Recuerde que Control F es una opción que le permite buscar en la totalidad del texto Ir al final del documento - Usted está en la última versión de la norma - Reglamento al Artículo 80 de la Ley de Biodiversidad, Ley Nº 7788 del 30 de abril de 1998 Nº 34958-MINAE(*)-COMEX (*)(Así modificada su denominación por el artículo 11 de la Ley "Traslado del sector Telecomunicaciones del Ministerio de Ambiente, Energía y Telecomunicaciones al Ministerio de Ciencia y Tecnología, N° 9046 del 25 de junio de 2012) EL PRESIDENTE DE LA REPÚBLICA EL MINISTRO DE AMBIENTE, ENERGÍA,(*) Y EL MINISTRO DE COMERCIO EXTERIOR (*)(Así modificada su denominación por el artículo 11 de la Ley "Traslado del sector Telecomunicaciones del Ministerio de Ambiente, Energía y Telecomunicaciones al Ministerio de Ciencia y Tecnología, N° 9046 del 25 de junio de 2012) En ejercicio de las facultades y atribuciones contenidas en los artículos 50, 140, incisos 3) y 18); y 146 de la Constitución Política; los numerales 25, 27 párrafo primero, 28 párrafo segundo, inciso b) de la Ley General de la Administración Pública, Ley Nº 6227 del 2 de mayo de 1978; los artículos 2º y 80 de la Ley de Biodiversidad, Ley Nº 7788 del 30 de abril de 1998; el artículo 15 del Convenio sobre Diversidad Biológica y sus Anexos, Ley de Aprobación Nº 7416 del 30 de junio de 1994, la Ley Orgánica del Ministerio del Ambiente y Energía, Ley Nº 7152 del 5 de junio de 1990; la Ley Orgánica del Ambiente, Ley Nº 7554 del 4 de octubre de 1995, y el Decreto Ejecutivo Nº 34582-MP-MIDEPLAN del 4 de junio del 2008, denominado Reglamento Orgánico del Poder Ejecutivo; y Considerando: I.-De conformidad con el principio de soberanía de los Estados, establecido en el artículo 15 del Convenio sobre la Diversidad Biológica, aprobado por Costa Rica mediante Ley Nº 7416 del 30 de junio de 1994, publicada en el Diario Oficial La Gaceta Nº 143 de 28 de julio de 1994; y el artículo 2º de la Ley de Biodiversidad Nº 7788 del 30 de abril de 1998, publicada en el Diario Oficial La Gaceta Nº 101 del 27 de mayo de 1998, el Estado ejercerá la soberanía completa y exclusiva sobre los elementos de la biodiversidad. II.-Que el Convenio sobre la Diversidad Biológica establece como objetivos la conservación de la diversidad biológica, la utilización sostenible de sus componentes y la participación justa y equitativa en los beneficios que se deriven de la utilización de los recursos genéticos. III.-Que la Ley de Biodiversidad, atribuyó al Poder Ejecutivo la tarea de reglamentar los aspectos necesarios de dicha Ley, con la finalidad de dar una adecuada aplicación a los preceptos que consagra ese cuerpo normativo. IV.-Que reconociendo que el Estado costarricense es responsable de la conservación de su diversidad biológica y de la utilización sostenible de sus recursos biológicos, es necesario establecer las pautas mediante las que este principio pueda ser alcanzado en los procedimientos específicos contemplados en la Ley de Biodiversidad. V.-Que es necesaria la promulgación de una reglamentación al artículo 80 de la Ley de Biodiversidad, con el fin de desarrollar los procedimientos aplicables a la consulta previa obligada que se debe realizar a la Oficina Técnica de la Comisión Nacional para la Gestión de la Biodiversidad (CONAGEBIO) antes de otorgar protección de propiedad intelectual o industrial a las innovaciones que involucren elementos de la biodiversidad, así como para la presentación de un informe por parte de la Oficina Técnica que detalle si el solicitante de una patente o de un título de obtentor ha cumplido con la normativa nacional en materia de acceso los recursos y elementos de la biodiversidad en el territorio costarricense, cuando éstos hayan sido utilizados para el desarrollo de las innovaciones. VI.-Que con este Reglamento se pretende dar aplicación efectiva a los mecanismos previstos en la Ley de Biodiversidad para garantizar que, cuando se otorgue un permiso de acceso a los elementos de la biodiversidad en el territorio costarricense y cuando dicho acceso derive en invenciones o en el mejoramiento de semillas, se cumpla con el régimen vigente de acceso a éstos recursos en el país. Este régimen tiene a su vez como propósito la utilización sostenible de los recursos genéticos y bioquímicos de los elementos de la biodiversidad del país y la distribución justa y equitativa de los eventuales beneficios derivados de esta utilización. VII.-Que, asimismo, en virtud de las recientes reformas introducidas a la normativa legal en materia de biodiversidad; es necesario reglamentar el artículo 80 de la Ley de Biodiversidad, con el propósito de que estas sean acordes con dichas enmiendas legislativas y los compromisos internacionales adquiridos por el país en esta materia. Por tanto, DECRETAN: El siguiente: Reglamento al Artículo 80 de la Ley de Biodiversidad, Ley Nº 7788 del 30 de abril de 1998 (Anulado este Decreto Ejecutivo mediante resolución de la Sala Constitucional N° 2012-17058, del 05 de diciembre de 2012.). Note that Control F is an option that allows you to search throughout the entire text Go to the end of the document - You are viewing the latest version of the regulation - Regulations to Article 80 of the Biodiversity Law, Law No. 7788 of April 30, 1998 No. 34958-MINAE(*)-COMEX (*)(Thus amended its name by Article 11 of Law "Transfer of the Telecommunications sector from the Ministry of Environment, Energy and Telecommunications to the Ministry of Science and Technology," No. 9046 of June 25, 2012) THE PRESIDENT OF THE REPUBLIC THE MINISTER OF ENVIRONMENT AND ENERGY,(*) AND THE MINISTER OF FOREIGN TRADE (*)(Thus amended its name by Article 11 of Law "Transfer of the Telecommunications sector from the Ministry of Environment, Energy and Telecommunications to the Ministry of Science and Technology," No. 9046 of June 25, 2012) In exercise of the powers and authorities contained in Articles 50, 140, subsections 3) and 18); and 146 of the Political Constitution; numerals 25, 27 first paragraph, 28 second paragraph, subsection b) of the General Law of Public Administration, Law No. 6227 of May 2, 1978; Articles 2 and 80 of the Biodiversity Law, Law No. 7788 of April 30, 1998; Article 15 of the Convention on Biological Diversity and its Annexes, Approval Law No. 7416 of June 30, 1994, the Organic Law of the Ministry of Environment and Energy, Law No. 7152 of June 5, 1990; the Organic Law of the Environment, Law No. 7554 of October 4, 1995, and Executive Decree No. 34582-MP-MIDEPLAN of June 4, 2008, called the Organic Regulations of the Executive Branch; and Whereas: I.-In accordance with the principle of sovereignty of States, established in Article 15 of the Convention on Biological Diversity, approved by Costa Rica through Law No. 7416 of June 30, 1994, published in the Official Gazette La Gaceta No. 143 of July 28, 1994; and Article 2 of the Biodiversity Law No. 7788 of April 30, 1998, published in the Official Gazette La Gaceta No. 101 of May 27, 1998, the State shall exercise complete and exclusive sovereignty over the elements of biodiversity. II.-That the Convention on Biological Diversity establishes as objectives the conservation of biological diversity, the sustainable use of its components, and the fair and equitable sharing of the benefits arising from the utilization of genetic resources. III.-That the Biodiversity Law assigned to the Executive Branch the task of regulating the necessary aspects of said Law, with the purpose of providing adequate application to the precepts enshrined in that normative body. IV.-That recognizing that the Costa Rican State is responsible for the conservation of its biological diversity and the sustainable use of its biological resources, it is necessary to establish the guidelines through which this principle can be achieved in the specific procedures contemplated in the Biodiversity Law. V.-That the promulgation of regulations to Article 80 of the Biodiversity Law is necessary, in order to develop the procedures applicable to the mandatory prior consultation that must be carried out with the Technical Office of the National Commission for Biodiversity Management (CONAGEBIO) before granting intellectual or industrial property protection to innovations that involve elements of biodiversity, as well as for the presentation of a report by the Technical Office detailing whether the applicant for a patent or a plant breeder’s certificate has complied with national regulations on access to the resources and elements of biodiversity in the Costa Rican territory, when these have been used for the development of the innovations. VI.-That this Regulation aims to give effective application to the mechanisms provided for in the Biodiversity Law to guarantee that, when an access permit to the elements of biodiversity in the Costa Rican territory is granted and when said access results in inventions or the improvement of seeds, the current regime for access to these resources in the country is complied with. This regime has, in turn, the purpose of the sustainable use of genetic and biochemical resources of the country's biodiversity elements and the fair and equitable distribution of the eventual benefits derived from this use. VII.-That, likewise, by virtue of the recent reforms introduced to the legal regulations on biodiversity, it is necessary to regulate Article 80 of the Biodiversity Law, so that these are consistent with said legislative amendments and the international commitments acquired by the country in this matter. Therefore, THEY DECREE: The following: Regulations to Article 80 of the Biodiversity Law, Law No. 7788 of April 30, 1998 (This Executive Decree annulled by resolution of the Constitutional Chamber No. 2012-17058, of December 5, 2012.)
