SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del catorce de noviembre de dos mil veinticinco .

 Recurso de amparo que se tramita en expediente número 25-030065-0007-CO, interpuesto por Nombre49435, cédula de identidad CED24899, a favor de SÍ MISMA Y DE PERIDOT S.A. y Nombre49436. contra el CONSEJO NACIONAL DE VIALIDAD (CONAVI), EL MINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTES (MOPT), EL MINISTERIO DE SALUD (MS) Y LA MUNICIPALIDAD DE GOLFITO.

Resultando:

 1.- Por escrito incorporado al expediente digital el 30 de setiembre de 2025, la parte accionante interpone recurso de amparo. Manifiesta que es una persona adulta mayor. Refiere que, desde el año 2022, durante la época lluviosa, y de forma reiterada desde entonces, se han producido inundaciones en el Dirección2800, debido a drenajes insuficientes, cunetas en mal estado y obstruidas, caños y cajas de registro deterioradas, así como acumulación de basura. Señala que como consecuencia se han destruido varias calles cantonales y una ruta nacional. Detalla que las vías afectadas por las inundaciones son seis calles cantonales y una ruta nacional, a saber: la calle central, desde el costado norte del ICE hasta la entrada al antiguo Club de Golf; la calle frente a la Dirección2801 hasta frente a la casa de Nombre49437; la calle frente a la casa Nombre49454, en el sector de la casa de Nombre49438 hasta la parte trasera del Hotel Don Fito; la calle desde el antiguo Club de Golf hasta el hangar, hacia el Bar La Pista; la calle frente al Hotel Don Fito hasta la parte trasera de los Tribunales de Justicia; la calle desde los Tribunales de Justicia hasta el inmueble de la profesora Nombre49439; y el tramo frente a la casa de habitación de esa profesora, ubicada frente a la calle cantonal, hasta el Hotel y Restaurante Corcovado, frente a la ruta nacional número catorce. Indica que en múltiples oportunidades se ha dirigido a las autoridades competentes señaladas en el primer punto, sin obtener respuesta positiva (22 de setiembre, 27 de setiembre, 4 de octubre y 11 de octubre de 2022, el 6 de marzo y 19 de mayo de 2023, 11 de abril de 2024 ante la Municipalidad de Golfito y el 6 de marzo de 2023 ante el ARS Golfito del MS). Refiere que en el presente año se repitieron las mismas inundaciones en los lugares mencionados, lo cual le ha ocasionado graves perjuicios, incluyendo daños en dos propiedades de su titularidad, inscritas en el Registro Inmobiliario de Puntarenas bajo los folios reales números 53698-000, ubicada frente al hangar, y Telf3543, donde se encuentra el PANI. Acusa que la situación denunciada continúa, por lo que estima violados los derechos fundamentales de las sociedades amparadas. Solicita que se declare con lugar el recurso.

2.- Mediante resolución de la Presidencia de la Sala de las 19:07 horas de 10 de octubre de 2025, se dio curso al proceso y se requirió informe el director ejecutivo, el gerente de Conversación de Vías y Puentes y el director regional Nombre18209, todos del Conavi, el ministro de Obras Públicas y Transportes, el alcalde, el jefe de la Unidad Técnica de Gestión Vial (UTGV), el jefe de la Unidad Técnica de Gestión Ambiental y el coordinador del Comité Municipal de Emergencias, todos de la Municipalidad de Golfito, así como el director del Área Rectora de Salud de Golfito del Ministerio de Salud, sobre los hechos alegados por la parte recurrente.

3.- Por escrito incorporado al expediente digital el 21 de octubre de 2025, informan bajo juramento Nombre35264, Nombre35265 y Nombre49440, por su orden, alcalde, coordinador del Comité Municipal de Emergencias e ingeniero de la Gestión Técnica de Infraestructura Vial (GTIV), todos de la Municipalidad de Golfito. Explican: “PRIMERO: De lo manifestado por la amparada, debo indicar que desde años anteriores la municipalidad ha venido ejecutando acciones que den atención a la problemática del sitio en cuestión. SEGUNDO: Mediante el oficio AM-MG-O-0137-2023, de fecha 23 de marzo de 2023, se comunicó a la señora Nombre49435 el seguimiento dado a la reunión sostenida el 7 de marzo de 2023, en atención a la denuncia ambiental N.° 38363-2023 (SITADA), al informe MG-UGAM-INSP-16-2023, así como a los incidentes reportados al 911 y a la denuncia ambiental presentada ante la Contraloría Ambiental. En esa línea, la Alcaldía Municipal, en el oficio citado, señaló las gestiones realizadas en torno a los hechos denunciados. 1. El suscrito, inmediatamente se comunicó con el señor Nombre49441, enlace de Emergencias del MOPT y le solicitó personal para realizar trabajos de limpieza tipo manual, en el sistema de drenaje que se encuentra sedimentado sobre la Dirección1174# frente a la casa del Dr. ombre9091.. 2. Se le solicitó a la Ing. Nombre49442, personal de la cuadrilla de Aseo de Vías y Sitios Públicos para realizar los trabajos de limpieza requeridos en dicho barrió. 3. Se le solicitó al Ing. Nombre49440 (sic), hacer una inspección detallada y realizar todas las acciones necesarias que correspondan para brindar una pronta solución a dichas situación. 4. Se le solicitó a la Licda. Nombre49443, realizar las coordinaciones que correspondan y necesarias con Nombre49441 del MOPT y demás instituciones de competencia para brindar una solución pronta a dicha situación A continuación, se adjunta captura de la notificación del oficio AM-MG-O-0137-2023 a la señora Nombre49435 TERCERO: Sobre la problemática expuesta, obstrucción de las alcantarillas que cruzan la Ruta Nacional, es oportuno destacar que la Municipalidad en específico el departamento de la Gestión Técnica de Infraestructura Vial, NO TENEMOS la competencia para solucionar dicha problemática. Debe tenerse presente que las municipalidades solo brindan atención a rutas cantonales. Resulta oportuno mencionar el análisis técnico realizado por el ingeniero de la Gestión Técnica de Infraestructura Vial en su oficio OF- MG-UTG-343-12-2024. Expone literalmente lo siguiente: “(…) se determinó que desde la cuneta de los departamentos que se ubican detrás de los Tribunales de Justicia de Golfito que en apariencia es propietaria la señora Nombre49444 hasta el antiguo Hangar debe de notificarse ya que existen unos accesos con tubería o losas que no cumplen con el diámetro correspondiente para la cantidad de agua pluvial que discurre en dicha cuneta. Ahora bien, cabe señalar que eso no va a dar solución al problema de inundaciones frente a las Instalaciones del PANI hasta que no se atienda el tema de la RN 14 (…)”. La ruta nacional, RN 14, corresponde al MOPT dar atención y NO a la Municipalidad de Golfito. Después lo anteriormente expuesto, consta en el oficio OF- MG-UTG-343-12-2024 el compromiso municipal de dar atención a la problemática dentro de nuestras competencias, y es que desde la Gestión Técnica de Infraestructura Vial realizó una visita de campo para determinar la situación expuesta por la señora Nombre49445. CUARTO: La Municipalidad de Golfito y el Comité Municipal de emergencias, ha venido realizando gestiones desde el año 2023 que buscan la articulación con el CONAVI para dar atención a la problemática que expone la recurrente, prueba de ello son los siguientes correos electrónicos: (…) QUINTO: Consta también correo electrónico de febrero 2025, de la señora Nombre49435, dirigido a la coordinadora del comité municipal de emergencia, en el que agradece la atención de la emergencia presentada. Lo cual demuestra que la municipalidad y el comité municipal de emergencia da atención a la problemática dentro del marco de la ley. (…) SEXTO: Con referencia a lo anterior, en fecha 14 de febrero 2023, la municipalidad por medio del Comité Municipal de Emergencias coordinado en ese momento por el alcalde Nombre35264 emitió el informe de situación No CME-GOL-01 en referencia al tipo de evento hidrológico. En lo que interesa dicho informe reitera mediante fotografía la problemática de drenajes colapsados ruta 14 frente al PANI. SÉPTIMO: Conocemos quienes suscribimos que el Consejo Nacional de vialidad, comunicó a la señora Nombre49445 que, Dentro de las funciones y/o competencias de la Gerencia de Conservación de Vías y Puentes, se incluye la mejora de la capacidad hidráulica de los sistemas de drenaje pluvial dentro del derecho de la vía, así mismo informó que se realizaría la solicitud a la Gerencia de Conservación de Vías y Puentes, del contenido económico necesario, para reactivar la continuidad de la Contratación Directa 2022CD-000145-0006000001, Dirección2802, de manera tal que se puedan efectuar los estudios topográficos, hidrológicos y de diseño final del sistema de drenaje pluvial adecuado, ajustado a las condiciones de sitio y con la suficiente capacidad hidráulica, que permitan solventar la problemática a corto plazo. Actualmente la ejecución del contrato se encuentra suspendida, dado a que no se cuenta con el suficiente contenido económico para continuar con actividades de mantenimiento rutinario y periódico asociado a la mejora de los sistemas de drenaje pluvial, no obstante, se mantendrá dentro de las prioridades a ejecutar por parte de esta Ingeniería de Zona 4-3, durante el primer trimestre del año 2024. Lo anterior consta en el documento: DRB-03-2023-1286 (0659) del 27 de septiembre del 2023 OCTAVO: Es necesario hacer de conocimiento que, la Ing. Nombre49446, del Departamento de Dirección Obras Fluviales Región Pacífico Central y Sur identificó la problemática, como la salida de agua que cae al manglar que está completamente atascada de material de arrastre, lo que impide el flujo de agua, además la tubería pluvial no tiene salida al manglar, lo que provoca un rebalse. Dicho lo anterior, es importante recordar que el manglar es una zona protegida y que por consiguiente la Municipalidad no tiene la competencia ni aval jurídico para ingresar al mismo y realizar trabajos. Dado lo anterior el Comité Municipal de Emergencias mediante el oficio CME-GOL-004-2024 buscó un acercamiento con el diputado Nombre32892 con el objetivo de llevar a cabo una reunión con el fin de buscar soluciones a esta problemática. NOVENO: Finalmente, el Comité Municipal de Emergencias ha dado seguimiento a esta problemática, consta el oficio CME-GOL-005-2025 consulta realizada al ingeniero Nombre49447 de Gerencia de Conservación de Vías y Puentes, Ingeniero de Dirección2803–  (…) Realizadas las manifestaciones anteriores, se da por rendido el informe solicitado. Resulta oportuno solicitar que se declare sin lugar el recurso de amparo, tómese en consideración la aprueba aportada por este Ayuntamiento en la que se demuestra que la municipalidad de Golfito mediante el Comité Municipal de Emergencias coordinado por la señora Vice alcaldesa Nombre35265 se han realizado acciones previas a la interposición del presente recurso de amparo y que dichas acciones son acorde a las competencias del municipio, así mismo se demuestra la articulación con las instituciones correspondientes: Ministerio de Obras Públicas y Transportes, aguas fluviales, CONAVI”.

4.- Por escrito incorporado al expediente digital el 22 de octubre de 2025, informa bajo juramento Nombre48807, en su condición de director ejecutivo a.i. del Conavi. Menciona: “III. ATENCION DEL RECURSO POR EL FONDO Así las cosas, nos referiremos a lo correspondiente según el ámbito de competencias y funciones de este Consejo, así como a los hechos manifestados por la señora Nombre49435, hechos sobre los cuales se harán las respectivas manifestaciones: IV. CRONOLOGIA TECNICO-ADMNISTRATIVA Y GESTIONES REALIZADAS A continuación, se van a detallar cada una de las actividades y gestiones realizadas por mi representada, las cuales son relevantes para la atención del presente recurso de amparo: • El día 20 de marzo de 2023 – DRB-112-2023-0434: Se inspecciona (indique quien, cual Gerencia, o el CONAVI) el sector PANI–Poder Judicial, verificando sedimentos y agua estancada en drenajes transversales a la Dirección2804. Se concluye que una limpieza “extrema” sería ineficiente debido a la barrera natural de la marea y al aporte de sedimento arenoso desde el manglar. Se coordinó limpieza manual con apoyo del Cuerpo de Bomberos, pero fue infructuosa. Al respecto, es importante aclarar que CONAVI no ingresa a manglares y que las limpiezas en manglar no son competencia de CONAVI, debiendo articularse con la Municipalidad de Golfito y la Comisión Nacional de Emergencias (CNE) para lo correspondiente. • El día 27 de setiembre de 2023 – DRB-03-2023-1286 (0659): Se documenta la ubicación (Dirección2805, est. 24+500), tres alcantarillas de diámetro de 900 mm, con obstrucción por arena/ramas provenientes del manglar, se continúa presentando como problemática la barrera de marea alta que impide la evacuación de las aguas. Se advierte que trabajos municipales de pavimentación en las calles de Dirección2806 y alrededores, redujeron la infiltración natural del suelo y aumentaron las escorrentías superficiales hacia la Ruta Nacional N.°14, exacerbando la limitación hidráulica. • El día 01 de octubre de 2025 – CARTA-CONAVI-DRB-04-2025-0900 (0455): Se diferencia claramente la red vial cantonal (con evidencia de obstrucción por residuos asfálticos tras intervención municipal y falta de mantenimiento, se indica a la Municipalidad de Golfito la necesidad de proceder con una auscultación del sistema de drenaje municipal para detección de puntos de conflicto) de la alcantarilla de la Ruta Nacional N.°14 (km 24+878), cuya descarga directa a manglar sufre ingreso de sedimentos y limitación por la fluctuación de la marea. Se cita la Ley No. 6043 y su reglamento (D.E. 7841-P) y el Reglamento a la Ley Forestal (D.E. 36786-MINAET), resaltando que toda intervención en manglar requiere autorización del SINAC; por ello, CONAVI consulta formalmente al SINAC, mediante oficio CARTA-CONAVI- DRB-04- 2025-0901 (0475) específicamente al Área de Conservación de Osa, a la Ing. Nombre49448, Coordinadora Subregión Coto, para definir el procedimiento a seguir y la posible intervención por medio de otras instituciones con competencia adecuada ante la situación. De conformidad con lo anteriormente mencionado, se evidencia las gestiones realizadas por CONAVI, mediante las cuales se acredita que mi representanta ha venido atendiendo dentro de sus competencias, lo correspondiente para la situación alegada por la parte recurrente, todo lo cual se acreditará más adelante. V. CARACTERIZACION TECNICA DEL SISTEMA Y DEL FENOMENO HIDRAULICO El sistema de alcantarillado pluvial bajo responsabilidad de CONAVI corresponde a las alcantarillas transversales a la Dirección2804 con diámetro de 900 mm ubicadas entre est. 24+500 a 24+878, con descarga final hacia el sector manglar del Golfo Dulce, sector de Golfito. El derecho de vía de la sección de control es de 13,00–14,00 m, lo que limita las soluciones físicas in situ sin afectar márgenes ni zonas protegidas. En marea alta, el manglar funciona como barrera natural: el nivel piezométrico de salida supera el nivel de descarga de la alcantarilla, provocando un flujo con remanso y pérdida de gradiente, que retarda/impide la descarga. Se produce retorno hacia la entrada y sobreelevación de niveles en la red vial nacional, afectando calzada y zonas aledañas. Aun con limpiezas internas, la re–sedimentación por aporte de las fluctuaciones de la marea es rápida, provocando que la eficiencia de mantenimiento sea transitoria y no resuelve la causa raíz. La impermeabilización por pavimentación de las vías cantonales por parte de la Municipalidad de Golfito aumentó las escorrentías hacia la Red Vial Nacional (flujos con pendientes hacia la Ruta Nacional N.°14), agravando la sobrecarga hidráulica en un punto de descarga limitado por los efectos de la marea. Se observaron obstrucciones con residuos asfálticos en el sistema de alcantarillado cantonal y falta de mantenimiento. (…) VI. ALTERNATIVAS EVALUADAS Es importante señalar que la Gerencia de Gestión de Asuntos Jurídicos plantea las siguientes gestiones como medidas preventivas de atención a la situación que se presenta en el recurso de amparo, las cuales son: 1. Limpieza manual / a presión en alcantarillas de la Ruta Nacional N.°14: Ya implementada; ineficaz por reingreso de sedimento. Viable solo como paliativo puntual. 2. Aumento de diámetro/sustitución de tubería: No resuelve el control aguas abajo (fluctuación de la marea), el cuello de botella persiste, problemática de necesitar un nivel de desfogue más bajo por el aumento en el diámetro manteniendo constante la elevación de la parte superior de la alcantarilla por el paso de la ruta nacional; riesgo de transferir mayores volúmenes al manglar sin autorización. No recomendable sin análisis hidráulico y permisos ambientales. 3. Dragado del cauce en manglar: Técnica potencialmente eficaz para restituir cotas de nivel, pero fuera del alcance del CONAVI; requiere viabilidad ambiental y permiso SINAC/MINAE; posible liderazgo de SINAC/CNE/Municipalidad como entidades encargadas de la intervención. 4. Gestión en red cantonal: Auscultación y corrección de obstrucciones/deficiencias de la red pluvial municipal; control de sólidos y mejoras de puntos locales (rejillas, sumideros, disipadores). Trabajos fuera de los alcances del CONAVI. VII. COMPETENCIAS Y COORDINACION A continuación, se detallan cada una de gestiones a realizar por dependencia en el marco de sus competencias, todo en apego al principio de Legalidad y Coordinación institucional, tendiente a realizar las obras necesarias para la atención de la situación presentada en el recurso de amparo. (…) V. CONCLUSIONES Con fundamento en los oficios y actuaciones citadas, así como en la normativa técnica y en la legislación ambiental aplicable a manglares, zona marítimo terrestre y protección forestal; se ha acreditado que el CONAVI ha actuado conforme a derecho y a la técnica, dentro del marco de sus competencias, sin violentar derecho constitucional alguno, y a su vez, ha activado la coordinación con la autoridad ambiental competente (SINAC), para la eventual solución estructural en el receptor. En consecuencia, no se configura violación de derechos fundamentales atribuible al CONAVI. Finalmente, se aclara que la Gerencia de Conservación de Vías y Puentes del CONAVI se encuentra en trabajos de coordinación interinstitucional entre el SINAC/COMISION NACIONAL DE EMERGENCIAS Y LA MUNICIPALIDAD DE GOLFITO; acciones tendientes a la atención de la problemática presentada en el recurso de amparo. Por tanto, queda plenamente acreditado que este Consejo ha actuado conforme a derecho, en el marco de sus competencias legales y funcionales, realizando las gestiones pertinentes ante los requerimientos planteados, sin que se haya incurrido en conducta lesiva de derechos fundamentales. Así las cosas, se evidencia que ni este Consejo ni el suscrito han incurrido en violación alguna de derechos constitucionales del recurrente que deba ser atendida por esta Sala Constitucional. PETITORIA Por las razones de hecho y de derecho expuestas solicito a la honorable Sala Constitucional de la Corte Suprema de Justicia, se declare sin lugar el presente recurso de amparo y se absuelva al suscrito en calidades indicadas, de toda responsabilidad; así como al Consejo Nacional de Vialidad al cual represento. Asimismo, se solicita al actuar dentro del marco de la legalidad y buena fe no se realice condenatoria de daños ni costas alguna”.

5.- Por escrito incorporado al expediente digital el 22 de octubre de 2025, informa bajo juramento Nombre42179, en su condición de ministro del MOPT. Refiere: “A la fecha de emisión del presente oficio, no ha sido posible remitir el informe requerido por esa Honorable Sala, toda vez que el Consejo Nacional de Vialidad (CONAVI), órgano competente en la materia objeto del recurso, no ha brindado la información técnica ni administrativa necesaria para la debida elaboración del informe institucional. Cabe señalar que la información fue solicitada al CONAVI el día 17 de octubre de 2025, a las 11:59 horas, mediante el oficio N.° CARTA-MOPT-DAJ-2025-4604, sin que a la fecha se haya recibido respuesta sustantiva que permita al Ministerio atender adecuadamente el requerimiento de esa Sala. II. Competencia del CONAVI De conformidad con la Ley N.° 7798, de Creación del Consejo Nacional de Vialidad, corresponde a dicho órgano la ejecución y seguimiento de las acciones técnicas, contractuales y operativas vinculadas con la gestión planteada en el expediente de cita. En virtud de lo anterior, este Ministerio, en su condición de ente rector, carece de competencia directa para pronunciarse sobre aspectos que son de naturaleza exclusiva del CONAVI. III. Consideraciones finales Por las razones expuestas, y ante la falta de respuesta del órgano competente, el Ministerio de Obras Públicas y Transportes se ve imposibilitado de emitir el informe solicitado dentro del plazo conferido. En consecuencia, corresponde que el CONAVI, en su ámbito de competencia y conforme al principio de legalidad, remita directamente la información requerida a esa Sala Constitucional”.

6.- Por escrito incorporado al expediente digital el 23 de octubre de 2025, informa bajo juramento Nombre49449, en su condición de director del Área Rectora de Salud de Golfito del Ministerio de Salud. Expone: “De lo expuesto en los alegatos, según consta en el informe técnico de inspección MSDRRSBRU- DARS-G-IT-0923-2025, de fecha 21 de octubre de 2025, suscrito por el Ing. Nombre49450, Regulación de la Salud, Área Rectora de Salud de Golfito, realizó visita en el sitio, específicamente en Dirección2807, el día 20 de octubre de 2025 entre las 09:35 am y las 11:35 am, siendo atendido por el señor Nombre49451, de dicho informe se extrae que: “VI. RESULTADOS DE LA INSPECCION (HALLAZGOS) 1. La calle central, desde el costado norte del ICE hasta la entrada al antiguo Club de Golf: a. Tramo superior (parte más alta con relación a la topografía y relieve del terreno), ubicado en la parte norte del barrio las alamedas, según la descripción transcurre de este a oeste con pendiente regular, sin desniveles pronunciados, constituye una de las entradas. b. Dentro de una de las propiedades al costado norte, en la parte central del tramo, se observa un cabezal de inicio de alcantarillado de la red de evacuación pluvial, con una reja de metal que cubre parcialmente la boca de entrada, utilizada para retener residuos sólidos de origen vegetal (hojas, ramas y raíces) que son arrastrados por las corrientes de agua. c. Cordones de caño y cunetas en tierra, dirigidos hacia sistema de alcantarillado pluvial, se observan con maleza en algunos sectores, en partes obstruidos con residuos vegetales, en partes deformadas o indefinidas. d. La calle cuenta con capa asfáltica en buen estado. En el extremo oeste del tramo, se observa acumulación de arena que es arrastrada por las corrientes de agua desde las partes superiores. e. Obstrucción de desagües en los frentes de calle de propiedades, por falta de mantenimiento y obstrucciones con estructuras de acceso (rellenos, parrillas, losas de concreto). 2. La calle frente a la Dirección2801 hasta frente a la casa de Nombre49437: a. Tramo interno intermedio ubicado en las partes altas, según la descripción transcurre de oeste a este, con pendientes regulares sin desniveles pronunciados dirigidos hacia la parte centran del tramo (parte central es el desnivel más bajo). b. Se observan cajas de registro obstruidas incluso con la reja de protección caída dentro de la misma caja y acumulación de residuos vegetales. c. Cordones de caño y cunetas en tierra, dirigidos hacia sistema de alcantarillado pluvial, se observan con maleza en algunos sectores, en partes obstruidos con residuos vegetales, en partes deformadas o indefinidas. d. La calle cuenta con capa asfáltica en buen estado. e. Obstrucción de desagües en los frentes de calle de propiedades, por falta de mantenimiento y obstrucciones con estructuras de acceso (rellenos, parrillas, losas de concreto). 3. La calle frente a la casa Nombre49454, en el sector de la casa de Nombre49438 hasta la parte trasera del Hotel Don Fito: a. Tramo interno intermedio ubicado en las partes altas, según la descripción transcurre de este a oeste, con pendientes regulares sin desniveles pronunciados dirigidos hacia la parte este del tramo con los desniveles más bajos b. Se observan cajas de registro obstruidas con residuos vegetales, maleza y tierra. c. Cordones de caño y cunetas en tierra, dirigidos hacia sistema de alcantarillado pluvial, se observan con maleza en algunos sectores, en partes obstruidos con residuos vegetales, en partes deformadas o indefinidas. d. La calle cuenta con capa asfáltica en buen estado. e. Obstrucción de desagües en los frentes de calle de propiedades, por falta de mantenimiento y obstrucciones con estructuras de acceso (rellenos, parrillas, losas de concreto). 4. La calle desde el antiguo Club de Golf hasta el hangar, hacia el Bar La Pista: a. Tramo perpendicular, según la descripción transcurre del sector noreste a suroeste, con pendiente irregular en la parte media alta con desniveles pronunciados y plana en la parte media baja, constituye una de las salidas. b. Cordones de caño y cunetas en tierra, con corrientes dirigidas hacia sistema fluvial en el extremo suroeste, que lo constituye una quebrada entubada con alcantarilla aguas abajo a partir del punto de descarga. c. Cordones de caño y cunetas se observan con maleza en algunos sectores, en partes obstruidos con residuos vegetales. d. La calle cuenta con capa asfáltica. En el extremo oeste del tramo, en el cabezal de alcantarilla que conduce una quebrada, se observa socavamiento debajo de la capa asfáltica con afectación y daño en la mitad de la vía donde colocaron una barrera de plástico como protección preventiva. e. Obstrucción de desagües en los frentes de calle de propiedades, por falta de mantenimiento y obstrucciones con estructuras de acceso (rellenos, parrillas, losas de concreto). 5. La calle frente al Hotel Don Fito hasta la parte trasera de los Tribunales de Justicia: a. Tramo interno intermedio ubicado en las partes bajas, según la descripción transcurre de oeste a este, con pendientes regulares sin desniveles pronunciados dirigidos, corrientes dirigidas hacia la parte central del tramo con los desniveles más bajos. b. Se observan una caja de registro del alcantarillado de evacuación pluvial completamente obstruida con sedimentos de arena y tierra, con la reja de protección removida-expulsada por las mismas corrientes de agua. Hasta este punto las corrientes de agua que trascurren desde las partes altas tienen curso, pero no tienen continuidad, el ducto para continuidad de aguas abajo se encuentra completamente obstruido, por lo que las aguas se desbordan sobre la calle y propiedades. c. Se observan cajas de registro abiertas, ubicadas en la parte norte de la calle, otras con modificaciones por parte de vecinos que han colocado rejas de protección para evitar el ingreso de residuos sólidos vegetales. d. Cordones de caño y cunetas en tierra, dirigidos hacia sistema de alcantarillado pluvial, se mantienen con agua estancada, en partes obstruidos con residuos vegetales, en partes deformadas o indefinidas. e. La calle cuenta con capa asfáltica, en la parte de paso del alcantarillado pluvial con partes removidas por las corrientes de agua. f. Se observa afectación por corrientes de agua pluvial en la estructura de calle y propiedades, entre ellas la propiedad donde se ubican las instalaciones del Poder Judicial de Golfito, propiedad donde opera el PANI de Golfito y propiedades particulares con estructuras habitacionales. g. Obstrucción de desagües en los frentes de calle de propiedades, por falta de mantenimiento y obstrucciones con estructuras de acceso (rellenos, parrillas, losas de concreto). 6. La Dirección2808 hasta el inmueble de la profesora Nombre49439: a. Tramo extremo sur del Dirección2809, ubicado en la parte más baja, según la descripción transcurre de este a oeste, con pendiente regular plana, con corrientes dirigidas hacia la parte central del tramo con los desniveles más bajos. b. Colinda en la parte sur con la ruta nacional número catorce. c. Se observan cajas de registro, cordones de caño y cunetas revestidos con cemento, dirigidos hacia el sistema de alcantarillado pluvial con dos puntos de descarga, que se mantienen inundados. d. La calle cuenta con capa asfáltica, en buen estado. e. Se observa afectación por corrientes de agua pluvial en propiedades, entre ellas la propiedad donde se ubican las instalaciones del Poder Judicial de Golfito, propiedad donde opera el PANI de Golfito y propiedades particulares con estructuras habitacionales. f. Obstrucción de desagües en los frentes de calle de propiedades, por falta de mantenimiento y obstrucciones con estructuras de acceso (rellenos, parrillas, losas de concreto). 7. El tramo frente a la casa de habitación de dicha profesora, ubicada frente a la calle cantonal, hasta el Hotel y Restaurante Corcovado, frente a la ruta nacional número catorce: a. Tramo de la ruta nacional número catorce, ubicado en la parte más baja, según la descripción transcurre de este a oeste, con pendiente regular plana, con corrientes dirigidas hacia el extremo este con los desniveles más bajos. b. Colinda en la parte norte con el Dirección2809, en la parte sur con zona de manglar y litoral del Golfo Dulce. c. Contiene dos puntos de paso de paso de aguas y desfogue del alcantarillado pluvial que transcurren desde las partes más altas del barrio Las Alamedas. d. La altura sobre el nivel del mar se encuentra a menos de un metro, lo que implica que existe afectación de mareas. e. En ambos extremos del tramo de la ruta, las estructuras cordones, caños cunetas, alcantarillas se mantienen inundados, sin continuidad por taponamiento con sedimentos de lodo y arena. f. La descarga del sistema de alcantarillado pluvial se produce en el manglar en el extremo sur de la carretera y el alcantarillado desde el tramo anterior en la línea detrás de los Tribunales de Justicia se encuentra obstruida con sedimentos de lodo y arena, por lo que el curso de aguas no tiene continuidad. Además, que, el nivel de los puntos de descarga está debajo del nivel de la superficie del manglar y son inundados por las mareas altas. g. En los espacios inundados de las estructuras del sistema de evacuación pluvial por la influencia del entorno presenta fauna propia de manglar siendo visibles peces y tortugas de agua dulce (un nido de tortugas de más de treinta individuos saludables). h. La calle cuenta con capa asfáltica, en buen estado, con transito regular. i. Obstrucción de desagües en los frentes de calle de propiedades, por falta de mantenimiento y obstrucciones con estructuras de acceso (rellenos, parrillas, losas de concreto). VII. OBSERVACIONES 1. La ubicación de las acciones y hechos alegados por la recurrente, se ubican en el barrio Las Alamedas, ubicado en la Ciudad de Golfito, distrito Golfito, cantón Golfito, provincia Puntarenas; en la red de calles internas del barrio que corresponden a sectores o secciones de la red de rutas cantonales y una sección de la ruta nacional número 14. 2. Las acciones y hechos alegados en el recurso corresponden a afectaciones en la red de calles en el barrio las alamedas debido a drenajes insuficientes, cunetas en mal estado y obstruidas, caños y cajas de registro deterioradas, así como acumulación de residuos, con impacto en propiedades y estructuras. 3. La Ciudad de Golfito está constituida como ciudad puerto, ciudad litoral o ciudad costera, lo que implica que existe colindancia marina e interacciones entre la tierra y el mar. 4. El barrio Las Alamedas, presenta redes de calles, cunetas, estructuras de alcantarillado pluvial y fluvial, alcantarillado sanitario y edificaciones desde épocas de la compañía bananera en la zona, con antigüedad superior a ochenta años y sin modificaciones sustanciales. 5. El sistema de alcantarillado pluvial pasa entre las propiedades y por debajo de estructuras, por la antigüedad y al ser instalado por la compañía bananera que radicaba en la zona, en su momento, dueña de las propiedades. 6. Los puntos de descarga de los sistemas de alcantarillado pluvial, fluvial y sanitario son directamente al mar, en sectores de manglar, con presencia de fauna propia de esos sitios, en este caso peces y tortugas de agua dulce. 7. El barrio las alamedas presenta distintos desniveles sobre el nivel del mar, que van entre los cero metros y veinte metros, con afectación de mareas en las partes más bajas. VIII. CONCLUSIONES Conforme lo verificado, de los hechos alegados por la recurrente se logra evidenciar que existen limitaciones en las redes de evacuación pluvial existentes en el barrio Las Alamedas de la Ciudad de Golfito, relativas a diseño, conformación, mantenimiento y adecuación a las capacidades requeridas como acciones preventivas y correctivas. Se logra evidenciar ausencia de caños y cunetas revestidos, control deficiente de maleza y residuos vegetales en los desagües en rondas de calles y frente de propiedades, falta de mantenimiento de rondas y frentes de calle de propiedades, obstrucciones en desagües en entradas de propiedades, ausencia de tapas de cajas de registro y rejas de protección en aberturas del sistema de alcantarillado, daños de la capa asfáltica en sectores de la calle de ruta cantonal (paso de alcantarilla en la línea detrás de los Tribunales de Justicia y paso de alcantarilla contiguo al Dirección2810), tramos del alcantarillado pluvial completamente obstruido con sedimentos de lodo y arena, partes inundadas en los sectores bajos, puntos de descarga en área de manglar obstruidos e inundados y con presencia de fauna (peces y tortugas de agua dulce), impactos en propiedades y estructuras, entre ellas las propiedades e instalaciones donde operan Los Tribunales de Justicia de Golfito, el PANI, propiedades y estructuras habitacionales particulares. Con responsabilidad de acciones en estos sistemas de evacuación pluvial intervienen los titulares de propiedades sobre los frentes de calle y entradas de cada inmueble, la Municipalidad de Golfito en la red de calles de rutas cantonales y red de evacuación pluvial, autoridades del Ministerio de Obras Públicas y Transportes sobre acciones en el tramo de la Dirección2811 en espacial los pasos de aguas y puntos de descarga, y autoridades competentes del Ministerio de Ambiente y Energía sobre las descargas en zona de manglar, posible canalización y reubicación de fauna; aspectos que deben ser valorados. Por parte del Ministerio de Salud – Dirección Área Rectora de Salud de Golfito, se procederá a analizar las competencias de cada institución citada y en caso de ser necesario se emitirán los actos administrativos con las acciones tendentes a las correcciones que le corresponda a cada una. (sic). Por otra parte, sobre lo alegado por la recurrente, con respecto a que: “…que en múltiples oportunidades se ha dirigido a las autoridades competentes señaladas en el primer punto, sin obtener respuesta positiva (22 de setiembre, 27 de setiembre, 4 de octubre y 11 de octubre de 2022, el 6 de marzo y 19 de mayo de 2023, 11 de abril de 2024 ante la Municipalidad de Golfito”, “Por oficio AM-MG-O-0137-2023 del 23 de marzo de 2023, el entonces alcalde de Golfito, le comentó de las gestiones realizadas afecto de brindarle una solución, en cuenta comunicaciones con el MOPT, solicitud de trabajos de limpieza de tipo manual, trabajos de mi pieza, inspecciones, y coordinaciones con otras instituciones ara buscar una solución”, “Por oficio DRB-03-2023-1286 (0659) del 27 de setiembre de 2023, el ingeniero de Zona 4-3 Sur- Sur de la Gerencia de Conservación de Vías y Puentes del CONAVI le dio respuesta a su gestión indicándole que solicitaría a la gerencia el contenido económico necesario para reactivar una contratación directa de manera que se “puedan efectuar los estudios topográficos, hidrológicos y de diseño final del sistema de drenaje pluvial adecuado, ajustado a las condiciones de sitio” (sic), es importante indicar que este es un tema propio de la Municipalidad de Golfito y del CONAVI, por lo anterior, siendo que, no es competencia del Ministerio de Salud, no me puedo referir sobre este punto, asimismo, no consta documentación en esta Área Rectora sobre lo alegado por la recurrente. Es claro que la Dirección del Área Rectora de Salud de Golfito ha realizado todas las acciones necesarias dentro del ámbito de sus competencias para atender la situación, en cumplimiento de la normativa sanitaria vigente, por lo que, en atención de la denuncia se realizó visita de inspección en el lugar, y mediante el informe técnico MS-DRRSBRU-DARS-G-IT-0923- 2025, el Área Rectora de Salud de Golfito evidenció las condiciones denunciadas, por lo que, esta Área Rectora de Salud procederá a analizar las competencias de cada institución y en caso de ser necesario se emitirán los actos administrativos con las acciones tendentes a las correcciones que le corresponda a cada una. Por lo anterior expuesto, ha quedado demostrado que las actuaciones de la Dirección del Área Rectora de Salud de Golfito fueron realizadas en estricto apego de sus funciones, de manera eficiente y diligente, en acatamiento de la normativa vigente (…) 3. Petitoria Como ha quedado expuesto y como se desprende de la prueba aportada, esta Área Rectora de Salud ha abordado el caso oportuna y adecuadamente en el marco de las competencias legales garantizando el debido proceso. Debido a lo anterior solicito de la manera más respetuosa a la Sala Constitucional, que en lo que a mí respecta y en lo que respecta al Ministerio de Salud, sea declarado sin lugar el presente recurso”.

7.- Por escrito incorporado al expediente digital el 23 de octubre de 2025, informa bajo juramento Nombre42179, en su condición de ministro del MOPT. Menciona: “I. Sobre la entrega extemporánea del informe El Ministerio de Obras Públicas y Transportes procedió oportunamente a solicitar al Consejo Nacional de Vialidad (CONAVI) la información técnica y administrativa necesaria para atender lo ordenado por esa Sala, mediante oficio N° CARTA-MOPTDAJ- 2025-4604, del 17 de octubre de 2025, a las 11:59 horas. No obstante, el CONAVI remitió su respuesta por correo electrónico a las 20:27 horas, mediante oficio N° DIE-17-2025-1340 (0139), de fecha 21 de octubre de 2025, esto es, posteriormente al vencimiento del plazo otorgado a este Ministerio para rendir el informe respectivo. II. Presentación del informe ministerial Cabe indicar que, ayer mismo, al ser las 21:25 horas, se presentó ante esa Honorable Sala el informe N° CARTA-MOPT-DM-2025-2079, elaborado con base en la información disponible hasta ese momento y en la documentación de apoyo generada por la Dirección Jurídica. En virtud de que posteriormente el CONAVI remitió su informe técnico (DIE-17- 2025-1340 (0139)), se procede ahora a ponerlo en conocimiento de esa Sala, como complemento del informe ministerial ya presentado. III. Contenido del informe del CONAVI El oficio DIE-17-2025-1340 (0139) detalla las actuaciones técnicas y administrativas realizadas por el CONAVI respecto a las afectaciones viales en el Dirección2800, incluyendo inspecciones en campo, coordinaciones con la Municipalidad de Golfito, la Comisión Nacional de Emergencias y el SINAC, así como la descripción del fenómeno hidráulico y las limitaciones derivadas de la influencia de la marea sobre el drenaje pluvial de la Ruta Nacional N° 14. complejidad técnica y ambiental de la zona, y no a una omisión o desobediencia institucional. IV. Consideraciones del Ministerio Este Ministerio lamenta la presentación extemporánea del informe y aclara que dicha situación se debió a causas ajenas a su voluntad, al depender de la información técnica que debía ser elaborada y remitida por el CONAVI, órgano competente según la Ley N° 7798. Una vez recibido el informe del CONAVI, el MOPT procede de inmediato a remitirlo a esa Honorable Sala, en aras de mantener la transparencia, el cumplimiento institucional y el respeto al principio de colaboración entre poderes públicos. V. Petitoria Con base en lo anterior, se solicita respetuosamente a esa Sala: 1. Tener por presentado extemporáneamente el informe complementario, con la justificación antes señalada. 2. Incorporar al expediente judicial el oficio N° DIE-17-2025-1340 (0139) emitido por el CONAVI, así como sus anexos técnicos. 3. Considerar cumplido el requerimiento de información, en tanto se ha atendido integralmente lo dispuesto en la resolución de las 19:07 horas del 10 de octubre de 2025”.

8.- Por escrito incorporado al expediente digital el 27 de octubre de 2025, informan bajo juramento Nombre35265 y Nombre49440, por su orden, vicealcaldesa en calidad de apoyo en el Departamento de Gestión Ambiental e ingeniero de la GTIV, ambos de la Municipalidad de Golfito. Explican: “Precisando de una vez informamos que actualmente la Municipalidad de Golfito no cuenta con nombramiento vigente de encargado del Departamento de Gestión Ambiental. Por tal motivo, mi persona como vice alcaldesa ha estado brindando apoyo y orientación a los funcionarios de dicho de departamento en labores operativas y administrativas en los asuntos que así lo ameriten. Sin embrago (sic), debo indicar que no soy profesional en área de gestión ambiental, razón por la cual no me es posible emitir informes técnicos relacionados con la problemática en cuestión. Realizada la aclaración anterior quienes suscribimos, manifestamos que ya hemos rendido informe dando atención a la audiencia conferida de las 19:07 del 10 de octubre del 2025. Dicho informe se encuentra firmado por el alcalde, la suscrita Nombre35265 y el suscrito Nombre49440, el mismo fue incorporado en el legajo electrónico en fecha 21 de octubre 2025”.

9.- Mediante constancia suscrita el 29 de octubre de 2025 por la secretaria a.i. y el técnico judicial 3, ambos de la Sala Constitucional, se indica que: “revisado, a las catorce horas cincuenta y uno minutos del veintinueve de octubre de dos mil veinticinco, en el sistema costarricense de gestión de despachos judiciales el control de documentos recibidos y este expediente, no apareció que del 23/10/2025 al 27/10/2025, el JEFE DE LA UNIDAD TÉCNICA DE GESTIÓN AMBIENTAL DE LA MUNICIPALIDAD DE GOLFITO haya presentado escrito o documento alguno, a fin de rendir el informe que se le solicitó en la resolución dictada a las diecinueve horas siete minutos del diez de octubre de dos mil veinticinco”.

10.- Mediante constancia suscrita el 29 de octubre de 2025 por la secretaria a.i. y el técnico judicial 3, ambos de la Sala Constitucional, se indica que: “revisado, a las catorce horas cincuenta y cinco minutos del veintinueve de octubre de dos mil veinticinco, en el sistema costarricense de gestión de despachos judiciales el control de documentos recibidos y este expediente, no apareció que del 22/10/2025 al 24/10/2025, el DIRECTOR REGIONAL Nombre49453 haya presentado escrito o documento alguno, a fin de rendir el informe que se le solicitó en la resolución dictada a las diecinueve horas siete minutos del diez de octubre de dos mil veinticinco”.

11.- Mediante constancia suscrita el 29 de octubre de 2025 por la secretaria a.i. y el técnico judicial 3, ambos de la Sala Constitucional, se indica que: “revisado, a las catorce horas cincuenta y nueve minutos del veintinueve de octubre de dos mil veinticinco, en el sistema costarricense de gestión de despachos judiciales el control de documentos recibidos y este expediente, no apareció que del 16/10/2025 al 21/10/2025, el GERENTE DE CONSERVACIÓN DE VÍAS Y PUENTES DEL CONAVI haya presentado escrito o documento alguno, a fin de rendir el informe que se le solicitó en la resolución dictada a las diecinueve horas siete minutos del diez de octubre de dos mil veinticinco”.

12.- En los procedimientos seguidos se han observado las prescripciones legales.

 Redacta el Magistrado Nombre41880; y,

Considerando:

I.- CUESTIONES PREVIAS. Primeramente, debe aclararse que, a partir de la sentencia nro. 2008-02545 de las 08:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contenciosa‑administrativa aquellos asuntos, en los que se discute si la Administración Pública ha cumplido o no los plazos fijados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales en los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo ‑instruido de oficio o a instancia de parte‑ o conocer de los recursos administrativos correspondientes. Sin embargo, también ha contemplado casos de excepción a lo anterior, como sucede en la especie, toda vez que el agravio se refiere a presuntas denuncias sobre situaciones que ponen en riesgo la vida e integridad física de la persona adulta mayor amparada. En este tipo de materia, la jurisprudencia constitucional ha estimado procedente la aplicación del control de constitucionalidad, de modo que se procede a resolver el sub iudice.

De segundo, en vista de que el gerente de Conservación de Vías y Puentes y el director regional Nombre18209, ambos del Conavi, así como el jefe de la UTGA de la Municipalidad de Golfito, omitieron contestar la audiencia dentro del plazo fijado por este Tribunal en la resolución de curso del sub lite, se procede a resolver el recurso de acuerdo con el artículo 45 de la Ley de la Jurisdicción Constitucional y tomando en consideración los elementos probatorios que constan en los autos

II-. OBJETO DEL RECURSO. La recurrente, quien es una persona adulta mayor, refiere que desde el año 2022, durante la época lluviosa, se producen inundaciones en el barrio Alamedas de Golfito, debido a drenajes insuficientes, cunetas en mal estado y obstruidas, caños y cajas de registro deterioradas, así como acumulación de basura. Señala que como consecuencia se han destruido varias calles cantonales y una ruta nacional, a saber: la calle central, desde el costado norte del ICE hasta la entrada al antiguo Club de Golf; la calle frente a la Dirección2801 hasta frente a la casa de Nombre49437; la calle frente a la casa Nombre49454, en el sector de la casa de Nombre49438 hasta la parte trasera del Hotel Don Fito; la calle desde el antiguo Club de Golf hasta el hangar, hacia el Bar La Pista; la calle frente al Hotel Don Fito hasta la parte trasera de los Tribunales de Justicia; la calle desde los Tribunales de Justicia hasta el inmueble de la profesora Nombre49439; así como el tramo frente a la casa de habitación de esa profesora, ubicada frente a la calle cantonal, hasta el Hotel y Restaurante Corcovado, frente a la ruta nacional número catorce. Indica que en múltiples oportunidades se ha dirigido a las autoridades competentes; empero, la situación denunciada continúa y ha generado daños a dos de sus propiedades.

III.- HECHOS PROBADOS. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

a)   La amparada es una persona adulta mayor de 67 años. (Ver página web del Tribunal Supremo de Elecciones).

b)   Por oficio fechado 22 de setiembre de 2022, la tutelada comunicó a la Municipalidad de Golfito que la alcantarilla ubicada frente a la casa del Nombre4495 está totalmente llena de material y provoca inundaciones. (Ver prueba documental).

c)    Por escrito fechado 26 de setiembre de 2022, la tutelada requirió al gobierno local recurrido la limpieza de las alcantarillas del Barrio Alamedas. (Ver prueba documental).

d)   Mediante escrito fechado 4 de octubre de 2022, la recurrente solicitó ante la corporación local de Golfito la intervención de las alcantarillas del Dirección2806, debido a que tienen problemas de atascamientos. (Ver prueba documental).

e)    Mediante oficio fechado 11 de octubre de 2022, la amparada reclamó la obstrucción de las alcantarillas del Barrio Alamedas, lo que genera inundaciones. (Ver prueba documental).

f)     Por memorial fechado 6 de marzo de 2023, la accionante denunció ante la Municipalidad de Golfito que en el barrio Alamedas se producen inundaciones por la saturación del alcantarillado, incluso la que pasa frente a la casa de Nombre49452 “tiene aguas negras y están estancadas”. (Ver prueba documental).

g)   Mediante escrito con sello de recibido del Ministerio de Salud del 6 de marzo de 2023, la accionante denunció que en el Dirección2806 la alcantarilla frente a la casa de Nombre49452 está atascada con sedimentos de arena, barro y agua sucia que no fluye; incluso, hay residuos de aguas negras. (Ver prueba documental).

h)   Por memorial DRB-112-2023-0434 del 20 de marzo de 2023, la Gerencia de Conservación de Vías y Puentes indicó a la Municipalidad de Golfito: “De acuerdo a (sic) la inspección realizada en el sector, se observó la presencia de grandes cantidades de sedimento y agua estancada en las estructuras de drenaje pluvial que atraviesan la Ruta Nacional N° 14, específicamente cerca de la sede del Poder Judicial y el PANI, así como en la intersección hacia el Depósito Libre Comercial Golfito; estructuras que en principio se supondría que se les debe realizar una limpieza extrema, sin embargo, se ha definido que no existe la posibilidad de hacerlo de manera eficiente, daba (sic) la cercanía con el manglar, toda vez que al aumentar la marea, se presenta una barrera natural para la salida óptima del agua pluvial que baja de las montañas y de los edificaciones del Dirección2806, además esta presencia de marea, genera un efecto de ingreso de sedimento arenoso a la estructura. Es importante manifestar, que esta Ingeniería de Dirección2812 tiene competencias directas en atender la infraestructura vial en el derecho de la vía, y no precisamente ingresar a manglares a realizar limpiezas de sedimentos, función que se presume, corresponde a una coordinación institucional entre la Municipalidad de Golfito y la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias. Se menciona que durante el día 17 de Marzo del 2023, con la vigente denominada Contratación Directa 2022CD-000063-0006000001 “Mantenimiento básico de la Red Vial Nacional Pavimentada”, se trató de realizar una limpieza del sedimento de manera manual y con ayuda de la Unidad del Benemérito Cuerpo de Bomberos, no obstante, los esfuerzos resultaron en vano, dada la complejidad y acumulación de sedimento y agua de mar estancada; situación que esta Ingeniería de Zona 4-3, evaluará a corto plazo como atender y brindar la solución más óptima a los habitantes del sector y a los usuarios de la vía, de conformidad a las competencias que rigen el mantenimiento y conservación de los drenajes pluviales en vías nacionales (…)”. (Ver prueba documental).

i)     Mediante oficio AM-MG-O-0137-2023 del 23 de marzo de 2023, la Municipalidad de Golfito comunicó a la tutelada: “1. El suscrito, inmediatamente se comunicó con el señor Nombre49441, enlace de Emergencias del MOPT y le solicitó personal para realizar trabajos de limpieza tipo manual, en el sistema de drenaje que se encuentra sedimentado sobre la Dirección1174# frente a la casa del Nombre4495. 2. Se le solicitó a la Ing. Nombre49442, personal de la cuadrilla de Aseo de Vías y Sitios Públicos para realizar los trabajos de limpieza requeridos en dicho barrió (sic). 3. Se le solicitó al Ing. Nombre49440 (sic), hacer una inspección detallada y realizar todas las acciones necesarias que correspondan para brindar una pronta solución a dichas situación. 4. Se le solicitó a la Licda. Nombre49443, realizar las coordinaciones que correspondan y necesarias con Nombre49441 del MOPT y demás instituciones de competencia para brindar una solución pronta a dicha situación”. j)     Mediante oficio fechado 20 de mayo de 2023, la recurrente indicó a la Municipalidad de Golfito que echa de menos el seguimiento del caso y requirió la limpieza de los caños. (Ver prueba documental).

k)    Mediante oficio DRB-03-2023-1286 (0659) del 27 de setiembre de 2023, el Conavi comunicó a la amparada: “Conclusiones De acuerdo con la inspección realizada en sitio, se concluye lo siguiente:  Se identifica que los tres sistemas de drenaje pluvial, cuentan con un diámetro interno de 900 mm, el cual, en su punto de desfogue final, presenta acumulación de sedimento proveniente por el aumento de la marea, lo que obstruye la evacuación continua del agua pluvial.  No resulta favorable realizar la limpieza de los sedimentos de los drenajes pluviales de manera manual, toda vez que cuando aumenta el nivel de marea, los sedimentos vuelven a ingresar hacia el sistema de drenaje y se obstruye nuevamente.  Se realizará mediante el procedimiento denominado: Contratación Directa 2022CD-000145- 0006000001, Dirección2813, adjudicado al contratista Quebradores del Sur S.A., los estudios topográficos e hidrológicos necesarios, para realizar los respectivos diseños de drenajes pluviales, ajustados a las condiciones de sitio y con la suficiente capacidad hidráulica, que permitan solventar la problemática a corto plazo. Actualmente la ejecución del contrato se encuentra suspendida, dado a que no se cuenta con el suficiente contenido económico para continuar con actividades de mantenimiento rutinario y periódico asociado a la mejora de los sistemas de drenaje pluvial, no obstante, se mantendrá dentro de las prioridades a ejecutar por parte de esta Ingeniería de Zona 4-3, durante el primer trimestre del año 2024.  Dentro de las funciones y/o competencias de la Gerencia de Conservación de Vías y Puentes, se incluye la mejora de la capacidad hidráulica de los sistemas de drenaje pluvial dentro del derecho de la vía, no así de ejecutar trabajos dentro del manglar, dado a corresponden a otras instituciones, sea la Municipalidad de Golfito y/o la Comisión Nacional para la Prevención de Riesgos y Atención de Emergencias (CNE), gestionar este tipo de limpiezas dentro de sus competencias. Recomendaciones  Se realizará por parte de esta Ingeniería de Dirección2812, la solicitud a la Gerencia de Conservación de Vías y Puentes, del contenido económico necesario, para reactivar la continuidad de la Contratación Directa 2022CD-000145-0006000001, Dirección2802, de manera tal que se puedan efectuar los estudios topográficos, hidrológicos y de diseño final del sistema de drenaje pluvial adecuado, ajustado a las condiciones de sitio”. l)     Por oficio CME-GOL-004-2024 del 6 de marzo de 2024, el alcalde de Golfito requirió a un diputado de la República convocar a una mesa de diálogo con el CNE, MOPT, MINAE, Conavi, SINAC y los Tribunales de Justicia de Golfito para abordar la problemática de las inundaciones acaecidas en los últimos años. (Ver prueba documental).

m) Mediante memorial OF-MG-UTG-343-12-2024 del 3 de diciembre de 2024, la Unidad Técnica de Gestión Vial de Golfito comunicó a la vicealcaldesa en relación con el caso de la amparada que existen accesos con tubería o losas que no cumplen el diámetro correspondiente para la cantidad de agua pluvial que discurren, por lo que se inició el proceso de identificación de los propietarios para concederles un plazo prudencial para su reemplazo. Además, se indicó que la limpieza de las cunetas se incluirá en la programación trimestral del 2025. Asimismo, se aclaró que ello no solucionaría la problemática hasta tanto se atienda lo concerniente a la Dirección2814. (Ver prueba documental).

n)   Por memorial CME-GOL-005-2025 del 5 de febrero de 2025, el Comité Municipal de Emergencias de Golfito consultó a la Gerencia de Conservación de Vías y Puentes por el estado del caso de la tutelada. (Ver prueba documental).

o)   Por oficio CARTA-CONAVI-DRB-04-2025-0900 (0455) del 1° de octubre de 2025, la Gerencia de Conservación de Vías y Puentes del Conavi indicó a un síndico del Concejo Distrital de Golfito en relación con la limpieza de la alcantarilla de Barrio Alamedas: “Como parte del seguimiento a esta gestión, el pasado 12 de agosto se coordinó una inspección en sitio. En dicha visita se verificó que las imágenes adjuntas al oficio municipal corresponden a un sistema de alcantarillado perteneciente a una calle cantonal paralela a la Dirección1174, tal y como se aprecia en la Figura 1. Por lo tanto, el mantenimiento de esa infraestructura recae dentro del ámbito de competencias de la Municipalidad, no del CONAVI. Durante el recorrido y conversaciones con vecinos, se indicó que las dificultades observadas habrían aumentado tras la intervención de la capa asfáltica realizada por la Municipalidad hace aproximadamente dos años. Se identificó la posibilidad de que residuos de dichas obras hayan ocasionado obstrucciones en el sistema, lo que fue corroborado visualmente. En consecuencia, se recomienda a la Municipalidad de Golfito realizar una auscultación del sistema pluvial cantonal a fin de aplicar las correcciones que correspondan. En cuanto a la infraestructura bajo responsabilidad de CONAVI, se determinó que la alcantarilla más cercana sobre la Dirección2815 se encuentra en el km 24+878. Esta estructura descarga directamente hacia un ecosistema de manglar, donde la dinámica de mareas provoca ingreso de sedimentos y limita la evacuación óptima de las aguas pluviales (…) Cabe recordar que la atención directa de obras dentro de un manglar no corresponde a las competencias de esta Ingeniería de Zona 4-3, dado que por su protección están fuera de nuestro alcance. Por tratarse de un ecosistema protegido por ley, cualquier intervención requiere la autorización del Sistema Nacional de Áreas de Conservación (SINAC). En virtud de lo anterior, se realiza la consulta con el Área de Conservación de Osa del SINAC, a fin de definir el procedimiento técnico y legal aplicable para este tipo de infraestructura en zona protegida”. (Ver prueba documental).

p)   Mediante oficio CARTA-CONAVI-DRB-04-2025-0901 (0475) del 1° de octubre de 2025, la Gerencia de Conservación de Vías y Puentes comunicó al Área de Conservación de Osa del Sistema Nacional de Áreas de Conservación: “Por este medio, la Ingeniería de Zona 4-3 del Consejo Nacional de Vialidad (CONAVI) se permite realizar la presente consulta respecto a la alcantarilla ubicada en la Ruta Nacional No 14, sección de control 60252, en el Dirección2816, cuya descarga desemboca directamente en un ecosistema de manglar. Durante labores de inspección y mantenimiento se ha detectado la necesidad de ejecutar trabajos de limpieza y desobstrucción en dicha estructura, a fin de garantizar el adecuado drenaje pluvial y la seguridad de la vía. No obstante, siendo el manglar un ecosistema protegido por ley, comprendemos que cualquier acción que pueda implicar afectación directa o indirecta debe contar con la debida autorización de la autoridad ambiental competente. En atención a lo dispuesto en la Ley de la Zona Marítimo Terrestre (Ley N.º 6043), su Reglamento (Decreto Ejecutivo N.º 7841-P) y la Ley Forestal (Ley N.º 7575) solicitamos respetuosamente a esta Coordinación Regional del SINAC nos indique el procedimiento a seguir, los requisitos técnicos y legales, para proceder de conformidad con la normativa vigente”. q)   El 15 de octubre de 2025, el director ejecutivo del Conavi y el gerente de Conservación de Vías y Puentes fueron notificados de la resolución de curso de este proceso. (Ver actas de notificación).

r)    El 16 de octubre de 2025, el ministro del MOPT fue notificado de la resolución de curso de este proceso. (Ver acta de notificación).

s)    El 17 de octubre de 2025, el alcalde y el coordinador del CME, ambos de Golfito, así como el director del Área Rectora de Salud de Golfito fueron notificados de la resolución de curso de este proceso. (Ver actas de notificación).

t)     El 21 de octubre de 2025, el director regional Nombre49453 fue notificado de la resolución de curso de este proceso. (Ver acta de notificación).

u)   El 21 de octubre de 2025, el Ministerio de Salud emitió el informe técnico de inspección MS-DRRSBRU-DARS-G-IT-0923-2025, por medio del cual se indicó: “se logra evidenciar que existen limitaciones en las redes de evacuación pluvial existentes en el Dirección2809 de la Ciudad de Golfito, relativas a diseño, conformación, mantenimiento y adecuación a las capacidades requeridas como acciones preventivas y correctivas. Se logra evidenciar ausencia de caños y cunetas revestidos, control deficiente de maleza y residuos vegetales en los desagües en rondas de calles y frente de propiedades, falta de mantenimiento de rondas y frentes de calle de propiedades, obstrucciones en desagües en entradas de propiedades, ausencia de tapas de cajas de registro y rejas de protección en aberturas del sistema de alcantarillado, daños de la capa asfáltica en sectores de la calle de ruta cantonal (paso de alcantarilla en la línea detrás de los Tribunales de Justicia y paso de alcantarilla contiguo al Dirección2810), tramos del alcantarillado pluvial completamente obstruido con sedimentos de lodo y arena, partes inundadas en los sectores bajos, puntos de descarga en área de manglar obstruidos e inundados y con presencia de fauna (peces y tortugas de agua dulce), impactos en propiedades y estructuras, entre ellas las propiedades e instalaciones donde operan Los Tribunales de Justicia de Golfito, el PANI, propiedades y estructuras habitacionales particulares. Con responsabilidad de acciones en estos sistemas de evacuación pluvial intervienen los titulares de propiedades sobre los frentes de calle y entradas de cada inmueble, la Municipalidad de Golfito en la red de calles de rutas cantonales y red de evacuación pluvial, autoridades del Ministerio de Obras Públicas y Transportes sobre acciones en el tramo de la Ruta Nacional número 14 en espacial los pasos de aguas y puntos de descarga, y autoridades competentes del Ministerio de Ambiente y Energía sobre las descargas en zona de manglar, posible canalización y reubicación de fauna; aspectos que deben ser valorados. Por parte del Ministerio de Salud – Dirección Área Rectora de Salud de Golfito, se procederá a analizar las competencias de cada institución citada y en caso de ser necesario se emitirán los actos administrativos con las acciones tendentes a las correcciones que le corresponda a cada una”. v)   El 22 de octubre de 2025, el jefe de la UTGA de la Municipalidad de Golfito fue notificado de la resolución de curso de este proceso. (Ver acta de notificación).

w) El 22 de octubre de 2025, el jefe de la UTGV de la Municipalidad de Golfito fue notificado de la resolución de curso de este proceso. (Ver acta de notificación).

IV.- SOBRE EL CASO CONCRETO. En el sub lite, la recurrente, quien es una persona adulta mayor, refiere que desde el año 2022, durante la época lluviosa, se producen inundaciones en el barrio Alamedas de Golfito, debido a drenajes insuficientes, cunetas en mal estado y obstruidas, caños y cajas de registro deterioradas, así como acumulación de basura. Señala que como consecuencia se han destruido varias calles cantonales y una ruta nacional, a saber: la calle central, desde el costado norte del ICE hasta la entrada al antiguo Club de Golf; la calle frente a la Dirección2801 hasta frente a la casa de Nombre49437; la calle frente a la casa Nombre49454, en el sector de la casa de Nombre49438 hasta la parte trasera del Hotel Don Fito; la calle desde el antiguo Club de Golf hasta el hangar, hacia el Bar La Pista; la calle frente al Hotel Don Fito hasta la parte trasera de los Tribunales de Justicia; la calle desde los Tribunales de Justicia hasta el inmueble de la profesora Nombre49439; así como el tramo frente a la casa de habitación de esa profesora, ubicada frente a la calle cantonal, hasta el Hotel y Restaurante Corcovado, frente a la ruta nacional número catorce. Indica que en múltiples oportunidades se ha dirigido a las autoridades competentes; empero, la situación denunciada continúa y ha generado daños a dos de sus propiedades.

La sala verifica que la amparada es una persona adulta mayor de 67 años. Por oficio fechado 22 de setiembre de 2022, la tutelada comunicó a la Municipalidad de Golfito que la alcantarilla ubicada frente a la casa del Nombre4495 está totalmente llena de material y provoca inundaciones. Por escrito fechado 26 de setiembre de 2022, la tutelada requirió al gobierno local recurrido la limpieza de las alcantarillas del Barrio Alamedas. Mediante escrito fechado 4 de octubre de 2022, la recurrente solicitó ante la corporación local de Golfito la intervención de las alcantarillas del Barrio Alamedas, debido a que tienen problemas de atascamientos. Mediante oficio fechado 11 de octubre de 2022, la amparada reclamó la obstrucción de las alcantarillas del Barrio Alamedas, lo que genera inundaciones. Por memorial fechado 6 de marzo de 2023, la accionante denunció ante la Municipalidad de Golfito que en el barrio Alamedas se producen inundaciones por la saturación del alcantarillado, incluso la que pasa frente a la casa de Nombre49452 “tiene aguas negras y están estancadas”. Mediante escrito con sello de recibido del Ministerio de Salud del 6 de marzo de 2023, la accionante denunció que en el Barrio Alamedas la alcantarilla frente a la casa de Nombre49452 está atascada con sedimentos de arena, barro y agua sucia que no fluye; incluso, hay residuos de aguas negras. Por memorial DRB-112-2023-0434 del 20 de marzo de 2023, la Gerencia de Conservación de Vías y Puentes indicó a la Municipalidad de Golfito: “De acuerdo a (sic) la inspección realizada en el sector, se observó la presencia de grandes cantidades de sedimento y agua estancada en las estructuras de drenaje pluvial que atraviesan la Ruta Nacional N° 14, específicamente cerca de la sede del Poder Judicial y el PANI, así como en la intersección hacia el Depósito Libre Comercial Golfito; estructuras que en principio se supondría que se les debe realizar una limpieza extrema, sin embargo, se ha definido que no existe la posibilidad de hacerlo de manera eficiente, daba (sic) la cercanía con el manglar, toda vez que al aumentar la marea, se presenta una barrera natural para la salida óptima del agua pluvial que baja de las montañas y de los edificaciones del Dirección2806, además esta presencia de marea, genera un efecto de ingreso de sedimento arenoso a la estructura. Es importante manifestar, que esta Ingeniería de Dirección2812 tiene competencias directas en atender la infraestructura vial en el derecho de la vía, y no precisamente ingresar a manglares a realizar limpiezas de sedimentos, función que se presume, corresponde a una coordinación institucional entre la Municipalidad de Golfito y la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias. Se menciona que durante el día 17 de Marzo del 2023, con la vigente denominada Contratación Directa 2022CD-000063-0006000001 “Mantenimiento básico de la Red Vial Nacional Pavimentada”, se trató de realizar una limpieza del sedimento de manera manual y con ayuda de la Unidad del Benemérito Cuerpo de Bomberos, no obstante, los esfuerzos resultaron en vano, dada la complejidad y acumulación de sedimento y agua de mar estancada; situación que esta Ingeniería de Zona 4-3, evaluará a corto plazo como atender y brindar la solución más óptima a los habitantes del sector y a los usuarios de la vía, de conformidad a las competencias que rigen el mantenimiento y conservación de los drenajes pluviales en vías nacionales (…)”. Mediante oficio AM-MG-O-0137-2023 del 23 de marzo de 2023, la Municipalidad de Golfito comunicó a la tutelada: “1. El suscrito, inmediatamente se comunicó con el señor Nombre49441, enlace de Emergencias del MOPT y le solicitó personal para realizar trabajos de limpieza tipo manual, en el sistema de drenaje que se encuentra sedimentado sobre la Dirección1174# frente a la casa del Nombre4495. 2. Se le solicitó a la Ing. Nombre49442, personal de la cuadrilla de Aseo de Vías y Sitios Públicos para realizar los trabajos de limpieza requeridos en dicho barrió (sic). 3. Se le solicitó al Ing. Nombre49440 (sic), hacer una inspección detallada y realizar todas las acciones necesarias que correspondan para brindar una pronta solución a dichas situación. 4. Se le solicitó a la Licda. Nombre49443, realizar las coordinaciones que correspondan y necesarias con Nombre49441 del MOPT y demás instituciones de competencia para brindar una solución pronta a dicha situación”. Mediante oficio fechado 20 de mayo de 2023, la recurrente indicó a la Municipalidad de Golfito que echa de menos el seguimiento del caso y requirió la limpieza de los caños. Mediante oficio DRB-03-2023-1286 (0659) del 27 de setiembre de 2023, el Conavi comunicó a la amparada: “Conclusiones De acuerdo con la inspección realizada en sitio, se concluye lo siguiente:  Se identifica que los tres sistemas de drenaje pluvial, cuentan con un diámetro interno de 900 mm, el cual, en su punto de desfogue final, presenta acumulación de sedimento proveniente por el aumento de la marea, lo que obstruye la evacuación continua del agua pluvial.  No resulta favorable realizar la limpieza de los sedimentos de los drenajes pluviales de manera manual, toda vez que cuando aumenta el nivel de marea, los sedimentos vuelven a ingresar hacia el sistema de drenaje y se obstruye nuevamente.  Se realizará mediante el procedimiento denominado: Contratación Directa 2022CD-000145- 0006000001, Dirección2813, adjudicado al contratista Quebradores del Sur S.A., los estudios topográficos e hidrológicos necesarios, para realizar los respectivos diseños de drenajes pluviales, ajustados a las condiciones de sitio y con la suficiente capacidad hidráulica, que permitan solventar la problemática a corto plazo. Actualmente la ejecución del contrato se encuentra suspendida, dado a que no se cuenta con el suficiente contenido económico para continuar con actividades de mantenimiento rutinario y periódico asociado a la mejora de los sistemas de drenaje pluvial, no obstante, se mantendrá dentro de las prioridades a ejecutar por parte de esta Ingeniería de Zona 4-3, durante el primer trimestre del año 2024.  Dentro de las funciones y/o competencias de la Gerencia de Conservación de Vías y Puentes, se incluye la mejora de la capacidad hidráulica de los sistemas de drenaje pluvial dentro del derecho de la vía, no así de ejecutar trabajos dentro del manglar, dado a corresponden a otras instituciones, sea la Municipalidad de Golfito y/o la Comisión Nacional para la Prevención de Riesgos y Atención de Emergencias (CNE), gestionar este tipo de limpiezas dentro de sus competencias. Recomendaciones  Se realizará por parte de esta Ingeniería de Zona 4-3, la solicitud a la Gerencia de Conservación de Vías y Puentes, del contenido económico necesario, para reactivar la continuidad de la Contratación Directa 2022CD-000145-0006000001, Línea 18, Zona 4-3, de manera tal que se puedan efectuar los estudios topográficos, hidrológicos y de diseño final del sistema de drenaje pluvial adecuado, ajustado a las condiciones de sitio”. Por oficio CME-GOL-004-2024 del 6 de marzo de 2024, el alcalde de Golfito requirió a un diputado de la República convocar a una mesa de diálogo con el CNE, MOPT, MINAE, Conavi, SINAC y los Tribunales de Justicia de Golfito para abordar la problemática de las inundaciones acaecidas en los últimos años. Mediante memorial OF-MG-UTG-343-12-2024 del 3 de diciembre de 2024, la Unidad Técnica de Gestión Vial de Golfito comunicó a la vicealcaldesa en relación con el caso de la amparada que existen accesos con tubería o losas que no cumplen el diámetro correspondiente para la cantidad de agua pluvial que discurren, por lo que se inició el proceso de identificación de los propietarios para concederles un plazo prudencial para su reemplazo. Además, se indicó que la limpieza de las cunetas se incluirá en la programación trimestral del 2025. Asimismo, se aclaró que ello no solucionaría la problemática hasta tanto se atienda lo concerniente a la ruta nacional nro. 14. Por memorial CME-GOL-005-2025 del 5 de febrero de 2025, el Comité Municipal de Emergencias de Golfito consultó a la Gerencia de Conservación de Vías y Puentes por el estado del caso de la tutelada. Durante labores de inspección y mantenimiento se ha detectado la necesidad de ejecutar trabajos de limpieza y desobstrucción en dicha estructura, a fin de garantizar el adecuado drenaje pluvial y la seguridad de la vía. No obstante, siendo el manglar un ecosistema protegido por ley, comprendemos que cualquier acción que pueda implicar afectación directa o indirecta debe contar con la debida autorización de la autoridad ambiental competente. En atención a lo dispuesto en la Ley de la Zona Marítimo Terrestre (Ley N.º 6043), su Reglamento (Decreto Ejecutivo N.º 7841-P) y la Ley Forestal (Ley N.º 7575) solicitamos respetuosamente a esta Coordinación Regional del SINAC nos indique el procedimiento a seguir, los requisitos técnicos y legales, para proceder de conformidad con la normativa vigente”. El 21 de octubre de 2025, el Ministerio de Salud emitió el informe técnico de inspección MS-DRRSBRU-DARS-G-IT-0923-2025, por medio del cual se indicó: “se logra evidenciar que existen limitaciones en las redes de evacuación pluvial existentes en el Dirección2818, relativas a diseño, conformación, mantenimiento y adecuación a las capacidades requeridas como acciones preventivas y correctivas. Se logra evidenciar ausencia de caños y cunetas revestidos, control deficiente de maleza y residuos vegetales en los desagües en rondas de calles y frente de propiedades, falta de mantenimiento de rondas y frentes de calle de propiedades, obstrucciones en desagües en entradas de propiedades, ausencia de tapas de cajas de registro y rejas de protección en aberturas del sistema de alcantarillado, daños de la capa asfáltica en sectores de la calle de ruta cantonal (paso de alcantarilla en la línea detrás de los Tribunales de Justicia y paso de alcantarilla contiguo al Dirección2810), tramos del alcantarillado pluvial completamente obstruido con sedimentos de lodo y arena, partes inundadas en los sectores bajos, puntos de descarga en área de manglar obstruidos e inundados y con presencia de fauna (peces y tortugas de agua dulce), impactos en propiedades y estructuras, entre ellas las propiedades e instalaciones donde operan Los Tribunales de Justicia de Golfito, el PANI, propiedades y estructuras habitacionales particulares. Con responsabilidad de acciones en estos sistemas de evacuación pluvial intervienen los titulares de propiedades sobre los frentes de calle y entradas de cada inmueble, la Municipalidad de Golfito en la red de calles de rutas cantonales y red de evacuación pluvial, autoridades del Ministerio de Obras Públicas y Transportes sobre acciones en el tramo de la Ruta Nacional número 14 en espacial los pasos de aguas y puntos de descarga, y autoridades competentes del Ministerio de Ambiente y Energía sobre las descargas en zona de manglar, posible canalización y reubicación de fauna; aspectos que deben ser valorados. Por parte del Ministerio de Salud – Dirección Área Rectora de Salud de Golfito, se procederá a analizar las competencias de cada institución citada y en caso de ser necesario se emitirán los actos administrativos con las acciones tendentes a las correcciones que le corresponda a cada una”.

Así las cosas, en el sub examine se echa de menos la actuación diligente y célere de parte de la Municipalidad de Golfito, así como del MOPT y Conavi a fin de atender la problemática denunciada por la accionante en cuanto a las inundaciones del Barrio Alamedas. Acerca de esto, de la prueba se colige que, por memorial DRB-112-2023-0434 del 20 de marzo de 2023, la Gerencia de Conservación de Vías y Puentes comunicó a la corporación local accionada “se observó la presencia de grandes cantidades de sedimento y agua estancada en las estructuras de drenaje pluvial que atraviesan la Dirección2804, específicamente cerca de la sede del Poder Judicial y el PANI, así como en la intersección hacia el Depósito Libre Comercial Golfito; estructuras que en principio se supondría que se les debe realizar una limpieza extrema, sin embargo, se ha definido que no existe la posibilidad de hacerlo de manera eficiente, daba (sic) la cercanía con el manglar, toda vez que al aumentar la marea, se presenta una barrera natural para la salida óptima del agua pluvial que baja de las montañas y de los edificaciones del Barrio Alamedas, además esta presencia de marea, genera un efecto de ingreso de sedimento arenoso a la estructura”; además, por oficio DRB-03-2023-1286 (0659) del 27 de setiembre de 2023, el Conavi comunicó a la amparada que “Se realizará por parte de esta Ingeniería de Zona 4-3, la solicitud a la Gerencia de Conservación de Vías y Puentes, del contenido económico necesario, para reactivar la continuidad de la Contratación Directa 2022CD-000145-0006000001, Dirección2802, de manera tal que se puedan efectuar los estudios topográficos, hidrológicos y de diseño final del sistema de drenaje pluvial adecuado, ajustado a las condiciones de sitio”. Pese a ello, no fue sino hasta el 1° de octubre de 2025, cuando el Conavi remitió un oficio al SINAC a los efectos de consultar el procedimiento a seguir para ejecutar labores de limpieza y desobstrucción de la ruta nacional nro. 14, cuya descarga desemboca directamente en un manglar.

En el caso del gobierno local de Golfito, véase que, desde marzo de 2023 comunicó a la tutelada que “Se le solicitó al Ing. Nombre49440 (sic), hacer una inspección detallada y realizar todas las acciones necesarias que correspondan para brindar una pronta solución a dichas situación”. Además, memorial OF-MG-UTG-343-12-2024 del 3 de diciembre de 2024, la Unidad Técnica de Gestión Vial de Golfito comunicó a la vicealcaldesa en relación con el caso de la amparada que existen accesos con tubería o losas que no cumplen el diámetro correspondiente para la cantidad de agua pluvial que discurren, por lo que se inició el proceso de identificación de los propietarios para concederles un plazo prudencial para su reemplazo. Además, se indicó que la limpieza de las cunetas se incluirá en la programación trimestral del 2025. Pese a ello, no se evidencia que la corporación municipal haya ejecutado lo correspondiente a los efectos de atender de manera diligente la problemática objeto de este asunto.

Así las cosas, en el sub iudice queda en evidencia la falta de solución de la problemática objeto de este estudio, cuya solución debe provenir de una labor conjunta entre la Municipalidad de Golfito, el MOPT y el Conavi, motivo por el cual lo procedente es estimar el recurso en los términos indicados en la parte dispositiva de este pronunciamiento.

V.- Por otra parte, en cuanto al Ministerio de Salud, la Sala verifica que, aun cuando por medio del escrito con sello de recibido de esa cartera ministerial del 6 de marzo de 2023 la accionante denunció que en el Dirección2806 la alcantarilla frente a la casa de Nombre49452 está atascada con sedimentos de arena, barro y agua sucia que no fluye; incluso, hay residuos de aguas negras, no menos cierto es que no se cuenta con elemento probatorio alguno que permita acreditar que el ministerio referido haya atendido formalmente tal gestión. Por ende, se acoge el asunto en cuanto a este asunto.

VI.- NOTA DEL MAGISTRADO Nombre41880. Considero pertinente advertir que, desde la sentencia nro. 2019002355 de las 9:30 de 12 de febrero de 2019, mi postura ha sido la siguiente en relación con los recursos de amparo cuando estos han sido planteados a favor de una persona jurídica:

“en la Opinión Consultiva 22-16 del 26 de febrero de 2016, la Corte Interamericana de Derechos Humanos indicó que si bien algunos Estados reconocen el derecho de petición a personas jurídicas con condiciones especiales, como lo son los sindicatos, partidos políticos o representantes de pueblos indígenas, comunidades afrodescendientes o grupos específicos, lo cierto es que “El artículo 1.2 de la Convención Americana sólo consagra derechos a favor de personas físicas, por lo que las personas jurídicas no son titulares de los derechos consagrados en dicho tratado”. Por otro lado, en la misma opinión consultiva, la Corte Interamericana dispuso que, en ciertos contextos particulares, las personas físicas pueden llegar a ejercer sus derechos a través de personas jurídicas (verbigracia, a través de un medio de comunicación, como acaeció en el caso Nombre32579 y otros contra Venezuela); empero, a efectos de que ello sea tutelable ante el sistema interamericano, “el ejercicio del derecho a través de una persona jurídica debe involucrar una relación esencial y directa entre la persona natural que requiere protección por parte del sistema interamericano y la persona jurídica a través de la cual se produjo la violación, por cuanto no es suficiente con un simple vínculo entre ambas personas para concluir que efectivamente se están protegiendo los derechos de personas físicas y no de las personas jurídicas. En efecto, se debe probar más allá de la simple participación de la persona natural en las actividades propias de la persona jurídica, de forma que dicha participación se relacione de manera sustancial con los derechos alegados como vulnerados.” (énfasis agregado) (OC. 22/16)”.

En la especie, de los autos se infiere una relación esencial entre la argüida afectación a una persona jurídica y la eventual lesión a una física, motivo por el cual estimo procedente conocer por el fondo el asunto.

VII.- NOTA DEL MAGISTRADO Nombre277. En tesis de principio, considero que los casos relacionados con la actividad o inactividad de la Administración Pública en la reparación, construcción, modificación o demolición de cualquier obra de infraestructura, deben ser desestimados, por constituir, esa omisión, un tema de legalidad, cuya discusión corresponde a la jurisdicción ordinaria, ante la cual la persona interesada puede debatir, con mayor amplitud, sus disconformidades. Sin embargo, cuando de aquella conducta administrativa (omisiva o no) se derive alguna violación a otros derechos fundamentales tutelados en esta jurisdicción constitucional, o se afecten grupos considerados vulnerables, sí entro a conocer el fondo del asunto, por constituir esta situación una excepción a mi posición en esta materia, tal y como sucede en este caso, en que la parte recurrente acusa que, ha presentado sendas denuncias ante la parte recurrida debido a la falta de drenajes, el mal estado y obstrucción de las cunetas, el deterioro de  caños y cajas de registro, así como acumulación de basura y , a la fecha de la interposición del amparo, no se le ha contestado ni resuelto nada, lo cual genera inundaciones que afectan la localidad y  su propiedad.

VIII.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo material que no sea recogido dentro de ese lapso, con base en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial" (aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 y publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012) y en el artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012.

Por tanto:

Se declara con lugar el recurso. Se les ordena a Nombre35264, Nombre35265 y Nombre49440, por su condición respectiva de alcalde, coordinador del Comité Municipal de Emergencias e ingeniero de la Gestión Técnica de Infraestructura Vial, todos de la Municipalidad de Golfito, Nombre42179, en su condición de ministro del Ministerio de Obras Públicas y Transportes y Nombre48807, en su condición de director ejecutivo a.i. del Consejo Nacional de Viabilidad, o a quienes ocupen esos cargos, así como a quienes se desempeñen los puestos de gerente de Conservación de Vías y Puentes y director Regional Brunca, ambos del Consejo Nacional de Viabilidad, coordinar lo necesario y llevar a cabo todas las actuaciones que estén dentro del ámbito de sus respectivas competencias para que: 1) en el plazo de CINCO DÍAS, contado a partir de la notificación de este pronunciamiento, se cree una comisión interinstitucional que se encargue de abordar la problemática expuesta por la parte accionante respecto a las inundaciones acaecidas en Barrio Alamedas; y 2) en el plazo de UN MES, contado a partir de la creación de la comisión interinstitucional supramencionada, se diseñe un plan para atender el problema objeto de este recurso. Además, se le ordena a Nombre49449, en su condición de director del Área Rectora de Salud de Golfito del Ministerio de Salud, o a quien en su lugar ocupe ese cargo, que coordine lo necesario y lleve a cabo todas las actuaciones dentro del ámbito de sus competencias, a los efectos de que, en el plazo máximo de DOS MESES, contado a partir de la notificación de este pronunciamiento, se resuelva conforme a derecho corresponda la denuncia planteada por la parte amparada el 6 de marzo de 2023 y se le notifique lo correspondiente al medio señalado para tales efectos. Lo anterior se dicta con el apercibimiento de que con base en lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quienes recibieren una orden que deban cumplir o hacer cumplir, dictada en un recurso de amparo y que no la cumplieren o no la hicieren cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Golfito, al Consejo Nacional de Viabilidad y al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El magistrado Nombre41880 consigna nota. El magistrado Nombre277 pone nota. Notifíquese.

CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours and twenty minutes on the fourteenth of November of two thousand twenty-five.  

 An amparo petition processed in case file number 25-030065-0007-CO, filed by Name49435, identity card CED24899, on behalf of HERSELF AND PERIDOT S.A. and Name49436, against the NATIONAL ROAD COUNCIL (CONAVI), THE MINISTRY OF PUBLIC WORKS AND TRANSPORT (MOPT), THE MINISTRY OF HEALTH (MS), AND THE MUNICIPALITY OF GOLFITO.  

Whereas:  

 1.- By brief incorporated into the digital case file on 30 September 2025, the petitioner files an amparo petition. She states that she is an older adult. She refers that, since 2022, during the rainy season, and repeatedly since then, flooding has occurred at Address2800, due to insufficient drainage, gutters (cunetas) in poor condition and obstructed, deteriorated pipes (caños) and manholes (cajas de registro), as well as garbage accumulation. She points out that as a consequence several cantonal roads and a national route have been destroyed. She details that the roadways affected by the flooding are six cantonal roads and one national route, namely: the central street, from the north side of ICE to the entrance to the old Golf Club; the street in front of Address2801 up to in front of the house of Name49437; the street in front of the house Name49454, in the sector of the house of Name49438 up to the back part of Hotel Don Fito; the street from the old Golf Club to the hangar, towards Bar La Pista; the street in front of Hotel Don Fito up to the back part of the Courts of Justice; the street from the Courts of Justice up to the property of professor Name49439; and the segment in front of that professor's dwelling house, located in front of the cantonal street, up to Hotel y Restaurante Corcovado, in front of national route number fourteen. She indicates that on multiple occasions she has addressed the competent authorities indicated in the first point, without obtaining a positive response (22 September, 27 September, 4 October, and 11 October 2022, on 6 March and 19 May 2023, on 11 April 2024 before the Municipality of Golfito and on 6 March 2023 before the ARS Golfito of the MS). She refers that this year the same flooding recurred in the mentioned places, which has caused her serious harm, including damage to two properties she owns, registered in the Real Estate Registry of Puntarenas under property folio numbers 53698-000, located in front of the hangar, and Phone3543, where the PANI is located. She accuses that the reported situation continues, therefore she considers the fundamental rights of the protected corporations violated. She requests that the petition be declared with merit.  

2.- By ruling of the Presidency of the Chamber at 19:07 hours on 10 October 2025, the process was admitted and an report was requested from the executive director, the Manager of Road and Bridge Conservation and the regional director Name18209, all of CONAVI, the Minister of Public Works and Transport, the mayor, the head of the Technical Unit for Road Management (UTGV), the head of the Technical Unit for Environmental Management and the coordinator of the Municipal Emergency Committee, all of the Municipality of Golfito, as well as the director of the Health Governing Area of Golfito of the Ministry of Health, regarding the facts alleged by the petitioner.  

3.- By brief incorporated into the digital case file on 21 October 2025, Name35264, Name35265 and Name49440, in that order, mayor, coordinator of the Municipal Emergency Committee and engineer of the Technical Management of Road Infrastructure (GTIV), all of the Municipality of Golfito, report under oath. They explain: “FIRST: Regarding what the petitioner stated, I must indicate that for years the municipality has been carrying out actions to address the problem at the site in question. SECOND: Through official letter AM-MG-O-0137-2023, dated 23 March 2023, Mrs. Name49435 was notified of the follow-up given to the meeting held on 7 March 2023, in response to environmental complaint No. 38363-2023 (SITADA), to report MG-UGAM-INSP-16-2023, as well as to the incidents reported to 911 and the environmental complaint filed before the Environmental Comptroller. In that regard, the Municipal Mayor's Office, in the cited official letter, noted the actions taken regarding the reported events. 1. The undersigned immediately contacted Mr. Name49441, MOPT Emergency liaison, and requested personnel to perform manual-type cleaning work on the drainage system that is silted up on Address1174# in front of Dr. Name9091's house. 2. Eng. Name49442, personnel from the Road and Public Sites Cleaning crew, was requested to perform the required cleaning work in said neighborhood. 3. Eng. Name49440 (sic) was requested to carry out a detailed inspection and take all necessary actions as appropriate to provide a prompt solution to said situation. 4. Licda. Name49443 was requested to make the appropriate and necessary arrangements with Name49441 from MOPT and other competent institutions to provide a prompt solution to said situation. A screenshot of the notification of official letter AM-MG-O-0137-2023 to Mrs. Name49435 is attached below. THIRD: Regarding the exposed problem, obstruction of the culverts (alcantarillas) that cross the National Route, it is pertinent to highlight that the Municipality, specifically the Technical Management of Road Infrastructure department, LACKS THE COMPETENCE to solve said problem. It must be borne in mind that municipalities only attend to cantonal routes. It is appropriate to mention the technical analysis carried out by the engineer of the Technical Management of Road Infrastructure in his official letter OF- MG-UTG-343-12-2024. He states literally the following: “(…) it was determined that from the gutter (cuneta) of the apartments located behind the Courts of Justice of Golfito, which apparently belong to Mrs. Name49444, up to the old Hangar, notifications must be given since there are access points with pipes or slabs that do not meet the corresponding diameter for the volume of rainwater (agua pluvial) that runs through said gutter. However, it should be noted that this will not solve the flooding problem in front of the PANI facilities until the issue of RN 14 is addressed (…)”. The national route, RN 14, is the responsibility of MOPT to address and NOT the Municipality of Golfito. After the foregoing, the municipal commitment to address the problem within our competences is recorded in official letter OF- MG-UTG-343-12-2024, and that the Technical Management of Road Infrastructure carried out a field visit to determine the situation described by Mrs. Name49445. FOURTH: The Municipality of Golfito and the Municipal Emergency Committee have been taking steps since 2023 seeking coordination with CONAVI to address the problem raised by the petitioner, as evidenced by the following emails: (…) FIFTH: There is also an email from February 2025, from Mrs. Name49435, addressed to the coordinator of the municipal emergency committee, in which she thanks them for attending to the emergency presented. This demonstrates that the municipality and the municipal emergency committee are addressing the problem within the framework of the law. (…) SIXTH: With reference to the above, on 14 February 2023, the municipality, through the Municipal Emergency Committee coordinated at that time by mayor Name35264, issued situation report No. CME-GOL-01 regarding the type of hydrological event. As relevant, said report reiterates through photographs the problem of collapsed drains (drenajes) on route 14 in front of PANI. SEVENTH: We who subscribe know that the National Road Council informed Mrs. Name49445 that, Within the functions and/or competences of the Road and Bridge Conservation Management, the improvement of the hydraulic capacity of the storm drainage (drenaje pluvial) systems within the road right-of-way (derecho de la vía) is included, and likewise informed that a request would be made to the Road and Bridge Conservation Management for the necessary economic content to reactivate the continuity of Direct Contracting 2022CD-000145-0006000001, Address2802, so that the topographic, hydrological, and final design studies of the adequate storm drainage system, adjusted to the site conditions and with sufficient hydraulic capacity, could be carried out to resolve the problem in the short term. Currently, the execution of the contract is suspended, given that there is insufficient economic content to continue with routine and periodic maintenance activities associated with the improvement of storm drainage systems; however, it will remain among the priorities to be executed by this Zone 4-3 Engineering division during the first quarter of 2024. The foregoing is recorded in document: DRB-03-2023-1286 (0659) of 27 September 2023. EIGHTH: It is necessary to make known that Eng. Name49446, from the Department of River Works Management Central and South Pacific Region, identified the problem as the water outflow into the mangrove (manglar) being completely clogged with dragged material, preventing water flow; additionally, the stormwater pipe has no outlet to the mangrove, causing an overflow (rebalse). Given the above, it is important to remember that the mangrove is a protected area and therefore the Municipality has neither the competence nor legal authorization to enter it and carry out work. Therefore, the Municipal Emergency Committee, through official letter CME-GOL-004-2024, sought contact with deputy Name32892 with the aim of holding a meeting to find solutions to this problem. NINTH: Finally, the Municipal Emergency Committee has followed up on this problem, as evidenced by official letter CME-GOL-005-2025, a consultation made to engineer Name49447 of the Road and Bridge Conservation Management, Engineer of Address2803– (…) Having made the foregoing statements, the requested report is hereby rendered. It is appropriate to request that the amparo petition be declared without merit; consider the evidence provided by this City Hall demonstrating that the Municipality of Golfito, through the Municipal Emergency Committee coordinated by Deputy Mayor Mrs. Name35265, has taken actions prior to the filing of this amparo petition and that said actions are in accordance with the municipality's competences; likewise, coordination with the corresponding institutions is demonstrated: Ministry of Public Works and Transport, river waters (aguas fluviales), CONAVI”.  

4.- By brief incorporated into the digital case file on 22 October 2025, Name48807 reports under oath, in his capacity as acting executive director of CONAVI. He mentions: “III. ATTENTION TO THE PETITION ON THE MERITS Therefore, we will refer to the relevant matters according to the scope of competences and functions of this Council, as well as to the facts stated by Mrs. Name49435, facts regarding which the respective statements will be made: IV. TECHNICAL-ADMINISTRATIVE CHRONOLOGY AND ACTIONS TAKEN Below, each of the activities and actions carried out by my represented entity, which are relevant for the attention of this amparo petition, will be detailed: • On 20 March 2023 – DRB-112-2023-0434: The PANI–Poder Judicial sector is inspected (indicate who, which Management, or CONAVI), verifying sediment and stagnant water in cross-drainage structures (drenajes transversales) to Address2804. It is concluded that “extreme” cleaning would be inefficient due to the natural barrier of the tide and the contribution of sandy sediment from the mangrove. Manual cleaning was coordinated with the support of the Fire Department, but it was unsuccessful. In this regard, it is important to clarify that CONAVI does not enter mangroves and that mangrove cleanings are not CONAVI's competence; coordination with the Municipality of Golfito and the National Emergency Commission (CNE) must be made for the corresponding actions. • On 27 September 2023 – DRB-03-2023-1286 (0659): The location is documented (Address2805, st. 24+500), three culverts with a 900 mm diameter, obstructed by sand/branches coming from the mangrove; the problem of the high tide barrier preventing water evacuation continues to be present. It is warned that municipal paving works on the streets of Address2806 and surroundings reduced the natural infiltration of the soil and increased surface runoff (escorrentías superficiales) towards National Route No. 14, exacerbating the hydraulic limitation. • On 01 October 2025 – CARTA-CONAVI-DRB-04-2025-0900 (0455): A clear distinction is made between the cantonal road network (with evidence of obstruction by asphalt waste after municipal intervention and lack of maintenance; the Municipality of Golfito is informed of the need to proceed with an assessment of the municipal drainage system to detect conflict points) and the culvert on National Route No. 14 (km 24+878), whose direct discharge into the mangrove suffers from the ingress of sediments and limitation due to tide fluctuation. Law No. 6043 and its regulation (D.E. 7841-P) and the Regulation to the Forestry Law (D.E. 36786-MINAET) are cited, highlighting that any intervention in a mangrove requires authorization from SINAC; therefore, CONAVI formally consults SINAC, through official letter CARTA-CONAVI- DRB-04- 2025-0901 (0475), specifically the Osa Conservation Area, to Eng. Name49448, Coordinator of the Coto Subregion, to define the procedure to follow and the possible intervention through other institutions with adequate competence in the situation. In accordance with the aforementioned, the actions taken by CONAVI are evidenced, through which it is proven that my represented entity has been attending, within its competences, to what is relevant to the situation alleged by the petitioner, all of which will be proven later. V. TECHNICAL CHARACTERIZATION OF THE SYSTEM AND THE HYDRAULIC PHENOMENON The storm sewer system (alcantarillado pluvial) under CONAVI's responsibility corresponds to the transverse culverts to Address2804 with a diameter of 900 mm located between st. 24+500 and 24+878, with final discharge towards the mangrove sector of Golfo Dulce, Golfito sector. The road right-of-way for the control section is 13.00–14.00 m, which limits physical solutions in situ without affecting margins or protected areas. During high tide (marea alta), the mangrove functions as a natural barrier: the piezometric outlet level exceeds the discharge level of the culvert, causing flow with backwater (remanso) and gradient loss, which delays/prevents discharge. Backflow towards the inlet and elevation of levels in the national road network occurs, affecting the roadway and surrounding areas. Even with internal cleanings, re-sedimentation due to the contribution of tidal fluctuations is rapid, causing maintenance efficiency to be transient and not resolving the root cause. The waterproofing by paving of the cantonal roads by the Municipality of Golfito increased runoff (escorrentías) towards the National Road Network (flows with slopes towards National Route No. 14), aggravating the hydraulic overload at a discharge point limited by tidal effects. Obstructions with asphalt waste in the cantonal sewer system and a lack of maintenance were observed. (…) VI. ALTERNATIVES EVALUATED It is important to note that the Legal Affairs Management proposes the following actions as preventive measures to address the situation presented in the amparo petition, which are: 1. Manual / pressure cleaning of culverts on National Route No. 14: Already implemented; ineffective due to re-entry of sediment. Viable only as a specific palliative. 2. Increase in diameter/replacement of pipes: Does not resolve the downstream control (tide fluctuation), the bottleneck persists, problematic to need a lower outfall level due to the diameter increase while keeping the culvert's top elevation constant for the national route crossing; risk of transferring larger volumes to the mangrove without authorization. Not recommendable without hydraulic analysis and environmental permits. 3. Dredging of the channel in the mangrove: Potentially effective technique to restore level elevations, but outside the scope of CONAVI; requires environmental viability and a SINAC/MINAE permit; possible leadership by SINAC/CNE/Municipality as the entities in charge of the intervention. 4. Management in the cantonal network: Assessment and correction of obstructions/deficiencies in the municipal stormwater network; solid control and improvements at local points (grates, catch basins - sumideros, energy dissipators - disipadores). Works outside the scope of CONAVI. VII. COMPETENCES AND COORDINATION Below, each of the actions to be carried out by each unit within the framework of its competences is detailed, all in adherence to the Principle of Legality and Institutional Coordination, aimed at carrying out the necessary works to address the situation presented in the amparo petition. (…) V. CONCLUSIONS Based on the cited official letters and actions, as well as on the technical regulations and the environmental legislation applicable to mangroves, the maritime terrestrial zone (zona marítimo terrestre), and forestry protection; it has been proven that CONAVI has acted in accordance with the law and technical standards, within the framework of its competences, without violating any constitutional right, and in turn, has initiated coordination with the competent environmental authority (SINAC) for the eventual structural solution at the receiving body. Consequently, no violation of fundamental rights attributable to CONAVI is established. Finally, it is clarified that the Road and Bridge Conservation Management of CONAVI is engaged in inter-institutional coordination work between SINAC/NATIONAL EMERGENCY COMMISSION AND THE MUNICIPALITY OF GOLFITO; actions aimed at addressing the problem presented in the amparo petition. Therefore, it is fully proven that this Council has acted in accordance with the law, within the framework of its legal and functional competences, carrying out the pertinent steps before the requirements raised, without incurring in conduct harmful to fundamental rights. Thus, it is evident that neither this Council nor the undersigned have incurred in any violation of the petitioner's constitutional rights that must be addressed by this Constitutional Chamber. PRAYER For the reasons of fact and law set forth, I request the Honorable Constitutional Chamber of the Supreme Court of Justice to declare this amparo petition without merit and to absolve the undersigned, in the capacities indicated, of all liability; as well as the National Road Council which I represent. Likewise, acting within the framework of legality and good faith, it is requested that no award of damages or costs be made”.  

5.- By brief incorporated into the digital case file on 22 October 2025, Name42179 reports under oath, in his capacity as Minister of MOPT. He states: “As of the issuance date of this official letter, it has not been possible to submit the report required by this Honorable Chamber, since the National Road Council (CONAVI), the competent body on the subject matter of the petition, has not provided the necessary technical or administrative information for the proper preparation of the institutional report. It should be noted that the information was requested from CONAVI on 17 October 2025, at 11:59 hours, through official letter No. CARTA-MOPT-DAJ-2025-4604, without a substantive response having been received to date that allows the Ministry to adequately address the Chamber's requirement. II. Competence of CONAVI In accordance with Law No. 7798, Creating the National Road Council, said body is responsible for the execution and monitoring of the technical, contractual, and operational actions linked to the matter raised in the cited case file. By virtue of the foregoing, this Ministry, in its capacity as governing body (ente rector), lacks direct competence to rule on aspects that are the exclusive purview of CONAVI. III. Final Considerations For the reasons stated, and in the absence of a response from the competent body, the Ministry of Public Works and Transport is unable to issue the requested report within the granted period. Consequently, it is appropriate that CONAVI, within its scope of competence and in accordance with the principle of legality, directly submit the required information to this Constitutional Chamber”.  

6.- By brief incorporated into the digital case file on 23 October 2025, Name49449 reports under oath, in his capacity as director of the Health Governing Area of Golfito of the Ministry of Health. He states: “Regarding what is stated in the allegations, as recorded in the technical inspection report MSDRRSBRU- DARS-G-IT-0923-2025, dated 21 October 2025, signed by Eng. Name49450, Health Regulation, Health Governing Area of Golfito, a site visit was conducted, specifically at Address2807, on 20 October 2025 between 09:35 am and 11:35 am, attended by Mr. Name49451; from said report the following is extracted: “VI. INSPECTION RESULTS (FINDINGS) 1. The central street, from the north side of ICE to the entrance to the old Golf Club: a. Upper segment (highest part relative to the topography and terrain relief), located in the northern part of the Las Alamedas neighborhood, according to the description runs from east to west with a regular slope, without pronounced unevenness; it constitutes one of the entrances. b. Within one of the properties on the north side, in the central part of the segment, a headwall of the start of a stormwater evacuation network culvert is observed, with a metal grate partially covering the inlet, used to retain solid waste of plant origin (leaves, branches, and roots) that are carried by water currents. c. Earthen curbs (cordones de caño) and gutters (cunetas), directed towards the storm sewer system, are observed with weeds in some sectors, parts obstructed with plant debris, parts deformed or undefined. d. The street has an asphalt layer in good condition. At the west end of the segment, an accumulation of sand carried by water currents from the upper parts is observed. e. Obstruction of drains (desagües) at the street frontages of properties, due to lack of maintenance and obstructions with access structures (fills, grates, concrete slabs). 2. The street in front of Address2801 up to in front of the house of Name49437: a. Intermediate internal segment located in the upper parts, according to the description runs from west to east, with regular slopes without pronounced unevenness directed towards the central part of the segment (the central part is the lowest elevation). b. Manholes (cajas de registro) are observed obstructed, even with the protective grate fallen inside the box and accumulation of plant debris. c. Earthen curbs and gutters, directed towards the storm sewer system, are observed with weeds in some sectors, parts obstructed with plant debris, parts deformed or undefined. d. The street has an asphalt layer in good condition. e. Obstruction of drains at the street frontages of properties, due to lack of maintenance and obstructions with access structures (fills, grates, concrete slabs). 3. The street in front of the house Name49454, in the sector of the house of Name49438 up to the back part of Hotel Don Fito: a. Intermediate internal segment located in the upper parts, according to the description runs from east to west, with regular slopes without pronounced unevenness directed towards the east part of the segment with the lowest elevations b. Manholes are observed obstructed with plant debris, weeds, and earth. c. Earthen curbs and gutters, directed towards the storm sewer system, are observed with weeds in some sectors, parts obstructed with plant debris, parts deformed or undefined. d. The street has an asphalt layer in good condition. e. Obstruction of drains at the street frontages of properties, due to lack of maintenance and obstructions with access structures (fills, grates, concrete slabs). 4. The street from the old Golf Club to the hangar, towards Bar La Pista: a. Perpendicular segment, according to the description runs from northeast to southwest, with an irregular slope in the upper middle part with pronounced unevenness and flat in the lower middle part; it constitutes one of the exits. b. Earthen curbs and gutters, with currents directed towards a fluvial system at the southwest end, which constitutes a culverted stream (quebrada entubada) with a culvert downstream from the discharge point. c. Curbs and gutters are observed with weeds in some sectors, parts obstructed with plant debris. d. The street has an asphalt layer. At the west end of the segment, at the culvert headwall that carries a stream, scouring (socavamiento) is observed beneath the asphalt layer with damage and effect on half of the roadway where a plastic barrier was placed as preventive protection. e. Obstruction of drains at the street frontages of properties, due to lack of maintenance and obstructions with access structures (fills, grates, concrete slabs). 5. The street in front of Hotel Don Fito up to the back part of the Courts of Justice: a. Intermediate internal segment located in the lower parts, according to the description runs from west to east, with regular slopes without pronounced unevenness, currents directed towards the central part of the segment with the lowest elevations. b. A stormwater evacuation sewer manhole is observed completely obstructed with sand and earth sediments, with the protective grate removed/expelled by the water currents themselves. Up to this point, the water currents flowing from the upper parts have a course, but they lack continuity; the downstream continuity duct is completely obstructed, so the waters overflow onto the street and properties. c. Open manholes are observed, located on the north side of the street; others with modifications by residents who have placed protective grates to prevent the ingress of solid plant waste. d. Earthen curbs and gutters, directed towards the storm sewer system, remain with stagnant water, parts obstructed with plant debris, parts deformed or undefined. e. The street has an asphalt layer, with parts washed away by water currents in the storm sewer passage area. f. Damage from stormwater currents is observed on the street structure and properties, including the property where the Golfito Judicial Branch facilities are located, the property where the Golfito PANI operates, and private properties with residential structures. g. Obstruction of drains at the street frontages of properties, due to lack of maintenance and obstructions with access structures (fills, grates, concrete slabs). 6. Address2808 up to the property of professor Name49439: a. Southern end segment of Address2809, located in the lowest part, according to the description runs from east to west, with a regular flat slope, with currents directed towards the central part of the segment with the lowest elevations. b. It borders on the south side with national route number fourteen. c. Manholes, curbs, and gutters lined with cement are observed, directed towards the storm sewer system with two discharge points, which remain flooded. d. The street has an asphalt layer, in good condition. e. Damage from stormwater currents is observed on properties, including the property where the Golfito Judicial Branch facilities are located, the property where the Golfito PANI operates, and private properties with residential structures. f. Obstruction of drains at the street frontages of properties, due to lack of maintenance and obstructions with access structures (fills, grates, concrete slabs). 7. The segment in front of said professor's dwelling house, located in front of the cantonal street, up to Hotel y Restaurante Corcovado, in front of national route number fourteen: a.

Section of National Route 14, located in the lowest part, according to the description runs from east to west, with a regular flat slope, with flows directed towards the eastern end with the lowest unevenness. b. It borders on the north with Dirección2809, on the south with the mangrove zone and the coastline of Golfo Dulce. c. It contains two water passage and storm sewer discharge points that flow from the highest parts of the Las Alamedas neighborhood. d. The height above sea level is less than one meter, which implies there is tidal influence. e. At both ends of the route section, the curb structures, ditch pipes, and sewers remain flooded, without continuity due to clogging with mud and sand sediment. f. The discharge of the storm sewer system occurs in the mangrove at the southern end of the road, and the sewer from the previous section on the line behind the Courts of Justice is obstructed with mud and sand sediment, meaning the watercourse has no continuity. Furthermore, the level of the discharge points is below the surface level of the mangrove and they are flooded by high tides. g. In the flooded spaces of the storm water evacuation system structures, due to the influence of the environment, fauna typical of mangroves is present, with fish and freshwater turtles being visible (a turtle nest with more than thirty healthy individuals). h. The street has an asphalt layer, in good condition, with regular traffic. i. Obstruction of drains on the street fronts of properties, due to lack of maintenance and obstructions with access structures (fills, grates, concrete slabs). VII. OBSERVATIONS 1. The location of the actions and facts alleged by the petitioner are located in the Las Alamedas neighborhood, located in the City of Golfito, Golfito district, Golfito canton, Puntarenas province; in the network of internal streets of the neighborhood that correspond to sectors or sections of the cantonal route network and a section of National Route 14. 2. The actions and facts alleged in the appeal correspond to impacts on the street network in the Las Alamedas neighborhood due to insufficient drainage, gutters in poor condition and obstructed, deteriorated pipes and manholes, as well as waste accumulation, with impact on properties and structures. 3. The City of Golfito is constituted as a port city, coastal city, or littoral city, which implies the existence of a marine boundary and interactions between land and sea. 4. The Las Alamedas neighborhood features street networks, gutters, storm and fluvial sewer structures, sanitary sewer systems, and buildings dating from the era of the banana company in the zone, with an age exceeding eighty years and without substantial modifications. 5. The storm sewer system passes between properties and beneath structures, due to its age and having been installed by the banana company that once operated in the zone, at that time, the owner of the properties. 6. The discharge points of the storm, fluvial, and sanitary sewer systems go directly to the sea, in mangrove sectors, with the presence of fauna typical of these sites, in this case fish and freshwater turtles. 7. The Las Alamedas neighborhood presents different unevenness above sea level, ranging between zero meters and twenty meters, with tidal influence in the lowest parts. VIII. CONCLUSIONS As verified, from the facts alleged by the petitioner, it is possible to demonstrate that there are limitations in the existing storm water evacuation networks in the Las Alamedas neighborhood of the City of Golfito, relating to design, configuration, maintenance, and adaptation to the required capacities as preventive and corrective actions. It is possible to demonstrate the absence of lined pipes and gutters, deficient control of weeds and plant debris in the drains along street easements and in front of properties, lack of maintenance of easements and street fronts of properties, obstructions in drains at property entrances, absence of manhole covers and protective grates in sewer system openings, damage to the asphalt layer in sectors of the cantonal route street (sewer crossing on the line behind the Courts of Justice and sewer crossing adjacent to Dirección2810), sections of the storm sewer completely obstructed with mud and sand sediment, flooded parts in the low sectors, discharge points in the mangrove area obstructed and flooded and with the presence of fauna (fish and freshwater turtles), impacts on properties and structures, among them the properties and facilities where the Courts of Justice of Golfito, PANI, and private residential properties and structures operate. Responsibility for actions in these storm water evacuation systems involves the property owners regarding the street fronts and entrances of each property, the Municipality of Golfito regarding the cantonal route street network and storm water evacuation network, authorities of the Ministry of Public Works and Transport regarding actions on the section of Dirección2811, especially water passages and discharge points, and competent authorities of the Ministry of Environment and Energy regarding discharges in the mangrove zone, possible channeling, and relocation of fauna; aspects that must be assessed. On behalf of the Ministry of Health – Governing Health Area Directorate of Golfito, the competencies of each cited institution will be analyzed and, if necessary, administrative acts will be issued with the actions tending to the corrections corresponding to each one. (sic). On the other hand, regarding what was alleged by the petitioner, with respect to: “…that on multiple occasions she has addressed the competent authorities indicated in the first point, without obtaining a positive response (September 22, September 27, October 4, and October 11, 2022, March 6 and May 19, 2023, April 11, 2024, before the Municipality of Golfito”, “By official letter AM-MG-O-0137-2023 of March 23, 2023, the then mayor of Golfito, commented on the steps taken in order to provide a solution, including communications with the MOPT, a request for manual cleaning work, inspection work, and coordination with other institutions to seek a solution”, “By official letter DRB-03-2023-1286 (0659) of September 27, 2023, the engineer of Zone 4-3 South-South of the Road and Bridge Conservation Management of CONAVI responded to her request indicating that he would request from management the necessary economic content to reactivate a direct contracting so that ‘topographic, hydrological, and final design studies for the adequate storm drainage system, adjusted to the site conditions, can be carried out’ (sic), it is important to indicate that this is a matter for the Municipality of Golfito and CONAVI; therefore, since it is not the competence of the Ministry of Health, I cannot comment on this point, likewise, there is no documentation in this Governing Area regarding what was alleged by the petitioner. It is clear that the Directorate of the Governing Health Area of Golfito has carried out all necessary actions within the scope of its competencies to address the situation, in compliance with current health regulations; therefore, in response to the complaint, an inspection visit was conducted at the site, and through technical report MS-DRRSBRU-DARS-G-IT-0923- 2025, the Governing Health Area of Golfito evidenced the reported conditions, so this Governing Health Area will proceed to analyze the competencies of each institution and, if necessary, administrative acts will be issued with the actions tending to the corrections corresponding to each one. Due to the foregoing, it has been demonstrated that the actions of the Directorate of the Governing Health Area of Golfito were carried out in strict adherence to its functions, efficiently and diligently, in compliance with current regulations (…) 3. Petition As has been stated and as is evident from the evidence provided, this Governing Health Area has addressed the case timely and adequately within the framework of legal competencies, guaranteeing due process. Due to the above, I most respectfully request the Constitutional Chamber, that as far as I am concerned and as far as the Ministry of Health is concerned, the present appeal be declared without merit.”

7.- By written submission incorporated into the digital case file on October 23, 2025, Nombre42179 provides a sworn statement, in his capacity as minister of the MOPT. He mentions: “I. Regarding the untimely submission of the report The Ministry of Public Works and Transport promptly proceeded to request the National Road Council (CONAVI) for the technical and administrative information necessary to address what was ordered by this Chamber, through official letter No. CARTA-MOPTDAJ- 2025-4604, dated October 17, 2025, at 11:59 hours. However, CONAVI sent its response by email at 20:27 hours, through official letter No. DIE-17-2025-1340 (0139), dated October 21, 2025, that is, after the expiration of the deadline granted to this Ministry to render the respective report. II. Presentation of the ministerial report It should be noted that, yesterday itself, at 21:25 hours, report No. CARTA-MOPT-DM-2025-2079 was presented before this Honorable Chamber, prepared based on the information available up to that moment and on the supporting documentation generated by the Legal Directorate. Given that CONAVI subsequently sent its technical report (DIE-17- 2025-1340 (0139)), it is now being brought to the attention of this Chamber, as a complement to the ministerial report already presented. III. Content of CONAVI's report Official letter DIE-17-2025-1340 (0139) details the technical and administrative actions carried out by CONAVI regarding the road-related impacts on the Dirección2800, including field inspections, coordination with the Municipality of Golfito, the National Emergency Commission, and SINAC, as well as the description of the hydraulic phenomenon and the limitations derived from the influence of the tide on the storm water drainage of National Route No. 14. [It highlights] the technical and environmental complexity of the zone, and not an institutional omission or disobedience. IV. Considerations of the Ministry This Ministry regrets the untimely presentation of the report and clarifies that this situation was due to causes beyond its control, as it depended on the technical information that had to be prepared and sent by CONAVI, the competent body according to Law No. 7798. Once CONAVI's report was received, the MOPT proceeds immediately to forward it to this Honorable Chamber, in the interest of maintaining transparency, institutional compliance, and respect for the principle of collaboration among public powers. V. Petition Based on the foregoing, this Chamber is respectfully requested: 1. To accept the complementary report as filed untimely, with the justification indicated above. 2. To incorporate into the judicial case file official letter No. DIE-17-2025-1340 (0139) issued by CONAVI, as well as its technical annexes. 3. To consider the request for information fulfilled, insofar as what was ordered in the resolution at 19:07 hours on October 10, 2025, has been comprehensively addressed.”

8.- By written submission incorporated into the digital case file on October 27, 2025, Nombre35265 and Nombre49440 provide a sworn statement, respectively, the vice-mayor in a support capacity in the Department of Environmental Management and the GTIV engineer, both of the Municipality of Golfito. They explain: “Clarifying at once, we inform that currently the Municipality of Golfito does not have a current appointment for the head of the Department of Environmental Management. For this reason, my person as vice-mayor has been providing support and guidance to the officials of said department in operational and administrative tasks in matters that warrant it. However (sic), I must indicate that I am not a professional in the area of environmental management, which is why it is not possible for me to issue technical reports related to the issue in question. Having made the previous clarification, we the undersigned declare that we have already rendered a report addressing the hearing granted at 19:07 on October 10, 2025. Said report is signed by the mayor, the undersigned Nombre35265, and the undersigned Nombre49440; it was incorporated into the electronic file on October 21, 2025.”

9.- By means of a certification signed on October 29, 2025, by the interim secretary and judicial technician 3, both of the Constitutional Chamber, it is indicated that: “reviewed, at fourteen hours and fifty-one minutes on the twenty-ninth of October, two thousand twenty-five, in the Costa Rican judicial office management system, the control of documents received and this case file, it did not appear that from 10/23/2025 to 10/27/2025, the HEAD OF THE TECHNICAL UNIT OF ENVIRONMENTAL MANAGEMENT OF THE MUNICIPALITY OF GOLFITO had filed any writing or document, in order to render the report requested from him in the resolution issued at nineteen hours and seven minutes on the tenth of October, two thousand twenty-five.”

10.- By means of a certification signed on October 29, 2025, by the interim secretary and judicial technician 3, both of the Constitutional Chamber, it is indicated that: “reviewed, at fourteen hours and fifty-five minutes on the twenty-ninth of October, two thousand twenty-five, in the Costa Rican judicial office management system, the control of documents received and this case file, it did not appear that from 10/22/2025 to 10/24/2025, the REGIONAL DIRECTOR Nombre49453 had filed any writing or document, in order to render the report requested from him in the resolution issued at nineteen hours and seven minutes on the tenth of October, two thousand twenty-five.”

11.- By means of a certification signed on October 29, 2025, by the interim secretary and judicial technician 3, both of the Constitutional Chamber, it is indicated that: “reviewed, at fourteen hours and fifty-nine minutes on the twenty-ninth of October, two thousand twenty-five, in the Costa Rican judicial office management system, the control of documents received and this case file, it did not appear that from 10/16/2025 to 10/21/2025, the MANAGER OF ROAD AND BRIDGE CONSERVATION OF CONAVI had filed any writing or document, in order to render the report requested from him in the resolution issued at nineteen hours and seven minutes on the tenth of October, two thousand twenty-five.”

12.- In the proceedings followed, the legal requirements have been observed.

Drafted by Magistrate Nombre41880; and,

Considering:

I.- PRELIMINARY ISSUES. Firstly, it must be clarified that, since judgment no. 2008-02545 at 08:55 hours on February 22, 2008, this Chamber has referred to the contentious-administrative jurisdiction those matters in which it is disputed whether the Public Administration has complied or not with the deadlines set by the General Law of Public Administration (articles 261 and 325) or sectoral laws in special administrative procedures, to resolve by final act an administrative procedure —initiated ex officio or at the request of a party— or to hear the corresponding administrative appeals. However, it has also contemplated cases of exception to the above, as happens in the present case, given that the grievance concerns alleged complaints about situations that endanger the life and physical integrity of the protected older adult person. In this type of matter, the constitutional jurisprudence has deemed the application of constitutionality control appropriate, so the sub iudice is hereby resolved.

Secondly, given that the Manager of Road and Bridge Conservation and the regional director Nombre18209, both of CONAVI, as well as the head of the UTGA of the Municipality of Golfito, omitted to answer the hearing within the deadline set by this Court in the procedural resolution of the sub lite, the appeal is hereby resolved in accordance with article 45 of the Law of Constitutional Jurisdiction and taking into consideration the evidentiary elements contained in the case file.

II-. OBJECT OF THE APPEAL. The petitioner, who is an older adult person, states that since 2022, during the rainy season, floods occur in the Alamedas neighborhood of Golfito, due to insufficient drainage, gutters in poor condition and obstructed, deteriorated pipes and manholes, as well as garbage accumulation. She indicates that as a consequence, several cantonal streets and a national route have been destroyed, namely: the central street, from the north side of ICE to the entrance to the old Club de Golf; the street in front of Dirección2801 up to in front of the house of Nombre49437; the street in front of the Nombre49454 house, in the sector of the house of Nombre49438 up to the back of Hotel Don Fito; the street from the old Club de Golf to the hangar, towards Bar La Pista; the street in front of Hotel Don Fito to the back of the Courts of Justice; the street from the Courts of Justice to the property of teacher Nombre49439; as well as the section in front of the dwelling house of that teacher, located facing the cantonal street, up to Hotel y Restaurante Corcovado, facing National Route 14. She indicates that on multiple occasions she has addressed the competent authorities; however, the reported situation continues and has caused damage to two of her properties.

III.- PROVEN FACTS. Of importance for the decision in this matter, the following facts are deemed duly proven:

a) The protected person is an older adult aged 67 years. (See website of the Supreme Electoral Tribunal).

b) By official letter dated September 22, 2022, the protected party communicated to the Municipality of Golfito that the sewer located in front of the house of Nombre4495 is completely full of material and causes floods. (See documentary evidence).

c) By writing dated September 26, 2022, the protected party requested the respondent local government to clean the sewers of the Alamedas Neighborhood. (See documentary evidence).

d) Through writing dated October 4, 2022, the petitioner requested before the local corporation of Golfito the intervention of the sewers of Dirección2806, because they have clogging problems. (See documentary evidence).

e) Through official letter dated October 11, 2022, the protected party complained about the obstruction of the sewers of the Alamedas Neighborhood, which generates floods. (See documentary evidence).

f) By memorial dated March 6, 2023, the claimant denounced before the Municipality of Golfito that floods occur in the Alamedas neighborhood due to sewer saturation, including the one passing in front of the house of Nombre49452 “has black water and it is stagnant”. (See documentary evidence).

g) Through writing with a received stamp from the Ministry of Health dated March 6, 2023, the claimant denounced that in Dirección2806 the sewer in front of the house of Nombre49452 is clogged with sediment of sand, mud, and dirty water that does not flow; there are even residues of black water. (See documentary evidence).

h) By memorial DRB-112-2023-0434 of March 20, 2023, the Road and Bridge Conservation Management indicated to the Municipality of Golfito: “According to (sic) the inspection carried out in the sector, the presence of large amounts of sediment and stagnant water was observed in the storm water drainage structures that cross National Route No. 14, specifically near the headquarters of the Judicial Branch and PANI, as well as at the intersection towards Depósito Libre Comercial Golfito; structures that in principle would be supposed to require extreme cleaning, however, it has been determined that there is no possibility of doing it efficiently, given (sic) the proximity to the mangrove, since when the tide rises, it presents a natural barrier for the optimal exit of storm water flowing down from the mountains and the buildings of Dirección2806, furthermore this presence of tide generates an effect of sandy sediment entering the structure. It is important to state that this Engineering Office of Dirección2812 has direct competencies in attending to road infrastructure within the right-of-way, and not precisely in entering mangroves to clean sediment, a function that is presumed corresponds to institutional coordination between the Municipality of Golfito and the National Commission for Risk Prevention and Emergency Response. It is mentioned that during March 17, 2023, with the current contract denominated Direct Contracting 2022CD-000063-0006000001 “Basic maintenance of the Paved National Road Network”, an attempt was made to clean the sediment manually and with the help of the Unit of the Benemérito Fire Department, however, the efforts were in vain, given the complexity and accumulation of sediment and stagnant sea water; a situation that this Zone 4-3 Engineering Office will evaluate in the short term on how to address and provide the most optimal solution to the inhabitants of the sector and the users of the road, in accordance with the competencies governing the maintenance and conservation of storm drains on national roads (…)”. (See documentary evidence).

i) Through official letter AM-MG-O-0137-2023 of March 23, 2023, the Municipality of Golfito communicated to the protected party: “1. The undersigned immediately communicated with Mr. Nombre49441, MOPT Emergency liaison, and requested personnel to carry out manual cleaning work in the drainage system that is sedimented on Dirección1174# in front of the house of Nombre4495. 2. Ing. Nombre49442 was requested for personnel from the Road and Public Site Cleaning crew to perform the required cleaning work in said neighborhood (sic). 3. Ing. Nombre49440 (sic) was requested to make a detailed inspection and take all the necessary actions that correspond to provide a prompt solution to said situation. 4. Licda. Nombre49443 was requested to carry out the corresponding and necessary coordination with Nombre49441 of the MOPT and other competent institutions to provide a prompt solution to said situation”. (See documentary evidence).

j) Through official letter dated May 20, 2023, the petitioner indicated to the Municipality of Golfito that she missed the follow-up of the case and requested the cleaning of the pipes. (See documentary evidence).

k) Through official letter DRB-03-2023-1286 (0659) of September 27, 2023, CONAVI communicated to the protected party: “Conclusions According to the inspection carried out on site, the following is concluded:  It is identified that the three storm drainage systems have an internal diameter of 900 mm, which, at its final discharge point, presents accumulation of sediment coming from the increase in tide, which obstructs the continuous evacuation of storm water.  It is not favorable to manually clean the sediments from the storm drains, considering that when the tide level rises, the sediments re-enter the drainage system and it becomes obstructed again.  Through the procedure called: Direct Contracting 2022CD-000145- 0006000001, Dirección2813, awarded to the contractor Quebradores del Sur S.A., the necessary topographic and hydrological studies will be carried out, to carry out the respective storm drainage designs, adjusted to the site conditions and with sufficient hydraulic capacity, that allow solving the problem in the short term. Currently, the execution of the contract is suspended, given that there is not sufficient economic content to continue with routine and periodic maintenance activities associated with the improvement of storm drainage systems, nevertheless, it will remain among the priorities to be executed by this Zone 4-3 Engineering Office, during the first quarter of 2024.  Within the functions and/or competencies of the Road and Bridge Conservation Management, the improvement of the hydraulic capacity of storm drainage systems within the right-of-way is included, but not the execution of works within the mangrove, given that it corresponds to other institutions, namely the Municipality of Golfito and/or the National Commission for Risk Prevention and Emergency Response (CNE), to manage this type of cleaning within their competencies. Recommendations  This Engineering Office of Dirección2812 will carry out the request to the Road and Bridge Conservation Management, for the necessary economic content, to reactivate the continuity of Direct Contracting 2022CD-000145-0006000001, Dirección2802, so that the topographic, hydrological, and final design studies for the adequate storm drainage system, adjusted to the site conditions, can be carried out”. (See documentary evidence).

l) By official letter CME-GOL-004-2024 of March 6, 2024, the mayor of Golfito requested a deputy of the Republic to convene a dialogue table with CNE, MOPT, MINAE, CONAVI, SINAC, and the Courts of Justice of Golfito to address the problem of the floods that have occurred in recent years. (See documentary evidence).

m) Through memorial OF-MG-UTG-343-12-2024 of December 3, 2024, the Technical Unit of Road Management of Golfito communicated to the vice-mayor in relation to the protected party's case that there are accesses with pipes or slabs that do not meet the corresponding diameter for the amount of storm water that flows, so the process of identifying the owners was initiated to grant them a prudential deadline for their replacement. In addition, it was indicated that the cleaning of the gutters will be included in the quarterly programming of 2025. Likewise, it was clarified that this would not solve the problem until what concerns Dirección2814 is addressed. (See documentary evidence).

n) By memorial CME-GOL-005-2025 of February 5, 2025, the Municipal Emergency Committee of Golfito consulted the Road and Bridge Conservation Management on the status of the protected party's case. (See documentary evidence).

o) By official letter CARTA-CONAVI-DRB-04-2025-0900 (0455) of October 1, 2025, the Road and Bridge Conservation Management of CONAVI indicated to a trustee of the District Council of Golfito in relation to the cleaning of the sewer of Barrio Alamedas: “As part of the follow-up to this request, on August 12 a site inspection was coordinated. During said visit, it was verified that the images attached to the municipal official letter correspond to a sewer system belonging to a cantonal street parallel to Dirección1174, as shown in Figure 1. Therefore, the maintenance of that infrastructure falls within the scope of competencies of the Municipality, not CONAVI. During the tour and conversations with neighbors, it was indicated that the observed difficulties had increased after the asphalt layer intervention carried out by the Municipality approximately two years ago. The possibility was identified that residues from said works may have caused obstructions in the system, which was corroborated visually. Consequently, the Municipality of Golfito is recommended to carry out an auscultation of the cantonal storm system in order to apply the corresponding corrections. Regarding the infrastructure under CONAVI's responsibility, it was determined that the nearest sewer on Dirección2815 is located at km 24+878. This structure discharges directly into a mangrove ecosystem, where the tidal dynamics cause sediment ingress and limit the optimal evacuation of storm water (…) It is worth remembering that direct attention to works within a mangrove does not correspond to the competencies of this Zone 4-3 Engineering Office, given that due to their protection they are beyond our reach. As it is an ecosystem protected by law, any intervention requires the authorization of the National System of Conservation Areas (SINAC). In light of the foregoing, a consultation is carried out with the Osa Conservation Area of SINAC, in order to define the applicable technical and legal procedure for this type of infrastructure in a protected zone”. (See documentary evidence).

p) Through official letter CARTA-CONAVI-DRB-04-2025-0901 (0475) of October 1, 2025, the Road and Bridge Conservation Management communicated to the Osa Conservation Area of the National System of Conservation Areas: “By this means, the Zone 4-3 Engineering Office of the National Road Council (CONAVI) hereby makes this consultation regarding the sewer located on National Route No 14, control section 60252, in Dirección2816, whose discharge flows directly into a mangrove ecosystem. During inspection and maintenance work, the need has been detected to carry out cleaning and unblocking works in said structure, in order to guarantee adequate storm drainage and road safety. However, as the mangrove is an ecosystem protected by law, we understand that any action that may involve direct or indirect impact must have the due authorization of the competent environmental authority.”

Pursuant to the provisions of the Maritime-Terrestrial Zone Law (Ley de la Zona Marítimo Terrestre, Law No. 6043), its Regulations (Decreto Ejecutivo No. 7841-P), and the Forestry Law (Ley Forestal, Law No. 7575), we respectfully request that this SINAC Regional Coordination indicate the procedure to follow, and the technical and legal requirements, in order to proceed in accordance with current regulations.” (See documentary evidence).

q)   On October 15, 2025, the executive director of Conavi and the manager of Road and Bridge Conservation were notified of the order to proceed in this case. (See notification records).

r)    On October 16, 2025, the minister of MOPT was notified of the order to proceed in this case. (See notification record).

s)    On October 17, 2025, the mayor and the coordinator of the CME, both of Golfito, as well as the director of the Governing Health Area of Golfito, were notified of the order to proceed in this case. (See notification records).

t)     On October 21, 2025, the regional director Nombre49453 was notified of the order to proceed in this case. (See notification record).

u)   On October 21, 2025, the Ministry of Health issued the technical inspection report MS-DRRSBRU-DARS-G-IT-0923-2025, through which it indicated: “it is possible to demonstrate that there are limitations in the existing stormwater drainage networks in the Dirección2809 of the City of Golfito, related to design, configuration, maintenance, and adaptation to the required capacities as preventive and corrective actions. It is possible to demonstrate an absence of lined gutters and ditches (caños y cunetas revestidos), deficient control of weeds and plant debris in drains along road rondas and property fronts, lack of maintenance of rondas and street fronts of properties, obstructions in drains at property entrances, absence of manhole (cajas de registro) covers and protective grates in openings of the sewer system, damage to the asphalt layer in sectors of the cantonal route street (culvert crossing on the line behind the Courts of Justice and culvert crossing adjacent to the Dirección2810), sections of the storm sewer completely obstructed with mud and sand sediments, flooded areas in low sectors, discharge points into the mangrove area obstructed and flooded and with the presence of fauna (fish and freshwater turtles), impacts on properties and structures, including the properties and facilities where the Courts of Justice of Golfito and the PANI operate, and private residential properties and structures. Responsibility for actions in these stormwater drainage systems involves property owners regarding street fronts and entrances of each property, the Municipality of Golfito regarding the cantonal route street network and stormwater drainage network, authorities of the Ministry of Public Works and Transport regarding actions on the section of National Route Number 14, especially water crossings and discharge points, and competent authorities of the Ministry of Environment and Energy regarding discharges into the mangrove area, possible channeling, and relocation of fauna; aspects that must be assessed. The Ministry of Health – Governing Health Area Directorate of Golfito will proceed to analyze the competencies of each cited institution and, if necessary, will issue administrative acts with the actions aimed at the corrections corresponding to each one.” (See documentary evidence).

v)   On October 22, 2025, the head of the UTGA of the Municipality of Golfito was notified of the order to proceed in this case. (See notification record).

w) On October 22, 2025, the head of the UTGV of the Municipality of Golfito was notified of the order to proceed in this case. (See notification record).

IV.- ON THE SPECIFIC CASE. In the case at hand, the complainant, who is an older adult (persona adulta mayor), states that since 2022, during the rainy season, flooding occurs in the Alamedas neighborhood of Golfito, due to insufficient drainage, ditches (cunetas) in poor condition and obstructed, deteriorated gutters (caños) and manholes (cajas de registro), and garbage accumulation. She points out that as a result, several cantonal streets and a national route have been destroyed, namely: the central street, from the north side of the ICE to the entrance of the former Golf Club; the street in front of the Dirección2801 to the front of the house of Nombre49437; the street in front of the house Nombre49454, in the sector of the house of Nombre49438 to the back of the Hotel Don Fito; the street from the former Golf Club to the hangar, toward Bar La Pista; the street in front of the Hotel Don Fito to the back of the Courts of Justice; the street from the Courts of Justice to the property of Professor Nombre49439; as well as the section in front of that professor's residence, located facing the cantonal street, to the Hotel y Restaurante Corcovado, facing national route number fourteen. She indicates that on multiple occasions she has approached the competent authorities; however, the reported situation continues and has caused damage to two of her properties.

The Chamber verifies that the protected party is an older adult (persona adulta mayor) aged 67. By official letter dated September 22, 2022, the protected party informed the Municipality of Golfito that the culvert located in front of the house of Nombre4495 is completely full of material and causes flooding. By writing dated September 26, 2022, the protected party requested the respondent local government clean the culverts of Barrio Alamedas. By writing dated October 4, 2022, the complainant requested before the local corporation of Golfito intervention on the culverts of Barrio Alamedas, because they have clogging issues. By official letter dated October 11, 2022, the protected party complained about the obstruction of the culverts of Barrio Alamedas, which causes flooding. By memorial dated March 6, 2023, the claimant reported to the Municipality of Golfito that in the Alamedas neighborhood flooding occurs due to sewer saturation, including the one that passes in front of the house of Nombre49452 which “has raw sewage (aguas negras) and they are stagnant.” By writing with the received stamp of the Ministry of Health dated March 6, 2023, the claimant reported that in Barrio Alamedas the culvert in front of the house of Nombre49452 is clogged with sand, mud, and dirty water that does not flow; even, there is residue of raw sewage (aguas negras). By memorial DRB-112-2023-0434 of March 20, 2023, the Road and Bridge Conservation Management informed the Municipality of Golfito: “According to the inspection carried out in the sector, the presence of large amounts of sediment and stagnant water was observed in the stormwater drainage structures that cross National Route No. 14, specifically near the seat of the Judicial Branch and the PANI, as well as at the intersection toward the Depósito Libre Comercial Golfito; structures that in principle, it would be assumed require extreme cleaning; however, it has been determined that there is no possibility of doing so efficiently, given the proximity to the mangrove, since as the tide rises, a natural barrier to the optimal outflow of stormwater coming down from the mountains and the buildings of Dirección2806 is presented; furthermore, this presence of tide generates an effect of sandy sediment entering the structure. It is important to state that this Dirección2812 Engineering has direct competencies to attend to road infrastructure within the right-of-way (derecho de la vía), and not precisely to enter mangroves to perform sediment cleaning, a function that is presumed to correspond to institutional coordination between the Municipality of Golfito and the National Commission for Risk Prevention and Emergency Response. It is mentioned that during March 17, 2023, with the current so-called Contratación Directa 2022CD-000063-0006000001 “Basic maintenance of the Paved National Road Network,” an attempt was made to clean the sediment manually and with the help of the Fire Department Unit; however, the efforts were in vain, given the complexity and accumulation of sediment and stagnant seawater; a situation that this Zone 4-3 Engineering will evaluate in the short term on how to address and provide the most optimal solution to the inhabitants of the sector and the road users, in accordance with the competencies governing the maintenance and conservation of storm drains on national roads (…).” By official letter AM-MG-O-0137-2023 of March 23, 2023, the Municipality of Golfito informed the protected party: “1. The undersigned immediately contacted Mr. Nombre49441, MOPT Emergency liaison, and requested personnel to carry out manual-type cleaning work on the drainage system that is sedimented over the Dirección1174# in front of the house of Nombre4495. 2. Ing. Nombre49442, personnel from the Road and Public Sites Cleaning crew, was requested to carry out the required cleaning work in said neighborhood (sic). 3. Ing. Nombre49440 (sic) was requested to make a detailed inspection and carry out all the necessary corresponding actions to provide a prompt solution to said situation. 4. Licda. Nombre49443 was requested to make the corresponding and necessary coordination with Nombre49441 of MOPT and other competent institutions to provide a prompt solution to said situation.” By official letter dated May 20, 2023, the complainant indicated to the Municipality of Golfito that she misses follow-up on the case and requested the cleaning of the gutters (caños). By official letter DRB-03-2023-1286 (0659) of September 27, 2023, the Conavi informed the protected party: “Conclusions Regarding the inspection carried out on site, the following is concluded:  It is identified that the three stormwater drainage systems have an internal diameter of 900 mm, which, at their final discharge point, present sediment accumulation from the tide increase, which obstructs the continuous evacuation of stormwater.  It is not favorable to clean the sediments of the storm drains manually, since when the tide level increases, the sediments re-enter the drainage system and it becomes obstructed again.  The necessary topographic and hydrological studies will be carried out through the procedure called: Contratación Directa 2022CD-000145- 0006000001, Dirección2813, awarded to the contractor Quebradores del Sur S.A., to carry out the respective stormwater drainage designs, adjusted to site conditions and with sufficient hydraulic capacity, to solve the problem in the short term. Currently, the execution of the contract is suspended, as there is not enough economic content to continue with routine and periodic maintenance activities associated with the improvement of stormwater drainage systems; however, it will remain among the priorities to be executed by this Zone 4-3 Engineering during the first quarter of 2024.  Within the functions and/or competencies of the Road and Bridge Conservation Management, the improvement of the hydraulic capacity of stormwater drainage systems within the right-of-way (derecho de la vía) is included, but not the execution of works within the mangrove, given that it corresponds to other institutions, whether the Municipality of Golfito and/or the National Commission for Risk Prevention and Emergency Response (CNE), to manage this type of cleaning within their competencies. Recommendations  This Zone 4-3 Engineering will make the request to the Road and Bridge Conservation Management for the necessary economic content to reactivate the continuity of Contratación Directa 2022CD-000145-0006000001, Line 18, Zone 4-3, so that the topographic, hydrological, and final design studies of the adequate stormwater drainage system, adjusted to site conditions, can be carried out.” By official letter CME-GOL-004-2024 of March 6, 2024, the mayor of Golfito requested a deputy of the Republic to convene a dialogue table with the CNE, MOPT, MINAE, Conavi, SINAC, and the Courts of Justice of Golfito to address the problem of the flooding that has occurred in recent years. By memorial OF-MG-UTG-343-12-2024 of December 3, 2024, the Technical Road Management Unit of Golfito informed the vice-mayor in relation to the protected party's case that there are accesses with piping or slabs that do not meet the corresponding diameter for the amount of stormwater that flows through them; therefore, the process of identifying the owners to grant them a reasonable period for replacement has begun. Furthermore, it was indicated that ditch (cunetas) cleaning will be included in the quarterly programming for 2025. Likewise, it was clarified that this would not solve the problem until the matters concerning national route no. 14 are addressed. By memorial CME-GOL-005-2025 of February 5, 2025, the Municipal Emergency Committee of Golfito consulted the Road and Bridge Conservation Management about the status of the protected party's case. By official letter CARTA-CONAVI-DRB-04-2025-0900 (0455) of October 1, 2025, the Road and Bridge Conservation Management of Conavi indicated to a trustee of the District Council of Golfito in relation to the cleaning of the Barrio Alamedas culvert: “As part of the follow-up to this action, an on-site inspection was coordinated on August 12. During said visit, it was verified that the images attached to the municipal official letter correspond to a sewer system belonging to a cantonal street parallel to Dirección1174, as shown in Figure 1. Therefore, the maintenance of that infrastructure falls within the scope of competencies of the Municipality, not of CONAVI. During the tour and conversations with neighbors, it was indicated that the observed difficulties would have increased after the asphalt layer intervention carried out by the Municipality approximately two years ago. The possibility that debris from said works may have caused obstructions in the system was identified, which was visually corroborated. Consequently, it is recommended that the Municipality of Golfito carry out an inspection of the cantonal stormwater system in order to apply the corresponding corrections. Regarding the infrastructure under CONAVI's responsibility, it was determined that the nearest culvert on the Dirección2815 is located at km 24+878. This structure discharges directly into a mangrove ecosystem, where the tidal dynamics cause sediment ingress and limit the optimal evacuation of stormwater (…) It should be remembered that the direct attention to works within a mangrove does not correspond to the competencies of this Zone 4-3 Engineering, given that due to its protection they are outside our scope. Being an ecosystem protected by law, any intervention requires the authorization of the National System of Conservation Areas (SINAC). By virtue of the foregoing, a consultation is made with the Osa Conservation Area of SINAC, in order to define the technical and legal procedure applicable for this type of infrastructure in a protected area.” By official letter CARTA-CONAVI-DRB-04-2025-0901 (0475) of October 1, 2025, the Road and Bridge Conservation Management informed the Osa Conservation Area of the National System of Conservation Areas: “By this means, Zone 4-3 Engineering of the National Road Council (CONAVI) is allowed to make this consultation regarding the culvert located at Dirección2817, control section 60252, on the Dirección2816, whose discharge flows directly into a mangrove ecosystem. During inspection and maintenance work, the need to execute cleaning and unblocking works in said structure has been detected, in order to guarantee adequate stormwater drainage and road safety. However, since the mangrove is an ecosystem protected by law, we understand that any action that may imply direct or indirect affectation must have the due authorization of the competent environmental authority. In compliance with the provisions of the Maritime-Terrestrial Zone Law (Ley de la Zona Marítimo Terrestre, Law No. 6043), its Regulations (Decreto Ejecutivo No. 7841-P), and the Forestry Law (Ley Forestal, Law No. 7575), we respectfully request that this SINAC Regional Coordination indicate the procedure to follow, and the technical and legal requirements, in order to proceed in accordance with current regulations.” On October 21, 2025, the Ministry of Health issued technical inspection report MS-DRRSBRU-DARS-G-IT-0923-2025, through which it indicated: “it is possible to demonstrate that there are limitations in the existing stormwater drainage networks in the Dirección2818, related to design, configuration, maintenance, and adaptation to the required capacities as preventive and corrective actions. It is possible to demonstrate an absence of lined gutters and ditches (caños y cunetas revestidos), deficient control of weeds and plant debris in drains along road rondas and property fronts, lack of maintenance of rondas and street fronts of properties, obstructions in drains at property entrances, absence of manhole (cajas de registro) covers and protective grates in openings of the sewer system, damage to the asphalt layer in sectors of the cantonal route street (culvert crossing on the line behind the Courts of Justice and culvert crossing adjacent to the Dirección2810), sections of the storm sewer completely obstructed with mud and sand sediments, flooded areas in low sectors, discharge points into the mangrove area obstructed and flooded and with the presence of fauna (fish and freshwater turtles), impacts on properties and structures, including the properties and facilities where the Courts of Justice of Golfito and the PANI operate, and private residential properties and structures. Responsibility for actions in these stormwater drainage systems involves property owners regarding street fronts and entrances of each property, the Municipality of Golfito regarding the cantonal route street network and stormwater drainage network, authorities of the Ministry of Public Works and Transport regarding actions on the section of National Route Number 14, especially water crossings and discharge points, and competent authorities of the Ministry of Environment and Energy regarding discharges into the mangrove area, possible channeling, and relocation of fauna; aspects that must be assessed. The Ministry of Health – Governing Health Area Directorate of Golfito will proceed to analyze the competencies of each cited institution and, if necessary, will issue administrative acts with the actions aimed at the corrections corresponding to each one.”

This being the case, in the present case (sub examine), diligent and swift action on the part of the Municipality of Golfito, as well as the MOPT and Conavi, is missed in order to address the problem reported by the claimant regarding the flooding of Barrio Alamedas. Regarding this, from the evidence it is gathered that, by memorial DRB-112-2023-0434 of March 20, 2023, the Road and Bridge Conservation Management informed the defendant local corporation that “the presence of large amounts of sediment and stagnant water was observed in the stormwater drainage structures that cross the Dirección2804, specifically near the seat of the Judicial Branch and the PANI, as well as at the intersection toward the Depósito Libre Comercial Golfito; structures that in principle, it would be assumed require extreme cleaning; however, it has been determined that there is no possibility of doing it efficiently, given the proximity to the mangrove, since as the tide rises, a natural barrier to the optimal outflow of stormwater coming down from the mountains and the buildings of Barrio Alamedas is presented; furthermore, this presence of tide generates an effect of sandy sediment entering the structure”; moreover, by official letter DRB-03-2023-1286 (0659) of September 27, 2023, the Conavi informed the protected party that “This Zone 4-3 Engineering will make the request to the Road and Bridge Conservation Management for the necessary economic content to reactivate the continuity of Contratación Directa 2022CD-000145-0006000001, Dirección2802, so that the topographic, hydrological, and final design studies of the adequate stormwater drainage system, adjusted to site conditions, can be carried out.” Despite this, it was not until October 1, 2025, that Conavi sent an official letter to SINAC for the purpose of consulting on the procedure to follow to execute cleaning and unblocking works on national route no. 14, whose discharge flows directly into a mangrove.

In the case of the local government of Golfito, observe that, since March 2023 it informed the protected party that “Ing. Nombre49440 (sic) was requested to make a detailed inspection and carry out all the necessary corresponding actions to provide a prompt solution to said situation.” Furthermore, memorial OF-MG-UTG-343-12-2024 of December 3, 2024, the Technical Road Management Unit of Golfito informed the vice-mayor in relation to the protected party's case that there are accesses with piping or slabs that do not meet the corresponding diameter for the amount of stormwater that flows through them; therefore, the process of identifying the owners to grant them a reasonable period for replacement has begun. Furthermore, it was indicated that ditch (cunetas) cleaning will be included in the quarterly programming for 2025. Despite this, there is no evidence that the municipal corporation has executed what is necessary to diligently address the problem that is the subject of this matter.

This being the case, in the matter under judgment (sub iudice), the lack of resolution of the problem that is the subject of this study is evident, a resolution that must come from joint work between the Municipality of Golfito, the MOPT, and the Conavi, which is why the proper course is to grant the appeal in the terms indicated in the operative part of this pronouncement.

V.- On the other hand, regarding the Ministry of Health, the Chamber verifies that, even though through the writing with the received stamp of that ministerial portfolio dated March 6, 2023, the claimant reported that in the Dirección2806 the culvert in front of the house of Nombre49452 is clogged with sand, mud, and dirty water that does not flow; even, there is residue of raw sewage (aguas negras), it is no less true that there is no probative element whatsoever that allows accrediting that the aforementioned ministry has formally addressed such action. Therefore, the matter is granted regarding this issue.

VI.- NOTE OF MAGISTRATE Nombre41880. I consider it pertinent to note that, since judgment no. 2019002355 of 9:30 a.m. on February 12, 2019, my position has been the following in relation to amparo appeals when they have been filed on behalf of a legal entity (persona jurídica):

“in Advisory Opinion 22-16 of February 26, 2016, the Inter-American Court of Human Rights indicated that although some States recognize the right to petition for legal entities (personas jurídicas) with special conditions, such as unions, political parties, or representatives of indigenous peoples, Afro-descendant communities, or specific groups, the truth is that ‘Article 1.2 of the American Convention only enshrines rights in favor of natural persons (personas físicas), so legal entities (personas jurídicas) are not holders of the rights enshrined in said treaty.’ On the other hand, in the same advisory opinion, the Inter-American Court provided that, in certain particular contexts, natural persons (personas físicas) may come to exercise their rights through legal entities (personas jurídicas) (for example, through a media outlet, as occurred in the case of Nombre32579 et al. v. Venezuela); however, for this to be protectable before the inter-American system, ‘the exercise of the right through a legal entity (persona jurídica) must involve an essential and direct relationship between the natural person (persona natural) requiring protection from the inter-American system and the legal entity (persona jurídica) through which the violation occurred, as a simple link between both persons is not sufficient to conclude that the rights of natural persons (personas físicas) and not of legal entities (personas jurídicas) are indeed being protected. In effect, one must prove beyond the simple participation of the natural person (persona natural) in the activities proper to the legal entity (persona jurídica), in such a way that said participation is substantially related to the rights alleged to be violated.’ (emphasis added) (OC. 22/16).”

In this case, an essential relationship is inferred from the record between the argued harm to a legal entity (persona jurídica) and the eventual injury to a natural person (persona física), which is why I deem it appropriate to hear the merits of the matter.

VII.- NOTE OF MAGISTRATE Nombre277. In principle, I consider that cases related to the activity or inactivity of the Public Administration in the repair, construction, modification, or demolition of any infrastructure work must be dismissed, because that omission constitutes a matter of legality, the discussion of which corresponds to the ordinary jurisdiction, before which the interested party can debate, with greater amplitude, their disagreements. However, when from that administrative conduct (omissive or not) some violation of other fundamental rights protected in this constitutional jurisdiction is derived, or groups considered vulnerable are affected, I do proceed to hear the merits of the matter, as this situation constitutes an exception to my position in this matter, just as occurs in this case, in which the appellant accuses that she has presented numerous complaints before the respondent party due to the lack of drainage, the poor condition and obstruction of the ditches (cunetas), the deterioration of gutters (caños) and manholes (cajas de registro), as well as garbage accumulation, and, as of the date of filing the amparo, nothing has been answered or resolved, which causes flooding that affects the locality and her property.

VIII.- DOCUMENTATION PROVIDED TO THE FILE. The parties are advised that, if they have provided any paper document or objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic device or one produced by new technologies, these must be withdrawn within a maximum period of 30 working days, counted from the notification of this judgment. It is warned that any material not collected within that period will be destroyed, based on the “Regulation on Electronic Files before the Judicial Branch” (approved by the Full Court in article XXVI of session no. 27-11 of August 22, 2011, and published in Boletín Judicial no. 19 of January 26, 2012) and in article LXXXI of the session of the Superior Council of the Judicial Branch no. 43-12 of May 3, 2012.

Therefore (Por tanto):

The appeal is granted. Nombre35264, Nombre35265, and Nombre49440 are ordered, in their respective capacities as mayor, coordinator of the Municipal Emergency Committee, and engineer of the Technical Road Infrastructure Management, all of the Municipality of Golfito, Nombre42179, in his capacity as minister of the Ministry of Public Works and Transport, and Nombre48807, in his capacity as executive director a.i. of the National Road Council, or whoever occupies those positions, as well as whoever holds the positions of Road and Bridge Conservation manager and Brunca Regional director, both of the National Road Council, to coordinate what is necessary and carry out all actions within the scope of their respective competencies so that: 1) within FIVE DAYS, counted from the notification of this pronouncement, an inter-institutional commission is created to address the problem set forth by the appellant regarding the flooding that has occurred in Barrio Alamedas; and 2) within ONE MONTH, counted from the creation of the aforementioned inter-institutional commission, a plan is designed to address the problem that is the subject of this appeal. Furthermore, Nombre49449 is ordered, in his capacity as director of the Governing Health Area of Golfito of the Ministry of Health, or whoever occupies that position in his stead, to coordinate what is necessary and carry out all actions within the scope of his competencies, so that, within a maximum period of TWO MONTHS, counted from the notification of this pronouncement, the complaint filed by the protected party on March 6, 2023, is resolved in accordance with the applicable law and the corresponding notification is made to the means indicated for such purposes. The foregoing is issued with the warning that, based on the provisions of Article 71 of the Law of Constitutional Jurisdiction, imprisonment of three months to two years, or a fine of twenty to sixty days, will be imposed on those who receive an order that they must comply with or enforce, issued in an amparo appeal, and who do not comply with it or do not enforce it, provided that the offense is not more severely penalized.

The Municipality of Golfito, the Consejo Nacional de Viabilidad, and the State are ordered to pay the costs, damages, and losses caused by the acts that serve as the basis for this declaration, which shall be liquidated in the execution of the judgment of the contentious-administrative proceedings.
