Esta reforma constitucional, identificada como Ley 4349, adicionó un tercer párrafo al artículo 50 de la Constitución Política, consagrando el derecho de todas las personas a un ambiente ecológicamente equilibrado. La norma disponía que ese derecho tenía rango constitucional y establecía la obligación del Estado de garantizar, defender y preservar el ambiente. Esta reforma fue anulada por la Sala Constitucional mediante resolución N° 2771 del 4 de abril de 2003, al determinar que la Asamblea Legislativa carecía de competencia para aprobar una reforma constitucional sobre ese tema por el procedimiento de adición al final del texto, sin seguir el procedimiento general de reforma parcial previsto en la Constitución. Antes de su anulación, fue un hito en el reconocimiento del derecho ambiental como derecho fundamental en Costa Rica.
