LA PRESIDENTA DE LA
REPÚBLICA

Y EL MINISTRO DE
JUSTICIA Y PAZ

Con fundamento en lo dispuesto en los artículos 140,
inciso 18) y 146 de la Constitución Política, en el artículo 32 de la Ley de
Asociaciones y en los artículos 27 y siguientes de su Reglamento.

Considerando:

I.-Que el artículo 32 de la Ley de Asociaciones N° 218
del ocho de agosto de mil novecientos treinta y nueve y sus reformas, confiere
al Poder Ejecutivo la potestad de declarar de Utilidad Pública a las
Asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades
sean particularmente útiles para los intereses del Estado, y que por ello
contribuyan a solventar una necesidad social.

II.-Que la Asociación
Acueducto de Ojo de Agua de Sictaya, cédula de Persona Jurídica número
3-002-203775, se inscribió en el Registro de Asociaciones del Registro Público
desde el día diez de junio de mil novecientos noventa y siete, bajo el tomo N°
438, asiento 14093.

III.-Que los fines
que persigue la Asociación, según su acta constitutiva son los que se
transcriben: ".Artículo tercero "los fines de la Asociación son
los siguientes: a) Construir un acueducto en Ojo de Agua, Sictaya, Turrialba.
b) Administrar, operar y conservar en buenas condiciones el acueducto, de
acuerdo con las disposiciones y Reglamentos de AyA. c) Obtener la participación
efectiva de la comunidad, en la construcción y mantenimiento del acueducto. d)
Colaboración en los programas y campañas de índole educativas que se emprendan.
e) Ayudar a explicar y divulgar en la comunidad las disposiciones y reglamentos
de AyA. f) Cooperar en los planes, proyectos y obras que emprenda AyA en la
comunidad. g) Participar en la vigilancia y protección de las fuentes de
abastecimiento del acueducto, evitar las contaminaciones de las mismas y ayudar
a la protección de las cuencas hidrográficas de la región.".

IV.-Que tales fines
solventan una necesidad social de primer orden, por lo cual merecen el apoyo
del Estado Costarricense. Por tanto,

Decretan:

Artículo 1º-Declárese de Utilidad Pública para los
intereses del Estado la Asociación Acueducto de Ojo de Agua de Sictaya, cédula
de Persona Jurídica número 3-002-203775.

Artículo 2º-Es deber
de la Asociación
rendir anualmente un informe ante el Ministerio de Justicia y Paz, de
conformidad con lo indicado en el artículo 32 del Reglamento a la Ley de Asociaciones.

Artículo 3º-Una vez
publicado este Decreto los interesados deberán protocolizar y presentar el
respectivo testimonio ante el Registro de Asociaciones del Registro Nacional,
para su respectiva inscripción.

Artículo 4º-Rige a
partir de su publicación.

José, a las diez horas del cinco de mayo del dos mil once.

THE PRESIDENT OF THE
REPUBLIC

AND THE MINISTER OF
JUSTICE AND PEACE

Based on the provisions of Articles 140,
subsection 18) and 146 of the Political Constitution, Article 32 of the Law of
Associations (Ley de Asociaciones), and Articles 27 and following of its Regulations (Reglamento).

Considering:

I.-That Article 32 of the Law of Associations (Ley de Asociaciones) N° 218
of August eighth, nineteen hundred thirty-nine and its amendments, grants
the Executive Branch the power to declare of Public Utility (Utilidad Pública) simple, federated, or confederated Associations,
whose development and activities are particularly useful for the interests of the State, and which thereby
contribute to solving a social need.

II.-That the Association
Acueducto de Ojo de Agua de Sictaya, legal entity identification number
3-002-203775, was registered in the Registry of Associations (Registro de Asociaciones) of the Public Registry (Registro Público)
as of June tenth, nineteen hundred ninety-seven, under Volume N°
438, entry 14093.

III.-That the purposes
pursued by the Association, according to its articles of incorporation (acta constitutiva), are transcribed as follows: ".Third article: "the purposes of the Association are
the following: a) To build an aqueduct in Ojo de Agua, Sictaya, Turrialba.
b) To manage, operate, and maintain the aqueduct in good condition, in
accordance with the provisions and Regulations of AyA. c) To obtain the effective
participation of the community in the construction and maintenance of the aqueduct. d)
Collaboration in educational programs and campaigns that are undertaken.
e) To help explain and disseminate in the community the provisions and regulations
of AyA. f) To cooperate in the plans, projects, and works undertaken by AyA in the
community. g) To participate in the surveillance and protection of the aqueduct's supply
sources, to prevent their contamination, and to help
with the protection of the region's hydrographic basins.".

IV.-That such purposes
address a social need of the highest order, for which reason they deserve the support
of the Costa Rican State. Therefore,

They decree:

Article 1º-The Association Acueducto de Ojo de Agua de Sictaya, legal
entity identification number 3-002-203775, is hereby declared of Public Utility (Utilidad Pública) for the
interests of the State.

Article 2º-It is the duty
of the Association
to annually render a report to the Ministry of Justice and Peace, in
accordance with the provisions of Article 32 of the Regulation to the Law of Associations (Reglamento a la Ley de Asociaciones).

Article 3º-Once
this Decree is published, the interested parties must formalize in a public deed (protocolizar) and submit the
respective certified copy (testimonio) to the Registry of Associations (Registro de Asociaciones) of the National Registry,
for its respective registration.

Article 4º-It becomes effective
upon its publication.
