AJDIP/028-2026, Acuerdo de Junta Directiva INCOPESCA





Considerando:





1.-Que mediante acuerdo de Junta Directiva AJDIP/049-2020, de fecha 02 de abril de 2020 se
estableció el área de veda para la pesca semi-industrial bolichera (cerco) de sardina Ophistonema
spp. en la zona comprendida por una línea recta imaginaria que va desde Punta Agujas
(84°39´19´´Longitud Oeste, 09°43´18´´ Latitud Norte) al Faro de la Isla Negritos afuera (84°49´25´´
Longitud Oeste, 09°49´20´´ Latitud Norte) y desde ahí hasta la parte Este de Punta Cuchillo en la
Península de Nicoya (09°49´48"Latitud Norte, 84°51´54" Longitud Oeste) hasta llegar a una línea
recta imaginaria entre Puerto Níspero (10°12'7'' Latitud Norte, 85°13'9'' Longitud Oeste) y Puerto
Moreno (10°12'4'' Latitud Norte, 85°14'75" Longitud Oeste) en la desembocadura del Río Tempisque.





2.-Que el acuerdo de Junta Directiva AJDIP/049-2020, estableció la veda de sardina de manera
permanente durante al menos 5 años, hasta tanto no se tengan nuevas investigaciones científicas que
determinen el cambio del acuerdo.





3.-Que actualmente no se cuenta con información diferente que justifique la modificación al periodo
y zonas de veda que han sido implementadas.





4.-Que existe la necesidad de fortalecer los procesos de colecta de información biológica pesquera y
al mismo tiempo que se realicen las inspecciones a las descargas de cada viaje de pesca.





5.-Que el acuerdo de Junta Directiva AJDIP/049-2020, de fecha 02 de abril de 2020 estableció que la
captura incidental en la pesca de sardina no puede ser superior al 10% de la captura total de la
embarcación.





6.-Que las embarcaciones de la flota semiindustrial están obligadas a notificar al INCOPESCA el
arribo a puerto para efectos de que se coordine la inspección de sus capturas por parte del
Departamento de Fiscalización. A su vez el Departamento de Investigación realizará muestreos
biológicos de dichas capturas para evaluar el comportamiento reproductivo de las sardinas.





7.-Que es importante que se continué supliendo de sardina a la flota comercial para el uso de
carnada.





8.-Que mediante oficios DGT-SJ-013-2016 y DDI-011- 02-18 se establece que el objetivo de esta veda,
es limitar el esfuerzo pesquero para proteger el recurso sardina en su etapa de reproducción en
procura de la sostenibilidad de este recurso pesquero y a la vez solventar el requerimiento de
carnada de la flota pesquera nacional. Por tanto, la Junta Directiva;





Acuerda:





1º-Establecer la veda de pesca de la sardina Opisthonema spp. en el Golfo de Nicoya, mediante el uso
de cualquier tipo de red, desde el 1 de marzo hasta el 1 de junio del año 2026.





2.-La zona vedada para la pesca de sardina Ophistonema spp. corresponde a una línea recta imaginaria
que va desde Punta Agujas (84°39´19´´Longitud Oeste, 09°43´18´´ Latitud Norte) al Faro de la Isla
Negritos afuera (84°49´25´´ Longitud Oeste, 09°49´20´´ Latitud Norte) y desde ahí hasta la parte
Este de Punta Cuchillo en la Península de Nicoya (09°49´48"Latitud Norte, 84°51´54" Longitud Oeste)
hasta llegar a una línea recta imaginaria entre Puerto Níspero (10°12'7'' Latitud Norte, 85°13'9''
Longitud Oeste) y Puerto Moreno (10°12'4'' Latitud Norte, 85°14'75" Longitud Oeste) en la
desembocadura del Río Tempisque.





3º-Se permite faenar una vez por semana durante 12 horas diurnas para cada embarcación, con la
finalidad de suplir carnada para la flota comercial, el área de uso condiciona será la siguiente:





Zona comprendida por una línea recta imaginaria que se extiende desde Punta Agujas
(84°39´19´´Longitud Oeste, 09°43´18´´ Latitud Norte) hasta el faro Isla Negritos afuera (84°49´25´´
Longitud Oeste, 09°49´20´´ Latitud Norte) a partir de allí, otra línea recta imaginaria hasta Punta
Cuchillo en la Península de Nicoya (84°51´54" Longitud Oeste, 09°49´48" Latitud Norte) y desde este
último punto, otra línea recta imaginaria hasta el Peñón o Punta Torres (84°43'52" Longitud Oeste,
9°53'35" Latitud Norte).





Para lo anterior, armadores deben coordinarse y entregar al Departamento de Fiscalización del
INCOPESCA, un cronograma mensual indicando con claridad, el día de la semana que ingresará cada
buque a faenar a la zona vedada.





Aquellos desembarques que se efectúen al amparo de este acuerdo sin presencia institucional, por
situaciones imputables al armador, conllevará la pérdida del beneficio de ejercer la pesca en la
zona vedada en los términos de este acuerdo.





4º-Los armadores o los capitanes de las embarcaciones, están obligados a solicitar la inspección de
desembarque según el procedimiento establecido. Las descargas que se realicen por parte de la flota
semi-industrial bolichera de sardina serán debidamente inspeccionadas por parte de los inspectores
de la Institución. Dicha inspección debe cubrir no solo las descargas de sardina, sino también la de
fauna de acompañamiento. Para los desembarques la franja horaria establecida será desde las 06.00
horas hasta las 20.00 horas.





5.-Todo viaje de pesca realizado por la flota semiindustrial, debe al momento de su desembarque ser
inspeccionado por un funcionario del departamento de fiscalización y dejar consignada la descarga en
el respectivo formulario de inspecciones.





6º-Cualquier situación no prevista expresamente en este acuerdo, será atendida y analizada de forma
primaria por el Jefe del Departamento de Fiscalización para su valoración respectiva, si amerita,
será trasladado a la Dirección de Ordenamiento Pesquero y Acuícola para su atención.





7º-Promover el fortalecimiento de los procesos de investigación y monitoreo del recurso, mediante la
coordinación con el sector semi-industrial y con los Departamentos de Investigación y Fiscalización,
de manera que en el futuro se disponga de información científica suficiente para sustentar la
revisión de la veda.





8º-El Departamento de Investigación del INCOPESCA realizará muestreos biológicos en diferentes
desembarques o durante las faenas de pesca para evaluar el comportamiento reproductivo de las
sardinas y cualquier otra investigación que contribuya a los análisis biológicos pesqueros.





9º-En concordancia con el acuerdo de Junta Directiva AJDIP/049-2020, de fecha 02 de abril de 2020,
la captura incidental en la pesca de sardina no puede ser superior al 10% de la captura total de la
embarcación.





10º-El Servicio Nacional de Guardacostas en coordinación con el Dpto. de Fiscalización del
INCOPESCA, realizarán las acciones pertinentes al amparo de lo establecido en el presente acuerdo, a
efectos de controlar y fiscalizar actividades de pesca ilegal en la zona vedada, especialmente, la
zona Tárcoles.





11º-Téngase como parte integral del presente Acuerdo, el mapa que se anexa a continuación:

Considerando:

1.-That by Board of Directors agreement AJDIP/049-2020, dated April 2, 2020, a closed area was established for semi-industrial bolichera (purse seine) fishing of sardine Ophistonema spp. in the zone comprised by an imaginary straight line running from Punta Agujas (84°39´19´´ Longitud Oeste, 09°43´18´´ Latitud Norte) to the Faro de la Isla Negritos afuera (84°49´25´´ Longitud Oeste, 09°49´20´´ Latitud Norte) and from there to the eastern part of Punta Cuchillo on the Península de Nicoya (09°49´48"Latitud Norte, 84°51´54" Longitud Oeste) until reaching an imaginary straight line between Puerto Níspero (10°12'7'' Latitud Norte, 85°13'9'' Longitud Oeste) and Puerto Moreno (10°12'4'' Latitud Norte, 85°14'75" Longitud Oeste) at the mouth of the Río Tempisque.

2.-That Board of Directors agreement AJDIP/049-2020 established the sardine closure (veda) permanently for at least 5 years, until such time as new scientific research determines a change to the agreement.

3.-That there is currently no different information that would justify modifying the closure (veda) period and zones that have been implemented.

4.-That there is a need to strengthen the processes for collecting biological fisheries information and, at the same time, for inspections of the landings from each fishing trip to be carried out.

5.-That Board of Directors agreement AJDIP/049-2020, dated April 2, 2020, established that incidental catch (captura incidental) in the sardine fishery may not exceed 10% of the vessel's total catch.

6.-That vessels of the semi-industrial fleet are obligated to notify INCOPESCA of their arrival in port so that the inspection of their catches can be coordinated by the Department of Enforcement (Departamento de Fiscalización). In turn, the Department of Research (Departamento de Investigación) will conduct biological sampling of said catches to evaluate the reproductive behavior of the sardines.

7.-That it is important to continue supplying sardine to the commercial fleet for use as bait.

8.-That through official communications DGT-SJ-013-2016 and DDI-011- 02-18, it is established that the objective of this closure (veda) is to limit fishing effort in order to protect the sardine resource during its reproductive stage, in pursuit of the sustainability of this fishing resource and, at the same time, to meet the bait requirement of the national fishing fleet. Therefore, the Board of Directors;

Agrees:

1º-To establish a fishing closure (veda de pesca) for the sardine Opisthonema spp. in the Golfo de Nicoya, through the use of any type of net, from March 1 to June 1 of the year 2026.

2.-The closed area (zona vedada) for fishing of sardine Ophistonema spp. corresponds to an imaginary straight line running from Punta Agujas (84°39´19´´ Longitud Oeste, 09°43´18´´ Latitud Norte) to the Faro de la Isla Negritos afuera (84°49´25´´ Longitud Oeste, 09°49´20´´ Latitud Norte) and from there to the eastern part of Punta Cuchillo on the Península de Nicoya (09°49´48" Latitud Norte, 84°51´54" Longitud Oeste) until reaching an imaginary straight line between Puerto Níspero (10°12'7'' Latitud Norte, 85°13'9'' Longitud Oeste) and Puerto Moreno (10°12'4'' Latitud Norte, 85°14'75" Longitud Oeste) at the mouth of the Río Tempisque.

3º-Fishing is permitted once per week for 12 daylight hours per vessel, for the purpose of supplying bait for the commercial fleet; the conditionally permitted use area shall be the following:

Zone comprised by an imaginary straight line extending from Punta Agujas (84°39´19´´ Longitud Oeste, 09°43´18´´ Latitud Norte) to the faro Isla Negritos afuera (84°49´25´´ Longitud Oeste, 09°49´20´´ Latitud Norte), from there, another imaginary straight line to Punta Cuchillo on the Península de Nicoya (84°51´54" Longitud Oeste, 09°49´48" Latitud Norte), and from this last point, another imaginary straight line to the Peñón or Punta Torres (84°43'52" Longitud Oeste, 9°53'35" Latitud Norte).

For the above, vessel owners (armadores) must coordinate and provide to the Department of Enforcement (Departamento de Fiscalización) of INCOPESCA a monthly schedule clearly indicating the day of the week each vessel will enter the closed area (zona vedada) to fish.

Those landings (desembarques) carried out under the protection of this agreement without institutional presence, due to situations attributable to the vessel owner (armador), will result in the loss of the benefit of fishing in the closed area (zona vedada) under the terms of this agreement.

4º-Vessel owners (armadores) or the captains of the vessels are obligated to request a landing (desembarque) inspection according to the established procedure. Landings (descargas) made by the semi-industrial bolichera sardine fleet shall be duly inspected by the Institution's inspectors. Said inspection must cover not only the sardine landings (descargas), but also that of the bycatch (fauna de acompañamiento). For the landings (desembarques), the established time window shall be from 06:00 hours to 20:00 hours.

5.-Every fishing trip made by the semi-industrial fleet must, at the time of its landing (desembarque), be inspected by an official of the Department of Enforcement (departamento de fiscalización) and the landing (descarga) must be recorded on the respective inspection form.

6º-Any situation not expressly provided for in this agreement shall be addressed and analyzed in the first instance by the Head of the Department of Enforcement (Jefe del Departamento de Fiscalización) for its respective assessment; if warranted, it shall be referred to the Directorate of Fisheries and Aquaculture Management (Dirección de Ordenamiento Pesquero y Acuícola) for its attention.

7º-To promote the strengthening of research and monitoring processes for the resource, through coordination with the semi-industrial sector and with the Departments of Research and Enforcement (Departamentos de Investigación y Fiscalización), so that in the future sufficient scientific information is available to support the review of the closure (veda).

8º-The Department of Research (Departamento de Investigación) of INCOPESCA shall conduct biological sampling at various landings (desembarques) or during fishing operations to evaluate the reproductive behavior of the sardines and any other research that contributes to fisheries biological analyses.

9º-In accordance with Board of Directors agreement AJDIP/049-2020, dated April 2, 2020, incidental catch (captura incidental) in the sardine fishery may not exceed 10% of the vessel's total catch.

10º-The Servicio Nacional de Guardacostas, in coordination with the Dept. of Enforcement (Dpto. de Fiscalización) of INCOPESCA, shall carry out the pertinent actions under the provisions established in this agreement, for the purpose of controlling and enforcing against illegal fishing activities in the closed area (zona vedada), especially the Tárcoles zone.

11º-The map attached below shall be considered an integral part of this Agreement:
