para los contratos a formalizar en el período 2024 y 2025

AMBIENTE Y ENERGÍA San José, a
doce horas con cincuenta y cinco minutos del veintisiete de agosto del dos mil
veinticuatro. Se establece al Fondo Nacional de Financiamiento Forestal la
cantidad de hectáreas a financiar para la actividad de protección de bosque del
Programa de Pago por Servicios Ambientales o Ecosistémicos y el monto a pagar
con base en los recursos disponibles.

RESULTANDO

ÚNICO. - Que para el
ejercicio 2024 el Presupuesto Nacional dispone un total de trece mil cuatro cientos
noventa y seis millones seis cientos veintitrés mil cincuenta y tres colones
con 00/100 (¢13.496.623.053,00) para el Programa de Pago por Servicios
Ambientales, los cuales serán utilizados para el pago de los compromisos de
contratos PSA de años anteriores y la incorporación de nuevas hectáreas en
Protección de Bosque para los años 2024 y 2025.

CONSIDERANDO

1°-Que el artículo 38 del Reglamento a la Ley Forestal
N° 7575, Decreto Ejecutivo N° 25721- MINAE, publicado en el Diario Oficial La
Gaceta N° 16 del día 23 de enero de 1997, y sus reformas; dispone que el
Ministro de Ambiente y Energía como Jerarca del Ministerio de Ambiente y
Energía, en funciones de la Administración Forestal del Estado, emitirá
mediante Resolución Ministerial, la actividad a financiar en el Programa de
Pago por Servicios Ambientales o Ecosistémicos y los montos a pagar con base en
los recursos disponibles.

2°-Que bajo este principio, los instrumentos
financieros deben orientarse a apoyar los pilares del Plan Nacional de
Desarrollo y de Inversión Pública 2023-2026 (Rogelio Fernández Güell) considerando
los objetivos de la creación del Fondo Nacional de Financiamiento Forestal
según la citada Ley Forestal, sin dejar de lado los criterios de orden técnico
establecidos.

3°-Que el Plan Nacional de Desarrollo citado,
considera como una de las metas nacionales el mantener bajo el Programa de Pago
por Servicios Ambientales o Ecosistémicos, al menos doscientas cincuenta mil
hectáreas (250.000 has), en sus diferentes actividades.

4°-Que la reforma al Reglamento a la Ley Forestal,
realizada mediante Decreto Ejecutivo N° 44607-MINAE publicado en el Alcance
número 145 a La Gaceta N° 156; establece cambios de fondo al Programa de Pago
por Servicios Ambientales o Ecosistémicos, para reconocer de manera independiente
los diferentes servicios ambientales a pagar. Para tales efectos, se establecen
tres servicios ambientales a reconocer: 1-un pago base, que comprende los
bosques con la función de mitigación de gases de efecto invernadero y
protección de la biodiversidad; 2-un pago adicional a los bosques que se
ubiquen en áreas consideradas de alta biodiversidad, megadiversos o zonas que por
su fragilidad, conectividad o deterioro que merecen ser preservadas y 3- se
reconoce un pago adicional a los bosques que por su ubicación coadyuven a la
protección del recurso hídrico para fines de consumo humano, rural e hidroeléctrico.

5º- Que la propuesta de los montos a reconocer por
hectárea, para cada servicio ambiental reconocido, pretende reajustar el monto
a un esquema basado en dos aspectos particularmente importantes: el primero, no
se pagará más el servicio ambiental de belleza escénica, ya que ni el mercado
interno ni externo lo reconocen, a pesar de sus beneficios; y el segundo, que
para los montos a reconocer, corresponde a los valores revelados en los
mercados internos y externos, relacionados a la reducción de emisiones de CO2
equivalentes de los bosques.

POR TANTO:

EL MINISTRO DE
AMBIENTE Y ENERGÍA

RESUELVE

Artículo 1°-Establecer el límite de gasto al Fondo Nacional de
Financiamiento Forestal, para los contratos a formalizar en el período 2024 y
2025 en la modalidad de mantenimiento de la cobertura forestal, actividad de
Protección de Bosque y los montos de pago a reconocer.

1. Actividades
a financiar: Para los años 2024 y 2025,
se considerará la actividad de Protección de bosque. Para tal fin, se establece
la siguiente distribución:

Si una finca se
encuentra ubicada dentro de las capas geoespaciales correspondientes a recurso hídrico
y alta biodiversidad, serán elegibles para recibir un reconocimiento adicional.
Este beneficio se otorgará de manera complementaria, sujeto a la disponibilidad
del presupuesto asignado.

El Fondo
Nacional de Financiamiento Forestal, podrá variar la distribución establecida
en el cuadro anterior, de acuerdo con la disponibilidad del presupuesto para el
Programa de Pago por Servicios Ambientales o Ecosistémicos.

De disponer de
una mayor asignación de recursos, según el artículo 5 de la Ley de
Simplificación y Eficiencia Tributarias N° 8114 publicada en La Gaceta N° 131,
del día 9 de julio de 2001 u otros recursos financieros que capte el Fonafifo
para el Pago por Servicios Ambientales, se distribuirán según el criterio de
los financiadores y de las autoridades del Ministerio o autoridades correspondientes.
En todo caso, los recursos utilizados para estos fines deberán ser incorporados
en el presupuesto institucional o al Fideicomiso 544 Fonafifo/BNCR.

2. De los
montos de pago por actividad y otras condiciones:

2.1. Para la
actividad de Protección de bosque: Las condiciones
que regirán para el trámite de solicitudes, para el reconocimiento de los
Servicios Ambientales o Ecosistemicos en esta actividad, son las siguientes:

a) El monto
para pagar por el servicio ambiental de mitigación de gases de efecto
invernadero y biodiversidad considerado como la base, será de ciento cinco mil
colones exactos (?105.000,00) por hectárea, desembolsados durante un período de
cinco años; distribuidos en pagos
anuales del 20% cada uno.

b) El monto
para pagar por el servicio ambiental de mitigación de gases de efecto
invernadero y biodiversidad considerado como la base, más un adicional por el
servicio de protección del recurso hídrico considerado como un plus, será
de ciento ochenta y cinco mil colones con 00/100 (¢185,000.00) por hectárea,
desembolsados durante un período de cinco años; distribuidos en pagos anuales del 20% cada uno.

c) El monto para pagar por el servicio ambiental de mitigación de gases de efecto invernadero y
biodiversidad considerado como la base, más un adicional por el servicio de protección de sitios de
alta biodiversidad considerado como un plus, será de ciento ochenta y cinco mil colones con 00/100
(¢185,000.00) por hectárea, desembolsados durante un período de cinco años; distribuidos en pagos
anuales del 20% cada uno.

d) El monto a pagar por la combinación de la base, recurso hídrico y alta biodiversidad será de
doscientos sesenta y cinco mil colones con 00/100 (¢265,000) por hectárea, distribuidos en pagos
anuales del 20% cada uno.

2.2.
Actualización de los montos a pagar. Para los
pagos anuales posteriores el MINAE, mediante resolución razonada podrá variar
estos montos y actualizarlos, de igual forma podrá decretar aumentos
extraordinarios en los montos a pagar, lo anterior considerando la disponibilidad
presupuestaria y su inclusión en los presupuestos correspondientes.

Artículo 2°-Se instruye al Fondo
Nacional de Financiamiento Forestal para que incorpore en los contratos
de Pago por Servicios Ambientales o Ecosistemas las siguientes condiciones:

1. De los
plazos de vigencia de los contratos: Los plazos de vigencia de los contratos de

Pago por
Servicios Ambientales o Ecosistémicos, generados por
la actividad de Protección de Bosque, que corresponde a la modalidad de
Mantenimiento de la Cobertura Forestal será el siguiente:

a) Los contratos
correspondientes a la actividad de Protección de Bosque relacionados a la
mitigación de gases de efecto invernadero y biodiversidad; así como aquellos
que contemplen el reconocimiento adicional recurso hídrico y/o alta
biodiversidad, tendrán una vigencia de 5 años a partir de la fecha en que se
presenta la solicitud de ingreso al Fondo Nacional de Financiamiento Forestal.

2.
Consideraciones especiales. Condiciones establecidas para los montos y actividades de las
solicitudes PSA:

2.1. En los proyectos de pago por
servicios ambientales, el Fondo Nacional de Financiamiento Forestal podrá
establecer a favor de las personas beneficiarias, montos diferenciados de los
pagos de servicios ambientales, según la zona, modalidad, actividad, oferta y
demanda cuando así lo ameriten por razón de oportunidad y conveniencia.

2.2. En el caso de las
solicitudes de ingreso que se presenten para acceder al Programa de Pago por
Servicios Ambientales o Ecosistémicos, deberán de
indicar el lugar para notificaciones, correo electrónico de la persona solicitante
para recibir notificaciones, número de teléfono de o las personas propietarias
del inmueble, o la que será beneficiaria del PSA. Sin toda esta información la
Administración estimará como incompleta la solicitud y procederá a su archivo.

Dicha información
es fundamental para el proceso de notificación del PPSA.

2.3. En caso de que en las
solicitudes presentadas se determinara la existencia de traslapes o
desplazamiento entre ellas y/o con otras fincas, el Fonafifo
valorará de acuerdo con criterios técnicos y legales la aprobación o no de las
solicitudes de ingreso.

2.4. Las solicitudes de ingreso a
la actividad de protección que son valoradas según la Matriz de Calificación y
que presentan varias fincas; la calificación dependerá de la finca de mayor
tamaño que se incluya en la solicitud.

2.5. Para inmuebles que se
encuentren sobre el límite de las áreas prioritarias, se considerarán para
efectos de la actividad de protección de bosque aquellos inmuebles que al menos
tengan un 30% dentro de dichas áreas.

2.6. Para el reconocimiento
adicional por la protección del recurso hídrico y/o el de alta biodiversidad
los inmuebles deberán de estar al menos en un 30% dentro de las áreas definidas
para este reconocimiento. Para el caso de los territorios indígenas los
inmuebles deberán de estar al menos en un 15% dentro de las dichas áreas.

2.7. El proyecto deberá contar
con un profesional forestal para la formalización del contrato y realizar las
visitas a los proyectos en los años 3 y 5 de la vigencia del contrato. El
profesional forestal debe estar acreditado ante el Colegio de Ingenieros
Agrónomos

2.8. Para cubrir el costo de
inscripción del contrato ante el Registro Nacional, el Fondo Nacional de
Financiamiento Forestal retendrá del primer desembolso un 0,6%. del monto total
del contrato.

2.9. El Fonafifo
realizará el trámite de pago de los contratos con morosidad según lo
establecido en la Ley N°9686 y sus modificaciones; en donde, la CCSS estableció
el procedimiento que las instituciones del Estado deben de seguir ante personas
beneficiarias que están morosas con la CCSS.

2.10. Los montos pendientes por
pagar para los contratos de años anteriores se regirán según lo establecido en
los Decretos Ejecutivos y Resoluciones Administrativas correspondientes para cada
año.

2.11. Para los pagos no tramitados
antes del año 2024 en forma oportuna; se establece un plazo de 18 meses de
caducidad, para el reclamo de cuotas derivadas de los contratos de pago por
servicios ambientales, en todas sus modalidades a partir del momento en que
fuese exigible tal obligación, salvo que se presente una justificación
aceptable para Fonafifo de acuerdo con los principios
de razonabilidad y proporcionalidad. Esta caducidad no afectara la vigencia del
contrato.

2.12. Los recursos recuperados en
virtud de los incumplimientos de contratos de pago por servicios ambientales o
las devoluciones o finiquitos, serán transferidos al Fideicomiso 544
FONAFIFO/BNCR y serán presupuestados para la ejecución de nuevas actividades de
fomento de pequeños y medianos productores.

2.13. Las solicitudes recibidas
durante el año 2024 que, por razones operativas y logísticas, no pudieron ser
tramitadas al término de ese año, serán gestionadas durante el primer semestre
del año 2025, en el entendido que, de conformidad con el artículo 116 del
Reglamento a la Ley Forestal, Fonafifo podrá
considerar para la vigencia del contrato los meses que transcurrieron desde la
presentación de la solicitud.

                        Establishes the spending limit for the National Forest Financing Fund,
for contracts to be formalized in the period 2024 and 2025

ENVIRONMENT AND ENERGY, San José, at
twelve hours and fifty-five minutes on the twenty-seventh of August, two thousand
twenty-four. The amount of hectares to be financed for the forest protection activity of the
Payment for Environmental or Ecosystem Services Program and the amount to be paid
based on available resources are established for the National Forest Financing Fund.

WHEREAS

SOLE. - That for the
2024 fiscal year, the National Budget allocates a total of thirteen thousand four hundred
ninety-six million six hundred twenty-three thousand fifty-three colones
with 00/100 (¢13,496,623,053.00) for the Payment for Environmental Services Program, which will be used for the payment of commitments from
PSA contracts from previous years and the incorporation of new hectares in
Forest Protection for the years 2024 and 2025.

CONSIDERING

1°-That Article 38 of the Regulation to the Forest Law
No. 7575, Executive Decree No. 25721-MINAE, published in the Official Gazette La
Gaceta No. 16 on January 23, 1997, and its amendments; provides that the
Minister of Environment and Energy, as Head of the Ministry of Environment and
Energy, acting as the State Forest Administration, shall issue,
through a Ministerial Resolution, the activity to be financed in the Payment
for Environmental or Ecosystem Services Program and the amounts to be paid based on
the available resources.

2°-That under this principle, financial
instruments must be oriented to support the pillars of the National Development
and Public Investment Plan 2023-2026 (Rogelio Fernández Güell), considering
the objectives of the creation of the National Forest Financing Fund
according to the cited Forest Law, without neglecting the established technical
criteria.

3°-That the cited National Development Plan,
considers as one of the national goals to maintain under the Payment
for Environmental or Ecosystem Services Program at least two hundred fifty thousand
hectares (250,000 has), in its different activities.

4°-That the amendment to the Regulation to the Forest Law,
made through Executive Decree No. 44607-MINAE published in Alcance
number 145 to La Gaceta No. 156; establishes fundamental changes to the Payment
for Environmental or Ecosystem Services Program, to independently recognize
the different environmental services to be paid. For such purposes, three
environmental services to be recognized are established: 1-a base payment, which includes
forests with the function of greenhouse gas mitigation and
protection of biodiversity; 2-an additional payment to forests that
are located in areas considered high biodiversity, megadiverse or areas that
due to their fragility, connectivity, or deterioration deserve to be preserved and 3-
an additional payment is recognized to forests that due to their location contribute to the
protection of the water resource for human consumption, rural, and hydroelectric purposes.

5º- That the proposal of the amounts to be recognized per
hectare, for each recognized environmental service, aims to readjust the amount
to a scheme based on two particularly important aspects: the first, the
environmental service of scenic beauty will no longer be paid, since neither the domestic
nor the external market recognizes it, despite its benefits; and the second, that
the amounts to be recognized correspond to the values revealed in the
domestic and external markets, related to the reduction of CO2 equivalent
emissions from forests.

THEREFORE:

THE MINISTER OF
ENVIRONMENT AND ENERGY

RESOLVES

Article 1°-To establish the spending limit for the National Forest
Financing Fund, for the contracts to be formalized in the period 2024 and
2025 in the modality of maintenance of forest cover (cobertura forestal), activity of
Forest Protection, and the payment amounts to be recognized.

1. Activities
to be financed: For the years 2024 and 2025,
the activity of Forest Protection will be considered. For this purpose, the
following distribution is established:

If a property is
located within the geospatial layers corresponding to water resource
and high biodiversity, they will be eligible to receive additional recognition.
This benefit will be granted complementarily, subject to the availability
of the allocated budget.

The National
Forest Financing Fund may vary the distribution established
in the previous table, according to the availability of the budget for the
Payment for Environmental or Ecosystem Services Program.

If a greater
allocation of resources is available, according to Article 5 of the Tax
Simplification and Efficiency Law No. 8114 published in La Gaceta No. 131,
on July 9, 2001, or other financial resources that Fonafifo captures for
the Payment for Environmental Services, they will be distributed according to the criteria
of the financiers and the authorities of the Ministry or corresponding authorities.
In any case, the resources used for these purposes must be incorporated
into the institutional budget or into Fideicomiso 544 Fonafifo/BNCR.

2. Of the
payment amounts per activity and other conditions:

2.1. For the
activity of Forest Protection: The conditions
that will govern the processing of applications, for the recognition of the
Environmental or Ecosystem Services in this activity, are the following:

a) The amount
to be paid for the environmental service of greenhouse gas
mitigation and biodiversity considered as the base, will be one hundred five thousand
exact colones (₡105,000.00) per hectare, disbursed over a period of
five years; distributed in annual
payments of 20% each.

b) The amount
to be paid for the environmental service of greenhouse gas
mitigation and biodiversity considered as the base, plus an additional for the
service of protection of the water resource considered as a plus, will
be one hundred eighty-five thousand colones with 00/100 (₡185,000.00) per hectare,
disbursed over a period of five years; distributed in annual payments of 20% each.

c) The amount to be paid for the environmental service of greenhouse gas mitigation and
biodiversity considered as the base, plus an additional for the service of protection of sites of
high biodiversity considered as a plus, will be one hundred eighty-five thousand colones with 00/100
(₡185,000.00) per hectare, disbursed over a period of five years; distributed in annual
payments of 20% each.

d) The amount to be paid for the combination of the base, water resource, and high biodiversity will be
two hundred sixty-five thousand colones with 00/100 (₡265,000) per hectare, distributed in annual
payments of 20% each.

2.2.
Updating of the payment amounts. For subsequent
annual payments, MINAE, through a reasoned resolution, may vary
these amounts and update them, and similarly may decree extraordinary
increases in the amounts to be paid, the foregoing considering the budget
availability and its inclusion in the corresponding budgets.

Article 2°-The National Forest
Financing Fund is instructed to incorporate the following conditions into the contracts
for Payment for Environmental or Ecosystem Services:

1. Of the
terms of validity of the contracts: The terms of validity of the contracts for

Payment for
Environmental or Ecosystem Services, generated by
the activity of Forest Protection, which corresponds to the modality of
Maintenance of Forest Cover, will be the following:

a) The contracts
corresponding to the activity of Forest Protection related to the
mitigation of greenhouse gases and biodiversity; as well as those
that contemplate the additional recognition for water resource and/or high
biodiversity, will have a validity of 5 years from the date on which
the application for entry to the National Forest Financing Fund is submitted.

2.
Special considerations. Conditions established for the amounts and activities of the
PSA applications:

2.1. In payment for
environmental services projects, the National Forest Financing Fund may
establish, in favor of the beneficiaries, differentiated amounts for the
payments of environmental services, according to the zone, modality, activity, supply, and
demand when warranted for reasons of opportunity and convenience.

2.2. In the case of
entry applications submitted to access the Payment for
Environmental or Ecosystem Services Program, they must
indicate the place for notifications, email address of the applicant
to receive notifications, telephone number of the property owner(s),
or the person who will be the PSA beneficiary. Without all this information, the
Administration will consider the application incomplete and will proceed to its archiving.

Said information
is fundamental for the PPSA notification process.

2.3. In the event that in the
submitted applications, the existence of overlaps or
displacement between them and/or with other properties is determined, Fonafifo
will assess the approval or rejection of the
entry applications according to technical and legal criteria.

2.4. For entry applications to
the protection activity that are evaluated according to the Qualification Matrix and
that present several properties; the qualification will depend on the largest
property included in the application.

2.5. For properties that are
on the boundary of the priority areas, those properties that have at
least 30% within said areas will be considered for the purposes of the forest protection activity.

2.6. For the additional recognition
for the protection of the water resource and/or high biodiversity,
the properties must be at least 30% within the areas defined
for this recognition. In the case of indigenous territories, the
properties must be at least 15% within said areas.

2.7. The project must have
a forestry professional for the formalization of the contract and to carry out
the visits to the projects in years 3 and 5 of the contract validity. The
forestry professional must be accredited before the Colegio de Ingenieros
Agrónomos.

2.8. To cover the cost of
registration of the contract before the National Registry, the National Forest
Financing Fund will withhold 0.6% from the first disbursement of the total amount
of the contract.

2.9. Fonafifo
will process the payment of contracts in arrears according to the
provisions of Law No. 9686 and its amendments; where, the CCSS established
the procedure that State institutions must follow regarding
beneficiaries who are in arrears with the CCSS.

2.10. The amounts pending
payment for contracts from previous years will be governed as established in
the Executive Decrees and Administrative Resolutions corresponding to each
year.

2.11. For payments not processed
before the year 2024 in a timely manner; a lapse period of 18 months
is established for the claim of installments derived from the payment for
environmental services contracts, in all their modalities, from the moment that
such obligation became enforceable, unless an acceptable justification
is presented to Fonafifo in accordance with the principles
of reasonableness and proportionality. This lapse will not affect the validity of the
contract.

2.12. The resources recovered by
virtue of non-compliance with payment for environmental services contracts or
reimbursements or settlements, will be transferred to Fideicomiso 544
FONAFIFO/BNCR and will be budgeted for the execution of new activities for
the promotion of small and medium producers.

2.13. Applications received
during the year 2024 that, for operational and logistical reasons, could not be
processed by the end of that year, will be managed during the first semester
of the year 2025, with the understanding that, in accordance with Article 116 of the
Regulation to the Forest Law, Fonafifo may
consider for the validity of the contract the months that elapsed since the
submission of the application.
