LA PRESIDENTA DE LA
REPÚBLICA

Y EL MINISTRO DE
AMBIENTE, ENERGÍA

Y TELECOMUNICACIONES

En uso de las facultades que les confieren los
artículos 140, incisos 3) y 18), y 146 de
la Constitución Política,
y la Ley de
Biodiversidad Nº 7788 del 30 de abril de 1998.

Considerando:

I.-Que la
 Ley de Biodiversidad Nº 7788 del 30 de abril de 1998, creó
la Comisión Nacional
para la Gestión
de la Biodiversidad
como un órgano desconcentrado del Ministerio de Ambiente, Energía y
Telecomunicaciones, con personería jurídica instrumental.

II.-Que la citada Ley
le asigna a esa Comisión, funciones referentes a la conservación, el uso
ecológicamente sostenible y la restauración de la biodiversidad, que son de
vital importancia para el desarrollo sostenible del país.

III.-Que el artículo
15 de la Ley de
Biodiversidad, establece la forma en que se integrará
la Comisión, de acuerdo al
nombramiento realizado por los entes y organizaciones que señala la ley.

IV.-Que el Decreto
Ejecutivo N° 29680-MINAE del 23 de julio del 2001, publicado en
La Gaceta N° 150 del
7 de agosto del 2001, regula el funcionamiento de esta Comisión. Por tanto,

Decretan:

Artículo 1º-Nombrar como parte de los miembros que
integran la Comisión
 Nacional para la
 Gestión de
la Biodiversidad, a los siguientes miembros:

1. Miembro propietario:

a. (Derogado
por el artículo 3° del decreto ejecutivo N° 38793 del 1° de octubre del 2014,
"Nombra miembro de la Comisión Nacional para la Gestión de la Biodiversidad")

2. Miembros suplentes:

a. (Derogado por el artículo 3°
del decreto ejecutivo N° 38729 del 10 de setiembre de 2014, "Nombra
miembros de la Comisión Nacional para la Gestión de la Biodiversidad")

b. (Derogado
por el artículo 3° del decreto ejecutivo N° 38793 del 1° de octubre del 2014
"Nombra miembro de la Comisión Nacional para la Gestión de la Biodiversidad")

Artículo 2º-Para los efectos del plazo contemplado en
el artículo 15 de la Ley
de Biodiversidad, los nombramientos se realizan por un plazo completo de tres
años.

Artículo 3º-Se
derogan:

1. El Decreto Ejecutivo Nº
35125-MINAET del 3 marzo del 2009, publicado La Gaceta Nº 66 del 3 de
abril del 2009.

2. El Decreto Ejecutivo Nº
35577-MINAET del 1º octubre del 2009, publicado La Gaceta Nº 223 del 17
de noviembre del 2009.

Artículo 4º-Rige a partir de su publicación.

                        Appoints a member of the National Commission for Biodiversity Management

THE PRESIDENT OF THE
REPUBLIC

AND THE MINISTER OF
ENVIRONMENT, ENERGY

AND TELECOMMUNICATIONS

Exercising the powers conferred by
articles 140, subsections 3) and 18), and 146 of
the Political Constitution,
and the Biodiversity
Law Nº 7788 of April 30, 1998.

Considering:

I.—That the
 Biodiversity Law Nº 7788 of April 30, 1998, created
the National Commission
for Biodiversity
Management
as a deconcentrated body of the Ministry of Environment, Energy and
Telecommunications, with instrumental legal personality.

II.—That the aforementioned Law
assigns to this Commission functions relating to the conservation, ecologically
sustainable use, and restoration of biodiversity, which are of
vital importance for the sustainable development of the country.

III.—That article
15 of the Biodiversity
Law establishes the manner in which
the Commission shall be composed, according to the
appointments made by the entities and organizations indicated by law.

IV.—That Executive
Decree N° 29680-MINAE of July 23, 2001, published in
La Gaceta N° 150 of
August 7, 2001, regulates the operation of this Commission. Therefore,

They decree:

Article 1—To appoint as part of the members that
compose the
 National Commission for
 Biodiversity
Management, the following members:

1. Proprietary member:

a. (Repealed
by article 3 of executive decree N° 38793 of October 1, 2014,
"Appoints a member of the National Commission for Biodiversity Management")

2. Alternate members:

a. (Repealed by article 3
of executive decree N° 38729 of September 10, 2014, "Appoints
members of the National Commission for Biodiversity Management")

b. (Repealed
by article 3 of executive decree N° 38793 of October 1, 2014
"Appoints a member of the National Commission for Biodiversity Management")

Article 2—For the purposes of the term established in
article 15 of the Biodiversity
Law, the appointments are made for a full term of three
years.

Article 3—The following
are repealed:

1. Executive Decree Nº
35125-MINAET of March 3, 2009, published La Gaceta Nº 66 of April 3,
2009.

2. Executive Decree Nº
35577-MINAET of October 1, 2009, published La Gaceta Nº 223 of November
17, 2009.

Article 4—It shall enter into force upon its publication.
