Español (source)Artículo 1°.- Apruébase el Contrato de Préstamo N° 4457-CR, suscrito el 20 de julio de 2000, entre el Banco Internacional de Reconstrucción y Fomento (Banco Mundial) y el Gobierno de la República de Costa Rica, por un monto hasta de treinta y dos millones seiscientos treinta mil dólares sin centavos (US$32.630.000,00) para financiar el Programa de pagos de servicios ambientales por un período de cinco años, tal y como lo establece el Programa 1 del contrato de préstamo. El texto del referido contrato de préstamo y su traducción oficial se anexan y forman parte de esta Ley.
Artículo 2°.- Para constituir la Unidad Ejecutora que se encargará de todo lo relativo a la ejecución del Proyecto aprobado mediante esta Ley, el Ministerio de Ambiente y Energía (MINAE) y el Fondo de Financiamiento Forestal (FONAFIFO) podrán utilizar el personal actual, el equipo y las instalaciones de la misma institución. Asimismo, mediante convenio, movilidad horizontal o préstamo podrán solicitar a otras entidades públicas el personal técnico necesario para llevar a cabo la ejecución.
Artículo 3°.- Los desembolsos del contrato de préstamo que esta Ley aprueba, no serán considerados para efectos de lo establecido en el artículo 9 de la Ley N° 7970, de 22 de diciembre de 1999.
English (translation)Article 1.— Loan Agreement No. 4457-CR, signed on July 20, 2000, between the International Bank for Reconstruction and Development (World Bank) and the Government of the Republic of Costa Rica, for an amount up to thirty-two million six hundred thirty thousand dollars (US$32,630,000.00) to finance the Environmental Services Payments Program for a period of five years, as established in Program 1 of the loan agreement, is hereby approved. The text of said loan agreement and its official translation are annexed and form part of this Law.
Article 2.— To constitute the Executing Unit to assume all matters relating to the execution of the Project approved under this Law, the Ministry of Environment and Energy (MINAE) and the Forestry Financing Fund (FONAFIFO) may use existing personnel, equipment and facilities of the same institution. Likewise, by agreement, horizontal mobility or loan they may request from other public entities the necessary technical personnel to carry out the execution.
Article 3.— Disbursements from the loan agreement approved herein shall not be considered for purposes of the provisions in Article 9 of Law No. 7970 of December 22, 1999.
