    SISTEMA NACIONAL DE
ÁREAS DE CONSERVACIÓN 

R-SINAC-CONAC-028-2011.-El Consejo Nacional de Áreas
de Conservación, de conformidad al Acuerdo Nº 12 de la sesión ordinaria Nº
05-2011 del 30 de mayo del 2011, acordó aprobar las modificaciones a la
resolución R-SINAC-CONAC-013-2009 publicada en el Diario Oficial La Gaceta Nº 72 del
15 de abril del 2009, y en cumplimiento del artículo 12, inciso del Reglamento
a la Ley de
Biodiversidad Nº 7788, Decreto Ejecutivo Nº 34433-MINAE, aprueba y emite la
presente resolución:

    Considerando:

I.-Que el Proyecto "Programa Consolidación del
Corredor Biológico Mesoamericano" a su término, ha desarrollado y consolidado
un Plan Estratégico y de implementación por parte de los Gobiernos, para la
consolidación a largo plazo del Corredor Biológico Mesoamericano, tanto a nivel
regional como de cada uno de los países de la región. Éste a su vez, sugirió a
cada Ministerio de Ambiente, la elaboración de una propuesta de Programa
Nacional de Corredor Biológico.

II.-Que mediante
Decreto Ejecutivo Nº 33106-MINAE, publicado en La Gaceta Nº 103,
del día 30 de mayo de 2006 se crea el Programa Nacional de Corredores
Biológicos: una Estrategia de Conservación de la Biodiversidad; el
cual contará con un Plan Estratégico de largo plazo. Se implementará a través
del Sistema Nacional de Áreas de Conservación (SINAC), el cual deberá otorgar
sostenibilidad al Programa, incluyendo las actuaciones de éste en sus planes de
acción y en su estructura funcional, administrativa y financiera.

III.-Que mediante Decreto
Ejecutivo Nº 34433-MINAE, publicado en La Gaceta Nº 68,
del día 8 de abril del 2008, se establece en el artículo 3º, inciso b), la
definición de corredor biológico de manera oficial por primera vez para Costa
Rica.

IV.-Que el artículo
22 de la Ley de
Biodiversidad Nº 7788, publicada en La Gaceta Nº 101,
del 27 de mayo de 1998 establece al Sistema Nacional de Áreas de Conservación,
como una institución desconcentrada y participativa, con personería jurídica
instrumental, que integra las competencias en materia forestal, vida silvestre
y áreas silvestres protegidas, protección y conservación del uso de cuencas
hidrográficas y sistemas hídricos, del Ministerio de Ambiente, Energía y
Telecomunicaciones (MINAET), con el fin de dictar políticas, planificar y
ejecutar procesos dirigidos a lograr la sostenibilidad en el manejo de los
recursos naturales de Costa Rica.

V.-Que el Consejo Nacional de Áreas de Conservación (CONAC), mediante acuerdo Nº 9 de la sesión
ordinaria Nº 002-2009 celebrada el día 23 de febrero de 2009 aprobó la Resolución R-SINAC-
CONAC-013-2009 de Lineamientos para la oficialización de Corredores Biológicos en Costa Rica, misma
que se publicó en el Diario Oficial La Gaceta Nº 72, del 15 de abril de 2009.

VI.-Que debido a que
los procesos de gestión local en los corredores biológicos usualmente se
encuentran limitados por la efectiva participación de los representantes de las
organizaciones locales y que la Administración debe
velar por la representatividad de los diferentes sectores de la sociedad dentro
de los Consejos Locales de Corredores Biológicos; es entonces, que en
observancia a los principios de oportunidad y conveniencia se hace necesario
establecer un nuevo plazo para que las Comisiones Locales de Corredor Biológico
que se encuentran activas a la fecha logren ajustarse a la figura de Consejos
Locales.

VII.-Que con el fin
de contar con los últimos avances tecnológicos el Sistema Nacional de Áreas de
Conservación ha mejorado su sistema de servidores y equipos de conectividad en
línea, por lo cual, las direcciones electrónicas utilizadas para obtener la
documentación correspondiente a la oficialización de corredores biológicos en
Costa Rica deben variarse y ser publicadas.

VIII.-Que de
conformidad al artículo 12, inciso q) del Reglamento a la Ley de Biodiversidad,
Decreto Ejecutivo Nº 34433-MINAE publicado en La Gaceta Nº 68 del
8 de abril de 2008, el Consejo Nacional de Áreas de Conservación (CONAC),
mediante acuerdo Nº 12 de la sesión ordinaria Nº 005-2011 celebrada el día 30
de mayo de 2011 aprobó la presente resolución, así como la delegación de su
firma para su ejecución en el Secretario Ejecutivo, quien de conformidad al
artículo 19 del reglamento indicado ostenta la representación legal del SINAC. Por
tanto,

 Oficialización de Corredores Biológicos en Costa Rica,

de 2009, mediante la
 Resolución R-SINAC-CONAC-013-2009.

2º-Modifíquese el artículo 2º, en el punto 1, el inciso a., que en adelante se
leerá así:

            a. Para presentar este requisito se debe aplicar el formulario oficial de Perfil Técnico

Artículo 6º-Plazo para los Consejos Locales de

Amendments to the Guidelines for the Official Recognition of Biological Corridors in Costa Rica

NATIONAL SYSTEM OF CONSERVATION AREAS

R-SINAC-CONAC-028-2011.-The National Council of Conservation Areas, in accordance with Agreement No. 12 of regular session No. 05-2011 of May 30, 2011, agreed to approve the modifications to resolution R-SINAC-CONAC-013-2009 published in Official Gazette La Gaceta No. 72 of April 15, 2009, and in compliance with article 12, subsection q) of the Regulations to the Biodiversity Law No. 7788, Executive Decree No. 34433-MINAE, approves and issues this resolution:

Considering:

I.-That the Project "Program for the Consolidation of the Mesoamerican Biological Corridor" at its conclusion, has developed and consolidated a Strategic and Implementation Plan by the Governments, for the long-term consolidation of the Mesoamerican Biological Corridor, both at the regional level and for each of the countries of the region. This in turn, suggested to each Ministry of Environment, the preparation of a proposal for a National Biological Corridor Program.

II.-That through Executive Decree No. 33106-MINAE, published in La Gaceta No. 103, on May 30, 2006, the National Program of Biological Corridors: a Biodiversity Conservation Strategy is created; which will have a long-term Strategic Plan. It will be implemented through the National System of Conservation Areas (SINAC), which must grant sustainability to the Program, including its actions in its action plans and in its functional, administrative, and financial structure.

III.-That through Executive Decree No. 34433-MINAE, published in La Gaceta No. 68, on April 8, 2008, the definition of biological corridor is officially established for the first time for Costa Rica in article 3, subsection b).

IV.-That article 22 of the Biodiversity Law No. 7788, published in La Gaceta No. 101, on May 27, 1998, establishes the National System of Conservation Areas as a deconcentrated and participatory institution, with instrumental legal personality, which integrates the competencies in matters of forestry, wildlife and protected wilderness areas, protection and conservation of the use of watersheds and water systems, of the Ministry of Environment, Energy and Telecommunications (MINAET), in order to dictate policies, plan and execute processes aimed at achieving sustainability in the management of the natural resources of Costa Rica.

V.-That the National Council of Conservation Areas (CONAC), through agreement No. 9 of regular session No. 002-2009 held on February 23, 2009, approved Resolution R-SINAC-CONAC-013-2009 of Guidelines for the official recognition of Biological Corridors in Costa Rica, which was published in Official Gazette La Gaceta No. 72, on April 15, 2009.

VI.-That because local management processes in biological corridors are usually limited by the effective participation of representatives of local organizations and that the Administration must ensure the representativeness of the different sectors of society within the Local Councils of Biological Corridors; it is then, in observance of the principles of opportunity and convenience, necessary to establish a new deadline for the Local Commissions of Biological Corridors that are active as of the date of this resolution to adjust to the figure of Local Councils.

VII.-That in order to have the latest technological advances, the National System of Conservation Areas has improved its system of servers and online connectivity equipment, therefore, the electronic addresses used to obtain the documentation corresponding to the official recognition of biological corridors in Costa Rica must be changed and published.

VIII.-That in accordance with article 12, subsection q) of the Regulations to the Biodiversity Law, Executive Decree No. 34433-MINAE published in La Gaceta No. 68 of April 8, 2008, the National Council of Conservation Areas (CONAC), through agreement No. 12 of regular session No. 005-2011 held on May 30, 2011, approved this resolution, as well as the delegation of its signature for its execution to the Executive Secretary, who in accordance with article 19 of the indicated regulation holds the legal representation of SINAC. Therefore,

THE NATIONAL COUNCIL OF CONSERVATION AREAS

AGREES:

Article 1.-To modify articles 2 and 4 of the Guidelines for the Official Recognition of Biological Corridors in Costa Rica, published in Official Gazette La Gaceta No. 72, on April 15, 2009, through Resolution R-SINAC-CONAC-013-2009.

Article 2.-Modify article 2, in point 1, subsection a., which shall henceforth read as follows:

1. Technical Profile of the Biological Corridor:

a. To submit this requirement, the official Technical Profile of the Biological Corridor form must be used (which can be downloaded from the following electronic address: http://www.sinac.go.cr/corredoresbiologics/documentacion/PerfilTecnicoCB.pdf). Said form must be submitted to the PNCB Coordination in printed original and in an electronic digital file. The information in an electronic digital file will be included in the database of biological corridors of Costa Rica;

Article 3.-Modify article 2, in point 2, subsection b., which shall henceforth read as follows:

2. Map of the Boundaries of the Biological Corridor:

Article 6.-Deadline for Local Biological Corridor Councils. The deadline of December 31, 2011, is established for the Local Biological Corridor Commissions active at the time of publication of this resolution to manage their adjustment to the figure of Local Biological Corridor Councils, through the Regional Councils of Conservation Areas.

Article 7.-Effective upon publication.
