Esta Ley 7412 reforma el Artículo 50 de la Constitución Política de Costa Rica para establecer de manera expresa el derecho a un ambiente sano y ecológicamente equilibrado. La reforma introduce dos párrafos nuevos: el primero reconoce que toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado, otorgándole legitimación para denunciar actos que infrinjan ese derecho y para reclamar la reparación del daño causado. El segundo párrafo nuevo establece la obligación del Estado de garantizar, defender y preservar ese derecho, y remite a la ley para determinar las responsabilidades y sanciones correspondientes. La reforma mantiene el texto original del primer párrafo sobre el deber del Estado de procurar el mayor bienestar, organizando y estimulando la producción y el adecuado reparto de la riqueza. Se trata de una reforma constitucional de calado que eleva a rango supremo la protección ambiental y sienta las bases para el desarrollo posterior de la jurisprudencia en materia de legitimación difusa y tutela ambiental.

                      REFORMA AL ARTICULO 50 DE LA

                          CONSTITUCION POLITICA

     ARTICULO 1.- Refórmase el artículo 50 de la Constitución Política,

cuyo texto dirá:

          "Artículo 50.- El Estado procurará el mayor bienestar a

     todos los habitantes del país, organizando y estimulando la

     producción y el más adecuado reparto de la riqueza.

                      REFORM OF ARTICLE 50 OF THE

                          POLITICAL CONSTITUTION

     ARTICLE 1.- Article 50 of the Political Constitution is hereby reformed,

the text of which shall read:

          "Article 50.- The State shall strive for the greatest well-being for

     all inhabitants of the country, organizing and stimulating

     production and the most adequate distribution of wealth.

          Every person has the right to a healthy and

     ecologically balanced environment. Therefore, they are entitled to

     report acts that infringe upon that right and to claim

     reparation for the damage caused.

          The State shall guarantee, defend, and preserve that right.

     The law shall determine the corresponding responsibilities and

     sanctions."
