Con fundamento en las atribuciones que les confieren los artículos 140
incisos 3) y 18) y 146 de la Constitución Política; los artículos 25 inciso 1),
27 inciso 1) y 28 inciso 2) acápite b) de la Ley No. 6227, Ley General de la
Administración Pública de 2 de mayo de 1978 y sus reformas; la Ley No. 8131,
Ley de la Administración Financiera de la República y Presupuestos Públicos de
18 de setiembre de 2001 y sus reformas; su Reglamento, el Decreto Ejecutivo No.
32988-H-MP-PLAN de 31 de enero de 2006 y sus reformas; la Ley No. 7593, Ley de
la Autoridad Reguladora de los Servicios Públicos de 9 de agosto de 1996 y sus reformas;
el Decreto Ejecutivo No. 26635 de 18 de diciembre de 1997; el Decreto Ejecutivo
No. 32452-H de 29 de junio de 2005 y sus reformas; y el Decreto Ejecutivo No.
36488-H de 8 de marzo de 2011 y sus reformas.

Considerando:

1. Que el Transitorio V de la Ley No. 7593, publicada en La Gaceta No.
169 de 5 de setiembre de 1996 y sus reformas, traslada el Departamento de Aguas
del Servicio Nacional de Electricidad, incluyendo su personal, activos y
funciones, al Ministerio del Ambiente y Energía. Disponiendo que el traslado se
haría efectivo dentro del plazo máximo de un año después de entrar en vigencia
esa ley, con el propósito de facilitar los ajustes presupuestarios y de otra
naturaleza que sean pertinentes.

2. Que el artículo 1° del Decreto Ejecutivo No. 26635, publicado en La
Gaceta No. 22 de 2 de febrero de 1998, trasladó con base en el Transitorio
V a la citada Ley No. 7593, el Departamento de Aguas al Instituto Meteorológico
Nacional del Ministerio del Ambiente y Energía. Definiendo en el artículo 2°
que su misión será la de administrar oportuna y eficientemente los recursos hídricos
en todo el territorio nacional, procurando el desarrollo sostenible mediante su
ordenamiento y manejo racional; brindando un servicio excelente.

3. Que mediante el oficio 238-2012 IMN de 12 de junio de 2012, el Director
General del Instituto Meteorológico Nacional, solicita ampliar el gasto
presupuestario máximo autorizado en el 2012 en ¢2.532.811.781,21 (dos mil
quinientos treinta y dos millones ochocientos once mil setecientos ochenta y un
colones con veintiún céntimos), para la Dirección de Aguas.

4. Que del monto anterior, de conformidad con lo establecido en el artículo 2o. quinquies del
Decreto Ejecutivo No. 36488-H, publicado en el Alcance No. 18 a La Gaceta No. 58 de 23 de marzo de
2011 y sus reformas, corresponde ampliar vía Decreto Ejecutivo la suma de ¢1.339.353.125,10 (mil
trescientos treinta y nueve millones trescientos cincuenta y tres mil ciento veinticinco colones con
diez céntimos), con recursos de superávit libre para la compra de mobiliario y equipo, vehículos y
el desarrollo de inversiones estratégicas y sustantivas.

5. Que del monto anterior no se autorizó la suma ¢326.662.695,00
(trescientos veintiséis millones seiscientos sesenta y dos mil seiscientos
noventa y cinco colones exactos), distribuida así: ¢251.062.695,00 (doscientos
cincuenta y un millones sesenta y dos mil seiscientos noventa y cinco colones
exactos) por que no se pudo determinar una relación directa con la actividad
sustantiva de la dependencia y ¢75.600.000,00 (setenta y cinco millones
seiscientos mil colones exactos) para transferir a la Comisión para el Manejo
de la Cuenca Alta del Río Reventazón (COMCURE), por encontrarse excluida del
gasto presupuestario máximo, según lo establecido en el artículo 3º de las
Directrices vigentes, Decreto No. 36488-H citado.

6. Que de conformidad con lo indicado en el considerando anterior,
corresponde ampliar vía Decreto Ejecutivo, la suma de ¢1.012.690.430,10 (mil
doce millones seiscientos noventa mil cuatrocientos treinta colones con diez
céntimos), con recursos del superávit libre, para la compra de estaciones
meteorológicas, que permitan obtener datos para conocer la disponibilidad de
agua tanto a nivel superficial como subterráneo, con el objetivo de mejorar la
cobertura, conocimiento y disponibilidad de agua en las cuencas sin
información; compra de licencias para la utilización del Sistema de Información
Geográfica (SIG) y scanner (para la digitación de expedientes); adquisición de
vehículos rurales para realizar las visitas de campo y atención de denuncias in
situ; conceptos que están directamente relacionados con la operación del
sistema operativo sobre permisos y concesiones; asimismo, para el desarrollo de
los proyectos denominados "Sistema Nacional de Monitoreo de Agua Subterránea en
tiempo real", que tiene como propósito obtener certeza científica de la
disponibilidad y comportamiento de las aguas y particularmente de los sistemas
de acuífero y el "Sistema Nacional de Gestión Integral de la Información del
Recurso Hídrico" que integre el registro en calidad de cuerpos de agua y
vertidos.

7. Que mediante el Decreto Ejecutivo No. 36488-H citado, se emitieron las
Directrices Generales de Política Presupuestaria para el año 2012,
estableciéndose en el artículo 2°, el porcentaje máximo en que podría
incrementarse el gasto presupuestario de las entidades públicas, ministerios y
demás órganos, con respecto al del año precedente. En correspondencia con dicha
disposición, el monto de gasto presupuestario máximo resultante para la
Dirección de Aguas, fue establecido en la suma de ¢1.156.810.000,00 (mil ciento
cincuenta y seis millones ochocientos diez mil colones exactos), el cual fue comunicado
mediante el oficio STAP-1515-2012 del 22 de agosto de 2012, cifra que no contempla
el gasto indicado previamente en este decreto.

8. Que mediante el Decreto Ejecutivo No. 32452-H, publicado en La Gaceta
No. 130 de 6 de julio de 2005 y sus reformas, se emite el "Lineamiento para
la aplicación del artículo 6 de la Ley No. 8131 de la Administración Financiera
de la República y Presupuestos Públicos y la regulación de la clase de ingresos
del Sector Público denominada Financiamiento".

9. Que el artículo 7° del Decreto citado en el considerando anterior,
dispone que los recursos de financiamiento que provienen de vigencias
anteriores -superávit libre- son parte del patrimonio de los órganos y las
entidades y pueden utilizarlos en períodos subsiguientes para financiar gastos
que se refieran a la actividad ordinaria de éstas, con los cuales se atienda el
interés de la colectividad, el servicio público y los fines institucionales
siempre que no tengan el carácter permanente o generen una obligación que
requiera financiarse a través del tiempo, como la creación de plazas para
cargos fijos, o cualquier otro compromiso de la misma naturaleza.

10. Que por lo anterior, resulta necesario modificar el gasto
presupuestario máximo fijado a la Dirección de Aguas para el año 2012,
incrementándolo en la suma de ¢1.012.690.430,10 (mil doce millones seiscientos
noventa mil cuatrocientos treinta colones con diez céntimos).

Por tanto;

 

Decretan:

 

Artículo 1°.- Amplíese para la Dirección de Aguas, el gasto presupuestario
máximo para el 2012, establecido de conformidad con el Decreto Ejecutivo No.
36488-H, publicado en el Alcance No. 18 a La Gaceta No. 58 de 23 de marzo de
2011 y sus reformas, en la suma de ¢1.012.690.430,10 (mil doce millones
seiscientos noventa mil cuatrocientos treinta colones con diez céntimos), para
ese período.

Artículo 2º.- Es responsabilidad de la administración activa de la
Dirección de Aguas, el cumplimiento de lo dispuesto en el artículo 6 de la Ley
No. 8131, Ley de la Administración Financiera de la República y Presupuestos
Públicos, publicada en La Gaceta No. 198 de 16 de octubre de 2001 y sus
reformas, así como en el Decreto Ejecutivo No. 32452-H, publicado en La
Gaceta No. 130 de 6 de julio de 2005 y sus reformas.

Artículo 3º.- Rige a partir de su publicación.

THE PRESIDENT OF THE REPUBLIC

AND THE MINISTER OF FINANCE

Based on the powers conferred by Articles 140, subsections 3) and 18), and 146 of the Political Constitution; Articles 25, subsection 1), 27, subsection 1), and 28, subsection 2), subparagraph b) of Law No. 6227, General Law of Public Administration of May 2, 1978, and its amendments; Law No. 8131, Law of Financial Administration of the Republic and Public Budgets of September 18, 2001, and its amendments; its Regulation, Executive Decree No. 32988-H-MP-PLAN of January 31, 2006, and its amendments; Law No. 7593, Law of the Regulatory Authority for Public Services of August 9, 1996, and its amendments; Executive Decree No. 26635 of December 18, 1997; Executive Decree No. 32452-H of June 29, 2005, and its amendments; and Executive Decree No. 36488-H of March 8, 2011, and its amendments.

Considering:

1. That Transitory Provision V of Law No. 7593, published in La Gaceta No. 169 of September 5, 1996, and its amendments, transfers the Water Department of the National Electricity Service, including its personnel, assets, and functions, to the Ministry of Environment and Energy. Providing that the transfer would become effective within a maximum period of one year after said law enters into force, with the purpose of facilitating the pertinent budgetary and other adjustments.

2. That Article 1 of Executive Decree No. 26635, published in La Gaceta No. 22 of February 2, 1998, based on Transitory Provision V of the cited Law No. 7593, transferred the Water Department to the National Meteorological Institute of the Ministry of Environment and Energy. Defining in Article 2 that its mission shall be to administer water resources in a timely and efficient manner throughout the national territory, promoting sustainable development through their management and rational use; providing excellent service.

3. That by official communication 238-2012 IMN of June 12, 2012, the Director General of the National Meteorological Institute requests to increase the maximum budgetary expenditure authorized in 2012 by ¢2,532,811,781.21 (two thousand five hundred thirty-two million eight hundred eleven thousand seven hundred eighty-one colones and twenty-one céntimos), for the Water Directorate.

4. That from the above amount, in accordance with the provisions of Article 2 quinquies of Executive Decree No. 36488-H, published in Supplement No. 18 to La Gaceta No. 58 of March 23, 2011, and its amendments, it corresponds to increase via Executive Decree the sum of ¢1,339,353,125.10 (one thousand three hundred thirty-nine million three hundred fifty-three thousand one hundred twenty-five colones and ten céntimos), with free surplus resources for the purchase of furniture and equipment, vehicles, and the development of strategic and substantive investments.

5. That from the above amount, the sum of ¢326,662,695.00 (three hundred twenty-six million six hundred sixty-two thousand six hundred ninety-five colones exactly) was not authorized, distributed as follows: ¢251,062,695.00 (two hundred fifty-one million sixty-two thousand six hundred ninety-five colones exactly) because a direct relationship with the substantive activity of the unit could not be determined, and ¢75,600,000.00 (seventy-five million six hundred thousand colones exactly) to transfer to the Commission for the Management of the Upper Reventazón River Basin (COMCURE), because it is excluded from the maximum budgetary expenditure, as established in Article 3 of the current Guidelines, cited Decree No. 36488-H.

6. That in accordance with what is indicated in the preceding Considering clause, it corresponds to increase via Executive Decree the sum of ¢1,012,690,430.10 (one thousand twelve million six hundred ninety thousand four hundred thirty colones and ten céntimos), with free surplus resources, for the purchase of meteorological stations, which allow obtaining data to ascertain the availability of water at both the surface and underground levels, with the objective of improving coverage, knowledge, and availability of water in basins without information; purchase of licenses for the use of the Geographic Information System (GIS) and scanner (for digitizing files); acquisition of rural vehicles to carry out field visits and address complaints in situ; concepts that are directly related to the operation of the operating system for permits and concessions; likewise, for the development of projects called "National Real-Time Groundwater Monitoring System," whose purpose is to obtain scientific certainty about the availability and behavior of waters, particularly aquifer systems, and the "National Integrated Water Resource Information Management System" that integrates the registry of quality of water bodies and discharges.

7. That through the cited Executive Decree No. 36488-H, the General Budgetary Policy Guidelines for 2012 were issued, establishing in Article 2 the maximum percentage by which the budgetary expenditure of public entities, ministries, and other bodies could be increased with respect to that of the preceding year. In accordance with said provision, the resulting maximum budgetary expenditure amount for the Water Directorate was established at the sum of ¢1,156,810,000.00 (one thousand one hundred fifty-six million eight hundred ten thousand colones exactly), which was communicated via official communication STAP-1515-2012 of August 22, 2012, a figure that does not include the expenditure previously indicated in this decree.

8. That through Executive Decree No. 32452-H, published in La Gaceta No. 130 of July 6, 2005, and its amendments, the "Guideline for the application of Article 6 of Law No. 8131, Law of Financial Administration of the Republic and Public Budgets, and the regulation of the class of Public Sector revenues called Financing" is issued.

9. That Article 7 of the Decree cited in the preceding Considering clause provides that financing resources coming from prior years - free surplus - are part of the equity of the bodies and entities and may be used in subsequent periods to finance expenses that refer to their ordinary activity, with which the interest of the community, the public service, and institutional purposes are served, provided they are not permanent in nature or generate an obligation that requires financing over time, such as the creation of positions for fixed charges, or any other commitment of the same nature.

10. That because of the foregoing, it is necessary to modify the maximum budgetary expenditure set for the Water Directorate for the year 2012, increasing it by the sum of ¢1,012,690,430.10 (one thousand twelve million six hundred ninety thousand four hundred thirty colones and ten céntimos).

Therefore;

 

Decree:

Article 1.- The maximum budgetary expenditure for the Water Directorate for 2012, established in accordance with Executive Decree No. 36488-H, published in Supplement No. 18 to La Gaceta No. 58 of March 23, 2011, and its amendments, is hereby increased by the sum of ¢1,012,690,430.10 (one thousand twelve million six hundred ninety thousand four hundred thirty colones and ten céntimos), for that period.

Article 2.- It is the responsibility of the active administration of the Water Directorate to comply with the provisions of Article 6 of Law No. 8131, Law of Financial Administration of the Republic and Public Budgets, published in La Gaceta No. 198 of October 16, 2001, and its amendments, as well as Executive Decree No. 32452-H, published in La Gaceta No. 130 of July 6, 2005, and its amendments.

Article 3.- It shall be effective upon its publication.
