LA PRESIDENTA DE

Y TELECOMUNICACIONES

En uso de las facultades que les confieren los incisos 3) y 18) del
artículo 140 y 146 de
la Constitución Política,
la Ley Forestal y sus reformas,
Nº 7575, del 13 de febrero de 1996 y el artículo 27 de
la Ley General de
la Administración
 Pública, Nº 6227, de 2 de mayo de 1978, y

Considerando:

I.-Que el artículo 1º de la
 Ley Forestal Nº 7575, establece como función esencial y
prioritaria del Estado, velar por la conservación, protección y administración
de los bosques naturales y por la producción, aprovechamiento,
industrialización y fomento de los recursos forestales del país.

II.-Que en los últimos 10 años, cuando la lucha
contra el cambio climático ha llegado a ocupar el primer plano de la agenda
mundial, no es posible buscar soluciones sin tener en cuenta los ecosistemas
forestales, los cuales contribuyen directa e indirectamente al desarrollo
sostenible y al cumplimiento de los Objetivos de Desarrollo del Milenio, pues
proporcionan empleo e ingresos, constituyen una fuente de biodiversidad,
almacenan el agua y estabilizan el suelo.

III.-Que en el caso de Costa Rica, donde los
bosques, plantaciones forestales, sistemas agroforestales y terrenos de aptitud
forestal, abarcan la mayor parte del territorio, es necesario contar con un
marco de política sólido e innovador que reconozca su valor e importancia para
la sociedad.

IV.-Que el Plan Nacional de Desarrollo Forestal
2011-2020, visibiliza las relaciones y conexiones que tiene el Sector Forestal
con otras agendas de desarrollo igualmente importantes, como lo son la
producción de energía limpia, la provisión de agua para consumo humano y
agropecuario, el turismo y otros usos del suelo que mantienen vínculos
inseparables con las actividades forestales.

V.-Que el Ministerio de Ambiente, Energía y
Telecomunicaciones, presenta oficialmente el Plan Nacional de Desarrollo
Forestal 2011 - 2020, el cual es producto de un proceso de diálogo intra e intersectorial,
que establece acuerdos, coordinaciones y compromisos concretos para poder
materializar metas planteadas para los próximos diez años.

VI.-Que las presentes metas están basadas en una
visión y en objetivos estratégicos que procuran la permanencia y el aumento de
bosques y plantaciones forestales y, en consecuencia, la producción futura de
sus bienes y servicios ecosistémicos. Por tanto,

Decretan:

MODIFICACIÓN DEL ARTÍCULO 1º DEL DECRETO

EJECUTIVO 33826-MINAE DEL 15 DE FEBRERO

DE 2007 Y OFICIALIZACIÓN
DEL PLAN NACIONAL DE

DESARROLLO FORESTAL 2011-2020 (PNDF)

Artículo 1º-Modifíquese el artículo 1º del Decreto Ejecutivo Nº
33826-MINAE, del 15 de febrero de 2007, para que en adelante se lea de la
siguiente manera:

"Artículo 1º-Téngase al
Plan Nacional de Desarrollo Forestal 2011 - 2020, denominado en adelante PNDF,
y sus planes futuros, como instrumento oficial de planificación para uso,
manejo y protección de los recursos forestales del país, en el cual se
establecen las directrices y lineamientos a desarrollar en el territorio
nacional."

Artículo 2º-En todo lo demás se mantiene intacto el mencionado Decreto
Ejecutivo.

Artículo 3°-Rige a partir de su publicación en el
Diario Oficial La Gaceta.

THE PRESIDENT OF
THE REPUBLIC

AND THE MINISTER OF ENVIRONMENT, ENERGY

AND TELECOMMUNICATIONS

Exercising the powers conferred by subsections 3) and 18) of
Article 140 and Article 146 of
the Political Constitution,
the Ley Forestal and its amendments,
No. 7575, of February 13, 1996, and Article 27 of
the Ley General de
la Administración
 Pública, No. 6227, of May 2, 1978, and

Considering:

I.-That Article 1 of
 Ley Forestal No. 7575 establishes that an essential and priority function of the State is to ensure the conservation, protection, and management
of natural forests and the production, use,
industrialization, and promotion of the country's forest resources.

II.-That in the past 10 years, when the fight
against climate change has come to occupy the forefront of the global
agenda, it is impossible to seek solutions without considering forest
ecosystems, which contribute directly and indirectly to sustainable development and the achievement of the Millennium Development Goals, since
they provide employment and income, constitute a source of biodiversity,
store water, and stabilize the soil.

III.-That in the case of Costa Rica, where
forests, forest plantations, agroforestry systems, and forest suitability lands encompass most of the territory, it is necessary to have a solid and innovative policy framework that recognizes their value and importance to
society.

IV.-That the 2011-2020 Plan Nacional de Desarrollo Forestal makes visible the relationships and connections the Forest Sector has with other equally important development agendas, such as clean energy production, water provision for human and agricultural consumption, tourism, and other land uses that maintain inseparable links with forest activities.

V.-That the Ministry of Environment, Energy, and Telecommunications officially presents the 2011 - 2020 Plan Nacional de Desarrollo Forestal, which is the product of an intra- and intersectoral dialogue process that establishes agreements, coordinations, and concrete commitments to materialize goals set for the next ten years.

VI.-That the present goals are based on a vision and strategic objectives that seek the permanence and increase of forests and forest plantations and, consequently, the future production of their ecosystem goods and services. Therefore,

They Decree:

AMENDMENT OF ARTICLE 1 OF DECRETO
EJECUTIVO 33826-MINAE OF FEBRUARY 15,
2007, AND OFFICIALIZATION
OF THE PLAN NACIONAL DE
DESARROLLO FORESTAL 2011-2020 (PNDF)

Article 1.-Amend Article 1 of Decreto Ejecutivo No.
33826-MINAE, of February 15, 2007, so that henceforth it reads as
follows:

"Article 1.-The
Plan Nacional de Desarrollo Forestal 2011 - 2020, hereinafter referred to as the PNDF,
and its future plans, shall be considered the official planning instrument for the use,
management, and protection of the country's forest resources, in which
the directives and guidelines to be developed in the national
territory are established."

Article 2.-In all other respects, the aforementioned Decreto Ejecutivo remains intact.

Article 3.-It becomes effective upon its publication in the
Diario Oficial La Gaceta.
