LA PRESIDENTA DE
LA REPÚBLICA

    Y EL MINISTRO DE AMBIENTE, ENERGÍA Y
TELECOMUNICACIONES

En uso de las facultades que les
confieren los artículos 140, incisos 3) y 18), y 146 de
la Constitución
 Política, y la
 Ley de Biodiversidad Nº 7788 del 30 de abril de 1998.

    CONSIDERANDO:

I.- Que
la Ley de Biodiversidad Nº 7788
del 30 de abril de 1998, creó
la Comisión Nacional para
la Gestión de
la Biodiversidad como
un órgano desconcentrado del Ministerio de Ambiente, Energía y
Telecomunicaciones, con personería jurídica instrumental.

II.- Que la citada Ley le asigna a
esa Comisión, funciones referentes a la conservación, el uso ecológicamente
sostenible y la restauración de la biodiversidad, que son de vital importancia
para el desarrollo sostenible del país.

III.- Que el artículo 15 de
la Ley de Biodiversidad,
establece la forma en que se integrará
la Comisión, de acuerdo al nombramiento realizado
por los entes y organizaciones que señala la ley.

IV.- Que el Decreto Ejecutivo
N°29680-MINAE del 23 de julio del 2001, publicado en
La Gaceta N° 150 del
7 de agosto del 2001, regula el funcionamiento de esta Comisión. 

        POR TANTO:

    DECRETAN:

Artículo 1º- Nombrar como parte de
los miembros que integran
la Comisión Nacional para
la Gestión de
la Biodiversidad, al
siguiente representante de
la Federación
 Costarricense para
la Conservación del Ambiente:

                       
1. Miembro propietario:

Eva María Carazo
Vargas.

Artículo 2º- Para los efectos del
plazo contemplado en el artículo 15 de
la Ley de Biodiversidad, el nombramiento se realiza
por un plazo completo de tres años.

Artículo 3º- Se deroga:

                       
1. El Decreto Ejecutivo Nº 34769-MINAET del 08 de setiembre
del 2008, publicado en La
 Gaceta Nº 203 del 21 de octubre del 2008.

Artículo 4º- Rige a partir de su
publicación.

Dado en
la Presidencia de
la República.- San José, a las once horas del
veintisiete de abril del dos mil doce.

                        Appoints member of the National Commission for Biodiversity Management

THE PRESIDENT OF
THE REPUBLIC

    AND THE MINISTER OF ENVIRONMENT, ENERGY AND
TELECOMMUNICATIONS

In exercise of the powers conferred upon them by articles 140, subsections 3) and 18), and 146 of the
Political Constitution, and
Biodiversity Law No. 7788 of April 30, 1998.

    CONSIDERING:

I.- That
Biodiversity Law No. 7788
of April 30, 1998, created
the National Commission for
Biodiversity Management as
a deconcentrated body of the Ministry of Environment, Energy and
Telecommunications, with instrumental legal personality.

II.- That the aforementioned Law assigns to
this Commission functions concerning the conservation, ecologically
sustainable use, and restoration of biodiversity, which are of vital importance
for the sustainable development of the country.

III.- That article 15 of
the Biodiversity Law
establishes the manner in which
the Commission shall be composed, according to the appointments made
by the entities and organizations indicated by law.

IV.- That Executive Decree
No. 29680-MINAE of July 23, 2001, published in
La Gaceta No. 150 of
August 7, 2001, regulates the functioning of this Commission.

        THEREFORE:

    THEY DECREE:

Article 1.- To appoint as part of
the members composing
the National Commission for
Biodiversity Management, the
following representative of
the Costa Rican Federation for
Environmental Conservation:

                       
1. Full member:

Eva María Carazo
Vargas.

Article 2.- For the purposes of the
term contemplated in article 15 of
the Biodiversity Law, the appointment is made
for a full term of three years.

Article 3.- The following is repealed:

                       
1. Executive Decree No. 34769-MINAET of September 8,
2008, published in La
Gaceta No. 203 of October 21, 2008.

Article 4.- This Decree shall enter into force upon its
publication.

the Republic.- San José, at eleven o'clock on the
twenty-seventh of April, two thousand twelve.
