En ejercicio de las facultades que
les confiere el artículo 140, incisos 3) y 18) de
la Constitución Política
y de conformidad con lo dispuesto en el artículo 82 de
la Ley de Conservación de
la Vida Silvestre Nº
7317 del 30 de octubre de 1992, los artículos 32 y 42 de
la Ley Orgánica del
Ambiente Nº 7554 del 4 de octubre de 1995,
Considerando:
1º-Que como consecuencia directa del
aumento de la población, la agricultura intensiva, la urbanización, la
contaminación, la sobreexplotación de los recursos marinos y otras formas de
intervención en el sistema ecológico e hidrológico, los ecosistemas de
humedales, principalmente en el Golfo de Nicoya, se están perdiendo en forma acelerada,
lo que podría traer serias consecuencias para la biodiversidad, las actividades
de pesca y la economía del país a mediano y largo plazo.
2º-Que
la Isla San Lucas, ubicada
en el Golfo de Nicoya, contiene rasgos culturales importantes, así como recursos
biológicos asociados tanto al área insular como la zona marino costera
importantes para proteger.
3º-Que el Golfo de Nicoya constituye
un criadero natural de muchas especies marinas que son aprovechadas por las
comunidades aledañas.
4º-Que los humedales constituyen un
importante sitio de alimentación, refugio y reproducción para una gran variedad
de especies silvestres, por lo que reviste especial importancia su protección y
conservación.
5º-Que el manejo racional integrado
de los recursos marinos contribuye a satisfacer las necesidades regionales para
la investigación, recreación, educación ambiental, belleza escénica, así como
el aprovechamiento de los recursos naturales renovables, explotados
racionalmente.
Decretan:
Artículo 1º-Declárase el Refugio
Nacional de Vida Silvestre de propiedad estatal el área comprendida por:
A. La porción terrestre conformada por la Isla San Lucas, ubicada en el Golfo de Nicoya, hoja
Cartográfica del IGN denominada Golfo, edición 3-IGNCR, situada entre las coordenadas geográficas de
latitud norte 9° 55' 55" - 9 57' 20" y longitud Oeste 84° 53' 23", con una extensión de 462 ha. Se
rectifican los límites de la porción terrestre insular, excluyéndose el área comprendida por las
siguientes coordenadas Lambert Costa Rica Norte.

enero de 2008, mismo que fue anulado parcialmente, mediante
resolución de
la Sala Constitucional N° 2010-13099 del 04 de agosto de 2010, en cuanto modificó únicamente el
inciso A del artículo 1° del Decreto Ejecutivo No. 33327-MINAE, salvo la adición hecha por este de
la porción de agua que se agregó al Refugio Nacional de Vida Silvestre Isla San Lucas y el apartado
B, que mantienen su vigencia. No indicó
la Sala en tal sentido, si se restablece el texto
anterior a dicha reforma.)

Artículo 2º—

Artículo 3º—Declárase el Estero de Puntarenas como Humedal del
Estero de Puntarenas y Manglares Asociados, que se describe según Hojas cartográficas
del IGN denominada Golfo, Edición 3-IGNCR y Chapernal Edición 2-IGNCR, se parte de un
punto ubicado en el extremo oeste del Barrio el Carmen de la Cuidad de Puntarenas de
coordenadas Lambert 217850 Norte, 442980 E (1) (borde del Estero). Sigue por ese borde del
Estero hasta la intersección con el estero Chacarita en el punto de coordenadas 218350
N-450400 E (2). De aquí toma una línea recta hasta el otro borde del estero de
coordenadas 218500 N-450350 E (3), para seguir por esa margen del estero Chacarita con
rumbo norte y este hasta llegar al punto 219900 N - 452850 E (4), que coincide con el
límite externo del manglar tal y como lo describen las hojas Golfo y Chapernal ya
citadas, por el que continúa hasta la orilla izquierda del río Guacimal, es decir
pasando por puntos como los que a continuación se describen:

ubicado al borde del Estero, en el Barrio el Carmen de la Cuidad de Puntarenas.

33327 del 30 de agosto de 2006, se rectifica, delimita y se amplía el área del Humedal Estero
Puntatenas y Manglares Asociados; así mismo ver los artículos 3, 4, 5 y
6 de dicho decreto)

Artículo 4º—La Administración de las áreas protegidas aquí
declaradas será competencia del Ministerio de Ambiente y Energía y de las instituciones
establecidas por la normativa vigente. Las categorías de manejo establecidas en el
presente decreto se regirán de acuerdo con las disposiciones establecidas al respecto por
la legislación vigente en la materia. Las actividades de extracción de especies marinas
se permitirán con base en las regulaciones que establezca el Instituto de Pesca y
Acuacultura (INCOPESCA).

Declares as a National Wildlife Refuge the area comprising San Lucas
Island and the coastal marine area

THE PRESIDENT OF
THE REPUBLIC
AND THE MINISTER OF
ENVIRONMENT AND ENERGY(*)

In exercise of the powers conferred
upon them by Article 140, subsections 3) and 18) of
the Political Constitution
and in accordance with the provisions of Article 82 of
the Wildlife Conservation Law No.
7317 of October 30, 1992, Articles 32 and 42 of
the Organic Environmental Law
No. 7554 of October 4, 1995,
Considering:
1º—That as a direct consequence of
population increase, intensive agriculture, urbanization,
pollution, overexploitation of marine resources, and other forms of
intervention in the ecological and hydrological system, wetland ecosystems,
mainly in the Gulf of Nicoya, are being lost at an accelerated rate,
which could have serious consequences for biodiversity, fishing
activities, and the country's economy in the medium and long term.
2º—That San Lucas Island, located
in the Gulf of Nicoya, contains important cultural features, as well as significant biological
resources associated with both the insular area and the coastal marine zone
that are important to protect.
3º—That the Gulf of Nicoya constitutes
a natural nursery for many marine species that are utilized by the
surrounding communities.
4º—That wetlands constitute an important
site for feeding, refuge, and reproduction for a great variety
of wild species, making their protection and
conservation especially important.
5º—That the integrated, rational management
of marine resources contributes to meeting regional needs for
research, recreation, environmental education, scenic beauty, as well
as the utilization of rationally exploited renewable natural resources.
They Decree:
Article 1º—The state-owned National
Wildlife Refuge is hereby declared for the area comprising:
A. The terrestrial portion made up of San Lucas Island, located in the Gulf of Nicoya, on the IGN Cartographic sheet named Golfo, edition 3-IGNCR, situated between the geographical coordinates of
north latitude 9° 55' 55" - 9 57' 20" and West longitude 84° 53' 23", with an extension of 462 ha. The boundaries of the insular terrestrial portion are rectified, excluding the area comprised by the following Costa Rica Lambert North coordinates.

(Thus amended by Article 1 of Executive Decree No. 34282 of January 25, 2008, which was partially annulled, by means of resolution of
the Constitutional Chamber No. 2010-13099 of August 4, 2010, insofar as it only modified subsection A of Article 1 of Executive Decree No. 33327-MINAE, except for the addition made by it of the portion of water that was added to the San Lucas Island National Wildlife Refuge and subsection B, which remain in force. The Chamber did not indicate
in that regard whether the text prior to said amendment is restored.)

Article 3º—The Puntarenas Estuary is hereby declared as the Puntarenas Estuary and Associated Mangroves Wetland, which is described according to the IGN cartographic sheets named Golfo, Edition 3-IGNCR and Chapernal Edition 2-IGNCR, starting from a point located at the western end of Barrio el Carmen in the City of Puntarenas at Lambert coordinates 217850 North, 442980 E (1) (edge of the Estuary). It follows this edge of the Estuary to the intersection with the Chacarita estuary at the point of coordinates 218350 N-450400 E (2). From here it takes a straight line to the other edge of the estuary at coordinates 218500 N-450350 E (3), to follow along that bank of the Chacarita estuary with a north and east bearing until reaching point 219900 N - 452850 E (4), which coincides with the outer limit of the mangrove as described by the aforementioned Golfo and Chapernal sheets, along which it continues to the left bank of the Guacimal River, that is to say passing through points such as those described below:

From here it takes a straight line with a southwest bearing until reaching the starting point of this description of the Puntarenas Estuary and Associated Mangroves Wetland at coordinates 217850 North, 442980 E (1) located at the edge of the Estuary, in Barrio el Carmen of the City of Puntarenas.

Article 4º—The Administration of the protected areas hereby declared shall be the responsibility of the Ministry of Environment and Energy and the institutions established by current regulations. The management categories established in this decree shall be governed in accordance with the provisions established in this regard by the legislation in force on the matter. The extraction activities of marine species shall be permitted based on the regulations established by the Institute of Fisheries and Aquaculture (INCOPESCA).
