MUNICIPALIDAD DE CARTAGO

El Concejo Municipal de Cartago, con sustento en los
artículos 169 y 170 de la Constitución Política, y en los artículos 13 inciso
c) y 43 del Código Municipal; aprobó de forma definitiva el Proyecto de Reforma
Integral del Reglamento de Uso y Control del Parque Ambiental Municipal Río
Loro, del 26 de mayo de 2009, Acta Nº 235-09, artículo 16, en sesión ordinaria
N° 289-2023 del 28 de noviembre del 2023, artículo N° 22

Para que en adelante se lea:

REGLAMENTO DE USO DE LAS INSTALACIONES DEL

PARQUE AMBIENTAL MUNICIPAL RÍO LORO.

CAPÍTULO I

Disposiciones generales

Artículo 1º-Parque Ambiental
Municipal Río Loro. El Parque Ambiental Municipal Río Loro (PAMRL) está
localizado en el cantón de Cartago, distrito San Nicolás, en La Angelina. El
área del inmueble donde se ubica mide 23 hectáreas y pertenece a la
Municipalidad de Cartago.

Tiene como objeto dar protección
efectiva al área de captación y los alrededores de la naciente Río Loro, para
mantener la calidad y cantidad del recurso hídrico y brindar un espacio para la
educación ambiental a la comunidad cartaginesa, además de áreas de
esparcimiento y recreación en armonía con el ambiente.

Artículo 2º-Ámbito de aplicación.
El presente Reglamento tiene por objeto definir los lineamientos para regular y
controlar el acceso, permanencia y uso de las instalaciones del Parque
Ambiental Municipal Río Loro (PAMRL) para asegurar la sostenibilidad del área,
del recurso hídrico de la naciente y cumplir con los objetivos de su creación.
Se aplicará al uso del terreno, instalaciones y planta física dentro de la
finca del parque ambiental.

Artículo 3º-Definiciones. Para
los efectos de este reglamento se entiende por:

ADMINISTRADORA: Persona funcionaria
municipal encargada del buen manejo y toma de decisiones para el adecuado
cumplimiento de los objetivos del Parque Ambiental Río Loro y los servicios que
se brindan en él.

ÁREA DE CAPTACIÓN: Sitio destinado para
el emplazamiento de una obra propuesta para obtener un cierto volumen de agua
subterránea y así satisfacer una determinada demanda.

AULA AMBIENTAL: Sala ubicada dentro
de un escenario de importancia para la estructura ecológica de un lugar, en la
cual se trabaja con propuestas pedagógicas que

tienen objetivos específicos sobre las
características naturales y los conflictos ambientales de las localidades donde
está inmersa.

CAPACIDAD DE CARGA: Número máximo de
personas visitantes que puede acoger un espacio sin provocar una alteración
inaceptable al medio ambiente y a sus condiciones ecológicas.

EDUCACIÓN AMBIENTAL: Proceso planificado
que busca la sensibilización de las personas para proteger el ambiente,
propiciar un desarrollo sostenible y un ambiente equilibrado, creando
conciencia y responsabilidad en ello para lograr actitudes positivas.

EXTENSIÓN E
INVESTIGACIÓN:
Actividad académica que pueden realizar estudiantes de diferentes niveles, para
la búsqueda e indagación científica que tiene por fin
generar ideas y acciones que posibiliten información para el mejoramiento de
las condiciones del PAMRL y de la calidad de vida de los pobladores cercanos.

FORMULARIO
DE SOLICITUD: Documento custodiado por la persona
administradora del Parque Ambiental que tiene por finalidad obtener información
básica de los visitantes y controlar los ingresos para recorridos guiados,
charlas o talleres.

NACIENTE: Punto en el que el agua
brota desde el suelo y la superficie del acuífero se encuentra con la
superficie del suelo.

RECORRIDOS GUIADOS:
Herramienta para transmitir conocimiento que consiste en una caminata por
senderos, en la compañía de un guía que muestra el sitio en detalle, explica
diversos aspectos y hace que el recorrido sea atractivo y educativo.

SENDERO: Ruta o guía que ha sido diseñada
de manera que por caminos se pueda visitar sitios específicos, observar e
interactuar con el paisaje y sus recursos naturales.

TALLER: Forma de enseñanza en la
cual un grupo trata un tema de una manera altamente participativa. Es un tipo
de aprendizaje práctico con el objetivo de traer algo de la
"realidad" al salón de clases para buscar una solución activa y
conjunta.

ZONA DE USO PÚBLICO:
Sector dominado por un ambiente natural donde se puede acoger aquellos
visitantes que llegan al lugar con fines de recreación, educación,
investigación y cualquier otro compatible con los objetivos de creación del
PAMRL.

ZONA DE USO RESTRINGIDO:
Sector que presenta un elevado grado de naturalidad, mantiene características
ecológicas importantes y es una zona frágil.

ZONA FRÁGIL: Zona que
ambientalmente puede deteriorarse con facilidad y en las que la intervención de
carácter andrógeno (del ser humano) puede desencadenar una serie de
alteraciones del ecosistema, que son una amenaza continua y llegar a ser irreversibles.

GUIA: Persona encargada de
dirigir un grupo de turistas y mostrarles los atractivos de la zona, ya sea a
través de tour, ruta o visita.

Artículo 4º-Servicios que brinda el PAMRL. El
PAMRL ofrece los siguientes servicios:

a.
Charlas y Talleres de Educación Ambiental: Estarán dirigidas a estudiantes de
primaria, secundaria, universitarios y grupos organizados de distinta índole,
que buscan educarse en temas ambientales.

b.
Recorridos guiados: Caminatas dirigidas en las cuales se informará y educará
sobre los temas que contemplan los senderos y los diferentes módulos
educativos.

c.
Uso de instalaciones para capacitaciones, reuniones y talleres: Se podrán
realizar reuniones, capacitaciones y talleres en el aula ambiental para
estudiantes de cualquier nivel, instituciones y grupos organizados de distinta
índole que buscan educarse en temas ambientales y/o desarrollar y promover
proyectos de interés ambiental y de desarrollo turístico sostenible, siempre
proyectados hacia la comunidad.

De
igual manera se podrán realizar actividades relacionadas con la gestión
municipal.

d.
Investigación y Extensión: Se podrán realizar proyectos de investigación y
extensión, los cuales deben solicitarse formalmente por una institución
científica o académica, y presentar una propuesta de plan de trabajo. Al
finalizar deben entregarse al Administrador del PAMRL, los resultados y la
documentación que haya generado el estudio o investigación.

La
selección de proyectos se adecuará a las siguientes prioridades:

.
Estudios sobre hidrología y recarga en el sitio.

.
Proyectos encaminados a resolver los problemas que plantea la gestión del PAMRL
en lo que respecta a la protección de éste y la compatibilidad del uso público
con la conservación del espacio protegido.

.
Proyectos asociados a la mejora de la calidad de la población haciendo énfasis
en educación ambiental.

.
Estudios sobre especies vegetales y animales que se encuentran en la zona.

e.
Los demás servicios que determine la Administración que correspondan a los
fines para los que fue creado el PAMRL.

CAPÍTULO II

De la Administración del PAMRL

Artículo 5º-De la persona Administradora del PAMRL.
La persona Administradora del PAMRL tiene las siguientes funciones:

a. Velar por el adecuado cumplimiento de este Reglamento.

b. Confeccionar, solicitar y ejecutar el presupuesto asignado al PAMRL.

c. Ejecutar la planificación del programa de mantenimiento de las
instalaciones del PAMRL.

d. Desarrollar el programa de educación ambiental del PAMRL, de acuerdo con
lo establecido en el artículo 4.

e. Aprobar o denegar las solicitudes de uso de las instalaciones del PAMRL,
conforme con los términos del presente reglamento, en forma justificada.

f. Comunicar a las personas usuarias del PAMRL, las recomendaciones u
órdenes, verbales o escritas, que se estimen pertinentes para el mejor
desarrollo de la actividad a realizar en el espacio cedido y suspender o
revocar de inmediato el permiso cuando éstas no sean cumplidas a satisfacción,
o se produzca algún uso indebido de las instalaciones.

g. Llevar el control de las actividades autorizadas en cuanto a fechas,
horarios o espacios, con la finalidad de procurar el mejor aprovechamiento de
las instalaciones y un servicio de calidad a los visitantes.

h. Mantener un registro de los permisos concedidos, ordenados
cronológicamente.

i. Mantener una estadística de las personas que ingresan al PAMRL.

j. Generar alternativas o iniciativas que propicien la sostenibilidad del
PAMRL.

k. Ser el enlace con la parte operativa del Área Técnica de Acueductos de
la Municipalidad de Cartago, a fin de que el área total del parque tenga la
operación y mantenimiento debido, protegiendo de esta forma el recurso hídrico
disponible en el lugar.

l. Las demás funciones atinentes con el cargo que determine la
Administración.

CAPÍTULO III

Uso de las instalaciones

Artículo 6º-Limitaciones de uso. Las instalaciones
del PAMRL solo podrán ser utilizadas para actividades relacionadas con
educación ambiental, protección del recurso hídrico, desarrollo turístico
sostenible y gestión municipal; por lo que toda autorización de uso contraria a
dichos fines se encuentra prohibida.

La Administración se encuentra facultada para ordenar la
suspensión inmediata de cualquier actividad que se desarrolle en oposición a
ese destino o que incumpla alguno de los requisitos de utilización, pudiéndose
hacer uso de la Policía Municipal y de la Fuerza Pública inclusive.

Artículo
7º-Modalidades de ingreso. Existen dos tipos o modalidades de ingreso:

a.
Ingreso por calendarización de espacios. En atención a las solicitudes
que realicen previamente las instituciones educativas, agencias de viajes y
otros grupos organizados.

Los
espacios y actividades se asignarán según la capacidad de carga del sitio y
disponibilidad de recursos materiales y recurso humano para atender dichos
grupos. Queda a discreción de la persona Administradora del PAMRL la asignación
de estos recursos y asignación de los servicios que se brindan.

Una
vez que se haya calendarizado un espacio y comunicado a la persona solicitante,
solo por razones de fuerza mayor o caso fortuito puede ser cancelado.

b.
Ingreso por desplazamientos espontáneos. Este es el caso de las personas que
visiten espontáneamente el PAMRL sin haber realizado una solicitud formal de
atención de un grupo.

Artículo 8º-Horario. El PAMRL permanecerá abierto
al público de miércoles a domingo (incluyendo días feriados) de las 8:00 a las
15:00 horas, sin perjuicio de lo que dispongan la Unidad Ambiental y/o la
persona que ocupa la Alcaldía Municipal.

En el lapso entre las 15:00 y las 16:00 horas, las
personas funcionarias del PAMRL se encargarán de retirar a los visitantes que
aún permanecen en los senderos, así como de inspeccionar las instalaciones de
los mismos, haciendo efectivo el cierre de las instalaciones del PAMRL a las
16:00 horas.

Artículo 9º-Trámite para solicitud de las
instalaciones. La persona interesada en reservar las instalaciones y/o los
servicios que brinda el PAMRL, deberá solicitarlo en forma escrita al menos
ocho días naturales antes de la fecha en la que desea ingresar, y mediante el
formulario que le suministrará la persona Administradora, ya sea en papel en
las oficinas del PAMRL o por medio de correo electrónico.

Recibida la solicitud, la Administración procederá a
verificar el cumplimiento de los requisitos. En caso de aprobarse, se
notificará la anuencia, así como las condiciones de uso de las instalaciones y
términos generales relativos a la visita.

Artículo 10.-Exoneración de responsabilidad. La
Municipalidad de Cartago no asumirá responsabilidad ante lesiones, discapacidad
o muerte de las personas visitantes y/o pérdida o daño a sus bienes, que ocurra
durante su estadía en el PAMRL.

Artículo 11.-Capacidad de carga de las instalaciones. Con base en estudio realizado por Onesimo
Geovanni Meléndez Mendoza, en el año 2019, como practica de graduación de la Universidad Autónoma
del Estado de México, se determina una capacidad de carga de 290 visitantes diarios para el PAMRL
según sus características de extensión, ubicación y recursos naturales.

Será responsabilidad de las personas funcionarias
municipales y efectivos de la seguridad municipal destacados en el PAMRL, velar
por que se respete dicha capacidad de carga y no se supere el máximo de
personas permitidas.

La Municipalidad podrá disponer en cualquier momento, por
razones de interés institucional, una carga de visitantes diarios menor a la
indicada.

Artículo 12.-Disposiciones de ingreso para las
personas visitantes. Son de acatamiento obligatorio para las personas
visitantes del PAMRL las siguientes disposiciones:

a.
Acatar las indicaciones y recomendaciones tanto de personas funcionarias
municipales como de los oficiales de seguridad, las cuales deberán estar
debidamente identificadas.

b.
No ingresar a las zonas de uso restringido. Por seguridad se deberá transitar
por los senderos o dentro de las zonas destinadas para uso público.

c. No ingresar al área de captación, que es una zona frágil.

d. No extraer plantas, animales, piedras o algún otro recurso natural.

e.
No ocasionar daños a la infraestructura con la que cuenta el lugar, ya que, los
mismos son bienes públicos, siendo responsable por su reparación.

f. Llevarse los residuos sólidos que generaron en su instancia en el PAMRL.

g. No ingresar con bicicletas, patinetas, patines, ni ningún otro elemento
recreativo.

h. No ingresar con animales, porque pueden alterar los procesos naturales
del parque.

i.
No generar ruido que perturbe los procesos naturales que se dan en el PAMRL.
Deberá moderar el volumen de voz y no utilizar radios o algún otro dispositivo
que genere sonidos no aptos para el área.

j. No se permiten conductas que alteren el orden público y las buenas
costumbres.

k.
No fumar, ingerir bebidas alcohólicas, utilizar petardos y cohetes de
artificio, productos y sustancias inflamables, tóxicas y peligrosas, elementos
punzocortantes y armas de fuego.

l. No acampar.

m.
No podrán ingresar niñas o niños menores de 12 años sin el acompañamiento de
una persona adulta responsable.

n.
No realizar actividades recreativas en los senderos del PAMRL, en la zona de
captación u en otra área que la administración considere necesaria.

o. No podrá cederse el permiso a personas u organizaciones diferentes a la
solicitante.

p. No podrá variarse la actividad autorizada sin la autorización previa de
la Administración.

Artículo 13.-Reserva del derecho de admisión. La
Municipalidad se reserva el derecho de admisión al parque ambiental, con el
objetivo de salvaguardar los recursos e instalaciones.

Artículo 14.-Seguridad en el PAMRL. La seguridad
de las personas funcionarias y visitantes y los recursos e instalaciones del
PAMRL, estará a cargo del Área de Seguridad Comunitaria y Policía Municipal.

Es obligación de los oficiales de seguridad municipal
poner en conocimiento de la Administración del PAMRL, sobre cualquier anomalía
o irregularidad ocurrida durante el desarrollo de las actividades dentro del
PAMRL, sin perjuicio de las facultades que conservan de adoptar las medidas
pertinentes e inmediatas que procuren cesar el acto o conducta irregular.

CAPÍTULO IV

Precio por concepto de ingreso y su cobro

Artículo 15.-Del Precio. La Municipalidad cobrará
un precio por concepto de ingreso a las instalaciones del PAMRL a todas las
personas visitantes en las siguientes categorías:

a. Adultos.

b. Adultos mayores.

c. Estudiantes.

d. Menores de edad.

e. Extranjeros.

El
precio se determinará conforme al artículo 83 del Código Municipal e incluirá el
costo efectivo en que incurra la Municipalidad por las actividades que
comprenden el servicio, más un diez por ciento (10%) de utilidad para
desarrollarlos.

Artículo 16.- De la Comisión Técnica. La administración
municipal integrará una Comisión Técnica para efectos de la actualización del
precio por concepto de ingreso, conformada por las siguientes personas
funcionarias:

a.
Analista de Costos.

b.
Unidad Ambiental.

c.
Administradora o administrador del PAMRL.

d.
Dirección Legal.

e.
Área Tributaria.

f.
Los departamentos correspondientes.

La Comisión Técnica preparará un anteproyecto de
propuesta de precios para estudio de la Alcaldía y aprobación del Concejo
Municipal, que entrará en vigencia treinta días después de su publicación en La
Gaceta.

Artículo 17.-Del Cobro. El cobro del precio de
ingreso lo hará un cajero humano o se realizará por cualquier otro medio de
pago que brinde el comprobante de ingreso a las personas visitantes.

El proceso de cobro estará a cargo de la Tesorería de la
Municipalidad.

Artículo 18.-Casos de excepción de cobro.
Únicamente estarán exceptuadas del pago de ingreso al PAMRL las siguientes
personas:

a.
Las beneficiarias de convenios suscritos con la Municipalidad, que tengan por
objeto el desarrollo y promoción de proyectos de interés ambiental y de
desarrollo turístico sostenible en el Parque Ambiental Municipal Río Loro.

b.
Estudiantes nacionales o extranjeros de instituciones públicas o privadas que
deseen realizar su trabajo comunal o voluntariado en el PAMRL.

c.
Estudiantes nacionales o extranjeros de instituciones públicas o privadas que
deseen realizar su práctica profesional en el parque ambiental, así como de
instituciones públicas o privadas y grupos de distinta índole que aporten
desarrollo y promoción de proyectos de investigación y extensión, de interés
ambiental y de desarrollo turístico sostenible, cuyos resultados deben ser
siempre proyectados hacia el mismo PAMRL o hacia la comunidad.

d.
Personas funcionarias municipales debidamente identificados con su carnet
vigente y únicamente cuando participen de actividades propias de la
institución.

e.
Las niñas y los niños menores de tres años de edad.

f.
Personas de instituciones participantes en iniciativas alrededor de la gestión
de proyectos de naturaleza ambiental turística y municipal.

Artículo 19.-Trámite de excepción de pago. Para
optar por esta excepción, las personas estudiantes indicadas en los incisos b.
y c. del artículo anterior, deberán aportar a la Administración del PAMRL,
oficio expedido por la institución educativa a la que pertenecen, mediante el
cual se solicite formalmente la admisión, que incluya el número de carnet o
cédula de identidad del estudiante y una descripción de la actividad a
desarrollar dentro del parque ambiental.

Adicionalmente, las personas estudiantes deberán aportar
una póliza de seguro contra todo riesgo, que se hará cargo de los daños
materiales y personales ocasionados al estudiante en el PAMRL.

La persona estudiante deberá firmar una declaración y
aceptación de que participa en actividades en el PAMRL bajo su propio riesgo y
de que exonera de toda responsabilidad a la Municipalidad de Cartago ante
cualquier lesión, discapacidad o muerte de su persona y/o pérdida o daño a sus
bienes, que ocurra durante su estadía en el PAMRL

En el caso de las personas del inciso f. del artículo
anterior, deberán solicitar la excepción de pago, por escrito a la
Administración del PAMRL, indicando el objetivo de la visita, el tiempo que permanecerán
en las instalaciones del parque, las actividades que allí realizarán, y el
nombre y número de identificación.

Rige a partir de la
publicación en el Diario Oficial La Gaceta, de acuerdo con lo dispuesto
en el artículo 43 del Código Municipal.

                        Comprehensive reform of the Regulations for the use of the facilities of the Río Loro Municipal Environmental Park

MUNICIPALITY OF CARTAGO

The Municipal Council of Cartago, based on articles 169 and 170 of the Political Constitution, and on articles 13 subsection c) and 43 of the Municipal Code; definitively approved the Project for the Comprehensive Reform of the Regulations for the Use and Control of the Río Loro Municipal Environmental Park, of May 26, 2009, Record No. 235-09, article 16, in ordinary session No. 289-2023 of November 28, 2023, article No. 22

So that henceforth it shall read:

REGULATIONS FOR THE USE OF THE FACILITIES OF THE

RÍO LORO MUNICIPAL ENVIRONMENTAL PARK.

CHAPTER I

General Provisions

Article 1—Río Loro Municipal Environmental Park. The Río Loro Municipal Environmental Park (PAMRL) is located in the canton of Cartago, San Nicolás district, in La Angelina. The area of the property where it is located measures 23 hectares and belongs to the Municipality of Cartago.

Its purpose is to provide effective protection to the catchment area and the surroundings of the Río Loro spring, to maintain the quality and quantity of the water resource and to provide a space for environmental education for the Cartago community, in addition to areas for leisure and recreation in harmony with the environment.

Article 2—Scope of application. The purpose of these Regulations is to define the guidelines for regulating and controlling access, stay, and use of the facilities of the Río Loro Municipal Environmental Park (PAMRL) to ensure the sustainability of the area, the water resource of the spring, and to fulfill the objectives of its creation. It shall apply to the use of the land, facilities, and physical plant within the environmental park property.

Article 3—Definitions. For the purposes of these regulations, the following definitions apply:

ADMINISTRATOR: Municipal employee responsible for the proper management and decision-making for the adequate fulfillment of the objectives of the Río Loro Environmental Park and the services provided therein.

CATCHMENT AREA: Site intended for the location of a proposed works to obtain a certain volume of groundwater and thus satisfy a specific demand.

ENVIRONMENTAL CLASSROOM: Room located within a setting of importance for the ecological structure of a place, in which pedagogical proposals are developed that

have specific objectives regarding the natural characteristics and environmental conflicts of the localities where it is immersed.

CARRYING CAPACITY: Maximum number of visitors that a space can accommodate without causing an unacceptable alteration to the environment and its ecological conditions.

ENVIRONMENTAL EDUCATION: Planned process that seeks to raise awareness among people to protect the environment, promote sustainable development and a balanced environment, creating awareness and responsibility to achieve positive attitudes.

OUTREACH AND RESEARCH: Academic activity that students of different levels can carry out, for scientific search and inquiry aimed at generating ideas and actions that provide information for the improvement of the conditions of the PAMRL and the quality of life of nearby residents.

APPLICATION FORM: Document held by the administrator of the Environmental Park whose purpose is to obtain basic information from visitors and control admissions for guided tours (recorridos guiados), talks, or workshops.

SPRING (NACIENTE): Point at which water emerges from the ground and the surface of the aquifer meets the ground surface.

GUIDED TOURS (RECORRIDOS GUIADOS): Tool for transmitting knowledge consisting of a walk along trails, accompanied by a guide who shows the site in detail, explains various aspects, and makes the tour attractive and educational.

TRAIL (SENDERO): Route or path that has been designed so that specific sites can be visited on foot, observing and interacting with the landscape and its natural resources.

WORKSHOP: Form of teaching in which a group addresses a topic in a highly participatory manner. It is a type of practical learning with the objective of bringing something from "reality" into the classroom to seek an active and joint solution.

PUBLIC USE ZONE: Sector dominated by a natural environment where those visitors who come to the place for recreation, education, research, and any other purpose compatible with the creation objectives of the PAMRL can be received.

RESTRICTED USE ZONE: Sector that presents a high degree of naturalness, maintains important ecological characteristics, and is a fragile zone.

FRAGILE ZONE (ZONA FRÁGIL): Zone that can environmentally deteriorate easily and in which anthropogenic (human) intervention can trigger a series of ecosystem alterations, which are a continuous threat and can become irreversible.

GUIDE: Person responsible for leading a group of tourists and showing them the attractions of the area, whether through a tour, route, or visit.

Article 4—Services provided by the PAMRL. The PAMRL offers the following services:

a. Environmental Education Talks and Workshops: These shall be aimed at primary, secondary, and university students and organized groups of various kinds, who seek education in environmental topics.

b. Guided tours (Recorridos guiados): Directed walks in which information and education will be provided on the topics covered by the trails (senderos) and the different educational modules.

c. Use of facilities for training, meetings, and workshops: Meetings, training, and workshops may be held in the environmental classroom for students of any level, institutions, and organized groups of various kinds seeking education in environmental topics and/or to develop and promote projects of environmental interest and sustainable tourism development, always projected towards the community.

Likewise, activities related to municipal management may be carried out.

d. Research and Outreach: Research and outreach projects may be carried out, which must be formally requested by a scientific or academic institution, and a proposed work plan must be presented. Upon completion, the results and documentation generated by the study or research must be delivered to the Administrator of the PAMRL.

The selection of projects shall conform to the following priorities:

. Studies on hydrology and recharge on the site.

. Projects aimed at resolving the problems posed by the management of the PAMRL regarding its protection and the compatibility of public use with the conservation of the protected space.

. Projects associated with improving the quality of the population, with emphasis on environmental education.

. Studies on plant and animal species found in the area.

e. Other services determined by the Administration that correspond to the purposes for which the PAMRL was created.

CHAPTER II

Administration of the PAMRL

Article 5—The Administrator of the PAMRL. The Administrator of the PAMRL has the following functions:

a. Ensure the proper compliance with these Regulations.

b. Prepare, request, and execute the budget assigned to the PAMRL.

c. Execute the planning of the maintenance program for the PAMRL facilities.

d. Develop the environmental education program of the PAMRL, in accordance with the provisions of article 4.

e. Approve or deny requests for the use of the PAMRL facilities, in accordance with the terms of these regulations, in a justified manner.

f. Communicate to the users of the PAMRL the pertinent recommendations or orders, verbal or written, deemed appropriate for the better development of the activity to be carried out in the assigned space, and immediately suspend or revoke the permit when these are not complied with satisfactorily, or if any misuse of the facilities occurs.

g. Control authorized activities regarding dates, schedules, or spaces, in order to ensure the best use of the facilities and quality service to visitors.

h. Maintain a record of granted permits, ordered chronologically.

i. Maintain statistics on the people who enter the PAMRL.

j. Generate alternatives or initiatives that promote the sustainability of the PAMRL.

k. Be the liaison with the operational part of the Technical Area of Aqueducts of the Municipality of Cartago, so that the total area of the park has the proper operation and maintenance, thereby protecting the water resource available at the site.

l. Other functions related to the position as determined by the Administration.

CHAPTER III

Use of the Facilities

Article 6—Use Limitations. The facilities of the PAMRL may only be used for activities related to environmental education, protection of the water resource, sustainable tourism development, and municipal management; therefore, any authorization for use contrary to these purposes is prohibited.

The Administration is empowered to order the immediate suspension of any activity that is carried out in opposition to that purpose or that fails to comply with any of the usage requirements, and may make use of the Municipal Police and even the Public Force.

Article 7—Admission Modalities. There are two types or modalities of admission:

a. Admission by scheduling of spaces. In response to requests made in advance by educational institutions, travel agencies, and other organized groups.

Spaces and activities will be assigned according to the carrying capacity of the site and availability of material resources and human resources to attend to these groups. The assignment of these resources and the services provided is at the discretion of the Administrator of the PAMRL.

Once a space has been scheduled and communicated to the applicant, it can only be canceled for reasons of force majeure or unforeseen circumstances.

b. Admission by spontaneous visits. This is the case for people who spontaneously visit the PAMRL without having made a formal request for group attention.

Article 8—Hours. The PAMRL shall be open to the public from Wednesday to Sunday (including holidays) from 8:00 a.m. to 3:00 p.m., without prejudice to what the Environmental Unit and/or the person holding the Mayor's Office may order.

In the period between 3:00 p.m. and 4:00 p.m., the PAMRL staff shall be responsible for removing visitors who still remain on the trails (senderos), as well as inspecting their facilities, effectively closing the PAMRL facilities at 4:00 p.m.

Article 9—Procedure for requesting the facilities. The person interested in reserving the facilities and/or services provided by the PAMRL must request it in writing at least eight calendar days before the date they wish to enter, using the form provided by the Administrator, either on paper at the PAMRL offices or via email.

Once the request is received, the Administration shall verify compliance with the requirements. If approved, the approval shall be notified, along with the conditions for the use of the facilities and general terms relating to the visit.

Article 10—Exemption from Liability. The Municipality of Cartago shall not assume liability for injuries, disability, or death of visitors and/or loss or damage to their property, occurring during their stay in the PAMRL.

Article 11—Carrying Capacity of the facilities. Based on a study carried out by Onesimo Geovanni Meléndez Mendoza, in 2019, as a graduation practicum from the Universidad Autónoma del Estado de México, a carrying capacity of 290 daily visitors is determined for the PAMRL according to its extension, location, and natural resource characteristics.

It shall be the responsibility of the municipal employees and municipal security personnel stationed at the PAMRL to ensure that this carrying capacity is respected and that the maximum number of people permitted is not exceeded.

The Municipality may establish, at any time and for reasons of institutional interest, a daily visitor load lower than indicated.

Article 12—Admission provisions for visitors. The following provisions must be complied with by visitors to the PAMRL:

a. Follow the instructions and recommendations of both municipal employees and security officers, who must be duly identified.

b. Do not enter restricted use zones. For safety, visitors must travel on the trails (senderos) or within the zones intended for public use.

c. Do not enter the catchment area, which is a fragile zone (zona frágil).

d. Do not extract plants, animals, stones, or any other natural resource.

e. Do not cause damage to the infrastructure on site, as it is public property, and the responsible party shall be liable for its repair.

f. Take away the solid waste generated during their stay in the PAMRL.

g. Do not enter with bicycles, skateboards, skates, or any other recreational element.

h. Do not enter with animals, because they can alter the natural processes of the park.

i. Do not generate noise that disturbs the natural processes taking place in the PAMRL. The voice volume must be moderated and radios or any other device that generates sounds unsuitable for the area must not be used.

j. Conducts that disturb public order and good customs are not permitted.

k. Do not smoke, consume alcoholic beverages, use firecrackers and fireworks, flammable, toxic, and dangerous products and substances, sharp objects, and firearms.

l. Do not camp.

m. Girls or boys under 12 years of age may not enter without the accompaniment of a responsible adult.

n. Do not carry out recreational activities on the PAMRL trails (senderos), in the catchment area, or in any other area the administration deems necessary.

o. The permit may not be transferred to persons or organizations different from the applicant.

p. The authorized activity may not be changed without prior authorization from the Administration.

Article 13—Reservation of the right of admission. The Municipality reserves the right of admission to the environmental park, in order to safeguard resources and facilities.

Article 14—Security in the PAMRL. The security of employees and visitors and the resources and facilities of the PAMRL shall be the responsibility of the Community Security and Municipal Police Area.

It is the obligation of municipal security officers to inform the Administration of the PAMRL of any anomaly or irregularity occurring during the development of activities within the PAMRL, without prejudice to the powers they retain to adopt pertinent and immediate measures to stop the irregular act or conduct.

CHAPTER IV

Price for Admission and its Collection

Article 15—The Price. The Municipality shall charge a price for admission to the PAMRL facilities to all visitors in the following categories:

a. Adults.

b. Senior citizens.

c. Students.

d. Minors.

e. Foreigners.

The price shall be determined in accordance with article 83 of the Municipal Code and shall include the effective cost incurred by the Municipality for the activities comprising the service, plus a ten percent (10%) profit to develop them.

Article 16—The Technical Commission. The municipal administration shall form a Technical Commission for the purpose of updating the admission price, composed of the following employees:

a. Cost Analyst.

b. Environmental Unit.

c. Administrator of the PAMRL.

d. Legal Department.

e. Tax Area.

f. The corresponding departments.

The Technical Commission shall prepare a draft price proposal for study by the Mayor's Office and approval by the Municipal Council, which shall take effect thirty days after its publication in La Gaceta.

Article 17—Collection. The admission price shall be collected by a human cashier or shall be made by any other means of payment that provides the admission receipt to visitors.

The collection process shall be the responsibility of the Treasury of the Municipality.

Article 18—Cases of exemption from payment. Only the following persons shall be exempt from paying admission to the PAMRL:

a. Beneficiaries of agreements signed with the Municipality, whose purpose is the development and promotion of projects of environmental interest and sustainable tourism development in the Río Loro Municipal Environmental Park.

b. National or foreign students from public or private institutions who wish to carry out their community service work or volunteering in the PAMRL.

c. National or foreign students from public or private institutions who wish to carry out their professional internship in the environmental park, as well as from public or private institutions and groups of various kinds that contribute to the development and promotion of research and outreach projects (extensión e investigación), of environmental interest and sustainable tourism development, whose results must always be projected towards the PAMRL itself or towards the community.

d. Municipal employees duly identified with their valid ID card and only when participating in activities specific to the institution.

e. Girls and boys under three years of age.

f. Persons from institutions participating in initiatives around the management of environmental-tourism and municipal nature projects.

Article 19—Procedure for payment exemption. To opt for this exemption, the students indicated in subsections b. and c. of the previous article must provide to the Administration of the PAMRL an official letter issued by the educational institution to which they belong, formally requesting admission, including the student's ID card or identity card number and a description of the activity to be carried out within the environmental park.

Additionally, the students must provide an all-risk insurance policy, which shall cover the material and personal damages caused to the student in the PAMRL.

The student must sign a declaration and acceptance that they participate in activities in the PAMRL at their own risk and that they exempt the Municipality of Cartago from all liability for any injury, disability, or death to their person and/or loss or damage to their property, occurring during their stay in the PAMRL

In the case of persons from subsection f. of the previous article, they must request the payment exemption in writing to the Administration of the PAMRL, indicating the objective of the visit, the time they will remain in the park facilities, the activities they will carry out there, and their name and identification number.
