de sistema de tratamiento de aguas negras de la comunidad de golfito. Se ordena a Irving Zelaya Palacios, en su condición de Director a.i. de la Región Brunca, Noilyn Gutiérrez Arias, en su condición de Jefe de la Oficina Cantonal de Golfito, ambos del Instituto Costarricense de Acueductos y Alcantarillados, y Fernando Mata Castro, en su condición de Director del Área Rectora de Salud del Ministerio de Salud, o a quienes desempeñen dichos cargos, adoptar en forma inmediata y coordinada las medidas y acciones necesarias, dentro del ámbito de sus competencias, para que se finalice la construcción de las obras del proyecto de la Planta de Tratamiento de Aguas Residuales de la ciudad de Golfito y la misma sea puesta en funcionamiento en el término improrrogable de veinticuatro meses contado a partir de la notificación de esta resolución. Asimismo, deberán presentar a este Tribunal un informe semestral del avance del proyecto. Se advierte a las autoridades recurridas que, de conformidad con lo establecido por el artículo 71, de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado y al Instituto Costarricense de Acueductos y Alcantarillados al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En lo demás se declara sin lugar el recurso. Notifíquese. El Magistrado Salazar Alvarado consigna nota.”.

Tal sentencia fue comunicada a las autoridades recurridas el 8 de setiembre de 2020.

II.- SOBRE LA GESTIÓN DE INEJECUCIÓN FORMULADA. En la especie, la gestionante plantea desobediencia en relación con la sentencia nro. 2020016705 de las 9:15 horas de 4 de setiembre de 2020, Alega que este Tribunal les ordenó a las autoridades del Instituto Costarricense de Acueductos y Alcantarillados construir la planta de tratamiento de aguas negras en un plazo que se cumplía en el 2024; no obstante, a la fecha no se ha realizado el mandato. Sostiene que mediante el dictamen nro. 23120 del expediente 23062, el terreno que se había asignado para la construcción de la planta fue cedido a un ente privado de la marina de Golfito.

En primer lugar, es menester aclararle a la recurrente que el hecho de que se haya cambiado el destino del terreno en el que se iba a realizar la construcción de la planta de marras, no constituye en sí una desobediencia a lo ordenado por este Tribunal. Sin embargo, dado que la tutelada indicó que las autoridades no han cumplido con el mandato de esta jurisdicción, se procedió a solicitar informe a las autoridades accionadas.

Al respecto, nótese que las autoridades del ICAA explican que: “1. En relación con la Resolución N.º 2024-021942, emitida por la Sala Constitucional en atención a la construcción de la Planta de Tratamiento de Aguas Residuales, se indica que dicha resolución está vinculada al proyecto BPIP 000413, denominado "Construcción de Alcantarillado Sanitario para la Ciudad de Golfito, Puntarenas", el cual comprende tanto la Planta de Tratamiento de Aguas Residuales como el sistema de alcantarillado sanitario. 2. El proyecto cuenta con diseños finales concluidos, viabilidad ambiental aprobada, terrenos debidamente adquiridos e inscritos a nombre de la institución, así como el pliego de condiciones finalizado, elementos todos necesarios para dar inicio a la etapa de licitación. 3. En cuanto al financiamiento del proyecto, la Administración Superior del Instituto Costarricense de Acueductos y Alcantarillados (AyA) está llevando a cabo las gestiones pertinentes para la formalización de un financiamiento dentro del marco del "Programa de Saneamiento", del cual forma parte el proyecto de Golfito. Dichas gestiones tienen como objetivo la ejecución de estos proyectos en el corto o mediano plazo, en cumplimiento de las necesidades urgentes de saneamiento en las comunidades beneficiadas y en observancia de las resoluciones emitidas por la Sala Constitucional. (ver prueba. Nota del BCIE GERCR-1712025, 27 de febrero 2025). 4. Se prevé que la ejecución del proyecto inicie en el segundo semestre del año 2026, condicionado a la formalización y obtención del financiamiento dentro del plazo establecido. 5. Actualmente, la institución está gestionando la formalización de un convenio con el Instituto Costarricense de Ferrocarriles (INCOFER), con el propósito de obtener la autorización para la colocación de tubería de la red de alcantarillado sanitario dentro del derecho de vía de dicha entidad. 6. En virtud de lo anterior, se pone en conocimiento de este Honorable Tribunal que el Instituto Costarricense de Acueductos y Alcantarillados está realizando todas las gestiones necesarias para la ejecución del proyecto, contando con avances significativos y encontrándose en la fase de formalización del financiamiento requerido para la materialización de los proyectos comprendidos dentro del "Programa de Saneamiento", siendo uno de estos el Proyecto "Construcción de Alcantarillado Sanitario para la Ciudad de Golfito, Puntarenas".”.

Por su parte, las autoridades del Ministerio de Salud indican que: “Sobre los alegatos de la recurrente, en fecha 23 de julio de 2019 el Ing. Marvin Salamanca Codero, Unidad de Rectoría de la Salud, Dirección Regional de Rectoría de la Salud Brunca, realizó visita de inspección a la propiedad con plano catastrado 6-2060218-2018, donde se pretende desarrollar el proyecto el cual propone recolectar la totalidad de las aguas residuales generadas en el área por medio de una nueva red de alcantarillado sanitario, en donde indicó que es criterio de la Unidad de Rectoría dar el respectivo VISTO BUENO DE UBICACIÓN, con una vigencia de dos años, lo anterior, mediante el oficio BRU-URS-258-2019, de fecha 05 de agosto de 2019, según consta en nuestro expediente administrativo No. 0892-BRU-GO que se custodia en el Área Rectora de Salud de Golfito. Por otra parte, en agosto de 2021, el Instituto Costarricense de Acueductos y Alcantarillados solicitó ante la Unidad de Dirección área Rectora de Salud Golfito Rectoría de la Salud, Dirección Regional de Rectoría de la Salud Brunca, el visto bueno de ubicación para planta de tratamiento, plano catastrado P-2060218-2018, ubicado en el cantón de Golfito, provincia Puntarenas, la cual procesaría las agua residuales provenientes de los sectores de ese cantón, dicha solicitud fue atendida y aprobada por la Unidad de Rectoría mediante el oficio MS-DRRSBRU-URS-IT 234-2021, de fecha 31 de agosto de 2021, con una vigencia de dos años, lo anterior, según MS DRRSBRU-URS-IT-82-2025, de fecha 04 de abril de 2025, suscrito por el Ing. Marvin Salamanca Cordero, Unidad de Rectoría de la Salud. La Dirección de Aguas del Ministerio de Ambiente y Energía, con Número de Expediente 3921-V, mediante la resolución No. R-0162-2021-AGUAS-MINAE, de las once horas veinte minutos del 04 de febrero de 2021 otorgó el Permiso de Vertido al Instituto Costarricense de Acueductos y Alcantarillado, con vigencia de 10 años. Marvin Salamanca Cordero, Unidad de Rectoría de la Salud, manifestó que en respuesta al visto bueno de ubicación para la ubicación para la construcción de una planta de tratamiento para la ciudad de Golfito, Puntarenas, el día 10 de agosto de 2021 realizó inspección a la propiedad plano 6-2060218-2018 y es criterio de la Unidad de Rectoría dar el respectivo visto bueno de ubicación, a fin de continuar con la tramitología, con una vigencia de dos años. Por medio de la plataforma “Ventanilla Única de Inversión” de PROCOMER, sistema VUI, en el año 2024 ingresó la solicitud de visto bueno de ubicación de la planta de tratamiento del Instituto Costarricense de Acueductos y Alcantarillados, por lo que, el funcionario Marvin Salamanca Cordero realizó visita a la propiedad indicando que el tipo de tratamiento se encontraba en las mismas condiciones de las referidas en el año 2021, que considera oportuno otorgar el visto bueno de ubicación, otorgándolo mediante el oficio MS-DRRSBRU-URS-IT-167-2024, con una vigencia de 2 años, a la fecha se encuentra vigente el visto bueno de ubicación, lo anterior, según MS-DRRSBRU-URS-IT-82-2025, de fecha 04 de abril de 2025, suscrito por el Ing. Marvin Salamanca Cordero, Unidad de Rectoría de la Salud. (…)”.

Desde este panorama, si bien este Tribunal observa que las autoridades recurridas han llevado a cabo actuaciones para cumplir lo ordenado por este Tribunal, no menos cierto es que no han sido suficientes, pues ha transcurrido sobradamente el plazo dispuesto en la sentencia nro. 2020016705 de las 9:15 horas de 4 de setiembre de 2020, sin que se haya, por lo menos, iniciado la ejecución de la construcción de las obras del proyecto de la planta de tratamiento de aguas residuales de la ciudad de Golfito.

En consecuencia, se acoge la gestión de desobediencia.

Ahora, visto que las personas que actualmente ejerce el cargo de director a. i. de la región Brunca del ICAA difiere de a quien se le giró la orden en la sentencia aludida, se ordena el cumplimiento de lo ahí dispuesto a quien en este momento ostenten tal cargo. Por último, debido a que quien ostenta el puesto de jefe de la oficina Cantonal de Golfito del ICAA y de director del Área Rectora de Salud del Ministerio de Salud en Golfito sí son los mismos a quienes se les dictó la orden en la supracitada sentencia, lo correspondiente es reiterarles el cumplimiento de lo ahí dispuesto.

III.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo material que no sea recogido dentro de ese lapso, con base en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial" (aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 y publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012) y en el artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012.

Por tanto:

Se acoge la gestión de desobediencia formulada. Se le ordena a Guillermo Zúñiga Esquivel, en su condición de director regional a. i. de la región Brunca del Instituto Costarricense de Acueductos y Alcantarillados, o a quien ocupe tal cargo, el cumplimiento inmediato de lo ordenado en la sentencia nro. 2020016705 de las 9:15 horas de 4 de setiembre de 2020. Se advierte a los recurridos, que según el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo, y no la cumpliere o no la hiciera cumplir, siempre que el delito no esté más gravemente penado. Por otra parte, se les reitera a Noilyn Gutiérrez Arias, en su condición de jefa de la oficina cantonal de Golfito del Instituto Costarricense de Acueductos y Alcantarillados; así como a Fernando Mata Castro, en su condición de director del Área Rectora de Salud del Ministerio de Salud en Golfito, o a quienes se desempeñen en esos puestos, el cumplimiento inmediato de lo dispuesto en la sentencia nro. 2020016705 de las 9:15 horas de 4 de setiembre de 2020. Lo anterior se dicta bajo la advertencia de ordenarse la apertura de un procedimiento administrativo en su contra si no lo hiciere. Notifíquese esta sentencia a Guillermo Zúñiga Esquivel y Noilyn Gutiérrez Arias, por su orden director regional a. i. de la región Brunca y jefa de la oficina cantonal de Golfito, ambos del Instituto Costarricense de Acueductos y Alcantarillados; así como a Fernando Mata Castro, en su condición de director del Área Rectora de Salud del Ministerio de Salud en Golfito, o a quienes ocupen los cargos, en forma personal.

**CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE.** San José, at nine hours and twenty-five minutes on the twenty-ninth of April, two thousand twenty-five.

Post-decision proceeding filed by Nombre01, identity card CED01, against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS (INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, ICAA), in relation to judgment no. 2020016705 of 9:15 a.m. on September 4, 2020.

**Whereas:**

1.- By incorporated brief received at the Secretariat of the Chamber on March 26, 2025, the petitioner claims disobedience in relation to judgment no. 2020016705 of 9:15 a.m. on September 4, 2020. She alleges that this Court ordered the authorities of the Costa Rican Institute of Aqueducts and Sewers to build the blackwater treatment plant within a term that expired in 2024; however, to date, the mandate has not been carried out. She maintains that, by means of opinion no. 23120 in file 23062, the land that had been allocated for the construction of the plant was transferred to a private entity of the Golfito marina.

2.- By resolution of 3:20 p.m. on March 27, 2025, the instructing judge granted a hearing to Irving Zelaya Palacios, in his capacity as Acting Director Nombre02. of the Brunca Region, Noilyn Gutiérrez Arias, in her capacity as Head of the Golfito Cantonal Office, both of the Costa Rican Institute of Aqueducts and Sewers (ICAA), and Fernando Mata Castro, in his capacity as Director of the Health Governing Area (Área Rectora de Salud) of the Ministry of Health, or to whoever holds those positions, so that they may address and provide the corresponding evidence regarding the facts and omissions attributed to them.

3.- By brief incorporated into the digital case file on April 2, 2025, Guillermo Zúñiga Esquivel and Noilyn Gutiérrez Arias, respectively acting regional director of the Brunca Region and head of the Golfito cantonal office, both of the Costa Rican Institute of Aqueducts and Sewers, report: “I. IN RESPONSE TO THE FACTS ALLEGED BY THE APPELLANT. Based on the technical report titled ‘Status of the Sanitation Project in the Community of Golfito, Puntarenas,’ dated March 2025, prepared by the UEN Programming and Control, which is attached as evidence and forms an integral part of the administrative file, the following information is provided: 1. Regarding Resolution No. 2024-021942, issued by the Constitutional Chamber in relation to the construction of the Wastewater Treatment Plant (Planta de Tratamiento de Aguas Residuales), it is stated that said resolution is linked to project BPIP 000413, called ‘Construction of the Sanitary Sewer System for the City of Golfito, Puntarenas,’ which includes both the Wastewater Treatment Plant and the sanitary sewer system (alcantarillado sanitario). 2. The project has final designs completed, environmental feasibility (viabilidad ambiental) approved, land duly acquired and registered in the name of the institution, as well as the finalized bidding terms (pliego de condiciones), all necessary elements to begin the bidding stage. 3. Regarding the project’s financing, the Senior Management (Administración Superior) of the Costa Rican Institute of Aqueducts and Sewers (AyA) is carrying out the pertinent steps to formalize financing within the framework of the ‘Sanitation Program’ (Programa de Saneamiento), of which the Golfito project is a part. These steps aim to execute these projects in the short or medium term, in compliance with the urgent sanitation needs in the beneficiary communities and in observance of the resolutions issued by the Constitutional Chamber. (see evidence. Note from BCIE GERCR-1712025, February 27, 2025). 4. Project execution is expected to begin in the second half of 2026, conditional on the formalization and obtaining of financing within the established period. 5. Currently, the institution is negotiating the formalization of an agreement with the Costa Rican Railways Institute (Instituto Costarricense de Ferrocarriles, INCOFER), for the purpose of obtaining authorization to lay sanitary sewer system network piping within said entity's right-of-way (derecho de vía). 6. By virtue of the foregoing, this Honorable Court is informed that the Costa Rican Institute of Aqueducts and Sewers is undertaking all necessary steps for the execution of the project, having made significant progress and being in the phase of formalizing the required financing for the materialization of the projects included within the ‘Sanitation Program,’ one of these being the Project ‘Construction of the Sanitary Sewer System for the City of Golfito, Puntarenas.’ II. CONCLUSIONS • In the present case, the Costa Rican Institute of Aqueducts and Sewers (AyA) has made significant progress in the development of the Project ‘Construction of the Sanitary Sewer System for the City of Golfito, Puntarenas.’ Final designs are available, environmental feasibility is approved, land has been acquired, and the bidding terms are ready, key elements for the bidding process. Currently, the institution is in the stage of formalizing financing within the ‘Sanitation Program’ and in the process of an agreement with INCOFER for the use of the right-of-way. Execution is projected to begin in the second half of 2026, conditional upon obtaining financing. With these actions, AyA reaffirms its commitment to complying with the Constitutional Chamber's resolution and to improving sanitation in the community of Golfito. AyA has carried out all pertinent actions within its competence and in strict adherence to the current legal framework. Consequently, it is concluded that the accusation of disobedience lacks technical, legal, and regulatory grounds, since AyA has fully complied with the obligations imposed by force of law, in accordance with the constitutional framework and the principle of legality. Therefore, no violation has been incurred nor has there been any disobedience of what was ordered by this Honorable Court. (See Technical Report ‘Status of the Sanitation Project in the Community of Golfito, Puntarenas’ and note from BCIE GERCR-1712025, attached).”

4.- By brief incorporated into the digital case file on April 8, 2025, Fernando Mata Castro reports, in his capacity as director of the Health Governing Area of the Ministry of Health in Golfito. He states that: “Regarding the appellant’s allegations, on July 23, 2019, Eng. Marvin Salamanca Codero, Health Stewardship Unit (Unidad de Rectoría de la Salud), Brunca Regional Directorate of Health Stewardship, conducted an inspection visit to the property with cadastral map 6-2060218-2018, where the project, which proposes to collect all wastewater generated in the area by means of a new sanitary sewer system network, is intended to be developed. He indicated that it is the criterion of the Stewardship Unit to grant the respective LOCATION APPROVAL (VISTO BUENO DE UBICACIÓN), with a validity of two years, the foregoing by means of official letter BRU-URS-258-2019, dated August 5, 2019, as recorded in our administrative file No. 0892-BRU-GO, kept in the Health Governing Area of Golfito. On the other hand, in August 2021, the Costa Rican Institute of Aqueducts and Sewers requested from the Health Stewardship Directorate Unit, Golfito Health Governing Area, Brunca Regional Directorate of Health Stewardship, the location approval for a treatment plant, cadastral map P-2060218-2018, located in the canton of Golfito, Puntarenas province, which would process the wastewater coming from the sectors of that canton. Said request was addressed and approved by the Stewardship Unit through official letter MS-DRRSBRU-URS-IT 234-2021, dated August 31, 2021, with a validity of two years, the foregoing according to MS DRRSBRU-URS-IT-82-2025, dated April 4, 2025, signed by Eng. Marvin Salamanca Cordero, Health Stewardship Unit. The Water Directorate (Dirección de Aguas) of the Ministry of Environment and Energy, under File Number 3921-V, through resolution No. R-0162-2021-AGUAS-MINAE, at eleven hours and twenty minutes on February 4, 2021, granted the Discharge Permit (Permiso de Vertido) to the Costa Rican Institute of Aqueducts and Sewers, with a validity of 10 years. Through official letter MS-DRRSBRU-URS-IT-234-2021, dated August 31, 2021, signed by Eng. Marvin Salamanca Cordero, Health Stewardship Unit, he stated that in response to the location approval for the construction of a treatment plant for the city of Golfito, Puntarenas, on August 10, 2021, he conducted an inspection of the property, cadastral map 6-2060218-2018, and it is the criterion of the Stewardship Unit to grant the respective location approval in order to continue with the formalities, with a validity of two years. Through the ‘Single Investment Window’ (Ventanilla Única de Inversión) platform of PROCOMER, VUI system, in 2024 the request for location approval for the Costa Rican Institute of Aqueducts and Sewers' treatment plant was submitted. Therefore, official Marvin Salamanca Cordero visited the property, indicating that the type of treatment was under the same conditions as those referred to in 2021, and deemed it appropriate to grant the location approval, granting it through official letter MS-DRRSBRU-URS-IT-167-2024, with a validity of 2 years. To date, the location approval is valid, the foregoing according to MS-DRRSBRU-URS-IT-82-2025, dated April 4, 2025, signed by Eng. Marvin Salamanca Cordero, Health Stewardship Unit. From the latest report of the Costa Rican Institute of Aqueducts and Sewers, dated March 28, 2025, addressed to the Ministry of Health, the following is extracted: ‘… IV. Current Status The project “Construction of the sanitary sewer system for the city of Golfito” has final designs completed, environmental feasibility approved and current before SETENA, land and easements (servidumbres) acquired, as well as all technical documentation (Terms of Reference (TdR), Technical Specifications, and Draft Bidding Terms) finalized for bidding the project. This documentation is kept updated during the search for a source of financing. AyA is currently carrying out the process of updating the feasibility study as required by MIDEPLAN. To achieve the estimated coverage and the desired impact with the construction project of the sewer system network in Golfito, the signing of an Agreement with INCOFER is necessary, since collection pipes need to be installed in the INCOFER right-of-way (current Dirección01). The formalization of this agreement is in process. IV.2 Execution Budgets The total estimated amount for the execution of the project “Construction of the sanitary sewer system for the city of Golfito” is US$26.36 million, of which US$10.20 million corresponds to the Wastewater Treatment Plant. These amounts do not include value-added tax. IV.3 Financing Status The Ministry of Finance made the decision to dismiss the undisbursed funds from loan contract No. 28568 with KfW Bank. This resolution was communicated through documents MH-DM-OF1303-2023 and MH-DM-OF-1445-2023, dated August 16, 2023, and September 8, 2023, respectively, instructing AyA to take the corresponding actions in order not to make further disbursements associated with this loan. The institution is obliged to comply with this requirement, despite being aware of the needs of the communities and the existing backlog in sanitation matters. The progress achieved in this project allowed having the Bidding Documents ready and approved by the borrowing entity to start the contracting process for these projects. The institutional Senior Management is focusing on the analysis of the Institution’s credit potential and viable financing strategies so that these projects can be executed in the short or medium term, for the benefit of communities requiring priority attention in sanitation matters and for compliance with the Constitutional Chamber's resolutions. In this search for financing, AyA is promoting an approach with the Central American Bank for Economic Integration (Banco Centroamericano de Integración Económica, BCIE) in order to obtain resources for the Golfito sewer system project and four other sanitation projects located in the sectors of Jacó, Palmares, Quepos, and the San José Metropolitan Area, projects that together are called the Sanitation Program. Through official letter PRE-2025-00052, AyA requests that the BCIE take the corresponding steps to grant financing for the aforementioned sanitary sewer system projects. As a result of this effort, AyA obtained approval for credit No. 2344 from the BCIE. Based on this resolution, AyA is working on the necessary approvals at the country level to be able to formalize said credit. IV.4 Works Schedule According to what is established in the project schedule, the Bidding process is estimated to begin in the second half of this year, which would allow the start of execution of the works for the second half of 2026. These dates are subject to the formalization and obtaining of the loan within the established period. V. Conclusions … It is estimated that the project will begin execution in the second half of 2026. This date is subject to the formalization and obtaining of the loan within the established period. The Institution is currently working on the formalization of an Agreement with INCOFER through which AyA would be allowed to lay sanitary sewer system network piping in the INCOFER right-of-way.’ (sic). It is clear that the Directorate of the Health Governing Area of Golfito has carried out all necessary actions within the scope of its powers to address the situation; the case has been addressed timely and adequately within the framework of legal powers, guaranteeing due process and respectfully complying with resolution number 2020016705 of 9:15 a.m. on September 4, 2020, of the Constitutional Chamber, as evidenced by the pieces provided within the administrative file. It is important to mention that the delays the project has experienced as a public investment, within the timeframes granted in Voto 2024-021942, are not the responsibility of the Ministry of Health; nonetheless, assistance for collaboration and project follow-up has always been provided.”

5.- The legal requirements have been observed in the proceedings followed.

Drafted by Judge Cruz Castro; and,

**Considering:**

I.- In judgment no. 2020016705 of 9:15 a.m. on September 4, 2020, it was ordered:

“The appeal is partially granted, solely due to the lack of a blackwater treatment system for the community of Golfito. Irving Zelaya Palacios, in his capacity as Acting Director of the Brunca Region, Noilyn Gutiérrez Arias, in her capacity as Head of the Golfito Cantonal Office, both of the Costa Rican Institute of Aqueducts and Sewers, and Fernando Mata Castro, in his capacity as Director of the Health Governing Area of the Ministry of Health, or whoever holds these positions, are ordered to immediately and in a coordinated manner adopt the necessary measures and actions, within the scope of their powers, so that the construction of the works for the Wastewater Treatment Plant project for the city of Golfito is completed and it is put into operation within the non-extendable term of twenty-four months, counted from the notification of this resolution. Likewise, they must submit a semi-annual progress report on the project to this Court. The respondent authorities are warned that, in accordance with the provisions of Article 71 of the Law of Constitutional Jurisdiction (Ley de la Jurisdicción Constitucional), a prison sentence of three months to two years or a fine of twenty to sixty days shall be imposed on anyone who receives an order that must be complied with or enforced, issued within an amparo appeal (recurso de amparo), and does not comply with it or does not enforce it, provided that the offense is not more severely punished. The State and the Costa Rican Institute of Aqueducts and Sewers are ordered to pay the costs, damages, and losses caused by the facts that serve as the basis for this declaration, which shall be liquidated in the execution of the judgment of the contentious-administrative jurisdiction. In all other respects, the appeal is dismissed. Notify. Judge Salazar Alvarado records a note.”

Said judgment was communicated to the respondent authorities on September 8, 2020.

II.- REGARDING THE NON-EXECUTION PROCEEDING FILED. In the present case, the petitioner claims disobedience in relation to judgment no. 2020016705 of 9:15 a.m. on September 4, 2020. She alleges that this Court ordered the authorities of the Costa Rican Institute of Aqueducts and Sewers to build the blackwater treatment plant within a term that expired in 2024; however, to date, the mandate has not been carried out. She maintains that, by means of opinion no. 23120 in file 23062, the land that had been allocated for the construction of the plant was transferred to a private entity of the Golfito marina.

First of all, it is necessary to clarify to the appellant that the fact that the destination of the land on which the construction of the aforementioned plant was to be carried out has been changed does not in itself constitute disobedience to what was ordered by this Court. However, given that the petitioner indicated that the authorities have not complied with this jurisdiction's mandate, a report was requested from the respondent authorities.

In this regard, it is noted that the ICAA authorities explain that: “1. Regarding Resolution No. 2024-021942, issued by the Constitutional Chamber in relation to the construction of the Wastewater Treatment Plant, it is stated that said resolution is linked to project BPIP 000413, called ‘Construction of the Sanitary Sewer System for the City of Golfito, Puntarenas,’ which includes both the Wastewater Treatment Plant and the sanitary sewer system. 2. The project has final designs completed, environmental feasibility approved, land duly acquired and registered in the name of the institution, as well as the finalized bidding terms, all necessary elements to begin the bidding stage. 3. Regarding the project’s financing, the Senior Management of the Costa Rican Institute of Aqueducts and Sewers (AyA) is carrying out the pertinent steps to formalize financing within the framework of the ‘Sanitation Program,’ of which the Golfito project is a part. These steps aim to execute these projects in the short or medium term, in compliance with the urgent sanitation needs in the beneficiary communities and in observance of the resolutions issued by the Constitutional Chamber. (see evidence. Note from BCIE GERCR-1712025, February 27, 2025). 4. Project execution is expected to begin in the second half of 2026, conditional on the formalization and obtaining of financing within the established period. 5. By virtue of the foregoing, this Honorable Court is informed that the Costa Rican Institute of Aqueducts and Sewers is undertaking all necessary steps for the execution of the project, having made significant progress and being in the phase of formalizing the required financing for the materialization of the projects included within the ‘Sanitation Program,’ one of these being the Project ‘Construction of the Sanitary Sewer System for the City of Golfito, Puntarenas.’”

For their part, the authorities of the Ministry of Health indicate that: “Regarding the appellant’s allegations, on July 23, 2019, Eng. Marvin Salamanca Codero, Health Stewardship Unit, Brunca Regional Directorate of Health Stewardship, conducted an inspection visit to the property with cadastral map 6-2060218-2018, where the project, which proposes to collect all wastewater generated in the area by means of a new sanitary sewer system network, is intended to be developed. He indicated that it is the criterion of the Stewardship Unit to grant the respective LOCATION APPROVAL, with a validity of two years, the foregoing by means of official letter BRU-URS-258-2019, dated August 5, 2019, as recorded in our administrative file No. 0892-BRU-GO, kept in the Health Governing Area of Golfito. To date, the location approval is valid, the foregoing according to MS-DRRSBRU-URS-IT-82-2025, dated April 4, 2025, signed by Eng. Marvin Salamanca Cordero, Health Stewardship Unit. (…)”

From this perspective, although this Court observes that the respondent authorities have carried out actions to comply with what was ordered by this Court, it is no less true that these have not been sufficient, since the term provided in judgment no. 2020016705 of 9:15 a.m. on September 4, 2020, has amply elapsed, without the execution of the construction of the works for the wastewater treatment plant project in the city of Golfito having even begun.

Consequently, the disobedience proceeding is granted.

Now, seeing that the person currently holding the position of acting director of the ICAA's Brunca region differs from the person to whom the order was given in the aforementioned judgment, compliance with what was ordered therein is directed to whoever currently holds that position. Finally, since the person holding the position of head of the Golfito Cantonal Office of the ICAA and director of the Health Governing Area of the Ministry of Health in Golfito are indeed the same individuals to whom the order was given in the above-cited judgment, the appropriate course is to reiterate to them compliance with what was ordered therein.

III.- DOCUMENTATION PROVIDED TO THE FILE. The parties are warned that, if they have provided any paper document or objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology-produced device, these must be collected within a maximum period of 30 business days, counted from the notification of this judgment. It is warned that any material not collected within that period will be destroyed, based on the "Regulations on the Electronic File before the Judicial Branch" (Reglamento sobre Expediente Electrónico ante el Poder Judicial) (approved by the Full Court in Article XXVI of session no. 27-11 of August 22, 2011, and published in Judicial Bulletin no. 19 of January 26, 2012) and Article LXXXI of the session of the Superior Council of the Judicial Branch no. 43-12 of May 3, 2012.

**Therefore:**

The disobedience proceeding filed is granted. Guillermo Zúñiga Esquivel, in his capacity as acting regional director of the Brunca region of the Costa Rican Institute of Aqueducts and Sewers, or whoever holds that position, is ordered to immediately comply with what was ordered in judgment no. 2020016705 of 9:15 a.m. on September 4, 2020. The respondents are warned that, according to Article 71 of the Law of Constitutional Jurisdiction, a prison sentence of three months to two years or a fine of twenty to sixty days shall be imposed on anyone who receives an order that must be complied with or enforced, issued in an amparo appeal, and does not comply with it or does not enforce it, provided that the offense is not more severely punished. Moreover, Noilyn Gutiérrez Arias, in her capacity as head of the Golfito cantonal office of the Costa Rican Institute of Aqueducts and Sewers, as well as Fernando Mata Castro, in his capacity as director of the Health Governing Area of the Ministry of Health in Golfito, or whoever holds those positions, are reiterated the immediate compliance with what was ordered in judgment no. 2020016705 of 9:15 a.m. on September 4, 2020. The foregoing is ordered under the warning that administrative proceedings will be ordered to be initiated against them should they fail to do so. This judgment shall be notified to Guillermo Zúñiga Esquivel and Noilyn Gutiérrez Arias, respectively acting regional director of the Brunca region and head of the Golfito cantonal office, both of the Costa Rican Institute of Aqueducts and Sewers; as well as to Fernando Mata Castro, in his capacity as director of the Health Governing Area of the Ministry of Health in Golfito, or to whoever holds the positions, in person.
