En uso de las facultades que les confieren los incisos 3) y 18) del
artículo 140 y el artículo 146 de la Constitución Política, Ley Nº 5605 del 30
de octubre de 1974 denominada Convención sobre el Comercio Internacional de
Especies Amenazadas de Fauna y Flora Silvestres (CITES), los artículos 6º, 12,
14,18, 25, 28, 29, 30, 31, 32, 33, 34 y 35 de la Ley de Conservación de la Vida
Silvestre, Nº 7317 del 30 de octubre de 1992, los artículos 11 y 57 de la Ley
de Biodiversidad, Nº 7788 del 30 de abril de 1998 y los artículos 26, 29 y 51
del Reglamento a la Ley de Conservación de la Vida Silvestre, Decreto Ejecutivo
Nº 32633 del 10 de marzo del 2005.

Considerando:

I.-Que en materia de recursos de vida silvestre, la facultad para dictar
medidas y establecer procedimientos necesarios para asegurar la conservación de
la diversidad biológica del país, son funciones del Ministerio de Ambiente,
Energía y Telecomunicaciones (MINAET).

II.-Que la destrucción de los hábitats naturales,
la cacería furtiva, la contaminación ambiental y el comercio ilegal de animales
vivos o sus productos, han disminuido peligrosamente las poblaciones de algunas
especies de fauna silvestre, y otras se encuentran en inminente peligro de
extinción en el territorio nacional, por lo que se hace necesario establecer
regulaciones para su aprovechamiento.

III.-Que algunas especies de
fauna silvestre son raras o endémicas en áreas muy reducidas del territorio
nacional y requieren estrictas medidas de control para asegurar su
sobrevivencia.

IV.-Que la Ley de Biodiversidad, Nº 7788 del 30 de
abril de 1998, estableció criterios preventivos y precautorios, cuando exista
peligro, amenaza grave o inminente a los elementos que componen la
biodiversidad y que la ausencia de certeza científica no deberá utilizarse como
razón para postergar la adopción de medidas eficaces de protección. Por
tanto,

Decretan:

    "Regulaciones
para la caza menor y caza mayor

    fuera de las áreas silvestres protegidas y de la

    pesca en áreas silvestres protegidas y

    derogatoria del Decreto Ejecutivo

    Nº 35700-MINAET del 14

      2009"

CAPÍTULO I

La caza, la pesca y torneos en Áreas Silvestres
Protegidas

Artículo 1º-Se prohíbe la caza mayor y menor, los torneos de caza y
liberación, la caza menor de aves canoras y de plumaje, la pesca en Parques
Nacionales, "con excepción de lo establecido en el artículo 10 de la Ley del
Servicio de Parques Nacionales, Nº 6084 del 24 de agosto de 1977 y el inciso c)
del artículo 24 de este Decreto", Reservas Biológicas, Monumentos
Naturales, Reservas Forestales, Zonas Protectoras, Reservas Indígenas, "excepto
la caza de subsistencia para los indígenas residentes", Refugios de Vida
Silvestre, "salvo cuando se trate de programas de manejo de poblaciones que
realice el Sistema Nacional de Áreas de Conservación del Ministerio de
Ambiente, Energía y Telecomunicaciones", y las fincas sometidas al régimen
de pago de servicios ambientales y aquellas que se encontrasen bajo la
administración de las distintas Áreas de Conservación.

CAPÍTULO II

Generalidades sobre la
caza mayor y menor

CAPÍTULO VI

Torneos de caza,
seguimiento de huellas o rastros y torneos de

canto o exhibición de aves canoras o de plumaje

Artículo 22.- (Derogado por

N° 40548 del 12 de julio de 2017.)

CAPÍTULO VII

    Actividades de pesca deportiva en áreas protegidas

Artículo 23.-La pesca fuera de Áreas Silvestres Protegidas se regirá según
lo dispuesto en la Ley de Pesca y Acuicultura, Nº 8436 publicada en La
Gaceta Nº 78 del 25 de abril del 2005.

Artículo 24.-Se autoriza la pesca deportiva de:

a) Guapote (Parachromis spp), róbalo (Centropomus undecimalis),
sábalo (Megalops atlanticus) y demás especies de peces, en, lagunas del Refugio
de Fauna Silvestre de Caño Negro y el Refugio de Fauna Silvestre Las Camelias,
que permiten la pesca deportiva en su plan de manejo, entre el 1º de agosto al
31 de marzo de cada año.

Cada persona podrá pescar un límite de hasta 5 piezas por día, con un tamaño mínimo de 25
centímetros de longitud, para un total máximo de 15 piezas; distribuidas en un mínimo de 3 días.

Quien realice
la pesca de ésta especie, deberá demostrar ante la autoridad competente, la
presencia en la zona de al menos tres días consecutivos, a efectos de poder
gozar del número máximo de piezas, dispuesto en el párrafo anterior.

b) Gaspar (Atractosteus
tropicus) en las lagunas del Refugio de Fauna Silvestre de Caño Negro y el
Refugio de Fauna Silvestre Las Camelias, entre el 1º de setiembre al 28 de
febrero de cada año. 

Cada persona podrá pescar un límite de hasta 2
peces por día, con un tamaño mínimo de 60
 cm. de longitud, para un total máximo de 6 piezas.

Quien realice
pesca de ésta especie, deberá demostrar ante la autoridad competente, la
presencia en la zona, de al menos tres días consecutivos, a efectos de poder
distribuir el número máximo de piezas, indicado en el párrafo anterior.

c) Para el Refugio de Vida Silvestre Barra del Colorado la actividad de
pesca será regulada de acuerdo a lo establecido en el Plan de Manejo,
instrumento establecido en el artículo del 2 inciso 28 Reglamento a la Ley de
Conservación de la Vida Silvestre, Decreto Ejecutivo N° 32633.

En Refugios de
Vida Silvestre y Parques Nacionales, fuera de las fechas indicadas en incisos a
y b de este numeral, podrá realizarse pesca de subsistencia cuando así lo
contemple el Plan de Manejo del área silvestre protegida (artículo del 2 inciso
28 Reglamento a la Ley de Conservación de la Vida Silvestre, Decreto Ejecutivo
N° 32633) y previo cumplimiento de lo dispuesto en el articulo 82 de la Ley de
Conservación de la Vida. Además, el interesado deberá estar registrado en la
administración del Área Silvestre Protegida como residente de los poblados
aledaños.

Artículo 25.-Se prohíbe la pesca deportiva en la
Laguna de Hule, ubicada en el Refugio de Fauna Mixto Bosque Alegre, Cariblanco.

Artículo 26.-De conformidad con lo establecido en
los artículos 12, 17, 63 y 65 de la Ley de Conservación de la Vida Silvestre Nº
7317, las oficinas de administración de las áreas silvestres protegidas y otras
que se establezcan con éste fin, serán las encargadas de autorizar, emitir y
suscribir o denegar las licencias de pesca, así como las licencias de
subsistencia, dentro de las áreas silvestres protegidas, cuando así lo estipule
el plan de manejo.

Artículo 27.-El SINAC a través de las oficinas de
administración de las áreas silvestres protegidas, podrá autorizar la
realización de torneos de pesca deportiva a grupos organizados, de conformidad
con el artículo 51 del Reglamento a la Ley de Conservación de la Vida Silvestre
Decreto Ejecutivo Nº 32633, en áreas silvestres protegidas cuando su plan de
manejo así lo permita.

De la tenencia de animales
silvestres en cautiverio

    THE PRESIDENT OF THE REPUBLIC

    AND THE MINISTER OF ENVIRONMENT, ENERGY,

    AND TELECOMMUNICATIONS

By virtue of the powers conferred by subsections 3) and 18) of Article 140 and Article 146 of the Political Constitution, Law No. 5605 of October 30, 1974, entitled Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES), Articles 6, 12, 14, 18, 25, 28, 29, 30, 31, 32, 33, 34, and 35 of the Wildlife Conservation Law, No. 7317 of October 30, 1992, Articles 11 and 57 of the Biodiversity Law, No. 7788 of April 30, 1998, and Articles 26, 29, and 51 of the Regulations to the Wildlife Conservation Law, Executive Decree No. 32633 of March 10, 2005.

Considering:

I.—That in matters of wildlife resources, the authority to issue measures and establish procedures necessary to ensure the conservation of the country's biological diversity are functions of the Ministry of Environment, Energy, and Telecommunications (MINAET).

II.—That the destruction of natural habitats, poaching (cacería furtiva), environmental pollution, and illegal trade in live animals or their products have dangerously reduced the populations of some wild fauna species, and others are in imminent danger of extinction within the national territory, making it necessary to establish regulations for their use.

III.—That some wild fauna species are rare or endemic to very small areas of the national territory and require strict control measures to ensure their survival.

IV.—That the Biodiversity Law, No. 7788 of April 30, 1998, established preventive and precautionary criteria when there is danger, serious or imminent threat to the elements composing biodiversity, and that the absence of scientific certainty shall not be used as a reason to postpone the adoption of effective protection measures. Therefore,

They decree:

    "Regulations
for small game hunting and big game hunting

    outside protected wilderness areas and for

    fishing in protected wilderness areas and

    repeal of Executive Decree

    No. 35700-MINAET of October 14,

      2009"

CHAPTER I

Hunting, fishing, and tournaments in Protected Wilderness Areas

Article 1.—Big game hunting (caza mayor) and small game hunting (caza menor), hunting tournaments and release tournaments, small game hunting of songbirds and plumage birds, and fishing are prohibited in National Parks, "with the exception of that established in Article 10 of the National Parks Service Law, No. 6084 of August 24, 1977, and subsection c) of Article 24 of this Decree", Biological Reserves, Natural Monuments, Forest Reserves, Protective Zones, Indigenous Reserves, "except subsistence hunting (caza de subsistencia) for resident indigenous people", Wildlife Refuges, "except when it involves population management programs carried out by the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación) of the Ministry of Environment, Energy, and Telecommunications", and properties subject to the payment for environmental services (pago de servicios ambientales) regime and those that are under the administration of the various Conservation Areas.

General provisions on big game and small game hunting

CHAPTER VI

Hunting tournaments, tracking tournaments for tracks or traces, and tournaments for song or exhibition of songbirds or plumage birds

CHAPTER VII

    Sport fishing activities in protected areas

Article 23.—Fishing outside Protected Wilderness Areas shall be governed in accordance with the provisions of the Fishing and Aquaculture Law, No. 8436, published in La Gaceta No. 78 of April 25, 2005.

Article 24.—Sport fishing is authorized for:

a) Guapote (Parachromis spp), róbalo (Centropomus undecimalis), sábalo (Megalops atlanticus), and other fish species in the lagoons of the Caño Negro Wildlife Refuge and the Las Camelias Wildlife Refuge, which allow sport fishing in their management plan (plan de manejo), between August 1st and March 31st of each year.

Each person may fish a limit of up to 5 pieces per day, with a minimum size of 25 centimeters in length, for a maximum total of 15 pieces, distributed over a minimum of 3 days.

Anyone fishing for this species must demonstrate to the competent authority a presence in the area of at least three consecutive days in order to enjoy the maximum number of pieces set forth in the preceding paragraph.

b) Gaspar (Atractosteus tropicus) in the lagoons of the Caño Negro Wildlife Refuge and the Las Camelias Wildlife Refuge, between September 1st and February 28th of each year.

Each person may fish a limit of up to 2 fish per day, with a minimum size of 60 cm in length, for a maximum total of 6 pieces.

Anyone fishing for this species must demonstrate to the competent authority a presence in the area of at least three consecutive days in order to distribute the maximum number of pieces indicated in the preceding paragraph.

c) For the Barra del Colorado Wildlife Refuge, the fishing activity shall be regulated according to the provisions of the Management Plan, an instrument established in Article 2, subsection 28, of the Regulations to the Wildlife Conservation Law, Executive Decree No. 32633.

In Wildlife Refuges and National Parks, outside the dates indicated in subsections a and b of this article, subsistence fishing may be carried out when so contemplated by the Management Plan of the protected wilderness area (Article 2, subsection 28, Regulations to the Wildlife Conservation Law, Executive Decree No. 32633) and after prior compliance with the provisions of Article 82 of the Wildlife Conservation Law. Furthermore, the interested party must be registered with the administration of the Protected Wilderness Area as a resident of the surrounding settlements.

Article 25.—Sport fishing is prohibited in Laguna de Hule, located in the Bosque Alegre Mixed Wildlife Refuge, Cariblanco.

Article 26.—In accordance with the provisions of Articles 12, 17, 63, and 65 of the Wildlife Conservation Law No. 7317, the administrative offices of the protected wilderness areas and others established for this purpose shall be responsible for authorizing, issuing, and signing or denying fishing licenses, as well as subsistence licenses, within the protected wilderness areas, when so stipulated by the management plan.

Article 27.—The SINAC, through the administrative offices of the protected wilderness areas, may authorize the holding of sport fishing tournaments for organized groups, in accordance with Article 51 of the Regulations to the Wildlife Conservation Law, Executive Decree No. 32633, in protected wilderness areas when their management plan so permits.

On the keeping of wild animals in captivity

Article 35.—It shall take effect upon its publication in the Official Gazette La Gaceta and shall expire on April 30, 2016.
